Stephanie ruhle. That does it for us this morning, as alex says. Stephanie ruhle picks up the coverage now. Sorry, stephanie. Hi, there, im stephanie ruhle, live at Msnbc Headquarters in new york city. It is thursday, may 20th and theres a lot going on this morning. Today hopes for a bipartisan commission to investigate the January 6th insurrection appear to be fading, despite some surprising support In The House from republicans. Mitch mcconnell now telling republicans in the senate to vote it down when it gets to them next week. In israel, prime Minister Benjamin Netanyahu shrugging of President Bidens calls to dial back his Military Operation in gaza and ignoring international calls for a ceasefire. Remember, we thought it might end today. And weve got Breaking News on former President Trump. A day after we learned the Trump Organization is now the subject of a Criminal Investigation in new york, The New York Times reporting that trumps longtime Cfo Alan Weitzeilburg is too. In other words, it is a very bad week for Donald Trump and it just got worse. Were going to get to all of this but i want to start on the January 6th commission. Nbcs Garrett Haake on capitol hill, eugene daniels, coauthor of political playbook. Garrett, We Saw Kevin Mccarthy come out aggressively. He did not want a single republican In The House to vote for this commission. And despite that, 35 of them did. When this thing moves to the senate, how aggressive is Mitch Mcconnell going to be . I dont think he will be nearly as aggressive as Kevin Mccarthy was. There was significant armtwisting behind the scenes to try to keep republicans from having essentially Jail Break and voting for that 9 11style Commission en masse, and 35 house republicans did. On the democratic side, its a little different. There are two fairly different bipartisan commissions going on into the events of January 6th. And i heard from some republicans, even those that might be otherwise inclined to back of commission, they would like to see their own Committee Work Move forward and it may not be necessary. This would be the first republican filibuster of congress would be difficult for democrats but not impossible. I think were in wait and see mode, and some again on what those investigations find. Garrett, he said we already have a bunch of investigations going on, this is redundant but i want to play what john thune, the number three republican in the senate, i want to replay what he said. There are some of our members who i think obviously have an interest in seeing a commission go forward. Others who i think believe it will be counterproductive because of the work thats already been done. And that it could be weaponized politically, and drug into next year. So they think opposing this commission is less politically damaging than supporting it. However, Nancy Pelosi is going to go forward with an investigation on her own no matter what. And if they had done something on a bipartisan way, at least republicans would have a say in this, joint Subpoena Power. Exactly. They actually got almost every single thing they wanted in the negotiations. They sent representative katko there. They wanted equal representation, be able to pick the representation on the panel. Like you said, the Subpoena Power share, they got that. They didnt want to go into 2022, and the bill says 2021. Everything they got, they want. Another Loyalty Test to Donald Trump played out and 35 republicans said no, they will not play political games with what happened January 6th. Everyone has a vested interest in figuring it out because there are all of these questions we may never know, especially if theres not a committee like this, kind of 9 11style Commission, because they have so much more leeway to get into things that some of the select committee may not get into, even some of the Committee Chairs may not be able to find. Can you explain that a little more for us . Mitch mcconnell, for the folks at home, Mitch Mcconnell is saying were already investigating, this is redundant. Someone watching is, maybe we dont need another investigation. Explain why this one is different and necessary. The thing about a commission this style is devoid of politics. Its not a government, retired experts. This time if you look at 9 11, its similar in that theres so much going around and so many different interests in both of those investigations, investigation that is independent, that Nancy Pelosi cant in and ay anything about, those things are important and republicans would probably say they want and wanted as well. Katko got on the Floor Yesterday and pleaded for everyone to set aside politics, i think he said, just this one time. The commission would be a lot different than what you who see with a select committee. As you remember, the Benghazi Select Committee and how much investigations that were into that, that was very political, almost explicitly political. Thats what democrats were trying to get out of the process with the commissioner. Garrett, theres another big vote set today. Almost 2 Billion in funding for capitol security. Whats going on . This vote will be interesting as well. Republicans are also whipping their members for this bill, theyre calling it pelosis partisan hold on. Theyre whipping