On board. Coming up, were live with one of the lawmakers working on that bill with its status. Elsewhere on capitol hill, the push to create and pay for a 9 11style commission to investigate what led to the january 6th attacks. Weve got the latest on that new move and where the investigation stands. Plus, make that at least two republicans now formally reprimanded for failing to convict President Trump for inciting the capital riots and there may be a third on the way as republicans Fight For The Future of the company and whether it including donald trump. Im Hallie Jackson along with Kara Lee Outside the white house, ali vitali, Pete Williams is with us and jake sherman cofounder of Punchbowl News and an msnbc political contributor. Kara, big push on covid relief today, big trip for President Biden and ahead of it the white house is announcing new protections for homeowners hit hard by the pandemic. Reporter thats right, hallie. The administration announced it is extending this Foreclosure Moratorium and the window for which people can enroll in a program for mortgage payment forbearance. Thats going to end until the end of june, until june to give relieve some economic pressure that people are under because of the pandemic while also then traveling outside the country, outside of washington in the country to try to build support for his plan, his 1. 9 trillion Coronavirus Relief package. And this is a bit of the outside in game where he is going outside of washington to try to put pressure on lawmakers in washington to really get behind that plan and there are some things that are still in contention when it comes to this, even among democrats themselves, whether or not to raise the minimum wage, for instance, what the size and scope of these direct payments to americans should be. And republicans still are saying that this is a package that at 1. 9 trillion is just a little too much and theyre all working under this deadline of march 14th to try to get something in place before people start to lose some of those economic benefits that theyve been receiving. So we see the president trying to keep democrats all together and also try to win over some republicans. He will start in Wisconsin Outside Of Washington and then he will head to michigan on thursday, hallie. Kara, thank you. Let me go to ali vitali over on capitol hill. House Speaker Nancy Pelosi now asking lawmakers for money to beef up security and set up this 9 11style commission to look at what happened before, during january 6th, right . Reporter yeah, thats exactly right. This is something that folks like jake as well as our team had been predicting would happen, but pelosi overnight ratcheting up the pressure on this, sending a letter to her colleagues with the subject line security, security, security. The focus is twofold, short term and long term. In the short term pelosi is saying she needs members to approve appropriations for more member security, more funding for member security. In the long term shes saying she would back putting up a kind of 9 11style commission that would investigate what happened on january 6th and what led to it being so bad and so deadly. And thats something thats likely going to require legislation to actually put it up, but at the same time that also legitimizes and elevates the commissions work once its created. So there is a bipartisan call for such a thing, at the same time, though, theres politics in play, especially when you Start Talking to folks about what this means and even if it was an armed insurrection, listen to senator ron johnson. This didnt seem like an armed insurrection to me. I mean, armed, when you think and hear armed dont you think of firearms . Heres the questions i would have liked to ask, how many firearms were confiscated . How many shots were fired . Im only aware of one. If that was a planned armed insurrection, man, you have really a bunch of idiots. Reporter hallie, a few things to keep in mind here. A 9 11style commission is a longerterm thing because that commission during 9 11 took months to actually get that ultimate report. Thats something that once its created we will be waiting a little while to figure out the details, but also remember how many details we dont actually know. Even think of the Impeachment Trial that we just went through last week, trumps lawyers offered no new details and they were asked repeatedly about what trump knew and when and what he did with the information that he had. You hear House Democratic Impeachment Managers in recent days after that Impeachment Trial, this is one of the reasons why they are so fullthroatedly backing a Commission Like this because they think that it will elucidate the details that trumps legal team obfuscated so deftly, hallie. Pete williams, on the topic of the insurrection, what happened on january 6th, were learning that the naacp and Benny Thompson have filed a federal lawsuit accusing donald trump and Rudy Giuliani of inciting that riot. What can you tell us us about that and where would that go . It was just filed in Federal Court in washington, it names the president , former president , Rudy Giuliani, the proud boys and the oath keepers, two extremist groups. It says that they had a common goal of trying to stop the vote count on january 6th. They cite they cite a federal law, the Civil Rights Act of 1871, which has a section in it that allows private lawsuits like this. This law was passed shortly after the civil war after the 14th Amendment was approved that basically allowed lawsuits against organizations like the ku klux klan. What they say is there was a common conspiracy of all these groups to stop the vote count. So