Opposed to just about any legislation put forward by democrats. The future of President Bidens agenda, other than the covid package, could depend on one thing. The filibuster. Thats the only reason you need 60 votes to pass a bill. Not for the bill itself but to stop the filibuster in a 50 50 senate, democrats effectively need ten gop votes to pass anything. The house just passed the for the people act. A comprehensive Voting Rights bill. On wednesday, senate ma rt jo leader Chuck Schumer said this about the bill. We will put the bill on the floor. We will see if our republican friends join us. If they dont join us, our caucus will come together and decide the appropriate action to take. Everything is on the table. Failure is not an option. You heard that, right . Everything is on the table . Well, more democrats are now saying that eliminating the filibuster should be on that table. Currently the Minority Party only has to threaten a filibuster to halt progress on legislation. This week, President Biden said that he is open to changing that rule without eliminating it. I dont think you have to eliminate it. You have to do what it was when i first got to the senate in the old days when you used to be around there. And that is that a filibuster, you had to stand up. You couldnt call for, no one could say, you know, a quorum call. Once you stopped talking, you lost it and someone could say, i move the question up. So you had to work for the filibuster. So youre for bringing back the filibuster. I am. Thats with a it was supposed to be. The president is pitching the return of a talking filibuster. Movie buffs will remember, thats what you saw Jimmy Stewart do in mr. Smith goes to washington. A man who controls a Political Machine and controls everything ellsworth controlling in my stath, and a man powerful enough to control congressmen, and i saw three of them the day i went up to see them. No, sir, i will not yield. You have to love that movie. Mitch mcconnell said he is vehemently opposed to this idea. This week he threatened to wreak havoc if the filibuster is changed at all. Nobody serving in this chamber can even begin, can even begin to imagine what a completely Scorched Earth senate would look like. But senator mcconnell had no problem with changing the rule in 2017. Back then, republicans were eager to get president trumps First Supreme Court nominee, neil gorsuch, confirmed. The filibuster has a dark history. Southern senators used to it defend slavery in the 19th century and again in the first half of the 20th, to oppose civil rights legislation. Last summer former president obama called it a jim crow relic. Joining us now is former democratic senator Barbara Boxer. She represents in california in the senate, for 24 years. Also with us is sarah binder, a senior fellow in governance studies at the brookings institution. She is a professor of Political Science in d. C. Good to see you both. Got plenty of audience questions to get to about the filibuster. And let me start with you. A question we got from ray who writes, the filibuster serves its purpose. You dont want legislation already passed under one party easily overturned by the opposite party, especially when theres a simple majority. Thats what happens with executive orders. What about that . Does the filibuster serve a purpose . Sure. It shuts everything down. Its a nightmare. Its misused and you know, i used to say, leave it alone because i used it myself to stop some really bad things from happening when the Republican Party started to move so far to the right that they were antigay and antienvironment and antiwomen and antiworker and i could go on. So i used it. But i have to tell you, if you care about this country and the people there in, you have to make change. If, if we hadnt used reconciliation which gets around the filibuster, it is complex but it happens a few times, we wouldnt have the American Rescue act which, 70 of the people want. So Mitch Mcconnell is acting like a bully and i think we have to move this down from the 60 votes to end the filibuster, to 51. Before i get to professor binder, i think thats the argument the people on the right would say. This is what we do to prevent the democrats from spending us into a ditch and taking on culture war issues, and so on and so on. It feels like either party can make the case that this is the way to prevent the other guys from driving us off a cliff. You see where i disagree. I saw a Republican Party when i was growing up, okay, and its a long time ago, for sure. That was very different from today. And i was so proud to pass 1,000 things when i was in congress. Every one of them had republicans on it. Now, they are so far away from the center that it is all changed. So i really think the democrats are the most center, left of center. The republicans are way off on the right. And thats why i dont think that the arguments can be the same from either party. Professor binder, let me get to a question. This person writes, i remember an else of the west i know when where the senator was filibustering because of something of his grandchildren. When did the