>> i'm not sure how we're going to do it especially with it being winter with rain and cold. so we're worried. >> this is devastating news. >> with covid spreading here four times faster than a month ago. >> we want to make sure because we're protecting public health at all points. >> gyms must also move everyone outdoors. owners and members are fed up with the constant shifting of rules. >> if they're going to shut it down so this virus could go away i respect that and hopefully that could prevent all these shut downs again. i could finally have good work outs. >> we've been at it for months people have been making sacrifices. not seeing loved ones or celebrating milestones. >> i think it's important for us to do whatever we have to do. i did have a lot of people calling the salon to get in for this week because they're worried about tomorrow and they'll have a new deadline to close. >> we didn't know we were going to go the two tier. a sudden fall and hard landing especially in a county reliant on tourism already struggling. >> now i potentially have a husband and wife that are both in hospitality that can be unemployed. that's a real story in the county and that's what worries me the most. >> reporter: schools are in in school learning and they can keep that as long as it's limited. governor newsom also announced today more stringent rules for face coverings. the only exception is when people are alone, children under the age of 2 or people with medical conditions. the governor also floated the idea today of a statewide curfew. it is being done in europe and other parts of the country. tonight strong reaction from a business owner who sees this as a big set back. >> reporter: what's unknown the hours and parameters for a curfew, the notion of it restaurants owners say is tough to swallow, restaurant owners say is tough to swallow. the mood today somber after learning that we have to move back to the orange tier and that means no more indoor dining. >> it was hopeful but wasn't meant to last. >> reporter: kpwaoeur combine that with talk of a curfew. the owner sees it as a crumble. >> the virus doesn't come out at 9:00 p.m. it doesn't have a time frame. >> reporter: governor newsom is reviewing other states with curfews as well as studies from other countries. >> we know that there's states that's massachusetts. and alcohol based curfew in the state of virginia. >> reporter: critics call it an overreach that doesn't make sense. in new york and europe curfews mean bars close early. bars here are already closed. opponents also say curfew success is not backed by data or science. >> there's not one infectious disease specialist in the united states that i've heard of that says that a curfew works. >> i think it's good that the state has a plan b. if the tiers going back to a largely purple tier doesn't stop transmission. >> reporter: dr. rutherford admits it is too early to know how effective is a curfew with stopping the spread of covid. but he says, it is an idea to consider. he says its part of a public health play book to stop covid transmission when cases are rapidly spreading in the united states. >> we may by the end of the year approach the number of u.s. battle dead in world war ii in the space of 10 months. that's a pretty sobering thought. >> the owner of pizza flora says he and neighboring businesses are preparing for a curfew trying to lean on each other to get through the year. the owner says the government hasn't helped small business owners as much as he would like. julie. >> azenith smith reporting live tonight. thanks. covid-19 is impacting babies and kids at an increasing rate now. the hospital association reporting today that more than 1 million infants, children and teens have been diagnosed with covid-19. just last week, there were 112,000 new cases. the academy says that was the highest weekly total of any week in the pandemic. children generally are much more likely than adults to have mild cases but hospitalizations and deaths do occur. researchers say the coronavirus was circulating in italy last september indicating that it may have spread beyond china earlier than previously reported. researchers say 12% of volunteers in a lung cancer treatment trial developed the condition long before it started in china. moderna announced today more promising news of a new covid vaccine. the news from moderna comes one week after pfizer also announced their vaccine was 90% effective. the vaccine could become available to available in the next few months. >> all of us have been waiting for positive news about a vaccine for covid. and this is really great news. >> reporter: they hope by the end of december there will be enough vaccines to vaccinate health care workers and the most vulnerable. and ending just 50 points shy of 30,000. nasdaq rose 94 points and the s & p rose 41. now turning to a big change in our forecast. dry, warm weather makes way for a wet and windy storm now approaching northern california. one that could finally put the threat of wildfires behind us for the season. chief meteorologist bill martin tracking the timing of that storm for us tonight. bill. >> yeah definitely rain in the forecast for tomorrow. we have a few clouds moving in right now. and as we get into the overnight hours early morning the rain starts. the commutes what's left of them will be noticeably wet. here are the models. this is 10:00 tonight, right about now. clouds increasing so now we're looking into the future. you can see where the front is. so that's 3:00 a.m., 5:00 a.m., 7:00 a.m., that looks