Allegations against him. We begin with Rudy Giuliani. Our cameras have caught him outside his apartment that was raided. Hes back on Television Doing what he did that gave so many clues to investigators. Talking about it all on tv. Talking about himself. This is, to be very clear, the opposite of what any prudent lawyer and someone like Rudy Giuliani, a former prosecutor, would advise most people in his situation. Hes also making up stuff. Hes saying he was framed. Hes saying a raid he called quite professional, is now, quote, out of control. When Something Like this happens and it goes to fruition, if they can do what they just did to me, to you they can do it to you. You dont see this for what it is . A political act. Its not a political act as a matter of law. Indeed its an independent judge who signed off on at least reasonable suspicion that theres evidence of a crime in giulianis residence, his apartment or office. Reuters reports warrants for giulianis computers were seized. There was also a report by other News Organizations and matched by nbc news that asserted last week that there was sources saying that the fbi had warned giuliani he would be the target of russian influence campaign. We referred to that report on friday. We have a correction. If we get anything off, well always follow up. That briefing was prepared and those reports referred to it. It was not actually delivered according to the latest updated information. A second source familiar with the matter told nbc news the reasons might be bad for giuliani. I want to mention them. The reasons of concern that giving that prepared briefing would complicate the Criminal Investigation of giuliani. Whether that was good or not for him, we mention it as if it happened. The latest information was he was not given that briefing. Now, the investigation is ongoing. Theres other reporting that people in trump world are concerned about this. They think about it, as one trump adviser said, it was a show of force. Other things may be coming down the pipeline. While giuliani has been talking up his own defense, hes still enough of a lawyer to know there are times you need lawyers in addition to whatever you want to say as a potential subject. Giuliani tapping Alan Dershowitz as a legal adviser. Joining us is former acting solicitor general neil cachaw and libby casey. Neil, everyone can launch their own criminal defense, but walk us through the framework for the claims giuliani is now making. The framework looks really ba for Rudy Giuliani. Ten of his devices have been seized. These devices were seized pursuant to a warrant as you just said. That requires an independent federal judge to sign off and to say that theres probable cause to believe a crime has been permitted. Its more likely than not. Here of course it wasnt just any old warrant. It was a warrant to search an Attorneys Office which requires approval at the highest levels of the Justice Department. Maybe the Attorney General himself and it wasnt just any old lawyer. It was a lawyer to the president of the United States. It wasnt just that. It was also a lawyer who happened to head the Southern District of new york that issued the warrant against him. All of these barriers were sky high to this warrant, yet it was executed last week. To me that tells me that this is an incredibly serious set of allegations that theyve got. They would have never taken the step otherwise. This isnt the kind of thing you do to score political points. Rudy giuliani will be able to hire lawyers and have a defense at trial if there is an indictment. Youre not, if youre the Justice Department, pull one over on anything by trying to execute this warrant. They did so for the most serious of reasons. Thats what everything here suggests. To your point, neil, they would certainly be familiar with the kind of pushback they were going to get from someone like mr. Giuliani. Exactly. You know, they knew that. They expect the defense and media and so on. The Justice Department cant comment. They cant say this is wrong. This isnt political. They speak in court. They speak in their actions. I suspect well be seeing further Court Activity in the next couple months, including possibly an indictment. I think its telling that Rudy Giulianis defense attorney Alan Dershowitz is saying prosecutors cant search lawyers offices. That goes up there with lawyers couldnt get Parking Tickets or speeding tickets. Come on, this is ridiculous. In certain circumstances, high circumscribed circumstances, you can search an attorneys afs. As youre reminding viewers, Alan Dershowitzs view of this doesnt match with the reality. Lawyers dont have an immunity, although they have protections for the justification and the legitimacy of a office of confidential communication. Thats the law stuff, libby. Lets talk about the politics. Rudy giuliani spent the last year and the months after the election as the face of a set of maga grievances and some Conspiracy Theories and ultimately the argument that led to the insurrection. Paul manafort, he was sentenced to more than seven years in prison. This adds to that Frothing Water around donald trump. The question is what is on those devices . What will investigators find . You dont generally want your face of an argument about whats wrong with the government tore the election to be under this much legal strain and have his homes raided. If youre pro law enforcement, youre going to wonder and defer to whether they might actually be just doing their jobs and be worried about crime. Neil, how much of this fits into the context of a rather brazen effort to get foreign help or collude with foreign actors in two consecutive elections . We know that the warrant identifies a possible violation of the Foreign Agent registration act which is not some i know some republicans are spinning this as a minor technical act. We need to know your motives and all that. Theres not a problem with representing a Foreign Government, but you have to register. Thats a critical piece of our Counter Intelligence, National Security law. It looks like that may have been violated here and thats what the warrant was designed to do, get information about that. Now Rudy Giulianis folks are out today saying, well, look, all these News Organizations retracted that story you were talking about earlier that said that he had been given an fdi warning ahead of time. Now, you know, i think its pretty common for sources to conflict and stories to get corrected. Im not sure ive ever seen someone so enthusiastically promote a correction that makes them look guiltier. This retraction is actually bad for giuliani. The retraction is that the reason why the fbi didnt give that warning to giuliani about the Counter Intelligence dangers was in part over concerns it may complicate his Criminal Investigation. What thats saying to me is the fbi said we could give him this defensive warning, but we already think hes crossed the line. We already think hes in the land of federal felony. So we cant do it because thats going to undermine the crime that hes already committed. This is bad news for giuliani. Its not good news. Right. Thats a useful break down. If its a defensive briefing to say this is what russia is trying to do, through ukraine, and the person says i know all about them. Ive been trying to do it. Youre way past the point of a briefing. Secondly, change the standards. Our country has always adapted and rejuvenated capitalism. It was Mark Zuckerberg who said we would rather buy than compete. That says it all. Does the Republican Party have a Truth Problem . Yes. And that being said, i saw the courage of mitt romney standing up many, many times last few years. And im also really, really happy that liz cheney stood up in congress and was so forceful. And as much as you would think i would be relishing this fight, i believe in the end you want to have two parties that embrace truth, otherwise how are you ever going to have debate . When you have a major faction of Major Political party literally denying results of election, literally some of them embracing qanon and other people are not decrying it, you have a major problem going on. I would be cheering mitt romney instead of booing him as people did at his own convention. Then youd need to get a ticket to utah, go to the convention. I know, i guess i wouldnt be invited. Wouldnt get good reception if he didnt. But point of it, i brought him up several times in the democratic president ial debates from the stage because i think we need more people who are willing to speak truth to power. You look at insurrection, which you brought up, at that moment, that night, there were a bunch of people not just mitt romney and liz cheney who voted to uphold the results, very important to bring us to inaugural stage where we could stand together, democracy brushed it off and we stood united. That was really important for our country. Since then we continue to see fraying and Up Truths Being told and leading to misinformation about vaccines. Its incredibly bad for the fabric of this country and im proud of joe biden for standing up against it, and understanding that there are still republicans, we know this from the polls, and independents, that support what hes doing. Thats why im able to talk to democrats and republicans in my state. But it seems like you got republicans supporting his agenda except the ones in congress. Thats how it is.
