The court brushed aside a colorado rulinguclaiming that he disqualified himself from office because ofuhis actions during the january 6th insurrection. Colorado maine and illinois had all decided to kick trump off for allegedly violating the ruling also stops efforts in seven other states with similar court cases. I think it will go a long way toward bringing our country together, which our country needs. If this was allowed to go forward. The colorado the decision to unilaterally remove the choice from the people, all, um, that it would create an untenable. Mr. Trump faces a much bigger legal problem next month, when the justices will hear his argument that he cannot be prosecuted for efforts to overturn the because hes covery president ial now on this decisin and the implications of it. Obviously, a crucial decision for former President Trump as we head toward the november election here. This was a unanimous decision as we pointed out at justices all reached the same conclusion. But it soundsulike they gott there in different ways. How did their reasoning differ . Of the 14th amendment, it was le colorado to take it upon themselves to decide whether somebody was or was not eligible because of the insurrection clause from Section Three of the 14th amendment, which goes back to the civil war, and instead that was something that states couldnt do. Now, theureason why theres a split is to that. Foum thought that the other five, five were wrong to go on to say enforce Section Three of the 14th amendment was that if congress passc it, legislation that explained how to do that, the other four, all the womenl all would have said, lets save that for another day. Thats not necessary to decide today. We agree. Nine nothing colorado cant do what it did. And lets wait andc see if Something Else happens. Okay but david, in this ruling, the Supreme Court did not directly address whether trumps actions on january 6th were in fact, an insurrection. Right . Thats quite right had that he engaged in insurrection. And the four, the three de soto, meyer, kagan and not well, the two of them, uh, said that he they called him a oath breaking insurrectionist. That was the phrasec they said any oath breaking insurrectionists but td that a state could not do that. The majority did not do that. It mr. Trump had engaged in in surrection, the fact that the justices here had had this narrow ruling and avoided this thorny question of whether or not former President Trump actually did engage in doorupotentially to someumore legal turmoil down we head towae november election . Well, what the majority of five and we dont know who wrote it. It was written in the name of the court. We just know the four women did not write that opinionn what they said is they were trying to avoid chaos by cutting off other potential of n three, except for legislation, they were saying, lets not have problems down the road, meaning between now and january of 2025, only if congress wanted to pass some sort of a mechanism to enforce it. Southey saw themselvesuas clamping down on that, while the other four were saying, youre reaching too far, you should only decide whats in front of you. Dont go out on a limb. And they were not willing to go out on that limb with the otherufive. Can we just talk for a moment about the overall view of the i found interesting was Justice Coney barrett and her sort of remarks telling americans, you know, you need to look past this. And the fact that four of the courts members herself included, disagreed with how broadly the colleagues decided this case. But to look past that fact she was trying to make there . Well, i think she was trying to say, look, we are unanimous on this one issue. Yeah. And its interesting that she felt the need to separatec herself away from need to be turningl bringing the temperature down. Right. Its not right for us to turn the temperature up. And if you look at that separate opinion that she wouldnt join in, theres two things going on. One is Justice Sotomayor begins the opinion by taking a little dig at, saying, in the dobbs opinionl the abortion opinion, we shouldnt decide more than we have to. And so theres Justice Sotomayor here saying, uh, i think thats going on. And the other is, as i said, the opinion calls people well, maybe not by name, but we know who theyre speaking of. Uh, oath breaking insurrectionists and obviously Justice Coney barrett did not care for that language as well. Let me ask you, before we this, this ruling from the high spcourt was turned around in an incredibly short period of time. They heard the arguments just last month. We get this decisionn obviously, we know were moving. You know, primaries are underway they wann to happen quickly. But by by the same token, a lot of people are looking at the immunity question. The immunity case thats before the Supreme Court. Whether you know, a, you know, President Trump, former President Trump has immunity. Why is that decision going to take several months all the way into the summer to decide . Right. We dont know. Is the short of it, alex. We do know that they moved quickly on the n today, obviously ahead of super tuesday because colorado is a super tuesday staten they could have moved faster in the in the in the other case because they question in decembern jackthet smiths Prosecution Team asked the Supremec Court to take up te question. In december, the Supreme