Within the last couple hours, the New York Times revealed that in february of 2018, trumps doj subpoenaed apple about an account that belonged to foreign white House Counsel don mcgahn. Apple was barred from telling mcgahn about it. Apple has not responded to The Times and the doj declined to comment. Heres Senate Majority Leader Chuck Schumer today. This was nothing less than a gross abuse of power, an assault on the separation of powers. I dont think weve ever had a record of this happening in the past. And the issues should not be partisan. Reporter this will be a major test for congress. Its quite extraordinary what appears to have happened under the former Justice Department. We heard Chuck Schumer calling on them to join him in investigating this. We havent heard much from the republicans but its a 5050 chamber and their support will be needed to issue subpoenas. One person to keep an Eye On here is Chuck Grassley, ranking member of the judiciary committee. He is one known to have taken his role seriously under the president of both parties. We have Speaker Pelosi telling our friends at cnn earlier today that the house will subpoena William Barr and jeff sessions, the two former Attorneys General, and have them in the house to testify under oath about this. Well see how this develops. We havent heard a whole lot from republicans yet, but it remains to be seen as to whether this is Something Congress takes more seriously or if it just gets wrapped up in the latest slew of partisan politics. Sahil, help me understand something. It is possible iran was being targeted as an individual. Its also possible he got swept up in a broader probe, is that right . It may be that what they were investigating, considering there was justification for the search warrants. It could be he got called by somebody who was already investigating. It doesnt mean this is normal. This is not normal, and i think the investigation is absolutely critical. Holding Someone Accountable is important to stop this from ever happening again. We cant have Members Of Congress, the press and the white House Counsel subjected to this, and the reason don mcgahn, of course, is of concern is because he was cooperating with mueller which made him an enemy of Donald Trump. Donald trump was calling out schiff, he was calling out swalwell, people who were subject to this search warrant, and he certainly must have felt uncomfortable with his own white House Counsel who was cooperating and telling the truth to mueller. So thats why its of concern. Jill, you have both barr and sessions distancing themselves from this story. Sources say sessions says he was never briefed on the series of record. Barr says the same that, he never discussed the cases with trump. Is it in the realm of possibility that none of these guys knew what was happening . In my opinion, no, and let me tell you why. First of all, we had Ben Venuto who was brought in, u. S. Attorney from new jersey, who was put in by barr to replace the new York Attorney who he was pushing out. He recommended venuto who came in, and Ben Venuto has said in a recording, that he briefed barr at least every other week. So it is not credible. And if barr didnt know about this, then barr is the worst manager, the worst Attorney General ever, because that is his job. The department of Justice Policy requires that there be Notice And Approval from a higher source. So its not something that you can just subpoena a member of congress records or a reporters records without something much more. So it doesnt pass what i call the red face test. Its like, could i stand up before a jury and say this in front of them without blushing or giggling . The answer is, no, i couldnt. I want you to take a listen to something that Majority Leader Chuck schumer said earlier. In addition to sessions and barr, any other members who were involved must testify under oath as well. There are many republicans who always look at overreaching executive branch authority, and were hopeful that they will join us in requesting this subpoena and demanding this subpoena, actually. To loop back to where sahil got us kicked off here, is it possible they change their contours of thinking around this . Its hard to say. I think thats pretty optimistic. This will go above the partisan politics that weve seen. I think that like sahil was saying you have people like Chuck Grassley who take the Oversight Responsibility of congress very seriously. Senator schumer was saying right there that this goes beyond politics, that this is about the separation of powers in congress and the White House, and Thats Something that no matter who is president , somebody is going to be upset about the overreach, and Thats Something that republicans have been talking about a lot. You talked about democrats like this is something that they have already been feeling in their guts, right, theyve been telling them for four years that Donald Trump was using the doj or the doj was being used as a bludgeon of his political opponents over and over. So the people caught up in this are those people, including, eventually, don mcgahn, his white House Counsel. This isnt the first time the doj has gone after administrations under democrats and republicans, but the biggest difference is this is about Members Of Congress while theyre in their official capacity doing their official work. Democrats have been telling us they think there is a lot more here. Theyll tell you Behind Closed Doors on the record that there is varying amounts of optimism on whats going to end up happening, and they want to know what happened during those four years because the only reason that we know anything is because of last month when the Gag Order was kind of expired there. Theyre hoping to find a lot more information in some of these investigations. And this isnt just about litigating what happened in the past, its also about making sure that it never happens again, that these institutions are strong enough to with strand this type of action. How could it be that there could be an investigation of members in the other branch of government, and the press and the rest, too, and the Attorneys General did not know . Who are these people and are they still in the Justice Department . Jill, suffice it to say, you know watergate well. What do you see as the similarities and differences between this and watergate . Again, this is an abuse of the institutions of government by the people in control of them. Watergate was exactly that. The Smoking Gun Tape was a conversation between the president and the Chief Of Staff in which they said, lets use the cia to stop the fbi from finding out that the money on the burglars came from campaign donations. Thats clearly a political use of the authority of the department of justice, the cia, the fbi, and thats whats happening here, too. It seems to be and we dont know enough. I dont know all the facts, no one does right now, but it does seem clear that the reason for this investigation was completely political. So far it looks like, except for don mcgahn, its not republicans who have been subpoenaed, it was