But we do want to start with that new report from the Washington Post and Shock Waves that it is creating. So, the Justice Department now confirming that during the Trump Administration, agents secretly obtained Phone Records of three Washington Post reporters for calls that they made while covering Russias Interference in the 2016 president ial election. Im joined now by the Washington Post reporter who broke this story, devlin barrett, also the author of October Surprise how the fbi tried to save itself and crashed an election. A big conversation for another day. But we want to talk about that shocking report in the Washington Post, the story that you, in fact, broke, and overall, the understanding is Attorney General barr needed to give essential approval for something like this. He was the Attorney General at the time. What do we know about Barrs Involvement so far . What are we hearing from the Barr Camp . Thats right, yasmin. So, were told that this approval came in 2020, that this investigation stems from reporting that three Washington Post reporters, ellen, greg, and adam did in 2017, but the barr approval, the Doj Approval of this pretty extensive and farreaching measure to take their Phone Records came in 2020. So, this investigation has been going a long time. So, the doj is defending its actions. I want to read this statement that was issued by the doj upon the reporting of this story. Saying this. While rare, the department follows the established procedures within its media Guidelines Policy when seeking legal process to obtain Telephone Toll records and noncontent email records from Media Members as part of a criminal investigation into unauthorized disclosure of classified information. So, moving to obtain reporter records, though, devlin, its not exclusive to the trump Justice Department. Actually, the Obama Administration was pretty notorious for Prosecuting Leakers and for, in one instance that we know of, possibly more, trying to obtain reporter records. Thats right. They did it they did it multiple times. It is rare but it does happen, and each time it happens, you see first amendment advocates and News Organizations essentially raise alarms that, you know, this has a Chilling Effect. Its not simply the act of going after leakers that is of concern. Obviously, as our Executive Editor expressed, its troubling because it could create, you know, a Chilling Effect on the entire act of news gathering, and if you think about what we were working on at that time, when the Phone Records in question were taken, we were working on stories about what russia did in 2016. And these reporters were three of the reporters who were extensively involved in that reporting and did great work on that subject. And so its obviously troubling to think that someone would try to essentially create a criminal case out of the facts. Supremely troubling. And what about the timing of all of it . Because this happened during the Trump Administration. Why are we only learning about this now during the biden administration . So, under Justice Department rules, they have an obligation, when they take this measure, to take Reporters Phone records, they have an obligation to eventually tell the news reporters, tell the news organization. So, essentially, what happened here is the decision to take the records was made during the Trump Administration, but the bureaucratic clock kept ticking until its the biden Administrations Responsibility to tell us. Any further action thats going to be taken by the Washington Post in addition to the statement that was made by your Executive Editor, devlin . So far, i dont know of any further action but, you know, well keep asking our lawyers and our own bosses if they plan to take any more measures. Obviously, what our boss has said, what our Executive Editor said, is they want more answers, and thats, i think, The Next Step here. All right, devlin, next time were going to talk about that book. In texas, lawmakers and demonstrators are speaking out against voter restrictions, crowds rallied on the steps of the State Capitol in austin this afternoon to protest a bill. The legislation passed through the house on friday, though amendments significantly watered down some of the restrictions that the bill still includes a ban on unsolicited Mailin Voting and other controversial provisions. The legislation heads back to the senate where it can be largely reshaped in a Closed Door conference committee. We are also following some Breaking News overseas where a bombing in afghanistan has killed at least 30 people, including children. The attack occurred in the Capital City of kabul near a Girls School. It happened just as the days religious fasting for ramadan was coming to an end. Joining us now is susanna george. Thank you so much for joining us so quickly on this. We appreciate it. Astounding news to say the least, the loss of life there, especially the fact that it includes majority children. Give us the details of what we know right now and who, in fact, may be responsible. Reporter well, this bomb detonated right outside of a Girls School in kabul just as classes were letting out. We spoke to The Schools principal, and she said that as soon as she heard the blast, her first instinct was to run to The School gates because she knew that so many of her students would still be in the streets right in front of the building. What she said