The prosecution leaving the jury with a final message, believe your eyes. You have seen the video, use your common sense. The Defense Arguing that a reasonable Police Officer, a word used 118 times in the desenses closing argument, a reason blg Police Officer would have acted as chauvin did, given what happened in the 17 minutes before that 9 minutes and 29 seconds with Chauvins Knee on floyds neck. And cities from minneapolis to los angeles, brooklyn center, minnesota to brooklyn, New York, are bracing for protests. Local governments are planning on how to handle it without inflaming tensions even further. President biden spoke about the trial just a short time ago. Theyre a good family, and they are calling for peace and fran quill tea, no matter what that verdict is. I am praying the verdict is the right verdict, and i think it could be overwhelming in my view. So we just talked and i wanted to know how they were doing and we just talked about personal things. And second degree, unintentional murder, third degree murder, and second degree manslaughter. Chauvin could be convicted on one, two, or all three charges, or none of them at all. Joining me now is nbc correspondent, gabe gutierrez, and former fbi official, chuck rosenberg, and retired seattle Police Chief, carmen best, and the president of the national Action Network and host at msnbcs politics nation, reverend al sharpton. Everybody, welcome. Chuck, i would like to begin with you and those comments from the president. Could the defense argue that they are as i guess, are they as intrusive for the jury as maxine waters comments, and can these be used against the results of this trial . Yeah, let me tell you, katy, i think about this in a couple different ways. First as a former prosecutor, i dont want any noise happening while my jury is out deliberating, because anything that could possibly invade upon the province of the jury is a bad thing from a prosecutors perspective. That said, i dont think that anything that Congresswoman Waters or President Biden said gives rise to a meritorious issue. Theres a huge gap between an issue they created and so the defense is free to raise this, but unless it can show it infected the jury, that the jury ignored the instructions the jury has given to them multiple taoeplz to avoid outside influence, i dont see this at all as a meritorious issue. So would i prefer as a prosecutor for everybody to just be quiet and let the jury deliberate . Absolutely. Am i concerned what was said will upset a conviction upon appeal . Absolutely not. Rev, lets talk about that Call A little further. How does the family feel about their conversation with the president and how do they feel right now awaiting a verdict . Well, the family is very strong. I have spent the last two days here with them and the last 11 months with them, and this is a family that is strong, that is solid, that is prayerful, and i think the president calling gave them more encouragement to know that he is the same man that he was when he flew to houston, and met with them. I was in the room the day before the funeral. The first time Joe Biden left delaware after the campaign, it was to come and meet with the family, and he dependant say Anything Yesterday about a conviction and he didnt say Anything Yesterday about his feelings. The White House called me in advance and said you might Call After the jury is sequestered, and thats what he did. I think what is disingenuous about what the judge said about Congresswoman Waters, and first of all people know Congresswoman Waters for decades, and she stood for peace even when there was violence in l. A. Where she was the congresswoman, so its absurd to distort what she said, and what was disturbing to me, and what the judge said and i was at the courthouse, is he felt that there was any way this could be appealed, so why didnt he poll the jury before they left and said let me ask, are there any comments or statements you heard that may have affected you and intimidated you or bothered you . He did not poll the jury at all. So what is the basis of him raising something that was not raised to him . There was no note from the jury and he did not poll the jury, and hes creating something unnecessary and i feel is unfair to Congresswoman Waters. Chuck, i do want to get you on the point that the reverend is making because i did hear that earlier, this idea if the judge thought they would be prejudicial, he should have polled the jury about the comments. What is your take . I think Reverend Sharpton makes a good point. It seemed he was concerned people outside the courtroom were making statements. Thats what people outside the courtroom do. Again, as a prosecutor i would like it if everyone just stayed away from the courthouse and my jury, but thats not how the world works. It seems to me he was blowing off some steam. I thought his comments sorry, let me be specific. I thought the judges comments were a bit hyperbolic. It doesnt seem to me the jury has ignored any of his instructions, quite to the contrary. It seems like they have run a clean trial and so blowing off a bit of steam, i guess, is understandable, and i would not put too much case on this, katy, and i think Reverend Sharpton raise as good and important point and theres no evidence that the jury has been infected by outside comments. Gabe, lets talk about what the mood is like there in minneapolis around the courthouse. What are you hearing . What are you seeing . Also, what are some of the last notes we got from the jury before they headed in to deliberate . Reporter hi, katy, theres high anxiety here in Minneapolis And Other Cities across the country. Last evening there was a demonstration with several hundred people and it was peaceful but they were gathering outside the courthouse waiting for a potential verdict, and