talking Filibuster Cease in real life and why . Of course our west wing fans, im sure this is a little crossover in the fan base, what about that . I thought if you wanted to do this, you had to actually show up and yack, yack, yack. When you ran out of air or passed out, you were done. Why did that to that . Probably the last time we saw those drown out talking filibuster like Jimmy Stewart was way back in the 1960s. By the time the 1970s came around, when joe biden joined the senate, there was a lot more on the senates plate. There were pressures not to get boiled down and dragged out in filibuster to move on to other issues. In the 1970s, they lowered the cloeture threshhold to 60 votes. Add that up and they decided, lets go on two tracks. If they get stuck, well move on. There was too much on lawmakers plates, too much to be done, that it was easier, file cloture. See who shows up. Try to get 60. If you cant, move on. Nobody really wanted to spend all night on the senate floor. To make sure were all clear for those who arent familiar with that, cloture. Thats the 60vote measure to stop a filibuster, right . Sure. So senate has two options. They can get unanimous consent, are we all ready to take a vote . Or they file cloture. And they need 60 votes to cut off debate. Senator boxer, your former colleague, Dianne Fine Stein of california said she is open to filibuster reform. What is your sense of the mood in the senate or what it would take to move the senate toward any kind of change . Whether it is eliminating a vote in the vote threshold, making it a Jimmy Stewart time filibuster again, what does it look like the attitude is for any kinds of changes . I think the democrats will move to change it. I cant predict exactly how. It could be going back to that talking filibuster, and i dont know whether that will do any good. Mitch mcconnell is being a bully. Do you that and youll suffer, well, you cant suffer much more than we are now for the american people. Cant get much done. So i think you will see a change. Im glad that Senator Feinstein changed her mind on this. Because what is important is this. We are going through a rough patch. A rough patch everywhere you look. You just have that beautiful young woman on the show who talked about, you know, her struggles to fight for equal rights for transgender. We know we have terrible, terrible hate crimes going on. Africanamerican community, asianamerican community, hispanic community, and on and on and on. We have gun violence. I mean, it would take too long. I dont want to filibuster the show. Bottom line is there are so many issues. We simply cant just sit back and say, okay, too bad. 60 people didnt vote our way. We wont get 60 votes for a darn thing. You look at Mitch Mcconnell when obama was president. His whole goal was to help the american people. He said it. I want to stop barack obama from getting reelected and did he everything in his power. He feels the same way about joe biden. Its a nightmare. And i dont think anyone will be voting. I can tell when i look at Chuck Schumer. He wont be voting. I hear you. I appreciate you not filibustering. Fortunately, i have unanimous cloture on this program so i can certainly move things along. I want to know, professor, why some democrats would even want to change this rule. I understand what Senator Boxer is saying in terms of the everall democratic agenda. But frankly, joe manchin kind of instantly became the most powerful senator for a minute when i will was able to hold up legislation and say, no, no, you have to do this to my satisfaction before we can move this forward because its 50 50 in the senate. It feels like any senator could realize, wait a minute. If im the one who slows this process down, i instantly become the most powerful person in congress. Well, i think thats what a lot of people are wondering. Keep in mine, Senator Manchin is in a somewhat unique position coming from a very strong republican state. If the world in the senate turns 51 votes, it is very clear what Senator Manchin stands for and what hes opposed to. It may be on some issues that senators who are cross pressured like that, prefer basically to blame the rules to say we couldnt get republicans to join us. We needed 60 votes. Well see. There could be, keep in mind, there have not yet been real filibusters of the democrats yet on the floor. So it may be as bill after bill is coming over, Voting Rights, antidiscrimination, a whole range of issues, infrastructure, as these bills come to the senate. If they cant get 60, pressure within the the contract, with the democratic caucus. This next question from trish who asks, is it possible for it to be set assigned for a defined period of time . A year without it would provide space for real progressive legislation, most importantly, Voting Rights, but would provide cover for those opposed to it completely. What about that . I think that would really require some consent from the Minority Party. And i dont quite see that time of reform happening. I think probably more likely would be democrats deciding to try to carve out of the filibuster, create an