I hope you have a lot of time because we have a lot to talk about. Joyce, let me start with you and the last topic of discussions going on about what happens if trump gets charged with something in manhattan. What is your read on that . Theres an interstate compact that allows states to easily transfer people who are indicted in one state but who are present in another state back to the state thats charged them. Thats something that happens in most cases almost automatically and no one ever gives it a whole lot of thought other than simply executing it. It is a ministerial function. So, of course, as with all things trump this routine process of our laws gets called into question. Although Governor Desantis can make some noise here, perhaps he can even take a little time to make sure that the President Trump in florida is the same former President Trump who is indicted in new york should cy vance choose to indict the former president. This is more smoke and noise than an actual effort to keep the president from leaving florida and facing justice. Of course, you can think about how this could play out if desantis were really to stand some ground and refuse to deliver trump here. It would likely mean that all transfer of prisoners between the states would fall down. It would mean trump would be unable to leave florida. It would reach a level of ridiculousness that would ultimately ensure he would be delivered to the state of new york. Reaching a level of ridiculousness could be the book that any one of us write about the last four years. Just like joyce is the legal analyst of our time, gentleman meesh elcindor, you are the journalist of our time. I know you have been on msnbc since your appointment to your new gig. It is always an honor to get your analysis. I just wish i didnt have such silly things to get your analysis on sometimes. But this business of the Bipartisan Commission into january 6th on its face is not silly. It is probably important. It is even marginally bipartisan at the moment. Tell me how you see this playing out because this could be a remarkable moment for taking stock of and bearing witness to what really happened on january 6th and looking at ways to move forward from it, or it could be dead in the water. First i just want to say thank you so much for that great congratulations. Im so excited to too the helm of Washington Week watching you anchor every weekend and during the week, ive learned a lot taking it all in. Hopefully i will do well. Thank you so much. When it comes to the commission, right, january 6th, what we know about republicans right now is theyre not only trying to run away from the idea that january 6th happened, theyre trying to retell it into some sort of tourist visit. You saw andrew clyde of georgia talk about the fact it looked like people were just coming there for a good day, almost having a picnic at the capitol. What we know, of course, is that this was a violent insurrection where the life of the Vice President , the House Speaker and so many other lawmakers was really in danger. People were terrified and people still have so much trauma from this moment. I think this is going to be a big question about whether or not this commission can really get to the bottom of what hatched. There are so many questions about that day, including chief among them what was the mind state of President Trump. Was he withholding Law Enforcement . Did republicans tell these people where to go in the building or was this just sort of a gathering of people from the dark web and this wasnt the intention of many of them to actually get involved in this . I think those are all of the questions that we have to ask, and because it is bipartisan it looks like, yes, maybe they can have a kumba ya moment. But you see Kevin Mccarthy saying why are we only investigating january 6th, what about antifa and black lives matter, things with nothing to do with january 6th. You know, people talk about it was antifa and it was black lives matter. The 9 11 commission, a lot of people had criticism of it but it was a big deal with important people on it and it led to changes in this country, some people are critical of and some that were important. What can happen to this if it goes right, joyce . I recently had the occasion to reread the 9 11 report, and in many ways it reads like a novel. It is a factual recitation, heavily documented, of the truth about what happened. Of course, it is only if you have a clear vision of the truth that you can begin to prevent Something Like 9 11 from happening again. So we know that for too long in this country white Domestic Terrorism has been sort of shunted to the side for whatever reason. You and i have discussed this a lot, ali, but for whatever rees reesreason it has not had the attention it deserves. It would prevent new laws and policies to go into place so we could begin to treat this sort of terror with the same priority we use for international terrorism, prosecuting and preventing to keep americans safer. Greene has a long history of accosting aoc. This newly unearthed video from 2019 before she was elected first reported by cnn shows the thenprivate citizen greene and several others including someone who later partook in the insurrection, searching for aoc at her office. In a new tweet responding to the incident aoc writes, quote, the