the defendant's actions caused the death of mr. floyd. >> tonight, the lawyers have all made their cases. now the world waits as the jury of derek chauvin's peers will decide his fate. then, congresswoman ilhan omar on justice for george floyd. and why republicans are trying to distance themselves from the natiist america first caucus. and the lack of supply, the shortage of locations, the confusing rules are all in the past. >> "all in" starts right now. good evening from new york. i'm chris hayes. the jury in the trial of former minneapolis police officer derek chauvin is now deliberating at this moment. the city of minneapolis, the country, are now awaiting a verdict. with hundreds of people out protesting in the streets of minneapolis tonight. today, the jury heard closing arguments from the defense and the prosecution, after testimony from 45 witnesses. derek chauvin is accused of killing george floyd. the jury tasked with reaching a verdict on second degree unintentional murder, third degree murder, and second degree manslaughter. with sentencing guidelines for someone like chauvin, any sentence would likely be much less. and the jury started deliberations around 5:00 p.m. it could take anywhere from hours to days and days and days. in 2018, it took a jury less than eight hours to convict a former police officer in the death of laquan mcdonald, a shooting video released belatedly by a city. so now we wait and reflect on what has been a dramatic, tense, difficult day marking the beginning of the end of the trial. this morning, the prosecution appealed to members of the jury who may be reluctant to convict a police officer. going out of their way to paint the case as pro-police. >> imagining a police officer committing a crime might be the most difficult thing you have to set aside. because that's just not the way we think of police officers. we trust the police. we trust the police to help us. we believe the police are going to respond to our call for help. we believe they're going to listen to us. this is not an anti-police prosecution. it's a pro-police prosecution. >> the prosecution's core argument to the jury was what happened to george floyd last may, what derek chauvin did by kneeling on his neck, was what they saw on the video. >> this case is exactly that, you can believe your eyes. it's exactly what you believed, it's exactly what you saw with you're eyes, exactly what you knew. it's what you felt in your gut. it's what you now know in your heart. this wasn't policing. this was murder. >> of course, this case, that video, what we did all see was particularly sadistic and egregious. and there's a reason why the video of george floyd's death moved around the world, people taking to the streets. with all that said, the contours of the justifications for derek chauvin's actions that came from his defense, today, were just so similar. so recognizable to what we've heard for honestly decades if not longer, in the wake of incidents in which police used deadly force. focusing on anything but what actually happened. and blaming the victim. >> sometimes people take reasonable police officers take someone into custody, with no problem. and suddenly they become a problem. it can change in an instant. the 9 minutes and 29 seconds ignores the previous 16 minutes and 59 seconds. it completely disregards it. it says, in that moment, at that point, nothing else that happened before should be taken into consideration by a reasonable police officer. it is not uncommon for suspects to feign or pretend to have a medical emergency to avoid being arrested. unfortunately, that is the reality. nobody likes to get arrested. and reasonable police officers know that. how many times did someone, oh, my heart hurts, or i'm having a medical emergency. insert whatever emergency. simply because they don't want to go to jail. >> the defense did what defense lawyers often do, they tried to get the judge to declare a mistrial. it was on an interesting pretext. it was centered around congresswoman maxine waters. she said, we need to get on the street, get more active, more confrontational, show them that we mean business. >> now that we have u.s. representatives threatening acts of violence in relation to this specific case, it's mind-boggling to me, judge. >> i'll give you that congresswoman waters may have given you something on appeal that may result in this whole trial being overturned. >> excuse me? strange, unusual statement from the judge who went on to call it abhorrent that elected officials made comments about this trial. katie feng, a trial lawyer and a former prosecutor, i just want to start on that exchange and the strangeness of it. maybe it wasn't that strange. maybe we thought it was weirder than it seemed. the judge saying that seemed to be itself a little bit inappropriate. this is a free country, you can talk about whatever you want. that's how we roll here. did it strike you as odd? >> it was odd. because judge cahill has been reserved like a jurist should be. and has not offered any commentary like a jurist should do. but the context is that the defense has consistently been attempting to have this jury sequestered, and has asked repeatedly, and it has been denied repeatedly by the judge. we know the jurors are not being sequestered today. but it's a ground for an appellate issue that derek chauvin is perhaps counting on if he's declared guilty of any of these charges. but it was chilling dialogue to hear. grateful that it didn't happen in front of the jury. they had already been excused and taken away by the deputy to start their deliberations. but it's in the context of the idea that this jury should never have heard about the daunte wright or adam toledo shooting. and the further riots and protesting. that's what people need to realize, the context within which that occurred today. >> and jelani, you've been covering this. what struck me, obviously in closing arguments there's the most leeway, legally. but the context of outside the courtroom was so present inside the courtroom. and i thought the riff by the prosecutor, this is not anti-police, it's pro-police. he said, we trust police to do the right thing. the whole time i'm thinking, it's a very specific we you're using