On whether this trial is even constitutional. That is going to happen tomorrow. Then wednesday you will see the start of up to 16 hours of debate for both the house Impeachment Managers and the defense team. Thats the Timeline Portion of this. And, again, if that holds, it is unlikely this trial would wrap up by the end of the week. What else we know about potential witnesses, whether the trial will go through saturday and the timeline now on a final vote to acquit or convict. Lets get right into it with nbcs monica alba in West Palm Beach florida, Leigh Ann Caldwell op capitol hill, Steve Kornacki at the big board. Leigh ann, this is coming in in literally the last two and a half minutes, i think. Tell us more about these impeachment i dont want to call them rules but perhaps signals that we are getting closer to what this trial is going to look like. Reporter thats right, hallie. Were 26, 27 hours away from the start of a trial and they really cut it up to the deadline where Senate Leaders are nearing an agreement on what this trial would look like. There were so many questions up until now, including on that issue of witnesses. So what the rules state as it states now is that witnesses would only be called after the senate votes to agree to hear witnesses at some point in the trial. So thats a clear indication that we might not see witnesses. The timeline also suggests that each side gets 16 hours to make their case. That means with the trial essentially starting in the middle of the week, it could go into a second week. So that means that its very unlikely to wrap by the end of this week if they use all of their time. But that first day of the trial, tomorrow, hallie, is really critical because theyre going to be four hours of debate on the constitutionality of the trial alone and then at the end of those four hours senators will take, again, a vote on if this trial is constitutional. Remember we saw that vote take place a couple weeks ago. Right. When senator rand paul forced that through the senate, 45 republican senators voted to say it wasnt unconstitutional. So why are they doing it again . Well, now theyre going to have that vote after theyre hearing from both the Impeachment Managers and the Trump Defense team on it. So theyre going to have perhaps a much more informed decision and so that vote talley could, in fact, change, especially after that rand paul vote a couple weeks ago, there was a lot of grumbling from some Senate Republicans saying that was not fair, they did not want to take that vote at that time and they didnt want that vote to necessarily lock them in into what was going to happen in the Impeachment Trial. So now that we are understanding a little bit more of the parameters of what this is going to look like, its going to start tomorrow with a very important face test on if this trial is constitutional or not, hallie. Leigh ann, explain that a little more of why were holding this sort of second vote on constitutionality. Why the senate is holding that. Is that because some republican senators had basically said, listen, we want more debate before we vote on this kind of thing or we would have liked more debate before we voted on this versus the last time around . Reporter absolutely. So last time senator paul sprung this on senators, there was no debate, there was a constitutional law professors writing opeds in newspapers and that was the extent of it. This time the Trump Defense team is most likely going to say that this trial is unconstitutional. They will have two hours to argue that case. The Impeachment Managers of course are going to say this is absolutely constitutional, they have written that in that i were 80page brief and they are going to argue that before the senators. So now they can make an informed decision on if this is constitutional or not. You can be sure that that vote is going that theyre going to vote that it is constitutional because democrats control the majority, but what were going to be looking for is if there are more than five republican senators this time who say that it is constitutional and that could be a better indication of what the final outcome on the conviction or acquittal of the president , what sort of talley that looks like, hallie. Lets keep in mind the math here, monica, before i get to you. The bar is to get basically 17 Senate Republicans, thats the number you would have to hit, the threshold you would have to hit in order to convict former president donald trump. As leigh ann said five back a couple weeks ago did not say that the trial itself was unconstitutional. You would need, leigh ann, im not a math major, im a journalist but you would need a dozen republican senators to basically flip their vote from last time around to this time around in order to give i would say hope to perhaps the house Impeachment Managers that they could actually convince enough senators to cross the line there to cross the aisle. Monica, i know that this is all happening in the past couple of minutes, i cant imagine we have reaction from the Trump Defense team but they would have been represented in these discussions, we are getting more of a sense of what that defense for the former president is it going to look like. Reporter exactly, hallie. What i think is so notable here is what we had heard from the former president s team, they want this debate to be a