Continues. By now youve heard about the extreme measures taken by republicans in georgia to severely limit voting access in legislation that haer harkens bo the jim crow era. Make no mistake, this bill will directly hit the black voters who make up roughly onethird of the states population and who help democrats win the white house and seize the majority in the senate. True to gop form, Georgia Governor Brian Kemp mocked the idea that the bill was racist. According to them, if you support voter i. D. For absentee ballots, youre a racist. According to them, if you believe in protecting the security and sanctity of the ballot box youre a, quote, jim crow in a suit and tie. You might be thinking, brian kemp cant touch me or, i dont live anywhere near georgia. But with 253 restrictive voting bills introduced in 43 states, georgias new senator, Raphael Warnock, says think again. If you think that this is something happening down in georgia, you are misapprehending the moment that were living in. If you think that this is something happening to black voters, you still dont quite clearly understand. This is a defining moment for the american democracy. If this is happening in the State Capitol in georgia, it will not take very long for it to visit a State Capitol near you. Joining me now is la tasha brown, cofounder of black voters matter, ari berman for mother jones and the democratic Lieutenant Governor of the great state of michigan, garland gilcrest. Thank you all. Ari, im going to start wide and start with you. Have a listen to what senator cruz had to say about hr1. This bill is the single most dangerous bill this committee has ever considered. This bill is designed to corrupt the Election Process permanently, and it is a brazen and shameless power grab by democrats. They do this by instituting a bill that will promote widespread fraud and illegal voting. Okay. So ari, i wanted to play that and get the conversation going about hr1. The for the people act. One, respond to senator cruz, but more specifically in your answer, talk about how hr1 could impact what just happened in georgia, visavis, the Voting Rights law there. Well, the amazing thing, jonathan, is that senator cruz is accusing democrats of doing the very things that republicans are doing. Exactly. Its republicans that are doing the massive power grabs right now through massive Voter Suppression. And hr1 would stop these kind of things by putting in place provoter policies like automatic voter registration. Election day registration. Two weeks of early voting in every state. Restoring Voting Rights to people with past felony convictions. Expanding mailin voting. These are extremely popular policies. Hr1 as a whole is supported by 68 of voters. Individual provisions in hr1 are even more popular. And the system worked in georgia. The system worked in other states. It was republicans that put in place automatic voter registration. Early voting. Expanded mailin voting in georgia. And only when democrats started using these Voting Methods, only when black voters started turning out in record numbers. Only when black senators, jewish senators were elected did they change the entire voting law in georgia. The only thing that changed from 2020 was that democrats used the Voting Methods that republicans wrote. Now theyre panicking and trying to change the entire Election System because democrats won one or two elections in a state changing very, very quickly. Ari, one of the reasons why georgia is changing very, very quickly and that all those people got out to vote in 2020 is because of the woman who is right next to me in the boxes there, la tasha brown. La tasha, i would love for you to lets put up, im sorry, element two, which talks about, how georgia voters feel about this measure that was passed. Look at that. On all of these things there, in the 70s in terms of opposition to stripping authority from the secretary of state. On local officials. Criminalizing giving food and water to people standing in line. Latasha, given all the work that youve done and all the work that you are continuing to do, still doing, your feelings and reactions about what georgia has done. Its really interesting. Even as we look at that poll and the numbers, that also includes republicans. What that says is, in the state, theres no appetite for what were seeing. This is brian kemp and a small group of folks who are predicating this whole law on a lie. Predicated on the trump lie. And i think out of a sensef desperation because i think you saw the numbers of what happened last year. Many of the voters in the state of georgia are going to remember what he did in 2018, and so this is a desperate attempt by a small group of people to really be able to hold hostage the democratic process. You know, what is so egregious about this is that not only is it racist. Not only is it antidemocratic, but this is something the people of the state dont even want, right . And they are pushing it forward. When you look at some of the laws theyre doing, theyre not only making it difficult for voters, but theyre also attacking organizations. Theyre criminalizing giving water and snacks to people that are on line. There are some folks on line as long as 11 hours last year. And so to be able to provide some support for a problem, a real problem that exists that they are not addressing. And so i think fundamentally what were seeing is this is an attack on our civil rights. This is an attack on democracy. I want you to listen to what President Biden said at his Press Conference when asked about georgia. Have a listen. Is there anything the white house can do to protect Voting Rights in georgia . Well, were working on that right now. We dont know quite exactly what we can do at this point. The Justice Department is taking a look as well. My apologies there. Thats not at the White House Press conference. Thats at joint base andrews. Latosha, do you want the Justice Department to get involved in some way, if they can, to push back against the georgia law . Absolutely. I actually think theres a clear path for the Justice Department to get involved in this. This is, when you are looking at, this is unconstitutional. Thats why we placed a lawsuit around amendment 1 and 14 that fundamentally, this is a quintessential purpose. What were seeing right now is this is jim crow revisited. This is exactly why the Voting Rights act of 1965 was passed. And this is not only just the Justice Department, but we need congress. As senator Raphael Warnock said, we need congress to pass the bills so we can pass hr1 and hr4 immediately to have extended protection. Lieutenant governor gilcrest, michigan, as i said at the top of the show, if you think that whats happening in georgia isnt going to happen to you because you dont live in georgia, you live in another state, think again. Whats going on in michigan . Well, thank you for having me on. Republicans in michigan, they felt a little left out. They decided to introduce 39 of their own bills that are aimed at really suppressing the vote in michigan. The record Voter Turnout in michigan that led to joe biden winning the state and reelecting senator peters. It terrifies republicans. They are working to do everything they can with their legislative power to try to make it more difficult for michiganders to vote because republicans are afraid of voters. Theyd rather assault and kick voters in the teeth than