Majority, the case was dismissed on the procedural basis of lack of standing. The court held that a texasled coalition of gopcontrolled states and two individual plaintiffs had not suffered any injury and therefore had no right to bring suit. Trump appointees Brett Kavanaugh and Amy Coney Barrett voted in the majority on a ruling that leaves in place the entirety of the affordable Care Act. Justices samuel Alito And Neil gorsuch dissented. So, willie, Big News, Big News from the Supreme Court this morning. Especially when you Look at that vote by Amy Coney Barrett. We heard from a lot of progressives and a lot of democratic senators that she was on a mission to destroy the affordable Care Act. Not the case yesterday. And not the first time that courtappointed justices have sided with the courts liberals. In 2014, Neil Gorsuch was the Swing Vote. In 2019, Brett Kavanaugh surprised many when he sided with the courts liberals, ruling that Iphone Users could produce antitrust lawsuits against apple over its app store. Kavanaugh wrote the Majority Opinion. And last year, it was gorsuch again who joined liberal justices in a rule that protected members of the Lgbt Community from workplace discrimination. So joe, we know that Confirmation Exercises are hyperpartisan circuses in many cases, but in this case the central criticism of Amy Coney Barrett was that she was on a mission, to use the term, to destroy the affordable Care Act. Yesterday, she voted to uphold it. You know, there are a lot of things that are disturbing in american politics. The clown shows that these Nomination Battles have turned into through the years. And on both sides, we can talk about what happened with Justice Kavanaugh and what happened on the other side. We can go all The Way back to robert bork. Theres screeching and yelling and screaming on both sides, which are actually deeply offensive to people who actually follow the court and understand that sometimes its not as cut and dried and willie, you can even Look at the other case, where the City Of Philadelphia was sued over adoption and over whether samesex partners could adopt children or not. Now, this is a case that could have ended up 54 if Amy Coney Barrett and Brett Kavanaugh had followed alitos concurrence. It was a redhot concurrence that a lot of people on the right would have absolutely loved. I think its extraordinarily telling that they chose instead on an issue that was going to be this divisive, to side with John Roberts, and still get to the proper outcome, perhaps with lesssharp edges. And a unanimous 90 verdict. This says an awful lot about at least in cases so far about Amy Coney Barrett, John Roberts, and their understanding that the Supreme Court obviously, again, is yes, it is a legal institution, but there certainly are political considerations, as well. Yeah, and in the case of the affordable Care Act decision, it was a 72 vote. Only Gorsuch And Alito dissented in that opinion. Lets bring in white House Correspondent for the New York times, peter baker. So should we be surprised at the size of the vote, the 72 vote on the affordable Care Act decision here . Well, on The One hand, yes . In the sense that we have begun, especially in recent years, to think of the court in the same way we think of congress. We think of it as another political constitution. The fact that we refer to it as a 62 court, thats a relatively new phenomenon that weve seen over the years. Republican appointees who turned out to be liberal and democratic appointees who turn out to be somewhat more moderate or conservative than their president s might have expected, but in recent years, weve seen a far more predictable set of opinions from justices depending on who they were appointed by. This reminds us that, in fact, its not a political body in The Way that congress is. There are different equiies as justices see them and they are willing to see outside of the political box at some time. That doesnt mean theyre suddenly liberals. Theyre not. Theyll rule with the conservatives the vast majority of The Times. But there will be moments where they see legal arguments that dont visit their view of the law. And in this case, were talking about whether or not the case should have been brought in the first place, and theyre saying, these guys dont have a reason to bring this case because they werent armed by anything. If you go back to the time where the Trump Administration joined this case, some of his own lawyers told him not to. They told him this was a Loser Case, not because of the standing issue, but the merits, that the court didnt even get to. Some of them told trump 90 against him. The merits of the argument were actually the merits of the arguments was the Law Couldnt stand if you took out that Tax Penalty. Without Tax Penalty, they had removed, as Steven Cobarrett mentioned in 2017, that the law would fall. Congress did vote on keeping the rest of the law, even as it got rid of that Tax Penalty. The lawyers told trump, theres no way youre going to in this, and he went with it in any way, he did lose in the Supreme Court because they talked about standing. It reminds us that the Supreme Court is more unpredictable than we like to think of it, even though the ideologies are pretty strong among these justices. The ideologies are strong, but there is, of course, peter, a difference between clarence Thomas Conservatism on the court and John Roberts. And we are seeing Brett Kavanaugh again, a guy who was vilified in it was a disgraceful display. Mika and i said it at time, well say it again, a disgraceful display that was churned up and made up about Brett Kavanaugh dish mean, even Michael Avenatti was given the national stage to talk about Rape Rooms and this, that, and the other, because the republic was going to be shredded. There seems to be a lot more John Roberts in him than say Alito Or Clarence thomas. I think thats right. Obviously, if you were to categorize on the court, you would say that Justice Alito and justice thomas are closer than the other conservatives are to Each Other, maybe Neil Gorsuch in some of those case seems to have been more on the alito Thomas Side. We dont know a lot about Amy Coney Barrett. Were still learning about her, obviously. And the other thing we need to remember, that justices evolve at times. Not all of them, but a lot of them tend to change over time. Their thinking evolves and It Shifts with the tenor of the court and the tenor of The Times. John roberts who was seen as a strong, solid conservative, the author of citizens united case, which got rid of a lot of Senate Finance rules, very skeptical of conservative action rules, today is seen as the Swing Vote in the middle, even if he doesnt decide anything with three liberals to join at times. Well see more fractured court than the 63 number that we tend to throw around seems to case all right. Yesterdays ruling was the third time, the third time the Supreme Court effectively saved the law. The first was in 2012 by a vote of 54 when the court held that the penalty for not having insurance is a tax that congress is entitled to levy. The second supreme Court Ruling came in 2015 by a vote of 63, allowing the government to provide Tax Subsidies to the underprivileged to buy health insurance. The law has also survived in congress. A gopled house passed 63 different measures in six years to either repeal or severely restrict the aca, according to a 2016 newsweek report. Only one narrowly made it through the senate in 2016 to be vetoed by President Obama. But in July Of 2017, with Donald Trump in the White House, republicans were poised to enact a slimmed down or skinny repeal of obamacare, but the late Arizona Senator John Mccain casting the deciding vote against it with a thumbs down that brought applause in the chamber. Good morning, mika. Listen, the affordable Care Act is here to stay. Thats such a great thing, not for democrats, but for all americans. There are 133 Million americans in this country that live with preexisting conditions. And had this law gone down, many of those folks would have lost their Health Care Coverage and would have gone back to those dark days. We often heard the republicans say, oh, were for preexisting conditions, but they did everything they could in order to take away Health Care for many, many americans. And im glad the Supreme Court has acted in the manner it has and has been consistent in making sure that we keep the affordable Care Act for all americans, particularly in the midst of a pandemic. Good morning, mr. Chairman. Its been about an 11year fight of conservatives and republicans trying to strike down the affordable Care Act since it was passed under President Obama. Some experts have Looked at this Ruling Yesterday and all of those previous in the Supreme Court on this issue and said, this is The End of the road. Do you think this is The End of the road in opposition to the affordable Care Act . Well see, willie. One of the things that are we are still fighting particularly in Red States, like The One that i live in now in South Carolina, where the republicans are still fighting against the aca and the Medicaid Expansion Component of it. Here