fact that Kevin Mccarthy, the house gop leader stripped but worked to protect this person from consequences including he doesnt see it tells you this is happening with the support of gop leadership. All of this comes amid a major change in the house of Republican Leadership with election denier Elise Stefanik replacing liz changie as third leading republican in the house, all because cheney had the gall to call out the gop leaders election lie and for the threat to democracy that it is. The lie is growing bigger and bolder every day as a coalition of republicans is trying to convince the American People and the Republican Party that they did not see what they saw unfold on january 6th. It was Trump Supporters who lost their lives that day, not Trump Supporters who were taking the lives of others. My constituents demand answers but the truth is censored and covered up. As a result the doge is harassing peaceful patriots across the country. Was january 6th an insurrection or could it be more accurately described as a mob of misfits. There was no insurrection and to call it an insurrection is a boldfaced lie. If you didnt know the tv footage was a video from january 6th you would think it was a normal tourist visit. You would actually think it was a normal tourist visit. We want to make it very clear that these ideas of freedom and constitutional foundations, im prepared to fight all day long against things that dont serve the American People. The fight immediately in front of us is about our democracy and what it means. We are about to go into an Election Cycle in which state after state around the country are currently rewriting the laws. We are going through a redistricting process in which the people redrawing the lines are not going to draw the lines in the best interests of the American People. So we want to make sure that we are in that space to call it out, for people to see what it is, to galvanize america around this idea of renewal so that we can all be better prepared to deal with what is about to come because 2020 is a warmup, folks. You thought it was over because you elected joe biden . Well, look whats happening in 47 states. All right. Look what is happening out in arizona. You think it is over . This crew is not stopping. So thats why were here. So you put out 13 principles that are really theyre really good, regardless of where one stands on the political spectrum. Democracy, founding ideals, constitutional order, truth, rule of law, ethical government, pluralism, civic responsibility, opportunity, free speech, conservation, common defense and leadership. Pluralism, the idea there can be people in this country breathing our air, sharing our politics, marrying our children or ourselves, sharing food with us who do not share all of our political beliefs, all of our religious beliefs, all of our culinary beliefs, how do we get back to that, that you and i might actually debate policy, as you said . Right. As opposed to this weird tribalism we are in. The pluralism for me is the most important part because it is foundational to the rest of it. If you create a society, a culture in which you look at your neighbor as other, then all of those other things on that list will fail. You dont get to the rule of law because we see how that plays out for black folks. You dont get to, you know, having a debate around constitutional ideas. We saw how trump basically crapped all over the constitution. The reality for us is you have to start with what this country at least on paper tried to set itself out to do. Now it is up to us to make that real and to bring it alive. I get the history. I know the 400 years. I know the struggles that we have all gone through. I know what our founders were like. I appreciate that, but they wrote words that still resonate about a certain i deal and freedom. So this idea of pluralism and all of those other principles that we want to bring together, thats what this is about. Thats what this party, my party, has lost sight of. It is sitting it is like sitting down in front of a reality tv show, and it is just sitting there with popcorn just eating it all in, oblivious to what is going on around it. So our goal is to turn the tv off and to pull the party into the 21st century. Those who dont want to come, fine, but the rest of us do. Thats what this struggle inside the gop is about. Lets make one thing clear. Israel has a right to exist and to defend itself. That is an indisputable fact. But so do palestinians, and thats a fact thats often ignored. Palestinians are at best third class citizens in the nation of their birth. The idea that it is even remotely controversial to call what israel has imposed on palestinians a form of apartheid is laughable. One look at a current map of israel, gaza and the occupied territories conjures up only one other example, apartheidera south africa. The Israeli Government on an ongoing basis declares parcels of land on which palestinians live to be either archeology importance. Sometimes theres a court case and almost always palestinians lose. Months or weeks later that important land becomes home to a brandnew israeli settlement. As more and more jewish settlers take over land on which arabs live, the occupied West Bank Becauses De Facto more israeli and more jewish. This is a long standing attempt and deliberate attempt