He had no pulse. He was not breathing. He was not responsive and the defendant had to have known what was right beneath him. This wasnt policing. This was murder. This was an authorized use of force. As unattractive as it may be, and this is reasonable doubt. Lets bring in the experts. I want to start with nbcs Shaquille Brewster outside the courthouse in minneapolis, where he had been since the start of this trial. David henderson, Civil Rights Attorney and former prosecutor, and kirk excuse me, kirk berk halter, currently a professor at the law school. Were at the phase today where everything is up to the jury, including the timing of how all of this plays out. They deliberated about four hours yesterday and the court will knife us when they begin deliberations every day, Pause Deliberations and when they have a verdict. And there are Pool Reporters who will let us know if there are questions coming back from the jury to the attorneys. We know that will happen virtually than in person coming back. We know the judge instructed them on one of the first things they should have done yesterday when they broke is go and select a foreman. They said each juror will have their own computer and monitor to go through the mountain of evidence thats been submitted as part of this trial. This all comes after the extensive Closing Arguments, lengthierthannormal Closing Arguments we heard yesterday. I want to remind our viewers one of the last things they heard from the prosecution right before they were sent off for their deliberations. Listen here. You were told, that mr. Floyd died that mr. Floyd dieds because his heart was too big. You heard that testimony. And the truth of the matter is that the reason george floyd is dead is because mr. Chauvins heart was too small. The jury remains anonymous and sequestered. So theyre not going home to their families every night, theyre being stayed locked away, essentially, and will be there until we see them again virtually in court if they have any questions they bring to the judge. David, give us some insites. What can you read into the amount of time a jury is deliberating . When does it tell you about which way theyre leaning, we saw a case similar to this 11 years ago and it took several hours for a guilty verdict. Stephanie, we know from the past it has taken about 11 hours under similar circumstances. Thats really the only basis we can use for how long the jury should be out, what we should have conclude. If we had a verdict yesterday, i would almost certainly say it was one for the prosecution. Quick verdicts tend to favor the prosecution. In a case like this that is so unusual, its really hard to draw meaningful conclusions from the amount of time they spent out. They do very well come back some time today or tomorrow afternoon. If they havent returned by tomorrow afternoon, thats when you know theres a problem back there in deliberations because it will be taking longer than should be expected. Kirk, the defense talked about the medical evidence and reasonable doubt about floyds death but also pushed the idea chauvins actions constituted reasonable force. What did you make of that argument . Well, they certainly pushed forward this idea of reasonable force, reasonable Police Officer. I think he used the word reasonable about 118 times in his closing and i really felt that was kind of a Nonstarter Given that we had all of this testimony from Chief Arradondo and other officials. Dont get me wrong, the defense has to make that argument that they certainly cant concede. However, the Defense Attorney spent so much time on that argument and to make matters worse while making that argument, he replayed video of the incident and while trying to make the point based on the visual evidence from the video, what did we all hear . We heard George Floyd Pleading for his life. I thought perhaps the defense spent too much time on that. Certainly the defense really wanted to get in the Causation Evidence and prior bad acts with regard to George Floyds drug use. Quite frankly, they should have made more use of that going towards causation rather than reasonable officer, which is basically a nonstarter. Such an important reminder, chauvins own former Police Officer chief testified against him. David, what do you think are the biggest potential stumbling blocks standing in the way of a guilty verdict . I dont think there are big stumbling blocks standing in the way of a guilty verdict, steph. I know thats a big statement. Its really hard for me to imagine chauvin being acquitted all together. I think theres going to be an issue with regard to what he may be convicted of and thats where ive got a concern about the Closing Arguments we heard yesterday. Typically a good Closing Argument seesaws back and forth between teaching the jurors the law and telling them how to apply it to the facts. If youre wondering what that conversation should look like, imagine if you ever had a talk with a doctor about a potential Serious Health condition, they typically explain the Health Condition to you and then apply it to your individual circumstance and then help