Please get off of me. I cant breathe. He cried for his mom. He was in pain. It seemed like he knew it was over for him. He was terrified. This was a cry for help. When i look at george floyd, i look at my dad. I look at my brothers. I look at my cousins, my uncles because they are all black. I have a black father. I have a black brother. I have black friends. I look at that and i look at how that could have been one of them. It didnt appear that any of todays Testimony Moved Chauvin who was in the courtroom. Witness after witness broke down on the stand wishing they had been able to do more for george floyd. It was difficult because i felt like there wasnt really anything i could do as a bystander. The highest power was there. I felt like i was feeling it. Genevieve hansen was on the scene and testified she pleaded to let her help mr. Floyd but was pushed away by one of the Police Officers. He said something along the lines of if you really are a minneapolis firefighter, you would know better than to get involved. Thats not right. I mean, thats exactly what i should have done. There was no medical assistance on scene, and i got there. I could have given medical assistance. Thats exactly what i should have done. The day began with donald williams. The Mixed Martial Arts fiter fought back tears when the court played the 911 call he made. He described exactly why he felt the need to make that call even with police already present. At some point did you make a 911 call . I did call the police on the police. Why did you do that . I believe i witnessed a murder. There were police there, right . There were police there. Why didnt you just talk to them about it . We just didnt have no connection. I spoke to them but not on a connection of a human being relationship. With me now is katy fang and mark claston. Mark, i want to go to you first. Let me play that 911 call. Hes a Mixed Martial Arts fighter. Here is his 911 call calling the police on the police. He pretty much killed this guy that wasnt resisting arrest. He had his knee on the dude neck the whole time. Officer 987. The man stopped breathing. He wasnt resisting arrest or nothing. That was in handcuffs. He was unresponsunresponsive. He wasnt resisting arrest. Im sitting with another off duty firefighter watching in front of us as well. She told them to check the man pulse but they wouldnt check the pulse. There was a lot of testimony to try to make donald williams, mark, look like he was somehow threatening to the officers. He was hostile. He said youre not going to make me look angry. He was angry as every one there watching somebody die in front of them. The other thing i want to play for you really quickly before i get your comment is he talked about having a conversation with officer tao who is one of the other officers there and the hostile reaction he got. Lets play a bit of the video shown in court about the bystanders and how they were treated. Bro, he was just moving when i waked up here. Do you have a pulse . Ive been watching this whole time. Im trying to tell you. Bro. Theres three of you guys. You should be able to multitask. As a former Police Officer, can you comment about this, mark. The other officers, including officer tao, seemed more hostile to the crowd who were outraged at what Derek Chauvin was doing than they seemed concerned about the man on the ground who they claim was a threat. There are two things over the past couple of days that really jump out at me and that is a lot of the attributes that people or Police Worshippers that ill call the Police Worshippers will attribute to Police Officers such as courage, compassion, empathy, integrity and humanity were only displayed by the nonpolice civilians on the scene. The Police Officers showed none of those characteristic throughout the entire interaction and that led to the death of mr. Floyd. What that is is the manifestation of something we have talked about before that toxic police culture. It was only the civilians that were acting as if they were professional, trained Police Officers. Point two is, we got an opportunity to see something that we took for granted or didnt realize and that is there are other victims of this killing. Those individuals, those brave men and women who witnessed, who were begging and pleading even feeling guilty about not taking the next step of physical interaction, intervening physically. Those brave men and women are victims and they will they dont have the opportunity to receive justice, if you will, in this particular case. Hopefully mr. Floyd will and his family will. Lets play Darnella Frazier. The kids, the under age people who testified were really moving. Here is Darnella Frazier who shot the video which we know is like 9 minutes and 29 seconds. Here she is taking questioning about whether or not george floyd was offered care. As you were observing there floyd under the knee of mr. Chauvin, did you ever see mr. Chauvin do anything to offer care to mr. Floyd . No. Did he ever either let up or get up so he could breathe . No. Did you ever see him try to administer cpr . No. Did you see him call anyone else to add minister aid to mr. Floyd . No. We talked yesterday about the most dangerous thing for the defense here is that after there was no pulse and after chauvin was told there was no pulse he still stayed on top of george floyd and continued to constrict his breathing. That testimony, what do you make of what you heard today . Well, it ties into what we heard in the Opening Statements for the prosecution. The idea that a Police Officer has a duty to protect but also to show compassion. As you recall during the Opening Statements, during the Opening Statement by prosecution, we heard the Mission Statement of the minute Minnesota Police department includes the idea of having the duty to care for