Holiday with a deeply personal remembrance, and a park of democracy. The Memorial Day 2021 comes at such an uneasy time in our nations history. Biden began the day at the arlington cemetery. After laying a wreath at the tome of the unknown, biden spoke of his late son, beau, and The Fallen veterans he said made the Ult Malt Sacrifice to protect our democracy. Each and every day, democracy It Sft is in peril, here and around the world. What we do now what we do now, how we honor the memory of The Fallen will determine whether or not democracy enduring, democracy thrive, when people have a right to voe, and a free and independent press pursues the truth, founded on facts, not propaganda. To why its such an uneasy time in the democracy, it comes as several states in the midst of passing laws that will restrict voting in the country. A falsehood that the 2020 election was rife with fraud, stolen. Late last night, democrats in the Texas State Legislature staged a Walk Out to sweep an overall of State Election laws. The move meant that last Nights Session lacked d decorum, and Governor Abbott has indicated i had will call for a Special Session of the legislature to restart the whole process, democratic texas lawmakers say they will ready for that. We have plenty of tactics and strategies at our disposal and we will fight every single day to protect the sacred right to vote in texas. We know what happens in florida, georgia, and if they team roll us here, they will make it very hard for everyone to vote. Meantime, all the way in the east in washington, democrats on Capitol Hill are trying to figure out their next move after republicans on friday blocked the creation of a commission to investigate the 1 6 riot. Schumer and Speaker Nancy pelosi are now planning their own Committee Investigations in the attack. Pelosi could also set up a Secretary Committee focused solely on the attack, handing democrats unilateral Subpoena Power and a much longer Time Line to investigate whatever they want. Democratic congressman jason crow, who served in iraq and afghanistan, and famously witnessed the 1 6 attack from the the balcony, says his caucus needs to get to the bottom of what really happened that day. This has to get done. I am sick of playing the game of Whack A Mole with gop members in congress. Every time we address one of the concerns, another one pops up. You cant continue to do that forever. We need to get answers. Today was also the first holiday with the pandemic seemingly in retreat in our country, with restrictions largely rolled back and over 51 of adults now vaccinated. There were crowds just about everywhere the weather would allah it. There is still work to be done. The be the has a dole of 70 of american adults to be vaccinated fully by july 4th. Its a number that should be very achievable. Lets bring in our leadoff guests on this Monday Night. Peter baker, the veteran journalist and chief white House Correspondent for The New York Times, and neil, he has argued dozens of cases by Supreme Court, and with us Oi Phone on the story out of texas, abby livingston, Washington Bureau chief for the texas tribune. Peter, i would like to begin with you, given the life you have led in this country and overseas, all the stories you have chon chronicled as a journ, how striking was it to hear our President Call Democracy in peril . I think we have heard in recent times, the democracy we thought that is cemented is fragile. The institution, the norms, the standards that we believed were rock solid in the United States have been vulnerability, just as we have seen in other countries around the world. I spent four years in moscow, a correspondent for the Washington Post, and i have traveled to the middle east, and we have seen in recent times, stories i would have only imagined here we would have covered as foreign correspondents, and the people who fought and died to protect the country, whose memories we honor today, did so with the idea they were defending a robust and healthy democratic system, one i think we do need to protect and guard, whether on the Battle Fields Or in sigh sighty, and no matter what party were in, we give thanks to those who stood up for us, and we think about the role we have to play, making this a more perfect nation, as they say. Abby, peters last point, this brings this story to you. Because it brings to the story to texas, and the prong of this, that republicans in that state are busy and trying to achieve tell us how long democrats are stave that off, and what power the democrats and republicans have regarding a Special Session. Well a essential session is called by the governor, texas has weak executive. But how long is really not the specific question. Its when. So the governor, there will be a Special Session in the fall. So its a matter of when did they pick it up again . In june or the fall and its very unlikely that democrats will able to override it. I think it did inject enthusiasm in the State Party and national democrats to have a cause on the voting Rights Issue to jump on to. I want to return to this topic with you, and neil, we asked 30 different versions of this question to you and the former feds we rely on in times like this. What power does the federal government have . What power does the when states are working so hard, and in some cases, passing laws signed by the governor to restrict voting . There is a bigger point here, there is a forest and that unites a lot of what were talking about, in texas, the January 6th commission, bidens remarks you just averted to, and the republican party has become an antidemocracy party. And when the democratic party was named and originated, i dont think anyone thought that to be controversial, you are in favor of democracy. Now, you have to view the Texas Vote in light of so much else the republican party is doing, like a concerted effort in georgia and other states to role back voting, a slavish devotion to a filibuster that bear no, Sir Relationship to the Fill Duster that is empowering of a small minority. You have a party that is scared to have people vote in washington, d. C. And puerto rico, you have a party that is this is an antimajority party in The End, and its a collapse party. Its a party that lost its moral ground. Its like the ussr in the world war. Yeah, they have Bluster And Strength and insults but they dont have purpose anymore. To answer your question, because of the supreme Court Decision in 2013, the federal government is fairly limited in the powers it has. I argued the case in 2009, and the voters right act that was reversed in 2013. The John Lewis votings Rights Act that would restore that act. When texas tries to pass a bill like this, it would require preclearance in washington, d. C. That it is the way it operated since 1965 but now it isnt because the supreme Court Decision. I do feel we will have more and more antics like this on a party that is bent on these antics. Peter baker, with all of that in mind, lets talk about this White House, the administration, you cover. If Joe Biden was our guest on this broadcast tonight, if i asked him, okay, start of business tomorrow, tuesday, post Memorial Day, 2021, name your Number One priority, if you had to. What do you