that she saw, she described as like a doomsday and what we saw in Social Media posts and in videos and photos that were circulating of the scene was bodies of students who were in school uniforms, strewn on the street, backpacks, notebooks, pens, and all of this was amid the debris of what appears to be a car bombing. We dont know who is responsible for this attack. No group has claimed responsibility. The taliban has said that they do not that they are not responsible for this attack and they have condemned it. The afghan government has also condemned it, but they have blamed the taliban for the attack. So, this is exactly, susannah, the fear when considering bidens plan to pull all troops out of afghanistan, targeting women, targeting institutions that represent freedom and education, especially for women, a vacuum filled by essentially terrorist activity. Do we know yet if this has any connection to the american troop withdrawal, and is this an overwhelming fear that persists inside the borders of afghanistan . Reporter well, Afghan Women, especially Afghan Women who live in urban areas, are incredibly nervous about what the next few months has in store for them. We have seen an uptick in violence across the country since the withdrawal of u. S. And nato forces began about a week ago, but most of that violence has been taliban attacks on afghanheld Government Towns and cities. They have been attacks on checkpoints and on vulnerable villages on the edges of these cities. We havent seen that many largescale bombings like this one in Kabul Today. We saw one over bombing that was on the eve of the withdrawal, just south of kabul. Also near an educational institution. Again, no group claimed responsibility for that attack. But one thing that this attack here in western Kabul Today mirrors is a similarly gruesome attack that happened just around this time last year when a Maternity Ward was shot up by gunmen, killing 16 people, including two newborns. Again, that attack, no group claimed responsibility, but the afghan government blamed the taliban and linked the taliban to the islamic state. Why thats important is because the islamic state has been known for targeting this neighborhood of kabul. This is a shia dominated neighborhood. The slammic state considers shias to be her ticks and has carried out and claimed many shootings and bombings in this area, so we dont know if this is directly connected to the withdrawal of u. S. Troops, but theres a lot of Instability And Insecurity thats being created by that withdrawal, and people are worried that that will bring with it more of these kinds of bombings. Susannah, thanks for hopping on with us. The images coming out of afghanistan right now are just so totally devastating considering the fact that so many of them are children. Young girls. Were following Breaking News out of jerusalem, a lot happening this hour, where at least 200 palestinians are wounded after violent clashes at a mosque. Raf sanchez is following this. Great to talk to you this afternoon. First, give us the latest on last Nights Violence between israeli police and palestinians and what exactly started it. Reporter yasmin, this is some of the worst unrest we have seen in jerusalem in years. Israeli Police Firing rubbercoated steel rounds, teargas, Stun Grenades and crowds of young palestinians throwing stones inside the old city of jerusalem. What was really striking, though, was to see heavily armed israeli police bursting into the mosque. Now, this mosque is the third holiest site in islam after mecca and medina and Last Night was the last friday in ramadan, the muslim holy month, so it is hard to imagine more inflammatory images than that being beamed around the world of israeli police inside that mosque. It is not just people in jerusalem who are concerned. The u. S. State department also rushing out a Statement Calling for restraint and an end to the violence. Yasmin . Raf, there have been, as you well know, rising tensions for weeks over possible evictions of palestinians and specifically East Jerusalem. Where do things stand with that right now . Reporter yeah, all eyes on the East Jerusalem neighborhood, israeli settlers have been trying to get palestinian families evicted from their homes in that area for years. Our team on the ground in jerusalem spoke to one palestinian man, hes 59 years old. His family has been fighting to hold on to their home since he was 10. Take a listen to what he had to say. I leave this house, as i told you, i was born in this house. All my life is here. I love the house. I love jerusalem. I cant imagine to leave this house and to stay in another place, even in jerusalem itself. Reporter now, israeli settlers argue before the courts that this land used to belong to jewish groups before 1948, before the founding of the state of israel, so they have the right to reclaim it. Palestinian families strongly rejecting that. They say what were seeing here is a systematic effort by these israeli settlers and encouraged by the israeli government to try to change the demographics in East Jerusalem by forcing palestinians out and moving israelis in. Now, this Court Case has been going on for years, but we may finally get a verdict on monday when israels Supreme Court is due to rule, so a lot of tense hours Coming Up in jerusalem. Yasmin . Exactly where and when, the details of all, that is why so many folks are