the constitutionality because they feel they have a very strong case when it comes to particulars. We saw an all from chuck cooper who is laying out the facts that the constitutionality doesnt have much merit that these proceedings are legitimate and thats because so much has been learned and debated just in the last week or so alone after we did see that initial vote where 45 Senate Republicans had questions about it. So i would imagine this is some welcome news to the former president s attorneys in terms of them wanting to have this debate even though its so notable, hallie, as you know while originally donald trump wanted the people representing him to actually bring up baseless claims of voter fraud, but that has not been included in the pretrial brief so far. We are going to get a glimpse into more of their legal strategy later today but Something Else about the timeline here as were getting new details just in. The fact that the former president s team has asked that there be no proceedings on friday evening or on saturday to respect the Jewish Sabbath means that the trial could potentially then resume on sunday. Thats not something that would traditionally happen, its not something that happened a year ago under the former president s first impeachment when he was in office, but that now is all being debated as theyre going to lay that out. Following that all pretty closely as you can imagine, hallie, is the current occupant of the white house and the president now joe biden just told reporters on his way back from delaware and into the white house he was asked specifically about this question of whether donald trump should testify and he told them, look, he got an offer to come testify, he decided not to, we will let the senate work it out. And that raises all kinds of questions about the sort of counterprogramming efforts that the current president is going to be offering as his predecessor is on trial. Remember a year ago when donald trump was acquitted he was doing all of these campaign rallies, he was out doing all of these events at the white house offering his own counterprogramming, a very different schedule, though, for joe biden and the white house this week as they look to get this trial wrapped up fairly quickly so that then they can get their legislative agenda back on track in their view, hallie. Let me bring in msnbc legal analyst paul butler to get a little bit of reaction to what were seeing as we get closer and closer to these trial rules. Paul, one of the things that this person familiar is telling our team over on capitol hill is that at the request of the managers there will be a debate and vote on calling witnesses if the managers actually want that. How do you see this playing out strategically over the next, you know, four to eight to however long days that this trial would last . So the president is arguing the law rather than the facts because the facts arent on his side. His only factual defense is that he believed that he won the election so he was never actually trying to incite an insurrection, he was just trying to get the votes counted. Thats undermined by all of the videotapes and witness statements from the actual rioters. On the law hes making two arguments, one that there is a First Amendment protection for his words, and second, that its unconstitutional to impeach a president after he left office. The First Amendment argument doesnt hold water. You cant cry fire in a crowded theater and you cant send an angry mob to stop Vote Counting in a democracy. I think that he has more room for debate on the argument that its unconstitutional to impeach a president after he left office. The problem for the president is its not the Chief Justice that is going to decide that legal issue, its Senator Leahy who is the presiding officer. He is a democrat and for both, i think, political reasons but also for constitutional reasons hes likely to decide that the impeachment even of President Trump after he left office is constitutional. Leigh ann, can i go back to you on this question of the potential for witnesses . Do you see that happening . What is your latest reporting on what the house Impeachment Managers may do for the sort of prosecution side of this thing . Reporter so, hallie, most democrats in the Senate Anyway and republicans, too, dont really want to see witnesses. Thats because they think that there is evidence enough, we know that theres going to be a lot of video played in this trial and to tell the story and to try to associate the former president with what happened on january 6th, but the fact that last week the Impeachment Managers they surprisingly called for donald trump to be a witness was an indication that perhaps they do want some witnesses to be called in this trial. The president s defense team shut that down. And ultimately according to these rules it is up to the senators to decide if there is going to be witnesses or not. So this trial is going to start without the fact that witnesses are going to come testify should you say, and the only way that it will change is that if there is a vote called to bring witnesses and if a simple majority agree that witnesses can come. So at this point it doesnt look like theres going to be any witnesses at the trial, hallie. So tomorrow weve got that debate on the constitutionality, the vote on the constitutionality of