From the very beginning, from when democrats first started talking about universal health care, up until Href='https://vimarsana.com/news/president-obama'>President Obama signed the affordable Href='https://vimarsana.com/news/care-act'>Care Act into law in march twenty, dismantling that law has been the number one Href='https://vimarsana.com/news/policy-agenda'>Policy Agenda items for republicans. Congressional republicans tried and failed to repeal baker at least 70 times before Href='https://vimarsana.com/news/republican-senator-john-mccain'>Republican Senator John Mccain of arizona quite dramatically shut down the last major effort to repeal it and replace it with nothing. But they did not just try in congress. They also took it to the Href='https://vimarsana.com/news/supreme-court'>Supreme Court, where it was shot down multiple times. Until 2012 Href='https://vimarsana.com/news/chief-justice'>Chief Justice roberts surpriseden and sided with the more liberal justices in a 54 decision upholding the law. Then again in 2015, it survives another challenge. But the margin expanded to 63. When Href='https://vimarsana.com/news/donald-trump'>Donald Trump became president he made repealing baker his number one policy goal. Even after senator mccains late night thumbsdown, trump and the republicans, they kept trying to find new ways to disp mantle the law. They landed on getting rid of protections for people with preexisting conditions, even in the middle of a pandemic. A pandemic that has killed hundreds of thousands of americans. It is why Href='https://vimarsana.com/news/donald-trump'>Donald Trump nominated Href='https://vimarsana.com/news/amy-coney-barrett'>Amy Coney Barrett to the Href='https://vimarsana.com/news/supreme-court'>Supreme Court. Its also why republicans rushed to confirm her only weeks before the 2020 president ial election, something democrats were very, very clear about during her nomination hearings. This well could mean that if Href='https://vimarsana.com/news/judge-barrett'>Judge Barrett is confirmed, americans stand to lose the benefits that the aca provides. It seems every time you whai in on the legality of the statue you come to one conclusion, the affordable Href='https://vimarsana.com/news/care-act'>Care Act is unconstitutional. Republicans are scrambling to confirm this nominee as fast as possible because they need one more Href='https://vimarsana.com/news/trump-judge'>Trump Judge on the bench before Href='https://vimarsana.com/news/november-10th'>November 10th to win and strike down the entire affordable Href='https://vimarsana.com/news/care-act'>Care Act. For her part, she dodged just about every question that came her way. Donald trump was happy to admit he expected the Href='https://vimarsana.com/news/supreme-court'>Supreme Court to toss out baker even as he claimed he wanted to protect people with preexisting conditions. So important. And thank you very much. On preexisting conditions, this is such a big issue for voters. A big issue for me, too. In point of fact, your administration is about to go to the Href='https://vimarsana.com/news/supreme-court'>Supreme Court to tHrow out the rest of baker. Thats right. Which includes preexisting conditions. Thats right. Youre in court right now to. To always under all circumstances we are going to protect the republicans. I mean, maybe i changed the party a lot over the last tHree years, but we will protect people with preexisting conditions. Well, today the Href='https://vimarsana.com/news/supreme-court'>Supreme Court announced its decision in that Href='https://vimarsana.com/news/case-trump'>Case Trump was referring to and baker survived again. It was the largest margin of defeat for republicans so far with trump Href='https://vimarsana.com/news/nominees-bret-kavanagh'>Nominees Bret Kavanagh and Href='https://vimarsana.com/news/amy-copy-barrett'>Amy Copy Barrett agreeing with the majority to preserve the law in a 72 decision. Now this decision does not permanently guarantee the affordable Href='https://vimarsana.com/news/care-act'>Care Act and protect it going forward. Theyre not sure how to gut it again. The decision is a victory, nonetheless. Former minnesota senatoriHref='https://vimarsana.com/news/al-franken'>Al Franken was one of the key votes in the passing of the aca. Hes host of the Href='https://vimarsana.com/news/alfranken-podcast'>Alfranken Podcast and joins me now. Thanks for being here. Thank you. Your senate yeah. 312 votes in minnesota possible i apologize. Theres a slight delay. Let me