Efforts to overturn the 2020 election. Well talk about whats next in the latest case against a former president who is scheduled to appear before a judge tomorrow. Plus, vaccines to fight rsv are expected to be available for the first time, possibly this month. Were sitting down with a Health Expert to talk about everything you need to know about the vaccine and who will be able to get it while its still in the process of being approved. My from Jack London Square this is mornington to the nine. Today is wednesday, august 2nd. Were looking live from Monument Peak and looking at some of the fog there over the Santa Clara Valley and some of the fog will burn off. Well talk about the weather in just a bit because you might want to know what the weekend. Yeah the weekend. I can see the weekend from here. Welcome to the news along with ali and pam. Im Sal Castaneda and were going to start off with a fire investigation. Pam. Yes, we are. We saw that big breaking news yesterday morning. The Investigation Continues after that massive fire destroyed a residential building that was under construction in San Francisco. Ktvu alex was on the scene for this update. And alex, youre talking about some of the roads are still closed. Thats right. Traffic here has been disrupted. Octavia and oak street is where this incident happened yesterday morning. The blaze was destructive to an Apartment Building under construction. Now, along with neighbors and fire investigators, were getting a good look at the destruction of the blaze. Fortunately no one was hurt, although eight neighbors were displaced. Investigators here this morning evaluating the site. No word on what started the blaze. The Fire Department reports theyre investigating is still underway. It was back in may that the haze Valley Neighborhood Association sent a formal letter to both the mayor, the supervisor and other city leaders concerned about street fires. Three have happened along octavia since may. Neighbors also concerned about the many unsheltered people that are living in encampments around this block. Many have reported that there have been unsecured building. The building has been unsecured, and that has had squatters go in and use the space before workers showed up in the morning. Coming back to the construction site, this man lives across the street from the site. He says homeless encampments are all around. Hes concerned about the safety for the entire community. Its complicated. People need places to live. I mean, i understand that. And, you know, i personally im just thinking about the people who live next door who have been affected with their housing now. Right. Like, where are they going . How are they living . And in addition to the damage that the construction site itself endured, many windows from some of the adjacent buildings and even across the street shattered and were blown out due to the heat from this fire today, later on, crews are going to continue to remove this melted scaffolding. Its all scorched and twisted. And the surrounding this site, the intersection is still closed off, met to the traffic is having to be diverted around. Octavia getting to fel street, going towards golden gate park. As far as getting back towards the freeway, headed towards oakland. Still an okay for now live here at the site of this construction fire yesterday alice wertz live ktvu fox two news. All right alice thank you. Police in san rafael cleared out people from a homeless campsite after a reported shooting and other criminal activity. City officials signed an order that prohibits people from camping on the site about a block from city hall through the end of the month. The order was signed last thursday, the same day the suspect in the july shooting was arrested. Police say officers have responded to more than 100 incidents and six arrests have been made at the site. Five men have been charged in federal court for an Armed Robbery where more than 1 million worth of jewelry was taken from a san ramon store last march. Seven people raced into the Jewelry Store at bishop ranch shopping center, a Security Camera captured images of two gunmen confronting security guards and store workers while a family runs away. Theres also video of a man using a hammer to smash into one of the jewelry cases. Other evidence includes video of an orange Dodge Charger and a jeep grand cherokee. When we heard that a vehicle of the same description was back in the city and was possibly associated with hellas jewelers, it gave us a lead to go on. Investigators were able to track the suspects because there was a gps tracker in one of the rolex watches that was stolen. Both those cars were found abandoned in east oakland. Police were also able to connect some of the suspects suspect to the cars. The reason the fbi was involved was because the stolen rolex watches were imported from switzerland to new york, then were taken across state lines. Police are still looking for the other two robbers. A grand jury indicted donald trump for a third time. The former president now faces felony criminal charges, accusing him of voter fraud and conspiracy related to his efforts to overturn the 2020 president ial election. The former president is expected to appear before a judge tomorrow to be arraigned on those charges. We want to bring in u. S. College of the law professor david levine, to break down all these charges for us. So conspiring to defraud the nation. Thats one of the four