in South Carolina, if the government would if our governor would expand medicaid, it would cover 250 to almost 300,000 people and give them Health Care health insurance. And it would be a boon to the Health Care industry in the state. Many of the rural hospitals that have closed over this country, many of them are in Red States that have refused to expand medicaid. This is an opportunity for these governors and these areas to actually help the people that they represent, that they claim to represent. And so, i think the fight will probably move to the states where were going to force and try to do all that we can to figure out how we get Health Care to the needy folks in these states that desperately need Health Care at this moment. Jamie, lets change topics for one second. Joe manchin, obviously, in the news, trying to strike a deal on a voting Rights Piece of Legislation Or Voting protection. A compromise on hr1. Hes got a lot of democrats interested in talking about. Some republicans even though republican leader is now shying away from it, im curious, what do you think about this legislation . It really is down the middle. It has things that republicans like, photo i. D. , which, as you know, is very popular, nationwide. The purging of rolls after couple of years. But on the democratic side, expanded early voting. And also, The End of gerrymandering. A little bit of something for everybody here. Stacey abrams have come out, saying its going in the right direction. Other democrats are saying that. It Looks like a bipartisan bill, and yet you have some republicans shying away from it. I think Manchins Proposal would stake a step forward in strengthening voting right protections in this country. And i think that is a positive step. Listen, you have to see the progress. Many of us thought he was not only a no, but a hell, no, but it seems like hes got soft in his stance and willing to work to find some Common Ground to move forward. We have a Voting Problem in this country. And that problem is that youve got republicans trying to suppress the right to vote in many of these states you see around the nation. Im heartened to see the discussion moving forward. I would love to see some republicans join democrats in that effort, to make sure that we can reform voting in this country. There are some parts of hr1 that are really, really crucial. We dont think and most americans do not believe that billionaires should be able to buy our elections. Most americans do not believe that politicians should choose who their voters are. They believe that the voters should choose who represent them. These are popular opponents. There are reasons why the Koch Brothers are pouring hundreds of millions of dollars into going against hr1, and s1, because they understand that it eliminate our power to control our elections. President biden is noting what he says will go down as one of his greatest honors as president , commemorating The End of slavery in the united states, President Biden made history by signing legislation to make juneteenth a federal holiday. Juneteenth marks both a long, hard night of Slavery And Subjugation and a promise of a brighter day to come. This is a day, in my view of profound weight and profound power. Today, i want you to remember the moral stain and the terrible toll that slavery took on the country and continues to take. Before signing the bill yesterday, biden gave special recognition to 94yearold opal lee. She is known as the grandmother of juneteenth, because shes been advocating for over 40 years for juneteenth to become a federal holiday. You are an incredible woman, miss opal. You really are. As a child growing up in texas, she and her family would celebrate juneteenth. And juneteenth, 1939, when she was 12 years old, a White Mob torched her family home. And such hate never stopped her. Joining us now, weve got professor at harvard university, Pulitzer Prize winning author, amet gordon reid. Her acclaimed book is entitled on juneteenth. Annette, when we had you on before, you told us that you had a little bit of problem people outside of texas celebrating this holiday. So Im Thinking this morning, in the words of my grandmother, grandma, jewel, this must take the rag off the churn. This has to really be something for, a national holiday. Would you have even believed this which you started writing this book . I would i wouldnt have believed it. I have to say, joe, when i was younger, i felt a lot of pique about people celebrating, but im totally happy about it now. But i didnt anticipate pip certainly didnt anticipate the quickness of everything thats happened this week, certainly. So talk about it. Talk about what it means to you. Talk about what it means to this country. Well, juneteenth is tailor made. I love it because im a historian, its tailor made for thinking about history. You have to ask, what happened . When it happened . Why . What happened afterwards . And almost every celebration that ive seen, every institution who does it also has a component of education with it. Its one of those holidays, there will be Mattress Sales, undoubtedly, 20, 30 years from now. But i think there will be a core of people who will always remember what this actually is about. So, professor, the Mattress Sales aside, i think your surprise at the speed that this has taken place is instructive as someone who understands the day and the significance of it so well, about how fast the country has learned. I think if you ask most americans a couple of years ago, particularly White Americans, what is juneteenth, they probably couldnt give you the answer, but thats changed thanks to people like you and your book, to educate the american public. What do you think people should know about juneteenth that they dont know already . One of the things that they should know is that its part of the process of emancipation. Emancipation wasnt just one lightning strike. There are different points. The Emancipation Proclamation, the fall of richmond, juneteenth, and the actions of enslaved people themselves, who ran away from plantations, effectuated their own emancipation that way. I want people to think about it in terms of the whole process of bringing africanamerican people out of slavery and the country out of, as the president said yesterday, the moral stain that existed because of the institution. What i think is interesting is that we have federal holidays so that we can recognize whether its Sacrifice Or Suffering or key moments in our history so, by The Way, today is a federal holiday, not to mistake the confusion, because actually, juneteenth falls on a saturday, so today, everybody, is a federal holiday. And i know everybody wants to get that information correct. But annette, this is also day that now americans can say, well, why is it a federal holiday . And learn, perhaps, things that we have glossed over in the past or tried to forget. Instead of trying to forget, we are remembering. Absolutely. And thats really important. Thats the first step towards thinking about how things can be changed today. Were linked to this past. There are legacies of slavery, legacies of the aftermath of it. And its good and important for us to know about these things, even though its unpleasant for lots of people and there are efforts now to stop people from remembering and talking about these kinds of things, but they wont be successful. Information is not kept you know, cant be kept secret forever. And im glad that people now are thinking about this day. Annette gordon reid, thank you so much for being with us. It seems to me that the book you decided to do during the pandemic had quite an impact. Good timing. Yeah, we really greatly appreciate it. And peter baker, really quickly, i wanted to ask you, to sum up this week, for Joe Biden, the administration. How are they feeling about the past week and how is washington and the foreign Policy Establishment feeling about the G7 Meeting with putin, and of course, the meeting with nato . Yeah, i think the biden administration feels that the trip went pretty well, obviously. He met with the fellow members of the g7, with nato allies, and capped off with this meeting with Vladimir Putin in geneva. The goal was simply to say, basically, im not Donald Trump. Were going to be back to a more constructive relationship. Were not going to be fighting with our allies, were not going to be appeasing our items. And i think that basically, he sent those messages. It doesnt mean that there arent real issues here still dividing them. There are, of course. There are very different Points Of View between the united states and some of their allies in the united states, which has emerged as the number one focal point, i think, of those discussions. What to do about how confrontational to be about it. Germany, italy, a couple of the European Countries view china more as an economic partner than the threat that americans and the british and others see it at moment. There are some divides still there. But i think that the president got home and felt that he had gotten most of what he wanted done done. That didnt mean there were a lot of he didnt come home with a new treaty, with new