exemption, say, for Voting Rights issues. Thats a high hurdle for joe manchin. The senator as well. I see that more likely than a truce where republicans fold on their right to filibuster. Senator boxer, before i have to go, i wish we had time play the clip of pat and oswald from Parks And Rec by talking about star wars, not even talking about the actual measure at hand. I wonder what you think that changing the filibuster would even do to the tone of discussions in congress . I dont believe senate rules say you have to filibuster by talking about the bill. You can recite the phone book if you feel like it. I think because of all the attention paid, i have to say to the professor, i agree with everything she just that. The senate can do anything it wants. But i dont think it will set aside, you know, set it aside for one year. I dont see that. But i do think because of the all the attention being paid to this, which i think is great, people are going to get disgusted if Voting Rights, somebody reads dr. Seuss books, or the books that are still there. So i dont see people getting accolades. They wont be Jimmy Stewarts. It is just, look at me. Ill great. I can stand here and read the dictionary. This is manager in this century, for gods sakes. By the way, the filibuster came about as a total accident, as the professor knows, with aaron burr saying, you know, the rules are slack. Theres apparently a definite need for what they call bed space for children. Before we delve into the rhetoric of this is the largest move in 20 years, we have to Pay Attention to what the back drop is. There is been four years of very draconian rules and laws on the border that have prevented Asylum Seekers from seeking asylum. This backlog, this basic need to keep people out has created a pressure, a Tourniquet Effect. Now there is been a push inward so we are seeing people come in in numbers. Yes, there are a lot of children coming in. But that also has to do with the fact that there is a title 42, Public Health law, still in effect. If i understand your meaning, this Tourniquet Effect means this backlog of people is now flowing with more force in a way because now there is been an opening, for lack of a better term, people are moving in greater quantity. I wonder how that affects the work that youre doing . This Tourniquet Effect, as you put it . Basically, what, we are frustrated on the border. The reason were frustrated is because the title 42 is now created this wall. This legal wall that we cant even get people through who have vulnerable issues. People at risk. What happened here was, the government, the state that Borders Texas and mexico, refused to take back families with children under 8. So these families that have been irregularly crossing are now being released in. Those with older children have been still returning, and biden is right. He is returning families into mexico. Theres such desperation that the older children feel the need, that they have no other way to deal with the situation and are now entering into the u. S. Once theyre in, they are not subject to title 42. So title 42 is creating a lot of hassles on the border. And with that, this bleeding in of what is built up for four years, is what is going on right now. Im sorry. Forgive my ignorance. What is title 42 . Title 42 is the Public Health law. It is pretty old. It was utilized by the Trump Administration essentially to keep people out. The people are the Asylum Seekers. Essentially, the cdc was not in agreement with it. And then later, forced by the Trump Administration to invoke the title from, basically, because of covid, they have invoked this law saying, because of the risk of covid, we cannot let anybody in. But i can come in. Im a u. S. Citizen. I could have covid. But im allowed in. The issue is people who are seeking asylum do Not Have Quote Unquote Documentation and therefore, have to be processed. And the processing of the Asylum Seekers in a congregate setting is what the title says, is what has led to the complete refusal to accept anybody in. Not even people who have huge fears, huge needs, vulnerabilities, nobody. With regard to semiing people in, abc news asked President Biden about his messaging to would be migrants in terms of whether they should come to the border. Heres part of what the president said. Yes, i can say quite clearly, dont come over. The process of getting set up, dont leave your town or city or community. How do messages like this reach migrants who come to the border if at all in terms of the people you dealt with . Are they aware of what the president is saying at this moment . On this day or another . When somebody is running for their life, it doesnt matter what the president of the United States is going to say. A lot of the Asylum Seekers are in hopeless situations. The hurricanes of october and november really hit hard in central america. There is a constant struggle with the gang wars in el salvador and honduras. When somebody is fleeing for their lives, when theyre being told, just stay there for a few minutes until we get our act together. Its not going to have any effect. And i think