if you will, its a civil its turning the House Managers claims into a civil lawsuit. What do they ask for . They ask for the court to declare that this is what happened, to bar the defendants from doing anything like this and then they also say they will ask for compensatory and punitive damages. So thats just filed now with the congressman Benny Thompson and the naacp here in Federal Court. And incitement is obviously a legal term, there is a bar that would have to be reached in this kind of a lawsuit, am i understanding that correctly, pete . Incitement is a criminal statute, so this is a civil lawsuit claiming that there was a conspiracy, combining together that basically, as i say, it takes all the House Managers claims that President Trump sort of planted the seed for this, fired the group up, used all these terms that egged these groups on and notes, as the fbi complaints against these groups have said in court, that they said among themselves that they were coming to washington at the request of the president. Where does this go next, pete . Obviously it has to work its way through the court system first, right . Right. I assume that the first thing that will happen is the lawyers for the president and giuliani and to the extent that the oath keepers and proud boys get lawyers they will file a motion to dismiss, they will say there is no proof of any conspiracy, but it may be that one of the things that congressman thompson and the naacp want to do is get to the next stage, which is using this lawsuit if it stays alive for discovery, to begin to use the courts to force the former president , giuliani and others to give up information that they could use to build this lawsuit and perhaps expand it out to others. Jake sherman, let me bring you in on this conversation here. As we talk about the fallout from the january 6th attacks you have kind of the piece thats working its way through the courts as pete just talked about, you also have the political piece of this now with more and more republican senators who voted to convict donald trump getting censured or under threat of censure, for example. Senator richard burr joining bill cassidy in a formal censure. Utahs Republican Party put out a statement that supports mitt romney saying they support diversity of thought. There are rumbles of censure for susan murkowski, ben sasse, pat toomey. What does this mean from a perspective . Not very much. Either of these people have just won or arent on the ballot for many years including mitt romney. I would say this, Party Politics inside of states tend to be the most ardent and more active type of people. These are not every day people. Ben sasse in a video said this is not whats on the minds of most people that i talk to in nebraska. If you want to censure me go away, thats fine. I would say it does illustrate that donald trump still has a control on Party Apparatuses across the country. Other than that, richard burr is not running back, Susan Collins just ran, pat toomey is not running again. This is not much of anything for any of these senators. But wait a second. Let me go back to something that you said that it shows donald trump still has a grip on some of the State Parties here. Here is what the pennsylvania one of the pennsylvania county republican chairs had to say about senator toomeys vote to convict. Watch. We did not send him there to vote his conscience, we did not send him there to do the right thing or whatever he said he was doing. We sent him there to represent us. So that is getting a lot of attention this morning and, jake, to your point about the sort of impact of this, does donald trump still retaining a hold on local parties not have an impact on where Republican Voters heads are and where that goes . I think thats an interesting push and pull. There are people who say you need to go to washington and vote the will of your constituents. Thats a mushy definition, but there are people who say you need to go to washington and vote your conscience, thats also those are competing things at times, right . I mean, i think no one could know exactly where every citizen in their state or in their constituency is, so you have to make the best judgment at that time. I really think that by and large we saw in the last Impeachment Trial had very political impact. I think people in 2022 are going to wonder, are going to vote on the fact that i mean, its very early, but they are going to vote on whether the coronavirus is contained, whether jobs are back and whether they have money to pay their bills. I dont think that this idea that people held donald trump responsible for a Massive Attack on the capitol is going to be dispositive in the election. Kara lee, ali vitali, Pete Williams and jake sherman, thanks to you all. An update this morning on some wild and deadly weather across the country. So lawmakers are out of town here in washington, they are on recess this week back home, but theres still some important behind the scenes work happening on covid relief right now, thats because the House Budget Committee is still putting together a final version of the bill which could get a full vote on the house floor as soon as next week. You see the calendar laid out there. Im joined by pennsylvania congressman Brendan Boyle. Thanks for being back on the show. Thanks, hallie. Sure. So can you give us an update. Where is your committee on this this morning . When do you think you will be able to release this bill . Yeah, well, some other committees have already marked up their pieces, i also serve on the ways and Means Committee and we marked up our piece last wednesday and thursday over 18 hours. Now, this