There is no rational basis for the federal government trying to take over all of american elections. So what can democrats do even if manchin is the magical 50th vote . The scenes were watched across this country, looters taking advantage of new York City protests in the wake of the killing of George Floyd. We have an exclusive update on what happened to the people who were, in fact, arrested. That is coming up. We want to begin with the fight over Voting Rights and the republicanled effort to expand their power over the election process, the impact of new gop laws are already being seen in states like georgia where local election officials being removed by county officials. Members of at least ten County Election boards have been removed, had their position eliminated or are likely to be kicked off through local ordinances or new laws passed by the state legislature. At least five are people of color, and most are democrats. Though some republicans and they will most likely all be replaced by republicans. So in a moment, im going to be talking to democratic congresswoman Sheila Jackson Lee of texas. But first, i want to bring in my panel, adrienne elrod, former senior aide on the biden harris campaign, and congressman from florida. Thank you for joining us on this saturday. David, i find it fascinating. The new york times reporting the state of georgia you think back to the 2020 elections and what state were we focused on, what local election officials were we focused on, these names we had no idea of until, in fact, those elections that states elections hinged on them. And now this reporting from The New York Times. Your reaction . Yasmin, i would tie in what Mitch Mcconnell misrepresented just in his Press Conference Yesterday and say none of these bills are designed to suppress the vote. Every single one of those state legislative packages that have passed and been enacted make it harder to vote, not easier to vote. That is the common thread in every single state legislative package. It makes it harder to vote, not easier to vote. Now, i dont know how Mitch Mcconnell is trying to parse words saying thats not suppression, but it makes it harder to vote in those states. And then theres another lane that is occurring that was in your reporting just there. Not only are they suppressing, making it harder for the individual to exercise their franchise, they also are removing authority from these armslength Election Administrators, your supervisors of elections or your secretary of state. Those who typically more elections without the heavy hand of politics. Thats the other common thread through all these state legislative packages which is they are removing authorities, in some cases, small, and in some cases big authorities from Arms Length Objectivity Election Administrators and putting it in the hands of partisans. Republicans are doing this for two reasons. One, they want to make it harder to vote, and, two, if there is a challenge to the vote, they hope that they can adjust the outcome based on who the ultimate administrator of the election is. Adrian, i got to say, one of the most nerveracking things about this is first and foremost a lot of folks that wont be able to vote because of the laws in place. Second, thinking back to 2020 in all the conversations we had about the result hinging on people, right, it wasnt our institutions that held up the 2020 election results. In fact, it was republicans, local election officials in georgia who were, in fact, republicans who held up those results because the responsibility they had to their office. And those are the very people that are now, it seems, being threatened by these new laws. Yeah. Thats exactly right, yasmin. And i think we got to look at this from a holistic standpoint. Why are republican legislatures doing this across the country . Especially in states where they have a significant majority . Because the republican party is losing voters by the day. Theyre losing women. Theyre losing young people. Theyre losing people of color. So this is sort of their Lastditch Effort to hold on to any grasp of power they can in terms of being able to get the votes they need to win elections, especially in some of those marginal swing districts. This is the only tactic they have left, yasmin. Its so obvious and desperate that, you know, were talking about it constantly, by The Way, which im glad the media is covering this to the extent that it can because these guys are trying to slip this through, you know, without us noticing. Theyre trying to guise them as were making it easier for people to vote, which is not the case. So im glad were talking about this. Its very important that we continue to get the public support to push back against this legislation. You know, look, yasmin, one of the great things i love about georgia, especially the voters in georgia, is they turned out. Remember those lines 10, 11, 12 hours long during early vote, black voters standing in line. They were not going to get their vote be suppressed or lose the election and have what happened to Stacey Abrams in 2018 happen to Joe Biden and Kamala Harris in 2020. Its just going to get more democrats to turn out on the left. We