reassure you about whats expected going forward. A Closing Argument should work the same way, just for the law and in the courtroom. The other Big 12u78ibling Block that would lead to a conviction but not acquittal is whether you have one individual juror back there who bought into some of the arguments the defense was making and decided youre going to hang this jury up from convicting on any of the three counts, because you need a unanimous decision to convict. Theres simply no way of knowing how well the defense connected at that point. Shaq, i think you have Breaking News. What do you know . Thats right. I told you the court will notify us when they begin deliberations and when they end. We got a notification from the court. It says simple, 8 00 a. M. , jury begins deliberations for the day. They are now deliberating. The jury are officially on their fifth hour of deliberations at this point, stephanie. Back to work. They made a point to say the police are not on trial, Derek Chauvin is on trial. From the police point of view, what is the best outcome of this trial . Thats a very interesting question. While the police are not on trial, this case did spur renew calls for Police Reform. I think whats on trial here is accountant. We saw that off where we had so many Police Officials testify. Usually in these cases, youll find Police Officers and supervisors know that Police Officer x, yeah, was always a wild card, people didnt want to ride with him but nobody really spoke up and this person continued to serve. So hopefully, the outcome here, will be more people will speak up. When you see someone that is way off the reservation so to speak, just entirely their behavior does not conform with the standards of policing, that people will speak up. Derek chauvin is a detriment to all of those Police Officers who want to do their job in this country. Somebody wanted to speak up and the defense didnt like it. Max, tell us about that. Maxine waters spoke up and the judge said they could be ground for a mistrial. What what happened there . The judge knew who it was before they even said the name. Maxine waters out of baltimore. She got on a bull horn talking about how she couldnt sleep because Daunte Wright did not deserve to die. She said she wanted to be there to support the family and community in brooklyn center. Then she was asked questions specifically about the Chauvin Trial. She said very clearly she wanted to see a guilty verdict. She was asked what would she tell protesters if theres not a guilty verdict and she said, we need to stay on the streets. She said, we got to stay on the street. Weve got to get more active and weve got to get more confrontational. Weve got to make sure excuse me, make sure they know we mean business. Republican leaders in Congress Took great issue with that, condemned those comments. They said she was citing or trying to incite violence or continue violence here in minneapolis. House Speaker Nancy Pelosi defended those kplepts. You heard the judge there in the courtroom yesterday say that while her comments he believed were abhorrent and he does not want political leaders talking about the trial, including leaders here in minneapolis, we heard this from the judge before, that was not grounds for a mistrial but he did concede eric nelson and the defense and by definition Derek Chauvin would have a possible grounds for an appeal after this is all said and done if there is a guilty verdict, stephanie. Our team is told President Biden the past two weeks have been meeting with Top White House officials to game out responses and reactions to any potential verdict outcome. The white house has also been coordinating with state and local leaders in minnesota but really around the country so all of the various states and cities are prepared for potential protests. Beyond that, the white house has also been drafting a statement for President Biden to deliver once the jury rendered its verdict in this case. Im told that no matter the outcome, the president will acknowledge and empathize the pain, grief and trauma that so Many Americans are feeling in the wake of George Floyds killing and that of so many other unarmed black men at the hands of police. Weve also learned separately that President Biden called the floyd family yesterday. We learned that by way of George Floyds brother, philonise floyd, who spoke with greg melvin on the today show earlier today. Take a look. So he was just letting us know he was praying for us and hoping that everything would come out to be okay. You will recall thencandidate biden met with the floyd family in houston last june and also taped an address that was played at George Floyds funeral last summer as well. Is that a big focus today . Yes, immigration will be a top focus. President biden introduced his immigration plan the first day in office and Congress Later introduced Immigration Legislation but that has stalled on capitol hill. And theres frustrations amongst democrats about the way the white house handled the Refugee Resettlement issue. That will be a prior issue they will talk about. Capitol Police Officer Brian