think, peter, the answer would be . The Number One priority is finishing up The End of the pandemic. Make sure that the vaccinations continue to be distributed. To edge courage people to get to the herd immunity, and in the process, we dont step backwards. We dont have flareups or variants, and along with that, comes with the rebuilding of the economy. Those are Number One. That is what you have been doing since you took sfi. He is trying to mace it an infrastructure argument. We build our severals up stronger, and the way we do that is to make sure that airports and roads and bridges are strong. That is a Way Tof taking one argument and transitioning it to another. But that is a big issue this week. Will they, in the next seven days, be able to come up with a deal to pay for feign structure, and get it done . And will they receive on the strength of the democratic majorities, and think you think both parties agree on. Abby, back to you. As no one needs to remind you, the democratic Fever Dream of a Blue Wave in the state of texas did not materialize this time around, though trump did not carry the state by all that great a margin. What we have seen is republicans doubling down on the republican. Abby, if you were to take a statewide poll, lay out clearly and concisely what this Voting Measure would do, what would outlow that is now allowable, where do you think texans, the population, would come down . That is a hard question to answer. But what i say, the smartest piece of analysis came The Morning After Justice Ruth Bader ginsberg side. And it puts the emphasis on them having a shot, and many people voted for Joe Biden, and he lost by six points, the closest margins in a generation. But the problem with the Texas State Legislature, and the reason why people outside of texas should care this is where the Supreme Court this is the laboratory of cases that go to Supreme Court. The democrats are not able to take Back Pow sore they can pass laws like this, and keep pushing the envelope. Neil, before we lose you, lets talk about Mike Flynn. He was national security adviser, if you can believe it, for all of 22 days, and now, a story that has gotten a lot of exposure, a qanon convention, he wud asked why what happened in Myanmar Cant happen here. And the their heses cheered, no reason, should happen here. In a country where we consider speech protected, is there any remedy, certainly any legal remedy for talk that is straight up dangerous . This Network Wont Air the clip because of its ability to incite, and thats how dangerous the words are. Yeah, its a ridiculous, preposterous idea that it comes from a former Flag Officer from the use is beyond appalling. I understand he tried to Walk Back the counts and try to think it means something else. Everyone can listen to the tape for what it is. This is coming from a guy who pled guilty to two different felonies and and he got two different pardons. He admitted to being a federal felon while he was a national Supreme Court security adviser. Hoe was one step above god, in the White House. This guy was a felon while he was doing the job. I dont put much stock in him. Absolutely, if someone is giving speeches like this, they do start coming close to, and you can trample the line between protected speech and beyond that. I think our network is doing something responsible here. And this guy is not responsible. He is a disgrace to our democracy. Wasnt he accused bay federal judge in Open Court having sold out his country, not a charge you hear too, a retired flag center, and former national securitied a virz. If someone wants to have a coup, im in the sure this the guy you want to do it. A guy who lacks credibility, any sense of honor and decency, he is go back to russia. To our getss, we are so grateful you have been able to join us on this holiday Monday Night. Peter baker, neil catiole. With youty. Coming up, as the president Put It, democracy itself is in peril. We will talk about this growing political divide with two of our favorite thinking, and a man who has fought and bled for democracy. The truth withdraw from afghanistan, on the words of a retired general, all this as the Twohour Edition 11th gets under way on this Memorial Day Monday Night. His Memorial Day Monday Night. Welcome back, america. It sure is good to see you. Im norm. Im szasz. [norm] and we live in columbia, missouri. We do consulting, but we also write. [szasz] we take care of ourselves constantly; its important. We walk three to five times a week, a couple miles at a time. Weve both been taking prevagen for a little more than 11 years now. After about 30 days of taking it, we noticed clarity that we didnt notice before. Its still helping me. I still notice a difference. Prevagen. Healthier brain. Better life. The americans of lexington and concord, new orleans, gettysburg, the argonne, normandy, afghanistan, iraq and thousands of places in between. These americans were not fighting for dictators but democracy. They werent fighting to exclude for enslave but to build and broaden and liberate. President biden using his first Memorial Day as president to stress the need to preserve our democracy. His words especially pointed as republicanled State Legislatures push ahead with their effort to make it harder for americans to vote. Back with us again tonight, caroline randall williams, writer in residence with department of medicine, Health And Society in nashville. And tim miller, contributor to the bulwark, former Communications Director for jeb bush. Appreciate you lending your time on holiday Monday Night. Tim, start by playing some of what texas congressman said on this network earlier. Stopping certain americans from voting, thats how you lose your democracy. Were having a sanitized conversation about this, pretending its democrats and republicans and usual push and pull. This is not usual. This is not normal. Talking about being able to overturn elections because you want to have Fraud Allegations or stop certain groups explicitly from voting is totally outside the bounds. Tim, we long ago prohibited normalizing reporting on broadcasts like this one, but my question to you is, are we diminishing this threat by not treating it as an emergency with each passing day . Possibly, brian. First i want to thank any of the veterans watching, anyone with a Family Member lost fighting for this country. Good to be with you all today. I agree with what Representative Allred was saying and President Biden earlier today. There is a danger in diminishing this threat. In politics that manifests in two ways sometimes with the democrats. Sometimes manifests as were not acting enough like its emergency, maybe arent willing to sacrifice or give up enough to make changes to get something passed. Look at hr1 debate. All or Nothing Attitude is not right in middle of an emergency. Another way It Manifests is not using all the tools at your disposal in an emergency. Thats what the texas democrats did exactly right tonight, the national democrats, allies that former republicans like myself can all learn from. Hey, this is emergency situation, we need to act as such and sometimes that means going outside of your usual norms of opposition, going outside of your usual procedural rules and