concerned. The u. S. Military estimating it could fall somewhere in turkmenistan, possibly tomorrow. The rocket was originally launched in late april as part of a larger mission to deliver portions of a future chinese Space Station into orbit. So, that was former first Lady Michelle Obama speaking out about Derek Chauvins guilty verdict and the work that still needs to be done as we all know to protect black lives in this country. It is coming amid a new federal indictment of chauvin along with three other former officers involved in George Floyds death. In addition to state charges, all four are now accused of violating floyds civil rights during his arrest. Earlier this afternoon, members of the floyd family, along with lawmakers and attorney ben crump, held the Press Conference reacting to the Justice Departments latest move. Watch this. You knew watching that video that they had violated George Floyds constitutional right to life when they prevented him from taking a breath for 9 minutes. Our department of justice will be here to make sure that all of americas citizens are afforded the constitutional rights of life and liberty. We all know his civil rights were violated but for some reason, with video footage, evidence, and everything supporting exactly what we saw, we somehow never get these charges. This gives us hope. This lets us know that there is change on the way. Gives us hope, there is change on the way. Joining me now, paul butler, nbc legal analyst and a Law Professor at georgetown school of law. Thanks for joining us. I want to get your reaction to these charges overall, and is this something that you saw coming . Yasmin, typically, the Justice Department would wait to decide about federal charges until after Derek Chauvin is sentenced in june and after the three other officers have their State Trial in august. I think there are two reasons that the Attorney General decided now is the time for prosecution by The Feds. First, its a bold move by the Justice Department to send a strong message that the federal government is back in the business of enforcing civil rights and holding Police Departments accountable. And second, i think The Feds may be trying to encourage these three officers charged with aiding and abetting to work out a joint Plea Bargain on both the federal and the state charges. Prosecutors are throwing the book at these cops, and that may encourage them to plead guilty, try to get a lower sentence on both the state and federal charges. So, what could the trial look like for these other three officers with this consideration of these new charges . Yasmin, its going to be harder for prosecutors to convict the three officers for aiding and abetting than it was for them to get the Murder Conviction of chauvin. They have better defenses and a jury might have more sympathy for them. Two of the officers were rookie cops. Officer thao says that he never put his hands on mr. Floyd. Those arent technical defenses, but jurors are often sympathetic to Police Officers in difficult situations. They werent for chauvin, but again, these are different cases. You know, i want to talk about the laundry list, as we well know, of Misconduct Complaints from 19 years of experience or serving in the force for Derek Chauvin. You think about this most recent second indictment involving the assault of a 14yearold Boy back in 2017 for Derek Chauvin. How important is it to have these instances made public, and does this make the case even stronger when we talk about Police Reform for having misconduct and complaints made public of all officers . Absolutely. Yasmin, according to the indictment, in 2017, chauvin hit a 14yearold Child with a flashlight and put his knee on the childs neck. The child complained that he could not breathe and the mother begged chauvin to stop, but he wouldnt. You have to wonder whether George Floyd would still be alive if chauvin had faced consequences for this alleged excessive force back in 2017. When it happened. Facebooks decision to indefinitely ban former President Donald Trump from its platform continues to attract criticism. Nbcs Scott Cohn is in menlo park, california, just outside facebook headquarters. Scott, good to see you. Good to see your face, by the way. We havent seen your face in some time. Good to see some of those masks off across the board. Yeah. The decision and the parameters of this ban, they are back, essentially, in Mark Zuckerbergs corner. Where are we on this, scott, and what does it mean for the possibility that the former president could actually get back on facebook one day . Reporter its entirely possible that he does, yasmin. Its really back in facebooks court, and you know, this whole thing is really kind of crystallized everybodys complaints about facebook from the left and the right and really across the spectrum, that they are that they may be biased or may be Censoring Speech or that their rules are arbitrary when they initially imposed this indefinite ban on former President Trump back in january, and so facebook was hoping to kind of Kick It to this oversight board, the Supreme Court of facebook as Mark Zuckerberg called it when he came up with the idea a couple of years ago, but as Supreme Courts sometimes do, they sent it back to facebook. They basically said that, yes, facebook was justified in imposing a ban following the January 6th insurrection because of the threats of