getting americans back to work vital for the economy, but to get back to work you need a road to get there on, fueling the administration's push for congress to pass its infrastructure plan which new polling shows a whopping 60% of voters support. the morning consult shows support for biden's american jobs plan like modernizing highways and roads and funding for caregivers are supported by even higher margins. what americans say they want does not appear to matter to the gop. the grand ole party with a former president won't even give them his name to put on a t-shirt. with or without trump's name to use, republicans have his legacy to pull from, stoking culture war after culture war. this weekend in florida, it is a who's who of gop lawmakers and donors for the rnc's spring retreat. a revival aimed at seeking unity within a party now largely defined by being divisive. the man who helped cement that image, former president will headline this weekend's event. it is all with an eye toward 2022 and in some cases, 2024, and so we start with the question tonight of what could win? full outrage or real efforts to move america forward? joining me now california congressman qana. if the gop shows no reason toen ga ij in serious policy, where does that leave democrats? >> alicia, where it leaves democrats is doing what the american people want. as your show pointed out, infrastructure, child care, these are extremely popular programs that have supported democrats, republican, independents, expanding broadband to rural america. the president's priorities have broad support and we're going to get them done. ultimately, that's what matters. a new morning consult political poll found the majority of voters support the infrastructure plan that you were just referencing over republican lawmakers are complaining the scope of the bill is too wide because it includes things for broadband access, housings and what will it look like for this bill to make it through congress, congressman? >> i'm happy to have that debate with republicans. are they really saying that broadband access to rural america is not infrastructure? are they saying that the smart grid and having new energy is not infrastructure? are they really thinking that we shouldn't prepare for a modern economy? they will not win that public debate. i believe that this will pass. as the president has said, he's hopeful that republicans will see the light, see the polling and support these measures, but if they don't we will support it and pass it as democrats, and that is unfortunate, but we have to get this done for the american people. >> president biden signed an executive order to study reforming the supreme court. what are you hoping arises from that commission and does expansion of the court seem possible given the political climate? >> well, i really applaud the president for keeping his promise and he said he would do this in the campaign. he's delivering on that key campaign promise and i think that what we ought to have is term limits for supreme court justices and i've had a bill calling for term limits, 18-year terms for supreme court justice and then making those serve on a circuit court. i believe that is constitutional and can solve this issue without being ideological. >> congressman khanna, how do you embrace pore progressive policies? there is a push to include more progressive elements while also maintaining the sense that democrats as a party, are very much in array, if you will? >> alicia, we can do both. for example, i'm working with schumer up to a billion dollars for industries of the future with senator todd young and representative gallagher. that's something that we believe will pass. that's a bipartisan bill that has broad support in the caucus. at the same time i'll be chairing a committee to make sure we don't have fossil fuel subsidies and that's a key priority supported by americans and it may not have bipartisan support and what we have to do is look for bipartisan support where we can get it, but not always expect it and do what we believe is right to build this country for the 21st century. >> congressman ro khanna, thank you for being our guest tonight and it seems your own camera person. i really appreciate your time. with me now is eli stoeckles, "the los angeles times" reporter, and author of the washington post power up newsletter and msnbc daily. haze, i'm going to start with you. wall street journal opinion columnist peggy noonan describes the republican party like this, she writes it is a badly divided party. it will have to work through a great deal. it can't keep existing only to own the lids, manipulate the distracted and plot revenge and manipulate those who spent the last few years on the wrong side. could the fixation of culture wars actually hurt them in the long run? >> yes. absolutely because as congressman khanna, saying there are things that are partisan, and small change in theory, and not the big, sweeping bills like the infrastructure plan that president biden and the white house are pushing, but there are things that could get done. what's stopping them is the belief that the second that you start working with the democrats and start showing that the democrats can govern you then lose any weight you have in the elections in the fall and the gop needs the voters they can get because of the shipping demographic in america and that's why you are seeing them pushing these culture wars and these divisive issues trying to stoke the flames that former president trump did during his time in office and