I will speak with a congressman. And Attorney General Merrick Garland says the doj will turn its eye on new restrictive voting laws passing in states all across the country. Well get to all of it. Welcome to the week. We begin with an astonishing story. Former Attorney General William Barr is attempting to distance himself from reporting that the Trump Doj seized the Phone Records of at least two prominent lawmakers. Barr tells politico that while he was Attorney General, he was, quote, not aware of any congressmans records being sought in a leak case. The Justice Department has announced that the Departments Inspector General will investigate and democrats are calling on barr and trumps other former Attorney General, Jeff Sessions, to testify before congress. But really none of us should be surprised. Remember, he literally called for this to happen. I call this receipts. Roll the tape. They ought to investigate Adam Schiff for leaking that information. He should not be leaking information out of intelligence. They ought to investigate Adam Schiff. Of course, congressman Adam Schiff is one of the democrats whose records were subpoenaed by trumps doj, of course. The enormity of the scandal could not be any clearer. Donald trump used the office of the presidency to exact political retribution against his perceived enemies. In a word, its nixonian. Lets begin tonight with cynthia, an msnbc legal analyst and former federal prosecutor. Thank you so much for taking the Time Out tonight. Good evening. So what exactly was the department of justice doing here . What kind of information were they going after . And is spying the right word for what they were doing . Well, they were going after whats called Meta Data and they can actually do that. Meta data is information it basically means data about data. For instance, if you were looking for Meta Data on an album, you would get the date it was published and maybe what were the songs on it and who was the artist but not the music itself. They were getting the Meta Data about who Congressman Schiff and Congressman Swalwell were communicating with, phone numbers, length of conversations, but not the conversations themselves. They were not just getting just two. They had over 100 subpoenas that they got. Its impossible for me to believe Attorney General barr did not know about it. There are several department of justice policies that specifically have to do with the fact that if you are getting information on a congressperson you have to communicate with the department of justice, the public Integrity Section and there is no way on gods green earth that you got 100 subpoenas on members of congress and the Attorney General of the united states was not told about it. And thats a big outrage for me. Its not that its just nixonian. Its worse than nixonian because the nixonian is the attack on basically the first amendment. This is the attack on the separation of powers. This is the most fundamental attack on the constitution. And it comes in this world of lying, right . Here we have an Attorney General, the man responsible for delivering justice to the country. He lies about the mueller report. He lies about the findings. He lies about whether or not trump cooperates. He lies about whats happening on Lafayette Square and the tear gas. He lies about the stone sentencing. Everything he does, this guy does, is lying. And hes responsible for delivering justice. So those of us who work in the department of justice, i find this infuriating, even though theyre already gone. I cant almost even compose myself im so angry that the head of the department of justice is still lying, too. So maybe we should make a Witness List of sorts for the upcoming and potentially very interesting investigations, whether they be in congress or elsewhere. There is going to be an Ig Investigation looking into this. Who would make the decision like this within the department of justice . Other than Bill Barr, whose desk does this come across . Well, it comes across the head of the Public Integrity division. It comes across the assistant united States Attorney who was brought in from New Jersey to be Barrs Guy on this who had no no experience in national security issues and he was like a Health Care Fraud asa. He was brought in to handle this. Hes certainly on top of the Witness List. The united States Attorney from New Jersey who was such good friends with barr that he recommended this guy and hes the guy that barr tried to get into the southern district of New York in that failed Coup Attempt on burman, hes on the Witness List. Everybody in the national Security Division of the doj who was not included in this who should have been included who might have gotten wind of it should be included. And anybody who had their fingers on anything to do with these subpoenas needs to be in front of congress. Now, they cant be in front of the Intelligence Committee because thats where the subpoenas went. It would be a conflict. But they need to find a committee quickly. I completely agree that the Attorney General and the Ig Investigation is a very good idea. The problem with it is its slow. And it could take over a year. Were at the point where we have had four years of lying from the Justice Department. And we have to have some we have to have some consequences. We have to have some clarification. We have to have something quickly for the american people to return to have faith in the department of justice. We cant wait for the slow process of the ig. Absolutely. And i share your outrage, the integrity of the Justice Department and the Rule Of Law are foundational in this country, and so this is critically important. Thank you so much for joining us tonight. Was this is a Act Of Pure Political Retribution by Donald Trump in your view . It looks like it. It looks like something that would happen in Putins Russia or xis china, not something that would happen in the usa. So youre a member of