opening up the democratic process which is what leaders like Gretchen Whitmer and i are going to do. The biggest difference between michigan and georgia is elections do have consequences. And voters in 2018 elected governor Gretchen Whitmer and myself. We also voted to expand Voting Rights in a way weve not done in a generation, which is what led to voting being more accessible and safer during the pandemic. Republicans are so afraid of that that they are working to suppress it. But we can stand tall against it in michigan because weve elected a democratic governor in our state and well never support legislation like this. The Lieutenant Governor, speaking of the governor, governor Gretchen Whitmer who everyone knows about because the vp search, but also because of the plot against her life. If you see there on the screen from the Washington Post, michigan gop leader calls Top Democrats witches. Jokes about assassination of republicans. The governor, the Attorney General and one other State Official are the witches hes talking about. What does that do to the tenor and tone of the debate in your state . Unfortunately, its been like this since at least april of last year when we saw armed gunmen storm our capitol. That was their practice before january 6th to try to blow up the building that i work in every day as the president of the state senate. And the leader of the republicans in the senate of michigan has been making misogynistic and hateful comments toward Gretchen Whitmer for months, talking about how he wants to punch her in the face and spanking her and things like that. This is par for the course for republicans. The fact the head of the Michigan Republican party would choose this violent, dangerous and deadly language, the language that weve seen lead to literal Assassination Plots on elected officials here in michigan is unacceptable. I think the voters of michigan and voters around the country need to recognize that republicans are dangerous for democracy. They are just dangerous. Its what they are. Its what they choose to do. Its how they speak to one another and how they speak in public. Latosha, i want to end with you. By now, everyone has seen this clip. But i want to play it again and get your reaction on the other side. Everyone, watch. Why am i under arrest . There is no reason to be arrested. I am a legislator. Do not touch me. I am not doing anything. I am literally not doing anything. Georgia state representative park cannon, an elected official in georgia, just trying knocking on the door of the governor. Latosha . It infuriates me. First of all, she was knocking on the door. Shes an elected official. She was knocking on the governor of the governors office. Hes sitting under a picture of a plantation where literally hes flanked by six white men. Like how disrespectful . How racist, just that image alone, i think its indicative of whats happening in this country that theres a small group of white men who are fearful of this coalition that is rising, being led by black women, communities of color, righteous white folks, asian people, indiggis in people that they understand theres a new coalition coming together thats going to stand for democracy, and were going to remove them out of office. Its a tragedy of what we saw and witnessed right before our eyes in 2021 to see this woman, who is an elected official, being dragged out of the capitol for no reason at all. Ari berman, last question to you. What happens if hr1 does not become the Law Of The Land . This is a do or die moment for democracy, jonathan. If democrats dont pass the for the people act if they dont pass the john lewis Voting Rights act, republicans will undermine democracy for the next decade and Voter Suppression in states like georgia will be the new normal. I cant overstate how important this is for democracy to pass these voting reforms. We either have democracy or dont have democracy. This is the choice before america right now. The filibuster at the end of the day is about Minority Rights in the senate. How are you going to insist on protecting Minority Rights in the senate while refusing to protect Minority Rights in the society . It all comes down to the filibuster. The antiquated senate rule threatens much of the change President Biden was elected to deliver, and that the moment demands from the for the people Voting Rights bill which would preempt much of the new jim crowstyle Voter Suppression in Georgia To Gun reforms passed by the house. Joining me is senator jeff merkley of oregon, a member of the senate rules committee, and the lead sponsor of the for the people act, known as hr1 or sr1 now that its in the senate. Thank you for coming to the sunday show. Youre welcome. Great to be with you. So the conversation has been, blow up the filibuster, talking filibuster. What do you propose . Well, i have been meeting with all the members of my caucus to say we have to collectively find a path around the filibuster. I dont like to call it a filibuster because that means people have to speak and hold the floor. This is simply a minority veto. A veto held in the hands of Mitch Mcconnell who can prevent you to have 60 votes to close debate, even though theres no debate going on, on the floor, and the result is hes intent on overruling everything that democrats do to try to make our world work better from health care, housing, education, living wage, jobs but also the reform of or the protection of the ballot box across america at this crucial time. Okay. So you are having all these conversations. Are you getting any closer to getting a bill getting a consensus to actually revise the Filibuster Rules . To make talking filibusters the rule for the senate now . Jonathan, theres been a Massive Movement in the caucus. And that is because theyve seen Mitch Mcconnells delay and obstruct game before. Because they know theres so much at stake. The voters of georgia delivered a majority. We now have the responsibility to govern. Whether we do this by changing how reconciliation works, which is an existing simple majority, whether we do it by carving out constitutional issues, whether we do it through the talking filibuster, whether we can do it by simply opening the floor to amendments and saying republicans, you use your 60vote blockade, which was designed to be used extraordinarily rarely. If you use it well then act. Any of those are possibilities. The key is 50 of us have to be in the room. I think were close to that vision of everyone being on board, but not quite there. Its a big change, and were working it hard. In the last block, during the interview that i did in the open of the show with ari berman, he said passage of hr1 is a, quote, do or die for democracy. Do you agree with that . Absolutely. The ballot box we have fought over since the beginning, and our original constitution was flawed in the sense that it blocked individuals from colored communities, those from Native Americans, women from voting. It had all kinds of restrictions. We have fought over 200 years to recognize that every citizen should have the ability to participate. The game thats going on right now is republicans know that election day can be easily manipulated. You can reduce the number of polling places. You can understaff them. You can change their location. You can put out false information about where they are. You can restrict the voting hours. And so, therefore, they are saying, lets