their members against . This isnt literal, this is about protecting their members of congress. Whats the argument against it . Theyre calling it an attempt to militarize the capitol on the house side. This may have problems in the gnat. The aforementioned investigations i was talking about still go on. Some senators say can we least get through our own investigations and own recommendations for what exactly the capitol needs before we rush to spend billions of dollars to change things here . Make no mistake, theres widespread agreement the Capitol Police need more money, there will be more money necessary to pay for the national guard who have been here protecting All Of Us for the last six months and even help with the prosecutions happening here in d. C. This bill will almost certainly become law eventually but probably not in the format it exists right now. Theres nothing political about security. Hopefully, this is just how much money and how and where exactly will it be spent . Eugene, garrett, Thank You both so much. Well have a lot more later in the hour when two members of the bipartisan Problemsolvers Caucus, republican josh gottheimer and republican fred upton will be here. We have to turn to the Breaking News out of the middle east. Nothing is letting up on Israels Assault on hamas, despite new calls from President Biden and international community to move towards a ceasefire. The u. N. General assembly will meet to discuss the conflict less than an hour from now. Nbcs Martin Fletcher is in tel aviv. You and i were speaking yesterday and in our last conversation you said, well, come tomorrow. That means today. We could can see a ceasefire. Thats come and gone. You shouldnt listen to me, stephanie. Theres a lot of speculation and the direction is towards a ceasefire and that is similar. Despite what prime Minister Netanyahu is saying, netanyahu is saying were going to continue as long as we need to. The information hes getting from israeli Security Officials is they can and should end the operations. Thats what he is hearing from Security Officials here. At the same time this morning, hamas officials said there should be a ceasefire within a day or two by mutual agreement. That was the emphasis, by mutual agreement. That does indicate there are serious negotiations of talks going on between israel and hamas indirectly. The third factor i would add to that is that weve heard now there may be israeli Security Cabinet Meeting this evening about 7 00 p. M. And having that Security Cabinet Meeting is an indication that they have to talk about something very seriously. Its an unusual time Thursday Evening to have that kind of meeting and obviously the inference is, expectation is, there will be discussing a ceasefire. Meanwhile, the shooting is continuing in both directions. Israels still bombing these targets in gaza. Hamas are still shelling israel. They fired one rocket at a bus where they hit the bus in israel. Fortunately for israel there was nobody in the bus. One person was wounded outside. The fighting is continuing. Theres serious moves towards a ceasefire but we have to hang on and see if that actually takes place and when. Martin, keep us up. As the violence continues in the middle east, now were facing a Hate Crime Probe into an antisemitic attack here on u. S. Soil. Police are looking into a violent fight at a Sushi Restaurant in l. A. After it broke out in Beverly Hills tuesday night. Witnesses say a caravan of men waving pro palestinian flags approached diners using antisemitic language. One of the diners sitting down yelled back and things quickly turned physical. Thankfully no one was seriously hurt. No arrests have been made as the lapd is investigating this as a hate crime. Now lets turn to the 12 punch of Bad News for former President Trump. The day after we learned his Business Empire is under Criminal Investigation by the new York Attorney general, there are new reports his longtime Cfo Alan Weitzeilburg is under Criminal Investigation as well. If you dont know the name weitzeilburg, you absolutely should. He started working for Trumps Father almost 50 years ago and at the heart of donalds businesses for decades. Heres how former fixer Michael Cohen put it to Joy Reid last night. Weitzeilburg knows every single dollar in not even dollar to the penny. Every single penny in, every penny out went through alan Weitzeilburgs Desk and reported before and after to donald j. Trump. That certainly sounds like an insider. Joining us to discuss, nbcs chief white House Correspondent Peter Alexander And Andrew weissmann, former fbi General Counsel and former member of robert muellers Special Counsel that investigated Russias Interference in the 2016 election. Now, lucky us, nbc legal analyst. Peter, lets start with you. What do we know. The new york times is reporting the States Attorney Generals Office in new york has been criminally investigating Allen Weisselberg for months over tax issues. The office of Letitia James notified the Trump Administration in a letter in january it opened that Criminal Investigation related to weisselberg according the times. More specifically theyre examing whether taxes were made on fringe Benefits Trump gave mr. Weisselberg, cars, Tens Of Thousands in private