ask the question and ill let you give your complete answer. What are the lessons learned, in your view, in terms of how to pass progressive legislation that will be upheld in court . Well, thats a tall order to figure it out, because they stack Href='https://vimarsana.com/news/the-court'>The Court. They packed the Href='https://vimarsana.com/news/court-can-federal-society-judges-during-trump'>Court Can Federal Society Judges During Trump and with really partisan unqualified judges and so they are this the Href='https://vimarsana.com/news/federal-court'>Federal Court now is very partisan. Part of what we have to do is we have to confirm our own judges. We you know, unfortunately, Href='https://vimarsana.com/news/mitch-mcconnell'>Mitch Mcconnell made it very clear that if in 22 they pick up the majority that he will not allow a biden nominee to the Href='https://vimarsana.com/news/supreme-court'>Supreme Court will get heard just like Href='https://vimarsana.com/news/mayor-garland'>Mayor Garland and that puts a lot of pressure, i think, on justice breyer. In retrospect, i think Href='https://vimarsana.com/news/justice-gipzberg'>Justice Gipzberg probably should have retired. We wouldnt have had copy comey barrett. Wed have somebody more progressive. Thats one of the lowsons we learned is that they packed Href='https://vimarsana.com/news/the-court'>The Courts and it was all federal society 100 ers. And consider getting back to the two judges that they stole on the Href='https://vimarsana.com/news/supreme-court'>Supreme Court. In terms of that mcconnell strategy, essentially what he did to your point is pack the federal bench with conservative jurists. Does that complicate the potential for a progressive Href='https://vimarsana.com/news/biden-agenda'>Biden Agenda if were able to see the biden administration pass some other things that are on the table, what happens when theyre challenged in court and we have all of these conservative judges on the bench . I think its a real fear. This was they got rid of the Href='https://vimarsana.com/news/blue-slip'>Blue Slip. You know what the Href='https://vimarsana.com/news/blue-slip'>Blue Slip is. That if, for example, Href='https://vimarsana.com/news/president-trump'>President Trump nominated a circuit court judge, minnesota circuit, i didnt hand in my Href='https://vimarsana.com/news/blue-slip'>Blue Slip, which is saying i dont want this guy. Normally i would go back to my state, form a committee to select somebody thats respected by everybody, its a republican because it was a republican president , but that created a Href='https://vimarsana.com/news/federal-court'>Federal Court that was respected. They got rid of that and as a result, this court is extremely partisan, including people like justice kavanagh, who during his Href='https://vimarsana.com/news/question-answer'>Question Answer in the second round there said he was going to take revenge. I mean, this is this is a very, very hard to anticipate what that kind of what those kind of judges are going to do. And in terms of looking forward, right, that in some ways were looking forwards and the laws have passed and theyre going into Href='https://vimarsana.com/news/the-court'>The Court system, but in order to even get there, the laws have to be passed. So in order to pass laws, you need to change the filibuster. And you have a plan to do that. Youve said that changing the Href='https://vimarsana.com/news/press-hold'>Press Hold to 55 votes is the way to go. Senator manchin is actually interested in this. How would it work . Joe has said that he will not get rid of the filibuster, but hes hoping to modifying it. Thats one modification, going to 55. But what weve be suggesting is that instead requiring six feet to stop the filibuster. Right now it takes one to filibuster and six to stop it. Were suggesting you need 41 senators in this case republicans to go to the floor and stay on the floor and do a talking filibuster, which means theyd have to stay there. I know my colleagues, they dont want to do that, so and joe also in this tape that was revealed by Href='https://vimarsana.com/news/the-intercept'>The Intercept where he spoke to no labels suggested said that he was open to that and that was very harping. Anytime he says Href='https://vimarsana.com/news/hes-tomorrow'>Hes Tomorrow an idea thats progress from where we currently stand, which is nothing is happening on many of the items on the bind agenda. What in your view needs to happen in the last minute here for all the senate