just got to make sure, to your point, that we stop this legislation because people have to vote and this is, make no mistake, legislation that is trying to suppress the vote. I want to bring congresswoman Sheila Jackson Lee into this conversation. Congresswoman, thank you so much for joining us. Really appreciate it. Thank you for having me. You were just listening to our conversation i was just having. Adrian brought up a really good point. It is incredibly important for us to talk about whats happening across the country when it comes to Voter Restrictions put in place and whats happening in states like georgia from this new york times reporting with local election officials, mostly democrats being removed from office. That being said, there needs to be federal protections, right . That comes down to the voting Rights Act. At this point, it seems like if a filibuster is not eliminated, considering where Mitch Mcconnell is, thats not going to happen. Were not finished negotiating yet. What your guest said is absolutely true, starting as far back as the gore v. Bush election. Republicans have been losing the popular vote in the president ial elections. They are now looking for that last Life Raft and its not going to get there. Were going to continue to work with members and senators like those from Senators Manchin as well as the other senators to be able to look at what theyve offered. Im not truly committed, but im hoping to what has been offered. And democrats realized that we have to get there. Because our voters are young and vulnerable, they are physically challenged, they are senior citizens, they are poor voters, but theyre americans. And so we cant leave them out. I will proclaim it. We will get this done. We have to pass the voter enhancement act, this is John Lewis bill, and we have to do something about h. R. 1. Were working on it. By The Way, you know that Senator Manchin has said that he supports the John Lewis bill, which was the preclearance, but it may be dealing with the second provision, article 2, section 2, because of the fact that the Supreme Court is making that decision now. So, you know, its interesting to hear that youre so confident that youre going to get this done. Seems as if youre hard to make sure that happens. That being sound, i just played some sound of senator Mitch Mcconnell essentially proclaiming that he feels as if none of these changes to Voting Rights across the country actually inhibit folks from voting, right . I can think of one, and thats voting on sundays. One of the laws is to keep folks from voting on sundays. That could really inhibit black voters from coming to the polls to vote after church essentially. Thats one of the reasons why that was put there. So talk to me about how you plan on going up against folks like that when you have Mitch Mcconnell declaring he doesnt think Theres Anything wrong with whats happening. You know, we passed bills before in the senate without Mitch Mcconnell. I remind you that we were able to get a federal holiday with a group of republicans who joined the democrats to make sure that we could withstand an objection on unanimous consent. Miracles do happen. Were going to have to keep working, and i think were going to have to look to methods that will work around the senator. The districts or seats that some senators hold in certain states, they win because people of color, young people, and others possibly vote for them. Theres a lot of leverage that can be utilized to let them know that their afflictions 2022 May be in jeopardy. We have to use every tool. What im trying to say is, theres so many heinous laws. In the original Senate Bill 7, we had judges able to overturn an election at a whim. They could overturn it because they said someone said there was fraud and i can tell you in texas, there are people who rise up at The Drop Of A Hat in black districts and black seats and latinx and hispanic seats and say there was fraud. So in order to preserve democracy, this has to be laid at the feet of really preserving this nation, ensuring that this nation is who she is. And you cant be who you are, you cant be a democracy if you dont have fair elections or you dont have election that are open to everyone. And so there are things that Senator Manchin has to think about. Senator sinema has to think about as to what is more important, preserving this democracy that was attacked on January 6th or some aspects of values that they may have. I think theyre going to err on the side of preserving the democracy because Senator Mcconnell is not going to give them any room. He is going to continue to rebut, but hes also going to continue to really use a very strong stick to say that im going to keep my members in line, what are you going to do . Frankly, were the only lifeline for american voters now. So at this point seems as if what im hearing from you in that youre urging Manchin And Sinema to do away with the filibuster or get on board with doing away with the filibuster in order to get voting Rights Act through . I am urging them to continue their deliberations. You know, im on record for the fact that the filibuster for me is associated with segregation. Senators of the 