Today, the president also got something of an assist from an unlikely source, the Conservative Majority Supreme Court upheld the affordable Care Act for a third time. President obamas Signature Legislation has been the target of relentless republican efforts to repeal it. In this latest ruling, the court decided 7 to 2 that a group of republican Attorneys General lacked the standing to strike it down. 11 years have now passed since it became the law of the land. The former president issued a Statement Today that read in part, quote, this ruling reaffirms what we have long known to be true. The affordable Care Act is here to stay. For the biden administration, the supreme Court Ruling removes the possibility of millions of our fellow citizens losing their insurance limit efforts to repair the economy after the pandemic. Its also a win for democratic leaders in congress working to advance the President S agenda. The affordable Care Act has won and now we are going to try and make it bigger and better. When we pass it i said this is a pillar of economic security. We will never forget how republican leaders embraced this Monster Sway to rip away americas Health Care in the middle of a deadly pandemic. While the president was overseas work continued on a one trillion Dollar Infrastructure Compromise bill of some sort which is now at the top of bidens list. The group is now made up of 21 senators out of 110 democrats, now 11 republicans have backed the compromise bill, but even as that effort is underway. Senate democrats are also talking amongst themselves about a six trillion Dollar Budget Package that would include bidens proposals, and could pass without republican support. Meanwhile, democratic senator Joe Manchin, West Virginia, his proposals for voting Rights Legislation are getting support from a voting Rights Advocate Stacey abrams, and they have been welcomed by several other democrats. Mansions proposals include, making Election Day a public holiday, mandated at least 15 consecutive days of early voting for federal elections, banned partisan gerrymandering, and require voter i. D. With allowable alternatives to prove identity. Democrats have been firmly against requiring Voter Identification of any kind before. But even that part of Manchins Compromise got Stacey Abrams endorsement. That was of. Note here is in fact what abrams had to say about Manchins Proposal today. I am endorsing the fact that we now have a list of priorities and that Joe Manchin is at the table and Hes Part of the conversation. I think you makes common sense opportunities available for compromise, its only going to be through federal legislation that we can negate or mitigate the harms being created at the state level. And remember, here are the stakes. Nearly 400 bills that would make it harder for americans to vote have been proposed in 48 of our 50 states. Manchins proposal still needs support from ten senate republicans to pass. It comes as The Hill and other Media Outlets reported Majority Leader Chuck schumer plans to move ahead with a four vote tuesday on the for the people act, also tonight new developments in the investigation into The One sixth Riot Insurrection and desecration of our capital. Today, the Department Of Justice released new Police Body Camera footage from that January 6th assault. He got here and suddenly there were signs of hope. There is a supreme Court Ruling on obamacare, of course which is a really significant development for this White House and for the democratic party as a whole, preserving that Health Care program. The bipartisan movement over on Capitol Hill in terms of the Infrastructure Plan is a very welcomed signed by this White House which has patiently been working for months now through the spring, to try to bring republicans together with democrats to work out some sort of a deal. Its not done yet, of course, and it does not include some of the Climate Change and other initiatives that are so important to the progressive base of the democratic party. But its progress towards bipartisanship nevertheless. And Joe Manchin, the West Virginia senator becoming effectively that 58 vote for the voting Rights Act, or voting Rights Legislation, rather, is significant. It means democrats when they bring this to the floor in the senate next week to begin debate should have unified support within their caucus which is a political win for the White House, even if it doesnt necessarily yet mean that bill is going to be passing the senate because of course its going to need those ten republican votes as well. Lisa, lets talk about that very dynamic that fill races. Biden has to hold the democrats and by the way, in his spare time, good luck finding ten republicans to pull across. Thats right. Finding ten republicans in this sort of polarized political environment is a heavy lift. And thats why you see democrats pursuing this dual Track Approach to the infrastructure legislation, where on The One, had there is a group thats negotiating this bipartisan Infrastructure Bill that comes in about 1. 2 trillion, and democrats are also working on a six trillion Dollar Infrastructure Package that should that bipartisan Bill Fall apart, they could try to push through using reconciliation, which means id only have to clear a 50 vote hurdle. There is political pros and cons to both approaches. Biden certainly wants, as phil said, this bipartisan achievement. He ran as this bipartisan legislator, this long timeline at the senate, Vice President , experienced washingtons who could cut across these polarized divisions and get things done. He also made pretty big promises to democratic base, which wont be fulfilled in that bipartisan package. On the flip, side theres a question about the bigger bill for their moderates to get the democratic moderates like Joe Manchin and others in the senate would get behind such a big proposal and get them to a 15 number. Still precarious negotiation for both of these potential paths. Joyce vance, counselor over to you and the news that started this day in many ways. Instead, the court stopped before it got to that substantive ruling and said listen, these plaintiffs dont have any right to sue. They dont