they want to make sure those voters keep voting and they can't fwiend a way to counter the democrats' message except the fights and you see these bills to ban transgender youth from participating in the country. bills like this don't really help anyone. they don't do anything to help change people's lives for the better. instead it tries to weaponize these grievances and keep those voters going to the polls and it's an a nilistic strategy that's dependent on the strategy instead of helping people get things done in their lives. >> yeah. it doesn't help anyone, and maybe hurt some kids who want to play soccer. >> eli, earlier today kamala harris had an infrastructure bill and what it encompasses. >> we are expanding the definition of infrastructure. it's not even about roads and bridges or even about water and broadband. it's about care. the american jobs plan invests $400 billion into our country's care infrastructure. our human infrastructure. >> so eli, as we mentioned the majority of americans support the bill and republicans are against it and they seem to be stuck in this debate over what can be defined over infrastructure. talk about the message of both sides and you just heard congressman ro khanna there about how he would love to be in a debate with republicans over whether or not broadband in rural communities is in fact, infrastructure. what does all of that mean for any meaningful negotiations? >> it's hard because you have some democrats and moderates in the senate like joe manchin who are demanding this bill be bipartisan, and as hayes and peggy have point out, they're not a party of debate and they're a party of culture wars. it's short-term thinking and how do i avoid a primary? how do i get myself invited on fox news? how will i continue to raise money through my email list? that is all that's driving them and so it's hard for democrats who need to reach out to republicans to satisfy some democrats in the senate and who want the bill to ultimately be bipartisan because they're making it easier for them to pass it. it's hard because there's not anybody out there for them to negotiate with, and there weren't ten republican votes in the senate on a stimulus bill in the middle of the pandemic and it's hard to see them materializing on infrastructure. >> they're doing the exact same thing which is sending out the president, the vice president and pete buttigieg and all of the surrogates they got to explain what's in the plan to tell the american people how it's going to help them. they understand that communicating clearly about the benefits of what they're proposing is critical to maintaining and improving, expanding on public support and that is something that ultimately they think will be enough, maybe to put the pressure on joe manchin to go along, perhaps with the reconciliation vote that might get some republicans to the table. they think that they have to talk directly to the american people about the benefits of what they're proposing and if they do that successfully they might have more room to negotiate as this thing goes true congress. >> go out there and make it clear. at the same time that all of this is going on rgs, and they won't be forming a union following both sides. how does this unionization shape up on capitol hill and how does it comport with their attempts to rebrand themselves as the working class party and as i keep calling it faux populism? >> it's a good point, alicia. this movement in general provides republicans with the opportunity to go beyond negative partisanship and beyond corporate railing against cancel culture and actually present some ideas here and put some proposals on the table because we have really yet to see that so far from the minority party, but as you noted, the republican party is trying to cement their status as the working class party. however, they still don't support unions. this lawsuit that we saw on amazon, it does provide republicans with the opportunity to say, look, there's a distinction here between being pro-worker and pro-business and we might need to re-think how you in this country work and you have some republicans like marco rubio who are working on policy toward working like some new pro-worker platform. at the end of the day there is so much overwhelming support for the american public on this infrastructure on the enhanced background checks for gun control and pollsters are working with the biden administration on the policies they're putting them out and they're putting them out for a reason and they're extremely popular for the american public and that will catch up with republicans if they rhetorically tout themselves as the party of the american worker and don't get behind any ideas that are benefiting them at a grassroots level. >> yeah. that rhetoric runs out at some point. hayes, this weekend, republicans down in florida getting together with former president trump to discuss the future of the party. i take what eli said about how they are thinking short term, right? how do i make sure that i can continue to fund raise off my email list. how do i make sure that i don't get primary and there was also this. i want to get everyone's thoughts as former trump aide telling "the washington post." people in d.c. think donald trump is radioactive. the republican party has grown and it is because of donald trump's successes. to do that you do it at your own peril. i was struck by this. there were low-propensity voters and voters they had not seen who turned out for donald trump. is there a plan to try to re-turn