School Tuition for one of weisselbergs grandchildren. Previously the Ags Office was conducting what was only a civil investigation into the organization, which means it could sue the company or seek fines but not criminal charges. For his part the former president tore into prosecutors, including Letitia James, just hours after announced it was joining the investigation led by the manhattan d. A. Mr. Trump writing a long statement, 12 paragraphs to be exact, Theres Nothing more corrupt of an investigation in desperate search of a crime. Make no mistake, that is exactly what is happening here. For a little better understanding of it, two lawyers from the Ags Office are now partnering with the manhattans das team, Nbc News confirmed materials contained during their parallel investigations but its not clear if they found any new evidence of possible criminality, steph. I realize youre not investigating this, but everything from what you have seen, read, and know, what do you think is going on here . I think theres a huge effort to get weisselberg to flip. And that effort really took a huge lead forward because right now i would say Weisselberg Is has the choice of playing Russian Roulette with one bullet or two. Because you now have two separate offices with Criminal Investigations into him. In addition, he has two types of exposure. He has exposure with the spectative conduct with respect to the Trump Organization, whether he did anything wrong there, and he has allegations with respect to whether he did anything wrong with respect to his personal taxes. And with that, as was just noted, he received, by all accounts, not just Tens Of Thousands, but hundreds of thousands of dollars in presents from the Trump Organization. And the question will be was that all reported on his Tax Returns in both manhattan and new York Attorney general have jurisdiction over those types of charges. So hes facing a whole lot of pressure to cooperate. Weve been talking about Allen Weisselberg since the Day Trump took office. Whats different now that trump doesnt have the ability to protect him, or if he did get in trouble pardon him a la Paul Manafort and Roger Stone . I dont think he obviously federally had that ability when Donald Trump was president. He didnt have the ability at the State Level to pardon anyone because federal pardons dont apply to state cases. I think the main difference, steph, is we basically have two offices that are really ratcheting up their investigation by all public accounts. But its a fair question to say where were they for the last four years . But all signs are that the drumbeat seems to be getting a lot faster when you look at who theyre adding to their investigations and the information that is slowly creeping out in various ways about what theyre doing. Havent we been saying this for five years . I agree. Im not sure five is quite right. A lot of people think if youre in the real Estate Market in new york, as Donald Trump was, there are probably some shenanigans and things the new York Attorney general was looking at from a civil perspective but you get the sense now theyre digging in. Its a fair question to say where have they been . But right now if you are where you are, well see if they make a case with the secretary of Donald Trump, other people of the Trump Organization. I think the critical piece is whether weisselberg flips. Without a doubt. Andrew, Thank You very much, peter, Thank You. Well leave it there. Ahead this hour, one county benefited from covid relief more than any other. Ready for this . It happens to be the Home District of House Minority Leader, republican Kevin Mccarthy. Were going to get into that. You do not want to miss it. Plus, texas is on the verge of a major change to covid guidelines. Well tell you theyre new plan as dr. This morning, theres growing confusion with a number of public officials still strongly encouraging people to wear face masks, while others are saying its okay to distance. Weve got our team of reporters across the country trying to make sense of it all. Lets start with Meagan Fitzgerald in wisconsin. Whats going on there . I can tell you one day after the mayor of chicago, lori lightfoot, appeared on your program, her top Health Official came out saying theyre strongly advising fully vaccinated people to wear masks indoors but theyre not requiring it. Keep in mind only 38 of chicagoans are fully vaccinated. 48 received at least one dose. And while they say theyre certainly making progress, theyre not there yet. Essentially what this does is puts the onus on the Business Owners, feeling they have to mandate the Mask Mandate in their establishment, putting them in a difficult position. I want to you listen to what one Business Owner had to say. Theres a lot of confusion on both independents of this argument. As a Business Owner, youre trying to make sure you protect your business, but at the same time not alienate your customers and clients. So putting these businesses in a precarious situation. Many of them obviously struggling over the last 14 months having to shut down or having to limit capacity, so the last thing they want to do of course is alienate customers. Thats the latest here in chicago but i want to turn now to my colleague morgan