Connection beginning with the gops nonstop attacks on our democracy. Unlike when we watched the nation of a mob of trump supporters attempt to overturn a democratic election on January 6th, dont be fooled. Today those efforts continue to thwart democracy. Theyre still happening but theyre unfolding in slow motion. This time not only through violence but through policy as well. Now across 14 states republicans have enacted 22 new laws this year that restrict access to the ballot. Thats according to the brennan center for justice. Its not just bills. Gop lawmakers from pennsylvania are calling for an audit of the states 2020 ballots and this is inspired by the ongoing audit happening in arizona. And in texas republicans nearly passed Senate Bill 7 on sunday which gives judges the ability to cancel any Election Result based on Nothing But Hearsay from partisan pole watchers. It does other awful things too. Democrats were able to temporarily block the passage of this bill by literally walking out, a dramatic move thats an example of what may be necessary to protect the bedrock of our democracy. Joining me now to discuss, cliff albright, Founder And Executive director of black Voters Matter. And sean moralis doyle, Deputy Director of the Voting Rights and sean youre going to kick us off. I am frustrated and terrified. In red states, republicanrun state legislatures. Im curious, what can we do . How do we stop this in our tracks . We are seeing democracy erode. Is there anything that can be done at the local, state, federal level to bring these efforts to a Screeching Halt . Yes, i think there are some things we can do. It certainly is scary. The first thing we can do is if we live in states that are passing restrictive laws, let our voices be heard. Fight back in public. Shine a spotlight on what is happening here so they Cant Pass laws without anybody realizing it. We saw just last weekend in texas that sometimes that fight back can be successful. We saw in georgia a law that was terrible, still was terrible when it was passed but some of the worst portions were taken out when it was passed. Number two, continue to talk to our legislators in congress and tell them they need to stop this. They have the power to put an end to this bypassing the for the people act and John Lewis act. There are a lot of things that stand in front of that. One is filibuster. The other two is Manchin And Sinema. If this was happening in other countries, can you imagine how america would report on this . If we were watching a super Powers Democracy erode it would be huge news yet in america these things continue to happen in texas. I understand democrats walked off. That only temporarily blocked this horrible bill. Whats going to happen when Governor Greg Abbott calls a Special Session and some of these deleted provisions will find their way back into the law . Then what . Thats why its so important that we see federal action because our governor and republican leadership is Hell Bent on passing this sweeping package of Voter Suppression bills. Theyre even going to call a Special Session for it. And we need in Washington Krysten Sinema and Joe Manchin to show the same conviction. They are standing in the way of the passage of Hr 1. In an attempt to maintain a rule, a rule that has been consistently used to filibuster, to deny communities of color their full rights as americans. Theyre sending a message to communities of color in the south that our voices and vote dont matter as much as maintaining this rule. We need them to get out of way of progress. I want to be clear for folks to understand whats happening in texas and georgia, these assaults on democracy are not just about attacking the rights of black and brown voters. These are an assault on everyone. The impact is on everyone. In texas if legislators actually had to respond to the will of the people of texas, they wouldnt be passing Bathroom Bill bans, they wouldnt be passing these Voter Suppression bills and they wouldnt be passing Abortion Restriction laws. Instead theyd be passing laws to make the minimum wage 15 an hour, 1. 5 million more texans would have coverage. So i take your point about it doesnt just impact black and brown voters. I think thats true. Cliff, Look, one thing that bothers me about this entire Story Line is these Voter Suppression rules are based on the Big Lie. That actually is the Big Lie. Voter suppression has always been a huge issue, originally targeted to black voters which We Saw during the jim Crow Era and i believe still targeting to voters of color now, particularly black and brown voters who tend to vote democrat. What is the work of black Voters Matter . You are in every southern state, a couple of swing states. How has the work of black votes matter been able to beat it back and whats the plan going forward and what can people at home do to step in. Thanks, tiffany. Our work has been around a number of issues. We use a variety of strategies. So were using litigation. Weve got two lawsuits right now. Weve used corporate Accountability Campaign which we started in georgia along with some of our partners here. Then we were able to get in touch with our friends in texas and to bring it out there and with the momentum that was already built in georgia, that played a role along with some other Organizing Phone calls, et cetera, that the organizations were already doing. But it all came together to play a role and then giving the democrats there the confidence to walk out, right . I have a pending update where i talk about four lessons that come out of the texas experience. One is the lesson that the legislative strategy has to be combined with direct organizing, Grassroots Organizing and direct tactics. We didnt get the 1965 voting Rights Bill to begin with just by voting for it. It took massive demonstrations and Bloody Sunday and the march on washington. Thats why were launching a Freedom Ride going from the south to d. C. From June 19th to june 26th. Ill be Looking for