they have a lot of questions of What Happens Next. We heard from a Pool Reporter a short time ago saying we would not know when the jury could break for lunch, so there could be developments at any point. This is not something that just minneapolis or minnesota is watching, but the entire country. The governor here has declared a State Of Emergency and backed up for Law Enforcement Assistance from two other states, and the Minneapolis Public Schools announced they will go to remote learning starting tomorrow through friday in anticipation of this verdict, but certainly, katy, you know, a lot of anxiety and several protesters i spoke with yesterday saying they were having a tough time watching the trial, because it was traumatic and some of the testimony brought up painful memories from last year, and we spoke with a few protesters that came from states across the midwest because they felt it was important for them to be here. Again, were awaiting right now any news from the deliberations, but this verdict could come down at anytime, and we just dont know when, katy. Chief best i want to talk to you about the preparations being made around the country. If you were still leading a Law Enforcement agency, i wonder what you would do . How do you respond to the criticism that many have if you create the conditions that say that you are preparing for violence, you are preparing for things to get out of hand, then you are fulfilling or creating a self fulfilling prophecy, you are making it seem like its a War Zone and thats what is going on happen . Yeah, katy, that comes up often, how do we find the right balance . But as a Police Chief and i have been through this myself, and i was Police Chief in seattle for a few years there, and you have to protect the facilities and personnel and you have to take care of the city, and you cant ignore it and hope that all goes well, and in minneapolis specifically, they burned down a precinct last not even a year ago. So theres the true reality there could be violence and looting, and there could be these things because we have experienced them. So people were injured at some of these events, and sometimes either way you are going to get criticism, so you have to be prepared for that and be ready to make sure that the height of your Plan Something all about public safety and the safety of everybody involved. Chuck, one final question to you. I am hoping you have run through each of the charges for us and what is needed for the jury to find Derek Chauvin guilty for each of them. Let me do that at a high level, katy. So homicide is the killing of another person. You can have unlawful homicide or you can have a lawful homicide, like when one soldier kills another during a time of war. We are in the unlawful Homicide Part of the equation. You can have an intentional killing, a murder, and chauvin is charged with both second degree and third degree, and you have it up on your screen now which is incredibly helpful. Or an unintentional manslaughter charge. Each of these require additional levels of intent. Thats the best way to think about it. Murder would be in general, an intentional homicide. Manslaughter, in general, an unintentional, in this case, culpable negligent homicide, and the jury could find him guilty of all three, of one, two of the counts, maybe one, not the third, or none of them. We will have to wait and see. Ten hours of deliberation with not just this country watching but much of the world. Everybody, thank you. Schools in the area are on lockdown and residents are being asked to remain indoors. Coming up with the Chauvin Case now in the hands of a jury, floyds family is anxiously awaiting a verdict. The Senate Judiciary Committee held a Highprofile Hearing on voting Rights Today with a number of well known witnesses, including Stacy Abrams and raffaele warnock. Voting laws passed in State Houses across the country. While republicans, including senators Ted Cruz who claimed false voter fraud, and called hr1 a partisan Power Grab. This is a fullfledged assault on Voting Rights, unlike anything we have seen since the era of jim crow. We must advocate for voting parts, not to ensure the success of a single party or ideology. Hr1 is not about righting wrongs, its about power, and its about grabbing power. This has been one of the most incredible organized campaigns by these corporations in american history trying to influence legislation and ultimately to overturn it. Joining me now is anna palmer. Cut through the politics of this for us. Whats happening . Well, its all about politics in some ways, right. You have the decisions between republicans and democrats cleared out, and its about Voting Rights and what happened down in georgia and what is happening with some of their State Laws but what it all comes back to is democrats hr1 which is fundamental in making sure Theres Access to polls. This will not be a debate that ends right now or that will end probably in the next coming months, but the question is where do republicans end up on this because so far they really said hr1 is political and its a Power Grab there, and without any republican Support Hr1 will not be able to go anywhere. So if it cant go anywhere, what is the resource that democrats have . Is it just about winning more seats in the next election to get past that threshold, or is there a way they could do this on reconciliation, or is this even a candidate for reconciliation . Its tough to see it being done on reconciliation, and the question is is this going to be the issue democrats feel passionate about where they think about blowing up the legislative filibuster, meaning they only need 50 votes to move things forward, and right now its 60 and so they are constantly in search of ten votes for hot button issues, and whether or not it could be part of