20th century that blocked every manner of civil rights legislation. These senators have a reason for their commitment to this as an aspect of senate rules. For me, it is not a statute. Its not part of the constitution. I think there are some aspects of it i like the idea of insisting on a rolling filibuster, meaning the proposals that have just been put forward where you have the burden is on those who the president stop the legislation, the burden is on the 41 to be able to stop the legislation or the extra ones that have to stop it. I like that. I dont know if those two senators can view that. They have some suggestions about a different kind of filibuster, and as i said, one of them is you have to remain on the floor, because right now you dont. You can say, i object or im standing for a filibuster and be on the beach. We cant have that. If youre committed to the filibuster, what rule can you use to ensure that the minority doesnt bludgeon the majority . That is what Mitch Mcconnell is doing right now. Hes bludgeoning the majority, not because Chuck Schumer is not working as hard as he can, but because he has the power to do so. Lets get rid of his power. What americans want, frankly, is not to see us at odds. They want the american jobs plan passed and the infrastructure bill. They want the american Family Plan passed. I know that. I see them no matter what their political persuasion, i see them. Texas is not a liberal state. We need to make sure were not bludgeoned. I live that every day. I dont have a district thats been drawn by the regular order, if you will, by the legislature. They have never drawn our district because they didnt want this majority minority district, which is the story of most southern minority democrats. Its a majority minority district, and they want to get rid of it. Because of growth in texas, latinx, and africanamericans, we got to protect the Voting Rights. Congresswoman, ironically while were talking about Voting Rights and access to free and fair voting, especially for black and brown communities, were also celebrating juneteenth for the first time as a federal holiday. It was an incredible day the other day to see you gavel that moment in what is today what does today mean to you . Its a culmination of a long journey. When i introduced the first bill, we believe, in the last session, it was not a time for it. We werent gathering the support. It wasnt rolling ahead, if you will. But we know things have changed, and there is that time that this bill seemed to bring people together, which is what i believe happened. People wanted to for a moment, take a pause in racial divide. Thats what weve been living in. If you speak about race, it divides america. One instance, im in galveston. Just spent the early hours in two different juneteenth celebrations. I want you to know, they were fully diversified. People were engaged and excited about that. So as ive said, In The Black Church we say we were filled. I was filled with the sense of history and spirit, and really i was filled with the collegiality and the unit of republicans and democrats standing together, being happy with juneteenth. I do believe this holiday will supercede the issues of critical race theory. People might think the George Floyd bill is a bill they can support or the bill to study slavery. We have just now touched the Third Rail of race, and it was touched in the house, 415 votes. And i appreciate ed the republican votes that we got and we fist bumped after that vote. Maybe theres a crack in the darkness. I hope that this holiday, which is only one of less than 11. To say we can go forward and we can do it together. Lets hope youre right, congresswoman. Hundreds of arrests were made Last Summer in new York City following nights of looting and rioting. It appears most of the looters that rampaged through streets of new York City Last Summer will go free. They tore through manhattan through The Bronx as the black Lives Matter protests gripped the city. More than a year later, charges against many of the looters have now been dropped. Wnbc Jonathan Deinst joins us with his Exclusive Reporting. We have some of these looters faces on video as they smashed storefronts throughout the city. So why have so many of these charges been dropped . Yasmin, thats a question many of the District Attorneys in new york are now facing. The nypd and the mayor were initially blasted for their response to the mobs that ran through the city Last Summer. They did set up a Task Force to try to track down many of the worst offenders, but the courts were closed due to covid. The cases have backed up and piled up. And now critics say the d. A. S are just not moving forward with prosecutions. Free Phones Reporter a year ago, parts of the city were out of control. Crowds were seen smashing storefront after storefront. The mayhem continued Night After night. At one point, there was even a socalled Looting Dance Party on the streets of soho. The mob seemingly pillaging at will. Many were caught on tape. Some with faces visible. I got to take all the papers. Reporter even posted live their own videos of their actions those nights. We got the rolex store. Reporter police far outnumbered and seemingly unprepared. But many arrests were made in manhattan and along some commercial streets in The Bronx. Video shows how numerous bronx stores were ransacked. Nypd data we reviewed shows 118 arrests were made in The Bronx during the worst of the looting. Since then, the nypd says the d. A. And courts have dismissed 73 of those cases. 