that Freedom Ride. Sean, i want to come back to you on this. Christina made this point, the filibuster is standing in the way of enacting Hr 1 which would essentially federalize a lot of these rules around Voter Voting rights and protection. If you had an audience with Joe Manchin and Krysten Sinema who are Hell Bent on bipartisanship, whats your advice . The filibuster cannot live while democracy dies. My advice is if you are waiting for bipartisanship on these issues, were not going to get there from all indications and this is too important of an issue to let die because of a procedural mechanism like the filibuster which, as christina already said, has been historically used to stand in the way of civil rights, specifically Voting Rights for people of color. So its time to use democracy and our processes to help our democracy and stop standing on procedure in order to avoid that. Christina, i want to hone in quickly on Senate Bill 7 and say some of the other provisions that have been deleted but, again, could be back in the bill when abbott calls for a Special Session, thats a shutting down of many Polling Places in democratic strong holds where there happens to be people of color and evade a provision to have people removed when they are otherwise determined to be ineligible. The problem is we dont know what determines somebody to be ineligible. Its very vague. Given these kind of tactics happening across the country, you know, do democrats even have a chance to flip some of these statehouses . Texas isnt unique. Like sean said, this is happening all across the country. If we Look at theyre passing these laws across the country but theyre also passing these laws in states that are incredibly diverse and the legislature oftentimes doesnt Look like the population. In texas every year 275,000 young people of Color Turn 18 and the legislative body in the republican party that controls the entire state is largely white and male. They dont Look like who we are today. And so that is why it is so desperate for federal action. As cliff said, Look, cliff and i may not have marched in selma because were too young, but we know people fought and died for us to have this right and were not going to give it up without a fight. Were going to double down on our organizationing efforts, double down on Mobilization And Registration efforts. We need Hr 1 to make sure it comes faster and sooner because our legislature is not enacting the will of the people. All right. Very quickly, cliff. Given whats happening across the country with Voting Rights, can democrats hold the power of the federal government . Yes, we can, but weve got to realize the urgency of the moment. The fierce urgency of now. This is avengers end game. We have to take the battle to the streets, to congress, weve got to take it to arizona, to West Virginia. Thats why were stopping in West Virginia on the Freedom Ride on the way to d. C. Now is the time we have to stop this. There is no more tomorrow. If we lose congress in 2022, who thinks that theres going to be an election in 24 where a Republican Congress will actually accept the Election Results if their candidate loses . Thats how serious this is. Absolutely. Thats my whole point. Has the peaceful transition of power been abandoned . Were going to talk about that. Thank you all for bringing some sense to all of this. Why has the democratic majority in congress not expelled those republican members who stood by and aided, abetted before, during and after the insurrection. The democrats need to get real and get tough because if they dont, theyre playing a dangerous game and our democracy hangs in the balance, tiffany. I think Mike Pence is a traditional republican who is desperately trying to thread the needle in this utter moment of chaos. I spoke to a Gop Fund Raiser this week who said trump continues to be by far their most effective envoy for fundraising. Republicans have suddenly been able to break through in online fundraising. That gets to why someone like Robin Mcdaniel would come out and say something like maybe we will not debate, right . Maybe we will tell the candidates not to debate. There are reasonable sort of arguments in favor of some of the things shes asking for. Shes asking for things like having the debates begin earlier in the cycle. Those are reasonable requests in a normal paradigm which were not in. Really the reason shes coming out and suggesting that, for instance, republicans might cease to participate in debates is because the whole name of the game for republicans is an attempt to erode trust in traditional institutions, right . Listen, we dont necessarily have to be surprised to be outraged. And the nfl, this is on brand for who they are and who they have always been. Thats the whole reason that this Concussion And Brain Injury Settlement had to take place. Lets all remember that this started from a lack of transparency in the first place. So in many ways it shouldnt be surprising to then uncover that the nfl was using Race Norming in a way in which historically it has not been used. Just to give people a little bit more background, Race Norming was something used at the federal level given the testing for employment opportunities, it was supposed to be not really advantageous to black and brown communities so they started Race Norming to sort of account for the fact that they were coming from communities that had a lot more against them. That was the way it was used at the federal level. The nfl decided we going to remix this and use it as a way to not pay out as much money to black players. They basically used it as a way to save money and unfortunately the nfl has september the message repeatedly that they are here for the use, the abuse of black bodies and they could care less about black minds. I couldnt put it any better. I want to play a Sound Bite. This is not about the nfl but i think the message still stands given the lack of diversity among coaches in the nfl. Take a listen to steven a. Nba