tangible, concrete agreements. I dont think that suddenly America And Russia are good friends again. Thats not the case. I think with russia, the goal was more minimal. It wasnt to make things better, necessarily, but to keep things from getting worse, which was a minimal goal. Given the provocations weve seen from russia lately, the cyber attacks, election interference, muscling its neighbors. That by itself might be at least some progress. And now, of course, he comes back to a more roiling domestic situation with infrastructure and other issues, waiting for him back here. How is he going to get those through with the summer starting to, you know, head straight into recess not too long from now. Hes got a lot of choices on his table, on his plate, and theyre going to be consequential ones. Well talk about that straight ahead. Peter baker, thank you very much. C. Police officer who was defending the capitol on January 6th. It was used in the case against Thomas Webster. Hes a retired marine, also a retired new York City Police Officer. Hes wearing a Red Jacket and carrying a flagpole. We should warn you, this video is disturbing. Yes, thats a d. C. Metro officer being beaten with a flagpole. Webster, the man in the Red Jacket, is facing seven federal charges, including assaulting police, unawfully entering capital grounds. Joining us now, msnbc national Security Analyst, Michael Schmidt, and Nbc 4 investigative Reporter And Msnbc contributor, scott mcfarland. Good morning to you both. Scott, you obtained this doj video, this Body Cam Footage. What have we learned besides the obvious from watching this about the defendant in this case . Willie, Thomas Webster is not only a former new York Police department officer, but also a former marine, and the feds say the flag on that flagpole was a marine Corps Flag. And when he lost the flagpole, they say he toppled the officer, started punching the officer. And this is critical. My reporting, about one in ten January 6th defendants are being held in jail pretrial. Thomas webster is one of them. And listen to the argument he made last night trying to get released from jail. Hes going to argue that the officer is responsible, that the officer was mocking the protesters, that the officer changed peaceful protesters into unpeaceful protesters by using Chemical Spray and that he was making provocative hand gestures. We Look back into Thomas Websters fbi file. Hes not only a former nypd Police Officer, he worked the City Hall beat during the Giuliani Administration from 1992 through 2011, willie. Good luck with that argument. Joe, you Cant Help but think as you watch that video about a d. C. Metro Police Officer being beaten, that another officer, Michael Fanone walked the halls of Congress And Cant get as much as a handshake from republicans up on the hill. Theyre still insisting many in the Insurrectionist Caucus are insisting that it was just, you know, just regular tour groups. You, of course, have a united States Senator who from wisconsin, who is saying that he didnt feel in danger at all. There was no threat. That these were peaceloving people, and its just not the case. These were people that were leading an insurrection. If you Look and i know people in the Insurrectionist Caucus that voted against certifying the results and voted against honoring those Police Officers, the Police Officers that protected them, i know that theyre deeply offended by the use of the Term Insurrectionist or sedition, but if you actually Look at the federal statute that got passed by congress on the definition of what a conspiracy to commit sedition is, it falls right in line with that, Michael Schmidt. It falls right in line with people committing violence or taking action to try to stop a constitutional action by being enacted by congress or other members of the united states government. And these images are extraordinarily stark. The video that you just played highlighted and reminded me of one of the most important things i think i learned in my reporting throughout in the aftermath of the insurrection, trying to understand it. And thats the thing about policing, which is that most Police Officers, when they have a confrontation, it happens over a few second, maub over a few minutes. Its something that plays out. But whatever it is, it played out very quickly. And what these officers had to confront at the capitol was something that went on for hours after hours. And that sustained combat, a glimpse of which we have a chance to see here, was just so different and such a more traumatic event to have to deal with. It was truly, as some of these officers have described, handtohand medieval combat. Thats what it was. And that is not the type of thing that officers are confronting on a daily or even yearly basis on The Street. And thats what made it so extraordinary. The entire event was how long it went on, and the types of injuries that came with that sustained us. So, michael, the House Judiciary is requesting that the department of justice disclose any Gag Orders put in place by the Trump Administration. The request comes after the committee opened an investigation into the departments secretive dealings under the previous administration. That includes Gag Orders to prevent News Organizations from Alerting Democratic lawmakers, reporters, and even former white House Council Don Mcgahn that their records had been subpoenaed. In a letter to attorney general merrick garland, democrats on the Committee Write in part, quote, we must ask why the department repeatedly pursued Gag Orders, preventing companies from notifying their users of sweeping Information Requests by federal law enforcement, despite realizing early in the effort that no criminal charges would result from these investigations. Your thoughts on this, especially since you found yourself front and center, as part of this story . So, the i had an experience with this. Because earlier this year, the Justice Department got into went to google, to try to get contents for my email, but did it secretly under one of these types of Gag Orders. And what ensued was a completely secret process that ended up between the top lawyer for the New York times, david mcgraw, and the Justice Department, negotiating about how the Justice Department was seeking these emails, and david mcgraws attempt to stop the Justice Department from doing this. This fight ensued over several months, up until two weeks ago on a Friday Night, when i found out about it for the first time. So my company, the New York times, was engaged in this litigation with the Justice Department, in which The Times could not even tell me, because they had been gagged by a federal judge, about what was going on. And Thats Anxample of how these Orders Function and h they keep individuals whose information the government is seeking in the dark, that there was even a fight. There was a legal fight going on for my emails or contents from my emails that i had no idea about until i sat down and Looked at my own email on a Friday Night two weeks ago and found out from my general count that he had been fighting against the Justice Department for me. So scott mcfarland, before we let you go, i want to go back to the videos in just a second. Do you expect in your reporting that we might see more footage from body cams, from different angles from what happened on January 6th. We have certain images burned into our minds from Media Coverage of that day, but there is just so much more footage of expected. I expect several more videos over the coming days, including frederico klein, which is the Trump Administrations State Department Employee who was allegedly part of the insurrection. We fought our first fight for video back in march. We succeeded getting video of a man from maryland, accused of using a Baseball Bat on police. Ive got to tell you, willie, its the audio from this footage which is perhaps most haunting. That guttural, visceral, and vulgar screaming, which is so compelling. The reason these videos are being pursued is because these are exhibits feds are using, trying to keep some of these alleged insurrectionists locked up. All right. People are being pulled to their extremes and too many people are worried about the primaries and feeding their base instead of the general election. And most concerning, we have to be concerned about our foreign adversaries that are trying to sow civil unrest, get us all to hate Each Other and be against Each Other in hyperbole and extremes. We have to constantly work at building relationships and see that we can disagree with our components, but we dont have to hold them in contempt. Such a great point to bring up, especially after Joe Bidens summit with Vladimir Putin, that our adversaries globally be it Russia Or China or other countries, north korea, that right now see themselves as our rivals love to see us divided, love to see us fighting Each Other. Were really playing into their own hands when we do that. You are part of a problem Solvers Caucus. Mika talked about a problem with the republican party, but there actually are republican members in that problem Solvers Caucus. Talk about your relationships with them and