vote only on election day so we have these tools to block people from voting. Democrats are saying, no, that is absolutely unamerican, unpatriotic, not in sync with our constitution. Were going to protect voting which means to avoid that type of manipulation there has to be early voting, vote by mail, none of these shenanigans. And the what will happen, and if we do not make these changes, is the restrictions will be aimed at our black american community, poor communities, Native Americans and College Students because thats what weve seen the targets are. Its a continuation of the very racist strategies of the past. And so then, final question to you is, if sr1 as its known now comes to the floor in the senate and it doesnt survive a filibuster, would that be the tripwire for you to push really hard and say the filibuster now has to be reformed so we can get this passed . Yes or no. Im already at the point of saying it has to be reformed. By the way, every democrat that was in the senate in 2011 who was present for the vote, voted for my rule for the talking filibuster ten years ago. So weve had a decade to ponder how this reform would get these silent, invisible noshow blockade that Mitch Mcconnell has. Senator jeff merkley of oregon, thank you for coming to the sunday show. Yeah, if you read my recent piece in the grio, jonathan, you know that i laid it out that i think we have to, at the very least, reform the filibuster. Look, Mitch Mcconnell went on record as you know two weeks ago and said that the filibuster had no racial history. Thats utterly preposterous. John c. Calhoun, south carolinas owner senator, used it during the debates leading up to slavery and into lincolns presidency and until we got through the civil war to stall any types of efforts around slavery and eradicating it, doing anything about it. And then we move all the way through Woodrow Wilsons presidency, jonathan, and you see that the jim crow which starts ulysses s. Grants presidency through Woodrow Wilson where these laws are passed, antilynching bills shot down, any Civil Rights Bills are shot down. Anybody says that the filibuster doesnt have racial connotations does not know history at all. Speaking of antilynching bills, the emmett till antilynching act, which senator thensenator Kamala Harris and senator cory booker were trying to get through the senate. That Got Filibustered by senator rand paul of kentucky. Absolutely right. That was, i thought, a really awful moment in this republic that rand paul, who prides himself on being a libertarian republican, but i think hes an obstructionist, frankly, that he was able to block that. And you saw how upset thensenator harris now, Vice President harris, was. We were in shocked a senator in the 21st century wouldnt understand that passing Something Like antilynching legislation would be so important to codify that. But he did what he did. Sophia, im going to be talking about this in my byline so i dont mean to give it away, but i want to ask you this question. What do you make of this choice thats out there, that democrats have to make. That if you blow up the filibuster, Mitch Mcconnell says, oh, watch out. All hell is going to break loose. On the other hand, if you dont do anything with the filibuster, President Bidens agenda isnt going anywhere. When it comes to that, which choice do you make . They can use the Reconciliation Process as you know, but heres the thing. Heres my advice to democrats, as someone who was a republican for 25plus years. Stop being afraid of Mitch Mcconnell. Hes not afraid of you. You need to do what you need to do in order to get this president s agenda through, to get infrastructure bills, health care reform, any type of other things we need to do. I dont think you ought to get rid of the filibuster, jonathan, but you have to radically reform it and civil rights and Voting Rights are going to be drastically impacted if we dont do something about it. Joining me now is Zerlina Maxwell and dan balz, chief Political Correspondent at the Washington Post. Both of you saw the first half hour of our show. What are your thoughts . Look, i think ari berman, hes so good on the issue of Voting Rights, obviously, with his extensive reporting, but the death of democracy line stood out to me, jonathan, because i think thats just factually correct. What you see happening across the country is a response by republicans to the changing demographics in the country. They are looking towards the future, and, frankly, the present, and theyre not seeing an electorate that is favorable to them. So instead of coming up with policy ideas, maybe a platform, maybe being a little less racist so that you can perhaps attract some people of color in the republican coalition, they have decided to block those folks from being able to access the ballot easily. And i think that, you know, the filibuster is an important conversation in this moment because if you can veto the will of the people, you dont have a democracy. And so hr1 and hr1 4 are essential to protecting the ballot for communities of color who historically sophia was so right on this. That history of south carolina, john calhoun, strom thurmond, 24 hours filibustering the Civil Rights Bill of 1957. This is a through line in American History. This is essentially not a new version of jim crow. Its just jim crow. Youre right, zerlina. Dan, your thoughts . Well, jonathan, i am struck with all of these conversations, the degree to which this country is still so divided over a fundamental issue about voting and voting access and Voter Participation. We can see at the federal level, democrats pushing in one direction, which is to provide, in a sense, a kind of uniform set of standards for Voter Participation and voting in the states. And republicans, as a result of what had happened postelection frankly, not necessarily just in the election but postelection and former President Trumps lies about what happened, are trying to go back and in one way or another restrict. Now theres debates over fine print over both sets of legislations, including whats in the states and whats in the federal legislation. But this debate, at this point, seems to not have any ability to get to any kind of consensus or compromise on it. Which takes us back to the issue of the filibuster. And i think that your interview with senator merkley was quite clear that the democrats are going to have to make a choice at some point during this congress, and probably sooner rather than later. I dont mean in the next week or two. But theyll have to make a choice about what theyre prepared to do and how far theyre prepared to go to try to alter the filibuster. I dont think its in the cards at this point to get rid of it, but alter it in order to get the agenda that the president is pushing through the congress. The other great line that was said in the first half hour of this show just came from Sophia Nelson when she said, democrats, dont be afraid of Mitch Mcconnell because Mitch Mcconnell isnt afraid of you. Id love for each of you to give your reactions to that. Zerlina, you first. I agree with sophia. Dont be afraid of Mitch Mcconnell. No. The people are on the side of the democrats in this particular instance. Specifically in terms of the popularity of many of the proposals that are being considered. You know, 68 of americans support hr1 and want to see it become the Law Of The Land. Just