What you think prosecutors opted on the more serious charge . When i watch the video i thought their initial filing of thirddegree murder was in order. The more i watched it, ive got to think that he actually should be charged with first degree murder. He was leaning on his neck for eight minutes and 40 seconds. As an experienced officer, he knows how long it takes for strangulation to take place and asphyxiation. As i look at this, i was thinking of someone else had done what wit and ive got to think of first degree murder. I dont like overcharging in the case. I think it is a pour in. But in this case i think of firstdegree murder case would be in order. It ups the ante and i understand what that attorney general is saying. But, gosh, let a jury decide what it is. There should be no plea bargaining in this case. If they plea bargain, there will be more riots. You cannot plea bargain this case. A jury has to decide this case. The attorney general said he had no plans for any plea deals whatsoever. What about the charges brought today for the other three officers involved in the death of george floyd . They were charged with aiding and abetting the crime of 2nd degree murder. Are those appropriate charges, and what do you think the process and discussion was like for prosecutors to decide how to charge those other officers . If you have an officer committing a first or 2nd degree murder, when you aid and abet that you nobodys doing and you have a specific intent to aid him in committing the crime. Is going to be a difficult case for the prosecution. It will be more difficult but notwithstanding, they should be charged with the same crime as the perpetrator in this case. The 2nd degree murder. I think they are appropriate charges. Again, it will be more difficult to convict them, first of all convict them let alone convict them of Second Degree murder. But one thing that i would like to point out to the listeners, in jury trials we are use to, not used to but we understand that the jury can hang. 11 for guilty and one for not guilty. Guilty or not guilty and so one. Keep in mind that a jury can hang on to, you can have 12 jurors and none of them say, i think it is seconddegree murder and three of them say no it is thirddegree and they can come together. That could hang the jury. So it is what degree of murder is it. They got to worry about that in of this case and the attorney general in minnesota knowledge that it is going to be in general difficult to convict a Police Officer of murder. The group plans to march to the Mission Police station on valencia street. Well this is being organized by young people, other groups plan to take part. Again, another life look at sky fox of a significant crowd that has gathered in San Francisco outside of Mission High School. They are going to march to the Mission Police station there by to call for justice for george floyd. Steph curry and his wife plus Klay Thompson took part in a march around lake merritt this afternoon. The event was called walking in unity. Demonstrators chanted the names of black americans killed by Police Including george floyd. A group of both the young people gathered in san jose for a protest amending justice and equality. It started at 10 am this morning in the willow glen neighborhood. The group held signs and chanted in a peaceful demonstration that was organized by black lives matter. It was another night of chaos in vallejo. Police responded to numerous reports of looting in that city. Henry lee joins us with more on the unrest and new information about the Deadly Police shooting of a suspected looter. They thought that young man was armed with a gun. Reporter we were told initially that this man, this looting suspect fired first, but that turned out to be wrong. Police thought he was reaching for a gun but it was a hammer and not the gun. A 22yearold man was shot and killed by Vallejo Police early Tuesday Morning on redwood street. An officer fired five shots after thinking the looting suspect was reaching for a gun in his waistband. Police determined he was armed with a camera and not a gun. Another suspect ramped an suv and escape. The driver of the pickup truck also took off but was arrested after leading police on a high speed chase. Police say there has been high speed looting with opportunistic criminals taking into stores and throwing rocks and bottles at officers and leading officers on numerous chases. The looters are distinct from peaceful protesters. This is left in the county to call in the National Guard. And attorney fermata roses family said he did not deserve to die over what started as a property crime. He was a well loved member of the community. This wasnt a person that from all of the Information Available to us, this wasnt a person that shouldve ended up dead the attorney is waiting for body cam video to see the moments leading up to the shooting. s killing is under investigation. In san jose, new details about a Police Shooting that followed an illegal side showed and protest at city this all started at 9 30 last night as police were breaking up protesters. Police chase it and it hit a pedestrian and a motorcycle during the pursuit. The suspects car came to a stop near the park police said the driver refused Police Commands to get out of the car. The suspect did not follow the commands and drove backward toward the officer. The officer fired at least once at the suspect. The suspect was transported to the local hospital with nonlife threatening injuries. The officer was not injured. The pedestrian who was sent last night suffered a head injury, a broken ankle and cots. Police arrested a 23yearold man from san jose on multiple felony charges including assault with a Deadly Weapon on an officer as well as hit and run. The order came after significant damage on sunday when there was widespread looting and vandalism. Several other cities and counties have enacted curfews to limit any further Property Damage. Well, one thing you might want to think about and asking about the goal is to ask for these an emergency orders. In some places like arizona where an emergency orders have been call, it is not clear which officials requested them. Amir from tucson tweeted out they hadnt been consulted. You may ask if what the goal is you have to distinguish between who called the curfew. Was it a political decision or of policing decision. Were policing is concerned, sometimes a prophylactic toward protest for instance riverside in california called the care few but they hadnt seen violence or Property Damage or looting. Their statement indicated it was to limit the chance of that happening and also the possibility of protests that were planned occurring. It is a mixed bag with respect to what those motives may be. Going back to these curfews, you raise a good question about just who is calling for the curfews. Are they an appropriate way to handle the unrest we are seeing right now . I am not a governor or a mayor. It is not my job to say what should or should not happen. I can tell you about some of the risks. I can tell you why they are sometimes use. They historically have been part of a strategy Something Like teargas which is on the dispersal side the curfews are on the prevention side better use when youre not entirely sure you can control your officers. You try to separate officers from people they may come into contact and use final with. This happened in the 60s when there were violent protests that brought widespread condemnation to Police Department and led Police Department to devise strategies. There is also a chance that in some cases it is about limiting coverage. In cleveland for instance, the Police Department originally indicated the curfew would cover the media even though the Mayors Office said that that wasnt true. Ultimately the Police Department said it doesnt cover journalists. So there are multiple reasons the Police Departments may use curfews that are not on their face about just controlling looting or violence. We see that in the distribution. We have communities that are affected by violence and Property Damage but others that arent a really interesting conversation. It is a debate that many cities are having at this time.