chesky, who is this dallas. Whats the latest there . Good morning. Today will be the beginning of what was enacted Byas Rn Abbott on tuesday, and that is a order that essentially prohibits organizations, communities, counties to implement their own Mask Mandates going forward. In addition to that, should they violate the governors order, they could be facing a fine up to 1,000. Governor abbott points to a Couple Key Metrics for the reason behind this decision. Effective 3 Positivity Rate over the past week and sunday there was not a single covidrelated death in the entire state of texas. This is creating some concern for parents because School Districts will no longer be able to enact their own rules. I want you to hear what one mother had to say from a dallas suburb. My fear is if we have a large concentration of unvaccinated children all together, not socially distanced in the schools, were just going to continue to keep infecting people. And with a 33 Vaccination Rate in texas, youre never going to get the pandemic to end. And there are some exceptions to the governors executive order. That includes hospitals, staterun prisons, jails or Support Care facilities. Steph . Thank you. And we have more developing news in the state of texas, where republican Governor Greg Abbott signed a Bill Banning Abortions once a heartbeat is detected. It effectively bans most abortions in the state because fetal heartbeats are detected before six weeks, before women realize theyre even pregnant. And the Law Wouldlet agencies sue providers or anybody involved in aiding an abortion. I can tell you we will be talking about it more this hour. Coming up next nearly 90 of republicans In The House voted against a bipartisan commission on the January 6th insurrection. Thats the planning effect, from fidelity. Back to our top story, the house approved a bill to create an independent commission to investigate the attack on the capitol January 6th. It now faces an uphill battle in the senate where it needs report from at least ten republicans to pass. Joining us now, democratic congressman josh gottheimer, and a remember of the caucus fred upton of michigan. Congressman upton, you joined just 34 republicans to vote yes on the bill. Why do you think the fellow of your house republicans voted no . Well, there was a lot of pressure from the top to vote against it. At the end of the day, katko, top republican on the homeland security committee, was given the order given the suggestion to move forward, to see if he can strike a bipartisan accord. He did so. It was regular order. By the end of the day he won by 75 votes or something like that. On the over under if someone made a bet, they probably would have won. We did a little better than i think people expected. Are you concerned youre going to face consequences from Kevin Mccarthy or Donald Trump . No, i dont think so. This is we will see what the senate does but this is a bipartisan, independent commission. You cant do anything unless it has bipartisan support. So at least one republican has to be with all of the democrats or vice versa, to get it done. At the end of the day we need to find out the answer to the questions, who knew what, when, and what did they do about it . And let the chips fall where they may. That is absolute logic. Congressman gottheimer, you were just named the most magna Muss House democrat. At the end of the day, how do you work with a party who Cant Support Logic . Definitely not a trophy. But in order to get this done and get it out of the senate, we need to get 60 votes and with starts with trying to build bipartisan support for this. We had a lot of republicans break with Leadership Yesterday because they recognized this is not a partisan issue. The issue is bipartisan, its bicameral and the Bottom Line is its meant to get to the bottom of an attack on our country. Its not a partisan issue. About 20 people who voted yesterday in the republican party, members of the problem solvers caucus, our whole mission is find a place we can come together and agree and we did. This will take a fight, like everything takes a fight in a partisan atmosphere, but this is bipartisan and commission is bipartisan and this is about our democracy, which is just red, white and blue. Im hopeful well get this done. Again, logic. Congressman upton, i want to share a bit of what congressman Tim Ryan said last night about all of this, and really calling out republicans for not being rooted in reality. Please watch this. If were going to take on china, if were going to rebuild the country, if were going to reverse climate change, we need two political parties in this country that are both living in reality and you aint one of them that sort of sounds like something anyones dad could say at the Dinner Table whos not political at all. Does it make sense to you . Well, you know, i was on the floor when he spoke. I spoke just a little bit before he did. But thats really what the Problemsolvers Caucus is all about. Were upset about the dysfunction thats there and everybody sees it whether theyre inside the beltway or outside. What our caucus did, we looked at the facts, endorsed it. Most of us on both sides voted for it. All of the democrats did and good number of the republicans in the