whatll together are trying to do to move Legislation Forward thats bipartisan and for the good of this country. Well, lets everybody know first that the problem Solvers Caucus is 29 democrats, 29 republicans. We meet on a regular basis, sometimes two or three times a week and we tried to find Common Ground with Each Other. I have a lot of great personal relationships with members of the congress, both the democrats and the republicans. And even on things that we disagree upon, weve tried to build trust over the past several years to understand why i disagree with you, based upon how i was grew up and based upon what my politics are, i know youre not coming from a bad place. You really want to do whats good for the country. And were working right now on a whole host of different things to try to bring us together, whether its on Infrastructure Or Police reform, every day, were working on different issues to try to find Common Ground with Each Other. Congressman, its willie geist. As you point out in the piece, the Reward System in politics these days and the incentives are for that kind of extremism that gets you attention, that gets you on perhaps a primetime Cable News show, that gets you fundraising. Im thinking, for example, of Kevin Mccarthy going into an Oval Office meeting, and coming out and having his campaign send out a message that says, i just met with the Radical Leftist president and i need ideas how to defeat him. How do you break that cycle, the more extreme i am, the more fire i can light, the more gas can i put on the flames, the more money i raise, the higher profile i become and the more power i hold. A big part of it is just identifying that the problem exists and why it exists. The more extreme you are, the more online i get. The more rapid i am, the more followers i get on twitter. Most americans are really just, hey, cant you get along, work together, and solve problems . But more and more of this Hyperbole And Extremism gets that big chunk of people in the middle, that 50 to 60 of americans to be politically disengaged and politically disenchanted. We need to keep on pointing it out and understand that Social Media and the media being as fractured as it is, and feeding it to different groups of people is a relatively good phenomenon. And as time goes on, we need to Look at holding other platforms more accountable and hold our adversaries responsible for sanctions promoting disinformation and misinformation. And the most important thing we need is to get the people more involved. The people dont want the nuts and extremism. If we could encourage them to show up at the primaries and get more than 10 or 15 of people to vote in the primaries, politicians would have to not worry about focusing on just the rapid base. They would have to focus on the people. The more people we get involved in democracy, the more effective democracy is. I understand youre a conservative. I understand that you feel like hes betrayed your party and your cause, but david would always gently tell me, find Common Ground on foreign policy. If he does something right, if republicans do something right, underline it. So david was always that voice telling me, hey, you know, maintain your equilibrium here, even at pretty radical times. And yet, heres David Ignatius, a guy who tries stubbornly to find Center Ground between both parties. Just really telling it like it is, which is, right is wrong with a political party or even parts of a political party, and we saw it in the poll yesterday, that like Vladimir Putin, more than they like the President Of The United States of america. Yeah, you know, David Ignatius piece, the parts of it that mika just read, make so much sense, but dont makeceps to the republican party. Theres another aspect of the trip that our friend, Dan Dressner really captured when in his Piece Yesterday in the Washington Post, he said, this was a normal foreign Policy Trip conducted by a Normal American president. And thats really the story here. I think a lot of people think that. And one of the stories that came out of this trip was joes the president s appearance on the tarmac, just prior to going home, when he issued an apology for whatever he said to the cnn reporter. And then for three or four or five minutes, whent on talking about his role as President Of The United States and everything that the country has endured in the recent past, the insurrection, coping with the virus for 14 to 15 months and when you listen to him, and joe, you and i talked about this the other night, when you listen to this, you realize that he has a renewed confidence in his role as President Of The United States. You can be around the presidency, as you know, as a lot of people in politics knows, you can br around the presidency. You can work in the White House, but until youre sitting behind that desk, with the Fire Hose of issues that come across that desk each and every day, you dont know what its like to really be president. Joe biden knows what its like to be really president. He is a moderate. He is a guy interested in getting things done for the american people. And i think thats the presidency going forward and the opposition, the crazy opposition and i underline that word crazy, is going to have to deal with that and figure out a way to meet him in order for the country to move forward. Right. You know, willie, the Operative Line coming out of the ignatius column, for me, if we want to talk about, how we move to bipartisanship and how we move to republicans and democrats trying to figure out how to move forward together on issues that we see time and again are approved by 60, 65, 70 of the american people was that one line that talks about making republicans pay for their obstruction. As long as republicans can continue to oppose bills that have 60, 65, 70 of support from the american people, and democrats dont know how to either pull them on to those bills or make them pay at the ballot box, then well have more of the same. Well have a party saying no. Well have extreme elements of that party pushing back on the legitimacy of american democracy, the Insurrectionist Caucus, and well continue to have campaigns run by slogans. Theyve got to figure out how to turn this popular legislation into, you know, a call for action. And Joe Biden, like President Obama before him, is dealing with a caucus who has announced his attention to make him a oneterm president. The question is, how do you work with that body . Theyve shown that very popular issues like covid relief, infrastructure, that the republicans are willing to stand in the door and the senate has said, okay, on those issues, at least, well push through with reconciliation. So theyre going to have to use all of those tools they have in their tool box. I will point to one, since its a friday morning, one moment of bipartisan yesterday on that juneteenth Vote Weve been talking about, the vote was unanimous in the senate to make juneteenth a federal holiday. And yesterday, i think there were only 14 republicans who voted in the house against it. So, lets celebrate that one moment of bipartisanship in this time of split votes and parties who dont seem to even Look at Each Other. I just dont know how you vote against that. So, topping the news this morning, a conservativedominated supreme Court Yesterday dismissed the latest attempt by republicans to eliminate obamacare, leaving in Tact Insurance Coverage for 31 Million americans. By a vote of 72 with Justice Stephen Breyer writing for the majority, the case was dismissed on the procedural Basis And Lack of standing. The court held that a texasled coalition of gopcontrolled states and two individual plaintiffs had not suffered any injury and therefore had no right to bring suit. Trump appointees Brett Kavanaugh and Amy Coney Barrett voted in the majority on a ruling that leaves in place the entirety of the affordable Care Act. Justices samuel Alito And Neil gorsuch dissented. This is not the first time trumpappointed justices have sided with the courts liberals. In 2018, Neil Gorsuch was the Swing Vote on a case about deporting undocumented immigrants for violent crimes, decideding that the law was too vague. In 2019, Brett Kavanaugh surprised many when he sided with the courts liberals, ruling that Iphone Users could pursue antitrust lawsuits against liberals. Kavanaugh wrote the Majority Opinion in that case. And last year, it was Neil Gorsuch again who joined liberal justices in a ruling that protected members of the Lgbt Community from workplace discrimination. Joe . Yeah, so Elise Jordan, i we were talking about it last hour, these confirmation fights for these Supreme Court justices have become despicable displays of partisanship. We saw people chasing after Michael Avenatti, talking about Rape Rooms in washington, d. C. , people trying to remember whether Brett Kavanaugh had done something to them or not 30 years ago, and things being printed as gospel. Him being called an alleged rapist. All of this other stuff going on, all because he was going to destroy the constitution as we know it. The same thing with Amy Coney Barrett. Okay, ideologically, they are conservative, but at the same