Sicknick following the january 6th attack on the capitol. Washingtons Chief Medical Examiner now says he died of Natural Causes. Our team of reporters is following the latest new developments so i want to go right to pete williams. Pete, walk us through this. One more is the Medical Examiner revealing . Because a lay person like me reads Natural Causes and thinks he wasnt sitting on a couch. Come on. He wasnt but the Medical Examiner said there was no contributing factor to his death other than the fact he suffered blood clots to the brain causing two strokes. What happened you will recall he was sprayed with a chemical irritant while he was on duty during the capitol riot. He went back to his office and that night collapsed and was taken to the hospital, where he died the next day on january 7th. The Medical Examiner says there was no sign of an allergic reaction to the chemical irritant, leaving the Medical Examiner with the conclusion that it was the blood clots that caused the death. Of course, now, the question is did his work on the capitol riot cause the blood clots . And the Medical Examiner doesnt offer any opinion on that but his base by saying it was Natural Causes, that means there was no other outside influence that caused the blood clots. The Capitol Police are saying they respect the findings but they say this doesnt change the fact that officer Brian Sicknick died in the line of duty courageously defending congress and the capitol. You may recall, 12e6ny, early on there was a thought maybe he was struck with something, maybe he was hit with a fire extinguisher. All of that turned out not to be true. Two men have been charged with assaulting him with a chemical irritant but not charged with causing his death. Of course, these findings will make it complicated for the prosecution to charge anybody with causing officer sicknicks death. I want to bring in ken dilanian where more on the insurrection. Ken, you and our other colleagues found hundreds of online posts about the plans to attack the capitol before january 6th. Why arent we seeing any of that in court . Stephanie, only the fbi and Justice Department can answer that question definitively and they declined to comment for our story. As pete reported, the Justice Department said in court at least in terms of the roughly 420 people charged so far in the riot, they have seen no evidence of advanced planning to attack the capitol building. And the fbi has repeatedly said they had no credible evidence of any such plans before january 6th. But we reviewed hundreds of posts on a site called the donald. Win where users discuss in granule lar detail plans to breach the building, arrest members of congress. Necessity made clear they want to stop the certification of the election ever joe biden. There was one meme i think you can put up on the screen, a cartoon with two big red buttons giving members of congress a choice, certify trump or get lynched by patriots. There was discussion of creating a stampede to overwhelm Capitol Police. There was even talk of erecting a gallows in fact, a mock gallows was put up on the right side of the capitol. So its possible none these anonymous users ended up going to the capitol and thats why were not seeing the evidence in court but that does not explain why the fbi said they had no credible intelligence beforehand. Lawmakers want answers and the Inspector General is actually investigating how the fbi handled all of this and that may be one avenue we get answers to the questions you asked at the top. Two of the representatives with President Biden yesterday say the president asked them for their counterproposal to what the white house is putting forward on infrastructure to be due back by the middle of next month. Where we are in this process right now, the white house has essentially the outline of a plan that will be discussed in this hearing today on the senate side in the appropriations committee, theyre saying to republicans, if you have something better, lets see it. The republican plan right now is even more conceptual then the democratic plan. Its not an outline. They go a lot of republicans are talking about something between 600 billion and 800 billion. The question is how do you pay for whatevers going to be done on infrastructure . Republicans are dead set against raising the Corporate Tax rate at all to the 21 level it was lowered to during trump years. They dont want to pay a higher gas tax, through the people who will be using it. So this hearing today will be very important on the appropriations committee. Youve been putting up Cabinet Secretaries who will be testifying. Im watching the republican side of the dais where susan collins, lisa murkowski, those in the meeting with President Biden will be in the room and starting to win over and convince, perhaps, some of the republicans its time to move forward slow or fast, because it will be key to the administrations push. It really starts in earnest this week here on capitol hill, steph. They need every vote they can get. Were also expecting an explosives hearing on Voting Rights today. What do you hear about