the trial after a fourhour debate. Wednesday is when, listen, the meat and potatoes of this thing goes on. 16 hours aside for presentations, thats when the arguments really begin. Steve kornacki, let me go to you on this. I am thinking back to the last Impeachment Trial of donald trump when we also got rules, these Sort Of Closing In On Rules of the trial very close to when the trial actually began. Do a little bit more comparison for us here. Public opinion on this compared to the last Impeachment Trial, theres new numbers. What are they telling you . Yeah, whats similar, whats different between now and the last time donald trump was coming before the senate for an Impeachment Trial. So right now if you look all the polling thats out there on that question of what should the senate do, should the senate convict trump, should the senate acquit trump its 50 on average say convict him, 43 say acquit him. That is a little different than we saw on the eve of his trial last year. Then the average on this same question was dead even, it was 47, 47. So theres been a little bit of an uptick there when it comes to conviction support, a little bit less in terms of acquittal support. So there is a difference there. There is a little bit more support right now for convicting trump than there was a year ago. Thats whats different. Whats not different and what i think is probably relevant to the political questions youre talking about here is this, among Republican Voters this looks like it did last year. Single digit, less than 10 support for convicting trump overwhelming nearly 90 opposition. Again, youre talking about it. Republicans it would take 17 republicans in the senate joining with all the democrats for trump to be convicted and, again, those republican senators looking at poll numbers among Republican Voters that look just like they did a year ago. We are in the midst of trying to get our arms around all of the increased spikes weve seen from the holidays and travel and now we have potentially another major event like this. I spoke with the mayor in tampa and asked her what are you doing about it . She said her hands are to some extent tied because she finds up about the parties after the fact, they talk to the businesses and ask them to modify their behavior. Caster said this is coming from tallahassee as well. There is an Executive Order from Governor Ron Desantis not to shut businesses down in the midst of this pandemic. As a result what shes doing is going and finding the individual businesses, but that takes time. Theres obviously a legal back and forth and if you are looking to shut something down immediately, its not really going to be that efficacious. That is where we find ourselves, in florida a state that has 1. 7 million cases of covid and climbing. Its not just whats going on here, its tens of millions of households all over the country and people partying all over the country getting together in close quarters that could really drive another spike and we are hoping that thats not what happens. Kristen, in his First Network interview as president before the super bowl President Biden is talking about covid and talk being what the super bowl might look like next year. Here is what he said. Its my hope and expectation if were able to put together and make up for all the Lost Time Fighting Covid thats encouraged that we will be able to watch the super bowl with a full stadium. So, kristen, what is the latest from the white house on fighting the virus and specifically on covid relief with more developments on that front . Reporter hallie, what you saw in that interview was President Biden trying to underscore the urgency for his covid Relief Package and thats going to be the key focus this week as the president does try to counterprogram former President Trumps second Impeachment Trial. Hes going to be trying to put the focus on covid, on the economy. Today, for example, hes going to have a virtual tour of a Vaccine Processing center, he will have more events like that throughout the week. Im also told that he may be meeting with state and local governments, governors, mayors, to try to build up support at the local level for his covid Relief Package, hallie. That will have political implications and it could have Practical Implications as well because, of course, as you know many republicans, some democrats, have said that 1. 9 trillion price tag is just too high. There is a lot of discussion behind the scenes right now about making those 1,400 direct payments that the president is proposing more targeted based on income level but no determination yet about where those Income Levels will fall. Bottom line there is a lot of pressure to try to get that Impeachment Trial wrapped up quickly on all sides, particularly from President Biden because he wants to move forward with this covid Relief Package, hallie. This morning as we follow those new details just in this hour about what that upcoming Impeachment Trial starting tomorrow is going to look like, ahead of it the gop Identity Crisis is getting a little more complicated. You have one leader publicly urging her party to try to move past donald trump. We have to really take a hard look at who we are and what we stand for, what we believe in. We should not be embraing the former president. Congresswoman liz cheney also saying the former president lied to americans