regulations in order to block something from happening. Obviously this is just kicking the can a few months in texas but i think it sent a signal and planted flag in important state in this fight. Texas is ideally for democrats the next georgia, next place of emerging diverse, big state where these fights need to happen and pressure needs to be put on republicans. If theyre going to try to block voting rights, people in suburbs of houston and dallas who have been leaving the republican Party Need to know about it and fight needs to be front and center and texas democrats have done a good job with that. Professor williams this is where i say im older than both of our guests and this is where i add i have grown up in this country trying to pay attention to events like anytime our President Speaks at gathering of note. I Cant Recall other President Ial addresses even on Memorial Day going back decades, i fear i will recall the day an american president in the modern era declared our democracy in peril. Speaking of moments you never think youre going to witness and words youre never going to think will be spoken seriously by the president. Caroline, did you find that as bracing as i did . And is there any remedy in your bag of tricks at vanderbilt that you reach to that you think of during times like this . I found it bracing in the way jumping into cold water that you meant to jump into is bracing. In the sense that i think its clearminded and speaks truth the way that i see it. I think there are a lot of us that have been ringing the alarm about democracy being in peril for a long time. Thomas jefferson wrote about how democracy was in peril when it began because we built it on the foundation of slavery, and were still paying backwards that owed debt to the descendents of enslaved people in this country and still paying that debt in the way we treat broad swaths of minority populations in this country. And i think figuring out how we navigate a democracy that has rightminded, openminded tolerant people on both sides of a socalled political aisle is a crucial way forward. And its hard to see how that will work. But i think naming thats whats necessary is part of it. It cant be that the republican party is the party of white people and that the democratic party is the party of everyone else, everyone decent and sane who is colored or not colored or other in any other way. So we need to figure out how to rectify that part of the conversation. And i think that that is the that will be where the hope for democracy lies, and i hope that we get to that. Lets let our viewers roll that around a bit. Thankfully our guests are going to stay with us while we fit in a break. Coming up when we continue, President S visit to Tulsa Tomorrow comes at especially divisive time as youve been hearing. The challenges that lie ahead of us in his pursuit of unity when this memorial Day Edition of our broadcast continues. No Gaming Options isnt an option. Get comfortable with it. We will say to america that we too are america. We too are americans. We too deserve. We too should be memorialized. We too should be repaired, restored, and there is as the church said yesterday, no reconciliation without justice. Congresswoman Sheila Jackson Lee spoke flanked by two of the three remaining survivors of the Tulsa Race Massacre. The president will be there tomorrow and thats important. Earlier today he issued a proclamation to commemorate the centennial of a massacre still wiped from the history books. Professor, i would like to begin with you. Natasha brown wroe this today. There is a direct connection between what happened 100 years ago in the tulsa massacre, the January 6th insurrection and recent attack on voting rights, the same rationale and source. Professor, isnt it another lesson were witnessing today, that if you try hard enough, if you get enough people on board, you can alter history, you can try to whitewash history. Sometimes that works, not forever but for a good long time. I think were seeing how well it works or doesnt in realtime, brian. As we said in the last segment, democracy is still at stake. As we speak there are legislatures all across the southeast trying to silence the tools and power instruments of an equitable, just democracy in america. I think that we as people of color, as people who have been come from downtrodden communities in america, as we grow and find our own voices and power, we will be for ourselves on our own behalf, will always empower ourselves to tell our stories. Whether that translates equitably into power at Ballot Box and power to make tangible change is still just a question. Question whether or not well be bearing witness as we are wrong done by, and speaking about it or whether or not america will come to its senses and come to work on our behalf to make equitable america for all americans. And i dont know if we have that in us. I know that people of color do, i know that people in other communities do, but i dont know if theres enough of a Critical Mass of comfortable white mass of Comfortable Whitamerica who does. And thats what its going to take. We all have to vote together and rise together. Benjamin franklin said it, we must all hang together or we will all hang separately. Democracy is right there right now, and we have to hang in together. And i dont know how many people understand how high the stakes are, and how quickly they will come to that awareness, if they will find it in time to save this precious thing that weve got here. Tim miller, im tempted to say that unlike tulsa, on 1 6 there was Social Media. After 1 6 we received hundreds of video clips we played on this and other broadcasts like a perverse, endless video wallpaper, so im tempted to make that point. Then im reminded there are republicans trying to tell us that we didnt see what we saw. There are republicans trying to tell us who the rioters and insurrectionists were, unlike those We Saw Carrying out the violence. Look, brian, think how easy it is to erase a massacre that happened 100 years ago. When theyre successfully erasing something that happened five months ago, at least in conservative circles and among consumers of conservative media, living in that ecosystem. Half of republican voters right now dont know what happened on 1 6 or convinced themselves something completely separate has happened. This is where education and raising awareness about this matters to carolines point. Im about to admit something embarrassing. Its important anecdote. David french a conservative wrote that im embarrassed to admit i learned about tulsa in my 40s. I learned about it recently, lunch a few months ago i learned about Birmingham Church bombing by four members of the kkk. Im a fairy educated person, and this is something that is fairly new to me. We Cant Raise Awareness and get white america comfortable with the history of black America And Pain and reality of how we got here if people dont know what happened. Theres a big debate now how to discuss history in schools and i think that this is absolutely critical. A critical fight, in our schools that Young Americans are taught about the great things about america, the sacrifices, were here on Memorial Day, that people have put forth for this