A short time ago, the White House said this. The president put forward a responsible offer in the interest of Finding Bipartisan, Common Ground that includes critical investments in our infrastructure to create middleclass jobs, and strengthen our competitiveness in the world. As well as cuts to his original proposal, and a way to pay for it. The ball is now in their court to respond with a goodfaith counteroffer. This is big news, for a number of reasons. First, this stalemate over Sticker Price further delays the critical revamp Americas Infrastructure needs. But it, also, is a tell of the Gops Strategy toward the White House, and presents the president and his party with a question that we have asked many times on this program. To get things done, must the filibuster go . If deadlines, still, stick in washington, timing is of the essence here. The White House Set Memorial Day as its deadline to strike an infrastructure deal. And no sign they are letting up on it. With me now, california democratic congresswoman brbara lee. And cochair of the poor peoples campaign. Both, Reverend And Congresswoman lee, along with Congresswoman Pramila Jayapal held a Press Conference this week where they unveiled a resolution pushing for a third rekrukz to tackle poverty and low wages. Something President Bidens Infrastructure Plan is also trying to address. Congresswomen lee, i am going to start with you. The gop refusing Bidens Price Tag on the proposed Infrastructure Bill. Still, demanding more cuts. What do you believe their goal is here . Well, i believe that the republicans goal is to just not want not support anything that President Biden puts forward. I mean, come on. We need a bill to make sure that our infrastructure is addressed. But also, our human infrastructure. And making sure that people are able to get goodpaying, union jobs. We need caregivers and the Caregiving Economy and caregiving industry, in many respects. Caregivers deserve goodpaid, union jobs. And so, we need to understand and realize that i dont think, and especially just seeing this counteroffer from the republicans or this offer from the republicans, that they really are being themselves. They do not want to do anything for working people. For lowincome people. For lowwaged people. All they care about are millionaires and billionaires. And theyll do anything to try to stop President Biden from moving forward on this very bold plan. And we say its got to be build back not only better but its got to build back bold. Representative, if i go back to your original point which is republicans dont want to do anything that behooves the president. Democrats met with the Senate Parliamentarian on thursday to discuss budget reconciliation. As you well know. Is there any sense that democrats may have to resort to that to pass this Infrastructure Bill . First, i know the president. I know the speaker. And i know that Senator Schumer want bipartisan support. But look. We have got to make sure that we look out for the people. People are suffering. They are living on the edge. And so, whatever whatever means necessary. You try and i think the president is trying to work in a bipartisan way. But you have to have a Backup Plan because these are peoples lives at stake. People living on the edge. They deserve better from their members of congress, whether they are republican, whether theyre democratic, or whether theyre Green Party or independents. Well, bishop barber, to the point the representative just made about people living on the edge. Some of the goals in this Thirdreconstruction Resolution can also be found in President Bidens infrastructure package. Addressing economic justice, lifting people out of poverty. If the president , if democrats, manage to pass this plan through congress, does that, then, adjust any of the goals you have in this third Reconstruction Proposal . Well, when we met with the president s economic team with 32 poor people, econ milkts, and lawyers, we pushed areas that need to be done and one of them was infrastructure, sure. We actually need a larger Infrastructure Bill, not a smaller one. And when you talk about what the republicans are doing, they are negotiating on the back of poor and lowwealth people. You know, we dont have a scarcity of resources and a scarcity of solution. We got a scarcity one other thing, alicia. The price of of low poverty and low wealth is too high. We are talking about we lose a trillion dollars a year from child poverty, alone. 2 Trillion from wage gaps. If we had raised the minimum wage to 15, it would have pumped 300plusbillion dollars into the economy. We got 140 Million poor and lowwealth people in this country. 43 of the country before covid. 8 Million more people went into poverty, after covid. Billionaires made 2 Trillion. In the first last year, we gave corporations and billionaires over a trillion dollars. But poor people didnt get a raise. 400 families while 62 Million people make less than 17 an hour. And you want to talk about death . 250,000 people are dying a year from poverty, before covid. 