when he said constantly the election was rigged. If republicans were looking for perhaps an apology from liz cheney they are not getting it. That said, Party Leadership is standing pretty publicly with donald trump. A lot of voters, though, do want to move on from the former president. Listen. I just think right now with the other things that are going on in the world we should be focusing on getting businesses open and getting people back to work, getting people fed and actually part of a Nonprofit Group i actually have a load full of groceries in the back of my car right now, meeting people to drop off. People are angry, thats what we should be focusing on. I want to bring in now former republican representative from florida, francis rooney. Congressman rooney, thanks for being back on the show. Thanks for having me on, hallie. So i want to talk broadly about the Republican Party but let me start you off here. I dont know if you had a chance to listen to the top of our broadcast about what this Impeachment Trial may look like. Im curious as somebody who obviously is an observer of your former workplace, if you will, your initial reaction to the news that we will see now a vote tomorrow on the after a debate on the constitutionality of the trial before arguments start on wednesday. Yeah, i think what ive read its probably constitutional to do it and certainly the behavior of the president before those people assaulted the u. S. Capitol was abhorrent at minimum and could be impeachable. When you look more broadly this Impeachment Trial has laid bare some of the cracks, right, that exist inside the gop, particularly after, of course, the election, what happens in this posttrump era. You heard from one of the voters that one of our Team Members Went out and talked to over the weekend, for example, some who say, yes, it is time to move on from donald trump. How do you do that when this next, you know, listen, couple of weeks is going to be largely dominated almost entirely dominated on the political front in congress by the former president . Yeah, thanks to trump everything is turned on its head, you know, as president bush used to talk about theisms, isolationism, protectionism and nativism which were not Republican Issues at all and now they are. Populism used to be a democratic dogma under William Jennings bryant, et cetera, and we used to stand for reasonable gun reform, reasonable support of the environment, global institutions, free trade, Fiscal Conservatism. We are stuck with a declining demographic, we have to be reaching tout to growing demographics with a more inclusive message. At the same time you have donald trump jr. , for example, telling political playbook this morning, hey, i hear primary season is lovely in wyoming, basically previewing that he is going to be out there fighting against her reelection. I read about that and its disconcerting to hear continued talk about the trumps. I dont think it was particularly valuable that Majority Leader mccarthy went down and, you know, pumped him up and supported him and all that. I think we ought to just let him go on down the road and refocus on getting our message together. For the First Time Ever i dont think the Republican Party had a platform in the 2020 elections. Just like whatever trump wanted. So whats the message got to be, then, if its not going to be that . Well, like i say, i think we go back to the traditional Republican Party that ive been a member of my whole life, the party of reagan and the bushes, of globalism, global institutions and free trade, private Sector Solutions instead of government ones. Certainly reasonable Fiscal Conservatism which we seem to have abandoned. Remember in the 150th congress we spent as much as the Obama Administration spent per day. So we need to get back to the basics that define the Republican Party. Remember that president bush tried to make the Assault Weapon ban permanent and approximate both bushes expanded the clear air act and nixon set up the epa. We used to be environmental people now we dont seem to stand for any of that stuff. Former congressman francis rooney. Let me bring in nbcs Shaquille Brewster from a shelter in chicago. Talk about this rollout, how its going and what the reception from the public has been like. Reporter well, hallie, this has been a priority for the city and for homeless and health care advocates. This he say this is a matter of protecting lives. Theyre race to go vaccinate people in the shelters not only because of the outbreaks that you see there but they know that people in the shelters, people who are homeless, the Homeless Population have a Life Expectancy thats lower, have conditions that make the coronavirus deadlier. So if you want to target saving lives the shelters is where you need to go. The problem is, and there are some challenges here, its that there is that deep skepticism of the vaccine. That exists throughout the country, exists within shelters as well and especially when the vaccine requires a second dose. I talked to the Nurse Practitioner who is leading this effort to vaccinate the Homeless Population. Listen to what she has told me about the complexities of making sure they reach people who might not have an address to put down or a phone number to put down to make sure they come back nor that second dose. It can be very difficult, but the systems