reconciliation is to be seen, but there are often times things the parliamentarian decides could go forward, and the next issue is what happens in Mid May when you will have another Committee Hearing on this where its going to be debated and clearly will likely pass out of the committee but then its going to be stalled on the overall senate floor. Im wondering what the strategy is for republicans . There was a piece in the New Yorker that got buried because of the Derek Chauvin trial about the for the people act and how there was a secret among bigname republican donors including the kochs, talking about how even many republican voters are for the reform, including the limiting of dark Money Spending and limiting the power of corporations and Theres Nothing they could do against it that would work even with republican voters, so what is the strategy for republicans, to kill it before it gets to the vote or bury it and dont talk about it . Is that what Ted Cruz and Josh Holly are doing . The cry is this is a Power Grab by democrats, and when you look at what was happening with the Election Laws in georgia, where republicans got sideways with corporations and they were going to pull out whether it was may major league baseball, and then you have the populist argument that has been the trump republican base and thats where you see a lot of the senate republicans thinking about the base voters they need. It was rich when mcconnell said corporations should stay out, and then that doesnt apply to their money. They can still spend their money on congress, but stay out of everything else, dont voice your opinion. Anna palmer, thank you so much. In other news out of capitol hill, roughly 20 minutes from now President Biden will participate in a virtual tour of a battery plant, and as they said on capitol hill, Senator Ed Marky and Congresswoman Alexandria Ocasiocortez are up dating the Green New Deal that they hope will be more receptive. Joining me now, garrett, this is not a piece of legislation yet and yeah, there are more democrats but can you call it a more receptive audience . Well, probably not in the terms of the house and certainly not in terms of the senate, but the proponents of the Green New Deal argued the last two years has changed one thing and thats cultural acceptance of the planks of this deal, and cory bush in missouri, and jones in york, and that was part of what they were arguing on, and they argue the dna of the Green New Deal is more along with the biden climate plan, and on the electric cars and the infrastructure bill, and they argue the cultural moment has changed. Heres aoc and Ed Marky this morning. What critics are calling Pie In The Sky is now recognized as undenialbly linked. Racial injustice, economic inequality, housing, education, jobs and climate change. Its all intertwined. Its going to be an all hands on Deck Approach and we refuse to leave any Community Behind in the process. Katy, what is a little different from the Green New Deal this time around, and what is the same here as ocasiocortez laid out, they lack the hands, the House Majority is smaller than in 2020, and you have at least Joe Manchin saying he does not support the Green New Deal, and the democrats do not have enough to pass it even if they eliminate the filibuster. And these two issues the democrats can run on for 2022, to try to gain more seats in the senate and a larger majority in the house. Try at least. This map, first of all, we have been tracking all green, and green means go, as you say, every state in the country 16 plus eligible for the vaccine, and who has already gotten it, and a couple ways to look at the numbers. Of the entire population, every person in the united states from oldest to youngest, 40 basically have now had at least one dose. 40 of the entire population. Now, if you look a little more narrow at the population, lets look at all adults, everybody 18 years or older, that group crossed a big milestone this week, slightly more than half of all adults have had at least one shot. If you go a step further and you look at Senior Citizens, 65 plus, now you are up to 80 , 80 of seniors in this country have had at least one shot. If you go a step further and you Take A Look at fully vaccinated, what are the stats there . It basically breaks down this way. One quarter, one out of every four people in the entire country are fully vaccinated at this point, and onethird of every of all adults in this country, onethird totally vaccinated and twothirds of Senior Citizens fully vaccinated at this point. The high numbers you see there, obviously priority was given to getting them vaccinated has everything to look that there have been half A Million folks who died from covid and 81 of the deaths have come from Senior Citizens, folks 65 and older. 95 of the deaths have come from folks years or older and thats the reason for giving the preference there, and that has a lot to do as well with the high number of vaccinations among seniors. The daily death, this peak right here, this is the start of february. This is basically when we crossed 10 of people vaccinated. Thats when we hit about 10 . Since then, dramatic increase on the daily basis, the number of people vaccinated especially seniors, and you see that pretty big dramatic steady decline there in the number of deaths. It has leveled off a little more recently but has come down dramatically, certainly as the vaccinations among seniors really took hold in terms of where you see the highest number of vaccinations, these are the top five states in terms of getting folks fully vaccinated. These are the lowest numbers. You will see the lowest five right here, and you see the range within the country. If you want to compare the united states internationally, Take A Look at this. Again, 40 of people in this country have