The most Conservative Court in history is going to rule on Abortion And Gun laws. How could that impact the political landscape . We dont know what the Supreme Court will do here. It could take incremental steps or these could be Big Blockbuster Rulings Against Abortion Rights and in favor of Gun Rights. Given the conservative tilt of the Supreme Court we can be pretty confident that the right is going to be happy about this. If they are big rulings, this creates an opportunity for democrats. Because on the issue of Roe Versus Wade, polling shows as much as 70 of the public supports that decision and doesnt want abortion rights taken away. Guns used to be an issue for republicans but since the newtown shooting, Public Opinion has moved toward stricter gun laws. So this all creates an opportunity for democrats to say, okay, theyre probably going to lose at the Supreme Court, but they have an opportunity to galvanize voters, the majority of americans who agrees with them and says you should show up for politicians that are going to counter act the court. I want to read an article. The conservative majority must choose. Will the justices unravel decades of precedent or will they preserve the credibility of their institution . Mississippi flay grantly transgressed in a scheme to address precisely this Supreme Court showdown. The court would burn legitimacy if it upheld Mississippis Breach of precedent. They are making it hard tore vote and have gerrymandering. I feel like theres fires on all fronts that are working against democrats going into this Midterm Cycle where we know people who are in control of washington, the party in control tends to not do well. As he mentioned, these conservative rulings coming from the Supreme Court will absolutely be a motivating factor if they go the way we think they will. I think there is a really easy story for democrats to tell about how republicans pack the port. With Amy Coney Barretts Nomination happening just a week before the election. But i think with the Supreme Court democrats also have to prepare themselves to be responsive to democratic voters. What did you do to prevent this . What did you do to potentially change these outcomes and saying we started a commission to study it. Our hands are tied, its going to be insufficient for voters. When i look at Voting Rights we know this is something that State Houses across the country have been taking on with republicans essentially using a Copy And Paste approach. The issue is two fold. For the republican party there could be backlash from the reality that theyre still using these lies and unfounded claims of election fraud, which may turn off republican voters who no longer trust or have confidence in elections. So republicans have to tread carefully there. But i think democrats absolutely have a steady drum to beat around all the ways republicans are making us all safe or all the ways republicans are dismantling these systems. And i think back to what you mentioned about the January 6 commission being another prime example of Republicans Obstructing Americans from getting the truth. So democrats have a platterful of things to respond to. Its about how theyre going to be framed in a way that is motivating and sustainable for the next 18 months. And i would add to that, juanita, something that has a longterm vision, something that goes beyond 2020, which sahil, President Biden has a panel. Do you expect to see a push from progressives to expand the bench . Right. The commission had its first meeting earlier this week a few days ago, and its mandate, a report six months from the first meeting, which takes us to november. It is made up of liberal and conservative voices. I dont expect it to say just expand the court by four seats. Progressive activists are pushing that. They believe its already necessary to do, its already arguably justified by republican tactics in 2016, blocking a democrat from filling a vacancy and allowing a republican to fill a vacancy in 2020. So, where it goes from here is unclear, but yes, i do think those democrats will probably have a little bit more traction, a little bit more oxygen to push that message, maybe convert a few more lawmakers to that cause if something really transformative happens, like overturning Roe Versus Wade or expanding Gun Rights where anyone can carry outside the home. I want to turn to the January 6 attack on the capitol as they try to push on. I want to go to a Trump Supporter who was charged in the attack. Something in the back of my head was saying this is, like my rosa Parks Type of moment. This might be breaking the law, but as long as i show my face, as long as i show that i am, you know, not wanting to be violent or not engaging in violence with police then ill be fine. Let me put it bluntly. Some people are going to be outraged that you compare yourself to Rosa Parks. I, i think its, i think its an appropriate comparison. There are six states in the country that only have one abortion clinic, a result of relentless attacks from republicans on Abortion Access. Mississippi, the center of the new supreme Court Case is one of those states. The New York times reports many women in mississippi already live 250 or more miles from the nearest abortion clinic. And this map from the times shows the clinics likely to close in the south if the court reverses roe. This would force women throughout the southeast to Travel Hundreds of miles for Abortion Access. Joining me now to discuss the dangers of overturning roe, i want to start with the decision to hear the mississippi case. Reading the tea leaves, what kind of ruling should we start preparing for given the new conservative Super Majority . Just a decision to take the case is earthshattering. For years the Supreme Court has been asked to hear these kinds of ban that are previability. In this case, its a 15week Ban out of mississippi. The lower courts have said this is not a complicated question. For 50 years the Supreme Court has said a person has a right to end their pregnancy until the point of viability. Until the fetus if delivered is a baby and could survive on their own. It has not been considered in full for a long time. It means there are four justices on the Supreme Court that believe they could get it by. When trump ran in 2016 he said he would appoint justices that would overturn Roe Versus Wade. We are now headed in a direction which the court has never seriously gone before. And you have to be really devastating. You mentioned that access to abortion in this country is a right on paper only. It really depends on your zip code. But as we learned with trump, it could always get worse. If the court overturned roe, it could be left up to the states. What kind of hurdles will women living in states with no Abortion Access face . It very likely would effectively overturn roe v. Wade, if it can ban abortion before 15 weeks, why not six weeks as texas just did, why not before women even typically know theyre pregnant. That may be a missed period if you have a regular period. So yes, it is the case that states have already passed these laws. Theyre ready for this moment. Theyve been preparing for this moment, the Antiabortion Movement for decades. What clinics do remain would have to close and the abortion funds already working in states like missouri and mississippi would be working overtime to help individuals cross state lines. Now theres something that didnt exist before roe v. Wade. We typically think about this coat hanger image. If an individual wants to end their pregnancy on their own they can with a set of pills. Like anybody else, hes entitled to be judged fairly, and if hes tried and convicted to be tried and convicted by a neutral jury. And also by prosecutors who dont have a predisposition to the case. And so i think, while i think shes done an admirable job as Attorney General and that shes an honorable and good person, she prejudged the case, and she ought to consider stepping aside. Its not that Big A deal. This happens. When i was united States Attorney for the eastern district of virginia i recused myself from at least one case i recall specifically, maybe a second, because of the perception of a conflict. We have to be objectively fair and perceived as objectively fair. Of course he would have to actually run. He would have to actually win. But what would the potential complications be there, when the reality of those politics bump up against these legal cases . It does make the politics a little bit more dicey. But to the extent we keep politics out of our work, and thats one reason we often consider recusal, i dont think it makes it that much more difficult, alicia.
