They didnt have that Intelligence Led Structure you would see in a lot of larger police departments. They didnt know how to pass it through and prepare. Separately and it was vague in the report what do we want the Fbi And Department of Homeland Security to prevent this . Will we allow them to look at Social Media posts available in the open to make an assessment or judgment. The report leaves us wanting. It doesnt clearly articulate what needs to be done. I am sure from the fbi perspective, any reports that came in were from President Trump supporters. If it had gone around that President Trump supporters would be rallying at the capitol, what do you think that would be . Fbi is spying on the Trump Campaign and free speech and i think the conversation would be different. What the derek tore said, of those 500 people that stormed the capitol that day, he had no impetus to investigate them prior to them breaking through the doors of the capitol. What we really need is to make sure the companies or other organizations who are victimized Reach Out and coordinate with the fbi and with our partners as quickly and promptly as possible. When they do that it helps us to take creative action which we cant always do. The ransom that colonial paid was impressive, but it seems like a lot of this has been going on without us knowing about it and it will get worse. Ransomware attacks is only going to get worse and a lot of it we know because local governments or hospitals make It Public they were hit. The fbi said why dont you tell the companies not to pay the ransom. He said we Cant Order them not to do it. We advise them not to do it for a couple of reasons, it encourages this kind of behavior, because when you pay it, it rewards their behavior. Secondly he said you pay the ransom and the key you get to open it is not effective. Colonial pipeline said the key they got back was pretty effective at getting their systems back. That was his advice. His main advice is tell us as early as you can which is what colonial did in that instance. Pete, what would you say is the level of threat associated with these Ransomware Attacks. He seems to be comparing it to some of the worst attacks we have seen. He made that point of 9 11, he is not comparing the severity of Ransomware Attacks to 9 11. But he is saying it ought to get a unified response coming together to fight this. It is on the rise and for a couple of reasons. One of it is the success of it. But the second way is that there are now these ransomware middle men that make a Ransomware Kit you can use. The proposal we are looking at is taking all serious crimes out of the Chain Of Command and giving it to trained military prosecutors. Thats the bill we have been debating for the last eight years. We drew a bright line on crimes that have more than a year of punishment. We think professionalization will end bias and more cases will go forward. And we want the bright line because of other issues. We have racial disparity of who gets punished. If you are black or brown you are two times more likely to be punished and we have data if it is a Capital Case you are more likely to receive capital punishment. What we heard from General Milley as well as our Secretary Of Defense, they are both open to removing all Sexual Assault crimes and related crimes out of the Chain Of Command. That is a huge step in the right direction. They have never said that before. What i asked and pushed in this hearing, are you open to the bright line of all felonies, not just one or two crimes, but all serious crimes. I gave them the data on racial disparities and they said they were open on that as well. We dont want to make a mistake. We have a onceinalifetime ability to fix the military justice system. We believe the bias in the Sexual Assault cases and lack of training is so important. Over the last three years we have data it is affecting racial disparities. We believe this is the right way to go. We also have the support of history and what our allies have done. Ux, israel, germany, netherlands australia. This is having a professional unbiased individual who doesnt know the Perpetrator Or Accuser and who has no skin in the game to make these decisions based on Evidence And Evidence alone. You spent so many years trying to build support for changes around this policy. And you are at the point where it seems, in terms of cosponsors, if you were to put it on the floor it would pass the senate, but we are seeing opposition from the former Chairman Inhoffe and from jack reed who is a member of your party. Do you expect that to change . I hope it will. Both jack and jim are against taking all serious crimesout of the Chain Of Command. Both of them are looking at these issues almost afresh. And this report found that despite all of those calls online for the violence, the police had no plan in place to respond to the threats and that that was the result of a failure in leadership. If you were making the decisions here as an afteraction report, what would you recommend be changed . First of all, i think there was clearly a failure of intelligence and did have information that people were coming to the capitol with the intention of using violence. And they had a couple of weeks in advance according to the senate. Equipped Capitol Police, should have brought reforcements in and they should have worked out an arrangement with the National Guard to supplement their resources. By not doing that, they create Aid Highrisk Situation which led to death, violence and destruction. But i think theres the broader issue, too, kacie, not just to look at the Capitol Police but all the elements of government. What led up to it, and what was available in advance that could have been used to prevent it or mitigate it. Do you think the only way to do those things as you suggested is to have a 9 11style nonpartisan or bipartisan commission to investigate . I think you need a bipartisan commission that can subpoena people to testify and can get documents and also for online media. The model of the 9 11 commission is a good model. Weve used that before in the Warren Commission after john kennedys assassination, another example of that. The key is not to be constrained by avoiding things that are politically difficult but to look honestly at all the facts that were available, what was done and what wasnt done. Who is going to investigate President Trumps role, for example . Do you think well ever get answers to the questions about what he was doing that day, why it took so long for the National Guard to show up, Et Cetera . Those are different questions. There will be online activity perhaps, maybe some physical evidence. Whether or not he will ever be required to testify, i would be guessing that. Even beyond that theres information out there in Social Media about what people were talking about doing, which whats ironic about this is unlike as has been the case in the past like with 9 11, where the plotters operated in secret, here the plotters boasted about what they were going to do openly. Acquiring that, organizing it, following up on it should be a relatively straightforward but very important task. So, widen the lens here a little bit, mr. Secretary. A single effort to undermine trust financed by people with a political agenda in a situation in which recounts were done, courts uniformly reek re injected challenges. The socalled quote audit, close quote, is a proop that has no experience in doing this but has publicly said they have already decided what the result is, which is there was a problem with the election.