citizens. Whats important for a legal per spect ef is theres a thirddegree Murder Charge that got reinstated and that has a lower standard of proof that the seconddegree unintentional murder and the seconddegree manslaughter charges. All the state has to prove for thirddegree is Derek Chauvin caused the death of george floyd through an act that is imminently dangerous to others. We heard lay people, eyewitnesss saying it was dangerous. He couldnt breathe. He didnt get off of him. He didnt give him help. We had firefighter, emt saying in her professional opinion it was dangerous. He didnt get off of him. We heard two different people today say, that they called the cops and george floyd may not have been able to testify on his behalf, we heard his voice through the videos that was power and through voices of those kids that testified and it was so compelling. Absolutely. Lets play genevieve. She was quite good. Do you think it would make your job fighting the fire harder if someone started yelling at you and telling you you were doing it wrong . Im very confident in training ive been given so i would not be concerned about somebody that was not trained to. What if they started calling you names . Like i said, i know my job and i would be confident in doing my job. Theres nothing anybody could say that would distract me. There struck me as one of the weirdest events that the people were distracting the officers for providing care. There were three Officers Holding down george floyd. There was only one officer trying to control the scene. If they were so concerned about the crowd, why was it three to one on plp floyd and not three to one on the crowd . That didnt make sense. Did it make sense to you . Didnt make sense to me at all. This defense is throwing the everything up against the wall seeing what sticks. What it did display not only did the Police Officers not live up to their duty to care for mr. Floyd. They rejected the offer of assistance by a person who claims to be a professional health care person. They are just tripling down on their negligence in this particular case and it will really come out later on about their liability in regards to the death of mr. Floyd. Its clear as both sides have said, primarily the prosecutors have said the video speaks for itself. It is very difficult i will say its hard to convict Police Officers even when it seems like obvious that what they have done is wrong. We just had case there week where an officers were acquitted for beating up another officer who was under cover. He was covering and videotaping at a protest, at a black lives matter protest. The other officers beat limb to the point he needed surgery and they still didnt get convicted. Its very hard. From what you saw today, ive never seen a case like this with this much compelling evidence from young people, from a firefighter, professional that was so damning. Ive never seen anything like it. Does this seem like a sort of separate case against mr. Chauvin . Well, listen, we have to strap in for a long ride. This is just day two. Theres going to be a lot more witnesses and the reason we heard the Defense Focus on the crowd is they koultds not go after the individual witnesses today. They were minors be p they were women. They were breaking down. You couldnt do that. What you do is go after the collective crowd. Remember, in the Opening Statements for chauvins defense, they said, lets not make an emotional decision. Lets not make an emotional decision. Lets listen to the evidence. What nay will say is they will wait for their day in the sun which will be the medical testimony, the Expert Testimony and the no excessive use of force. They will try to tell the jury, which shay have done, we need you to make a decision based on common sense, logic and reason. I happen to no Katangee Brown jackson. I think shes wonderful. I knew her in college. She made it to the top three. They were the top three choices for the scotus and president obama chose garland. Theres a lot of people disaappointmented. I was one of them. All of this drama played out with Merrick Garland being sort of humiliated by mitch mcconnell. They wouldnt meet with him. Look at karma. Hes Attorney General and that opens the door for Katangee Brown. Tell us about her. Any of those three would have been great jurists and she would be great Supreme Court justice. She brilliant. Shes got a deep soul. Shes a great writer. Shes collegial. Shes going to fit in well on this new court, the d. C. Circuit. I think there are other people in that league. I dont think we should write them off. Theres other people too. I think what the president did here is say, here is a great person for our nation second highest court. She should go up today and alone with this other rich, diverse, competent slate of nominees. This is just really incredible day. Im just looking at some of those folk. The idea of somebody like her plus Sonya Sotomeyer changes the way the court would look. Theres a lot of other great people. There arecunningham. Theres kansas jackson nominee for the u. S. Court of appeals. You can go down, theres judges with different background and religions. In your view, what difference does that make to jurisprudence. Here you have people who led all different walks of life. Our very first muslimamerican judge should he will confirmed. Will probably have a different set of experiences than a lot of the trump nominees, to put it mildly. Youve got incredible the 7th circuit judge. Since march of 2020, there have been more than 3,700 hate crimes against asianamericans in this country. We have seen 150 increase in hate crimes against the Aapi Community. Were seeing violence and mayhem targeted in the most disgusting, unimaginable ways happening just in front of businesses, on public streets, riding public transit.