time, the republic stands, the affordable Care Act is firmly in place. If you Look at those two justices, Amy Coney Barrett and Brett Kavanaugh, they could have gone with an alito concurrence, a firebreathing concurrence, and it would have been a 54 Split Decision on a really contentious matter. Instead, they sided with John Roberts. A little bit more narrow decision, but a 90 ruling against the City Of Philadelphia on the contentious issue of samesex adoption, and thats the path they chose. So a lot of these warnings, it just really show house hyperbolic these supreme Court Nomination fights are too often. Joe, thank you for saying that, just because you Look at what happened a couple of years ago, with Justice Kavanaugh and the sliming was such an egregious low point in american politics, and for those of us that know and respect Justice Kavanaugh, he did what we always expected him to do is uphold the Law And Rule according to the law and not as an ideologue. And you Look at justice Amy Coney Barrett, who we all warned was going to usher in a new era of the hand maids tale, and not ruling as an ideologue, but a judge, following the law, and these justices ruled there was not standing. They did not let their political beliefs come into the decision. And im glad that the Supreme Court is an institution in the country that americans can Look at as apolitical, as they should, when it makes decisions like this that are drawn from the law and not from politics. You know, rev, this is also theres a fascinating backstory to this case yesterday. I know it will shock our viewers, but experts around Donald Trump said years ago, please dont bring this case. You are going to lose. It is going to weaken our hands. There is we will not win this on the merits. And yet Donald Trump pushed it and once again, the Supreme Court reaffirmed for the third time the affordable Care Act. And its constitutionality. And i think, at this point, affirmed that it is here to say. But that doesnt mean to republicans in Congress Arent going to continue their decadelong battle against it. In many ways, it was a selfinflicted wound on the right wing that opposes the affordable Care Act or opposes obamacare, whatever term you want to use, because on the merits, the case should not have been ruled any differently. Even Clarence Thomas voted that it did not meet the merits of the law or have standing in terms of something that they would entertain. I mean, clearance thomas, i think, youre clearly right to raise the two trump appointees, but what shows clearly they should not have gone forward with this is when Clarence Thomas goes the other way, i think its clear that this is something that was not thought out, that was emotiondriven, and it gave a good day and a good headline to those of us who have supported the affordable Care Act, that this is the third time the Supreme Court affirmed it, when they really didnt affirm the obamacare or the affordable Care Act as Policy Or Anything other than they did not have the merit to bring the case in the court. They didnt have the standing, i should say, to bring that case in the court. But the perception is that we won again, and they gave it to us. Rev, i want to get your take on another big development yesterday. Democratic senator Joe Manchins voting Rights Compromise received a big endorsement from Stacey Abrams, who says she supports senator Manchins Proposal. What Senator Manchin is putting forward are some basic Building Blocks that we need to ensure that democracy is accessible, no matter your geography. And those provisions that he is setting forth are strong ones that will create a level playing field. That will create standards that do not vary from state to state, and i think will ensure that every american has improved access to the right to vote, despite the onslaught of State Legislation seeking to restrict access to the right to vote. Senator manchin released his proposal earlier this week with some republican priorities, mkding voter i. D. , potentially opening the door to compromise on the democrats top voting bill, though we havent seen much signal that republicans are willing to go along with it. So rev, this was a big moment for the Manchin Proposal to have Stacey Abrams, a leading voting Rights Activist in the country working outside the government on these issues to endorse it. Is this the direction theyre going to go in the congress . What i believe is we saw Stacey Abrams play chess and maybe well see whether those in the senate can equal this. What happens here, we in the civil Rights Leadership have had several conversations with Senator Manchin and others and when he came with this counterproposal, some of which we do not agree with, and stacey said, okay, fine, well go with that, and you still cant get ten republicans to come forward, the question is now, what can manchin do when hes made this appeal, hes made this cry to all of this. I will not support Senate Bill 1, i will not support anything unless its bipartisan. He throws out a compromise. All of us are reluctant because of certain elements in there we disagree with. Stacey comes out and says, im with it. Now, show your hand. And he has no hand to show. Where are the ten republicans . Mcconnell comes back and slaps him in the face and says, i dont care what you give up, were not going to do it, which shows that there is not a willingness to have a bipartisan solution to a very serious problem of voting. I couldnt have seen a better way to dramatize the Republicans Insistence on not dealing with the Voting Rights of american people and the discriminatory denial in certain communities. They, in many ways, made the message clearer than i could have ever verbalized. To your point, reverend sharpton, here is Mitch Mcconnell Yesterday talking about senator Manchins Proposal. You all have notice that there is now a debate among democrats over a revised version produced by one of the democrats yesterday, which has been endorsed by Stacey Abrams. So i would make this observation about the revised version. Equally unacceptable. Totally inappropriate, all republicans, i think, will oppose that, as well. Okay, then. Senator Roy Blunt of missouri, the ranking member on the senate rules committee, also slammed The Endorsement from Stacey Abrams. Well, we all, i think every One Of Us Looks for opportunities to work with Senator Manchin and we found those opportunities. I actually think when Stacey Abrams immediately endorsed senator Manchins Proposal, it became the Stacey Abrams substitute, not the Joe Manchin substitute. So, joe, there you have it. Republicans are going to attach this proposal now to Stacey Abrams and it will underline the argument from senate democrats and progressives who say, trying to work with republicans on this issue and others is an exercise in futfutility. I mean, i just im just sitting here wondering, like, did they all get together . Did manchin and Stacey Abrams and everybody get together and just plot this to make republicans Look as bad as they could possibly Look . They didnt, but had they, you would just say theyre the most brilliant people on the face of the earth. Because Joe Manchin comes forward with something that democrats have always opposed. Voter idea. Something widely popular with the american people, but democrats have always opposed it. Republicans have always in insisted, we must have voter i. D. Joe manchin says, okay, thats fine, we will give you voter i. D. And republicans say, we must purge the rolls of dead people. Which, of course, we all want that. Democrats, we dont want to purge the rolls. Manchin says, lets purge the rolls. It doesnt make sense not to purge the rolls. Thats how you make sure you have qualified voters on the rolls. So manchin does that. Listens to the republicans, puts it in the bill. And then he puts in the bill about gerrymandering and also about expanding early voting. Now, republicans, im sorry, just not too smart to be against early voting, because voters like early voting. I like early voting. I like not standing in lines for five hours like you do in new York State and texas and a lot of other states on election day. So, so its almost like he set the trap, because manchin is doing everything he can, Elise Jordan. Hes doing everything he can to work with the republicans. Hes making himself an enemy of liberals, progressives, democrats. He doesnt care. Hes just doing hes bending over backwards to work with republicans. And i must say, yesterday was the worst display of republicans going, oh, wait a second, Stacey Abrams says shes okay with this . Okay, were against it now, when, in fact, it is a bipartisan bill that manchin is promoting. And joe, just good luck with republicans trying to demonize Stacey Abrams, because she is just such a good messenger. And you Look at how she responded about this bill and how she said, great whereby this is a step in the right direction. It might not be everything that i want, but i never said i opposed voter registration, voter i. D. , that i dont want it to be toocumbersome. Thats sensible, thats reasonable. And when progressives talk like that, its much harder to demonize. So when Senator Blount