to force arabs that have lived in that land, sometimes for hundreds of years, out. It is an attempt to dilute their presence because to have arabs as full participants is in the opinion of the Israeli Government and their courts diluting israel. Prior to the pandemic i toured many of the contested areas and homes from which arabs are being push you had out, both in israel proper and in occupied territories. Palestinians dont control the important parts of their lives. Palestinian families are refused permits to build or renovate their homes when they connect their homes to the municipal water supply, Israeli Soldiers sometimes cut the pipes. When they attempt to harness Solar Energies because their homes are not on the grid, Israeli Soldiers come and remove solar panels from their homes. I spent an hour and a half traveling alongside an elderly Palestinian Woman being transferred between three ambulances from gaza to the nomans land in between and then into israel to get cancer treatment. Three ambulances over the course of one mile. More than an hour to cross the border. Thats how gazans live, without medical treatment because israel prevents it, without electricity much of the time because israel prevents it, without the ability to fish in the Mediterranean Ocean buss israel prevents it, without an airport or sea port because israel prevents it. Like Israelis Palestinians have a right to exist and to defend themselves, but there is no one willing to help them do that. Not the israeli courts and not the u. S. Government. What the u. S. Also shares with israel is the belief that hamas, the Political Party that governs gaza, is a terrorist organization that calls for the destruction of israel. Hamas is supported by the majority of palestinians in gaza. Hamas may not be in the best longterm interests of the gazans but peace hasnt really worked out for them. Faced with an Israeli Government which pins them into what has been called the Worlds Largest open air prison, they have chosen a government most of us wouldnt prefer, one not given to negotiation and moderation and respect for its neighbor. Israel needs a new approach to the palestinians and America Needs a new approach to israel. After more than seven decades of not just being deprived from land which they were evicted, palestinian frustration runs deep. It may be worth going deeper than what you may hear inside your bubble and understanding the depth to which the Palestinian People are subject to apartheid in their own land, deprived of basic necessities and subject to relentless civil rights violations. More than four months after the attack on the capitol, congress is finally getting closer to investigating what unfolded that day with the leaders of the House Homeland Security committee agreeing to the terms of a January 6th Commission. Democratic congressman bennie thompson, the chair of the committee, released a statement that reads in part, inaction or just moving on is simply not an option. The creation of this commission is our way of taking responsibility for protecting the United States capitol. We owe it to the Capitol Police and all who enter our citadel of democracy to investigate the attack, end quote. While that commission would seek answers about the insurrection, several concerns about the commission itself remain. For one, minority leader Kevin Mccarthy says he hasnt signed off on the commission which could potentially cause problems down the road. Secondly, right now many republicans refuse to acknowledge the attack, which indicates what a tall task getting to the truth is going to be. For more on this im joined by michael chirtoff, now executive chairman and cofounder of the chirtoff group. Thank you for being with us. It is important to talk to you because you were so central to the last time we tried to get to the bottom of why there was an attack on sort of what we hold dear in america. It feels different now. It feels different than it did with that 9 11 commission, which most people will agree was a noble effort and probably led to some important changes, some of which you implemented. Whats good about what we are seeing with the January 6th Commission and what worries you . Well, i think the idea of having a January 6th Commission that would be bipartisan is a very good idea. Just like with the 9 11 commission, you want to understand what were the failures that allowed a situation where you could have a violent insurrection at the capitol, particularly in circumstances where it was pretty obvious there was going to be an assembly of people coming to washington, many of whom were ardent Trump Supporters and who had negative attitudes about the election. Getting to the bottom of this and making sure it doesnt happen again is exactly what we need to do as we did after 9 11. What worries me is were in a much more political environment now. I remember after 9 11 everybody came together, republican, democrat, all americans because we knew we were under attack. Were under attack now, our values are under attack, but it is a domestic attacker, not a foreign attacker. That has created a degree of political division, an allergy to the truth that is either going to make it more difficult to have this commission. I want to talk to you about what your successor has done with the National Threat assessment bulletin. Yesterday