that . This will be interesting, the most Political Committee in the senate will be talking about Voting Rights issues and the star witness is stacey abrams, the one and perhaps future democratic gubernatorial candidate down in georgia, whos become somewhat of a boogieman, boogiewoman, Gender Neutralish figure for republicans. They are those looking for possible president ial races to go toe to toe with abrams, particularly on the issue of the georgia restriction bill, will be very interesting to watch, steph. Certainly is, garrett. Thank you. Now to the latest on the coronavirus pandemic. The number of Covid Infections is rising, up nearly 30 nationally. In 11 states, cases are climbing by at least 25 . All of this despite vaccine now being available to everyone ages 16 and older in all 50 states. Vice president harris combating Vaccine Hesitancy during her visit to North Carolina monday stressing the vaccines are safe, effective and will save lives. And the u. S. State department announcing its do not travel guidance will extend to about 80 of countries in the world due to covid19 cases increasing globally. Lets go live to ali vitali in baltimore, where theres a new setback in the Johnson Johnson this morning. Ali, what is going on . Yeah, steph, for Johnson Johnson theres the Manufacturing Piece of it and then the uses and Disessential Nation of the Vaccine Piece of it. On the usage front, we know the cdc and fda asked people to pause putting shots in peoples arms while they investigate a potential link between the vaccine and rare Blood Clotting Disorder reported in about six women nationwide. On the manufacturing front though, thats what were focused on here today, because we found out yesterday overnight that the fda has asked this subcontractor of Johnson Johnson in baltimore to pause production of the vaccine at this facility while they figure out some Quality Control issues that have been found. I think the timeline, steph, is really important here to understanding whats going on. Back at the end of march, we found out this facility mixed up ingredients to two different vaccines, astrazeneca and Johnson Johnson. A few days after that news broke, the Biden Administration decided this facility was only going to manufacture Johnson Johnson and they put j j in charge of this Emergent Plant here in baltimore. A week or so later, the fda came and inspected this facility and a few days after that, the fda asked emergent to stop manufacturing the j j vaccine and to quarantine their existing material. Now, this is a setback because this facility was manufacturing a substantial number of the hundred million total doses j j hoped to deliver to the u. S. Government for dissemination by the end of may. J j did say overnight they dont know yet what the impact of timing is going to be on this. But this plant specifically did acknowledge that there are changes they have to make theyre willing to make as they move forward in coordination with the fda as they await a fuller picture of what that fda investigation here found. I will also say that cnbc had on the cfo of Johnson Johnson this morning. They asked him about the potential time delay. Listen to what his answer was we are in very good position, assuming the regulatory process goes as we expect. We will certainly do our part to make sure that we have a favorable outcome there. Should that go well, we will be in a position to meet our contractual commitments. So a pause here, steph, at this facility manufacturing the j j vaccine as Johnson Johnson awaits on a few fronts, manufacturing and Disessential Nation. Actually, thank you. I think the j j vaccine is the fist vaccine available, the conversation would be different. Then the conversation would be theres a very rare side effect which is serious, occurs one in a Million People. On the other hand if you take a Million People who are infected with this virus, 5,000 die. So the conversation would be the benefits of the vaccine dramatically and clearly outweigh its risks but it wasnt the third vaccine, it was the third vaccine. Pfizer and moderna preceded it and they dont have this risk. Now the question will be, we basically put a Scarlet Letter on this vaccine, scared people about this vaccine, even though it has certain characteristics that are advantageous, single dose, refrigerator stable for months compared to the pfizer vaccine, which is refrigerator stable five days or moderna, refrigerator stable for one month. Then the question becomes are there going to be people who dont get vaccinated, only because this would be the only vaccine they would get, in which we may have done more harm than good in all of this. Speaking of Vaccine Hesitancy, its political. When you look at the number of covid cases on the rise and or Vaccine Hesitancy, it is in red states. What is that going to mean for the rest of us who have been vaccinated and who are ready to get back to normal . Thats the key question. Whats the answer . Theres going to be enough vaccine for everyone. Then you will find out what percentage of the population really doesnt want to get vaccinated . If we dont get to 