congress, just like Adam Schiff and congressman eric swalwell, your colleagues. How does this story make you feel as a person on a Human Level . How would you react if you found out that Donald Trump got the doj to subpoena your Phone Records as well as members of your own Family And Staff . Well, its an appalling abuse of discretion. It is a gross abuse of power, and its shocking. And, you know, in the case of me or my family, i think they would probably find a lot of goofy tiktok videos. But on a more serious note, i think that this is what is considered to be a fishing expedition. When they start looking at records of Family Members or the records of personal staff, that is Staff Members who have nothing to do with national intelligence or the house Intelligence Committee, it looks like theyre just looking for some type of Gotcha Information on these members and others, and i think that is deeply, deeply disturbing and Merrick Garland needs to clean house right now. So, right. Merrick garland is now the Attorney General and hes heading up a department where some of the people involved on the Staff Level in this investigation into these leaks going back to 2017, theyre still there. You think they should be gone . I dont know why they still have jobs. Mr. Ben benuto from New Jersey, but there is a whole raft of Line Prosecutors in the doj who actually carried out this particular investigation and who should have known better. You cannot go to a Grand Jury and start presenting secret subpoenas on a coequal branch of government. And, of course, i think people need to be held accountable up and down the chain, and id like to see Jeff Sessions and Bill Barr testify under oath. I would be very interested in seeing if they say they had no idea that this investigation was going on and they did so under oath. So these Leak Investigations began all the way back in 2017 when Jeff Sessions was the Attorney General. But according to the New York times, they actually were revived by William Barr when he became the Attorney General. I want to play this exchange that now looks very different than it did then, even, from May 2019 between then Senator Kamala Harris and William Barr. Lets take a look. Has the President Or Anyone at the White House ever asked or suggested that you open an investigation of anyone . Yes or no, please, sir. The President Or Anybody else . Seems you would remember something like that, be able to tell us. Yeah. But im trying to grapple with the word suggest. I mean, there had been discussions of matters out there that they have not asked me to open an investigation but perhaps they have suggested . I dont know. I wouldnt say suggest. Hinted . I dont know. I love how then Senator Harris was looking at the source in realtime. But, congressman, William Barr claims to have no awareness of the records that congress was trying or was being sought at that time. Do you want to bring him before congress . And what other questions do you want to ask him . Yes. We need to bring him before congress. We need him to testify under oath as to, you know, what was the scope of this investigation . Who were all the members that were targeted . We still dont know, by the way, all the members that were targeted. Who were all the staffers . And we also need to know why he revived the investigation in 2020 after he im sorry, in 2019 after he became Attorney General. If you recall, it started in 2017. Apparently it died out in 2018. But then in 2019 when he becomes Attorney General, he revives it, and the question was what were the suggestions from other people that led him to go ahead and revive that investigation . And who made those suggestions . Something tells me that the suggester was located at 1600 pennsylvania avenue. The idea is that global leaders are getting together to try to stave off a future pandemic. Now, the main headline from this is that they hope to ready the world to confront the pandemic and come up with a vaccine for a new disease within 100 days of a pandemic appearing. So this is, you know, lessons learned from the covid19 pandemic. But the other thing theyre working on and talking about today, the big headline, is infrastructure. Thats quite a bit different from Joe Bidens Infrastructure Plan domestically. The idea is theyre trying to confront chinas huge global Belt And Road initiative, which has seen china lend and give money to developing economies to build up their infrastructure so china can trade with him. The g7 hopes their plan will be a more ethical plan to chinas expanding power throughout the world. That was Nbcs Matt Bradley reporting. Now, we turn to the other half of the bidenharris administration. Vice president Kamala Harris is taking a little bit of heat from both sides of the aisle after she said this while on her trip to central america. I want to be clear to folks in this region who are thinking about making that dangerous trek to the united statesmexico border. Do not come. Do not come. Republicans pounced on the comments, of course. But they also didnt go over too well on the left, including with representative alexandria ocasiocortez. Given that immigration is one of the most complex situations we face as a country, a situation where there is no quick fix, is there anything harris could have said that would not have drawn criticism, as a woman, a person of color and the daughter of immigrants herself, the first ever Vice President who isnt a white man, by the way, always remember that, is harris being held to a different standard . Lets be honest about that, up top. I think this line from your recent Op Ed in Usa Today sums it up well. You wrote as a woman of Color Harris would be getting much more intense and negative blowback if she had flung open her arms with a huge come to America Sign and came off as soft on immigration on her first official trip to guatemala and mexico. So she didnt have a whole lot of options when it came to messaging on this