my oh as said with the issuance of todays ntas bulletin, were advising people to be vigilant about the ongoing threats to the United States, including those posed by Domestic Terrorism, grievancebased violence and other malign influences. Thats the point you were making. Is it more complicated we acknowledge the fact thats possibly the major threat facing our country right now, that it is grievancebased Domestic Terrorism . Well, this has been evident for a few years now. We have seen that actually most of the deaths in the u. S. Caused by acts we would characterize as terrorists have not come from Jihadi Terrorists overseas but from americans pursuing extremism, particularly right winger extremism. It doesnt mean overseas terrorism is not a threat anymore but we have to look at home for where the threat is. The complication is this. When we collect intelligence on foreign actors who may be terrorists, the law allows us much more flexibility. Domestically we have to be careful not to tread on the First Amendment and Freedom Of Speech. So we have to be careful to distinguish between political ideas we disagree with and acts that incite or actually further violence. So it is going to be a little tricky to do the intelligence collection here, but the important thing is not only secretary my mayorkas has been clear that it is the most urgent threat in terms of terrorism. You bring up something important. People will remember after 9 11, it was also very important, the idea that you do not tread on Civil Liberties, in this case we are talking about there were other Civil Liberties involved in the work including what you did with the patriot act that people were critical of. How do we address that right now when so much of this is argued to be Freedom Of Speech and expression and others fear it is actually attacking democracy . That is a very hard line to walk. It is a hard line to walk. The key is really to use the phrase incitement as a distinguishing factor. If i express a view on politics in a general sense, thats normally protected by the First Amendment. But if i suggest go out and do something violent or physical, thats incitement and it has never been protected by the First Amendment. So i think the important thing is to be carefully and in a measured way, but not to abdicate the responsibility to identify threats. I will say this. Now days on social media many of the people who are most violent advertise what theyre going to do. They dont keep it secret. They go, im going to go and do something blow something up or kill somebody. Once you say that, youre no longer in First Amendment territory. Michael, i want to ask you about this new effort, this new threat to the Republican Party, that either it gets its act together or people like you and others will do Something Else. What does it look like . What does the do Something Else look like . Look, i think we would like to have the Republican Party return to its roots as a party that cherishes the constitution, democracy, freedom, and also treats creates a big tent where people of all different views within reason can come in and be part of the party. It has deviated from this over the last few years, and we have seen a much more hardedged ideological and, frankly, antidemocratic group within the Republican Party that have taken over. I like to think that most americans including a lot of people who are naturally inclined to be republican in terms of policy would like to see a return to a party that cherishes our fundamental values like the Democratic Party should as well. If that doesnt happen, people are going to bail out and either join the Democratic Party or join an existing party or create a third party. But the important thing is to create a movement and a platform that people can feel a part of in order to promote these very significant Constitutional Values which americans have fought for and died for since the beginning of the republic. Well, if it works, it will be interesting because the 13 principles that are laid out are principles that would be appealing to people across the political spectrum. So we will watch it closely. He is joining us by phone because hes on the move now. Richard, since you and i talked moments after this happened the Israeli Defense force has said that hamas went assets inside such a building. It becomes a lawful military target. This is Clear International law. So as you reported, the israelis are saying that this building was not just a building that housed media, but, in fact, it was a fair military target. Reporter so this is a building that many journalists use, that journalists operate openly in and have for many years including the associated press, the bbc, aljazeera. I have heard this line from the israelis before. I have worked out of this building in the past, said that hamas militants use it, that they have a hiding place underneath the building. I dont know. I have never been down below the building. I dont know what happened there. I cant guarantee that hamas may have some subterranean structure but i have been there and operated there as have many, many other journalists and i have seen no indication at all that in the past this was being used to house hamas or Shelter Hamas or that it was any kind of a military facility. That said, gaza city is very dense. Hamas does operate