counts that the president faces into this indictment. This is the third time hes been indicted last time for mishandling classified documents and then the hush money payments. How is this case different from the others . This one is different, ali, because it gets to the very heart of democracy. The other cases, in a way, are sort of sideshows paying off somebody for hush money to influence an earlier election is kind of a one off. The documents down in florida are significant. Thats a very serious set of charges. But its kind of just its a little bit peripheral, whereas this is at the core of democracy, because after all, what are we talking about . What were talking about is that if the if jury accepts the allegations that mr. Trump, knowing that he lost the election, knows that he needed to walk out of the white house on january 20th and shake hands with his successor so we could have a peaceful transition of power. Did everything in his power and beyond to make sure that that did not happen. Why did the prosecutors choose a fraud in particular former prest with. Well, the conspiracy relates to a number of it goes in a number of different directions. And the core is that it is something that can be proven relatively easily. We saw a lot of detail in that indictment. Everybody should read that indictment to see what were talking about. And presumably they can prove every single one of those pieces with sworn testimony, with documents , with emails, recordings. And its a relatively narrow case in that way. You cant say things that will end up defrauding people. Thats the core of it. And the fraud is really that that the election where Everybody Knows where it should have gone, 50 states certified their electors and the president tried to stop that. What do you think trumps defense will be in this case . I think hes got two defenses, at least from the initial things that weve heard. Number one is that they are going to claim that he had a First Amendment right to say everything. And the indictment talks about that. It says, look , we accept that he did have a First Amendment right up to a point. He had a right to say what he wanted to say when he was interviewed on television. He had a right to ask lawyers to file lawsuits. What he didnt have a right to do is to then conspire to interfere with the lawful process of counting the votes, of certifying electors, of counting the electoral votes. And as the indictment says, taking advantage of the volatile situation on january 6th, that was beyond what was legitimate First Amendment rights. Now, on that january 6th implication, the charges implicate trump for that, but they dont charge him with inciting that violence directly. Why is that right . Well, its a im sure that was a very difficult choice with the prosecutors because the incitement charge, the insurrection charge, would actually, if that was actually it would just stick. Mr. Trump would be disqualified from federal office because of the 14th amendment. Actually but not doing that then gives mr. Smith, the prosecutor, the advantage of focusing very narrowly on things that are because incitement is difficult to prove, because of the First Amendment. You can say things. I want my supporters to go out and support me tomorrow, and thats not a crime. So i think they made the choice of saying, lets keep it narrow, lets keep it to what we can prove, and lets leave these interesting theoretical discussions for law school. Ill take it up in late august. Ill take it up with my students. But mr. Smith decided, lets see what we can prove and stick with that. Its important to note none of the charges hes facing for this indictment or the others would bar trump from running for office. None of these would presumably its going to go into everybodys calculation as to whether mr. Trump deserves another round as president or not, but none of it would formally prevent him from running for office or indeed serving. If the American People were to vote him another term in office. Really quickly, tomorrow, what will we see . He could appear in court, in person or virtually, i understand, but hes not going to be coming in in handcuffs or anything like that. The last i heard is that he will show up in person. He i dont believe hes not going to be handcuffed. As with the other cases, he will be formally booked, but he will be treated a little better than other indicted people. And just as the sun will come up tomorrow, we can be just as sure that mr. Trump will plead not guilty. Thats all thats going to happen tomorrow. Its very formal. It should be relatively quick. Some scheduling might take place. I dont think we will yet have a sense of where the trial, when the trial will take place. But theyll have to start setting up any motions. Et cetera. And remember, this is an indictment. He is entitled to the presumption of innocence until and unless we go all the way through the process and until and unless a jury convicts him. All right. Its still a long process ahead for this indictment as well as the others. Oh, yes. David levine, professor of law, thanks for speaking with us. Well send it back to you guys. All right. Thank you very much. Coming up on mornings on two, the nine californians could soon be drinking highly purified sewage water in an effort to create a more Sustainable Way to treat drinkable water. Can lead to a serious respiratory infection that requires hospitalization. However, the vaccine is not approved