country, but also our sins. Until people are fully aware of them, then hopefully we can move to the next step. Always have people who believe what they want to believe, people who are bigoted. But to get a Critical Mass as caroline said aware and comfortable, we have to educate about it. What biden is doing is good in that regard. I cant thank our guests enough. Caroline randle williams, tim miller. Greatly appreciate you spending part of your holiday Monday Evening with us. Coming up, general Barry Mccaffrey is here to talk about what he calls a very dangerous period as u. S. We owe them our whole souls. We owe them our full best efforts to perfect the union for which they died. President biden at the memorial Day Ceremony at arlington national cemetery. We also heard from Defense Secretary Lloyd austin who paid tribute to Gold Star families. For the Loved Ones of those who have fallen, let me simply say, we know the depth of your sacrifice. But we can never truly know the depth of your loss. What we can do is honor of memory of those you lost by caring for those who mourn them, and by seeking to perfect our union and defend our democracy. We are so thankful on this of all days our next guest has been willing to spend a few minutes with us. Retired general Barry Mccaffrey, retired as fourstar general in the u. S. Army. Who are you thinking of, even if its a long list, on this Memorial Day . Well, i think for a lot of us combat veterans, its intensely personal memory. I always object to the notion of families healing from loss of one of their Loved Ones in combat. They dont. They end up putting it in context, they understand it, admire the people theyve lost, but its never really a healing process. First time i ran into casualties in vietnam was august of 1964. In Airborne School and my brotherinlaw was killed in action with three other soldiers in vietnam. Serving with 41st vietnamese ranger battalion. West Point Class lost 24 of our class in vietnam and other wars to include the gulf war. The country has been privileged to have millions of young men and women step forward and be willing to stand between us and danger. Thats the whole purpose of Memorial Day. Fast forward to now, and i want to read you something from The New York Times on our withdrawal from afghanistan. United States Troops and nato allies intend to be out by early to midjuly, well ahead of President Bidens deadline. In what has turned into accelerated ending to americas longest war. General, what is the danger to you and how Grave A danger is it . Well, look, anytime youre involved in a withdrawal, pulling forces out of combat, thats most dangerous of all military operations. Were fortunate Four Star General Scotty Miller is there, more time in combat than anyone in uniform, so i think its going to be okay and navy has backed up with Carrier Battle Group this effort. But its very tricky. Looks as if the afghan Security Forces are starting to come apart, in particular the police. Central government is corrupt and incompetent, and the taliban are going to wreak vengeance on that country. Were watching a likely humanitarian disaster with millions of refugees, return of women and girls to servitude. Im not sure the biden administration had any options, but i think we ought to be cleareyed what is Coming Up in afghanistan. I have not had the opportunity, general, in the days since a sitting u. S. Senator from texas tweeted out a Straightup Propaganda Recruitment video for the Russian Military and followed it with a video meant to diminish Recruiting Tactics and standards in the modernday military. I know as retired four star, you keep up constantly with the State And Readiness of especially your branch, the modern u. S. Army. Where do you put things and how do you assess the actions of this senator . Well, this is just base political warfare. Back off the whole situation. 20 of the Air Force and navy are women. When you look at the army, around 50 , marines around 9 . There is no Serving Officer who doesnt think were better prepared to protect america because of these high quality young women in our ranks. Young men were recruiting out of the top 25 of american males. Women tend to be around 50 . Look, weve had over 1,000 women killed or wounded in the war on terror, 149 killed in action. This is political warfare but harmful to the morale of the Armed Forces. Weve never had a more competent Fighting Force than we have today. And now i have to go to the sorry subject of michael flynn. Liz cheney put out a tweet after his comments were widely spread. Hes attempted a Walk Back today but lets put the Liz Cheney tweet on the screen. Picture of flynn, no american should advocate or support the violent overthrow of the United States. Thats what he did at qanon convention. I know youve been through the ringer over the course of his career as a General Officer in the army to present day, including but not limited to his 22day Term as our national security adviser. What do you make of it other than the fact its extremely dangerous talk . Well i think thats the most important thing to say. This is actually very dangerous rhetoric. This is harmful. This is putting the country at risk. I have never heard anything like this, probably last 100 years, this kind of just completely irresponsible provocative language. I think Mike Flynn has mental Health Problem to be blunt. But this whole notion of 15 of the country by the way believes in Qanon Conspiracy theories, global network of satan worshipping pedophiles, crazy stuff. Hes slipped into a different realm. I think its a mental Health Condition but as senior Military Officer retired as he is, to be calling apparently for a coup against our democratic country hes done this before is extremely dangerous. Department of justice. Is going to be hard pressed to not consider whether this language is criminal in nature. What do you think turned him, general . Because for him to hold these views, now, means a dramatic reversal of all the Training And Indoctrination that our our Flag Officers go through. To work up to the rank he occupied in the u. S. Army. It was alarming, to see him enjoying a Banquet Dinner with putin on the Russia Television Coverage of that event, early on. But what what turns a man, like Mike Flynn . I dont know. I saw him in afghanistan, and, you know, he was an important part of the mcchrystal effort to stop terrorism from coming back to american shores. So he was a very capable intelligence officer. He got the dia, defense intelligence agency, and he failed there. And he essentially got fired by The Pentagon and by president obama. Then, he started to go off the deep end. So, i mean, all the way through the the campaign, where he is chanting, lock her up. This is not the language we expect of any public servant, never mind a senior Military Officer. So, again, i think its a sad situation. But hes becoming a threat to the security of the United States. Hes lost it. Yours is one of the voices we desperately want today hear from a today. We appreciate every time you take our questions, but especially on this day. General Barry Mccaffrey, thank you so much. Coming up. Greg abbott has vowed to hold a special section against the Election Law to get a pass. Over