violence, but it was unacceptable to impose an indefinite ban because that really was not something that was in facebooks policies and rules. So, facebook has a decision to make now, whether to end the ban, whether to delete the account entirely, or whether to let the former president back on. It does seem, though, that the ultimate fallout could be on facebook because it seems like theyve done the impossible. Theyve found something that democrats and republicans can agree on. Democrats and republicans in congress both hate the internet platforms. They just hate them for different reasons. So, republicans think that the sort of group of liberals in Silicon Valley are censoring conservative speech and democrats tend to think that theres simply too much incitement, Hate Speech and disinformation on these platforms. And so while they both want to regulate the platforms, they want to do it in different ways and for different reasons, and thats not exactly a prescription for legislative compromise. Reporter another pert that i spoke to thinks that facebook will make the decision well in advance of that sixmonth deadline, and of course, we all will be watching. Yasmin . We certainly will. Scott cohn in san francisco, good to see you. All right, another republican member of the house of congress, excuse me, paying a price of sorts from his own party for defying donald trumps big election lie. Congressman anthony gonzalez, censured by the ohio gop over his vote to impeach the former president. Theyre also urging gonzalez to resign. Trump himself has endorsed a primary challenger in the 2022 midterms. The party even went beyond its own borders, Censuring Nine other House Members from different states. Censures are purely symbolic and have no actual effect. Also, an ambitious effort to reunite more than A Thousand families separated at the border under the Trump Administration is now under way. This week, Bidens Task Force announced parents from four families who were deported to central America And Mexico without their kids under trumps zero Tolerance Policy would be allowed entry into the united states or reentry, we should say, to join their loved ones. Among those, a woman named Mabel Gonzalez who after being ripped away from her sons at the border back in 2017 decided to keep her return a secret until she was firmly on american soil. Take a look at a little bit of their emotional reunion. [ speaking foreign language ] oh. Joining me now, jonathan blitzer, Statue Writer at the New Yorker who is covering this story for us. Jonathan, gosh, that was emotional just to see a snippet of the video and the reunification they had after so many years of being apart. I couldnt imagine being torn apart from my boys like she was. One of the first families under the trump zero Tolerance Policy to be torn apart. How emotional was it in that room . Take us there. I mean, it was ecstatic in every sense. I mean, the sense of relief, joyfulness, i mean, you could see some of it in the video, just everyone sobbing. It was a moment of absolute Elation And Something very visceral at that. You just felt a kind of vibrational intensity in the house. You know, one thing that was striking, too, that i dont know immediately comes through on the video because how could you ever capture this element of it. I mean, the senselessness, too, of what this family has had to go through also came through very clearly in the moment. The sobbing, the wailing, the relief, the happiness, all of it was shot through, too, with profound grief. I mean, this was three and a half years of nothing short of torture, and this family had kind of weathered all of that to get to this moment, and so watching it, you felt, of course, profound happiness for the family. But you also felt a real kind of gutting question about what the hell have we just lived through . What has this family gone through . Why was this moment even necessary . Yeah. Well, and the fact that so many families are still separated right now that havent been reunified. With their kids, in spite of seeing this one happy moment for this family. There was this one part that really stuck out to me in your piece, and it talks about kind of the fear that she had in coming back to the united states, thinking that it actually might be a trick, that they might just be luring her back. You write this. If the international bridges connecting juarez to El Paso were a symbol of hope, they were also a reminder of the greatest trauma of her life. At one point, she texted corchado, theyre not going to set up a trap for me, are they . She was worried that in fact she was being tricked versus reunified with her children, which seems a bit like ptsd. To be clear, theres nothing paranoid or unreasonable about her having that concern either. Just to kind of quickly go through the catalog of what she was put through, i mean, to begin with, when she was first Apprehended In September of 2017, she was initially told by an arresting Border Patrol Agent that she and her children would be released imminently. Then a day and a half later, she was told, actually, no, youre going to be separated from your children. After she was immediately separated, in a moment of total Confusion And Chaos and alarm, she was reassured again that it would only be one week that it would take before she could see her children again. Of course, that week amounted to three and a half years and