What is happening in the critical swing states . Reporter good evening. It is clear this race will come down to the swing states. Likely to be close. Frankly it will take time to count the ballots. Lets look first at the midwest where much of the attention is the three states President Trump flip inside 2016. The blue wall that he broke through in michigan so far the state has seen a historic number of absentee ballots returned. Trump is leading biden 5445 . In wisconsin so far 92 reporting. A very close race. President trump leading 5147. One note here Election Officials have said in many counties absentee ballot numbers will not be reported until they are all counted. And, pennsylvania, critical 20electoral votes, 65 reporting, trump leading biden 5742 . One state that remains close, georgia, 92 reporting, President Trump 52 , joe biden 47 with still a lot of absentee ballots to count. Now to one of the surprises of the night so far. Fox news called arizona for joe biden. The last time the state voted for a democrat was in 96. In one of the major prizes of the night, florida, fox news calling this one for President Trump. This was essentially a mustwin for the president and he delivered 51 48 with 99 reporting. Lets go to ktvu now for more reaction on the president ial race so far tonight jana . And the turnaround we call today for minnesota and he will still in a game in georgia. Although that is not one we expected. And the best people there at the drive in rally. Declaring the victory and he said he was going to be waiting like everyone else for the results. Talking to a Trump Campaign dylan here in california. Here is what she had to say. The president successfully expanded our partys reach beyond the traditional republican base. He garnered a large number of votes from independents and democrats just like Ronald Reagan did and critically in states like florida and you will see in others he has significantly expanded our reach in the minority community. Democrat mark kelly has won arizona and colorado has been called for john hickenlooper. Republican the auburn football coach has won alabama he is a republican. 8 seats still have to be decided. Democrats are expected to keep control of the house and possibly add more seats. Nancy pelosi is hopeful snow am here just to sing the praises of our House Democrats not just in terms of numbers. It is not just about the quantity it is about the quality of leadership they provide for our country. Now, brian, before we get to the results we heard joe biden speak moments ago, we are awaiting possibly trump to speak what would you expect to hear from the president . Basically the same thing that we have heard from Vice President joe biden that is, they are hopeful on the republican side of the ticket. Joe biden currently with the lead, at this point, julie, donald trump needs to run the table of the rest of the states to win this. Yes. What do you think of the numbers so far . We saw arizona flip turn blue tonight any other surprises so far be sides arizona . Not really. You know, much of what we expected occurred. It is one flip state that has occurred. We will have to see how these other states that are out there, wisconsin, michigan and pennsylvania, north carolina, georgia, nevada i expect to go to biden. But, we will see. And, in those states there are a lot of votes, michigan, 20, georgia, 16, wisconsin, 10, in nevada 6. If you near the biden camp what are you thinking right . If you are in the trump camp, what are you thinking right now . We all know what President Trump had to do based on the polls and it seems like so far pretty much everything has broken towards President Trump. So far but we will have to see what happens in the states i just mentioned. At the end of the day joe biden has to be feeling good and democrats feeling good tonight. At the end of the day, though, once again, we have a country that is essentially split down the middle on who they want as president. We will have to break it down later, frank, as if there was a shift in the his panic and latino vote and black vote and the other folks around the country and among women to see who was voting for him. But we have a lot of counting to do. Yes. Still a lot of votes, a long way to go. Still could be a couple days based on what the Election Officials and the midwest states told us. We are watching results come in from 153 polling places. Coming in the red patches in the form of cards ready to be entered into the system. With so much early voting the moment to start tabulating started with more drama than usual. With a push of a button hundreds of thousands of ballots were processed the past week were tabulated and within minutes 41 of the votes were in 41 for joe biden for that first batch. All evening we were watching scanners reporting stacks of ballots from mail boxes and drop boxes. The inperson votes from the polling places are collected at the sites and received electrically. This Election Year Voter Registration surged to a level never seen before in contra costa surprising veterans. I never thought that it would hit 700,000. When i got here we were about a little over 500,000. But, voters have register inside huge numbers. A year ago when we started planning for this election we estimated we would have 700,000 voters and on the last day of registration we actually hit that number exactly 700,000 voters. Always Little Things that happen but it has been a smooth election. I am proud. Voters have been awesome in that they listened to what we asked them to do, vote early, vote safely, use the ballot we sent them. As the voting ended tonight, caravan of cars pulling out from the polling places, staff, seasonal workers, volunteers bringing in all of the supplies and records after breaking down the sites. So, certainly covid19 changed