But three weeks from now, you can pretty much bet that if you are not according to the rules, you are very likely to be fined and that is something that is probably going to be very important for saving lives. Health Officials Say 130 people, most patients, have been infected at Manor Care Health services tice valley in walnut creek. 92 were patients, and 38 are staff members. He signed a memorandum today that would prevent them from being counted in redrying of voting districts. A law professor at uc hastings. Dole, thank you for being here. The administration is looking to restrict them from the census. Is it constitutional . There are a few things in the constitution that are as clear as the requirement that you must count the whole number of all persons living in a state in the census. It is right there in the explicit language of the 14th amendment. So it doesnt look like it is constitutional on its face. His argument in his executive order is that congress has delegated to him a certain amount of discretion in deciding what the numbers look like after the Congress Department adds everybody up. But that doesnt mean that the president can exclude people because the president thinks they shouldnt be included. And moreover, there isnt actually a mechanism by which the president can determine who is an undocumented alien. We dont count that in the census. So the only thing the president could do is sort of make up numbers and try to subtract them from the whole numbers of People Living in the state which of course would not be constitutional. That was something i was going to ask because as of now, there is no Citizenship Question on the census. So how would the administration be able to determine that . The president says in the executive order that he has estimates of the numbers of undocumented aliens in states and he would use that number. So he would subtract i believe, 2. 2 million potentially undocumented aliens from the state of californias census. How he would decide where they lived in the state or what congressional district, where they would or would not have more or less voters, who knows. This is just nonsense on stilts. The president cant do it. If he tries to do it, the courts will certainly stop him from doing it. So professor, lets talk a little bit about the let the Trump Administration is arguing here. They say we should not give congressional representation to someone who is in the country illegally just as we dont for lets say, to arrest or other people visiting the country. That is true. We dont stop people in the street and count them one at a time for the census. We count people by going to their places of residence. So in principle, everybody who is a residence in the state should be counted in the census. The president is saying that people who he thinks art undocumented aliens would not be counted as residents but of course they are residents. They pay taxes, they have jobs here, they pay rent, they own homes, there is no reason to exclude those people from who is counted as a resident. Theres never been any effort made to try to exclude aliens from the account for purposes of the census. And it is really important to understand, as well, that aliens need to be counted because they are also represented in congress whether they are documented or undocumented aliens. They still have representation and it is also important to determine how much money should be allocated to a particular state for various federalaid programs. So the census is important for aliens and nonaliens alike. My final question, talk about why you believe the Trump Administration might be trying to pursue this, especially when it comes, and it seems as though the focus is on redrawing congressional districts. I mean, voting districts. There is something to be said about that. Right. So i suppose, in the ideal world for mr. Trump, he would like to be able to take away congressional seats from those states, like california, that he sees as not in his camp. But of course, other states are in his state like texas who also have a large number of undocumented aliens. So this exercise indiscretion by the president , it is as if we are telling him he can do side for himself how many congressional seats each state can have which is absurd. He could also be trying to discourage aliens from filling out the census forms. And frankly, it is against the interest of aliens to not fill out the census forms. No one is going to knock on your door and try to deport you because you filled out the census form. The census form protects aliens by ensuring that they have adequate representation in congress. All right, thank you so much. As we mentioned, this latest attempt by the Trump Administration is expected to face some swift legal action. So we will be following that challenge which im sure, if it already hasnt happened, it is coming. Professor, thank you. In the area of weather, no major heat this week. I cooler weather pattern is here to stay. He probably noticed that cooler wind setting up. We are not talking about any excessive heat inland, only the low to mid 80s. San jose right now 76, oakland 70 and in the north bay, a bunch of 70s in novato, santa rosa and napa. Just to the north of the bay area as you can see, those showers are kind of popping up here. Firefighters in east Contra Costa County were busy overnight putting out three fires in just eight hours. The last of those fire started about 2 15 this morning on jet slough road just outside the oakley city limits. In fact, men we spoke with that he accidentally started this fire. The president was very clear that he would like to see a payroll tax along with Liability Protections, tax credits for businesses to bring people back to work. They proposed more than 100 billion to help schools reopen and another round of stimulus checks, plus money and Legal Protection for businesses.