trip. What do you think of how she did . You know, i think this was a really tough topic, a really tough portfolio. And for her first trip or her first international trip abroad. And it could have been a tough portfolio for even a seasoned diplomat. But because she is a woman and a woman of color, the level of scrutiny that she is getting from both the left and the right is really off the charts. And, you know, it is interesting that you mention the part about white men because we always give them the benefit of the doubt. No one criticized Jared Kushner once for not delivering peace to the middle east. But people really do expect Kamala Harris, our Vice President , to solve the Border Issue overnight. All that being said, and i know she is in a really tough situation, it was jarring to hear this Administration Sound so much like the last administration, especially on the issue of immigration and because she is the daughter of an immigrant. But as i say in my Usa Today piece, as the first black and first asian and first woman to hold the second most powerful job in the country, she cant keep anybody happy. Its not possible. You know, one of the things i think is really important to always remember is that the intention behind a critique, that matters. So the intentions behind the critiques from the left, theyre really different than the criticism she gets from the right. Theyre like, go put on the little vest and stand at the border and do cosplay. Speak a little bit more to what you just said about how it was jarring for the daughter of immigrants to say, do not come. I mean, you know, how can she say something different that is more authentic to her own experience . Exactly. Well, you know, shes the reason shes in such a tricky position is because the republicans are very good on this issue. Not good on this issue with solutions and policy, but with their messaging and with their false information. And basically lies. They have framed this issue. So they have their Talking Points already ready to go. To be quite blunt with you, it is shocking that the Vice President wasnt briefed better, wasnt prepared better with her language on her wording on such a complicated issue because for the republicans going to the border is a photo opportunity. Kamala harris is tasked with solving the root issues that drive the Border Crisis. So, you know, while the republicans are pouncing on this, the messaging around it is the fact that it is a very complex issue and, so, while republicans are very good with images, the dems need to get better around our messaging because we kind of sent the Vice President to the Lions Den on this issue. It feels to me like we cannot forget how complex this issue is. And sometimes im like if a criticism is why didnt you go do this thing instead of that thing, then explain to me how doing a, or this thing, would help. Yeah. Women and men arent assessed through the same lens. Thats one thing we have to keep in mind whenever were talking about the Vice President. Can women get angry and actually show it . Is that something that we are going to have to get used to now that we have a Vice President in Kamala Harris who is a woman . How does she navigate that dynamic . It is so tricky. And its full of land mines. And as you and i know, and especially as you know as a black woman, women of color, were not allowed to get emotional or be angry. We will be dismissed and written off as hysterical so fast, faster than you can say border. Which is what i talk about in my upcoming book, we will be labeled and dismissed. But i do think Kamala Harris is in a tight spot and people have to remember our Vice President is not going to be able to solve Border Crisis overnight. Its only been six months, everybody. There was a major development friday on efforts to address restrictive voting laws passing in states all across the country. Attorney general Merrick Garland announced friday that the department of justice will expand their votes Rights Unit and make protecting Voter Access a top priority. There are many things that are opened to debate in america. But the right of all eligible citizens to vote is not one of them. We are scrutinizing new laws that seek to curb Voter Access and where we see violations we will not hesitate to act. We are also scrutinizing current laws and practices in order to determine whether they discriminate against black voters and other voters of color. This comes as democrats confront the reality that their window to Voter Protection laws appear the be closing. The John Lewis Voting Rights Act is working its way through the senate but with only one single republican so far committed to supporting it. The likelihood of passage is pretty slim. For more, were joined by hayes brown, a Writer And Editor of msnbc daily. Great to see you, hayes. Thanks for joining us. Glad to be with you. So you have written a lot this week. I mean just period, full stop. But specifically about Voting Rights. Whats your reaction to Merrick Garlands speech this week . Is it too little too late . I mean, im very glad that this is a top priority at the Justice Department. Im really glad that after four years of the Trump Administration basically leaving the voting Rights Section of the civil Rights Division shut down, im glad to hear garland is about putting more resources into it. Im not sure how much they will be able to do right now. One of the things thats really interesting is they will be doubling the amount of staffers they have, working on voter right enforcement. But No One knows how many are actually working there right now. I tried to ask the department of justice yesterday. Havent gotten an answer yet. New york times doesnt know. So i want to see how much how much resources is garland going to pour into this because it is going to be a lot, between the scrutinizing of the new laws theyre talking about, when it was stripped away by the Supreme Court. They will be looking at redirecting