democrats. Why only democrats . Well, we dont know. Why was a minor and the family of people investigated . Was there any real evidence that Someones Family Member was making these calls or that the member of congress was using a family Members Phone to avoid detection . These are all possible. The Gag Order is not unusual in a case like this, but it should have been lifted as soon as the investigation was dropped, which it was, Number One, when sessions said, well, there really is nothing here, and then it was revived under barr but clearly there was no reason to continue it because they never got anything that linked any of the people they were going after their records. So there is a lot of similarity to abuse of governmental powers, and thats a very dangerous thing. All right. Would you agree with that . I actually would agree with that, and the Actions Putin has taken consistently are responsible. We would prefer to have a more stable relationship. I think that would be of benefit to people in the United States, in russia, indeed around the world. Ryan, how hard can we expect biden to go against putin, and is a stable relationship possible when you have issues like cyberwarfare . Well, i think dialogue is a precondition for having any form of improved relationship. Thats clearly the driving factor of why biden is having the meeting in the first place. And its choreographed in a fairly clever way by building up the alliances, first g7, then the Nato Summit, then the eu summit. Because if you dont go in with a United Front with someone like Vladimir Putin, hes only going to respond to that United Front and whatever tough language Joe Biden chooses to lay out. There are also things we have to cooperate on with russia, ranging from climate change, ranging from key infrastructure, lets say hospitals, keeping them out every day. But we shouldnt be expecting that biden is going to get some big result that he can wave around at his Press Conference on wednesday. Its not going to work out like that. You and i talked about these policies that were put in place to try to mitigate the spread of covid, but i actually had the opportunity to travel to the Rio Grande Valley and spend a week with the Border Protection and with these families as they tried to figure out if they should come in with their children or send them alone. Thats because children are guaranteed to come in, but with covid restrictions, not all of them are allowed in. Its a very difficult decision, as youll see. Take a listen. Reporter so far this season, more children crossed the border than all of 2018. A stunning 78,000. Thats not counting children who crossed the border with their families. Like kelly. Her mother brought her from ecuador so this sixyearold could have ear surgery. I know its a blessing to be able to cross over because not everyone has the same luck. Reporter here in the Rio Grande Valley, many families like theirs with children under seven are allowed to wait in the u. S. For asylum hearings. Even though unaccompanied children are allowed to stay. But whether sending children alone or with their family, they have a harrowing decision. Subjecting their children to the elements for a chance of life in the United States. Officer cobb sees that firsthand, rescuing migrants who fall to the sweltering heat. Do you see kids out here . From infants all the way to 17 to 18 years old. Reporter but still, for many families attempting to cross the border, it can be a game of chance. Reporter these mothers who are coming with infants, what happens to them . Is there any guarantee . There is no guarantee that an individual with a kid of a certain age is going to be able to remain in the United States. Reporter despite the risk, more than 172,000 migrants attempted to cross the border illegally last month. The Border Patrol Chief here says he sees some expel families, send their children back across the border alone. A prospect he worries about. Weve even seen smugglers stoop to the level of kicking kids and people who cant swim out of a raft thats crossing the rio grande river, knowing our agents will go rescue those kids and the swimmer can go safely back to mexico. But there is no legal path right now. They cant appear at the court of entry and expect to get asylum. Do we have programs set up in their countries now . After what ive seen, i cannot encourage them to cross the border illegally. Reporter for many the risk is worth the reward, like this family. Reunited after two years apart. She and her daughter left honduras for the United States two years ago. But she didnt have enough money to pay for her sons to cross the border as well. Until now. I couldnt sleep or eat. Who knows what theyll find along the way . So much violence, kidnapping. Did you miss your mom . Si. Si mucho. You can see you can see from that exchange there that theyre with the head of Border Patrol in the Rio Grande Valley that they really dont have another option. I talk all the time about how the woman who opened the national museum of africanamerican History And Culture alongside the Obama Family in 2016 was the daughter of an enslaved person. My Grandfathers Grandfather was enslaved. This institution existed for 250 years and its only not existed for 150. So the idea it would have nothing to do with the landscape of inequality is not true because there are People Today who were in community with people who were born into generational bondage. And that system that was not that long ago has shaped our political infrastructure in profound and unsettling ways. As part of writing the book, you visited eight cities crucial to slavery in this country. What did you learn . Part of it originated in 2017 when i saw the statues of confederate leaders come down in our hometown of new orleans. I watched beauregard, jefferson davis. What did it mean to get to school i went down clint, i want to pull up this tweet of you facetiming with two of your grandparents and sharing the news with them, that you had landed on the New York Times best Sellers List and you talk with your Grandfathers Grandfather, this is an intellectual pursuit but also really personal. What did that moment mean to you . What did it mean to them . It was everything. The epilogue is based on the Conversations Ben interviews with my grarnd parents. I was writing the book over the course of four years and spending so much time with the history of White Supremacy and sometimes i think we forget the best primary sources are the people next to us and my grandfather said something when i was facetiming him, i was born in 1930, Jim Crow mississippi, never thought my grandson would be Number One on the New York Times Best Seller list. Its a reminder that its so much bigger than us, than me and i hope the book and the stories in this book can tell the story and lift up the stories of so many public historians, teachers, scholars, students, activeists across the country doing the hard, everyday work of preserving the memory of slifry and making sure that we fully account for what it has done to this country and how it continues to shape our country.