upcoming monday, almost a week from now, the Budget Committee will put together basically all of the pieces and then send it to the house floor. So im pretty confident that come next week the house will be able to dispose of this and send it over to the senate. God knows it is badly needed. The danger of a doubledip recession is real, so the quicker we act the better. And do you think there is this midmarch, March 14th Deadline that the what u. S. Is pushing to get ahead of. Do you believe right now you are on track to potentially get this passed and instituted before march 14th . Yeah, i do. Certainly the house will easily beat that deadline, my only hesitation will be how long the senate takes. Ideally this should be wrapped up by the first week of march, but, again, that depends on how long the senate takes and they certainly have rules that slow things down in a way that we just dont have in the house. Nonetheless, im confident that we will meet the original deadline of the president. Let me ask you about this issue over putting in place something related to the minimum wage here. Speaker pelosi says this 15 minimum wage will be involved in this bill thats coming through, but as you know that is not necessarily something thats going to sail through with no obstacles. You have a couple Democratic Senators, kristen cinema, joe manchin that have said they do not support this, even whether senate rules will let it be included in the reconciliation process. If there are no procedural objections are you concerned they could shoot down this whole package because of the minimum wage that could be added. Im a supporter of the raise the wage act. We passed it in the congress, obviously Mitch Mcconnell didnt bring it up. It would ultimately raise the minimum wage to 15 an hour though that is over the course of about four and a half to five years. Right. I know it is going to be in the house package and that we are going to pass it as part of the overall package that goes to the senate. Then the question is what does the senate do . I think the Senate Parliamentarian and im not an expert certainly in this regard, but given the cbo score i think it does have a budgetary impact, meaning it should qualify for reconciliation. Then the question would be would those one or two Democratic Senators who have previously expressed disapproval, would they still be willing to hold it up even if the reconciliation grounds no longer apply. That question i just dont know. If it does, lets say, get stripped, right, and there is not enough Senate Support for it and it comes back, would you support some kind of a package for covid relief even if it does not include the raising of the minimum wage which youve made clear is something you overall support . I would be disappointed if it were stripped out but overall the urgent need for so many of the things that are in this 1. 9 trillion package is such that i would not let that stand in the way of my overall support of the covid relief bill, especially because i would be pretty confident that we would be able to come back to it at a later time. Let me ask you switching gears here about something we talked about at the top of the show, house Speaker Nancy Pelosi announcing there will be this independent commission to look into what happened on january 6th and the insurrection. Is it your sense is this going to require legislation the way that the 9 11 commission did . If so is that in the works . What can you tell us about that . Thats a good question. Im not sure. Certainly you can appoint a blue ribbon Bipartisan Panel and not necessarily need legislation. The question in my mind is would it be Subpoena Power because im one person, for example, who lived through that nightmare who really wants to know what donald trump was doing for those five or six hours, what he was doing and what he was failing to do when so many people on capitol hill, democrats and republicans, were directly reaching out to him to send in the national guard. I just want to make sure whether its a 9 11like commission, whether its over at the doj as some sort of prosecution, i want to make sure whatever the investigative body is that they have Subpoena Power. Congressman Brendan Boyle, thank you for being with us and talking about the headlines of the morning. Just ahead, after being cut off for more than a month why the social Media Network where some of those Capitol Rioters organized is back up and online. Up next, Kids Under Pressure. Leave the structure, call 911, keep people away, and call pg e right after so we can both respond out and keep the public safe. Covids still a threat. And on reopening schools, we know what happens when we dont put safety first. Ignore proper ventilation or rates of community spread, and the virus worsens. Fail to provide masks or class sizes that allow for social distancing, and classrooms close back down. A successful reopening requires real safety and accountability measures. Including prioritizing vaccines for educators. Parents and educators agree reopen schools. Putting safety first. If you see wires down, treat them all as if theyre hot and energized. Stay away from any downed wire, call 911, and call pg e right after so we can both respond out and keep the public safe. This morning some new glimmers of hope in the fight against coronavirus. The nation is now averaging under 100,000 new cases a day, down from 239,000 just a month ago. Daily Vaccination Numbers are reaching an average of 1. 