during that time, she spent, you know, a solid two years in detention. She waited something like eight months even just to appear before an immigration judge. She passed her initial credible fear screening, which to say her story of what she was fleeing was compelling, and yet, its took seven months after that first screening for her to be to appear before a judge. When she did appear before that judge, she had documents, notarized documents, complaints she filed in honduras. Shes very much unlike other Asylum Seekers in that she had the whole Paper Trail with her. She carried it north in the hopes of being able to present it in immigration court, to present the evidence of her actual persecution. It was denied in less than an hour. She didnt have any Immigration Lawyer in the initial moments of her hearing, helping her. And so sure, her sense was that, god, is this a system i can trust . So up until the final moment, she really was nervous. She was apprehensive. Yeah. Especially because of all that she had been through. My Colleague Alicia Menendez sat down with her. Lets take a listen to a little bit of their interview. If you could speak to former President Trump, what is it you would want to tell him . I mean, the psychological ramifications, jonathan, will be with her and her sons forever. Thats right. I mean, you know, you think about three and a half years in the lives of these children, to say nothing of her own life, and you know, she has other Family Members too who depend on her and to go through formative years of their lives without the presence not just without the presence of their mother, i should say, but with the reminder that their mother was crudely ripped away from them. Its something traumatic on probably too many levels to count. One thing thats worth noting in this regard, i mean, there are ongoing settlement negotiations right now between the aclu, the american civil liberties union, and the government in terms of Coming Up with, you know, longer lasting Relief And Redress for the families that were put through this. And you know, one of the Big Questions, of course, is what will happen right now, keldy has three years of whats called humanitarian parole so she doesnt have to worry about being deported. Shell have work authorization. The Big Question is whether that will ultimately translate into permanent legal status, which is what she wants and needs, but one of the other terms under negotiation right now is the actual provision of medical and Mental Health Services for the family, precisely because of the trauma they all had to withstand and endure. Yeah, the uncertainty, im sure, it makes it that much worse. Jonathan blitzer, thank you. Fantastic reporting on this. Maybe Somebody Hasnt gotten vaccinated yet or they have kids that havent gotten vaccinated so Road Trips are going to be up this year as well, and pretty soon, we had talked about travel had been under the guise of this risk and potentially spreading covid19. A former Fda Commissioner recently said he believes that is now going to shift into this conversation about economic recovery and of Course International Travel is going to be a big part of that. But right now, were largely talking Domestic Travel because, of course, as you know, for many reasons, international travel remains stalled. Yeah. Cori coffin for us in new york, thanks, good to see you. So, as americans are eagerly planning their summer vacations, the cdc is out with new guidance on airborne covid transmission. With me now, msnbc medical contributor, dr. Kavita patel. Dr. Patel, thanks for joining us on this. Lets talk about this new guidance. I want to read directly from the Washington Post, saying the centers for Disease Control and prevention advise that Airborne Transmission is one of several ways the virus can spread, we knew that, adding that people more than six feet away, this is the difference, from others indoors can become infected, according to the agencys website. So, we do want to preface, though, that its more likely within three to six feet but even more than six feet can, in fact, become infected. What does this mean for lifting the mandate on wearing masks indoors, dr. Patel . Yeah, yasmin, so, first of all, i think many of us were frustrated this guidance didnt get updated earlier, and i think its very confusing for americans. Heres the most simple way of thinking about it. If you spray perfume, like they do at department stores, you can be ten feet away and a likely some people could smell it and thats really what weve understood about coronavirus. Not just the droplets, which caused us to wipe down our groceries. So that is something that has an implication for when we can take away indoor masks because it is much more likely that this is an indoor kind of poor Ventilation Environment that causes coronavirus to spread, and so if you are in one of those environments and you wont know until youre in it, you really should still wear a mask, which means, bad news, that people will still have to wear masks until we get more people vaccinated and have a better sense that the places were going into are more vaccinated and better ventilated. But heres the good news. We probably could have taken away those outdoor Mask Restrictions months ago, and you should feel safe if youre vaccinated to go outdoors, not wear a mask, and if youre with other vaccinated people, you should also feel