comes out of the gate, Stacey Abrams endorses this, it must be bad, but cant back it up with actual facts, it is a sad day for republicans. And they are showing a complete unwillingness to give any compromise, to get anything done, which is so much of the american Peoples Frustration right now. Just that nothing can get done period in washington even when you have Joe Manchin playing this role and bringing together two side for muchneed reform. Joe manchin doing everything he can do to bring republicans and democrats together. And hes learning, Mike Barnicle, day in and day out, that theres one side that just doesnt want to get together. He had talks with republicans on the January 6th commission and was saying, hey, tell me how you want the commission to Look. What are your objections to the commission . Quooel take Care Of your objections to the January 6th commission, but you have to put the country ahead of your own political party, just like democrats have to put the country ahead of their own political party. And hes found is, no, hes getting no to 1 6, getting no to requiring voter i. D. From republicans. Hes getting no to purging the rolls from republican senators. Really, again, this is this is not how nothing to be outraged about here. This is showing how dumb they are strategically. I dont know if manchin is just setting them up, but if he were just setting republicans Up To Look stupid, just playing right into his hands. With all due respect to the rev, this is a come to Jesus Moment for Joe Manchin. Hes confronted with working hard to come up with a system, a proposal that he thinks is fair and right across the board. Hes backed up now by Stacey Abrams. I Cant Think of anyone more respected in terms of the Voting Process and articulating why the importance of the vote is the foundation of the america that we live in. And his first reaction to what he proposes is from senator mitch mcconnell, not republican from kentucky, republican from the true state of cynicism. And its a no, no matter what you propose, no matter how far you go to come towards giving us something, the republican side, that we can live with, the answer is no. And hes backed up by his entire caucus and nearly every member of the republican senate. So now Joe Manchin is going to have to stand there and hes going to have to say to himself, geez, ive been begging for bipartisanship on any of these votes. And when i turn around, theres No One behind me. Theres No One behind me. They dont want bipartisanship. They just want to continue to say no. So, Joe Manchin, you know, we like Joe Manchin, hes great with us when he comes on, but hes got some thinking to do. You know, mike, Joe Manchin, hes pretty good at that thinking thing. Joe manchin, i think Joe Manchin has thought this out long, long ago, before today and i think that Joe Manchin has decided, im going to do everything i can to give republicans every chance listen to me, republicans on the hill. Im trying to help you here, but joe has given you every chance meet him in the middle. Hes given you every chance. And as ive been saying for the past six months, this is not 2009. And Joe Biden is not barack obama. Hes been around this town for 40 years. So dont be too clever by half, and dont think Joe Manchin doesnt know exactly what Joe Manchin is doing. And progressive, please, please, Joe Manchin was figuring out how to win in West Virginia while you were Eating Cheetos in your moms basement. Oh, wait, youre still Eating Cheetos in your moms basement. Strike that, please. But reverend al, when people talk about Joe Manchin, Look, i dont understand, i wish Joe Manchin understood politics more. I just sit back and im laughing. And yesterday was one of those days where manchin the genius of Joe Manchin was revealed he is giving them everything they want and its still not enough. And manchin, by trying to be good, by trying to be bipartisan, is exposing an element of the republican Party Party that really is Looking bad to voters. Theyre now against voter i. D. , and theyre now against purging the rolls. Manchin got them there yesterday. Absolutely. Hes set up, of course, by the republican reaction to where now it is going to be even more loudly called upon by the democrats to go to reconciliation or against filibustering some of the things that many of us want. And it is amazing to me, because as soon as it came out, that Stacey Abrams said, i would go with the Manchin Proposals and before any of us could react to stacey, mcconnell and others ran out there and started condemning it, so they would checkmate before we could even say, well, i dont know if were all The Way with stacey on this one or not. It was the perfect setup that they went for it. It was amazing to me. And i think i have always been one that Looked kind of skeptically at Joe Manchin. I think hes a lot more savvy than one would give him credit when youre two steps away from him. I dont know whether he thought this out, but he has put the republicans into a very bad position and certainly helped those of us who want to see the reconciliation on some things like Police Reform and other things that are still being debated. We couldnt have had a better ending on this one. A conservative dominated supreme Court Yesterday dismissed the latest attempt by republicans to eliminate obamacare leaving in Tact Insurance Coverage for 31 Million americans. By a vote of 72 with Justice Stephen Breyer, the case was dismissed on the procedural basis of lack of standing. The court held that a texasled coalition of Gop Controlled States and two individual plaintiffs had not suffered any injury and therefore had no right to bring suit. Brett kavanaugh and Amy Coney Barrett vote on a ruling that leaves in place the entirety of the affordable Care Act. Justices alito decentdecented. We heard from a lot of democratic senators that she was on a mission to destroy the affordable Care Act. Not the case yesterday. In 2018, Neil Gorsuch was the Swing Vote on immigrating and Brett Kavanaugh sided with the liberals ruling that Iphone Users could pursue antitrust lawsuits over its app store. Kavanaugh wrote the Majority Opinion in that case and last year it was gorsuch again who joined liberal justices in a ruling that protected members of had Lgbt Community from workplace discrimination. We know Confirmation Exercises are circuses when were Looking at Supreme Court justices and nominees but in this case the central criticism of Amy Coney Barrett she was on a mission to use the term to destroy the affordable Care Act and yesterday she voted to uphold it. We could talk about we could talk about what happened with Justice Kavanaugh and talk about what happened on the other side and we can go all The Way back to robert bork. Theyre screeching and yelling and screaming on both sides which are actually deeply offensive to people who follow the court and understand that sometimes its not as cut and dry. Willie, you can Look at the other case where the City Of Philadelphia was sued over adoption and whether samesex partners could adopt children or not. This is a case that could have ended up 54, if Amy Coney Barrett followed the concurrence. A red hot concurrence that a lot of people would have loved. Its telling that they chose instead on an issue that was this devisive to side with John Roberts and get to the proper outcome with less sharp edges and have a unanimous 90 verdict. That says an awful lot at least so far four about Amy Coney Barrett and Brett Kavanaugh and John Roberts and their understanding that the Supreme Court, again, is, yes, it is a legal institution, but certainly are political considerations, as well. Yeah, and in the case of the affordable Care Act decision, 72 vote. Only Gorsuch And Alito in that opinion. Peter baker. Peter, good morning. Should we be surprised at the size of the vote, perhaps. The 72 vote on the affordable Care Act decision here . Well, on The One hand, yes, in the sense that we have begun especially in recent years to think of the court in the same way we think of congress. Just another political institution. In fact we refer to it as a 63 court like it was a mini legislative body with political bodies. That is a relatively new phenomenon and republican appointees who turned out to be liberal and democratic appointees who are more moderate and conservative than expected. In recent years weve seen a far more, you know, predictable set of opinions from justices depending on who they were appointed by. This reminds us, not a political body in the same way that congress is. Different equities as justices see them and they are willing to think outside of the ideological and partisan box at times. That doesnt mean at Amy Coney Barrett and Brett Kavanaugh are liberals, no, theyre going to rule with liberals but they see legal arguments that dont fit their view of the law. In this case, were talking about not getting to the merits of the case. But whether or not the case should have been brought in the first place. Theyre saying, no, these guys dont have a reason to bring this case because they dont have standing. Thats the legal term. Whats interesting if you go back to the time where the Trump