there. though maybe useful for the jury. >> i think that some of this is a kind of political rhetoric and calculated. but it points to a bigger dynamic. that is think is much more substantial. we've seen in this case the police come out against derek chauvin in a way that you almost never see. >> yeah. >> in previous cases. it's been because the outrage that that video generated, worldwide outrage, it became a national indictment on the global stage. that the blowback that was so significant, that the system itself went into self-preservation mode. the city council voted to disband the police department. something that would be inconceivable otherwise. what we've seen now is as opposed to the standard arguments, to try to say that the person who is accused is actually innocent, and we should side with the police officer, we have seen an effort to say that the system itself is innocent. and therefore this police does not represent some bigger systemic problem. and i think that was the final statement from the closing statement from the prosecutor but right in line with the implications of that strategy. >> let me follow up on that, and i'll come back to you on the charges, katie. but on the defense's approach, it was striking to me that those arguments are arguments i've heard 100 times in covering the aftermath of police use of force, violent shooting against civilians. you don't understand what it's like to be in their shoes, that someone can be compliant, and turn non-compliant, they lie and say they have a heart condition and they don't. it was the full battery of stuff we've all heard dozens of times. >> sure, it is. and you mentioned laquan mcdonald and the conviction there. the other instance is the conviction of the officer in the death of walter scott in south carolina. and you saw those arguments deployed in all of those instances. that says under certain circumstances, in the case of walter scott, you saw the person drop the taser near his body, in a way that made it look like he was in jeopardy. the jury didn't buy it. so the difference has been not that the police officer made a judgment call, which large segments of the public are hesitant to question. but the person did something over 9 minutes and 29 seconds, excruciaingly long, and there's little you can say that that entire time he had to maintain that posture on mr. floyd's neck. >> and katie, we talked about this throughout these weeks, we don't know what will happen, and what conclusion the jury will reach. and in fact, there have been examples, like the rodney king one, there was visual evidence that did not lead to a conviction. talk us through the charges, and what needs to be found in terms of cause and the state of mind of chauvin. that's a really important question. the reason why is, we've talked about the fact that the jury instructions about the causation, was derek chauvin the cause, legally, of the death of george floyd? what is important is the prosecution made it excruciatingly clear, he just has to be a factor, not the sole factor in the death of george floyd. you can consider his heart condition, and still find derek chauvin guilty of all three charges. saying that he committed a felony assault at the time that he killed george floyd, it's the felony itself. third degree murder, there was an act that was imminently dangerous that would cause the death of george floyd. and the second degree manslaughter, that's the lowest and easiest to get to. but the fact that the prosecution made it clear, this is not an indictment of an entire police department or police system, derek chauvin went criminally rogue. he deviated from the professional standards, the things he was taught, the policies he was supposed to adhere to. instead of respecting the badge, he went criminally rogue. and that's what the state is trying to tell the jury to do. render a verdict that is consistent with the facts and the evidence and the law that is in this case. and you should not have a problem finding him guilty. because it's derek chauvin on trial, not the entire minneapolis police department on trial. >> they were very, very clear, to try to draw that narrative distinction. jelani, last thoughts. >> very quickly. one thing i have to say, it's difficult to say that derek chauvin went rogue. he was in a supervisory capacity that day. >> right. >> officer potter, in brooklyn center, was in a supervisory capacity. while it may not be textbook policing, it may reflect how poliing operated in that department. >> thank you both for your time. friday, we brought to you the story of the new caucus, being shopped around by marjorie taylor greene and paul gosar. and it was staking a claim to a vision of a republican party not afraid to say that tens of millions of non-white people that came to our shore by 1965 may have been a mistake. but that seems not to have gone over too well. that's next. l. that's next. to allergens all season long. psst! psst! all good ♪ ♪ (engine starts) the john deere z365r ztrak mower is here, and it's built for taking it easy. look, it says so right there. those comments and a lengthy history of similar statements, he was stripped of his committee assignments and successfully primaried by a republican challenger. he's no longer in congress. you would think that would serve as a kind of deterrent to others, that our country is born of its heritage in the anglo-saxon heritage, yadda yadda. then the news that taylor greene and gosar were forming an america first caucus, not far from what king and donald trump's former aide stephen miller said. and kevin mccarthy said the republican party is the party of lincoln. okay. that sent the america first caucus scrambling to walk it all back. paul gosar said he did not author the document, and became aware of it only when it was reported by the news media. and marjorie taylor greene saying it was a staff level proposal that i hadn't read. nick sherman broke the story, he's the founder of punchbowl news, and he joins me now. first, what is this document, and who wrote it? >> chris, thanks for having me. that's a good question. but when we went, let me clarify a few things. when we went to marjorie taylor greene's office, their first comment was something along the lines