a dozen states to install new barriers to voting after Trumps Loss to Joe Biden. As all this unfolds there is growing pressure on democrats in washington and on the White House to set up some sort of commission to investigate the riot and living on January 6th inside our capital. Friday, senate republicans refused to get behind the bill to create a commission. Now Congressman Gerry connolly, democrat of virginia is calling on the president to create a President Ial commission to investigate the attack. We have lots of precedent for President Ial conditions that have looked that momentous events in American History. By and large, they have consider themselves well and if commended broad public respect. The president has latitude to tap into republican Talent Pools including former members of congress who to care about their country and do care and are troubled by the events of January 6th. With that, lets bring in our lead off guests for this second hour of our expanded memorial Day Edition of the 11th Hour. David juliet, former republican. Former member of the u. S. House of representatives. These days, chairman of serve america movement, a group of current and former democrats, republicans, working to fix our broken politics. Former u. S. Attorney joys fans who spent 25 years as a federal prosecutor. One of the cohost of the podcast sisters in law. It dont callaway, Democrat Strategist and member of the Advisory Board for the national Voter Protection fund. Protection Action Fund and Ceo Founder of pine street strategies, a d. C. Based lobbying firm. Well good Evening And Welcome to all of you. Were especially grateful for you spending a few minutes with us on this holiday Monday Night. Congresswoman id like to start with you. Republicans arent letting up, theres every reason to believe these efforts are going to become more aggressive as we approach the midterms and certainly the next general in 24. How do you remain optimistic . Its more or less the Mission Statement of your new organization. In terms of the legislation were seeing it work its way through republican legislators in states across the country. I think a lot of these matters will end up in Federal Court or hopefully theyll be judged on the merits of Voter Integrity or Voting Integrity forces the impact of communities in color. Brian, i think the trend thats very important to note in all of the states that are passing these laws is this. While we focus on the Voter Suppression of individual voters, reduction of drop off. Reduction of Mailin Ballot opportunities, there is another narrative here and that is moving the administration. Commissions of elections, supervisors of elections. Secretary of state and into the hands of political Run Organizations or even in the Texas Case to a judge that has the ability to invalidate an entire election. That is just as disconcerting as the suppression of the individual vote. The fact that you can have political hands deciding an election or votes have already been cast. Don, you and i have lived long enough to hear our president , Yours And Mine and president of all the american people whether they want to admit it or not declared today that our democracy is in peril. I think we really witnessed a moment in the modern presidency with those words, combining that with what weve heard from david jolly. Are you confident and your President S ability . Your Progovernments Ability to protect but weve got . . No. And that is a sobering statement to make but im not, primarily because my colleagues that the democratic party has elected to the senate are for more interested in catering to republican interests into the wants and needs of middle american white folks who probably are done voting with us for another generation. They have been done voting for us since 1960 when John Kennedy was the last person the last democrat to win a majority of white male votes in the country. And democrats continue to find a way to cater to their interests first as opposed to catering to the wants and needs of the vibrant multi racial democracy that has been forming for the last four years and will certainly dictate the demographics and the politics of the next 50 years. If i had a little bit more confidence in where the democratic party was putting its resources and energies in terms of building an electoral vibrant democracy i would be more confident in potential outcomes and how we can stop subversive efforts just like this. Im also not that confident doesnt seeing State Legislatures across the country, particularly democratic parties building the infrastructure that we should be building to build Voter Protection infrastructure. Were far more concerned with whats going on in voting. Now im proud of what the Texas Democratic Party did in the senate to suppress their Voter Suppression bill but we did a lot more of that. And we need a lot more aggressive affirmative Voter Protection agendas across the country its going to take more than just electing a democratic president. Joyce vance, how do you stay optimistic . What are the limits to the backstop that David Julie talked about. Not only the doj but the federal bench . The so where in a tough position here on any number of grounds and Joe Biden is correct to identify democracy as fragile. But that doesnt mean that weve been defeated. One of the right points of optimism is the third week in june the senate will take up for the people act which would restore much of the protections to voting that were eviscerated when the Supreme Court in Shelby County gutted the voting Rights Act. Thats why Doj Teen only has the ability to challenge these laws like the ones texas is trying to enact in a way that would protect voters and protect populations. And of Course Passage of the people act is far from a foregone conclusion in the senate. Theres also long Term Work to do on the John Lewis Voting Protection Act bill. But there will be some hard decisions ahead among them. The decision about the filibuster which by every estimation is really important to maintaining the institution of the senate but we may be on the verge of dealing with issues that are so critical to the survival of democracy that we have to make some bad decisions, perhaps letting go of the filibuster to ensure the future voting because without voting and as you point out brian, i think its another key point a strong system that will support the Rule Of Law and not the political wildes, the folks who put them in place than the fragility becomes a long Term Danger and we would be a great risk. David jolly i dont think im out of bounds guessing that had you been still a sitting republican in congress he wouldve been among the crossover republicans to vote in favor of the one six commission. Of course thats not going to happen. Talk about remedies there. What would best serve the role . Something Nancy Pelosi generated or a President Ially named independent commission with Subpoena Power . Brian i think you can appreciate it would be a leap for me to consider still being a republican in todays congress. And i would have voted for the Commission I. Can tell you i fully expect republicans to double down on their narrative that this is a partisan witch hunt. Democrats have a tough choice to make here. Do they set up a Special Committee Of The House . Because if they do i believe republicans, particularly if kevin mccarthys testified or asked subpoena i dont think theyll testified. I dont think the cooperate. They spend their political capital telling the american people that this is a partisan witch hunt. But heres why its critical that i did the house have a commission or as Congressman Connally has suggested, President Biden 0. 