democrats to get on the same page to pass some of this critical legislation . The democratic party needs to be in lock step. Well part of what joe was saying in that tape was that he was disillusioned about the vote on the Href='https://vimarsana.com/news/january-6th'>January 6th commission. A couple of those votes, for example, on his billings say, and joe might say, you know what, they arent bipartisan, we are not going to do it that way and it might move joe and might move crisp cinema toward the kind of modification that will make them invest, have skin in the game when they filibuster. There will be a lot fewer filibuster. Mcconnell filibustered nor executive nominees during obama than in the previous history of the united states. That is a really interesting fact there. And i think wering go to leave it there. But its something to keep it in mind when senators go to bed at Href='https://vimarsana.com/news/night-and-wonder'>Night And Wonder if there should be reforms to the filibuster. Melissa, can you break down for us the Href='https://vimarsana.com/news/courts-reasoning'>Courts Reasoning in todays ruling on baker . Its a technical opinion. It doesnt focus at all on the merits of this case, whether the aca is in fact unconstitutional. It focuses on the right of the plaintiffs here, group of individual plaintiffs and a group of states to bring this case in Href='https://vimarsana.com/news/federal-court'>Federal Court. So the decision was on standing. The idea that federal plaintiffs have to have standing, a true injury in order to bring their case in Href='https://vimarsana.com/news/federal-court'>Federal Court and here it was determined that there was no injury that could be addressed. It was a technical jurisdictional opinion. Doesnt address the merits of the case at all. How surprising was it to see robs Href='https://vimarsana.com/news/barrett-and-cav'>Barrett And Cav on and off . That was quite a surprise. I think it speaks to the justices skills. As it has the numbers to do what it likes. This was a surprising opinion. Again, the fact that it was decided on jurisdictional grounds suggests that he found a narrow way to bring them all together and essentially avoid the bigger question, but the fact that there are two justices on Href='https://vimarsana.com/news/the-court'>The Court who are willing to go on report for demolishing the affordable Href='https://vimarsana.com/news/care-act'>Care Act in the middle of a global Href='https://vimarsana.com/news/health-crisis'>Health Crisis is striking as well. Nothing could be more important than in this particularly moment than health care, yet we had two justices willing to demolish the aca. That is particularly striking. What does the supreme Href='https://vimarsana.com/news/courts-decision'>Courts Decision tell us about the security of the aca going forward on that central issue . So i think this is much debate. Earlier today on msnbc are republicans going to reel it back, this is baked in and these entitlements will endure because people have expectations to them. I think thats probably right but we also said in 1992 after planned Href='https://vimarsana.com/news/parenthood-versus-casey'>Parenthood Versus Casey reaffirmed row versus wade. We saw that the port would chip, chip, chip away at the rights. It wasnt a full frontal attack on row but a gradual derail j. You could have surgical attempts to demolish certain aspects of it like the contraceptive mandate, for example. That can whittle away protections such that it real really is toothless by Href='https://vimarsana.com/news/the-end'>The End. We have a crisis right now. We could see the same thing over time here with the aca as well. I brought up with Href='https://vimarsana.com/news/al-franken'>Al Franken the fact that republicans have put so many conservative jurists on the bench in terms of not just reproductive Href='https://vimarsana.com/news/care-but-baker'>Care But Baker cases, there are other things that biden wants to do. Is that something that democrats who are pushing nor agenda, is this something they should keep in mind as they pass these bills into law . Absolutely. We saw this over the summer, the democratic national convention. It was basically a litany of progressive legislation but no one talked about the fact that in most those cases, Href='https://vimarsana.com/news/progressive-games'>Progressive Games in congress had been gutted by decisions in the Href='https://vimarsana.com/news/supreme-court'>Supreme Court, so you Href='https://vimarsana.com/news/cant-keep'>Cant