had at least one dose. How does that compare internationally . Other countries to compare it to, one that jumps out is israel, they have one of the highest numbers in the world. If you look at israel right now, really getting low in the number of new cases there, new deaths there in israel. So if the u. S. Can continue the upward trajectory in getting vaccinated, thats what that the future could look like. Theres a higher share of the population in the uk has at least one shot, and if you look at the full vaccinations, the u. S. Passes the uk. We put japan on here, because the summer olympics, its supposed to be in japan this summer, and very little in the way of vaccinations in japan so far, katy. I am really surprised by that number out of japan. Steve kornacki, thank you so much. My husband and i were having a conversation about our 2yearold, because i am nine months pregnant right now, and once this baby comes out she will have some measure of vaccination, because i got vaccinated, and the only one in our household that wont have any protection will be our 2yearold son and you are doing something to address that. Talk to me about what you the Thought Process you went through to have your 3yearold get his first shot already happened, and your 7monthold get their first shot, i believe, gets that tomorrow. Am i correct . Thats right. Congratulations, katy. I am a pulmonologist at standard and i am looking into the benefits of this vaccine, and vaccinating our kids was a way for us to participate in this trial, and for those that maybe cannot they can vaccinate their kids later. Ana, shes three years old and got the vaccine last wednesday, and little baby, soren, hes 7 months old and he is scheduled to get his Vaccine Tomorrow as part of this trial, and during the trial thats what you get, and you start from a lower dose, not the full dose that adults get. For babies, its 0. 1 of a dose, and then it goes up to twothirds and then a full dose. After the small dose is there, you will get tested in a trial where still many kids can participate in pfizer, and of Course Moderna as a trial as well. Your kids are so cute. How is your 3yearold doing after his first dose . Great. Of course he gets so many vaccines these days, and he has a Sore Arm and was low with energy the day after and thats all gone and hes a happy kid running around, and hes been into dinosaurs, so. Hes very cute. I took my kid to the Doctor Today and he screamed the whole time, so i think i need advice from your 3yearold on how to toughen up at the doctors. And there are many out there that said they would be so scared to put my infant in any trials for this, and when you thought about the process and what was going to happen, tell me how you outweighed the risks . Yes, of course, we dont want to experiment for no particular reason, and i became worried about the coronavirus in kids like little baby soren, because Theres Evidence accumulating that kids can have what is known as noncovid, and quite frequently, and there are kids that will have a mild form of Coronavirus Disease, who have a mild form of Coronavirus Disease and they could have longterm consequences, and thats related to Lung Damage and brain as well as the heart. Joining me now is tara brown, george Floyds Cousin and the director of the George Floyd foundation. Tara, thank you very much for being with us. It was a really difficult time for the Floyd Family, and i am wondering, though, what does justice look like for you . Is it guilty on all three charges . Is it guilty on one or two . We are looking for guilty on all three charges. We obviously want, you know, the strictest punishment that he will be allowed at this point. So that is justice. What would you want to hear from Derek Chauvin if he speaks during his sentencing, which often happens . I have thought about that. I have pondered that question a couple of times and i honestly dont feel like Theres Anything that he is going to say that is going to change my feeling about what happened on the day that my cousin was murdered at his hands. You know, throughout the trial i kind of, you know, kind of studied and watched and he doesnt show any remorse, any emotion, so i am not convinced he even feels hes done something wrong at this point. I am not looking for him to give us anything thats going to make us feel any better about what happened. I have been taken back about how little the defense has done to humanize, Derek Chauvin, not that i am saying that that needed to happen, but very little on who he was and why he became a Police Officer. I guess i just wonder for the family, had you heard from him sooner, if you had heard remorse from him, would that have changed anything for you . Hard to say, especially since i have had to kind of relive the video of, you know, the Way George died. Its been traumatic, having to watch that over and over again, the way that he suffered and the way that in my opinion, i feel like chauvin had ample opportunity to do things differently throughout that nine minutes and 26 seconds. I didnt see that so i mean, its really hard for me to say. Its so hard watching it just from the Vantage Point where i am, watching it from this chair, I Cant even fathom what its like for a family to watch that over and over and over again. I want to ask you about What Happens Next after the verdict regardless of what it is, what is your message to people around the country who are anxiously awaiting the results . My message to people around the world is very simple. We are very appreciative of the support we have received so far, up to this point. We are grateful for that. I know america and the rest of the world is anxiously awaiting in decision just as we are. Tensions are high and people really want to see justice served in this case, and so we are hoping for the best.