1. At The End of the day the american people in the voters deserve transparency and they serve the information about what occurred in January 6th. What caused it. How did leaders respond in that moment so the voters can make a political judgment next november. Doj fbi are handling the criminal investigations and are doing a great job but the voters deserve to make an informed political assessment about which actors were culpable, responsible for the events of January 6th and which political leaders deserve to lead us after the 22 elections. So don, take Everything David just said and lets talk about Joe Biden. A through the Roof Approval raking for his handling of the pandemic but look at whats is lurking. Look at inflation, look at the Gun Violence we just covered in our last hour. Look at crime across the country. All these negative stories that make us feel bad about ourselves and society. Lets not forget get a big assist from the russians especially on the Social Media that we all see. So don what would your advice speak to this president , to your party, to get out ahead of issues like this and stay on that side . I was hoping for an easy question on the holiday williams but alas its not happening. Youre not gonna get it. My best advice to Joe Biden is to thine own self be true. Joe biden is 62 Approval Rating is because a whole lot of people in this country across races and social economic classes and a variety of lived experiences believe in him because we can fundamentally see that he is a good and decent man. Joe bidens fundamental responsibility. Right now its not to paint some rosy picture about americana of your or into the Rosie Future but its to tell us how we can bind together and face the challenges. Right now i think the republican party is unfortunately ahead to take the flag and to a moment of partisanship but right now the republican party is sacrificing our democracy. Theyre not on the right side of this discussions. But i think Joe Biden across party is viewed as a unifier, a guy who can tell us Hard Truths and talk to us about how to pull together and we believe in him because of his lived experience and we believe it because he delivers this message with such integrity. Joe bidens best but is a political. Its to continue being of self because we believe in him as a good and decent person. And decency matters when it comes to leadership. Thats why regardless of policy, the last president was so bad because nobody believed at least reasonable people did not believe he was a fundamentally decent person. Joe biden is the opposite. Just to be fair Hearing Choice the tough question for you and its a change of subject. New york state, new York City are all over formal resident one drawn with trump. There are other jurisdictions as well. Joyce a bottom line answer, how much real legal peril is the former president in right now tonight . It is a tough question because its clear to me that prosecutors in new york can answer some of the most important questions that prosecutors deal with in an investigation. They figured out what happened and where it happened and they probably know why it happened and they know the substance of what happened because theyve had since late february, the President S Tax Returns and underlying documents which they litigated so strenuously to get. So having those papers in hand you dont call a Special Grand Jury Begin Proceedings there because you still have questions about whether or not a crime was committed. The answer to that i think people are clear. On the issue there remains is who . And whether theyll be able to go all the way to the top of the Food Chain and indict the former president perhaps they already know the answer to that. Perhaps right now theyre stuck at the Cfo Level with Allen Weisselberg who doesnt seem yet hes made a decision to flip in cooperate with prosecutors. They could be focused on the President S children and other key officials in the Trump Organization. But Donald Trump i believe is at great Risk And Danger here because this is a Paper Case that documents dont lie. The evidence is in front of prosecutors. Theyre bringing this Case Home and whether they have to indict Allen Weisselberg ultimately to obtain his cooperation, they seem to be very firmly on track to go as far up in the Trump Organization as they can with these allegations of fraud. Covering this pandemic as Case Rates in the u. S. Continue to fall. Dr. Fauci warns that the pandemic is not over yet, making skulls of All Of Us. In his latest interview, fauci tells the guardian, quote, he goes on to say as long as theres some degree of activity throughout the world, theres always a number of variants are emerging and diminishing somewhat the effects of our vaccines. Were gonna get to that with these two guests with us tonight. Doctor van ghouta, critical Care Pulmonologist and seattle specializing in exactly this kind of thing. Hes on faculty the university of washington, Institute For Health Metrics And Evaluation and we have Stephen Sample back with us. Hes an er doctor at the memorial Hospital And Health Care Center in jasper indiana. Also voluntary clinical Factory Member at the clinical school of medicine. Good evening to you both, thank you for spending a few moments of your Memorial Day monday with us. And doctor gupta, since you are physically closest to a specific roomy that the first question its about this troublesome vietnam variant. Heres how the Washington Post Put It now announced on saturday that it has detected a highly transmissible new variant of the coronavirus that is helped fuel will infections in the country. Genetics advancing indicated that it was a mix of the coronavirus strains, first detected in the United Kingdom and india. So doctor gupta, noting that it is amid good news, what is there in here for you to worry about . Well good evening brian, great to be here with you and the good colonel. On the Memorial Day but also its emblematic of what Doctor Fauci and others have a warning about that the threat anywhere is a threat to All Of Us everywhere and its just to say that whether its the v8 numb which is concerning were still learning about how the vaccines may or may not be impacted by. We dont know with certainty whether the variant presented identified in india how it responds to the vaccine which is what were hoping its all to say that whats happening in india, ive looked at reports at 7700 deaths and 11,000 estimated would actually is happening and 4000 in south africa. Theyre experiencing a wave, and the peak at The End of july which is not by any means done but i worry about what is the southern part of the United States look like in the Fall Winter when we have cold uptake of the vaccine is not as high here in seattle. What does that look like for major