Keep and maintain your democratic agenda regardless of what happens in congress if you have courts, not just the Href='https://vimarsana.com/news/supreme-court'>Supreme Court, the lower courts as well, who are inhospitalble. The courts as Href='https://vimarsana.com/news/senator-franken'>Senator Franken have tilted to the right in the last few years. The Href='https://vimarsana.com/news/supreme-court'>Supreme Court now has a 63 conservative super majority. It was an encouraging move because earlier this month he announced that he would not support the sweeping voting Href='https://vimarsana.com/news/rights-bill'>Rights Bill known as the for the people act as it currently stands. Democrats including Href='https://vimarsana.com/news/stacey-abrams'>Stacey Abrams endorsed senator mamplgins compromise suggesting the party might be willing to get bmd it. I am endorsing the fact that we have a list of priorities and that Href='https://vimarsana.com/news/joe-imagine'>Joe Imagine ip is at the table and Href='https://vimarsana.com/news/hes-part'>Hes Part of the conversation. Its an important step forward as we try to protect the freedom to vote and protect access to the vote that all 50 democratic senators are part of the conversation. I think that he makes Href='https://vimarsana.com/news/common-sense'>Common Sense opportunities available for compromise. But, Href='https://vimarsana.com/news/mitch-mcconnell'>Mitch Mcconnell, of course, rejected the compromise on behalf of senate republicans today writing, quote, the plan endorsed by Href='https://vimarsana.com/news/stacey-abrams'>Stacey Abrams is no compromise and republican Href='https://vimarsana.com/news/senator-roy-blunt'>Senator Roy Blunt of missouri Href='https://vimarsana.com/news/who-manchin'>Who Manchin recently called a, quote, good friend, also shut down the proposal. I actually think when Href='https://vimarsana.com/news/stacey-abrams'>Stacey Abrams immediately endorsed Href='https://vimarsana.com/news/senator-manchin'>Senator Manchins proposal it became the Href='https://vimarsana.com/news/stacey-abrams-substitute'>Stacey Abrams Substitute not the Href='https://vimarsana.com/news/joe-manchin'>Joe Manchin substitute. So the questions remain. Can democrats come together to pass any meaningful roting Href='https://vimarsana.com/news/rights-legislation'>Rights Legislation . No partisan gerrymandering and move it over to computer generated maps. But it also had has some things in it. It has voter i. D. In it but seems like its a more flexible voter i. D. Which we have proposed in the past, but it had some problems. One of those problems is that it significantly weakens the democrat of justice and their when they go after states that have discriminated, and so and then it allows local officials to do purging in a much more aggressive way, and so its a problem. I think a lot of people saw it as a start, including Href='https://vimarsana.com/news/stacey-abrams'>Stacey Abrams, but at Href='https://vimarsana.com/news/the-end'>The End of the day, does it matter. The gop has shown you who they are. They are saying we dont want to compromise, we dont want your bill. The thing we have to remember is they are the party of states rights. They dont want the federal government in the business of making sure that voters are protected against Href='https://vimarsana.com/news/state-voter-suppression'>State Voter Suppression laws. Important context. Meghan, that was pretty fast. The whiplash going from Href='https://vimarsana.com/news/stacey-abrams'>Stacey Abrams endorsing Href='https://vimarsana.com/news/manchins-compromise'>Manchins Compromise to Href='https://vimarsana.com/news/mitch-mcconnell'>Mitch Mcconnell and Href='https://vimarsana.com/news/roy-blunt'>Roy Blunt coming out and being all like yeah, just kidding. Mccobble said he believed all 50 republicans would oppose Href='https://vimarsana.com/news/senator-manchin'>Senator Manchins bill. Do you think that democrats are making the mistake of trying to recapitulate to republicans over an over an then nothing materializes. Right. Yeah. We at least want to be able to check it off the list. They talked to some republicans and gave it a good Href='https://vimarsana.com/news/faith-effort'>Faith Effort to try to get republican support but they never do. They never get the support they try so hard to get. This is a bad approach, not only because its followly to convince republicans, its a huge time waster as well. And time is one of the most powerful tools that the