the pace and ph of the protocols how it was conducted this season but as across the bay area a lot of pride in the department and how so many challenges have been overcome. People tell me they are passionate about their support for former Vice President joe biden. Reporter this is an outdoor Democratic Watch Party held in San Franciscos Mission district. People arrived wearing masks, workers measured the distance between 38 tables. The election is something that everyone in the United States is involved in. I want to be with people that feel like i do. I want to be with people even six foot distance and mask. Reporter estimated crowd of 200 people who support former Vice President joe biden attended. Some visiting from out of town. I feel good. It is a bit early to tell. I am excited to see what happens. I have a lot of faith in the momentum behind joe biden. Definitely nervous. Amber, thank you. The republicans organization gathered to cheer on their candidates and watch the result come in. They had 100 people, sold out event and dozens that were interested in attend handwriting to be turned away because of space with covid19 restrictions. The president of the organization told us earlier this evening they were keeping a close watch on proposition 15. Businesses have really been devastated by the coronavirus and you know, raising office rent and commercial space rent dramatically, that is what is going to happen, it will be just another nail in the coffin for a lot of Small Businesses that are struggling. The groups president told us they want proposition 22 to pass that measure classifies appbased drivers as independent contractors and not employees. We will check in on more of the propositions coming up after the break. First here is a look at a local race measure s1 in oakland making changes in the oversight process at the Police Department. Independent of the Police Department looking into how the police handle misconduct claims and requiring the police chief to get requests from the police commission. We still have quite a bit to go in that total vote count. Reminder you need more than 50 for a proposition to pass. Ktvu has been in touch with both sides who are closely following this and joins us live. Reporter a lot is at stake for companies uber, lyft and doordash, raising 220 million and Television Ads to get prop 22 passed. It has taken an early lead. Still, too close to call but so far returns indicate that californians want Ride Sharing Companies uber, lyft and doordash to keep them as contractors and not reclassify them as employees. If passed prop 22 would make these companies exempt from a now state law that would require socalled gig economy appbased companies to offer Health Care Benefits and unemployment insurance. Opponents of prop 22 say drivers should have basic protections. Reaction tonight from two lyft drivers here in the bay area. One for and one against on the early results. I think they know it is guarantee based service that we need. We need drivers to remain independent and so that we have flexible hours. We are going to make sure every vote is counted. Organized. No matter what the outcome is. We are getting stronger through this campaign and we will continue to organize. If prop 22 failed uber and lyf, it is as workers jobs will be cut and fares will be raised. I reached out tonight and the companies tell me they are waiting to comment until a final call is made. Now, again, this proposition does require a simple majority to pass. Legal battles will continue. Greg . Hotly contested race that ruled the airwaves leading up to tonight, thank you very much. There are races on the state ballot. Heather holmes is tracking those. Heather . Reporter frank, every year we see a range of hotly contested ballot and this is no exception. Millions and millions were spent on this measure. Right now we will take a look at six of them starting with proposition 15. Now, it was one of the big money battles as well and one of 2 property tax measures on the ballot. It would raise property taxes on businesses with the money going to schools and local governments and lets go ahead now and look at the results so far in this case as you can see here it is neck and neck with the vote split right down the middle. Now we want to move on to proposition 16. It would repeal the ban on affirmative action and hiring and contracting decisions and right now as we take a look at the latest results on the screen this measure is failing. Now the second measure dealing with property taxes, 19, homeowners over the age of 55, disabled or victims of natural disasters to transfer part of their Property Tax Base with them when they sell their home and purchase new one and tax restrictions for those that receive family properties. A lot of the money from the measure would go to fund wildfire agencies. This fight had more than 100 million behind it and as you can see now the current tally shows that the yes vote is slightly ahead here, 53 to 47 . Now, proposition 21. It would allow cities and counties to put rent control policies into place for Certain Residential Properties over 15 years old and taking a live look now at the latest results voters soundly rejecting the idea to expand rent control. Another one, 23, pits for profit dialysis. Tightening regulations against dialysis clinics. 144 million was spent in the fight over this measure and as of right now as you take a look at the latest results it is headed for defeat. Finally lets talk about proposition 25. It would end cash bail as a way for people accused of a crime to secure a release before the trial. Owner of the clippers contributed 3 million to the yes campaign. Right now his efforts to get it passed are falling short. No leading this race, 54 to 46 . Frank, spending on this year totaled 760 million. So much money spent to try to sway voters showing just how much was at stake this election cycle, frank . All right, heather holmes, thank you. As we take a break now here is a look at a few local measures in berkeley measure ii would increase police oversight. It would change the way the Police Misconduct is investigated and extend the deadlines for the public to filed complaints against police officers. It also lowers the burden of proof. 