that we cannot be os trichs with our heads in the stand. Okay, just stay there until we clean up our act. It doesnt work that way. These migrant situations have been during for a long time. The causes are what we need to address. What would you like to see happen now in terms of the people that you deal with . If they could get a message to the president , to congress, to washington in terms of what would make the biggest difference in the situation, what would that message be, before we go . We really need to revoke title 42 as it is being applied on the border so people who really need protection can then apply for this protection in an orderly fashion. He deals in a lot of xenophobic rhetoric that White Supremacists have made no secret of supporting and that has made him the target of a lot of tv takedowns. Tucker carlson is the new donald trump. Tucker has taken trumps place as a right wing leader, as an outrage generator, a fire starter. It is all happening on fox just like Trumps Campaign did. I want i had bat enough to hear the white supremacist families gather around to watch tucker twice . The fact is millions of viewers watch him once and once is already more than enough. Ive resisted criticizing mr. Carlson myself. Its not really my style. Why not . I couldnt really put my finger on why i resisted until now. Donald trumps election in 2016 burned a lot of bridges within families and work places and faith communities, and circles of friends. Maybe yours, too. It still breaks my heart that so many people have skimmed the holidays for years over political differences. Maybe you can relate. Tucker carlson is just the latest whipping boy for people who hate his kind of rhetoric. His work is lucrative for fox news because hes chosen an easy path. Endless outrage. At a certain point though, that outrage gets outlandish. New rule, stop using the term plain virginia nil. A it is a flavor like any other. It comes from the vanilla bean. Do you know another flavor that comes from a bean . Chocolate. You dont their major stream media using the term plain chocolate. Plain vanilla . Thats okay . It isnt okay. Im Tucker Carlson, good night. This divisiveness and xenophobia is fair game for calling out. Especially when it seems like nothing is safe from the culture war. Not even ice cream. Its the kind of television that millions of americans watch five nights a week, and to his critics, that is the most dangerous thing about him. Firmly sum planting sean hannity as the number one star on fox news with ratings far ahead of anyone else on fox. And by the way, other shows all day long. And tucker knows this. He knows there are easily Accessible Answers to these questions about the vaccines. Hes not stupid. He just thinks his audience is. And thats what has really got his critics upset. Not his intolerance. His influence. There is more to this. Under the surface. Check out this recent study from puig research. The survey asked that peoples concerns over media bias. It shows that people are almost twice as worried that other peoples news is biased than they are about bias in their own news sources. Think about that. Our problem with media bias is about those people. About them. The ones we believe are getting Bad Information from untrust worthy outlets. To supporters, Tucker Carlson, he has fans. To his opponents, he has hostages. If you hate him, im guessing that someone you love watches him. Shows like his have driven a wedge between and you someone you love. And that hurts. So what youre feeling is not just anger. Its loss. Especially if youve tried to have a reasonable conversation with someone about one of his commentaries. Even fox news has argued in court that hyperbole is part of his act. Hes not meant to be a reliable source of facts. Fox news argued this in a slander case and got the case dismissed. This culture war sucks. I hate it more than i can say. And this situation is a prime reason why. We focus. So on the warriors that we forget about the wounded. Because were all wounded. And it is. So easier to rage on in war than to stop and tend to our wounds, just looking at them can be unbearable. But the pain is real. It matters. And it needs to be spoken. You lost someone. In some cases, theyre so estranged, it is like they died. Youre basically dead to each other. Why should anyone on tv be closer to the people you love than you are . Political commentary is vital in our First Amendment system. Thats a good thing. Some of my colleagues here have very hot, hot takes and i am cool with that. Fox and msnbc and cnn make a lot of money on points and perspectives. Thats also fine in principle. But there is a time and a place for debate. Not everywhere and not all the time. Besides, fighting over his Talking Points with your loved ones is exactly what i expect mr. Carlson wants his viewers to do. There is no point competing, going head to head. You cant love people head to head. You love them heart to heart. Of course, abusive people, toxic people have no right to be in your life. What about the people you still love whose views are somewhat toxic . How close can you hold them to keep