750 a day. The price is too high. So the real question is not the Price Tag but what price do we pay if we dont address poverty and low wealth . And if we would invest in lifting the poor and others from the bottom, guess what . Goodmoral policy would be goodeconomic policy. The republicans, way theyre talking, would lead us into more hurt. What we need is to the kind of investment that will lift from the bottom, up. And thats what this third reconstruction, Omnibus Vision, says if you are serious about helping 43 of the nation and ending poverty, here is the roadmap for what must be done. Congresswoman, i take the reverends point, that this is not a question of need. This is a question of political will. We talk, very often, about the ways in which living through the pandemic have reshaped Americas Understanding of the interplay between government and their daytoday lives. Has the calculus changed when it comes to combatting poverty . I believe that it has. When you have 8 Million more people living below the Poverty Line now. When you look at the food lines. I mean, remember seeing cars and cars lined up for baskets and boxes of food . Many of those individuals were middleincome individuals. And they were struggling, just to barely survive. Many were evicted. Many could not pay their bills. Many are, still, waiting for checks. And so, yes, we have to look, now, at how covid has exacerbated the the crises and more people are living, now, below the Poverty Line. So, we absolutely have to pass not only the Infrastructure Bill but our bill which lifts people out of poverty. Because now, you have more people living below the Poverty Line, and i think that really bodes well for, mr. Barber says, fusion coalitions. I think more people now will come together because they are feeling the pain just like so many people we know, in our communities. Black and brown communities. Poorwhite communities. Communities all around the country. Our native american communities have been living with all of their lives. So, bishop barber, i mean, when i listen to all of that. And when i listen to you lay out this plan. There are many parts of it. One of the parts of it has to do with Voting Rights. And i think there is an argument that we will hear people make, that you cannot address any of these economic issues, if Voting Rights are in play. Do you agree . I certainly agree that there are five interlocking injustices. Systemic racism, systemic poverty, ecological devastation, denial of healthcare, and the war economy. And Voting Rights is key because what we have found is the same people that fight and push Voter Suppression, also, vote against healthcare. Also, vote against living wages. Also, vote against unemployment. Also, vote against dealing with the climate. And so, what you have is people use Voter Suppression to get the power to vote. And once they get the power of office, they protect the corporate elites. They protect the greedy. And they dont care for the very people. In fact, most socalled Red States are the socalled poorest states. And a third of allpoor people live in the south. A third of all poor, white people live in the south. Theres 66 Million poor, white people poor, lowwealth white people. 26 Million poor, lowwealth black people. I mean, this issue, has Congresswoman Lee has said, forces us to come together. And you Cant Address one, little piece here, and one, little piece there. We need a reconstruction. And its for the very health and the soul. We cannot sustain 43 of this Country Living in poverty and low wealth before the pandemic. And after the pandemic, youve moved closer to 50 of people living in poverty and low wealth. Only 31 39 of this country can afford a thousanddollar emergency. Lets think about that in the midst of america. Thats why your show is so important, alicia. I hear all these folks talking about policies about morality and religion. Listen. The bible says those who legislate evil and rob the poor of their rights. Jesus said the poor is how the nation will be judged and economists now tell us a moral vision is a good economic vision. If you lift, from the bottom, guess what . Everybody benefits. But if the benefit is broken, the whole thing will fall apart. This Omnibus Vision that Barbara Lee and jayapal and so many others have said. They are saying, here is the vision. Heres the resolve. Its not the answer. But its what resolve we must have, as a nation, if were going to truly be the america we say we are on paper. Well, speaking of resolve, congressman lee, we are continuing to learn more about the latest incident of Police Brutality that resulted in the death of a black man, Ronald Greene, in louisiana after he was arrested back in 2019. As we approach the one Year Anniversary of the Police Murder of George Floyd, at this critical moment, what strategy are democrats looking toward to get the George Floyd justice in Police Act passed . Yes, first of all, my heart is broken. Once again, about the tragic murder of Ronald Greene. We have got to have criminaljustice reform. But we have got to have systemic, also, criminaljustice reform. And really, looking at how this incarceration, this mass incarceration, has impacted black and brown people. But starting now, we need to pass the George Floyd justice in Policing Act. And i know that our negotiators, senator booker, senator scott, congresswoman bass, theyre working, day and night, to get