now that this is the first cycle for redirecting where the states decide to redraw the lines based on population from a census. Since this law since the voting Rights Act was taken down by the Supreme Court. So it will be interesting to see how they struggle all these various different things and how much time and Energy And Money theyre willing to pour into the lawsuits that will be necessary to roll back these changes. There is also this important point, which is that, you know, lawsuits take time. Challenges to laws take time. So while the doj is over here hiring lawyers and getting them to work on that, you know, congress has the John Lewis Voting Rights Act sitting there. They also have Hr1 Or Sr1 sitting there. But they need nine additional republicans for the John Lewis Voting Rights Act. There are zero for hr1 or s1. Listen to what Mitch Mcconnell said about that on tuesday. There is no threat to the Voting Rights law. Its against the law to discriminate in voting on the basis of race already. And, so, i think it is unnecessary. What is your reaction to that . Not surprised because, i mean, Mitch Mcconnell has had years. So in 2013, the Supreme Court in Shelby County Decision said, okay, sections 4 and 5 of the voting Rights Act, you dont need them anymore. Which states the doj could look at and say, okay, give us your election laws before they are enacted and we will decide whether they discrimination. They took action against those laws before they could come into effect. That got taken down. Mitch mcconnell has had years to correct this because the Supreme Court said these are old, outdated. This is outdated. Congress, do your job and rewrite this because right now its unconstitutional. Mitch mcconnell has said no for years to updating the voting Rights Act. There have been no proposals from republicans, despite many of them sitting in the Senate Voting for previous reauthorizations. Im not surprised that mitch is like, no, its fine. Its hard of his schtick for a while now especially now that we see these actions in the states from republicans. Im not surprised this is whats coming out of his mouth. We got the right to vote as Black Americans a really long time before we were able to actually vote. It was legal but, again, what you are able to do not always the same. So lets talk about senator Joe Manchin for a moment. His logic here is that he wants these Voting Rights bills to be bipartisan. But the ones that are passing on the state level, they are partisan. Explicitly republican and partisan. So doesnt his position seem to be contradictory when it comes to his opposition to the bills that are before him in the senate . I completely think so. I think it would be easy for him to justify by saying, no, the federal level, the state can do what they want, et cetera. Except thats wrong. Thats a bad idea. We have seen what happens when states are given the ability to pass laws that are discriminatory against their voters. That is something that we have worked very hard as a country to stop the states from doing. Now here we are ready to allow it to happen again . I think that manchin, part of it is that he comes from this culture in West Virginia of democrats and republicans arent that far apart trying their best to work together. But it doesnt work together on the federal level right now. None of What Manchin is talking about works in the senate where he can turn to them and say, if ten of you vote for this, you are i dont Think Manchin is thinking about how this works at the federal level right now. This morning, in a statement commemorating the event, President Biden called on congress to pass Gun Violence Prevention measures and address what he called a public Health Epidemic of gun violence. In the coming days, the president will sign a bill designating Pulse Nightclub as a national memorial. Biden wrote in part the bill will enshrine that Pulse Nightclub is hallowed ground. She spent the last five years trying to understand what took place at pulse. So much has changed. Where i am kind of ebbs and flows every single day throughout the year. I know its been five years. And sometimes it feels like its been a long time and sometimes it feels still like yesterday, and i think its just because either of things you see or how you wake up this morning. It hits you at certain kinds of moments. But students are challenging the power of that institution and took people known as its, quote, social center. Professor Amy Chua and her husband New York magazine detailed allegations against her, abusing her power over the Clerkship Process and engaging in excessive drinking with students in her home. Chua spoke to the magazine. She denied hosting the parties, but she did admit to inviting students into her home for mentorship. She said she was publically humiliated with a falsehood. One of the reason i was interested in reporting on this is this nexus of power that you mentioned. That four Supreme Court justices sitting on the court right now attended, including Brett Kavanaugh and neil gorsuch, sewn Ya Sotomayor and samuel alito. The kind of pathway to power goes through Law School, but it goes through professors who can recommend students for all kinds of opportunities, chief among them the clerkships. If you get one of these clerkships on the Supreme Court, it puts you on a glide path. In corporate law, it can involve a 400,000 bonus just to sign a deal with a law firm. Six of the nine Supreme Court justices clerked on the supreme Court Court themselves. It might even lead you to the Supreme Court. Its sort of a pipeline to a lot of The Powers That Be right now. So for two individuals who happen to be married to each other, happen to be pretty colorful characters to now stand accused of abusing that power by a whole new generation of students, this pointed to a new conflict that there were people going forward through official challenges, saying there had been an abuse of power play.