in the city, but i have never seen any evidence to suggest that this was a military already, there are many cries in gaza and outside of gaza from journalists that this was an attempt by israel to punish those reporting in gaza, to try to silence voices that are speaking out in gaza about the assaults. Israel is bombing to stop rockets falling on israeli cities which is clearly a legitimate military target. Im here in tel aviv right now. In the last several hours i have heard Air Raid Sirens going off in the city, i have seen israelis running to their shelters, at least one man was killed just outside of sell aveve today. So israel attack. It is bombing hamas but a building that houses journalists and has long housed journalists, it is a different kind of act. The way it played out is first they the owner of the building received a warning phone call telling the Media Organization to evacuate. They had one hour, they were told, to evacuate, then there was a mad scramble to get out their equipment, to get themselves out and to salvage what they could. As you and others watching can imagine, moving a lot of Television Equipment in a building that is trying to evacuate all at once with only a few elevators, and it is a tall building, you can imagine the scene there with the stress, knowing that you didnt have time to be late. That after one hour the building was going to be bombed and it was. And after one hour it was bombed and collapsed like a house of cards. Richard, i know you dont need the admonition. Reina shaw, a former republican senior hill aide and strategic and policy consultant and director of Domestic Policy Studies at American Enterprise institute ryan streeter. Ryan is a former Deputy Chief Of Staff for policy for mike pence. Ryan, you work for the aei, you have to think about Economic Policy all the time. When i was arguing with republicans a few years ago about the tax cut, the point was and i think people across the board politically can agree on this lower the rate and broaden the base. More people will pay taxes and they will pay a lower overallwe truth to what youre saying, but i think also we achieved a lot through the tax reform in ways that have benefitted us. The way you started this out was talking about corporations and whether theyre paying taxes, particularly as it relates to the infrastructure bill. I think we achieved a lot of progress along the way by lowering the Corporate Tax rate. We need to make sure everybody whos supposed to be paying is paying. The key for this discussion that you started with is to keep the American Economy competitive, we need to be making sure that, one, everyones paying the taxes they should be paying and, two, were Funding Infrastructure in a way that makes things competitive. As someone who has worked at the state level in government as you mentioned, thats where a lot of Infrastructure Dollars go to die. So i think the focus of the conversation should really be how do we invest in the things that truly make americas economy competitive so that it can keep growing, innovation and productivity can stay up which benefits us all at the Household Level . Thats focusing on the key things like ports, airports, things that are in limited supply that are really important to the American Economy and making sure that we focus our investment there. Okay. Hold that thought for a second. Im going to talk about how broad or narrow infrastructure should be. Reena, if i get into an uber, the dreefr needs to get me where im going and not have me die. The only thing that needed to happen with the lowering of the Corporate Taxes. Only two things. This he did only one of those things. So i actually agree with what ryan is saying. I agree on what the goal was. We just lowered taxes for corporations. There arent more Companies Paying taxes. Well, ali, you know the many times ive been here ive will lamented how republicans cant get them done with fewer of them in congress and what are the areas of agreement in what joe biden has proposed, what democrats in congress are asking them to come to the table and do with them. Its no secret the infrastructure has been neglected for decades. In looking at infrastructure i see one big agreement. To ryans point of competitive and what we need to frame is the business benefit of this demand side economic spending. Even though the funding starts at the federal level, it started at the business level. The money that goes to state, county, municipal, school districts, its on Business Procurement to implement business project. That has a huge stimulant on corporations that are hiring people. They turn around and hire employees and Small Business vendors for these projects. Those employees and Small Businesses pay taxes. What we have is positive Economic Policy and thats what i want to see republicans come to the table and broker an honest deal with democrats on. Ryan, lets talk about you eluded to what infrastructure is. I think the point is on narrowly focused infrastructure, bridges, ports, roads, things like that, we all know that thats what infrastructure is. The Biden Administration is taking a bigger view of what infrastructure is which is kind of what roosevelt did and eisenhower did. They introduced things people never thought about because we didnt have an interstate highway system. Whats wrong with thinking