of, you know, someone leaked this to you guys. and we'll let you know when we have a final version of this. they did not deny its authenticity in any way, shape, or form. paul gosar, we had gone to his staff and contacted them. and they had this. and we posted it online, we certainly weren't trying to hide this document. so, you know, listen. they were creating this ccaucus this was material linked to this caucus. we never reported they were the ones that drafted it. but this was a pretty extensive document to have nothing to do with it, after kevin mccarthy came out against it. >> matt gaetz celebrated it, he tweeted, oh, i want to get in on that action. that's before the mccarthy tweet. and the paul gosar history, it was really notable. he was at this sort of alt-right version of cpac. the america first political action conference, he says if america loses its white demographic core, its faith in jesus christ, it's not america anymore. this is part of gosar's belief system, apparently. >> also, to put a finer point on it, marjorie taylor greene over the weekend tweeted, she said i had taken fake jake sherman, she called me. which does have a nice cadence. she said i had taken her words out of context and misconstrued them as racist. we didn't call them racist or take it out of context. sorry, she said i took anglo-saxon out of context and made it seem racist. we posted the entire document. it was not out of context. i'm not going to try to make sense of what she's saying. i will tell you this, though. this is an important story, because as you indicated in your opening, this the fundamental to an identity that is deep within the republican party in the house at this point. and you're seeing people rally to marjorie taylor greene's defense. it's very important stuff. >> and i was surprised by mccarthy's reaction. that's usually not the way he goes on this stuff. usually, i don't know, he tends to be a passive and reactive dude. i would not have bet that he would have tried to do that. were you surprised by the tweet? the white house said on friday, the 15,000 cap that was set by the trump administration remained justified. later, you said, actually, no, the number will go up by may 15th. >> i would dispute that being our characterization on friday. this was always meant to be just the beginning. in the announcement we made on friday, we were clear, in the emergency presidential determination, if 15,000 is reached, a subsequent determination would be issued to increase admissions as appropriate. and that is our expectation. >> the white house spent a good part of today trying to explain why the biden administration seemingly broke a promise, then changed the position after backlash. friday, president biden announced he was keeping the trump administration's historically low cap. and then a few hours later, saying he would set a new, higher cap by the middle of next month. we still do not have that number. there's probably no singer member of congress that has a more personal connection than minnesota congresswoman ilhan omar. when she was 8, they fled somalia to kenya. they were sponsored for refugee resettlement, moving to virginia and then minneapolis. joining us now, congresswoman ilhan omar, one of the most outspoken people against the refugee cap. congresswoman, thank you for joining us. what is your understanding of where the cap is, and what the administration's posture towards it is? >> there isn't really clarity yet. as you know, the original cap that was agreed upon by multiple state departments, by members of congress who chair committees of jurisdiction, by those of us who have been advocating for the cap to be lifted since the trump administration have all agreed upon there being a 65,000 or so refugees admitted this year. and then subsequently increased next year. so what we were appalled to learn was that this wasn't going to happen. and, you know, as you have alluded to, there's been a backtracking that says that we will learn a new information, hopefully by the decision that will be made by the biden administration on may 1st. so we're all waiting and going to make sure that we advocate as hard as we can to make sure that that number does not stay at 15,000. >> something you said 65,000, which would still be below the last year of the obama administration. something that might i think be worth noting for people, just because your family went through this, just the level of application, paperwork, vetting, difficulty, hoops that one jumps through to become an official refugee in the united states is really, really onerous. it's not easy, and it's very long and drawn out. there's conflating of people presenting for asylum at the southern border, and applying from abroad. >> yes. and oftentimes i think we forget how lengthy of a process it is. for my family, it was one of the shortest processes. it was a couple of years. for a lot of families, it could be five, six, ten, some 20 years to go through the process of getting vetted. waiting for a state to be resettled in, if you're coming to the united states. and it's a really long process. and as we talk about capacity, i want to remind people, the kind of capacity challenges that we're talking about at the border, it really doesn't apply to capacity challenges existing with the refugee resettlement program. because there are resettlement agencies that partner with the united states government, that do this processing. that process a lot of the vetting that takes place. and then help families when they get to the united states to get assimilated into society. those partners have come out and said we have the capacity. we're ready for you not to only bring the 65,000 we've had a conversation about since inauguration, but we can even do more than that. what we want, what we're advocating for, this administration to keep its promise, what they campaigned on, what they've promised since inauguration. and what we know to be true in regards to their policy and what they morally say they believe. >> this is a personal question. so if you don't want to answer, you don't have to. but do you remember when your parents told you, or your family told you in mumbasa that you were actually going to go to the united states? >> yeah, it