cities in the south . Its going to be different there. Theres gonna be peaks here come the fall and winter. Doctor sample, far from the pacific brim but close enough to reach out and touch yesterdays race. 138,000 in attendance. Nowhere near capacity at the Motor Speedway but its a start. Where are things now locally for you and again amid the good news, any concerns you have about the virus . Good evening brian. Get doctor gupta, how are you . It feels over where we are. I dont really want to talk about the fire in indiana and thankfully going through four down about 49 in new cases over the last four weeks alone which is the lowest number of cases that weve been since july of last year. And so nobodys talking about the virus much but what i am concerned certainly ive always got my eye on the news and whats going on with india and its hard to explain to my fellow citizens out here in the middle of the country that whats happening there can actually matter here. But it certainly can. Its a valuable point. When that we Cant Repeat enough. Ill tell you what im gonna do im gonna ask both of these gentlemen to stay with us and were Gonna Sneak in a break because the conversation ive been wanting to have and fixing to have for a long time is Coming Up. Were going to talk about the other reason we asked both of these men to take Time Out of their memorial Day Holiday and spend their time with us tonight. It happens to be about their other passion and the other service. Service. Like you, my hands are everything to me. But i was diagnosed with dupuytrens contracture. And it got to the point where things i took for granted got tougher to do. Thought surgery was my only option. Turns out i was wrong. So when a Hand Specialist told me about nonsurgical treatments, it was a total game changer. Like you, my hands have a lot more to do. Learn more at factsonhand. Com today. Back with us on this Memorial Day, Doctor Van Gupta who happens to be a major in the United States Air Force medical corps and now serving as a reservist. And doctor steven sample. His 20 years of total service includes eight years active duty Air Force including deployments to iraq and afghanistan. These days, a Lieutenant Colonel in the international guard. Gentlemen, i have known this about you both individually but weve been so eager to put you together to talk garden Reserves Stuff together and pay tribute to your service. Doctor sample, you first. What drew you to it and tell our viewers who may not know civilian population but the average yearly obligation is . I appreciate you having to talk about that brian military madison initially was fear of death. I was a 25 going on 26yearold Kid who is starting Medical School in the fall with the three year old and a six month old daughter and a wife who is a Brain You several hundred thousand dollars and frankly im looking for a way to pay for it but in may of 2001, when i signed my contract over and i was looking forward to doing medical missions for central america and when the towers came down as the week before examinations and that old school. We talk call it Black Monday and i knew my life was going to be different at that point in time but i didnt know that it was going to be sell the years almost to the day that id be in the middle of a sandstorm it Brand New Baby Face Doctor scared out of their minds. Oh my Goodness Dr. Gupta same question to you. You know brian in some ways just as the colonel mentioned it was financial. The Air Force helped me get through residency and beyond just giving you a style to live on any that you name it and would all say for all your viewers out there to answer the question about what ive seen in my ears going on nine is that there is an enormous amount of capabilities on the medical side that we dont talk a lot about and i understand we want to talk about our wounded warriors and the conventional Military Strength of all branches of our Armed Forces but my gosh there is a lot. To contend with pandemics and Bio Warfare how many operated united assistance 2014 tackling ebola. Whatever scene here i have colleagues in my own Unit And Transport team that responded immediately lasted 24 hours to the threat of covid in new York City. Were seeing other examples here in just the ability to expand our footprint to address a changing threat and that is our mobile military capabilities. Lastly all say Harrabin Part of the a prep back during the Obama Administration and to have the medical footprint, we have many military nations had treatment facilities within less than 24 hours so that they can deal with Emergency Response issues in places like africa. Theres a lot we can do, theres a lot we dont talk about this been expanding in the next 15 years. Doctor sample, this requires standard employers and in that way its a lot like volunteer first responders and our country. Talk about your experiences as a reservist during the pandemic. Absolutely. My Hospital System has bought so much loyalty for me. When i came back duty in the Air Force and transitioned over into my service for the national guard i dont know that i knew it i was getting into but i disappeared for a month, for a week and every month and a week here and a week there and as needed. And my hospital has been no to answer the call from the beginning. They always bring in part timers, partners to cover my shifts and its hard on them. Theyve spent Tens Of Thousands of dollars on the last nine years to keep them active in service and im grateful for that opportunity. Doctor gupta, starting with you if i place the two of you dead gentlemen in an establishment that served alcohol beverages, a shot you down and sat a few feet away and listened, would there be good nature Air Force reserve trash talking, my unit is better than yours. What would typically happen . I probably would be obligated to listen. No i was going to say that i probably would be obligated to follow Lieutenant Colonel examples orders whatever they may be, brian. But its just to say that theres a lot of camaraderie across units and i will say that for everybody out there thats considering or has been considering a career in military medicine, its incredibly fulfilling its been an honor of my life. Especially in this era of pandemics and Bio Warfare, constant threat to changing landscape and not better Opportunity Or Career moves then making that jump. And doctor gupta, how frustrating is it when you hear all im sorry Doctor Sample, hang on one second. When you hear of people talk about limitations and you and Doctor Sample boast know the airlift capacity, the men and Women Power Capacity of things like the u. S. Air force reserve. Both of you guys know your way around the interior of a c 17. Youve seen what you can do, correct . You bet. And which is why moving Oxygen Tanks for india right now, bryant the answer to your question. Enormous move of oxygen in the consent people who are trained to stand up medical treatment facilities and the most austere environments. Ive seen and participated in and it myself and its an incredible ability. Doctor sample, go ahead. I owe you time for a response but the fact that hes now referenced your rank three times tells me this is gonna be a very polite conversation. Yet, going