7 million per day, but that doesnt mean that we are in the clear. Far from it. Youve got warnings getting louder about the weeks ahead with more of those very transmissible variant cases being reported. And about the toll the pandemic is having on kids. Something we are covering all week long across msnbc and nbc news in our series Kids Under Pressure. Nbcs Priscilla Thompson is in denver, also joining us us is dr. Natalie azar. Youre covering a big push by Denver Public schools to make Vaccines Available to all teachers and the priority and how that rollout happens is equity. Well, hallie, good morning. Thats right, Denver Public schools is looking to vaccinate all 18,000 of their teachers by the end of next month, already theyve done more than 3,000 teachers, they started this effort about a week ago, theyve been Doing Mass Vaccination Sites on the weekends which they plan to continue. During the week theyre going school by school allowing students to work on assignments at home while their teachers go to those Vaccine Appointments but they are not doing it based on how large the school is or how many students the school serves theyre doing it based on the amount of students at these schools that are on free or reduced price lunch in order to prioritize equity in their vaccine distribution. I had an opportunity to speak with lauren den the Senior Advisor to the district who has been responsible for rolling out this vaccine plan. Take a listen to why she said it was so important to prioritize those highest need schools. We wanted to make sure that we focused on those schools that are serving the highest poverty students and that they are healthy, happy, that they can be back in school in person and have their teachers with them because we know that thats what they need more than ever right now. Reporter and, hallie, i spoke to a number of teachers who got those vaccines and they tell me that seeing how this virus has disproportionately impacted low income communities, communities of color, it was very important that they return to these schools in these communities fully vaccinated. Hallie . Priscilla thompson, thank you. We just heard one approach for trying to help students, now lets talk more about the why. Weve been telling you about nbcs new study with Challenge Success that looked at more than 10,000 High School Students in 12 schools representing students all across the country. Among the findings on the pandemics impact, kids everywhere are more stressed out and less engaged with school. Nbcs Savannah Guthrie went inside one school she knows a Little Something about to hear more firsthand. I wish teachers knew that on some days i cant handle any more work. I wish my parents knew how much i stress. Stress. Stress. Im not just dealing with academic and social stress, im dealing with family stress, too. How stressful it was to be a student during covid19. Its a Common Thread weaving together High School Students across the country, a feeling of mounting stress and less motivation to learn. Sometimes its really hard to just be motivated to like actually get on the zooms and to do the work just because i feel like it doesnt even matter. It feels like were not really learning. Mia hernandez is a senior at Amphitheater High School in tucson, arizona, a school i know a Little Something about. I hear you go to afphi. I went there. Her High School Experience has been dramatically different than mine. The pandemic forced students to be remote for most of the last year, their return to hybrid learn delayed as arizona reported the highest Transmission Rate in the country last month. Do you feel more stress now that you are sitting in front of a computer most of the day and having to learn online . Yeah, the second that the last zoom class is over i just want to be away from school for as long as i can so i will wait until like the middle of the night to do my homework so i can have free time. Mia is not alone in one of the largest most comprehensive studies of its kind nbc news smart nerd with Challenge Success to ask 11,000 High School Students about their experiences during the pandemic. 42 of students reporting a decrease in their engagement with learning, 56 saying their stress related to school has increased since the pandemic started, especially among girls and students of color. More kids are reporting their Mental Health is a major source of stress. Theyve always been stressed about school, theyve always been stressed about schoolwork, but now youve layered that with this whole other existence. To make a challenging learning situation even more difficult, many students deal with all too common tech issues during class. Something we witnessed firsthand. With zoom theres more work added to the classes. Wait. Hold on one second, ethan, because you just froze up. Okay. Sorry. Let me ask you again whats it been like to have to do school on a computer on a zoom . It gets pretty tiring, obviously with wifi problems. Senior ethan hitch ngs has done what he can to be positive, staying active and seeing friends during Basketball Practice and games. He says worrying over school and homework has resulted in a new level of exhaustion. Im just i oversleep sometimes or i just get caught up doing homework and i forgot to log on to another class. He is one of many teens who say theyre now sleeping less, the pandemic also leading students to feel more disconnected from teachers and classmates. Before last spring this junior had a packed schedule, balancing clubs with cheerleading and volleyball. Im actually one of those people who like to get involved in school a lot. So one day youve got a until things to do and a million places to go and then everybody is at home. What has that been like for you . It hasnt been the greatest. Miriam admits its harder to concentrate now, especially with stress leading