from throwing them away . What would they say if they really knew how hard you are trying to hold on . If youre watching this, and you also watch fox news, welcome. I am honored that you are here. And what i found is that people who disagreed with me about everything important, abortion, you name it. Could not do any more for me. Could not come and help me enough when i was ill. And sometimes the people that agreed with me, had the same ideas, didnt show up. It was a very interesting thing to find out. That political similarity is not necessarily moral similarity. Love is not all defined in politics. And this really changed my mind about a lot of things. From my own experience. My next door neighbor, who is a National Review reared, extremely prolife, et cetera. I had to beat her off to not come with me every day to the hospital. Okay . Thats a wonderful thing to hear. That there are things that you found, things in your life that transcended these political lines. I wonder what your finding is most ineffective. Lets start with what doesnt work, first of all. When dealing with these divides, what have you found that doesnt tend to work in terms of mending fences, reconciling, making peace moving forward. The first thing i recommend never doing is what i call article thrusting. This is article thrusting. Read this. Read this. This will show you that you are wrong. Right. And the tone of voice is very important. Yes, yes. You cant go into a political conversation with somebody you know that disagrees with you with that attitude. Forget it. The first point, maybe the first, second and tenth point is, stop thinking you can change the other persons mind. This is the hardest thing. And im starting with it because it is the only thing that really matters. If you want to have a conversation with somebody that you love that disagrees, you have to shift your mindset so that what youre doing is listening and not talking. Do not try to show them the error of their ways. They dont think their ways are in error. They think yours are. So if you want to have a conversation, you cant do it. Im sorry. I have a little audio issue between you and me. I dont mean to interrupt you. No problem. What do you do in terms of that emotional tug . And i dont judge it. It comes from a real place that says i love you but your politics are a direct contravention of my right to live, to have freedom, equality, justice, the things you believe have a Material Impact that hurts me. And i need you to know how hurt i am. What do you do with that . What do you accomplish by saying it . I wonder. Who are you talking to . Are you talking to somebody who stands by you when youre ill . Are you talking to somebody who is a good friend to you . Even though you hate their politics . I mean, i am extremely for womens rights. And i live with a man and his whole community of people on the right, who are prolife. It goes against something very important to me. But i also have relationships with them that in other areas i admire them, i love them, and they take care of me and i take care of them. You cant agree with everybody on everything. And i have plenty of people that i can talk to about the things that matter most to me. In way. And some of them, one of them is my husband. Everything else, we agree on, right . So you have to have, you have to have some compassion for others who see the world differently than you. And i think thats hardest when it is your family, frankly. I think with others, its a little easier. Family relationships, there is something that you write about called manifest content. You refer to politics as the manifest content. The thing that kind of shows up. And then the latent content underneath, the back story behind why youre bringing up the politics behind, why youre bringing up the culture war issue. That sounds like really scary work that i would have to do on myself before i go bringing up something to somebody else so that i know where im coming from. I think thats a brilliant, brilliant way to look at it. Work on yourself first. Because manifest and latent content. These are terms from psycho analysis. That they really do applaud. Many of the political violent arguments that i see in families, there is always something underneath it. Somebody is angry about something else. In politics, you can feel very selfrighteous, you can feel justified, you can feel outraged without ever dealing with the personal issues at all. People like to feel that theyre right. And they dont, so, you have to understand, you have to think. If you want to have a political discussion, are there other things going on . You have to be your own therapist in a certain way to do this right. Am i making an argument with this person because im angry at them for something else, because theyve disappointed me . Because i dont agree with them . Whatever. That is a very important thing to do. Right. Not everybody youre going to agree with. And not everybody, this is very, very important. Not everybody that you do agree with is going to be a good friend to you, somebody who loves you and takes care of you. It doesnt work that way.