players are some of the most powerful people in the world. When have they ever spoken up for black coaches . When they have spoken up for black executives, gms, president of Basketball Actions . Lebron, all of them, everybody. Where the hell have they been . You know what, im going to walk away. Now obviously steven was talking about the nba, but i kind of feel like this applies to the nfl which also has terrible diversity when it comes to coaches and i wonder if there were more diverse coaches would we have seen the same policy in the nfl . Do players have a responsibility to speak up about the diversity in the ranks . Well, i want to give people again a little bit of history in terms of the nfl. For a long time we did not see a lot of black quarterbacks . Why . Because it was a prevailing thought and a mentality by the league that black quarterbacks or black men specifically were not smart enough to be leaders of men. That intellectually they could not handle the position. Even now present day you hear in the descriptions of players that that still remains kind of a biased thought in a lot of peoples minds by applauding black players for the athleticism, talking about their physical gifts but never talking about how theyre students of the games. With white player we always hear how smart they are, not the black players. Black men were not thought to be leaders of men and not thought to be intellectually capable. Its that same implicit bias. Its that black coaches are players coaches meaning they can just relate as if, you know, theyre sitting up there discussing hiphop and thats the whole reason why these players are playing for black coaches, right . Theyre not given the credit of being innovators, being tacticians. Thats not something thats the kind of credit given to black coaches. Then you Look at the fact that theyve had one black president in years which the Washington Football Team has, one. These are statements they are making about what they think of black men, leadership, intellectual capabilities. For the players, football is a much different sport than basketball. Theyre quick to tell you god, family, football, whatever order they want to do that in. Because of that i think there is sometimes too much of a sense of one team one fight as in the sense of if i speak out, im going somehow against this general code that we have in the nfl. But while i appreciate steven as passion, heres what i dont like and i think is unfair to black people as a whole and you know this given the work you do. I dont think its our responsibility to be tasked with destroying and dismantling the racial oppression thats against us. Thats saying were more at fault than the White People who constructed the system and the White People who continue to practice institutional racism. This is not to say we shouldnt be the champion of our own causes. White people need to be held accountable as opposed to making it seem like we are the ones at fault for our own demise. Absolutely. So, Look, qualified immunity is a phrase that you will hear about a lot over the next month as senate lawmakers try to finalize a deal on Police Reform. This is one of the major sticking points. Qualified immunity is a legal defense that protects individual Government Officials including Police Officers from being sued for monetary damages for their official conduct except in rare situations. So, for instance, right now you can only sue a cop if you can prove they violated one of your constitutional rights, but not just any constitutional right, but a, quote, clearly established right which is a really high bar. In fact, the only way you can win is if you can point to a past case with similar Context And Conduct as to what happened to you. If you cant, which is likely since no two interacts with Law Enforcement officer, it is extremely difficult to hold Police Officers criminally accountable for acts of brutality. Derek chauvin was the exception, not the rule. So if a bad Cop Isnt afraid of going to jail or losing their job or being sued, whats to stop them from kneeling on a mans neck for nine minutes or shooting a little boy in a park or killing a man with an illegal choke hold . Thats the argument for abolishing or at least reforming qualified immunity, much to the display of the very politically powerful police unions, and that, my friend, is why republicans in congress dont want to abolish the doctrine. Mitch mcconnell claims it will make it harder for departments to recruit officers. One potential compromise proposed by republican senator Tim Scott is making it easier to sue Police Departments, but not individual officers, but, like, seriously, whats that going to do . Thats not a compromise at all since qualified immunity pertains to individual officers and not Police Departments and hello, Tim Scott, i think you know this. You can already sue Police Departments. Congress Cant End qualified immunity which is a doctrine created by the courts and not by elected official and it can act just like colorado raising the possibility of victims of Brutality And Deterrent for the future. Data from the Gun Violence archive shows that as of last week theres been 232 mass shootings so far this Year And Gun sales are at an alltime high, but this may convince some white conservatives to pass Gun Legislation because Gun Ownership among some black folks has also surged. If the first half of 2020 when the pandemic was at full steam there was a whopping 58. 