Minutes City of South Heart Regular Meeting December 5, 2022 7:00 P.M. MAYOR: Floyd R Hurt Council Members Jeremey Binstock Mike Stick Brock White Arlen Kubas CITY AUDITOR: Renae Praus UNAPPROVED MINUTES: ROLL CALL: Hurt, Praus, White, Binstock, Kubas, Sticka ALSO PRESENT: Kyle Mylar, Alyssa Mylar and their daughters, Paul Clarys (Stark County Commissioner) Mel Zent (City Building Inspector) REGULAR MEETING: Mayor Hurt called the meeting to order at 7:00pm. APPROVAL OF AGENDA: Councilman White made a motion to approve the agenda and Councilman Sticka seconded the motion. All in favor. Motion carried. MINUTES: Councilman Kubas made a motion to approve the November 7, 2022, Regular Meeting Minutes and Councilman White seconded the motion. All in favor. Motion carried. MEL ZENT: ANIMALS AND FOWL ORDINANCE-REVISED TO ALLOW CHICKENS IN CITY LIMITS: Mr. Zent presented the revised animals and fowl ordinance that allows chickens within the city limits of South Heart. The ordinance is very straight forward with restrictions including the how many chicken hens you are allowed, no roosters, a permit needs to be purchased and an inspection of the property they are being kept on. The owners must stay in compliance with ordinance or they will be fined and have to remove the chickens from the property. The council discussed the issue and Councilman Sticka made a motion to approve the preliminary reading of the prepared ordinances allowing chickens within the city limits of South Heart, Councilman Kubas seconded the motion. All in favor. Motion carried Mylar’s family presented another list of residences in the community where they live that are in favor of allowing the chickens to be kept on the property. TREES: Councilman Kubas informed the council he met with Ty Nordby to discuss having the soil conservation plant trees for the city. Mr. Nordby informed him they will not be able to plant evergreens this next year as they are booked out. The cost is .75 cents per tree and the city would have to provide a tractor and a person for planting. The council discussed getting other varieties that are hardy to the area so we can plant them this spring. Councilman Kubas will be in contact with Mr. Nordby and see what varieties we can get for this coming spring. Councilman White made a motion to allow a $4,000.00 budget for planting and buying the trees, motion was seconded by Councilman Sticka. All in favor. Motion carried I DON’T KNOW BAR LICENSE RENEWAL: The council reviewed the license renewal application and had no concerns. Councilman Binstock made a motion to renew the liquor license for the I Don’t Know Bar motion was seconded by Councilman Kubas. Voting in favor Binstock, Kubas, and White. Abstained from voting Sticka. Motion carried SHERIFF/POLICE REPORT: Police Commissioner White did not have any incidents to report for the month. Stark County Sherriff department was not present to give their monthly report. STREET COMMISSIONER: Street Commissioner Binstock did some checking with the highway patrol on issuing permits for overweight vehicles on our streets and reported he was informed the city is only be patrolled by the county. From the city’s understanding we do not have the proper ordinances in place to enforce restricting overweight loads on our streets. There was discussion and the council would like to prepare an ordinance addressing this issue. WATER DEPARTMENT: Mayor Hurt informed the council everything is operating smoothly. SEWER COMMISSIONER: Mayor Hurt informed the council the lift station pumps are operating properly. Mayor Hurt had Dakota Pump and Control out to change seal in pump #2 sat the lift station; they also changed the oil in pumps at the lift station and the water tower. Mayor hurt reported he drained #1 cell into #2 cell at the lagoons. KC PERMIT FOR SPORTS POOL: The council reviewed the permit for a sports pool for the KC Club. Councilman White made a motion to approve the gaming permit for a sports pool motion was seconded by Councilman Binstock. All in favor. Motion carried OTHERS: The council discussed a couple of past due accounts that will be turned over for collection for non-payment. Since both accounts are from properties that have been sold it would not be fair to assess it to the property taxes. The council discussed the past due utility accounts and all utility accounts that are over 60 days past due will be shut off. The service will not be reconnected until the balance is paid in full. Disconnect and reconnection fees will apply to the balance and must be paid in full before the service is reconnected. All in favor. Motion carried. ADJOURNMENT: Councilman Kubas made a motion if no further business to adjourn and Councilman Binstock seconded the motion. All in favor. Motion carried.