have any standing, we havent brought claims that involves a law that actually damages them. And because they are not suffering any harm, here we arent going to let this suit proceed. Its pretty much a slam on the case that was brought here, but it does stopped short of a full merits ruling. Perhaps republicans or people who are against the affordable Care Act will try and find some new way to attack the bill. Phil, i want to play for you missouri republican senator roy blunt, the justification he has come up with on not joining the Mansion Compromise on Voting Rights. We will discuss on the other side. I think wednesday see abrams immediately endorsed senator Manchins Proposal, it became the Stacey Abrams substitute, not the Joe Manchin substitute. Phil, forgive me, thats just like a real reason, only flimsy. It is the standard now that anything a democrat has gone near is tainted in terms of legislation . Brian, i am at a loss here to try to explain what the senator meant there, other than to point out that the substance of the proposal is no different whether it was put forward by senator manchin, or by Stacey Abrams. We should just keep in mind when hes trying to do there. Stacey abrams is a wellknown national figure at this point. Shes beloved by the democratic party and by progressives, and credited with helping Turn Georgia into Joe Bidens column. In the 2020 election. And getting those two democratic senators over the hurdle. In january, and the special elections. And yet she is reviled by the conservative base, by the republican party because shes seen as activists, because she seen as threatening the Status Quo for republicans and to former President Trump in particular. I think blunt was trying to have something of a Dog Whistle there too conservative republican voters out in the country, in explaining why the republican senators at this point appear to be united in trying to resist and oppose this voting legislation. Lisa, i have one for you, this reminder of exactly how popular obamacare was with the last president , just a reminder we will discuss on the other side. Someone said the other day, but is the first thing you are going to do . We are going to work immediately on repealing obamacare. The problem with obamacare, its not good. I want to give great Health Care. Obamacare is a disaster, we want to terminate it. We are going to cancel that obamacare, if we can win the case. Lisa, we are waiting on that alternative trump care Health Care plan, but lets say this, to Joyce Vance last point, if the supreme court decides they are done with challenges to the aca, either standing or the law itself, and they dont grant another challenge, another case, can we is soon this will disappear as a republican Rallying Cry . This has been a really long road for republicans. It does feel, at this moment, that the fight has sort of run out of a bit of gas. There were more than 70 attempts and congress to repeal all, were part of the law. They all failed, most famously with a thumbs down from john mccain, in 2017. This is the third time in the supreme court that theyve refused to undermine the law. Republicans lost the midterm elections, democrats made them a referendum on Health Care. They lost the 2020 election. They lost the presidency. What weve seen is the law is more popular now than its ever been. Majority of americans approve of the law, and certain provisions like maintaining Health Insurance for people with preexisting conditions is approved by margins that are nearly two thirds republicans, 75 of americans, so what struck me the most about the republican reaction to this case was the silence. You simply didnt hear the level of outrage that youve heard, after this supreme Court Rulings on this in 2012, 2015. I dont think it disappears completely. But it becomes sort of a Zombie Issue thats trotted out, maybe to rally some primary voters, and tight republican primaries. But i dont think republicans really see this as a winning general Election Issue moving forward. They are setting their sights on other topics. And the last word goes to Joyce Vance but maybe the most important question of the evening and it comes from the world of the possible. Joyce, you know anything thats going to get 60 votes on Voting Rights in the u. S. Senate is not going to be what the democrats want. Its going to be something by definition watered down. Here is the question, though. Will it still be enough in terms of federal protections to counteract all of these Voter Suppression measures being passed by republican controlled State Legislators . That is tough work we have ahead of us as a country, to protect Voting Rights. And of course that happens in two bills that are currently sitting in the senate with the manchin proposal, we are really talking about the for the people act, which in many ways prospectively addresses voting. How do we register . Can we vote absentee . What sort of restrictions like identification do we have to provide in order to exercise our right to vote . Then theres the john does voting Rights Act which would attempt to restore the protections of section five of the voting Rights Act, which gives the Justice Department and private individuals the ability to challenge when states pass these restrictive measures. The Mansion Plan is really, from my point of view, someone whos litigated Voting Rights issues for a couple of decades, its extraordinary. It has a 15day Period for voting in advance of the election. An alabama, we have one day. Provisions like that would make it very strong. It would certainly not expose anyone to fraud, but manchin has this interesting notion that he would actually impose or legitimize the Voting Right i. T. After requirements many states have, but make the kind of i. D. That you can use more flexible. In alabama and other states that do this, the restrictions are really strong. In texas, you can vote with her gun license, but you Cant Vote with your college i. D. Manchin would let people use things like Utility Bills, and other sorts of material that would firmly established their identity, that would make what we know to be the absolutely minimal risk of fraud clear after trumps Big Lie in