for everyone just yet, as of right now, it is approved for those 65 and older children who are two and younger and some people with Underlying Health conditions. Joining us now for more insight is dr. Peter chin hong, an Infectious Disease specialist at ucsf. Thank you for joining us this morning, dr. Tell us, what do you think so far about the idea of this vaccine . Well, i think its a great idea. Its something people have worked on for decades. Its been very elusive until this point. And we focus on covid and influenza in terms of hospitalizations and deaths every year. But i think last year, what we learned is that rsv is a really serious contender, not only for bringing young kids and older adults to the hospital, but also causing disproportionate mortality, particularly in the older adult side. Until at this point, many people dont know. But if you had rsv, we didnt have a lot in terms of treatment. So the fact that we still dont have treatment for rsv makes the vaccine even more important for those who are eligible for it. Its interesting. Its been around for a while. Weve been talking about it more now. But my daughter, whos actually in college now, got rsv along with me and my other daughter when she was a baby. And then just this last year in college. And our doctors told us at the time, you know, she could be more susceptible. And this last year in college, she got it again and she had to be a nebulizer, a very severe cough. And so its something people arent aware of. Its similar to long covid, right . You could live with this for a while or it could pop up again. Well, i think what happens with particularly young kids is that it manifests as wheezing and airways hyper responsiveness. Its almost like asthma. So in terms of living with it for a long time, it may set off some reactive airways or asthma. And then that may make somebody more susceptible every time you get rsv again. So in terms of prevention, it is really better to not get it than to get it. And get some consequences like that. And thats where this vaccine comes in. What are some things that parents in particular older people should be looking for to determine whether they might have rsv versus a cold or a cough or even covid . So for most people in the community, rsv feels just like a cold. Its you know, you have a runny nose, congestion, headache, but for the very young and the very old, that Cold Medicine rogue. So in the very young because the airways are very small, it causes so much mucus that it fills in that airway. So the infant can some infants, particularly those under six months, have a very hard time breathing and that might have been what happened to your daughter, pam, when she was younger and when you go to the hospital, they suction out all that mucus and all the adults it can cause like a pneumonia or the areas of the lung just being filled with fluid and pus. And thats what can kill older adults. So the death rate in older adults is much higher than in younger. But the hospitalizations in younger is very substantial. So thats what were trying to deal with. The first step is, of course, vaccines for the older individuals and then what people will see coming up soon is a Monoclonal Antibody for those under six months because well, under two years because they cant make their own antibodies. The younger you are and then vaccine for pregnant persons in the third trimester because those antibodies will go over to protect the newborn. What do you think the timeline is for this . When we might see the vaccine for available for everyone . And could it be something that would be required for School Children . No i dont think so. I think this will always be a niche vaccine, meaning that it will be restricted to the very old and the very young because the people in between are generally , you know, kind of immune to no pun intended to going to the hospital because, again, it feels like a cool perhaps if youre immune compromised, that will be the one exception for somebody whos younger. So for the time being, were going to see it in pregnant persons, third trimester for under two years old and then older than 60 or 65, depending on on the season, but not for the general population. All right. Dr. Peter chen from ucsf, thank you so much for joining us this morning. Thanks so much, pam. State water officials have new proposed regulations for turning treated sewage into Drinking Water. The new rules would require extensive treatment and monitoring before highly purified wastewater could be piped directly into Drinking Water supplies. Currently the most treated sewage is released into rivers, streams and the ocean. Water agencies have been working on ways to use that treated sewage as an additional water source. After endless cycles of drought. All right. Lets check in with Steve Paulson for our august forecast. How long will this last . A couple of days. And then well get a little bit decrease in that by the weekend when temps warm up again. But right now, its a cool pattern, although it is burning back a little bit. Theres actually a couple of holes in the fog. You can watch it retreat there. San jose, the north or peninsula, parts along the 880 corridor, still though thick as thieves to the north. And also Santa Clara Valley, although its probably on borrowed time. But look how that disappears. Some drier air coming in. Boy, erodes it fast, but still it set the table for a cooler pattern, a couple of lows are moving in