this done. This is a must do. We cant wait, anymore. I mean, more and more of these videos. More and more of these cases are going to come out. In my own district, police misconduct. No one is above the law. And we have got to get a system where we have police reform. So that black and brown people can feel safe. So that we have communities that dont have to worry about walking out of the door. Or driving down the street and getting stopped. An africanamerican men and women. It it its gotten to the point where this is a national emergency. And so, i am hopeful that the George Floyd justice in Policing Act passes. And again, this is just a first step. Weve got to look at entire system of Criminal Justice that needs reimagining. It needs reforming. And it needs to have public safety and at its center, in terms of all communities because this cant go on much longer in this country. Because there should be equal justice under the law. And No One is above the law, including Police Officers. Reverend barber, representative lee. Thank you both. When it comes to the gop, white House Spokesman tells Nbc News that the ball is in now in their report to respond with a goodfaith counteroffer. Dpooit bidens willingness to lower the Price Tag, Shelley Moore Capito says the two parties are moving fartherer apart on infrastructure. And democrats are already exploring the possibility of having to go it alone. We have been given a signal by the Senate Parliamentarian that we can do an Infrastructure Bill by the reconciliation process. Which just requires a simplemajority vote. And democrats, were going to do it. We would rather do It In a bipartisan way, because that would make the bill better, frankly. But if we cannot find republican cooperation, we are committed to invest in an historic way, in american infrastructure. Joining me now, tia mitchell, Washington Correspondent for the atlanta journal constitution. Also, with me, former congresswoman of florida. Tia, what are the chances republicans will actually come back to the table on this . Oh, thats the milliondollar question. I think, theres a chance that republicans come up with something, so it doesnt look like they just turned their back on being, quote unquote, bipartisan. Im not sure if it will be a change in Price Tag. Which, of course, is what the biden administration is looking for. You know, he came down. He is hoping the republicans come up. Im not sure that will happen, that theyll budge on the Price Tag. But i think they will come up with something, that at least they market as a counteroffer. The art of marketing. Debbie, the White House is still making a bipartisanship a priority. Here is how Press Secretary Jen Psaki described the smaller infrastructure package. Take a listen. In our view, this is the act, the art, i should say, of seeking Common Ground. This proposal exact exhibits a willingness to come down in size. While, also, staying firm in areas that are most vital to rebuilding our infrastructure. Debbie, at this point, how important is, quote, the art of seeking Common Ground . I think that its always incredibly important to try and find a compromise. Where the President And Congress members are listening to Each Other so that we can include issues that are important to the other side. But unfortunately, alicia, what weve seen is that Mitch Mcconnell has already made it very clear that he is going to try and block anything that President Biden is trying to do. He has had multiple conversations with republican members. Its critically important for republicans in congress to make sure they invest in our crumbling infrastructure. We know that were falling behind. Were ranking at 13th, globally, as it pertains to our infrastructure. So i think that its going to take a lot of work. But i know that President Biden has said, many times, inaction is not a choice, at this point. Tia, Senate Republicans are likely to use the first filibuster of Bidens Term to stop the January6th Commission. Even Senator Manchin calls this move, quote, disheartening. Will that be a Turning Point in the debate over the filibuster, tia . I think, of course, as weve been saying all along. Thats really going to depend on whether Senator Manchin, and to a lesser extent, senator sinema, decide republican opposition to the January6th Commission is the straw that breaks their back, if you will. You know . Theyre the two that have stood in the way of democrats, who have said lets blow the filibuster up. If they decide that republican opposition to the January6th Commission is is is not just disheartening. But, you know, undemocratic, unamerican, then then they could join with their colleagues and decide, you know, this is important enough. We are going to get rid of the filibuster. But it really depends on those two, specifically. Debbie, on this question of the January6th Commission, your sense of how badly it could backfire for the gop . Alicia, i cannot overemphasize how important it is, right now, for us to investigate and understand what, exactly, happened on january 6th. It was an insurrection. It was an attempted coup by the president. When house members, congress members, were actually certifying the election. The 2020 election. I think that we have seen, from