2 increase in Gun Purchases by black men and women. Joining me now is michael singleton, a political Consultant And Contributor for the Boston Globe finally making his premiere on the Cross Connection and daniel webster, director of Johns Hopkins Center for Gun Violence, Prevention And Policy and professor at the Bloomberg School Of Public Health who is wearing Orange Today for Gun Violence prevention. Sorry, daniel. Daniel, i want to come to you on this because Gun Violence really is uniquely an american problem. Why is that and what can we do to get it under control . Yeah. Thats the question we should be asking rid now, and should be for a very long time. You know, our country is does not stand out in most metrics for violent behavior or some of the Risk Factors for violence when you compare us to other highincome nations. We have our Crime Rates are generally average. Our rates of Substance Abuse and Mental Illness and other things like that, bullying. Were about average. We are an outlier when it comes to racial violence and our homicide rates are six to seven times higher than the average other highincome countries and its principally because our rate of Gun Homicides are about 25 times as high. Wow. And so certainly, we can dissect a lot of factors that drive lethal violence, racism, of course, being a key one, but its undeniable, in my opinion that the prevalence of guns and more importantly, the lack of regulation really explains why we are exceptional in a very bad way. Yeah. So, shermichael, your ig is all about the guns these days and this is why i wanted both of you on versus gones guns are good, versus guns are bad. Here we for 2021 pretty much talking about the same issue. You were recently in tulsa and we know for a fact what the economic impact was as it pertains to whites attacking blacks and black businesses, and i am of the position which our focus which weve been discussing for over 100 years needs to be on education and economics for africanamericans and im willing to bet that if given these opportunities many of the black men who have par taken in this violence, and if i cant, quickly, the gentleman who killed my father was recently released a month ago. My grandfather and i were talking to other folks including the guy, and i told him while i forgive you, that theres a part of me that cant forgive you because ill never get my dad back. He also has a son thats 30 years old. As we began to talk about why he did it and the issues that he dealt with growing up that ultimately led him down the wrong path. Its not necessarily the gun and there are other systemic issues that we refuse to deal with as a society. Shermichael, i want to be clear and what i cannot do is lay the increase of Gun Violence at the hands of black folks. I want to make sure that i dont misunderstand you. There are other issues that White People in particular would like to point to, strip the Gun Laws, if you will, thats going to somehow make things better in the inner city. I just wanted to make that point clear because a lot of the mass shootings weve seen have not been at the hands of black people, but im glad you clarified it. Four or five africanamericans and all of the way back to the 1920s that have been, quote, unquote, thing. Its mostly a white thing. Thank you. I want to bring you back into the conversation because shermichael made good points about other issues that can bring down Gun Violence. Im curious where you are on this, because you know, legislation is one route, but hon of thely these mass shootings, the guns were purchased legally and they did a background tech. Would more guns on The Street Squash Gun Violence and i wonder how impactful the Gun Laws have been so far. What do you think . Well, my center and my colleagues and i study Gun Laws and the impact and think, not all Gun Laws hope for impact of reducing Gun Violence, and one thing that shermichael has, and thats an assumption, but thats not true. You can go, in most states you can purchase a gun without getting a license and no training and we have a very unregulated marketplace when it comes to guns and the smaller number of states are nine states now that have reasonable Licensing Mechanisms and requirements of training and so on. We found that those are actually quite effective in reducing all forms of Gun Violence including, you know, Law Enforcementrelated Gun Violence, as well as well as homicides and suicides. So laws do matter, but of course, its not an either or question. I work in the school of public health. We advocate a public Health Approach to this problem and thats addressing all of the issues that were just mentioned as part of that strategy, but the reality is and what the data say is we have very, very lax regulations that allow too many guns in places they shouldnt be. Yeah, and i think thats a really good point. Conservatives have seized on this complaint by a small group of asianamerican students as a way to challenge Affirmative Action Policies that really benefit all students of color. So joining me now is Claire Jean Kim Professor of Political Science of asianamerican steadies at Uc Irvine and Kwame Jefferies at ohio State University and editor of understanding and teaching the civil Rights Movement. Thrilled to have you both here. Claire, i want to start with you, and forgive my ignorance with these questions and this is why you are here to help walk us through this. When we say the aapi community, that includes a lot of people. Im curious why the dissent against Affirmative Action comes from mostly a small sect of the chineseamerican part of the community. Why do you think that is . Well, this particular group of chineseamericans are a conservative, affluent, Immigrant Population that mobilized into these views to protect the educational opportunity their children and that theyre affluent it speaks to the kind of interest they have in ending Affirmative Action. And thats a good point and hassan, let me ask you because this logic suggests that, you know, that asianamericans that the number of white students should remain steady or increase while, you know, the changing Demographics Shouldnt be accounted for when it comes to college admissions. So in a way, this could be perceived as Affirmative Action for white student, but i know the Bottom Line is black students are not the enemy. Whats your take on all of this. The principal force driving these cases and serious cases since June 2014 have been White Folk who are adamantly opposed to Affirmative Action, and so in a way the