Administration joined this case, some of his own lawyers told him not to. They told him this is a Loser Case not because of the standing issue but because of the merits that the court didnt get to. They think on the merits they would have ruled some told trump 90 against him. The merits are the argument that were actually on. The marriage of the argument is that the Law Couldnt stand if you took out that Tax Penalty, right. Without the Tax Penalty that they had removed, as Stephen Colbert mentioned in 2017 the rest of the law should fall because Congress Wouldnt allow the law to go forward without it. In fact, congress did vote on keeping the rest of the law even as it get rid of the Tax Penalty. The lawyers told trump, youre not going to win this argument, dont go with it and he went with it anyway. He did end up losing at the Supreme Court not even on the merits but not even getting because they talked about standing. It reminds us the Supreme Court is a little more unaware than we like to think of it. The ideoloies are pretty strong among these justices. The ideologies are strong but a difference between clarence Thomas Conservatism on the court and John Roberts. Were seeing kavanaugh who was vilified a disgraceful display. Mika and i said it at the time and say it again. A disgraceful display what was churned up and made up about Brett Kavanaugh. All because the constitution was going to be shredded and the republic was going to be brought to its knees. If you Look at Brett Kavanaugh over the past several years, a lot more John Roberts in him than say Alito Or Clarence thomas. Yeah, i think thats right. Obviously, if you were to categorize on the court, you would say Justice Alito and justice thomas are closer than the other conservatives are to Each Other. Maybe Neil Gorsuch seems to be more on the alito Thomas Side on many cases. We assume because of her services on the Appeals Court and some of the things she has written but were still learning about her, obviously. The other thing we need to remember that justice involve at times and a lot of them do tend to change over time. Their thinking evolves and shifts with the tenor of the court and the tenor of The Times. John roberts who was seen as a strong, solid conservative and the author of citizen united case and got rid of Campaign Finance rules and who has been skeptical of affirmative action cases over the years and, obviously, on the conservative side of things and today is seen as the Swing Vote in the middle even if he doesnt decide things any more with only three liberals to join at times. Were going to see, i think, a more fractured court in the 63 number that we tend to throw around seems to indicate. All right, yesterdays ruling was the third time, the third time the Supreme Court effectively saved the law. The first was in 2012 by a vote of 54 when the court held that the penalty for not having insurance is a tax that congress is entitled to levee. The second supreme Court Ruling came in 2015 by a vote of 63 allowing the Government Tosubsu underprivileged and buy health insurance. The law also survived in congress. A gopled house passed 63 different measures in six years to either repeal or severely restrict the aca, according to a 2016 newsweek report. Only one narrowly made it through the senate in 2015 to be vetoed by President Obama. But in July Of 2017 with Donald Trump in the White House, republicans were poised to enact a slimmed down or skinny repeal of obamacare. But the late Arizona Senator John Mccain casting that deciding vote against it with a thumbs down that brought applause in the chamber. Remember that moment. Some experts Looked at this Ruling Yesterday and all those previous said this is The End of the road. Do you think this is The End of the road in terms of the opposition of the affordable Care Act . You know, one of the things that were still fighting particularly in Red States like The One i live in now here in South Carolina where republicans are still fighting against the aca in the Medicaid Expansion Component of it. Here in South Carolina, if the government, if our governor would expand medicaid, it would cover 250 to almost 300,000 people and give them Health Care insurance. And it would be a boom to the Health Care industry in the state. Many of the rural hospitals that have closed over this country, many of them are in Red States that have refused to expand medicaid. So, this is an opportunity for these governors and these areas to actually help the people that they represent. That they claim to represent. And so i think the fight will probably move to the states where were going to force and try to do all that we can to figure out how we get Health Care to the needy folks in these states desperately need Health Care at this moment. Thomas webster is one of them and listen to the argument he made last night trying to get release from jail. He is going to argue that the officer is responsible. That the officer was mocking the protesters, that the officer changed peaceful protesters into unpeaceful protesters by using Chemical Spray and that he was making provocative hand gestures. You, of course, have a united States Senator who from wisconsin who is saying that he didnt feel in danger at all. There was no threat. These were peaceloving people. And its just not the case. These were people that were leading an insurrection. If you Look and i know people in the Insurrectionist Caucus that voted against certifying the results and voted against honoring those Police Officers, the Police Officers that protected them. I know theyre deeply offended by the use of the Term Insurrectionist but if you Look at the federal statute that got passed by congress on the definition of what a conspiracy is, it falls right in line with that, Michael Schmidt. It falls right in line with people committing violence or taking action to try to stop a constitutional action by being enacted by congress or other members of the united states government. And these, these images are extraordinarily stark. The video that you just played highlighted and reminded me of one of the most important things i think i learned in my reporting throughout and in the aftermath of the insurrection trying to understand it. And thats the thing about policing. Which is that most Police Officers when they have a confrontation, it happens over a few seconds, maybe over a few minutes. Its something that plays out. But whatever it is, it plays out very quickly. And what these officers had to confront at the capitol was something that went on for hours after hours. And that sustained combat a glimpse of which we have a chance to see here was just so different and such a more traumatic event to have to deal with. But, first, lets talk about getting diversity which is a lot of what this book is about because it starts with retaining diverse talent. Ive been working really hard on figuring out ways to do that and your title triggers me. Where you are is not who you are, but, dont you think you do have to meet people where they are . Oh, absolutely. Absolutely. My reference here is not about meeting people, its about assuring that you dont get too too big headed when you make progress. You dont get so away from your start or wherever your hoMe And Your roots are so that you forget who is there. You have to reach back and help. Its more about that than forgetting where you started from. For sure. And toward The End of your memoir you write in part this. There i was at the height of my success enjoying all the trappings of my position. Money, access, a bully pulpit, respect. I had a great job and a great family. I also felt a bit guilty, survivors guilt. Why were there so few like me . So few black or female or poor beginnings people sitting around the table i had access to. I do know that i am not a unicorn by Intelligence Or Endurance or education or sponsorship. My uniqueness shone a light on the grip that men, white men have on the systems and institutions that they built. Being recognized as a successful Business Leader is an important accomplishment but it leaves out many other measures of accomplishments such as impacts on social justice, education and the environment. My mother would never have made it on to any list. But nonetheless her impact on many people was profound. Tell us about her. My mother was an immigrant, single parent from panama. We had no Connection Or Contact with my father when i was growing up. She was poor, obviously. We had, she had basic skills. She could read, write, graduated from high school. Nonetheless, she had very little access to the graces that most people expect or would like to have in life. She didnt have good Health Care, food, we lived in a tough place, et cetera. But she was insanely focused. She was insanely focused on three things. My brother, my sister and i. She wanted to make sure that we had the best that was possible for someone who made 4,400 a year and who lived on welfare. She hustled every single day. Every single day. To make sure, first of all, we had an education that was, as we said, the best that was possible and we got above average here and paid for us to go to catholic school, parochial