Kevin Mccarthy and other republicans in the house, that they have embraced authoritarian populism. Coming from the trump party. I i think its very important that we call it for what it is. The the republican party spoke, very clearly. When they took away representative Cheneys Post as the third in command in the house. And embraced stefanik, who has been a huge ally of President Trump. And if you listen to her speech, she basically says that President Trump is going to lead the republican party, in the future. They are laying all the groundwork to ensure that they win in 2022. This is a critical moment. My message to Joe Manchin and Kyrsten Sinema is you do not want to lose our democracy because you have gotten caught up in a procedure that most americans dont understand. This is the moment that we have to have a commission. We have to pass votingrights act, h. R. 1, and other bills, that are going to ensure that we have a democracy in america. Debbie. Tia. Two of new yorks top prosecutors teaming up to investigate the Trump Organization. New York Attorney general, letitia james, is looking into finances of trump org cfo, allen weisselberg. And hes probably the most trusted Employee Trump ever had. And there was never a question that that allen would be loyal, to my mind. But now, that theyre playing with his kids. And maybe, even implicating him. I dont see allen going to jail for trump. The most trusted employee. Joining me, now, former assistant u. S. Attorney, alex little. Alex is now a partner at burr and foreman. Alex, what does the Attorney Generals involvement tell you about new yorks criminal case against trump . Tells you two things. One, it has to involve a crime within the Attorney Generals Office Jurisdiction that probably involves financial crimes. With what they were looking at in d. A. In manhattan, that seems to make the most sense. It also tells you they are stacking up. They are adding firepower, and they are putting more lawyers on it. Thats never a good sign if you are a criminal defendant. If the governments sort of adding people to this effort. Michael cohen says trump will try to evade charges, by flipping on everyone else. Take a listen. Donald trump never put his name on anything. He had, as you know, no email. He very rarely texted, if ever, unless he was tweeting. And so, what he will do is hes going to turn and say, it wasnt me. It was my cfo. He is the one that did it. He worked with my accountant. It wasnt me. He will blame everyone. He will blame ivanka, don jr. , eric, the accountant, weisselberg, calamari, me. He will blame anybody else, other than to accept responsibility. I guess, my question is how does that then if that is the strategy how does that check out, from a legal perspective . Well, its certainly what he is going to do. Its sort of what he did in both impeachment proceedings. I think the way you combat that, if you are a prosecutor, is you get all the people hes likely to blame on your side. So one of the discussions about the cfo was whether he will cooperate. I think he will, exactly for this reason. Otherwise, he is left holding the proverbial bag. You get their testimony, lock It In, you corroborate it. It makes it much less credible when the former president tries to do that. At this point, trump, in some respects, has already lost the criminal investigation of the Trump Organization. Given the burden it has imposed on his company. I wonder what you make of that assessment . And you can talk us through why this case is likely to be so costly for trumps businesses. I mean, i think, look. As prosecutors shouldnt try to burden, you know, private corporations just for that purpose. Thats not why they are doing it. They are doing it because they think they saw a crime and they are trying to prove that crime. But the practical effect is real. I mean, anybody involved with the Trump Organization is going to be very, very careful about what theyre doing. Anypotential Business Partners are likely to stay far, far away. We so that in investigations of companies all the time. So it likely froze any sort of activebusiness opportunities they had. Made it very difficult for them to do their work. Rudy giuliani wants to restrict the Southern District of new Yorks Access to evidence. Claiming that there is sensitive material on the devices the fbi seized from his home, from his office. What are the chances this argument will succeed in shielding him and shielding trump . Well, the arguments not not going to succeed at all. What will ultimately happen is, i think, there will be Sp Federal Judges who will be taskwood looking at this material. The only conceivable basis for withholding it from federal prosecutors is that its privilege. Attorneyclient privileged information. But there is some defenses to that particularly in rudys case. There is fraud exception. You cant use a lawyer to commit a crime so i suspect prosecutors in the Southern District, who are very good, will use those sort of arguments to get access to this. I think they are likely going to be able to look at most of it. Alex, pushing forward, what are you looking for next . Look. I mean, we are at a stage now. Now that the Attorney General said publicly or at least told the Trump