about infrastructure more broadly as things that create a better environment for people to be more productive purely economically . Theres nothing more broadly. Whats important about infrastructure is its structure. It has the bones on which our economic markets work. So you can broaden it out. Theres money proposed in the plan for broad banged, for instance. We know we need that more than ever. There are parts of country and communities within larger metro areas ill served. Thats certainly a legitimate use. I think its smart to break out the overly broad definition of infrastructure which falls into the realm of Family Policy and all of that. And focus on things that lead to competitiveness. I think the way you framed this at the beginning is really important, that this is really about the structures that make our economy hum, that help us do things faster and better and increase innovation and productivity. That benefits everyone. When it comes to the individual bridges, the roadways, the cable lines, the Telecom Infrastructure at the state level as reena said, thats where the stuff gets negotiated at the end of the day. Nothing is more political than that at the state level. These are the things that make these dollars get spent in a bad kay. They get directed to things that arent necessarily important for competitive businesses. I think its important for our federal money to go to the things that work and leave the stuff at the state level things like user fees, the other kinds of things that let the dollars follow where people are going and choosing to go to work. Yeah go ahead, reena. I wanted to point to the fact that the American Society of Civil Engineers told us that more than 40 of our roadways are in poor or mediocre. Where i grew up in rural southern west virginia, broadband is a problem. The state doesnt do well on that. Why is infrastructure seeking to address those problems by steering that extra 115 billion extra dollars to help repair the 20,000 miles of roads and 10,000 bridges we have nationwide. Thats huge. I think we can really agree that we are a better country when we have all of that handled. Its unacceptable for a country like ours to have these problems in 2021. Let me ask you about another area that there might be some degree of bipartisanship. George Floyd Justice act. Probably not going to happen by the anniversary. Im not saying the things keeping republicans and democrats are not big deals, but it seems like there might be room for some bipartisanship and compromise here. Well, we know that conservatives hate the Defund The Police Talks but i believe Bipartisan Police talk is needed. Senator tim scott said compromise on qualified immunity will get it over the finish line. Hes proposed something different, instead of weakening it, he thinks civil suits should be allowed to be brought against department and hes analogized that with other Industries Like with doctors and lawyers and saying most industries that employers bear that brunt instead of employees. This will be a tough one, ali, but its very possible that he will be with senator booker and karen bass of california as well. I think this is going to be good because senator scott is really doing well for his colleagues here. Theyre saying to him, look, give me a reason to get to the numbers here. Show me the reason. Show me why, how i can explain my position and hes going to give them cover, so to speak. This needs to be done. Its so its high time. We are past the Derek Chauvin verdict here too. It is high time that republicans in the senate act on this. Ryan, your point earlier about infrastructure applies to this too. There are 18,000 Police Forces across the country. In fact, a lot of the important work that needs to be done in policing is going to have to happen at the state and local level. This may be progress if there can be a bipartisan deal but does policing really change if we dont change it more locally . I think reenas right. Were on the right track and doing the right kinds of things for a bipartisan agreement. I think if you want to see the roots of bipartisan compromise, just look at the polling data. Over the past year americans want to see Police Reform but they also dont want to see their police defunded or done away with. You look at the way those numbers have changed after George Floyds murder last year until now when weve seen a 33 spike in homicides. 63 of 66 jurisdictions have seen increases of violent crime. Its no surprise youve seen support for defending the police really drop and yet the support for Police Reform stays high. What does that tell you . People really value their Police Presence in their communities. Urban residents dont want it to go away. They want the things that weve witnessed in the chauvin incident and the others to stop. So i think the areas of agreement, the banning of choke holds, the no knock warrants, the national database, these are all steps in the right direction and i think thats why someone like jim clyburn last week said hed be willing to kind of negotiate away for now the qualified immunity issue so we can make progress. Its a good sign. Its showing people can come together and they feel like their communities are safe and to feel like if they have a confrontation with the police, theyre going to be treated the right way and treated fairly.