because republicans are standing in the way of the popular will of the people doesnt mean democrats should not use that popular will to facilitate the policies that we want. The American People voted in the election to get Joe Bidens Administration to do certain things. First with covid relief, making sure that folks got their 1400 checks, but next is ensuring that we have the ability to effect our government. If were not able to access the ballot easily and make our voices heard, then i dont know whats left of we, the people. Dan, real quickly, talk about the wiliness of Mitch Mcconnell. Theres a reason why sophia gave that admonition to democrats. Well, he is a legislative tactician, par excellence, and he has used the rules of the senate over many, many years to frustrate the democrats, time and again. But i think theres one point thats worth remembering, and its not original to me. It was written by our colleague ruth marcus a week ago about the filibuster. If you get rid of the filibuster, in this congress, it allows the democrats to do the things they want to do. But if in a few years you end up with a republican president and a republican congress, even with the narrowest of majorities, those things can be undone. So i think thats the reason that the debate over what you actually do about the filibuster is so difficult. I mean, i think senator merkley was correct which is that there has been movement within the Democratic Caucus in the senate. I spoke to a former senator who said hes not sure its quite there yet but he thinks things are moving. But well see in a few months where things actually are. We will see. And i really sort of feel i owe it to them. Theyre great people. Theyre doing an incredible job. Mr. President , when do you think that you would go . When do you think you would go to the border . Over the next couple of weeks. The Border Patrol wants me to go. Come on, man. Of course, in trump speak, next couple of weeks is the equivalent to half past never. Whether he goes or not, the former president is already firmly immeshed in the Immigration Debate as republicans are still pushing for his border wall and cruel immigration policies. The parties are as deeply divide as ever. But yesterday, a bipartisan congressional delegation toured a Detention Center in el paso. Congressman Veronica Escobar led the delegation and tweeted that conditions there are, quote, unacceptable and heartbreaking. Joining me now is that congresswoman. Congresswoman Veronica Escobar of texas. Thank you for coming to the sunday show, congresswoman. Thank you for having me. I really appreciate it. So, i first, tell us what did you see on your tour yesterday . You know, ill tell you, jonathan, ever since 2019, my first year in congress, i have made a concerted effort to bring as many members on a bipartisan basis to see whats happening for themselves and to talk about solutions. In 2019, i brought nearly 20 of congress to el paso. And we just started up again with our first bipartisan trip this the last couple of days. Unfortunately, it feels like were seeing the same things over and over again. We see, you know, a number of vulnerable people. This year, its children who are in conditions that are unacceptable because they are in Border Patrol processing facilities which are not intended to hold people for long period of time. Especially not intended to hold children. I see stressed out Border Patrol agents and a concerned community. And hhs facilities that are the appropriate place for kids that are ramping up as quickly as possible. So i im sorry . Finish your thought, and then i have a question for you. I saw some improvements from 2019. There were some seriously unsanitary, unhealthy, horrific conditions in these facilities. And i tweeted out photos. I wanted folks to know, while this is absolutely unacceptable, we are at least now providing clothing and shoes, toothbrushes, showers, clean clothes, two hot meals a day, you know, as opposed to 2019 where agents were going to like Convenience Stores to buy frozen burritos and warming them up in tiny microwaves. So there are improvements that were made as a result of our supplemental bill, thanks to the work of congress, but we still have a lot more work to do. From what i understand, sources tell me you had a call with Vice President Kamala Harris. You didnt call her. She called you. What was that conversation about . It was incredible. She reached out to talk through part of what i wrote about in my New York Times oped about the fact that our crisis is not necessarily at the border. Yes, this is where we are seeing the consequences of whats happening. The real crisis is outside our border and requires a real significant effort to get to the root causes of migration because if we dont do that, this will never end. Well keep talking about this year in, year out. Ive been speaking to people in minneapolis who think the trial should lead to a conviction, which would be some form of just nice the death of george floyd and larger reflection on policing in america. Others look at this and say its difficult to convict a Police Officer of the killing of a person, in particular, a black person. It typically hasnt happened in america. What the defense is going to point out is that the along with his preexisting Heart Condition could have contributed to his Preexisting Condition rather than Derek Chauvin being on neck. The issues are George Floitd was seen on camera pleading for his life. Asking them not to kill him and saying i cant breathe there were onlookers of videos of people asking to check his pulse. Derek chauvin did not rise up from being on his neck after it seemed george floyd was unresponsive, even after emt technicians arrived on site. So thats what this is going to come down to. Not necessarily chauvins conduct but did Derek Chauvin having his knee on george floyd, not offering aid or assistance, contribute to or cause George Floyds death . Ultimately, thats what the defense is hoping they can create doubt in at least one jurors mind that it was fentanyl or a heart issue or Something Else that caused george floyd to die, not Derek Chauvin. Thats what this is coming down to. The people i spoke to here who are looking for conviction in this case, jonathan, were saying they cant conceive of or think about if hes not convicted and what hurt that is going to create and reopen here in minneapolis and across the country. The medias reaction to how he fared was a mixed bag. Some deeming it a success and others calling it a failure. However, as much as thursday was a test for President Biden, it was also a test for the journalists covering him, especially as biden gears up to tackle another big item on his agenda this week, a 3 trillion economic and infrastructure plan. Joining me now to discuss is pbs News White House correspondent who was at the Press Conference, margaret sullivan, Media Columnist for the away post, and eric bullard author of press run media. Thank you so much for coming to the sunday show. Margaret, you had a piece in the Washington Post headlined bidens News Conference is a test for him but a bigger test for white house reporters. All right. Weve seen the Press Conference. What grade would you give the press . I dont like to give grades but thank you so much for having me. An assessment . I was disappointed, certainly, you know, seriously disappointed that so much of the Press Conference