safe that the risk is low and you can take off your mask indoors as well. So, living life is possible, but theres too much about this virus with half the country unvaccinated that we cant take a risk with. It just goes to show you, a year and a half into this thing at this point, there is still so much uncertainty and so much that were still learning about this virus, which is just incredibly fascinating to me. Lets talk about some of the Vaccine Hesitancy and getting more folks vaccinated so that we can get to a point in which we can actually lift those Mask Restrictions. President biden wanting 70 of americans, adults, to get partially vaccinated and at least 160 Million american adults fully vaccinated by July 4th but you have nationwide vaccinations, dr. Patel, falling to 35 from their peak just a couple of weeks ago. At this rate, dr. Patel, are you confident we can actually achieve those goals, and do you think were going to get to a Herd Immunity in this country, considering the high levels of Vaccine Hesitancy across the board and also the number of variants that were now seeing across the country . Right. Yeah, those are the exact questions we need to continue to ask, but i do think were going to get to an immunity, whether it hits a target 70 that the president set or 65 . Were going to get to an Immunity Percentage where the cases each Day Drop dramatically and that is when we know its going to be safe to resume activities, workplace activities, Et Cetera without masks. And i do feel very strongly that we still have the ability to vaccinate people. It is much less than 3 Million a day, but we are now moving this into offices, and we will get shots in arms when we can just let people come in, get it when they want, and get it from people they trust. All right, let me just ask you a quick question. Pfizer is seeking to get clearance in september for kids. Are you going to get your kids vaccinated once they get clearance . I am. Pfizer is the safety data from 12 to 15 will be more public as the fda reviews that and authorizes it. Hopefully this next week and then the two trials that are ongoing, of course, ill wait and look for this data, but i am eager and i think nothing could be a better Mothers Day present for us, yasmin, than to have the ability to get our kids safely vaccinated. So, i dont think were anybody including the fda is going to rush into this but i do think that younger children, theyre not just small adults but they are testing doses, and this is how were going get our kids in School And Playing and sports and have their mental health improve, so, yes, in fact, i tried to sign my kids up for the trials but sadly, there wasnt any more spots available so thats how firmly i believe in trying to be a part of this. Im telling you, fighting with a 2yearold to put a mask on will take years off your life and its a daily fight for my family. Dr. Patel, thank you. Good to see you. Well be right back, everybody. Breaking news out of the state of texas as demonstrators gathered at the State Capitol to rally against the voting Restrictions Bill that passed through the house yesterday. Thats where we find Ellison Barber, who is in austin, texas, for us. Ellison, great to see you this afternoon. Talk to us about what rally goers tell you and what the expectations are for the rest of the weekend when it comes to protests. Reporter yasmin, there was close to 300 people who gathered outside of the capitol here trying to make sure that people knew that they do not want to see this bill become a law and to really just make sure that people heard, especially lawmakers that work inside this building, that they heard their concerns and their opposition. Heres some of what we heard. I think we need to send a message to the lawmakers in the capitol that if they dont want more people voting, they shouldnt be in office. Its that simple. This small subset of people who would like to suppress our votes, theyre small in number. Texas, we really are proud. We really do stand for democracy. And i dont want that small subset to be represent all of us. Reporter so, one of the other things activists have told us that theyre hoping could maybe happen is that they could sort of run the clock out here on this as the wind blows all over the place. So, there are two bills, really, that are at issue here. The bill that recently passed the house, whats known as hb6, its a different version but its not sb7. They added amendments so things have been changed so now the legislation that passed the house has to go over to the senate. The senate can decide to either just vote on that asis or send it to a conference committee. Conference committee is the most likely route, and what will happen there is you will have the Lieutenant Governor as well as the speaker pick people to be on this committee to try and reconcile those two bills. Then, if theyre able to do that, that new piece of legislation reconciled legislation has to then go back to the senate and the house for votes before the governor could sign it. All of that has to happen by The End of this month because the texas legislative session, it ends on may 31st, so some activists say this type of action here could actually do something, even though this is a republicancontrolled state, because maybe, just maybe, they can run the clock out and people wont have time to vote on it before the legislative session ends.
