Starting on tuesday there will be a 23u78 ber of opening arguments, then pre battles, rebuttals and senators will be able to speak about how they may vote. Finally, that final vote on whether to convict or acquit the final president. One thing that senators want to leave in the past is the long and lengthy trials. We remember during the first Impeachment Trial of the former president , it lasted roughly three weeks. Senators hoping this just goes until saturday, so not even a full week. Also, one thing we do know, one of the very few things that are concrete is the fact that the president has said he is not going to come the former president has said hes not going to come forward and testify in person during this Impeachment Trial. The House Democratic managers, Impeachment Managers say that shows a form of guilt, that President Trump has no defense whatsoever. They will actually continue to make their arguments by appealing to those 17 republican senators by reminding them about how they felt when they were all in hiding and trying to make sure that they remember that once the insurrection passed, that they came out, including some of those trumpsupporting republican members, who said that trump bear some brunt that what happened, he did incite some of this violence at least through his rhetoric. You remember minority leader Kevin Mccarthy saying he did and then switching as time went on saying, well, theres many people involved that caused this to happen. So they are very much trying to make emotional appeals, not only talking about their own testimony and what they went through during that day, but also making sure that their colleagues as well as staffers discuss what had happened to them on that day. You guys obviously showed that video where a number of Trump Supporters said, listen, we came here and were also leaving because the president told us to do so. A lot of evidence pointing to trumps rhetoric over time, especially in those leading days to hopefully get those 17 votes to formally convict the president. That is what democrats are hoping for. Monica, the former president s defense team will plan to say this isnt constitutional, you cant try to impeach a private citizens. 55 senators voted that it is constitutional to go ahead with the trial. Exactly, lindsay. The counterpart is what the former president s leigh Legal Defense team is also going to make a central argument here. Theyre going to say only five Senate Republicans said this could proceed. And it was the 45 other republicans who had issues with some of the constitutional questions. Thats really what has given david shone and bruce castor, Donald Trumps two attorneys, a lot of o confidence and what they would say even optimism about the outcome of this trial. Thats why they feel at the end of this donald trump will be acquitted for a second time. The other thing, of course, that is very different than the first Impeachment Trial is also a centerpiece of the case that theyre going to make which is the fact that now he is a former president and a private citizen, theyre going to say because this is the first time weve had a former president on trial in the senate, for inciting an insurrection, theyre going to say thats unconstitutional. Theyre also going to essentially say that what donald trump said On January 6th when he told his supporters to fight like hell and head to the capitol, that that might be protected under his First Amendment rights and free speech. Thats an argument theyre also going to be prepared to make. We know both of those things because they included them in a pretrial brief that was submitted last week. We dont know a lot more about schedules, questions, testimony, further witnesses. All of that is expected to be revealed tomorrow when we get some more guidance from the senate on what the rules are going to be. We also know from the former president s team, they dont expect this trial to go on very long. They think it could even be less than a week, but were not sure because we dont know what the expected schedule is. In terms of the former president , since hes been stripped of his preferred social media platforms, we havent heard much from him apart from Press Releases from his official office, its likely well be getting reaction. Its striking, kendis and lindsay, to think that a year ago when donald trump was in his first Impeachment Trial, he was not only reacting on twitter, he was on the Campaign Trail Holding rallies and had a complete team to try to do a counterprogramming effort. Ironically thats what were going to see from President Biden next week in washington, to try to make his own case for why people shouldnt be putting too much emphasis on the Impeachment Trial and more on what his priorities and legislative agenda is going to be in the coming days. We saw when congresswoman Marjorie Taylor greene, many republicans siding with her to make sure she wasnt stripped of committee assignments. She said, my vote to impeach complied with my oath. She will likely continue to act and likely condemn the former president. I dont expect americans to be unified on much of anything these days. Im glad that the senate is moving to the trial. We impeached the president for what i believe and many believe is the most heinous act ever committed by a sitting u. S. President. I think the American People should see the case and hear the case against him. We pend to see everything through a partisan lens. Nearly 30 million on additional inaugurationrelated security and the rest on legal challenges and security for election officials. Would it benefit democrats to bring this up during the trial . I dont think thats the main point. I think were talking about a president who was reckless throughout his term, was never aware of the consequences of the things he did and said. That to me was the greater flaw is the greatest flaw in donald trump, is that he never understood the consequences and he was never held accountable for the consequences of his actions. Again, this is one more piece of evidence about what a flawed human being donald trump is, and someone who never deserved to sit in that office, and i think were all glad most of us are glad that hes gone and cant do anymore damage. The law about whats unconstitutional is whatever the senate says during an Impeachment Trial. For one thing, this president was impeached while he was still in office. He just left since then. So if we were to say its unconstitutional, that would mean there would be sort of a january forgiveness clause. Here is the analysis, lindsay. The First Amendment can protect a private citizen from being convicted of a crime in certain situations. Your free speech overpowers the governments right to criminalize your conduct. That doesnt apply in this case to a then sitting president because he is, of course, the government. When he comes up for trial in the senate, its not for a crime. Impeachment is about whether he violated his oath of office, whether or not he committed high crimes and misdemeanors. Thats something separate from the criminal interaction with the First Amendment. For the sake of argument, lets say the First Amendment applied to President Trump in this instance, the speech he engaged in here would not be protected by the First Amendment. What he did was inciting a riot. Thats what the charge is, thats what we hear e protesters saying, they did what the former president asked him to do. That sort of speech would be exempted from the First Amendment just like you cant cry fire in a crowded Movie Theater to set the crowd off. Thats essentially what trumps conduct here amounts to. It kind of sounds like there might be a case for the d. C. District attorney after this. Its possible that there could be a criminal case. On the other side of this building there are a couple hundred protesters. Thats been the main message. They want to see the officers who have been fired, they want them to face some sort of criminal prosecution.