pretty good. about 8:00 a.m. in the north bay so the models have slowed this down since 4:00 this afternoon the models were a little quicker than that. so now it's 9:00 a.m. in the north bay. 10:00, 11:00 a.m. in san francisco then san jose it's all the way down to about 2:00. there's that frontal passage you will see it slip right through. here's the thing with the system, in terms of get to the satellite imagery. it's a pretty significant system that it has a lot of latitude. it's coming from a lower latitude. we're going to see some pretty significant rainfall amounts. i say significant, quarter of an inch to a half inch. that's a good weather system. behind this system there's another one. not as powerful but to keep it going. but what does it mean? it's wet tomorrow pretty much all day. wednesday is kind of on and shower and in the mountains it's going to be going off and probably lasting through wednesday and they'll see maybe one to two feet of snow. a good weather system for this time of year. and certainly help us with the fire concerns that we've been having up until now. look at that thing. it's going to get here late details from the south bay where a fire broke out tonight in an auto dealer. then new numbers on hate crimes in america reaching their highest level in more than a decade. >> what we heard today from the fbi is a continuation of a trend we've seen in the last several years. new at 10:00, a fire broke out in san jose. it happened at around 7:45 tonight at the san jose auto outlet near humbolt street. the fire was confined to the business and no cars were damaged. so far no word on what started that fire. now to a troubling trend. the trend, the fbi reports the highest car thefts in a decade. jana katsuyama speaks to us now and joins us with their reaction about their disturbing data, jana. >> reporter: julie the community leaders i spoke with tonight say sadly they are not surprised by this data. that's because they say, they are seeing many incidents right here in the bay area. the fbi's annual report released monday showed that 2019 had 7,314 reported incidents of hate crime in the u.s. that's the highest number since 2008. more than 57% targeted victims for their race or ethnicity. 20% for their religion and more than 16% for their sexual orientation. >> what we heard today is a continuation of a trend we've seen for the last several years. >> reporter: tim smith from the defamation association says that they've also been targeted the latin x community. >> there were 25 people that were murdered because of a hate crime. that's the highest number that have ever been killed in a single year. >> reporter: three were from a shooting rampage. california had 1,015 reported incidents in 2019. >> in 2017, when we opened the lgbtq center it was in response to hate crimes because of black and lgbtq people here in the bay area. >> reporter: they're not surprised by the report and says the problem persists just this past june the centers windows were smashed by a man who witnesses say was yelling anti gay and anti black slurs. >> we have to report these crimes that happen against us. >> reporter: jenni says she just received a call monday to say a man shouted obscenities at a woman for wearing a head scarf. >> we have to restore tolerance. taás really the bottom line. if you compare it to 2017 when the numbers really have peaked, you know we can correlate that directly with the trump administration announcing a muslim ban. >> reporter: community leaders say, one problem is the data according to those community leaders in that fbi report it submitted on a voluntary basis by law enforcement agencies. there is a bill sitting in congress right now that seeks to fund better reporting and prevention. brisk says that it has bipartisan support but so far has not been able to pass. julie. jana k atsuyama reporting live tonight, thanks jana. president biden says that president trump's reluctancy to allow joe biden to at least begin a transition. >> i expect joe biden to be the next president of the united states and it is very important that joe biden have access to the intelligence briefings to make sure that he is prepared during times of transition. >> reporter: ohio governor mike dewine says much the same thing prompting a twitter rocket from the president. who will be winning ohio will be hotly contested. but even robert o'brien speaking about the reliability of a biden ticket. >> obviously things look that way now. we'll have a very professional transition from the council. >> reporter: in floyd county the recount discovered 2,600 ballots that had not been originally counted. that could narrow joe biden's lead by some 800 votes. president trump not happy with the recount complaining signatures on mail in ballots are not being verified tweeting georgia won't let us look at the all important signature match without that the recount is meaningless. georgia's republican secretary of state responding not true. >> well there's no truth to that first off. we have signature match. >> reporter: the trump campaign also rejecting reports it is withdrawn parts of its lawsuit in pennsylvania. saying they only restructured in another case. tim murdoch saying the fundamentals in our case have not changed we're still making the argument that ballots were counted in secret. president trump has made it clear he has no plans to concede in the election. coming up at 10:30, california's next senator san jose police. martinez police are investigating the death of a man who's body was found in a creek. a