out those voters. >> yes, and i think it is really fascinating that it is trump at the center of all of this because yes, it's true that outside of the beltway trump himself is less toxic, but it doesn't change the fact that it's much like trump himself and his brand is all very gilded. it's this very surface-level support for trump the person, trump the former president and trump the idea, really instead of the actual policies of what he's done and what he did in office and what he can do if he returns to power. you see the republicans go down to florida to cow tow to former president trump to harness his support in 2022 and 2024. the problem is nobody can replicate that and you can't build on top of a foundation, and you can't get any deeper with the policy like that. >> and so, i think that over time over the next year or two, he would say that president trump start to fade, but we will see what emerges from florida. i'm not that optimistic how this weekend is going to go, but it's it's good for my blood pressure. we'll see. >> i love how you make the disclaimer at the end. i've made a compelling case, but i could be wrong. we'll review the tape at the end of the year to see which comes to bear. thank you all so much. coming up, what we learned this week in the murder trial of derek chauvin. what to expect when the defense starts to make its case for acquitting the former police officer in george floyd's murder. plus the president's announcement this week addressing gun safety. what could actually come of these new rules against ghost guns? steak! choose better be better and now save when you order in the app. subway eat fresh. an army officer is suing two virginia police officers for holding him at gun point and pepper spraying him during a traffic stop in december. new video of the incident making rounds online shows the moments after second lieutenant karen nazario was pulled over while driving an suv he had just purchased in the town of windsor, virginia. the video provided by nazario's attorney shows police with their guns drawn and yelling at him to get out. confused, nazario is heard telling the officer he is afraid to get out of the car to which the officer replies, quote, you should be. police then used pepper spray before striking and handcuffing the army officer. the lawsuit alleges the officers threatened to add additional charges against nazario's career had he spoke out. they are in court, for illegal search and seizure, excessive force and violation of his first amendment rights. nbc news has reached out to the windsor police for comment and we have yet to hear back and we will continue to follow the story. >> key witness taking the stand in the trial of derek chauvin. the medical examiner who declared george floyd's cause of death. dr. andrew baker saying -- >> when we look at other contributing conditions. those other contributing conditions are not conditions that you consider direct causes, is that true? >> they are not direct causes to george floyd's death. they're contributing causes. >> in terms of manner of death, you found then and do you stand by today that the manner of death by mr. floyd was, and you still classify as a homicide. >> yes. i would still classify it as homicide today. >> josie duffy rice president of the appeal and frederick and gray stokes professor of law at new york university. she is also the faculty chair for the bierbaum. >> we heard from two other forensic pathologists and here's what they said. take a listen. >> things like that. >> when were you first licensed? >> may of 2020. >> would you tell the ladies and gentlemen of the jury a little bit about your educational background? >> so i attended medical school at the university of minnesota twin cities and then residency training at hennepin county medical center. >> and when did you finish your residency then? >> last summer. >> melissa, has the prosecution left any room for doubt about how floyd died when you look at everything that we have seen in the aggregate? >> they've tried to make the case very carefully that the underlying cause of george floyd's death was, in fact, officer chauvin's conduct and really, the defense, as i said before on the show has the easier burden to bear here. all they have to inject is some sliver of doubt in one juror to hang this jury essentially and officer chauvin will not be convicted. the prosecution has a much harder case to make, because they have to show beyond a reasonable doubt all elements of this crime including causation and they've done a remarkable job of hammering over and over and over for this jury that this would not have happened if officer chauvin had not compressed his neck by kneeling on his back and neck. >> they called several experts to address the drugs found in george floyd's blood and in his car. what did they share about his substance use that night and how well did they counter the defense's argument that his addiction led to his death? >> the prosecution provided, you know, was very straightforward about the fact that george floyd had drugs on -- that he possessed drugs that day and that he had been using drugs. i think that they made it very clear, however, that it was not the drugs that caused george floyd's death and it was directly the actions of derek chauvin. they brought in dr. tobin who had 40 years of experience studying the pum nol gee, studying people's lungs and how they breathe and demonstrated that it was actually the nine minutes of kneeling on this man's neck that killed him. it was not the drugs. >> melissa, among