to more frequent headaches and shes grateful for understanding teachers. Theres times where my Mental Health is worse than other days, but its gotten better. The pandemics negative impact on students a big concern for principal aj mallis. We have some sophomores on campus that have really only been in high school for a semester. Theyre struggling with understanding what Real High School is like. But yesterday a positive step forward, hundreds of students arrived back on campus for the first day of hybrid learning this semester, an embrace of a familiar routine of the past as they look ahead to what comes next. I wanted to do all these things my junior year, go to dances and maybe prom, but but hopefully next year i will be able to do those things. What are your plans . Do you know where you want to go to college . I will be going to Johns Hopkins in the fall. I have already got accepted to many universities, so im very confident im going to find a good college. Theres so much hope on the horizon. Yeah. Nbcs Savannah Guthrie there for our Kids Under Pressure series. I want to bring in now dr. Natalie azar, nbc news medical contributor. Dr. Azar, i know you had a chance to watch that with us. You understand the challenges kids are going through. What should people know about what how to help these students, what theyre dealing with and the longerterm impacts the longer this pandemic goes . You know, hallie, im just so happy that were doing this this week. You know, im listening to those students and im thinking these are the exact same things that are coming out of my kids mouths. My son is in tenth grade, my daughter is in seventh grade. Shes having a little bit of an easier time of it. I think last year when everybody went home, you know, Remote Learning was still a new thing. If i recall correctly im not even sure that they had real exams. My kids kind of went through a little bit unscathed initially. I thought im lucky, my kids are old enough, they can teach themselves. I felt really, really sorry for working moms who had to take time off from work to teach their children. I didnt have to do that. This year especially at the High School Level it has been incredibly challenging for my sophomore. I mean, in addition to all the technical issues, one of the which are real, i mean, imagine, hallie remember in those classes like history and english where its so didactic and that give and take of thoughts and ideas its just really missing. Its not even so much that, it is literally that they dont feel motivated. I think how can you not be interested in learning about history . It is a very, very real issue, hallie, and one that i really hope that this is eye opening for everyone. I know educators are understanding this and im sure what im saying is resonating with a lot of parents at home who are watching this as well. So then talk to us not just as a doctor but as a parent. What are you doing . What is your approach at home and what advice would you give from the sort of the medical perspective and the parenting perspective on how to help kids who are feeling this way . Right. What was interesting last night, my son kind of said im just a little tired, im just a little uh and my husband immediately was like, well, no, lets talk about that. What do you mean by that . I think to us it was more, you know, sometimes you are in a little bit of a funk, you dont feel so good, but in this case lets not just ignore that. Lets delve a little bit deeper. Are you concerned about your grades . Did something happen on social media . That kind of thing. In my house were big on sleep and were big on exercise and so im trying to, you know, impart that on my kids, too, like if youre feeling bad, get a little you know, get a little get your heart rate up, you will feel a little bit better. Ive been more lenient on video games during the week, i normally wouldnt but for teenage boys that is their way to with one another. We also take a lot of walks outside as a family and are talk being the vacations were going to take as soon as its safe and keep on looking towards the future and know that this, too, shall end. Dr. Natalie azar, thank you so much. Excellent advice. Thanks, hallie. From both your medical, wearing your medical hat and your mom hat. Almost 98 percent of patients on eliquis didnt experience another. And eliquis has significantly less major bleeding than the standard treatment. Eliquis is fdaapproved and has both. Dont stop eliquis unless your doctor tells you to. Eliquis can cause serious and in rare cases fatal bleeding. Dont take eliquis if you have an Artificial Heart Valve or abnormal bleeding. Shaq, you are back in one of the counties that we dove into back during the election for our county to county series. What are you hearing now from voters . What do we want to hear from the president today . Reporter they want to hear a clear focus on getting control of this pandemic, its definitely a focus and topic that you heard from joe biden during the Campaign Trail and its what they want to hear from them now. Listen to a sample of my conversations with some voters here. Get the kids back to school. That would be priority number one. The Small Business assistance, getting these Small Businesses the resources they need. Lets focus on covid, number one. All the dose that is we can possibly buy in the world should be purchased. I appreciate President Biden for showing that leadership, showing the empathy. My father is gone from covid and so like when i hear the name covid and i hear on the news people dying, im reminded of it every day. Reporter that last gentleman that you heard from his father was one of the first