80plus percent herd immunity, this virus will continue to spread. And then you have to decide is it okay for significant numbers of people not to be vaccinated or do we have to find some way to compel them to be vaccinated. Youre starting to see some evidence for that. If you and i are vaccinated, everyone in our family is available to be vaccinated, can we not say go fish to those whoa dont wouldnt to be vaccinated. If you get sick, thats your own free will. The problem is when you make a decision not to vaccine yourself, youre not only makingization for everyone else with whom you come in contact. The question is, is it your inalienable right to transmit a fatal infection, especially one that continues to m mew trait, create variants and become immunosuppressant and continue. So the degree to which it continues to have variants and we dont get a High Percentage of the population immunized is something we all risk. Do we have to do something to force people to comply . Just encouraging them, especially when you consider the amount ever disinformation out there and how politicized this has become, just saying come on, guys, lets do it, its not going to make a difference. I think youre already seeing that in the private sector. 40 schools said if you want to come back to school, you have to be vaccinated. I think its happening already. Restaurants, bars. I think its the private sector that will step forward here and thats going to be where the rubber meets the road. We will know how well we do by next winter. This basically is a winter bug. The number of deaths are dramatically coming down between the weather and vaccine, so i think we will be good over the summer. Then we will see how well weve done when next winter hits. Outside the courthouse, weve already seen businesses boarded up and minnesota governor tim wolf declared a state of emergency, asking other states for help. Whether its here or brooklyn center, minneapolis where Daunte Wright wright was shot, ten miles north of here, you will see police and National Guard are behind two lines of fences, not one, two. Theres no interaction between police and National Guard people and citizens generally speaking. Around the city i have been noticing police patrols. Theyre moving in two cars together and tend to have a National Guard car with them. Police are not looking for international with the public here or brooklyn center. The protests last night went on for a few hours but they were marshalled by their own people. In other words, no interaction with the protesters, marshals kept them off the sidewalk in case there was damage to report, if they got too far, marshals would push them back, if a car tried to stop, they would stop the car without confrontation. But no interaction really between traffic and people and protesters. Protesters were allowed to protest, do what they wanted to do, no conflict. Here in minneapolis they said theres school today but wednesday through friday, all school will be virtual. As you said, they activated National Guard in cities like chicago and elsewhere. They told police theres no leave, everybody is either on call or on duty for a verdict. Police are doing it differently across the country but police leave have been canceled in many cases, emt leave and fire duty leave canceled. National guard is activated, about 2,000 in minneapolis, but they have another 1,000 or 1,500 available to them to activate and states are working on Cooperation Agreements with each other in case someone needs to borrow either police or National Guard from a neighboring state as weve seen happen a few times in the last year. D. C. s on guard, chicago, new york, places like that embracing for trouble but trying very hard not to provoke trouble ahead of a verdict. In other words, youre just seeing it feels like a city thats a little bit shutdown but youre not seeing a lot of police or National Guard, except in places like this behind me. Ali, how do you feel, you have been in situations like this before in minneapolis . Its tense. Its tense. Theres a lot of anger. I have spoken to people here in minneapolis who say what they saw with their eyes is what they think happened. So the sentiment ive had most commonly from people, stephanie, if not this, then what . If there cant be a conviction in this case, then what . And i think thats what were looking for because thats what people will be reacting to. Was there a conviction in this case . Was there not . We dont know. The jury deliberated four hours yesterday. Been in there an hour now this morning. But that is what everybody is thinking about right now. Its as you know, stephanie, not just here in minneapolis, this is probably one of the mostwatched verdicts in history. Please, please, stay safe. As the jury deliberates that very case, communities all over the country, really all over the world, are grappling with Police Shootings. What do we do about them . We saw some in detroit and san antonio get little attention over the weekend. Since the Chauvin Trial began, the New York Times reports at least 64 people have been killed by Law Enforcement. With states