was concentrated On Immigration Issues and didnt get to some of the really crucial issues of our time, specifically questions about the pandemic. I thought that was a real failing. Its not that any of the particular questions were bad or shouldnt have been asked but the sort of concentration on it to the exclusion of anything else not anything else but almost Everything Else was disappointing. You were in the room among the many reporters who were in the room. Take us take the viewers inside. How do you prepare for a Press Conference like that . You prepare a president ial conference by thinking about the issues americans are facing that are in the news but also by thinking about what are the hardest challenges this administration is facing. What are the things the president or his aids havent been wanting to talk about that you can press the president on. So the questions i asked were related to immigration. The first on the idea theres a perception, the idea that republicans and some democrats are saying that the president , his decision to act in a legal way to allow unaccompanied minors into the United States following u. S. Law that somehow is creating this crisis, this challenge at the border. I know the white house doesnt want to call it a crisis. So theres this issue. And the others you asked about is Voting Rights and the idea republicans in at least 43 states, of course, georgia having just passed theirs, they are literally trying to change the way americans across this country can vote and getting more power to State Legislatures which are, of course, politicized. In some ways, those are critical issues. Immigration is going to be a big challenge for him and the way he deals with the Voting Rights issues. It could imperil his Reelection Campaigns and democrats all over this country and, of course, africanamericans because democrats are saying its the new jim crow that republicans are trying their best to prevail the access to voting to africanamericans. And a follow up to you, one of the things at least saw on twitter people were just sort of debating about or asking, hey, you know, follow up on so and sos question. Follow up on that persons question. Again, take us inside the room before the Press Conference happens. Do reporters get together and talk and say, okay, if you ask that, i will follow up. No. Reporters do not do that. I dont go to my colleagues and say what are you going to ask. I need a follow up. I think as a reporter, you want to follow up and listen to the president. If he says something that is interesting or you thought you want to follow up. Two reporters after referenced my question about the filibuster. Its swampy legislative issue, it is also the issue that will stand in the way of democrats, if they want to pass big reforms on civil rights or on Voting Rights. I think you saw people reference that and something i think the media heard a lot and why not follow up on your colleagues questions. I think during the Press Conference you saw that. You saw it during the former Trump Administrations Press Conferences where i would follow up on other peoples reportings and said, hey, the responsibility, mr. President , but you did close the office on the pandemic. That was one of the follow up questions i asked President Trump when he was in office. Right. Eric, there was one question asked at the Press Conference that, umm, made me lose all my hair. Have a listen. Have you decided whether you are going to run for reelection in 2024 . You havent set up a Reelection Campaign yet as your predecessor did. My predecessor needed to. My predecessor, oh, god, i miss him. No, the answer is yes, my plan is to run for reelection. Eric, the president s term is 1,461 days. I think he was at day 65 around there. Your reaction to a question being asked about the president running for reelection . So soon well, i think it was a clearly an attempt to create news. Look, were in a different environment now. This is the antitrump and that Press Conference proved it. Its not a pathological liar. Its not a malignant narcissist. This is not a president who feels he has to insert himself into news cycle but every hour. I think the d. C. Press is trying to adjust to a kind of no drama obama approach to the presidency of biden. So are you going to run for reelection again . Well, lets create news. Actually, that question was asked twice, if im not mistaken. There was a follow up to it. It wasnt really that important. Look, i think back to the question about immigration that, you know, margaret mentioned so many questions, the problem for me is we take a step back, you know, its the d. C. Press looking at the news through the prism of the gop. Republicans dont care about covid today. Republicans dont care because biden is posting success after success after success. Hes taken a Vaccination Rollout that was a National Embarrassment and turned it into a model for the world. What are republicans angry about . The border or so their theatrics say. He got a lot of questions about the borden. I think the other problem is the prePress Conference trying to turn the fact that biden into a two week news story when he was dealing with a pandemic and insurrection and Impeachment Trial and passing 2 trillion Spending Bill by a single vote. I dont think it was a big deal he had hadnt a Press Conference yet. There was a lot of weird Media Coverage the two weeks before about, you know, is he hiding or, you know, and that, again, it was in collaboration with the Republican Party. Fox news had a countdown how many days until Bidens Press Conference . The good news, theres a respectful, professional, working relationship between the white house and the press. There hasnt been for four years. Its good for our country and democracy. Lets keep on improving on that. Margaret, if memory serves, in your column that i referenced about, you know, the biggest test being for reporters, i think you didnt you mention, umm, say please dont waste time on asking whether hes going to run for reelection . If you didnt, if my memory failed, i would love your reaction to that question being asked. Thats a media critic. I dont know if i did get into it but i agree with eric its not on people i dont think its on americans minds, at this point. While the Press Conference just have to be top of mind for americans, i think that was, as he put it, you know, its an attempt to generate news. Political news. I didnt think it went particularly well. I mean, its no surprise he would say i expect to run for reelection. I would have Kamala Harrison harris on the ticket. Its a limited amount of time and i think it should be just used in a much more focussed and beneficial way. And yet, yamish, this drove me crazy about the president hasnt done a Press Conference yet. The White House Press secretary has been doing Press Briefings every day since inauguration day. I watched them. I see you sitting there. I would love for you to talk about the importance of the Daily Press Briefings in relation to those big, you know, fornational Television Moments like the Press Conference we saw on thursday. Theyre important. I think the Daily Press Briefings jen psaki is doing and the threetimes a week covid white house briefings from the actual scientists are important. I get a lot of my questions about equity, about covid, Vaccine Access answered. I would say i get a lot of access to people who talk to me