school that we were safe, that we were not caught up in the, basically the neighborhood that we grew up in. Gangs, drugs, filth and just Chaos And Disorganization and she focused on her kids and that for me ended Up To be my safe space. Thats how i lived for 20 something years in a crazy environment. Because when i came home, it was anything but crazy. She was an amazing, she is what i call a miracle worker. Elise jordan has a question for you. Elise. Ms. Burns, your story is just incredible. Your personal story and then how you rose in the ranks at xerox and i had no idea about the culture there and after the race riots in 1964 in rochester that there was a concerted effort to diversify and to recruit from outside the normal corridors of power. Can you talk a little bit about the example of xerox and what lessons you think that you had to teach us about how we can be more inclusive in the corporate environment. First, xerox was another place. I lucked out in life, you know, running into these places or people, one was the person who gave birth to me and the other one, as i say in the book, i picked the perfect company for me. Without it, i could not have gotten anywhere near as close as i had got. We happened to be founded by an enlightened man. Someone who is a scientist, obviously. Came from not very much. He realized during these riots that people outside that when he Looked inside the company, there were none of. And before he got into all the whats happening here, his fundamental question was, why dont we have these people inside . It was not only africanamericans, it was also women. So, he basically said, were just going to bring them inside and literally start to understand where theyre starting from, train them if they needed to be trained and Look for them if theyre not close to home and bring them in. My husband who passed away almost two years ago, more than two years ago literally was one of the first beneficiaies of being hired. He was a scientist who couldnt be hired anywhere else because he didnt have a citizenship. Xerox brought him in and became a very famous Scientist And Physicist at xerox. Black Man And Chester carlton, joe wilson, our founders thought that diverity would be an asset and it was. The way companies can do this, i always say this, start close to home. Before you go and fix Everybody Elses shop, fix your own. Make sure you have a diverse board and a diverse and make sure you hire people from diverse organizations and backgrounds and, please, please, please, measure yourself and keep track of where youre going. Its possible to make progress. Its possible to make progress, but its not going to be easy. Ms. Burns, Al Sharpton. One of the things and i have admired you, i ran into somewhere and told you that from afar. One of the things that has struck me in Looking at your book is that youve had to become very disciplined and focused because at one level you did not become intoxicated with your Position And Stature and another level of fighting to break that Glass Ceiling for women and blacks. You did not step outside of your role as a corporate executive and begin leading the marches and rallying. There was pressure on both sides. You have pressure from those in the corporate world that Look at you to see if youre going to be confident and you have pressure from the black community, the Womens Community that want you to be a cruseder and you successfully resisted both and became an example. How did you deal with those tensions . Reverend sharpton, im so pleased that you asked the question and so pleased that youre here. Thank you for being here. It turns out this is one that i had a lot of guidance on. I had some sponsors and mentors who helped me to figure out what choices to make. These are people like Vernon Jordan or ken who had kind of gone before me, my husband gone before me and knew that i was being pulled in many directions and that i had responsibility to many constituents and serving those constituents meant well and meant that you couldnt get too intoxicated, as you say, with any of the constituents and also with my position. So, i had a lot of guidance on how to proceed. I knew one thing for sure that i would even after i was an executive at xerox be black and be a women. I decided early, no choice here. It wasnt rocket science. That was the thing i was going to center on. Every interaction i had, every example i had to make, i made it from the perspective of who i was. Not trying to fit any other space. Im a black woman. I was born in an environment surrounded by black people. Im very comfortable in that environment. And i never even when i was in the White House in front of corporate executives giving speeches around the world one thing that was very clear was i was very, very proud and firmly rooted in my history and that that history was a positive for me, not a negative. Which was what a lot of people wanted it to be. Right. This is what people called. This is what they told me when i was growing up. I basically stayed close to home as i moved along in the world. I wont ask your favorite because ive been asked that, its an impossible question, but there was something about that Mike Tyson Interview that struck me as special. Willie, it was amazing. He came out on stage and it was so raw, because in the hour he cried uncontrollably, he laughed maniacally, he was sad, he was happy. We do it in front of a live audience. They were sitting on the edge of their seats. At times i thought he was going to hit me. I just found this ou a week and a half ago, that show airs on yes. After it was over, spike lee, who was watching it, picks up the phone and calls Mike Tyson and says, thats a Oneman Broadway Show right there. You do what you just did on centerstage on broadway, and youve got a hit. I was amazed by it, too, but i didnt make broadway. Ive interviewed tyson, too, and you do get, for a brief moment if you ask the wrong question, what it must have been like to be michael spinx for those few seconds staring a across at Mike Tyson. Mike . I remember that show. It was absolutely riveting. First of all, you should know, and im sure you do know, ive raised all my children and they wake up in certain months of the year, and the first question they ask isnt about breakfast, they always ask, did the yankees lose last night . Thats my household. The point you just raised, michael, is so important about the status of major League Baseball. The other night im watching the game. It was 4 hours and 7 minutes long. Im crazy, i watched it. But you mentioned the dilemma of baseball, the Home Run or the strikeout. What impact do you think it will have that we have this Midseason Crackdown on pitchers that are now going to be frisked, apparently, in between innings . What impact do you think that will have on the speed, the pace, the tenor of major League Baseball games now that pitchers are suspect for using sunscreen and other sticky stuff . Mike, i tell you, its going to have huge ramifications. I dont think they even know exactly what ramifications its going to have. What they did, though, changing a Rule Oren forcing a rule in midseason is they were petrified about the three two outcomes. Thats what all the analytics are about in baseball. They want to you hit a Home Run, strike out or walk. When that happens you have no action on the field whatsoever. The games were slow, they had no pace, and obviously there wasnt much run scoring. So they take the sticky stuff away, and theyre going to start enforcing it on monday, and if you have any on your hand, it will be a tengame suspension. They hope it reunites the offense, that they start hitting again, that they take a step down on efficacy. You could have a fourhour game. Baseball is at a crossroads right now. They have a big cba Coming Up during the offseason. Theyre going to have to work together. Thats the problem, mike. These two sides dont work together. The fact that pitchers all of a sudden have what they use to get a grip on the baseball taken away in the middle of june and there is no replacement whatsoever, thats scary for what could happen. Balls could slip out of their hands, people could get hit. I think people will watch this very closely. Spider tack is a term people have had to learn the last couple weeks. Theres been more diversity at higher levels of Staffing And Management but not ownership. How do you view this as one who lives in sports every day about the growing calls, needs and diversity in terms of Ownership And Management in sports . I think the key is you need ownership. People that own teams, miami having Derek Jeter be the owner of the marlins, thats significant and thats huge. I think they should open these teams to everybody, and people who have the money should buy it. Thats where a president of the team will be hired, thats where a gm of the team will be hired. What ive seen throughout sports, and covering sports over half my life, it really is a situation that people hire who they know. Once you get diversity in the ownership levels, then i think diversity will spread throughout. Michael, before we hit the top of the hour, weve got to run here, i need to ask about Larry David.