18 remain open, and there are 19 convictions from mostly lesser counts like trespassing, counts which carry no jail time. Those numbers are, to be honest with you, its disgusting. Reporter Jessica Bettencourt owns an Eye Glass Store which was ransacked. She is Vice President of a local merchants association. They brushed everything off to the side, what happened. Reporter in manhattan, Nypd Data we reviewed shows there were 485 arrests, 222 cases later dropped. There are 73 convictions, many for lesser counts like trespassing, another 40 cases sent to family court, and 128 remain open. Thats not justice. Thats selective enforcement. Reporter Law Enforcement Expert and former Nypd Chief of patrol wilber chapman, critical of the d. A. S dropping so many Looting And Burglary cases. They are so overworked that they cant handle the mission that theyre hired for, then maybe they should find another line of wo. Reporter sources in the d. A. S offices tell us in some Cases Evidence was simply not strong enough for proof beyond a reasonable doubt, and with the courts closed amid the pandemic, there was a huge backlog of cases that was unwieldly for both the courts and prosecutors. The nypd did set up a Task Force after the riots to examine videos to separate out suspected rioters. The nypd says there were tedious followup Investigations Led in part by andrew arias, where evidence included photos and recovered stolen property. We have to analyze each case individually and see if, in fact, we can prove that the right person had committed the crime. Reporter former chief chapman says while the in my opinion did some followup, the data shows the d. A. S and the courts havent. It loud people who committed crimes to go scotfree. Reporter bronx d. A. Declined repeated requests for an interview, as did the manhattan d. A. In an internal memo, vance says there were over 600 commercial burglary arrests in addition to over 3,500 unindicted Felony Cases in the Pipeline Waiting to move forward in the courts. All on hold because of the pandemic. Before dropping a case, the memo shows his Office Reviewed Defendants criminal histories and whether police can in Place Suspect at the scene and whether the individual caused any damage to the store. Vance told his prosecutors for many of these commercial burglaries, you will be asked to reduce the initial Felony Charge to a misdemeanor and to dispose of the case with an eye towards rehabilitation. And he stressed the importance of our continued goal to achieve consistency and equitable treatment in these cases. A Court Spokesman says decisions to dismiss cases were made by the District Attorneys. An application must be made by the d. A. Or as they have done with hundreds of Desk Appearance tickets, decline to prosecute them. In The Bronx, some businesses are back, but the scars from the events of a year ago remain. They could do it again because they know that no one is theyre not going to get the right punishment. And in brooklyn, prosecutions also seemingly low. A d. A. Spokesman says they are moving forward with about 20 cases to date. So after hundreds and hundreds of lootingrelated arrests and followup investigations, it appears very few are being held responsible for the looting that took place in new York City about a year ago. Congresswoman Elise Stefanik, who not only voted against the certification of Joe Bidens win, but also voted against an independent commission to look into the January 6th riots currently sits on the Board Of, get this, the national endowment for democracy, a revered u. S. Organization whose mission is at odds with just about everything that she currently stands for. But despite pushback from fellow Board Members and lawmakers, it doesnt look like shes going anywhere. Joining me is daniel lipman, Washington Reporter for politico. Thanks for joining us on this. So this is some really interesting reporting. Essentially Elise Stefanik, who called into question the results of the 2020 election, who has repeatedly done so since then, who has been incredible loyal to the former president , Donald Trump, on the Board Of this organization. Whats going on here . She was put on the board back in January 2019 when she had a reputation of being a pretty moderate republican from upstate new york, went to harvard. But shes seen the path to republican relevancy, and that is fealty to Trump And Loyalty to trump. And so she was one of his on his impeachment Defense Team the first time around. She got a Shout Out from him then. And she has kept this post, which seems at odds with her current stance, which is, you know, questioning the results in georgia, saying there was 140,000 ballots that were fake. There are some people in this orbit of this organization that say how can you promote democracy abroad when you have this person on the board . I want to read a little