the way he litigated. Broad is not impacting elections in america. Manchin, nonetheless, puts that provision in and it is something democrats and all americans can live with because this proposal would expand the right to vote. Still need the John Lewis Act to be able to protect things in the long run. And we note it still keeps mansion at the center of the conversation, but it also shows he may have indeed listened to the parade of voices making their way to his office in the u. S. Senate. Does this bipartisan legislation have any convertibility into any other bipartisan legislation . It absolutely does. First of all, we should not diminish the importance of recognizing juneteenth as a federal holiday. It is important. Yes, i will acknowledge the critics as they will say its largely symbolic, but it is important particularly as republicans across the State Legislators of this Country Attempt to whitewash, no pun intended, the very nasty legacy of slavery and through the vehicle diminishing the city of critical Race Theory which is actually not being taught in schools, but it is but it is. To your second question, i think the idea that Juneteenth Bill passed today Cannot Exist in a vacuum, so black twitter and the leftist twitter should claim a major victory because they made enough noise that people like Joe Manchin and the Senate Democratic Caucus recognized for the first time that they cant do this symbolic somewhat performative stuff, and not pass real Voting Rights reform. And not pastoral reform a substantive issues that are going to make a difference in peoples real lives, but particularly in the context of the racial issues we still have an america. You cannot pass a Juneteenth Bill and look at the american people with a straight face and not do something on Voting Rights reform. Thats why we are in a much more optimistic posture as democrats, than we were a week ago, and weve gotten Joe Manchin to a decent place. Democrats would not be able to look at anybody with a straight face by having passed juneteenth and not done anything on Voting Rights. I think everybody should claim a pretty broad victory here, and we are happier than we were this time last week. Mark, don raises a terrific point, and that is that some of these senators who were part of the unanimous Yes Vote on the Juneteenth Legislation are big fans of Voter Suppression back home. They know it, they know we know, and we know their names. What would your advice be to the democrats, especially given the kind of bubble of hope surrounding what mr. Manchin has been able to write . But mr. Manchin has been able to get some agreement with, and yes, the story that keeps mr. Manchin at the center of the story. Joe manchin at the center of the story and proving what he has to be. Hes come forth with a really reasonable compromised solution. Its very thoughtful, brian. It touches on the major ideas democrats have been pushing for and adds another one, which is a reasonable one on voter i. D. And even though i would argue and many opposed argue its a problem, its a solution in search of a problem. But the fact is people, most americans say you have to have some form of i. D. Manchin is saying you just are bringing down a level of i. D. , so that is a reasonable Utility Bill or something else that almost all americans have. It makes it easier but it is something republicans make a big Sticking Point on it. Democrats dont care about i. D. Because they want to have which is not true. But by including this provision in the bill, it gives Democrats Cover and it gives republicans less of a reason to vote against it. The problem, is Mitch Mcconnell is going to use the federal overlay over the states and ultimately the problem is that this is the acid test. It is the ultimate test for republicans because it faces support, it means they are denying the Big Lie, and that is a Litmus Test for republicans today. You must march in step on the Big Lie and if you march in step on the big, let you cannot vote for the democratic voting Rights Bill thats right because absent massive voter fraud, why would you want to fix voter fraud. I think the first and most important remedy is the John Lewis Voting Rights Act. Joyce vance, my fellow alabamians mentioned a moment ago that the johns voting Rights Act is perhaps the most important thing because it restores section five of 1965 voting Rights Act in the preclearance notions. States cant do a lot of the shenanigans either on a state regulatory level, on a state legislative level, without preclearance from the Department Of Justice. That means any substantive procedural change to Voting Procedures on the State Local County Municipal Level would have to be cleared by the Department Of Justice. My mentor and good Friend Deval Patrick of the civil rights former director of the civil Rights Division of the Department Of Justice firmly let the preclearance process. No Kristen Clark leads it. If it were restart under section five. I think we have to recognize the play here between federal legislation and if Joe Manchin is on board for nothing else, hes got to be on board for preclearance, which he is, in the genres voting Rights Act. So, before states can enact a whole lot of the shenanigans on the back, and on the counting, on the Arizona Audit Type stuff, you have to be able to restrict their ability to make the changes from the beginning. Secondly i think that before you can even get to the count you have to open up access to the Ballot Box. Im not even really worried about the Counting Procedures on the Back End because we have lawyers, we have the Lawyers Committee for civil rights, the naacp legal Defense Fund to handle things like that. Where there is not an integrity and again, i hate to use the word for the third time the segment, but shenanigans on the counting process. I think its critical Resort Preclearance on the front end, and i think its crucial that you really thwart a whole lot of these Ballot Box contraction bills, on which decides who gets the opportunity to vote in the first place. Its very difficult to throw out votes when they actually have been properly cast. Its very difficult to mess around on the counting process.