we have developed over the past 30 years with our tv program and with our Homeless Health and outreach programs theyre able to track we hope most of the people and that they will be able to come back and get their second vaccine. Reporter and vaccinations started just about ten minutes ago. I spoke to the first person who got his vaccine today, he was initially skeptical but by the end after asking his questions he said it was a blessing that they were there to help him. Shaq brewster live in chicago, thanks. Back on capitol hill, democrats determined to move this week at whats basically Lightning Speed on covid relief. You have the Senate Holding the Impeachment Trial but nine House Committees are set to take up that Relief Package and move it forward almost right away. Not a ton of time to iron out sticking points or details or new proposals. Democrats getting ready to unveil another that will give families up to 3600 more per child. Looking at that Mid March Deadline to have the package at President Bidens desk. Joining me now is democratic congresswoman rosa delauro of connecticut, chair of the appropriations committee. Listen, people might youve been pushing for this expansion of the Child Tax Credit for almost 20 years. Almost 20 years. I thought Jared Bernstein the white house economic adviser told the 19 today that as the white house was putting together this economic package you called him and in language he described as somewhat juicy you were very emphatic about what needed to happen with this tax credit. What did you say . What do you think this has to be included an does it have a chance at getting through . Listen, i had willing partners with the administration on this effort, but, you know, in the United States, hallie, the United States is exceptional and we are admired all over the world for so, so many things, but not for ending Childhood Poverty and when we take a look at what the virus has done, it dramatically has worsened Childhood Poverty. So what we will see in the president s rescue plan which will be unveiled by our ways and Means Committee that, in fact, we will the family act which will make available for one year expanding the current Child Tax Credit and that will begin the process of cutting Child Poverty in half. As you said, im particularly pleased, ive been working on this since 2003, but also later this morning which is important is congresswoman susan dell benny of washington, congressman Richard Torres of new york and i, we are going to introduce the American Family act which will make this expanded Child Tax Credit permanent and that has such a potential, just very briefly, it cuts Child Poverty in half for black children, 40 for latino children, 61 for nativeamerican children, asian asian children, et cetera. It is transforming and lifting youngsters out of poverty. Do you think, though, congresswoman, that by including this it might make it harder to get bipartisan support for the Relief Package just looking at the realities politically, you know, on the house and Senate Floors . Well, i mean, i think that republicans have joined the debate in several ways, you know, senator romney has a proposal that is out in the past senator rubio, mike lee has been supportive of it. My hope is when you see the scope and the breadth of the potential of the Child Tax Credit, that what we do is that we bring the opportunity to transform the effort on Child Poverty. This is not just throwing money at a problem. This is building the architecture for the future. Transforming a little bit like social security. Think about that. 90 of seniors were lifted out of poverty with social security. Thats the kind of effect we can have with the Child Tax Credit. I hope they come along. Very quickly before i have to let you go, congresswoman, i have to ask you at the debate on lowering Income Eligibility for the covid stimulus relief checks, Senator Sanders called it absurd from a political perspective that people who would be eligible under former President Trump would not be eligible under President Biden. Should that be part of the calculation . No, we need to people are in desperate, desperate economic shape today and what we need to do is to provide them with the additional 1,400 as the president said that he is going to do. Thats what the calculation needs to be. Lets make sure that people can get back to the Economic Security that they need to in order to take care of themselves and their families. Okay. Its not fettermans first time running in the democratic primary for senate, but he is certainly a much more prominent name this time around. Why . Well, he was one of the most visible state officials fighting back against former President Trumps false Election Fraud claims and lawsuits in those weeks following the election, unleashing some of the most fiery and memorable responses, just a few on your screen there. Calling the lawsuits dopey, the president can sue a ham sandwich, taunting the former president and his team over what he perceived as flawed legal strategies now the springboard for todays announcement. Before i get started im pleased to report that donald trump retains 100 of the dead relative vote here in pennsylvania. We uncovered another case of voter fraud, coming for him. We can rest assured that pennsylvania had a free and secure election. Still going after former President Trump. Is