people to die of covid, to lose his life from the coronavirus here in the city of milwaukee. If you listen to the common theme from all of those people the first person who supported trump, the second person who was a Small Business owner you hear elements of President Bidens covid relief plan. Thats why hes coming to milwaukee to sell it to the regular people, regular people in this state of wisconsin. Hallie . Landing in the middle of a Storm It Looks like potentially later tonight. Shaq brewster, stay warm in milwaukee, my friend. In new York Governor Andrew Cuomo has no Public Events on his schedule today, at least not yet, as this morning he is under fire from both democrats and republicans alike. The governor now accepting some of the blame for that delay in publicly reporting crucial data related to the pandemic. Data that showed covid deaths at Nursing Homes in the state are actually around 15,000, a lot higher than the initially reported 8,500. Listen. We should have done a better job providing more public information. Cuomo stopping short of a full apology. Disputing deaths have been underreported, he is explaining the lack of transparency was because of a threat of investigation from the then trumprun justice department. Still new yorkers like vivian zias who lost her mother in a nursing home are demanding accountability and answers. Were calling for an independent federal investigation so that this continued can be looked at in a deeper way because for some reason seniors are treated as disposable and it has left a void. Joining me now is Gyasi Mckinley Albany Bureau chief for the new york times. Good morning. Good to have you on the show. Of course. So Governor Cuomo literally wrote the book on how to respond to a health pandemic, he made a name for himself nationally, talking about transparency, those briefings early on, folks remember those. Whats the reaction in new york to this explanation now from Governor Cuomo . I think if you are talking to lawmakers in albany the explanation did not go far enough. As you mentioned in the lead up, the issue of the data not going to State Lawmakers and the Cuomo Administration basically using the federal investigation as an excuse, that involves a sixmonth lag and lawmakers here are still quite upset about that on both sides of the aisle, not just republicans who have been calling for federal and state investigations, but also democrats who are now talking about stripping him of his emergency powers. So if it was a Cleanup Effort yesterday by the governor i dont think it quite got there. So what are going to be potentially the repercussions or the continued backlash . You talked about the possibility he gets stripped of some of his emergency powers. Is that where it ends based on your reporting and what you have heard . I think thats certainly the first step thats going to be taken here, but, you know, the call for federal investigations may not go anywhere considering that the Trump Administration had kind of floated this in the fall and obviously we are in a Biden Administration now, but certainly i think the larger issue here may be the governors reputation. As you mentioned as well the governor made a great deal of kind of got great reviews for being the data guy, you know, the facts guy, the guy who always told the truth and what weve seen over the last two and a half, three weeks is that that wasnt always the case. So in talking about his political brand, kind of no nonsense truth teller, i think thats taken a significant ding over the last couple of weeks. Theres also been criticism of the Cuomo Administration for this policy to send nursing home folks hospitalized with covid basically back to those Nursing Homes. How does that fit into this . I think thats going to go to the heart of it. You know, the governor said yesterday, again, that that policy was not to blame for additional deaths, that those infections were brought in by workers not by patients being returned to Nursing Homes, but keep in mind we now have updated data, data that was being withheld and certainly our publication and other publications are going to start to comb through that data and see if that holds water. If this idea that, you know, the policy had nothing to do with additional deaths, which the Cuomo Administration has steadfastly stuck to, were going to start to look at that and see if thats actually true. Jessie mckinley, Albany Bureau chief for the new york times. Thank you for your expertise and reporting on this issue. So just out in the past hour, not even, some new details on what went on behind the scenes with Donald Trumps impeachment defense team. In a new piece from the Jewish Insider lawyer david schoen, one of Donald Trumps defense attorneys, paints a picture of a rather dysfunctional one of the trump team which he said had poor communication, shakeups and management problems. Kristen welker is at the white house with this. We knew based on the reporting from sources, this was happening, but it is very interesting that david schoen is putting it on the record at this point. Tell us more about what were learning in this interview . Its pretty fascinating, hallie, and youre right basically what were learning from david schoen underscores are reporting in the sense there was miscommunication and a lot of lastminute decisions that were happening. Schoen weighs in on the fact that there was a lastminute shakeup, remember the legal team that we thought was going to be in place about two weeks before the trial was not the legal team that ultimately wound up defending former President Trump, in part because some of the members of the previous legal team didnt want to