Organization this is a criminal investigation. There is likely going to be somepublic movement. Whether thats people in the organization pleading guilty. Or more overt actions like the Search Warrant on giuliani. Its a different investigation but it sort of signals that we are moving to a more public phase of this investigation. That was hard to do perhaps when he was president. Today, we got new reaction from Greenes Mother. Here is what she told Nbc News correspondent, priscilla thompson. Seeing this video, and reliving even more of how these troopers take joy in how they actually kill my son. Im so mad. I am so mad. Its like they picked on the right mother here. Let it be known. You know, if it takes to my dying day, i hope i live to see it. All these guys need to be held accountable. They need to pay the penalty for murder. There is noother way you can look at this. Greenes mother reacting to footage taken two years ago. That first came to light, this week, through the associated press. Nbcs Blayne Alexander takes us through it, but we want to warn you, what you are about to see is very disturbing. Reporter a graphic, new look at Police Bodycamera Video that shows the final moments of Ronald Greenes life. The video obtained, edited, and released by the associated press, shows a Handcuffed Greene trying to repeatedly roll on to his side. Turn over. Lay on your belly. Reporter at one point, an officer is seen forcing greene down with his shoe. Is that consistent with Law Enforcement Training . No, its not. So, the goal is always to get the subject under control. Officers have a responsibility to do that. But they, also, have a responsibility, roll those persons over, get them on their feet. Reporter the incident happened in may, 2019, after greene led Louisiana State police on a highspeed chase. In the video, you see and hear officers repeatedly punch greene, tase him, and at one point, drag him. I beat the everliving [ bleep ] out of him. Choked him and everything else trying to get him under control. Reporter Louisiana State police announced the department will release all bodycamera video. Greenes family calls it a coverup saying they were initially told he died in a car crash. This newlypublic Autopsy Report does not list a manner of death. And in the early 1800s, especially in the state of louisiana, we had specific statutes which codified and deputized anywhite citizen in the in the state to surveil, and to exact Corporal Punishment upon newlyfreed slaves. And to harm them at whim. And it is no surprise, that these officers are exhibiting that exact same conduct. Those were Slave Patrols in 1835. And frankly, in the state of louisiana at least as regards to troop f, it seems as if we have Slave Patrols today. In your statement, this week, on greenes death. You write, in part, our entire system of policing needs to be reimagined. Adding, a system that produces such extreme levels of Violence And Brutality cannot be reformed. The mostimmediate changes are that we need to eliminate qualified immunity. Police officers and Government Officials should be able to be held accountable, personally liable, when they violate the constitutional rights of citizens. Qualified immunity was a doctrine that was created by the Supreme Court in 1967 and there is no need for it, anymore. We, also, need to eliminate loopholes for officers who harm people. There is no reason why an officer should be 30 days of a Coolingoff Period before they should have to give testimony with regard to hurting or killing a citizen. If we do not remove these harmful loopholes, we will never be able to hold officers accountable. And in our state, in louisiana, the justice lab, which is the Aclus Project which brings racist police to trial. We will we will challenge qualified immunity. And we will, also, seek to eliminate anyother loopholes within the law, that would prevent people who harm and Police Officers who harm their citizens from being held accountable. Civilly and personally. Alana, i want to drill down on this question of ending qualified immunity. Because its not just a conversation, of course, that is happening in louisiana. It is happening, nationally. And i there is a push, from progressives, to make sure that the George Floyd justice in Policing Act grapples with qualified immunity. I suppose, my question is, can that legislation have the impact you want to see it have, without tackling qualified immunity . No, it cant. We have got to tackle qualified immunity. I want the Viewing Public to understand. That qualified immunity, simply, means that an officer can violate your constitutional rights, and can do so in the most profound and dehumanizing way. And simply, the fact of there not being precedent or a case that happened before yours, that has the exact same facts. If there is nosuch case, then your case will be dismissed. That is absurd. It is not its not constitutional. It is something that we do not need. And why dont we let the jury or a reasonable finder of fact determine whether, or not, an officers actions are constitutional or unconstitutional . We dont need to throw those cases out, before they make it to a jury. What is our system of jury a Jury System for but for to evaluate factual scenarios .