85 yes, 59 no. In san jose the passage of message g. Will authorize the independent Police Auditor to review reports and records related to shootings where an officer is involved. And changing the Planning Commission from 7 to 11 members. And authorizes the city council to establish redistricting time lines following the release of census data. Now the question is sorting them, counting them and doing all of the things that you have to do for much as you know, another week or two unless there are other complication. A long tailed thing going on. Here is exactly where we stand right now with both the registrar and voters we met. Tonight we will put out first report of results shortly after 8 00. Then, when we get the ballots back from the polling places we will count those and we will update and do a last report for the night. But we will still need to keep counting the vote by mail ballots and the provisional ballots in the coming days. So it could be, i dont know, a couple weeks. It was my first time voting. That was exciting. But i am nervous for, you know, the future of our country and everything. I guess nervous and excited. Excited to actually be a part of it but nervous for the outcome and just everything that is happening in our country right now. No one should have to feel unhappy, unwelcomed or uncomfortable in a country they live in. Until everyone feels happy i dont think we should all be satisfy flood it is at satisfied. It is at a Tipping Point where it feels anxious and it feels like something is going to pop one way or the other. Now, registrar roger believes that 90 of all marin county voters actually voted through mail or by coming in person and all of the other things they could have done and she is very pleased with that. Marine is one of the highest ranking in state for the number of people voting. One final thing this is turning out to be a nail biter nationally. And all of the ones going down to individual cities and of the other issues, that all has to be ironed out, too. That is why so much of it is so complicated. Back to you. All right, tom, thank you. Democrats are expected to keep control of the house and possibly add to their advantage. There are dozens of races left to be decided tonight. Lets bring in our political analyst once again. Lets go back to the race for president. Right now fox news has biden with 238 votes. 218 for President Trump. You need 270 to win. It looks like it is all going down to wisconsin, michigan and pennsylvania. At the moment, President Trump is ahead in all three of those states. Obviously there are still votes to count. How do you see this playing out . Reporter well, he is ahead, frank, but the margins are so slim. Depending on who is left to count that will be the decider. We will not get results tonight or definitive results, clearly from michigan or pennsylvania. And quite possibly now not from georgia where the president holds, according to what we are hearing, a slight lead. But a lot of votes in fulton county, atlanta. That say big urban center. The president has a pathway to victory but if you are joe biden you are feeling pretty good right now. Brian the coronavirus has been such a big player in all of this just in the way it changed the dynamic of the race do you think it had a big impact on voters going to the polls today . Reporter i think we know it did. We know from exit polling and interviews that people have more confidence in joe biden Going Forward on the issue of coronavirus. Going forward than they do donald trump. But, at the end of the day i think a lot of Trump Supporters felt like the president s hands were tied to the extent that how do you handle a pandemic . But criticism was there, it is among voters voting against donald trump this evening that coronavirus did have a big part of their vote and we are seeing it at the polls. Some of the ballots or many are expected to swing. Trump urged many of his voters not to vote by mail but go to the polls today. Do you think that could be a tough one moving forward . Especially for midwest states that are close . Reporter it could be, greg. But, i think what we have seen is a lot of enthusiasm among Trump Supporters. I think his ability to get out the vote will pay dividends for him. All of the early voting, i think, in many, many states especially won by biden were the ones using mail in options. Those votes were recorded and on record if there is enough of a surge in some of the states for trump to maintain a lead in some of the states or to hang on to ultimate victory at 270 electoral votes what we know tonight is we wont know tonight. How concerns are you once we find out who wins there will be legal action from either of the two sides . Both sides have lawyered up as they say. They have all kinds of people on the ground ready to go into any state that is a problem and i am sure right now they are flying to michigan, they are flying to pennsylvania, probably a few headed to georgia. We dont know. But, it is highly likely that we will see some litigation coming out of this because that seems to be what we are used to now. If you look at the total number of votes cast at this hour, it is biden 64 million, trump 63 in that neighborhood. So, america is right down the middle on these two candidates. And we are watching americans, thank you. On wall street, there was a rally hoping the election will