Court said no. Then they were asked again by mr. Trump. And last week, of course, they said yes, but they could have somewhat lackadaisical schedule. Theres a sense that maybe it was a bit of a compromise, because it took them a couple of weeks to decide whether to take the case or not, and the feeling is maybe the compromise was that if they really wanted to slow this down it to october and to hear the case in october. This way, in april, theyre staying on a semi normal schedule. We know that well get an opinion between anf june, still leaving potentially some time for trials. If the immunity case that goes against mr. Trump. But it is interesting when you contrast the two if they want to move fast, they know how to move fast. Sure. Well, here we are on the eve of super tuesday and the ballots are now set for the republican president ial primary following todays Supreme Court ruling. So, donald trump and nikki haley will be vyingufor the nomination. The democratic candidates, of course, include president joe biden, dean phillips and marianne williamson, and three Third Party Candidates are also running jill stein, cornel west and Robert F Kennedy jr. One third of the delegates for both parties are up for grabs tomorrow 865 of the 2429 republican delegates will be selected on super tuesday. The presumptive nominees will then be finalized at the National Convention this summer. Here in california, there are 169 delegates up for grabs on the republican side, the party recently changed their rules so that if one candidate gets more than u0 of the vote, they get all of those delegates. State democrats allocate 424 delegates from the primary. Okay, other races up for election tomorrow. Two bay area congressional up for election for the first time. Lee, of course, is running for u. S. Senate. She officially endorsed lateefah simon, a bart board member. The top two vote getters in both of theseuraces advanced to the generaluelection, coming up newsom is in San Francisco today ahead of election day, increasing the sppush for the yes on propositin one campaign. The governor was joined this governor Eleni Kounalakis and mayor london breed, along with a coalition of mentaluhealth workers, doctors and firefighters. If its approved by voters, proposition one would let the state borrow d Supportive Housing for unhoused people, Governor Newsom saysuit has bipartisan support in the state legislature. We are in a position we havent been in 50 years to address this crisis. To take this opportunity in this moment, to not just assert ourselves which i think meets way. This was bipartisan in the senate. Opponents however, questioned the constitutionality of proposition one because they say it calls for forcing ill pee streets into treatment programs. They say homelessness cannot be solved through a forced treatment. Among the other issuesc up fr spvote, San Franciscos the power of the San Francisco police department,c allowing for officers to use surveillance cameras and drones with the aim of reducinguofficers paperwork requirements. The Police Commission would also have to follow a new public input process for new policies. The proposition requires a simple majority to pass and proposition f focuses on drug screening. This proposition would require those who receive cash Welfare Benefits from San Francisco to submit to drug screening. If there is reasonable suspicion that they are dependent on illicit drugs. Those found to be struggling with addiction would then be required to enroll in a free Drug Treatment Program in order to keep their assistance, benefits. A petition Voters Office in the effort to recall Alameda CountyDistrict Attorney pamela price, the group save alameda safe says it has cd over 123,000 signatures, on the, but the groupusays it collected more in case some of the signatures are invalidated. The group says da price is jeopardizing the safety of residents and businesses by failing to enforce laws and prosecute criminals. We shouldnt have to do this, but for the safety of our community, the safety of our children, the safety of our businesses had to be done. Thisa right for the citizens of Alameda County. The county registrar of voters has ten days to validate those signatures. Meantime, da price has defended her approach to criminal justice reform. She says to accept the results of a legitimate democratic election to remove the status quo in recent yearsl many californians have switched to becoming no Party Preference voters. Its a different process, however, if you want to voteufor a candidate in the republican green or peace and freedom party, those parties require you to officially reregister either as a member of spthat party can do that at the county Elections Office as well. And so, look, we have spent the vast majority of our advertising budget and our engagement budget on positive messages. Early turnout is trending historically low, older conservative voters outpacing democrats data that favors garvey. As these candidates battle for a position in the top two, theyre urging people to get to the polls. The point that i want to make today, though, is that everyone to the polls to vote, and we have so many trusted messengers who are out there. And as we know, all four of these candidates have spent a significant amount of time because they know the pockets are deep and that voters are incredibly political, politically active.