bit from your piece. So you write this, its kind of like the Catholic Church appointing a selfdescribed atheist as a cardinal. Elise stefanik is part of the threat to american democracy. Its a travesty that the goal is to promote democracy. What is the organization saying about why it is that she is still on the board . And is there a worry that especially overseas this could shrill sully their republican station because they do so much work outside the united states in promoting democracy . They spent about 300 Million of american taxpayer dollars, you know, Helping Labor Groups and prodemocratic activists build political parties. The reason they said shes staying on the board is because they dont impose Litmus Tests on their members. You would think supporting democracy at home might be one of the Litmus Tests. I dont think she would get picked this time around. But you can see their point, which is that she is the number three house republican. They need to keep funding from congress on a bipartisan basis. And so it serves their interest to have someone who is a top figure in the republican party to keep that money going to the organization. Yes, but it is a different time. It is a completely different game. So something that may have been able to fly years ago doesnt necessarily fly now. Daniel lipman, so good to see you. Now, more than three months later, my colleague, Richard Lui, headed back To Atlanta to see what has changed in that time and to hear the stories of the families still grieving and searching for answers. But yet, these families, these individuals that lost Loved Ones are still very much grieving. You spoke to these families. What did they have to say . Yasmin, its so important to look at this. Thank you for talking with us about this story. The atlanta shootings as reverend Al Sharpton puts it, had the impact of Bloody Sunday on the asianamerican pacific islander community. And so this 100day Mark for many of them, june 24th, is like a first anniversary. We spoke with five of the eight victims families. In the case of a 49yearold woman, she was killed in cherokee county. She was a new u. S. Citizen. She was simply focused on that American Dream that her Birth Country did not have. The new york times saying the longtime loyalist could face criminal charges as early as this summer. The latest sign that an investigation into his financial dealings could be approaching its final stages, even as mr. Weissleberg continues to Rebuff Cy vances office. Joining me is syracuse law lecturer, foundering of dcreport. Org, and author of the making of Donald Trump. David, thanks for joining us on this. This was groundbreaking information in hearing that they were now circling Allen Weissleberg. This is the closest it seems an investigation can get to the former president or to threaten, i should say, the former president considering all he likely knows about the financial dealings of Donald Trump. Well, Allen Weissleberg has been with the Trump Organization back to when Donald Trumps father, fred, ran it. And so he is the person who tells people to cut checks, who donald would with a wink and a nod tells what to do. Hes absolutely central to this. And if the state of new york or more likely the District Attorney in manhattan brings a new York State racketeering charge, a corrupt enterprise charge, as ive been arguing for about a year, is likely. Allen weissleberg has a simple choice. He can either be indicted or turn states evidence. We dont know what hes going to do, but he hasnt been called as a witness to the grand jury. If he is, we know hes cooperating for sure because new York Law grants immunity for anyone who testifies before a grand jury. I just want to read a bit from The New York Times headline here. So the full scope of the investigation into mr. Weissleberg including whether prosecutors are considering other charges against him, separate from the fringe benefits, could not be determined. It is rare for prosecutors to build a criminal case solely around the failure to pay taxes on fringe benefits. I know that you talked a little bit about the possibility of the case they could build around Allen Weissleberg. They cant say likelihood this could threaten him enough to flip on Donald Trump . Well, Allen Weissleberg is 73 years old. If they bring a racketeering charge, its a 25year sentence. Any sentence at that age may well be a life sentence, and thats going to weigh heavily on him. On the other hand, allen built his whole life around donald, doing his bidding, getting around requirements everywhere he had to in order to serve donalds demands. So for him, personally i suspect this is a terrible internal struggle, and my former colleagues at The New York Times are very careful about pointing out that we dont know exactly what the grand jurys going to do. We do know from subpoenas that have been issued that they are looking at tax fraud, business records fraud, which is a new york crime that could get you 25 years, insurance fraud, and property tax fraud. Thats part of the reason i think its a high looked like well see a racketeering charge. This is going to be developing all summer and into the fall. David cay johnston, thank you.