on background about the pandemic. I think theres a lot of real robust interaction with the media that this administration is definitely doing. I think it doesnt mean you can also not think its important that the president himself should be answering questions. I think its incredibly important for the president to take the time to answer questions in a calm way where were not rushing in and out of the room. Were not talking over helicopters but able to ask questions and ask follow up questions and just talk to the president in a way that feels like hes given some time to really answering the American Peoples questions. I think both can be true. I think at the end of the day, were seeing a more respectful back and forth administration. As a point of personal privilege, its wonderful to watch a president ial Press Conference and not see you being attacked by the president of the United States. Eric, i want to quote something from a piece that you wrote. Biden beats the press. By turning the temperature way down by refusing to manufacture news where none exists in the name of partisan warfare and general chaos. Biden is denying journalists their professional momentum. You sort of talked about this in your answer earlier. Talk about what this piece was about and why you felt it was important to say that. Well, you know, trump reinvented everything. He tore up the protocols and traditions. One of the most beloved things he tore up was a healthy relationship with the press and being an agent of chaos. He tried to control the news cycle every day, he tried to control it every hour. So in the first weeks of the Biden Administration in the Press Briefings, we saw a couple of instants where people were asking culture war stories. What does the president think . What does the president think . The white house made it clear that biden is not going to weigh any on that stuff because he didnt think its what he was elected to do. We dont have a narcissist. We dont have an agent of chaos. Look, it was good for news. It was good for the news business. People could not consume enough news when trump was in office. Biden has come in and said were not doing that. Im not interested in it. Its not good for the country. Its not good for democracy. Im trying to get people vaccinated. Im trying to rebuild this economy. Im trying to do the blocking and tackling. And naturally, i think, from the presss perspective, theres a sense of thats not that interesting. Lets be honest. Were not going to get that many book deals from a Biden Administration the way we got a lot of book deals from a Trump Administration. Its a different culture. I completely understand that. I think were in the early months of making that transition. I think the press is improving but i still see flashes of that missing the circus. We dont have a circus, thankfully. Yeah. How precious our constitution is, and how, if we want its words to truly mean something, we must actively work to make them mean something. The late john lewis would call it good trouble. Look, they went in, they shouldnt have done it, some of them went in and theyre hugging and kissing the police and the guards, you know, they had great relationships. [ laughter ] as former President Trump dries to rewrite the history we all watched with our own eyes, the nation is getting a Reality Check with new revelations from the department of justice laying out how the proud boys communicated and conspired with the Militia Group the oath keepers in the weeks leading up to the capitol hill riots. Joining me now is Glenn Kershner and malcolm nance. Two people i couldnt be more happy to talk to before about this. Before we get started, know we the doj is looking how they communicated and conspired i want to listen to mr. Sherman. Have a listen and well talk about it. It seems like a low bar. I wonder why youre not charging that now. I dont think its a low bar, scott. I will tell you this, i personally believe the evidence is trending toward that and probably meets those elements. Do you anticipate charges against some of the suspects . I believe the facts do support those charges. I think that as we go forward, more facts will support that, scott. And so, glen, charges given what i said in the intro, given what we know now, do you think those charges are coming . Yeah. It doesnt mean michael sherwin, a federal prosecutor had any business going on 60 minutes and talking about future charges. A Bedrock Principle of being a federal prosecutor, jonathan, i was one for 30 years, we dont talk about pending cases or investigations. We certainly dont predict what charges might be brought in the future. Moving past michael sherwins inappropriate conduct, you know, there are four ways that the charges can be brought. Yes, one is the violent overthrow of the government. One is levying war against the United States. There are two other theories of liability in the conspiracy law. People conspire to prevent or delay any law from being carried out. They certainly tried to prevent and delay the Election Results from being certified and the fourth might actually be the most on point, jonathan, give what we know happened at the capitol on january 6th. The fourth, if anybody takes, seizes, or possesses property of the United States by force and without authority, that also satisfies the elements of the crime. I think the fourth crime is really the easiest to prove based on what we know. Finally, when people say, well, the federal government brought the charges ten years ago unsuccessfully. They might be shy about doing it again. That dog dont hunt. You know, if i lost a murder case ten years ago, but i have the evidence to support bringing murder charges today, the last thing im going to do is be shy about bringing that charge today because i lost a similar charge ten years ago. And, you know, malcolm, one of the interesting things and troubling things about what happened on january 6th is the number of the members of the military caught up in this one. One in eight charged in capitol riot have military First Responder ties. Then you have someone like mike rogers, a Ranking Member of the House Armed Services committee who seemed to be down playing extremism in the military. Have a listen to what he said on capitol hill on wednesday. I also want to root out of the military those who actively participated in violent hate groups. We cannot ask people to die under the shadow of racial hatred. Extremist behavior is prohibited by the uniform code of Military Justice and each services own regulation. Its important to point out we lack any concrete evidence that violent extremism is ripe in the military as some commentators claim. Malcolm . Well, thats very interesting. I recall a welldecorated Gulf War Veteran of the United States army named Timothy James mcvea who served in the army. He didnt seem to have any ties while he was in the army, but later on upon investigation, they found that not only was he actively, you know, studying the neonazi movement and the antigovernment movement, his platoon sergeant, terry nichols, helped him build, device, deliver the largest car bomb in American History that killed 186 american citizens. So, you know, for him to say that there is no active, you know, believes in the armed forces is ridiculous. Theres racism in the military. Theres sexism in the military. Massage any. Its prohibited by the uniform code of Military Justice but