A federal judge blasted former Attorney General Bill Barr in a decision released Last Night accusing barr of misleading her and congress. The remarks from Judge Amy Bermanjackson came as she ordered the Justice Department to released the redacted portions of a 2019 memo that was prepared by barr and top doj officials whether President Trump should be charged with obstructing the mueller investigation. The Justice Department at the time withheld the full memo from a Watchdog Group saying it continued information around an undecided case. However, jackson wrote in her decision that her review of the redacted portions, quote reveal that both the authors and the recipient of the memorandum had a shared understanding concerning whether prosecuting the president was a matter to be considered at all. In other words, the judge continues, the review of the document reveals that the Attorney General was not then engaged in making a decision about whether the President Should be charged with obstruction of justice. The fact that he would not be prosecuted was a given. Jackson also criticized the Fourpage Summary of the Mueller Report that barr provided to congress which trump then used, you may remember, to declare he had been exonerated. In the letter, barr claimed that the special Counsel Investigation did not support charges of obstruction and that he came to that conclusion based on the advice contained in the memo. According to the judge, emails show Barrs Letter to congress and the memo were, quote, written by the very same people at the very same time and adds, quote. Judge jackson called barr disingenuous and accused the barr Justice Department. This is not the first time a judge has questioned barrs credibility. Last year a former judge said the former Attorney Generals summary in handling the Mueller Report was, quote, distorted and misleading. A lot to start off with this morning. Lets go to politics now. The battle between House Minority leader Kevin Mccarthy and Liz Cheney. Their feud appears to be at a boiling point. Mccarthy was caught on a Hot Mike criticizing cheney ahead of Fox News but his comments were different from what he said on the air. Here is what he said off air, versus what he said live. There is no concern about how she voted on impeachment. That decision has been made. I have heard from members concerned about her ability to carry out the job as conference chair, to carry out the message. I havent heard members concerned about her vote on impeachment. Its more concerned about the Job Ability to do and what is our best step forward that we can all work together instead of attacking one another. Meanwhile, a spokesperson for Congresswoman Cheney put out a statement after Mccarthys Interview saying, quote. And republicans are, of course, inching closer to ousting Congresswoman Cheney from her role in house leadership. The vote could come as early as may 12th, that is the next time the House Republican Conference meets. But cheney remains defiant. According to her spokesman, cheney will not step down from the position. Meanwhile, a possible, if not even likely successor has emerged, a republican with direct knowledge tells Nbc News that congresswoman of New York has been Making Calls to fellow Party Members to replace cheney as conference chair. The general sense seems to be if she wants it, its hers and you see there, she did. This push to remove her from leadership gains stadium. Congressman Ad Kin Zinger said the following. She seems to be going forward into that and thinking about it as something that ultimately is going to raise her profile and perhaps set her up to be a standard bearer of whichever we dont know how big it is, if its big at all, but the section of the party that is willing to stand up to former President Trump and say, nope, we are not going along with this. We are really watching for a battle for the soul of the party to take place in a very public way. You have the House Minority leader Kevin Mccarthy on a Hot Mike saying that his number three is in trouble. That cant be a good sign for Liz Cheney but she is really proving she wants to forge ahead here and really try to be the face of the party that is not going to look away from what happened on January 6th and is actually going to stand up to former President Donald Trump at a time when a lot of the party is aligning towards him as we move forwards the 2022 midterm elections. Even though mccarthy has said that this push against cheney, it doesnt have to do with this impeachment vote. As you said, a spokesperson made clear that is exactly how cheney feels. She thinks this is because she is standing up to Donald Trump who has made it clear that he is going to step in and endorse and support anybody who happens to run against her in the wyoming midterm. So we are seeing this feud play out and a really in a really public way. Lets talk about the midterms for a second, because its clear Kevin Mccarthy wants to be speaker of the house. Historically, there is a precedent for a party that is out of power to regain control of the House Of Representatives when the White House is held by the opposing party, but, on the other hand, the districts where they actually need to win to gain seats are suburban areas in some of the places where Joe Biden showed a lot of strength and without trump on the ballot, that could be a tricky needle to thread. Is it Liz Cheney that has the politics of this right in terms of regaining the majority, or Kevin Mccarthy . Its kind of the million dollar question. There was some iciness between Mccarthy And Cheney down at the republican Gop Retreat last weekend in florida that is run by cheney and a time when republicans are trying to gather around the same Policy Points and get on the same page, but what we are seeing this week, that really didnt happen. And they know, like you said, that they have an opportunity here going into the 2022 midterms that they need to capitalize and they should be showing a United Front and some members of the party think that Liz Cheney is getting in the way of all of that. But as you said, some of these really critical districts for them, they are not coming from they are not the trumpiest corners of the country and maybe a little dose of Liz Cheney might be good for them. What is your sense of what that anniversary is going to mean for the country and how decisions in the state of minnesota are making around these questions for a mistrial or a retrial may affect all of that . I think its going to be huge. How the city and the State Deal with those questions, the kind of, i guess Kitchen Sink Approach that the Defense Attorney threw in this motion is something that we were expecting. Its something that, you know, any Defense Attorney worth their salt would actually do. So it wasnt it was exactly what we expected, and especially some of the arguments that were in there things we heard during the trial, right, talking about how much attention this was getting, et cetera. But i think, you know, this is a country that and a world, frankly, that was hit so hard by, you know, that Nineminute Video from watching George Floyd be murdered by derek chauvin. I think it was always going to have heightened emotions. And what the state does here is going to impact that in huge, huge ways, right . Are people going to feel as they felt on that tuesday excited and hopeful . Or is it going to be a little