that why you decided to run . Talk to us about your decision here given that recent history, you know, all of it in light of the Impeachment Trial starting this week. Yeah, you know, my decision to run really is the culmination of full circle of the values, policies, principles, places, people, why i came to a marginalized place like braddock 20 years ago. I would encourage your viewers to go back and think about where the Democratic Party was back in 2001 a few years after ending welfare as we know it, a few years after the now infamous crime bill. Now i showed up here 20 years ago to really work against the raging inequality that i saw as a fundamental threat to our democracy and to our nations health. So lets talk about what would happen if you were in the senate. Youre obviously not right now. We know your position, you made it very clear at the top of this interview about donald trump. If you were in the senate right now, obviously this Impeachment Trial begins tomorrow. Votes could happen possibly by the end of next week. You would vote to convict, is that a safe assumption and if so if that didnt get through would you vote to censure as some Democratic Senators have suggested . Yeah, no, i would promise to the people of pennsylvania i plan to be 100 seditionfree if im elected to come in. Theres already too many seditioncurious members of the United States senate and i would never be one and absolutely the president should be impeached for his conduct simply because of the fact that if not helping incite a riot where Police Officers were bludgeoned to death is not grounds for that then why do we have that on the books in the first place . There are a lot of voters in your state, i dont have to tell you, who support donald trump. Why should they vote for you to represent them in the senate . Well, i mean, theres some of them that absolutely wont and i accept that. I would rather not have someone vote for me and then tell the truth and what i believe i know to be true, whether its about paying a living wage that people can survive on, whether its that health care is a fundamental human right, whether its the members of our lbgtqia communities deserve equal protection under the law, whether we should have compassionate common sense Immigration Reform in this country and end this war on drugs and legalize weed across the United States, whether we should address the Climate Crisis we are confronting this this country. Theres so many things that need to get done and if you dont agree with me on any of those, i would hope you can still vote for me, but you will at least know where i stand proudly and i have for the past 20 years. So let me ask you about some of those issues because some of those will be things that of course a senate will have to be thinking about in two and a half years from now, two years from now. Let me start to get things through there is a discussion among some Democratic Senators that you need to basically end the filibuster, which is sort of the long way of saying that 60 vote threshold to get things done. Theres not unanimous agreement in your party in the senate on what should happen. Do you agree . Would you support ending the filibuster if you are in the senate . Yes, i would. And here is why, because these are some fundamental changes that are truths. Like if you dont support raising the minimum wage to 15 an hour i want you to live and work for 7. 25 an hour and show me how you can get by and feed your family quite frankly. In order to get those kind of important things passed, whether its Climate Change or things like that, you need to get rid of the filibuster. This idea that some random senator from a state with 600,000 people can hold up the democratic will and the sense of urgency that these policies are coming from, i dont think thats very democratic at its core. Would you vote as it stands right now in support of President Bidens 1. 9 Trillion Covid relief plan . I would, but i was also deeply disappointed that it appears that the 15 an hour minimum wage isnt part of that, which i think it absolutely must. To me thats absolutely critical. I mean, you can send checks and we should because people are hurting, but what would that mean to millions of lowwage workers across pennsylvania and the United States to say, hey, weve got a check for you now, but we have a giant pay raise for many of you in the pipeline because you deserve it. You know, we have a body of individuals making 175,000 a year saying thumbs down on raising the wage from 7. 25 an hour. Its immoral. Its outrageous. And its also a mathematical impossibility. We must raise the wage to 15 an hour and if that costs me votes, hey, so be it. But im always going to tell the truth because its a mathematical certainty. You mention in the Climate Crisis and i dont actually knowers i dont know youve talked about where you stand on this issue. One of the Executive Orders that President Biden did early on in his time in office is to end construction on the keystone xl pipeline. Do you think that was the right move for President Biden . I think he President Biden is walking the line appropriately between acknowledging that our Energy Sector is home to lots of jobs and also the reality that our Energy Sector provides the fossil fuels provides 40 of our nations electricity, but he also recognizes how critical it is to address this Climate Clim Emergency and is making that a priority. We had a president who was tearing up the paris accord and other agreements and throwing Environmental Concerns away. Now you have a president who is building that back and making decisive actions like cancelling the Keystone Pipeline which some people dont support. I think he made the right call. Theres a lot of projects that i do support, including one across the street from my home. Thats the expense of a 1. 