passing more than 140 new Police Reform laws, the question is, are they enough . I want to bring in a man who knows best, dr. Philip gawk, ceo of center for equity and professor for africanamerican studies at yale. So good to have you here. States passed over 140 Police Reform bills since george floyd was killed, but thats just states. How badly do we need federal action . So its a tricky question because people are paying attention to the federal comings and goings but most of the stuff happens at the local level. Of the 140 reforms passed at the state level, almost all of those were off the shelf from president obamas task force. Things like better training, mandatory bans on choke holds, banning tear gas, things that make things a little less deadly and dangerous. But in terms of federal work, what were looking for there is leadership. What that will look like is not just about reforms but saying the way we keep people safe is not just making police better but taking police out of places they dont need to be. We need federal leadership in that direction. Signals in that direction. From there we hope for local leaders will take up the struggle from that. So places like where berkeley where they said no lower level Traffic Enforcement and ithaca, theyre putting together a partnership of Community Solutions and Public Safety thats civilian led, and there will be no armed responses to nonviolation crises. Thats the hope of what comes next. And there are other things happening on the local level too. Take florida, Governor Desantis just signed a controversial bill, antiriot bill, antiriot on its face, people can say sure, but what it does is crackdown on protests. How damaging is a bill like that to the cause of overall improving policing . Lets talk a quick second about what words mean. This antiriot bill is designed to crack down on quiet riots. It says if youre three or more people, you can be declared a riot by whatever Law Enforcement is there. And that includes hurling mean worlds. One of the components of the bill, if youre convicted or charged with this, you have to be held in custody until your trial with no chance of bail in that context. Its a logistic nightmare. Its a moral failing. And its having exactly the right direction from where the rest of the country wants everybody to go. Its sad, it is disappointing, and it honestly is part of the tradition of not keeping us safe but using Public Safety as a weapon against vulnerable communities. Lets be clear, the band quiet riot, needs no reforms. Were not talking though when we talk about Police Shootings of lowlevel crimes. We have seen Police Shootings where they did the right thing or they were caught in very dangerous situations. When we look at reform, how do we balance those concerns with also fighting systemic racism . So, it is tricky for someone leading at the local level, whos seeing an unprecedented National Surge in murder. Murder is bad. We are used to relying on Law Enforcement to help us out with that. But i want to be clear, Law Enforcement are not the people who stop murder. It feels like it. Weve been told that for a really long time. But if somebody breaks into your home, Law Enforcement is not going to catch them in the middle of the act. Theyre going to show up after its over. The best way to prevent murder is give communities the resources they need so they dont feel so desperate in the first place. Thats not a policing issue. Thats a resources issue. Thats a job and Substance Use and Mental Health issue. Its an education issue. So i understand right now it feels like, well, we just got to have police because theres so much violence going on. But i want to be clear, Police Respond after the fact almost all the time. The things that cause violence to communities in the first place, those are areas Law Enforcement have been asking to get out of for decades themselves. Philip, i always want to talk to you but yesterday when i was watching the Closing Arguments, i knew i wanted to, the prosecution made a point to say this is not about police, this is about Derek Chauvin. What do you think about that argument . For weeks weve been hearing this is about policing in america. Yes, so if the trial is a metaphor for what were doing in the united states, i have to say a lot of communities are just going to be devastated regardless of the outcome. In one case you have the potential of an acquittal, god forbid, or conviction on manslaughter but not murder, which means hes convicted of an oopsy, thats not going to feel good for anybody who worries they or their children or family might be next. But on the other side if this isnt policing, what are we to make of the three killings a day perpetrated by Law Enforcement every year since we started keeping track, which is only five years ago . Police contact has been down, arrests down. All other crime other than murder have been down. But the killings have stayed constant, even in this year of quarantine and covid. So if this isnt policing, this cant be talked about as an indictment of the system of policing, what the heck do we do to prevent the next one .