bit more anger because of something that another decision that could be made regarding a retrial or a mistrial or any of those things. And i think we all will be watching that. I think one of the things is that the in congress, you know, you covered congress for a long time, there has been more conversation, i think, over Police Reform in a bipartisan fashion than ive seen in a while. They feel really good about this. Tim scott on the republican side and those on the democratic side are starting to meet in earnest and i think they feel more pressure once President Biden gave them the George Floyd anniversary as kind of a deadline so they are feeling that pressure. The senator from texas tweeted a photo Last Night alongside former President Trump at dinner writing, quote. He is in great spirits and we talked about retaking the House And Senate in 2022. Cruz visit follows Kevin Mccarthy Visiting Trump just 22 days after the capitol riots. Lindsey graham hosted a Golf Sweepstakes at maralago last week. More than 52 companies and Business Leaders have signed an open letter opposing Voting Restrictions in texas. Several companies signed on. The letter reads in part, quote. The legislation is being debated in austin this week with several other states in the midst of debates over voting laws, including georgia and florida. Joining me now, is boston Globe Columnist Kimberly Atkins and she is also an msnbc contributor. Kimberly, thanks so much for being here this morning. This is a fascinating dynamic to me. I mean, we heard Mitch Mcconnell basically trying to tell ceos to stay out of politics. He then walked that back a little bit. But this is starting to pose a real problem for many of these states who are trying to restrict voting and the fact that these corporations are at odds with republicans is a shift in the dynamics. There have been a lot of companies, especially silicone valley, who Want To, say, move to texas and now questions about that. What is driving these companies to do this . And what does it say about where we, as a nation, are broadly . Yeah. So there are a number of factors that are driving these companies to engage in this sort of corporate activism that we have seen in georgia and texas and now florida. Sometimes the ceos themselves. Some of the companies among this group of companies in texas now really spoke out because they did not think that enough ceos were speaking out loudly and forcibly enough against some of these restrictions that are moving their way through the Texas Legislature and they really urged for this letter to be pushed forward. Some of these ceos are acting because they hear it from their employees. They Want To have Work Places in which increasingly employees are allowed to not leave all of their views at the door and bring their full selves to work. In doing so, they have made it clear to their bosses that these are issues that are important to them and they want them to speak out. And some companies have a long history, companies like patagonia had a long history of speaking out opposing, for example, Bathroom Laws that were really seen and really were antilgbtq laws that we saw on the state level. Some states even backed off from passing some of those laws. So theyve seen it be effective in the past. They see this issue on voting as beingial, so theyre acting. Yeah. And, of course, they have to answer to their consumers as well as to their employees, which i think says something about the state of the country as well. Kimberly, let me circle back to what we started off at the top of the block with Ted Cruz making the pilgrimage to maralago. Theres a lot of focus on what mood former President Trump happens to be on that day, even as he has faded in terms of setting the agenda for whats being discussed, theres still clearly is this sense among republicans, my sense is, okay, make sure hes not angry with you. That causes him to lash out and do unpredictable things. But when you look at this photo of Senator Cruz next to Donald Trump and that one of Kevin Mccarthy down at maralago, what do you see . I see someone who at least according to those republicans is still at the head of the party. I found it was interesting that Ted Cruz said that Donald Trump was in good spirits. Thats usually what you say about somebody who is ill or in an accident or something. So that was an interesting choice of words. But look, were seeing it playing out, as you mentioned earlier in the show, in congress. Donald trump is the leader of the party, and anybody who even speaks truthfully pointing out that the Election Fraud that he pushed was a lie, risks losing her career in that caucus were seeing that still play out. I think part of it is fear. Part is a desire not to get on his wrong side but i think also its a lack of any other sort of leadership in the party right now that folks are still going down and kissing the proverbial ring. Mayor Eric Garcetti to be ambassador for india, which is a very high profile ambassadorship. India is the worlds most populous democracy. It has 1. 4 billion people. And biden administration really views the country as key to helping counter chinas ambitions. L. A. Is also the second largest city in the country. So he has some experience with handling very populous areas. And garcetti was a cochair of the campaign as well as remained a top ally to the biden administration. So, his name has been floated for a lot of positions, but right now very seriously being considered for the ambassador to India And India is also, of course, going through its own issues right now with coronavirus, the biden administration just announced this week theyre going to be sending more vaccines overseas and trying to help india helping get those coronavirus cases down. Its a big ambassadorship for someone and if it does go to garcetti would be a signal of their support for the l. A. Mayor. Yeah. And of course, lets not forget that garcetti is considered a future president ial hopeful and this would give him some foreign Policy Experience to run on. Lets also talk about this decision that facebook is going to be announcing today about whether former President Donald Trump is going to stay permanently banned from the site. Whats at stake here for facebook . A lot at stake. Its a huge decision. And you know, either way, i would say a large part of the country is going to be disappointed. The protrump supporters, of course, if it chooses to continue its ban on the former president will be furious. And then people who dont Want To see him on Social Media, see him as a threat following the January 6th attack on the capitol in particular will be disappointed. So a big decision. I think a lot of people at facebook are kind of bracing for the fallout. But its a huge deal also for the former president. We have spoken with people who are so close to the president as he stays in maralago. They really see this decision as key to whether hes going to launch his 2024 campaign. The former President S increasingly looking like he wants to run again in 2024, even though its a long way off. He misses being at the center of the political universe. Thats what his allies tell axios. And so facebook is key to that. It was kind of the Lynch Pin of all his fundraising. Everyone sees the former president as the twitter guy, but facebook is really where a lot of Campaign Advertising and Fund Raising that they had was done.