3 billion green is steel. We must maintain a balance between transitioning away from fossil fuels but holding the union way of life sacred and protesting those jobs and those workers that are in that sector. Given that response, safe to say you are not fully or wholly embracing the Green New Deal . Im embracing what the green ideal considers a priority. The Green New Deal isnt a specific piece of legislation. What i am in support of is acknowledging that the Climate Crisis is absolutely real. The science is clear. We must act decisively. We also must protect and we also must have a realistic transition. I want to emphasize, since my First State Run in 2015, i have never accepted a dime of Fossil Fuel Money ever in my first senate race, in my race for Lieutenant Governor. I have signed the Fossil Fuel Pledge Money Banning for the 22 race i just entered. The decisions and policies that i believe about this industry come from a place of sincere belief and understanding that often two things can be true at the same time. But its never because i received a single dime from the industry or anyone that works within it. You were a big backer of Senator Sanders president ial campaign in 2016. Former sanders supporter yourself. Do you have a concern that you are too progressive . No. Im Lieutenant Governor. The Second Highest Office holder. Pennsylvania must like something of what i stand for. I dont consider my policies progressive. Its a fact you cant live off 7. 25 an hour. Its a biological fact that you are going to need health care. Everyone should have access to health care. The climate is changing. We have to address it. The Lgbtq Community deserves equal protection under the law. Marijuana was legalized in south dakota. How are we behind south dakota on any issue . I dont think im too progressive. The voters of pennsylvania didnt think so. The delay is killing me here. Im sorry. I wanted to ask quickly before i have to let you go, you make the point one of your slogans is voters in every county, every voter, thats who you are looking for. Did the events you and i have talked about the postelection claims that donald trump made, the lawsuits filed, did the act of what happened on january 6th, is that what motivated you . Is that what put you Over The Edge to make this run . Yeah. That certainly crystallized it. Just spending months defending the lies. When i was growing up, we used to call them lies. They need to be called what they are. I mentioneded it earlier, four cases of voter fraud and they will say there was fraud in pennsylvania and thats a lie. We cant have a that. It came together in a way i never would have foreseen. So many lines have been crossed over the last three months that i didnt think we could or would in this country. Absolutely, its what crystallized it. Finally, what made the decision that much easier was that 38,000 and counting grassroots donors have stepped up when we announced were just kicking tires, looking at this race. Those folks stepped up and today was my turn to do that. Im so grateful for their support. Im honored that these folks have chipped in an average of 30. Thats the way campaigns should run. Speaking of former president donald trump, new Breaking News on his Impeachment Trial. His lawyers filing a memo as we were having that conversation. Among other things, unsurprisingly, calling this trial unconstitutional. That has been the argument that they have been previewing for several weeks now. I want to go back to our White House Correspondent monica alba who is in West Palm Beach. This is 78 pages long. It just came out in the last eight minutes. I dont expect you to have read all 78 pages. Give me the highlights. What do we know . Reporter thats right. My colleague on capitol hill and myself getting our first look at this trial memo from the former president s team. They go into great detail specifically on then President Trumps remarks on january 6th at that stop the steal rally where he did encourage his supporters to, quote, fight like hell and walk to the u. S. Capitol. They are arguing in this brief that all of that should be protected by Free Speech Protection and First Amendment rights. Thats a big chunk of the brief. In addition to that, they delve into these questions of the constitutionality of all of this. They are going to argue that the senate does not have jurisdiction over a former president , only over a sitting one. They go into that in a number of pages as well. The major conclusion from this, hallie, does come down to a question of this single article of impeachment presented by the house, they write, is unconstitutional for a variety of reasons any of which would be grounds for immediate dismissal. They demonstrate that indulge House Democrats hunger for political theater is a danger. One detail, we know who this third attorney is thats been added to the former president s team, michael t.