wasn't a conversation with me. but i do remember my grandfather and father talking about us starting the process of relocating to the united states. and i remember there being a long interview process. i remember us waiting for nearly a year to know if we would get a second interview. i remember going through testing, medical testing, other testing. i remember us going to nairobi to do more processing work. i remember the long process of orientation. and i remember the long process of waiting to hear if our flight had been scheduled. so it is not an easy process. and many of the people who are in this refugee camps, who have already started the process long ago, have been waiting. and waiting for their papers to get processed. we hear from so many people in the united states who have family members that they, themselves have sponsored. who are asking what is taking so long. when they will be reunited with their family members. this is something that people had high hopes for, something people fought so hard to make sure that this new administration would be able to do. and it's just, you know, with desperation and frustration that we're speaking out against the biden administration in their backtracking on this. and we do applaud them for changing course. and we just want to make sure that they follow through with clear communication on what those numbers are going to be. so that we can feel comfortable where those numbers will land. >> finally, i want to ask you about the mood in your city this evening. the jury is deliberating in the trial of derek chauvin for the killing of george floyd. of course, daunte wright's death coming just in the last week and a half, i believe. also in your district, i think. what are you hearing from your constituents about where folks are at right now, as they're in anticipation of this verdict? >> just about. i mean, remember where we have to go, chris. we have to, based on the high transmissibility of these new variants, the b.1.1.7 variant from the united kingdom. the 1.4.2.9 out of california, we have to vaccinate or else transmission goes up. we need 80% of the u.s. population vaccinated. that essentially means just about all the adults and a high percentage of the adolescents. in theory, all the stars are aligning now in order to vaccinate our way out of this epidemic, at least in the united states, provided we can get everybody onboard. >> i saw this in the city of houston, where you're located. the houston chronicle saying covid vaccine supply increase in texas. clinics now saying no appointment needed. and i think that's going to be increasingly common, right? that when you're getting to the point where you don't have to regulate or ration supply, you can say, like, come on down. >> the whole idea is, to make this as easy-breezy as possible. victory would be anybody who wakes up that morning says, hmm, maybe i'll get vaccinated today should be able to do that. and we're just about there. many states are already there. the problem is, there is a sizable chunk of the u.s. population that has said they would be defiant, just like they were defiant of masks and social distancing. now they're saying they won't be vaccinated as well. there are at least five polls now, we did one with texas a&m, monmouth university has done one, and there are others. they all point to the same thing. it's white republicans. and i don't know how to more elegantly say it, but that's the reality. and this has been the growing trend since 2015, when the anti-vaccine movement first glommed on to the republican tea party. now it's a strong component of the republican party. >> what do we know from social science, i don't think shaming anyone will do any good. they're not going to listen to me telling them that they're doing it wrong. so the question of, how do you reach people where they are in the information environment that we're in. what do you say to that? >> well, you know, part of it is, you know, they're very much focused on this concept of health freedom, medical freedom. that was the basis for defying masks and social distancing. now, we're saying, if you can vaccinate, guess what, you can have everything you've asked for in terms of not requiring social distancing and masks. we can have an extraordinary quality of life. and it's been an enormous source of frustration for me. i've been trying to go on as many conservative news outlets as i can in order to appeal to these groups. now it's gotten more complicated in the last two to three weeks. we've seen fox news pile on in a big way. not so much the daytime people, it's the nighttime anchors have decided that they're going to spectacularize this. they've targeted me, and tony fauci, and vivek and others. the truth this, this is new. the republican party has never been anti-science. it's going to be one of the great challenges in the coming weeks. >> i think the climate trajectory was the canary in the coal mine, and before that, tobacco. let's talk about that chart, people think the light at the end of the tunnel, 50% of adults are vaccinated. it's really bad in india right now. brazil looks like they're past the peak and coming down. but i've been thinking about afghanistan, we're going to pull our troops out. and the level of resources we marshalled in response to 9/11, it would be good for us, morally, strategically, diplomatically, and public health-wise, to throw a lot of our resources into vaccinating the world. >> and our economy can only go high up before it plateaus again. we can't do business with africa and latin america. we're going to be looking at six or seven countries that are fully vaccinated. and that's why we're trying to accelerate a low-cost covid-19 vaccine that could be given to large populations at low cost. we're partnering with a company in india, making a billion doses. looking great in trials. and there's no end to where we can scale that up. we need the u.s. government to help us, and they'll make about a billion doses in india. if we can get the u.s. government to make that other 4 billion, we can do this. $1.50 a dose, you can't beat that. >> and we did a podcast talking about the complexities. dr. peter hotez, always a pleasure. thank you. that is "all in" on this monday night.