person reported seeing a man's body floating in the water behind ferry treat in downtown martinez. police say the man's body had visible injuries but a cause of death is not yet known. his name was not released pending notification of his family. police are investigating another grab and run robbery. the thieves attacked a security guard and then made off with expensive handbags worth tens of thousands of dollars. >> the yves st. laurent store has been targeted twice in the last month. the last time less than an hour before closing time. >> a male suspect opened the store and struck the victim. >> reporter: the man held down the guard. the intruder wasn't alone. >> then several other suspects entered the store and did their deed. they came in to steal merchandise all as one group. >> reporter: the store manager told us the robbers grabbed about 20 purses and hands bags. the robbers two men and a woman took off. security lets customers in one at a time. >> that has to do with the covid. but in this case, it also helps control the theft. >> reporter: police say the store did everything right with regards to security. whatever happens witnesses should not engage. >> we know that property can be replaced. injuries are much harder to recover from versus merchandise or inventory that can be replaced. >> reporter: the same store has been hit twice before in recent months. last month thieves backed an suv into the store. then they store expensive heels and handbags. including some that retail at $14,000 a piece. there are other security measures in place. some stores have overnight guards and others use cables to secure their merchandise. san francisco police are asking anyone with information to give them a call. police in redwood city need your help in finding an elderly man with dementia. he is 83 years old and described as 5'7" call weighing 170 pounds with light brown, gray hair and brown eyes. he was last seen wearing a black jacket and black baseball cap. anyone with information about his whereabouts should call redwood city senator seat. >> reporter: the latino community is asking the governor to fill kamala harris' senate seat with a latino or latina. there's no lack of qualified candidates. back in august more than 500 latino leaders across the state sent a letter to governor newsom. with latinos making up 40% of the population and contributing billions to the economy. >> now that covid has hit our communities direly, harmfully and has hit us the most. we need someone who's going to represent us and fight for us for our communities. >> reporter: newsom short list of candidates does include secretary of state alex padilla and javier becerra. but there are dozens of men and women looking for the opportunity. >> if you're looking to turn the page on democrats that having democrats move forward in a stronger way with a latin x community. this is a golden moment to do that. >> reporter: political science chair says newsom could consider tony atkins who respects the lgbq community. >> whomever the governor picks that person has to stand on their own two feet and run for election in 2022. which means they have to raise funds to do it. >> reporter: the rallies will continue throughout the state ending next month at mexican heritage plaza in san jose. newsom ha not given a time line on when he will announce his pick. governor newsom apologized for attending a friend's 50th birthday. >> the spirit of what i did that was contradicted so i want to apologize to you because i need to preach and practice not just preach and not practice. >> reporter: governor newsom said he was unaware that the party would include as many people as it did before he arrived. but he admits now that he should have stood up and gone home. as ktvu's christian kaptan explain, the city is still implementing new restrictions as california sees a sharp rise in infection rates. as coronavirus rates spike around the country san francisco is not immune. that city's director of public health says rates are up in the city as well. >> let me be clear, san francisco is in the midst of a major surge of covid-19 cases. >> reporter: after enjoying almost three weeks in the yellow tier the least restrictive. san francisco has now jumped two tiers back to red. san francisco's major confirming in addition to last month's restriction to restaurants they will now see lower attendance at gyms and fitness centers. >> it's hard to stand up here and tell people that you're going to have to close your business. you're going to have to make some adjustments. you can't see your grandmother who's in a nursing facility. you can't hang out with your friends. >> reporter: the city is seeing the steepest increases in infection rates now and that is a leading indicator with infection rates up, hospitalizations, icu rates even the death rates are all likely to increase in the days and weeks to come. the mayor saying the city has crushed the goal twice. and now she's asking san franciscans to do it again. >> think about how it feels to go and get your hair done or nails done or go to the gym and enjoy your time there. but just remember how important it was for the people who were finally able to open their business. >> reporter: this move comes just before the holiday. they are advising against any unnecessary travel and are asking people to celebrate virtually or at home with less than 6 people outdoors. >> the choices i and you make for the next few weeks will determine the remainder of the holiday season. >> reporter: everyone with all the restrictions the mayor is