republicans have right now in this tri effecta. Wasting time is one of the best things they can do to block Href='https://vimarsana.com/news/joe-bidens-agenda'>Joe Bidens Agenda from being enacted into law. Its really critically important that democrats stop fall for it because we dont have much time. Running up on some significant deadlines here. Snups data will be released in august. States will start drawing congressional maps. They need to be finalized by Href='https://vimarsana.com/news/february-of-2022'>February Of 2022 and the mid terms are right after that. Were reaching the point where its just driving the car into the same wall over and over again and we really just dont have time for that. Do you think democrats understand the sense of urgency of activists like megan and others who have been on the ground trying to push their senators, no matter what state theyre in, to do something about Href='https://vimarsana.com/news/voting-rights'>Voting Rights. Do they get that sense of urgency thats so clear on the ground . Well, democrats may not understand the you areinessy that we feel in the Href='https://vimarsana.com/news/voting-rights'>Voting Rights movement, but they will feel it in the fall of 2022. And they might feel it in a really bad way. Because as megan said we have Href='https://vimarsana.com/news/redistribue-districting'>Redistribue Districting coming up. It could actually kill the rest of the voting Href='https://vimarsana.com/news/rights-act'>Rights Act that exists. So when we move into 2022 and those fall elections, you know, for more barriers to be in place is going to be a problem. So i mean, we have litigation with projects in cases involving georgia and florida. We are part of black Href='https://vimarsana.com/news/voters-matter-bus'>Voters Matter Bus ride thats coming to d. C. And were doing all that we can, but now its time for the democrats to step up. Its time for Href='https://vimarsana.com/news/senator-manchin'>Senator Manchin top understand that the house is on Href='https://vimarsana.com/news/fire-and-youve'>Fire And Youve got to stop playing with people that dont want to play with you. Yeah. I feel like you probably dont want to play with people who dont want to play with you. Its an early lesson you learn in life. You sort of Href='https://vimarsana.com/news/move-om'>Move Om from the people who like you. Why keep trying if people dont like you . Meaghan is Href='https://vimarsana.com/news/filibuster-reform'>Filibuster Reform necessary on getting anything done . Im doing the math. You still need 60 votes. I dont see ten republicans. How do you get to ten . I dont see one republican for the Href='https://vimarsana.com/news/manchin-compromise'>Manchin Compromise or as it currently stands. We absolutely need to get rid of the filibuster. I think one Href='https://vimarsana.com/news/thing-answer'>Thing Answer to a Href='https://vimarsana.com/news/priest-question'>Priest Question about whether or not democrats are feeling the urgency, i agree. They will. But i do think they are right now. I think for the people acting in this current form is incredibly popular are going to end Href='https://vimarsana.com/news/citizens-poll'>Citizens Poll showed 79 of people in Href='https://vimarsana.com/news/west-virginia'>West Virginia support this bill. We wouldnt be here today if it werent for activists who are in contact with Href='https://vimarsana.com/news/joe-manchin'>Joe Manchin, after he put up the oped that he wasnt going to vote for the for the people act. Activists in virginia, especially black activists and activists of color, naacp down there, did a lot of work to impress upon Href='https://vimarsana.com/news/joe-manchin'>Joe Manchin the significance of the for the people act but we cannot pass it if the filibuster as we know it now is in place. As Href='https://vimarsana.com/news/senator-franken'>Senator Franken mentioned before, whatever it was, he did indicate that hed be open to some changes, which is good, because not even his pal Href='https://vimarsana.com/news/lisa-murkowski'>Lisa Murkowski seems to be anywhere in the mix on this for the people act compromise. Right. I just dont see how you get to 670 but maybe somebody out there has Href='https://vimarsana.com/news/magic-gnat'>Magic Gnat im not aware of. Thank you both for being here tonight. We need to understand the full extent because if we dont learn from this, i promise you there are people, including some running for president , who are watching this and say, thats a pretty cool tool.