back to the last thing. If i had cooked in a bar i had him under the table with bourbon and have been Doing Pushups by The End of the night. But yeah, What Gupta says is absolutely true. The capability of our military medical system are on real. Or shockingly good at what we do. When i was in iraq and afghanistan, if you made it. You made it. If you were a kid who is 500 miles away and blown up in a convoy and you made it to my doorstep, you had a greater than 97 chance of going home to your family. These kids saw A Flash Of Light and they woke up a day and a half later determined. In the Man Power in the Skill Set that is taken to get that done is shocking. Well ill Put It this way. We will try our very best to put you together with a shared beverage. Tell you what, i dont drink so maybe it sounds like you need an adult in the room its gonna be some mixture of bourbon and pushups maybe ill be there and will record pictures of the events. Some day when we all get together. Doctor vin gupta, dr. Steven sample. And addition to the service you have provided for all of our viewers during this pandemic on this day of all days, we couldnt be more grateful for your service to our country. Thanks gentlemen. Thanks for doing this and thanks for accepting our invitation to come on back to your families both. Coming up for us, he called empathy the fuel of our democracy. The mission falls each of us, each and every day, democracy itself is in peril. But we do now. What we do know, how we honor the memory of The Fallen. That will determine whether or not democracy will long endure. President Biden Today join that straight line in between those who fought and died for our country and the ongoing attempts to undermine our democracy. Back with us tonight, celebrated author President Ial Historian Michael bash loss. His latest work is President S of war. Michael we are in your debt for spending a few minutes of your holiday Monday Night with us. I made the point in the previous hour, like you i have tried to pay attention one its been a national moment and our President S give an address but i dont think i can remember wording like this today, a sitting american president in the modern era declaring our democracy in peril. Weve had president used this event to exhort us, its obviously pay tribute to the sacrifice that we earn from fdr. That we were in a battle against tyranny for our very lives and system of government and all that we cherish. But to hear president in the course of one speech say that empathy is the engine of democracy but that that democracy itself is in peril, that seemed like a new territory to me today but youre the expert. Go ahead. Joe biden is absolutely right. As you know, democracy is always in danger but sometimes its created more than others. 1861 Abraham Lincoln gave speeches sounding very much like Joe Biden today, saying our union, our democracies in danger from a southern insurrection over the evil of slaves. And then in 1940, Franklin Roosevelt said in 1941 that we, the american people, are in danger never since jamestown or Polis Rock have been in such dangerous in now from hitler and imperial japan. 1961, state of the union. John kennedy said im good at the hour of maximum danger, the question of whether it can organize and govern, can endure and is very much open. But you know, those two moments of danger in American History do our clumps our soldiers were the ones who are carrying the way. Here we are in 2021, 80 years after 1940 in which Joe Biden appeals compelled to say that our democracy is in danger from within. Thats something that were not accustomed to. He knows that if he fails, theres a very good chance that the next president could be someone who is an autocrat. Someone who has contempt for democracy in this could be The End. It is very possible indeed, perhaps likely that our problems are way bigger than one Man But Id like you to talk about the ability of a president to heal at the same time and having asked that, the pressure especially from fellow democrats is enormous for Joe Biden. His healing instincts aside, to be more aggressive and take this as the emergency that it is, as the Clear And Present Danger that it is. He knows how much is at stake and hes got to make sure that the pandemic is and it in a way thats as good as possible. As to fix the economy, has to do with terrible problems of inequality and racial injustice. Lots of other problems at the beginning of 1933. And the lessons from history is for instance you have roosevelt and failed in the beginning of 1933 and people wouldve begun sit out the democratic system and our economy. It wouldve turned four other answers to demagogues like long or father cognition, 1961 said if i fail there is some chance that demagogues like Edward Walker who is at that point in Dallas Texas who was saying the Jon Kennedy should be overthrown in a military coup. Much as were hearing tonight from people like Mike Flynn. Weve had moments like this in American History. The benefit is you see a president who sees the danger and is trying to do anything he cant overcome it but it may not be enough. Has there ever been a time when Conspiracy Theories have taken hold by percentage of the population and were talking here about qanon as a wild and otherworldly as it may seem to sentinels, have we ever gone down that path before and what triggers that . Well, you have the know nothings for instance and the mid 19th Century saying that immigrants were responsible for all of our problems economic and otherwise. In the 1930s, there was terrible antisemitism and racism. Efforts by the Ku Klux klan to stay the reason for our economic problems in the Great Depression has to do with certain groups within our country. Same thing is true in the 1960s. But the difference between those moments and nowadays is you didnt have the internet. If someone was going to put out an antisemitic or racist handled in that person had to do it on a Street Reporter and printed him or herself. Nowadays, all you have to do is put on the internet. You have a potential audience of billions of people, and all the american people have access to that. Its much more difficult problem for a leader or a president who is a champion for democracy like Joe Biden. Michael, finally and only because youre next topic we work on President S and race has a fierce urgency to it and could not be more timely, can you give those of us in the Reading Population perhaps a Publication Date . Thank you for asking brian. Im hoping its going to be done in the next year or two and its a book on racial justice on the 20th Century President S but if i could leave a final thought and that is a day like Memorial Day we celebrate our soldiers. We celebrate good things like heroism. Wonderful important part of American History but at the same time its the anniversary of the 100th. As youve been talking about in the Tulsa Race Massacre and we have to remember those another massacres and other bleak horrible atrocities in American History to make sure they never happen again. Indeed we have seen history covered up before our very eyes before Michael Bash Law thank you enough on this Holiday Night for spending a few minutes with us. Thank you my friend. My pleasure.