argue something President Trump wanted to talk about, which is his baseless claims of election fraud. They changed strategy there. New legal team. And new set of problems. David schoen says that there was some miscommunication between him and bruce castor who was really in charge. Let me read you one of the key graphs, hallie, from this new interview. He says, Trumps Team Asked me if i would work with bruce castor, if i would take the lead and so on, but then castor would help me and he has a firm that can help and all that, the alabama based attorney explained. Im not sure that message was communicated to him clearly enough because he never seemed to quite understand that i was supposed to be the lead in the case. Now, i have reached out to bruce castor and i havent gotten a response to that specific quote and to these broader allegations, but again, you and i were reporting on this all of last week and we know that a lot of these decisions were coming together last minute, including and especially the first testimony we heard from bruce castor, which was criticized as being rambling and not focused. He acknowledged at the time that they had changed their strategy, what they were going to talk about, based on what they thought was a very strong presentation by the house Impeachment Managers. So here we have it on the record from david schoen himself, hallie. Schoen also saying of that introductory performance by bruce castor that was widely criticized that he wasnt sure how castor was going to get up in the morning, thought his career was going to disappear but castor thought he did a good job. Appreciate it. Speaking of what happened on january 6th right now, youve got more than 200 federal cases happening related to the Capitol Riots. The fbi has linked at least 40 defendants to extremist groups, so an actual physical community of friends or allies like the proud boys or oath keepers and at least 59 other cases the defendants are linked to violent or extremist rhetoric, Conspiracy Theories or far right connections on social media including parler. Remember parler . Its a site that doubled its number of users after facebook and twitter cracked down on the accounts spreading misinformation. As we told you about a month ago its been dark after amazon, google, and other Tech Companies cut off parler because users were promoting calls for violence around the time of the capitol riot. This Morning Parler is back. It is revived by a new host, sky silk which is a web Infrastructure Company out of l. A. Joining me reporter for the Washington Post and msnbc Technology Contributor tony rahm. Good morning to you. Hey, good morning. So, parler is revived. It is back up and online this morning. How is day one going . Yeah. Things are a little bit slow but it is back. I mean remember, as you pointed out, this was a service, very popular among Trump Supporters, among others in some of these far right communities, that had been used to sort of talk and some cases perhaps to plan the activities that we saw leading to the deadly mob that stormed the capitol about a month ago. You go on to parler you will find a slow but generally functional website. That being said, it is blocked in some other cases so the Apple App Store and Google Play Store which took action to ban the app both continue to ban the app so smartphone users will have difficulty there. So what about the issue of monitoring things like dangerous rhetoric, right, or groups on parler . This was an issue that other companies had and why parler got booted off these Server Companies in the first place. They raise those red flags. Parler ceo has said and tends to come back with the idea that the sites goal is freedom of speech. How does this play out differently if it does play out differently, now that theyre working with sky silk . Right. Parler made this huge case that it was the Free Speech Network and really what that ended up being in the eyes of experts was free for all where people were planning attacks and spreading disinformation and other sorts of things without the same kind of moderation that you would normally see on a site like facebook and twitter which take a lot of criticism for not doing enough in the first place. But that being said, the companies took action because there werent those strict Content Moderation Policies in place. Parler and the new ceo say theyre looking to tighten up this stuff, and its unclear if thats going to be enough perhaps to lift this digital blockade that keeps the app off of apple and google devices. Suffice it to say in the eyes of lawmakers its probably still not going to be enough and those who have sought regulation in this space are likely to continue to push for regulation here. So you dont see anything stopping that at this point, tony . In terms of Parler Operating for right now, sure. Weve seen other sites disappear and come back as they have found more sympathetic Hosting Platforms than some of the Bigger Companies like amazon, but with respect to regulation, i mean weve heard talk about section 230 over the years the federal law that protects websites and platforms from being held liable for what their users say. Lawmakers have been looking to turn up the heat in recent months, they have said that they are looking to change this law as a result of the attack on the capitol, so to that respect, you know, the investigations and other scrutiny are likely to continue on capitol hill no matter what parler does in the next few weeks or months. Tony rahm, it is always great to have your perspective on the show and your phillies hat in the background, thank you. Thank you all for watching this hour of msnbc live.