still saying she's pushing for some schools to reopen for limited instruction in january. saying the education and well being of the city's children is a necessity. christian kaptain, ktvu news. the cif is the state's contra costa county, supervisors will consider extending a previously approved protection ordnance through next march. the measure is set to expire at the end of this month. the existing ordnance also be reduced to about 2,500. the order stops short of outgoing president donald trump's goal to have all troops withdrawn by the end of the year which had faced opposition by military and diplomatic that i noticed is that, normally people celebrate friend giving this weekend and we didn't have a lot of friends giving turkey purchases. >> reporter: grocery stores are also preparing for an unusual holiday season. >> we're seeing customers just prepare early. >> we're seeing a lot of dried goods being purchased this last weekend was a pretty busy weekend here at zenatos. >> zenatos is already seeing more shoppers than usual on the week before thanksgiving week. store management says they have plenty of stuffing, pumpkin and turkey noting turkey sales are actually up. >> does seem that we have more turkey orders than normal and that's just because more people are eating in their own homes and not going over to grandma and grandpas this year. >> reporter: this year the store is adding extra hours the week of thanksgiving to help spread out shoppers and lines. for those planning an outdoor get together patio heaters are hard to find. the online site wayfare says the heaters were the most searched for product. a shipment of 10 patio heaters sold out in 10 days instead of the usual two months. >> the demand is way far exceeded the supply. we don't expect more shipments to come in until the first of the year. >> reporter: the patio heating selling out, customers are turning to other options like fire pits and grills. >> we try to do the best to support our community and order removing the time limit for thanksgiving gatherings. we're talking about rain. that's a good thing. we had rain last week. a colder storm this is a warmer storm which means, usually a little bit more precipitation. here's the model right off the top. tomorrow morning 4:00 a.m., 5:00 a.m. here it comes. here it comes. maybe a quarter inch to half inch from this weather system. looks like about 9:00 a.m. in the north bay san francisco. 10:00 a.m. down in redwood city. 11:00 a.m. into noon and san jose. that's the frontal passage. that's essentially the timing. rainfall accumulations i wouldn't be surprised if we see an inch and a half of rain there. i would say for san francisco quarter inch, half inch maybe for berkeley. something like that. it's going to be a nice weather. on top of that there's more behind it and that's sort of the key to that thing. there's a little bit of an impulse on wednesday. and that will set us up with another round of rain. this is a healthy looking storm. it looks good right. you see how low it is. the latitude. we have 60s and 70s. temperatures tomorrow will be in the 60s. where does the southerly flow bring the air from down by l.a. and those areas. warmer air coming in. it's not a warm day it's just not going to be cold. the moisture streaming into the pacific northwest now bringing rain. that rain will be here into the next 7 hours something like that. the forecast for tomorrow will be a mild day. it's indicated by these mild temperatures right now. overnight lows aren't going to be that cold. overnight lows are going to be in the 40s and 60s. not in the 20s and 30s. san francisco, oakland, san rafael, about 7:00 a.m. clouds for sure. showers in the north bay then about 8:00, 9:00 it starts raining in san francisco and in oakland and redwood city. then it works its way south through into san jose. at about you know, 12:00, 1:00 something like that. so it's going to drag through southern part of the bay a little bit slower. there are the forecast highs like i said it's warm. the last storm we had remember that one. that was really cold. we had the low snow levels. some snow in bay area peaks is not going to be the store this time. it's warmer storm, more rain, more pre precept. that means the higher snow levels. we'll see accumulations of 1 to 2 feet possible. we come back at 11:00 we will certainly update the forecast. and bill, after this storm do we see much coming out a little bit later or does it look like it's going to be this and then we're done for a while? >> so you have this, julie then you have a little bit coming in on wednesday. then yeah, it looks like we have 3 or 4 days of dry. but the pattern is really progressive. is the jet stream is real far south. i think we're in a good spot julie i really do. i think the fire danger is going to really take a powder tomorrow and wednesday. a couple of days off and then hopefully something tees up for the next several weeks. >> nice to get some rain in side came in last week's game against tampa. saints are saying brees could be out for the rest of the regular season. the nba's wheeling and dealing got started today. the suns have made a deal with oklahoma city to acquire chris paul. the milwaukee bucks have made a deal to acquire halladay. the bucks are trying to put a roster together and sign a max deal. they will get the 30-year-old halladay considered one of the league's best defenders. the bucks give up three first round draft picks. diverse events on which to reflect as we take a look at this day in sports history. his later life and