use of asianamericans to front this a term. To end Affirmative Action is just that. Its a Smoke Screen for the preservation of the privilege of whiteness in the highest echelons of education. I completely agree with that, very well put, and claire, i will ask you because i think there is something that we have to address and that is there are studies that indicate that asianamericans are discriminated against when it comes to college admissions, not at the cost of, you know, to black students, but there are studies that suggest asianamerican applicants need to have higher grades and Test Scores than other applicants including other people. Why do asianamericans need higher achievement to gain admission and if thats the case, why not Target Legacy kids like Jared Kushner who clearly allegedly fell short to get into harvard, but his dad wrote a big check so he got in. How do black students and brown students become the enemy of this movement . I dont think its true that asianamericans need to do better than other students to get in. Were talking about different kinds of criteria for admissions. For example, harvards Admission Plan with the raceconscious aspect is a holistic review of students and race can count under its race conscious submission as one plus factor in its overall assessment and the overall calculation for a lot of asianamerican advocates who have been defending the plaintiffs in this case, and in the harvard case. Theyre focusing on grades, Gpa And S. A. T. S and if asianamericans are doing best on these two measures, why arent they doing better in their admission rates. Those arent the only two measures that predict or constitute and harvards plan Looks at trying to get wellrounded applicants and Looking at different kinds of criteria for performance, and so i dont think its true that asian americans have to do better, but i do want to echo Hassans Point that what we are seeing with this new population of conservative, affluent, chinese immigrants is their right Wing Agenda is dovetailing with the longer standing by white conservatives namely and its significant that you ran that piece about texas right before this piece because in texas that Voter Suppression effort that were seeing all over the country has been enabled by ed blooms sponsorship of the Shelby County Holder case in 2013 which effectively eviscerated the voting Rights Act of 1965 and opened up the door of the Voter Suppression laws at this level and the students for fair admissions versus harvard university. Its very important to see theres been a longstanding effort by bloom and his associates to move us back to the period before the civil Rights Movement and the fact that asianamericans are now coming in with the sponsor of this Case And Fighting against Affirmative Action on other fronts dovetails with that larger effort. Asian americans comprised of 26 of the incoming class which is up from years ago. We are seeing an increase of aapi students are being admitted, but im glad you and hassan brought him up, and he had a hand in that, clear, he challenged Redistricting Process and its interesting that this is an interest of conservatives who normally reject identity politics. Hassan, a campus thats considered too asian or too black or too latino is seen as problematic, but this is all in comparison to White People. So why are predominantly white campuses considered the norm by a lot of people who support this movement. First, its important to point out that this is not about fair admissions because as you noted, if it was about fair admissions then people would be targeting Legacy Admissions and people would be targeting students admitted simply because their parents gave large amounts of money and that far outweighed students of color who have been admitted and thats important to point out, but it is also a reflection of this idea that the most privileged spaces in American Society belong to White People. This is an effort, the effort to roll back affirmitive action in all of its forms, race conscious including race in Making Decisions at any level to any degree is a direct assault on the preservation of white attitudes and white beliefs and white behaviors and we are seeing that not only being expressed in this attempt to end Affirmative Action admissions and higher education and also pointed out in the wave of laws designed to suppress voters, voting, black voting, but then also in these anticritical Race Hysteria and pro serve the people in higher education and also the ideas because these institutions like harvard, like yale and the others are aware of the ideas of society, the leaders of society are generated. You keep that white and then you keep the idea of whiteness intact. Speaking of keeping the idea of whiteness intact, claire, what about the impact of a conservative Supreme Court because if this case goes before scotus, how are you optimistic in terms of this . Whether they will hear this case, its likely that they will hear it and if so, well get a discussion by probably next summer of 2022. The court his a sixperson Conservative Bloc right now. It is the most conservative Court Weve seen in many decades and in addition to justice alito, thomas and roberts all we need two of the three Trump Appointees to go along with them to get a ruling that goes against harvard and checks down Affirmative Action and higher education in the u. S. And it is an impactful case and it is important to point out that the majority of asianamericans support Affirmative Action according to polling. We also know that the asianamerican advocates at the national level, for example, an organization of Asianamericans Advance in justice, theyre strong supporters of affirmative Action And Theyve submitted amicus briefs in the Affirmative Action including this one saying we support the action plan. Yeah. Conservative, affluent chineseamericans who are claiming to be speaking for all other asianamericans when the other asianamericans. Claire, well keep our eye on this.