the star witnesses this week was pulmonologist dr. robert tobin and dr. tobin invited jurors to feel their own neck and almost the whole jury followed him, did so. for you watching, what did this moment mean for the prosecution? >> well, all good trial work is essentially good story telling and with the expert testimony of dr. tobin, you had someone who could explain very complicated physiological concepts to a lay juror in ways that would make it not only visceral for them, but easy to understand. so having them palpate their own necks gave them a sense of what this would have been like for george floyd and they will carry that into the jury room when they deliberate. so all of the other discussion of drug use and what not, what they're going to carry with them is the feeling of their own fingers on their neck and what that meant when dr. tobin walked them through what those nine and a half minutes were like for mr. floyd. >> melissa, police experts say chauvin used excessive force and some implied he was deliberately cruel. here's what lapd sergeant jody stiger had to say about the use of handcuffs. take a listen. >> the handcuffs were not double locked. double locked meaning that they were not -- they could continue to ratchet tighter as the person moved. >> were you able to hear what instances what you think what appeared to be rancheting from the body worn cameras? >> yes. >> from what i understand, your testimony you would inflict pain for the purpose of having the subject obey your command? >> yes. comply. >> what if there is no opportunity for compliance? >> then at that point it's just pain. >> melissa, how important is chauvin's motive for harming george floyd? >> i think this say big part of the prosecution's case, and it is, perhaps, i think an unfortunate one to some degree because as the clip that you played entering into the segment shows, we could be having a much larger conversation through this trial about the nature of policing in this country and whether policing and police tactics and procedures are actually necessary given what they are doing in the field, but it seems that the prosecution has made it a direct point not to put the police and their procedures on trial, but to instead focus on officer chauvin as a kind of rogue cop who has been trained to do better, but actually has not done better and certainly not in this case. so we could be having a broader conversation about whether pain compliance methods are useful in the field, but instead, we are having a conversation about this particular person whose characteristics and conduct was perhaps idiosynchratic and unorthodox. >> josie, you know part of the reason that i wanted to talk to you tonight, police officers are rarely convicted in this kind of case, but we've had the chief of police and several senior officers testify against one of their own. i wonder when you've made of this testimony and how likely these law enforcement witnesses are to change the outcome of this trial? >> look, it's extremely rare, right? that the blue wall of silence is broken, that police officers testified against their own, to your point, and i think that, if anything, it helps the prosecution's case and leads to a more likely chance that derek chauvin is convicted, although i still don't think it's a home run or slam dunk. to melissa's point, what i think this does is it further legitimizes the practices of police and frames derek chauvin as outside of the realm of what normally happens. when we see cases like this, day in and day out, right? why start here? >> first of all, let me say this is tremendous leadership from the president. a lot of us were initially frustrated in the early days of his administration that he was missing an opportunity toledo this issue and what we saw this week was just a tremendous step forward. these are important pieces because we've seen such a proliferation of ghost guns that are turning up at crime scenes overwhelmingly. we need to know, for instance, what's happening with gun trafficking across the country and another piece of this ensures that there's actually a report on what gun trafficking looks like from the justice department. so in terms of what his authority is, he went pretty far in doing what he could to make sure he is saving lives. >> senator manchin opposed to gun bills passed by the house last month. i want you to listen to what activist frank guttenberg whose daughter jamie was killed in the parkland massacre. >> you're either on the side of saving lives or you're not. let's start with senator manchin and let me remind him because he keeps talking about how he represents the people of his state. you know what? no, he doesn't. he ran to be a senator. his decisions have national implications and people die because of the things he does or doesn't do. my daughter died because of gun violence that was preventable. >> that's exactly rid. >> your message to senator manchin be? >> my message would simply be, you, senator, met with families in 2013 and 2012 who lost their 6 and 7-year-old children to gun violence. senator, they looked into your eyes and they asked you to work on this issue and our gun violence has only gotten worse. >> to that point, a lot of republicans point to bill clinton's assault weapons ban as a cautionary tale of what happens when they come to what they would describe as overreach on guns and the terms that followed, democrats lost more than 50 seats in congress and you're familiar with the history and the politics here, but that's over a quarter century ago?