Problemsolvers Caucus. We exchanged the rules a bit and we went regular order, committee did its work and members voted for it. End of the day, 75vote different. Hopefully that sends the signal to the adjustment, they make some changes and send it back. But we ask it would be better to do it with both parties sitting at the table, and thats what this bill did. To that very point, Nancy Pelosi is putting together an investigation, some sort of commission no matter what. Why wouldnt republicans want to have a say in this . You remember right after the insurrection, you had some republicans saying it was antifa that did this. We know it wasnt but wouldnt this give the opportunity to show that if that were true . Thats exactly what i dont get. If anyone is trying to hide something. On the 6th, i was on the floor with a gas mask. It was an Insurrection Led by a bunch of lawless thugs. The Bottom Line is we should figure out what happened and also how do we make sure it doesnt happen again. How do we protect our democracy and make sure theres clear separation of power. Its important we get to the facts and bottom of this to prevent it from ever happening again from our country and both sides should want that and democrats and republicans were attacked that day. Law enforcement was attacked that day. So for me this is just a matter of getting to the facts and preventing something like this ever again in our great democracy. You would think that all republicans, democrats would want to be there. Thats why i praise fred upton and his great leadership and so many problems in our caucus have said, why are we putting a partisan label on this . Why dont we just do our job . The country wants us to move on together and unite. Congressman, i want to turn to infrastructure. Im in no way knocking President Bidens plans or goals but i want to get to reality, if you cannot even get republicans to play ball on what happened January 6th, you do not have a Snowballs Chance in hell that theyre going to pass the infrastructure bill. Why wouldnt democrats consider the House Transportation committees plan . Its still a very big one. And you can work on other things after. Just given where we are in reality. Well, i think theres certainly an opportunity here and fred and i in our caucus meeting, we met last night again, are working on a piece of the package focused on physical infrastructure. I believe theres a bipartisan agreement that can happen there. Its coming together. Were working on it. And im hopeful we can get that done together. The country needs it and we cant afford to have a package that fails. Im focused, and i know our caucus is on doing a piece of this, physical infrastructure, roads, tunnels, energy grids, water, im hoping we can get that done together. And i talked to a lot of republican senators ready to go on that. Congressman upton, to your point, clean water in michigan, pipes, your state absolutely needs that. Help me understand the rational we hear from republicans, Mitch Mcconnell, who is focused on blocking President Biden at every turn. Is that what constituents want . Do constituents want no compromise . Because in all of our regular lives we compromise at home, work, in every aspect, yet our elected officials dont seem to want to do that. Whats the rational . I agree to your point. People want us to do our job. I share joshs optimism were going to get a deal done. It may not be the biden plan, which was literally about 2 trillion. Had a lot of things that werent physical infrastructure. Our group has met with governors, republicans and democrats, senators, republicans and democrats. We will get another Zoom Call next week i think on this. Were trying to find the right sweet spot where we can move forward on the bipartisan package the president will support. I have been to the white house, so has josh, to talk specifically about Infrastructure Plan that we can get both republicans and democrats to support. Were getting close. Of its going to be the next couple of months. I think were going to get this thing done and i share joshs optimism its going to happen. If you have optimism, you can always bring it here. Congressmen, Thank You both for joining us. And speak eck of infrastructure, ive got to share the details of a new report that reveals one of the biggest ben factors of the american Rescue Plan happens to be one the most vocal critics of bidens Infrastructure Plan, House Minority Leader Kevin Mccarthy. Joining us to discuss the journalist behind this post, erica warner. This is amazing. Kevin mccarthy vehemently opposes bidens proposal. Tell us about this. What do they use . His district at the bottom tip of central california valley, has a lot of poverty, large sizes relatively, younger family and they really need that child tax credit. We found that theyre among the highest need districts in the state and in the country for that particular benefit. Some 93 of children would qualify for it compared to around 86 nationwide. Lots of folks getting stimulus checks, unemployment still in double digits in that district, even as its falling to single digits in the rest of california and the nation. So a lot of enhanced unemployment benefits. Just a lot of needs that federal legislation addressed but that