its up to your Chain Of Command and peers in the service to identify your behaviors while in service. Many of these people get out and take their skill sets out, including some of the people who were charged in the capitol hill attack who were members of the Special Forces or Naval Special warfare. Nothing said theyre not going to act using their skills when theyre going from the service. Malcolm, how concerned are you given the participation in the January 6th Insurrection that the extremism within the military is something that the military wont be able to get a handle on . The military will be able to get a handle on it and keep it under control with the Standing Orders as they exist now. The good order of discipline of the military is how the Chain Of Command handles individuals, should these things pop up. The point is, you can keep quiet for four or five years without making your views well known. Right. And then you get out of the service and you become a member of the proud boys or the oath keepers. Uhhuh. Quick point, jonathan, that being said, i want to touch on something that glenn talked about, you know, the conspiracy in the capitol hill between the oath keepers and the proud boys was really their Military Discipline and their Communications Protocols to stand away from the riot. To stand away from the speech and to be on capitol hill to carry out some sort of nefarious action. That, i mean, if you read the indictments, their level of coordination was militarily off the charts. They were prepared to do something. Glenn, yes or no answer. Was michaels comments to 60 minutes pose a danger to the forthcoming cases by the Justice Department . Yes or no . The good news is not in the long run because jury selection, which will not take place until, you know, long in the future, the judge will go through with the jurors, if they heard it, and if they didnt hear it, can they set it aside and decide the case based only on the evidence at trial. Well, as you know, jonathan, our congressman has hr 51 in the house and senator karper for delaware has the Companion Bill that is moving through the senate. We know that theyre focussed on protecting the right to vote and, finally, ensuring that d. C. Residents are part of the union, have two senators, and a vote in the House Of Representatives that matches our contribution to the union. We are fullpaying taxpayers. We have the obligations of state hood but dont have full autonomy and dont have two senators. One thing we here in the district is a lot more people. We have 749 people here in the district, that is more than vermont and thats more than wyoming. They have two senators. Another thing you said on monday, i believe it was at a hearing, on monday you said, you know, the simple fact is denying american citizens a vote in the body that taxes them goes against the founding principles of this great nation. You know, we get taxed. I pay taxes. You pay taxes. We dont have any representation. Mayor, is there anything we can do about that . Can we withhold our taxes . Well, that certainly is a tactic that people have suggested. One of the republican members and House Oversight also suggested it but, jonathan, you know that d. C. Residents sent me to the congress with one purpose. To ensure were treated like full americans and we can only be treated like full americans as a state. I also argued on monday that the issue of Withholding Representation from d. C. Residents has a long history tied with race and the fact we developed quite a black Political Power Base in the district of columbia, which has made the congress slow. 220 years slow to correct this wrong. And we know that is what hr 1 is about, too. So we do see d. C. Rights and d. C. State hood as a civil rights issue and a Voting Rights issue that is ripe to be addressed right now. President biden has supported it. Speaker pelosi has supported it. Leader schumer has supported it. We need everyone to get behind it. Mayor, let me get you on another issue. On thursday, the new York City Council passed a Reform Package and one of the big things in it they ended qualified immunity for Police Officers, which would make it possible for citizens to sue Police Officers in the way that, say, the family of george floyd will not be able to sue Derek Chauvin. Could it happen here . Could it here in the district of columbia qualified immunity go away . What do you think . Well, jonathan, our city council, our council at the district of columbia has been very active on Police Reforms and theres a Current Commission that is also looking at Police Reforms. Our focus has been on how do we deal with bad cops . How can we make sure that the police chief, you know, the mayor can fire a bad cop. How do we get discipline out of collective action and separate the two issues. How do we ensure arbitrators cant make me, the mayor, or the police chief hire another bad cop or jurisdiction not know that a cop has faced that type of discipline. We know when we focus on the members of our force are that are not joined constitutional policing, that are not making neighborhoods safer will be able to hold our force accountable. People expect that the mayor and the police chief are the ones that can do it. Not this kind of, you know, time gone by era of having discipline as part of the collective action. It doesnt help for people on either side to try to inflame them unduly. We have to recognize these racial tensions are real and that the Republican Party has been, you know, has had its image affected by what President Trump did. I was going to go to Something Else but i have to get you in on this. Your reaction to senator graham, connie . Im sorry he thinks only liberals oppose racism. We can start with that. Secondly, it is racist to champion a racist, which he has done unequivocally for four plus years now with donald trump. It is racist to support let me say it this way, its racist not to vocally, strongly oppose intent to suppress the vote of black americans, for example, what is happening in georgia. Wouldnt it be a perfect time for him to take a stand and be clear that nobody should be tolerating racists, including senator Lindsey Graham well, what do you call someone that is completely tolerant of racism . What do you call someone that doesnt stand up to, connies point, racist rhetorics or policies. What do you call somebody who supports the insurrectionist and hung literal gallows outside . Some of this is silly because we can see what is happening. When youre a person of color living in this country where you have to fear violence that is inflected by police or vigilantes or asianamerican and the president is saying racist things about the pandemic and you are in fear for your safety in public because of racist incidents, i mean, it doesnt matter what Lindsey Graham says in terms of what democrats are doing by playing this socalled race card. Racism is happening in real time. Its harming people in real life. People have been hurt and killed as a result. Its not a matter of an insult or you hurt my feelings. Racism is violence. Theres so much there. I think you know what ive been thinking about all week long in terms of this Immigration Discussion is essentially republicans have no policy platform. So they needed something to talk about in the beginning of the Biden Administration and the images from the border are compelling for their particular audience. They can