end the uncertainty on the markets. The dow jumped 554 points, more than 2 . The nasdaq rose 200 and the s p was up 58 points. Here is a look now at bay area congressional races in district 11. District 11 includes contra costa county. Nancy pelosi secured reelection by a large margin. The powerhouse was pitted against a socialist and activist and lawyer. Tonight a large crowd gathered to watch election returns at black lives matter plaza near the white house. There were reports of a small trouble in the middle of the night that broke out after protesters did not comply with orders to move a vehicle that was illegally parked. The Police Reportedly made one arrest. In florida, cuban americans gather inside miamis Little Havana to celebrate the president s strong showing in florida. They waived trump flags as cars drove by. Cuban americans turned out in support of trump in the days leading up to the election. The Community Held several rallies and get out the vote events. As the votes are counted in key states across the country there have been some issues and attempts to undermined the election process. Our Investigative Reporter has been keeping tabs on what is being done, brooks, to make sure that every vote counts. Well, frank, because of vote by mail ballots and added security measures in place it could take longer to finish counting ballots this time around. So, it is really important that we are all patient. I know we keep saying that. There have been efforts regardless of that to undermined our democracy. In many battleground states voters received robo calls in the days leading up to the election even on election day today telling them to stay home amid the coronavirus pandemic. Take a listen. Just a test call. Time to stay at home. Stay safe and stay home. Now we dont know the source of those messages. The robo calls were meant to trick voters into not going to the polls. Other robo calls sent to vote on wednesday instead of today. The new york states attorney general launched an investigation. We know that the fbi is involved. This is just another example of misinformation. Hitting phones in ohio, texas, florida and nebraska. This information was also largely spread on social media in an attempt to influence voters. At polling places there were minor issues across the country that printers or computers went down. Most of the problems were quickly solved. In doing so Election Officials understand those systems are not perfect. Sometimes things break, malfunction or can be hacked. The election experience it is designed to ensure technology is not a single point of failure. You should have confidence in the integrity of the proses and dont overreact to claims that exagerate the importance of insignificant events. Now, new this year as many of us know, an expanded vote by mail process in several key states. The u. S. Postal service was ordered by a judge today to search several Processing Centers to make sure ballots get to county Election Officers on time. That was after 300,000 ballots in 15 states could not be traced. But the postal serviced instead of following that order he would just stick with his own inspection schedule. Now in california as long as your ballot was postmarked by today. Arriving any time between now and november 20th. They sometimes require that they be there on sometimes before an election day to be counted the best advise we have to be patient here and wait for all of those votes to be tabulated. Over all election day was smooth. Not a lot of chaos. Just a lot of counting now. As we go to break lets look at congressional races district 15, democratic heading towards a victory. Going up against hayden to represent most of eastern Alameda County. Leading 74 to 26 . In district 17, 95 reporting. In San Francisco creating an office of Inspector General to investigate complaints against sheriffs deputies and incustody deaths right now the yes vote is leading with 68 . And prop e. Instead a datadriven process to determine how many officers are needed out on the streets. Prop e. Looks headed for passage. It has 73 voting yes. Just like the rest of the country voter turnout in Santa Clara County is breaking records. 53 of registered voters in the county cast their ballot during early voting. Reporter right now the process is underway to get all of the ballots counted. Crews unloading the ballots that were cast at different officers or polling places across the county and drop boxes, litters, hundreds of them are littered throughout the county. So far just less than 46 of ballots for Santa Clara County have been counted. Put my name up here, too . Reporter just as the doors closed voters were among the last to cast their ballot at the Santa Clara County registrar office. We were finishing up at the office and the other two guys had not voted we were trying to just get to it. The local measures were more important. It was prop 25, that is important to mow. Reporter his ballot will be among the hundreds of thousands that participated. In santa clara there are one million registered voters. Outside of the Registrars Office a flurry of activity. Workers secured collection boxes after 8 00 p. M. Waiting in the wings couriers that rushed them. The ballots taken to a room, checked for signatures and verify they match what is on file. The top issues for peoples ballots is the signatures are missing, the signatures dont match, or the ballot that came in too late. Battles that clear that are taken to another room. The results tallied are given the results from Santa Clara County voters we caught up with him as he was about to cast his first ballot. He just became a u. S. Citizen. I am excited. Yes. Way exciting. A little nervous. Reporter the Election Office reports 450 out of the 596 precincts here in the county have reported in at this point.