mr. Mccarthy opposed in the most recent round of legislation. What is he doing in office . He hasnt been reelected since 2007. Thats right. And i think your previous segment went to that a bit. Which is that mccarthy, someone in the california state legislature, record of some moderation, hes know toeing the Party Line and sticking with President Trump and that is where he has to be as a national leader. His district remains strongly republican. Theres a lot of Voter Disengagement among those folks, a large number of undocumented immigrants who are not able to vote, and the congressman continues to have a base of support, in some cases folks that are benefiting from the programs that he opposes but nonetheless, maybe dont Connect The Dots or continue to support him nonetheless. Democrats have some work to do in that district. You think he will be safe in the next cycle . You can only be a leader on the national stage if you get elected in your Home District. I dont think hes at risk, and clearly, hes trying to make sure that hes not and thats in part by supporting President Trump, which where republicans have to be for the most part for electoral viability. Any challenge from the right, like The One that knocked off his predecessor Eric Cantor back in 2014, would emerge if mccarthy were to distance himself from trump, take different instances than what are the Party Line instances. So he is where he is. And that is working for him politically for now. His reelection numbers have been dropping slightly as far as his winning percentages. There are demographic changes that herald maybe problems ahead in the long term but for the short and medium term, i think hes fine. It is stunning. Youve got political leaders voting against things that theyre own constituents want, need and use. Erica, fantastic report. Thank you so much for joining us. Coming up next you do not want to miss this. A Black Homeowner who thought her home was being lowballed in two appraisals, she had her white Friend Stand in for her during a third appraisal. Guess what . Turns out she was right in a big, big way. First, i have to introduce you to our hero of the day. 17yearold Nigel Berry from Las Vegas has made it his mission to support kids in need. For years they welcomed a Foster Child into their home. Seeing his brother arrive with just a bag of clothes that were in the wrong sizes, nigel wanted to make a change for other Foster Kids and launched his own nonprofit. Since the start of clothes for kids, nigels rallied donations for Local Foster Agencies and connected 2,000 Foster Kids with new clothes and basic essentials. Were learning more about Housing Discrimination across the nation. After a Black Homeowner in indianapolis saw her Homes Value doubled when she hid her race to The Appraisers. Presill La Thompson has been all over this story. How in the world did this happen . Three times did Carla Duffy have her home appraised over the past year. The first two times the value came back well below what she expected. So on that third try, she got creative. Check it out. After her grandmothers death, Carla Duffy set out to buy the Family Home by refinancing her own house. This is a photo of her behind her home with my dad. But after receiving two appraisals well below what she thought her home was worth, duffy worried something might be amis, especially after the second appraisal. He said 110,000. 15,000 less than the first one, which was three months earlier. So duffy tried again. This time she didnt disclose her race or gender. Only spoke with The Appraiser visa email. I met with two of my girlfriends. Both of them are married to white men. I said, all right, i need to borrow one of your men. Duffys home is valued at 259,000, more than double that of her previous two appraisals. I screamed with joy. I just was i was so elated. And then it just it quickly dissipated. And then i just cried. Duffys Experience Isnt isolated. Homes in black neighborhoods are underpriced by 23 , about 48,000 per home, and that adds up to 156 Billion in lost equity. This Month Duffy filed a complaint with the u. S. Department of housing and urban development, alleging discrimination in both her Appraisal And Lending process. You are taking away my Familys Ability to create generational wealth. In statements to Nbc News, City Wide Home Loans denied any discrimination and said they are actively participating in the hud investigation. Freedom mortgage said they use an automated Valuation Model after receiving the complaint and stood by the appraised value. None of The Appraisers named in the complaint responded to Nbcs Request for comment. As for duffy, she used the money from the final appraisal to fulfill that dream. Its the house that my grandfather built. I hope to see my grand baby raised in that house. Experts tell me that Black Homeowners should assume that they are being discriminated against in this process and look at those appraisal forms very carefully. Now, if homeowners feel like their home has been undervalued, they can challenge that appraisal through the lender. And if necessary, reach out to their fair Housing Organization locally or an attorney to discuss next steps. And if you dont, we will be covering these stories every single day. Thank you.