show brown children and they can claim that theyre scary for some reason, even though theyre legally seeking asylum in this country and running for their lives. Essentially Senator Kennedy and other republicans who have gone to the border basically to do a stunt, driving or going around in a boat with a gun on it. I dont know what they were going to shoot at. But essentially they wanted to use this issue to distract from the fact they tolerated the racism of donald trump, they supported him all the way up to and including insurrection. They keep lying about the election. They dont have any policies to point to. So they needed a distractions. Immigration gave them that. To be clear, no republican, no republican is upset by the treatment of the migrants at the border. They are not upset that the migrants are not being treated inhumanely. They didnt say anything about child separation. They are upset because they dont have anything else to talk about. The other big issue that weve been talking about is Voting Rights. Lets have a listen to what senator ted cruz had to say about hr 1. It also strikes down virtually every state Election Integrity law. So 29 states have voter id laws. It strikes them all down, which facilitates fraud. Its a profoundly dangerous bill. In fact unbelievable. I think corrupt politicians act is the single most dangerous bill before the United States congress. I mean, connie, he renamed hr 1 the corrupt politicians act. This is all they have. They must prevent americans from voting. Specifically they must prevent black americans, latino americans, americans living in poverty, americans who are homeless, these are the people they must prevent from voting. Its the only path they see forward to winning. We must call it for what it is. To listen to Senator Kennedy talk, i mean, im listening and hearing hes holding Kamala Harris roots against her and the color of her skin against her saying she could not be the person who can oversee what is happening at the border. Theres such a consistent Narrative Thread that we can pull through this. In a little bit of time we have left, dan, i dont have the sound in front of me. You know it because it was georgia senator rafael warnock. He was giving a Press Conference in georgia about the georgia laws. He was walking away. Someone asked him about the filibuster and he came walking back. His point ill talk about it in the byline after this, where he said basically stop asking me about the filibuster and start asking republicans what are you going to do about Voting Rights . What is the possibility that Senate Republicans in the conversation about sr 1, the for the people act, will come to the table with their own version of a Voting Rights bill that can actually lead to a real conversation between the two parties about what to do to standardize voting in this country . I think the odds of that are quite slim, at this point. I mean, i watched the opening day of hearings on the bill in the senate and the distance between republicans and democrats is enormous, at this point. This is a massive bill. I think everybody should understand how much is in this bill. It has to do with Voting Rights. It has to do with redistricting and dark money and public financing. Its an enormous bill. Its 800 pages. Theres all kinds of details in this that people will get caught up in. At this point, it does not appear as though, a. , the democrats have any desire to slim that down. I think they think that all of these are essential and i dont find that republicans have anything at the federal level they want to do. I mean, their basic argument is this is a federal takeover of elections and they are opposed to that, though in the states, republican legislatures are trying to take control from local officials. Yeah. It depends on where you sit. At this point, i think the odds of a real comprise are slim to none. In the little time we have, do you agree with that . The comprise on this slim to none . Owe. Going back to the previous conversation about the filibuster. Democrats who want to make sure that the ballot is protected in the next election and ones after that need to really rethink their position. Im talking to joe manchin. The democracy is literally at stake. The things that are included in these bills are going to protect the voters whose numbers are growing in the country. Our demographics are shifting. They will do everything they can to prevent americans from voting. If they think its a partisan issue, my answer its up to americans. So let me say this very clearly, for all 99 of my colleagues. Nobody serving in this chamber can even begin, can even begin to imagine what a completely scorched earth senate would look like. You mean like stealing a Supreme Court seat from thenpresident obama nine months before the 2016 president ial election by arguing that the next elected president should make the selection . Or like killing the filibuster for Supreme Court nominees the following year so only a simple majority vote was needed to fill said stolen seat with Justice Neil Gorsuch . Or like stealing a 63 conservative majority on the Supreme Court by ramming through Justice Amy Coney barrett just eight days before a president ial election despite what you said in 2016, mr. Mcconnell . My Washington Post colleague ruth marcus laid out a litany of what could happen if republicans took back the majority, from banning abortions in the 20th week of pregnancy to a nationwide right to carry concealed weapons. Yes, all very scary. But im willing to live with the consequences if it means protecting every americans right to vote with the passage of the for the people act. Lawmakers in 43 states have filed 253 bills restricting voting access. And georgia was one of them, where its now illegal to give food or water to anyone waiting in line for hours and the Republican Majority Legislature now has full control of the state board of elections. At his thursday Press Conference, President Biden was asked what impact it would have on the administrations china policy. His response was instructive. But as the Biden Administration is pivoting to a massive infrastructure package this week, the polling also indicates new warning signs ahead for the president s other agenda items, mainly gun reform and immigration. 57 of americans disapprove of his approach to both issues. Immigration is becoming a focal point for republicans as the white house is making clear they inherited problems from the prior administration. So we saw spikes in 2014. We saw them in 2019 when the Trump Administration had perhaps the cruellest imaginable policies in place, family separation, to try to deter people from coming and they still came. So this is a cyclical issue, one that President Biden has said is unacceptable to him and hes working quickly to address it. He needs to apologize, President Biden, to the Border Patrol agents and their families for putting them through this. Were being overwhelmed at the borders, its not a crisis, its a complete loss of sovereignty down there. Meantime on capitol hill democrats are turning up the heat on republicans to pass a sweeping elections bill that would expand Voting Rights. Senator Raphael Warnock says democracy depends on it. We can walk and chew gum at the same time. Weve got to work on the infrastructure of our country, our roads and our bridges. And weve got to work on the infrastructure of our democracy.
