And now mr. Floyd. It is blackout tuesday. There is no justification in the world for anybody to attack we will explain what this is a Police Officer. And the message behind the movement up next on the 4. There is no justification for a Police Officer to put his knee when you have nausea, heartburn, indigestion, on the neck on someone that results in their deck, death. There is no justification for the lawlessness and crime taking place. We are tired. I have experienced the same myself, even as a Police Officer i have been stopped and profiled. We need to move ahead and make a commitment. We need to take a stand that we will do right by what was written in the United States constitution. It seems as though this divide is so wide right now. I know that just me talking about the officers injured, people will say that we are targeted all the time. How do we overcome this . I will tell you that the city of sacramento has what i believe to be the right answer. I have done transformational policing model for sacramento and the training sessions we talk about, i have Police Officers in the room and Community Members in the room which is the only way to have this conversation. The citizens get College Credit or get credit for the class in Law Enforcements get standards and training for the class. That is how we are going to solve this. Pretty both parties in the room and going through training. Police need to learn why the distress is there and it is applicable and it does align. Community members need to understand that every Police Officer is targeting them. Upset stomach, diarrhea they need to understand the rules and the responsibilities of our justice system. Pepto bismol coats and soothes your stomach for fast relief we need to educate, educate, and now, get the same fast relief in a delightful chew with new pepto bismol chews. And educate both sides. My pleasure and thats why we graduated to tide pods sport. Finally something more powerful than the funk. Tide sport removes even weekold sweat odor. Its got to be tide. As part of the blackout tuesday, you have probably seen a black square. Many people are using the hashtag black lives matter and blm but by doing so people are clogging up critical channels of communication being used to share information about protests in donations. Instead, use blackouttuesday. For more on this protests we are joined by Management Consultant tracy webb. Is good to have you here today. It is powerful to scroll through your timeline today. You see all of the black tiles how effective do you think this online protest will be in terms of raising awareness about racial inequality and Police Brutality . Thank you for having me. I appreciate it. I think that the awareness is critical right now. We are at a Pivotal Point in this country. Change has to happen, and it will happen. Posting or nonposting is very effective in terms of raising the issue across all the social media platforms. We have to do more than raise the issue. This has been an issue for 400 years, and we have to this ide women that work in the wellknown musicians and artists frame and to your point, how do you translate this sort of Movement Online into real change . It has to come from a very authentic designer. An authentic place from each of our souls. We have to decide that it is time to fix the very broken and frankly rotting fabric in this country. We can do that if we have to authentic conversations, the hard conversations, and then strategize about what we need to do and where we need to put our money, time, and collected effort to change. It is of critical importance right now. As this movement grew, many people as we pointed out at the top use the hashtag black lives matter. And then you started stepping in and asking people not to do that. They believe this can drown out an important message. Do you think that that is a valid point here . I think it ends. What we have to do is to realize that in order to win this battle which is to save our country and fundamental ideas on which it was born, we have to use every era in the quiver. One of those heroes is of course awareness. Is being strategic enough to keep much needed information open. I think we need to heed the words of those saying be careful how we use the right hashtag. Use blackout and not black lives matter. What comes up is the blackout squares and not the information that people need to donate or come involved. As we wrap up here, id like to get your take on this. There are many people in well known figures who have chosen not to say silent today. There was a post that said, i do not think the movement has ever been this powerful. We do not need to slow it down by posting nothing. What about that take . I think we can all have a different opinion. That is the beauty of this country. We are about free speech. I think for some, the 400 years of frustration and hatred and micro and macro aggression is so deep that they have to express. For others, the path of blacking out and not posting anything is effective. There is room for all of us. We have to come together to change this country now. We do not have any more time. We will leave it right there. We appreciate your time. Its been a pleasure. Thank you. An infamous bay area killer gets another day in court. Reporter the president is receiving strong criticism for his handling of the fallout from George Floyds death. It comes after another night of peaceful protests that included riots and attacks on Law Enforcement that followed a president ial speech calling for law and order. And joining us not to talk more about the president s push for military response is law professor david levine. David, always a pleasure to see you. The president has the Legal Authority to take this step. Explain the law that allows it. The insurrection act of 1807 gives the president some power. It has a been invoked fewer than 20 times since Thomas Jefferson first used it. It hasnt been used for 30 years since 41 used it. Here is the key. And almost all of the cases, the insurrection act has been invoked only at the request of a governor who said there is an emergency and i cannot handle it. Whether ritz riots in detroit, the demonstrations after rodney king in los angeles, it is with the request of the governor. It is possible for the president to step in, but the president has to go through certain steps and there really has to be a situation where the State Government is utterly unable to handle it or refuses to. The best example is when president eisenhower used troops to enforce his Supreme Court order to enforce the rights of schoolchildren to go to little rock schools under the 14th amendment and the state of arkansas refused to do that. If all of the president s gun concerned about is that he doesnt think the governors are acting fast enough or harshly enough, it is not an appropriate use. In terms of raw power, it is there. If push comes to shove the Supreme Court will probably approve of the president invoking the act. Obviously, we have seen the violence that erupted in so many states. At least 14 states have called on the National Guard. If theyre already requesting the National Guard, and President Trump make the argument that the states are in over their heads at this point . The National Guard is controlled by the states. The commander in cheech of each National Guard is the governor. This problem is largely a state and local problem. By and large what we expect is the federal government will come and help and only on request. So yes, in certain places, think of that is the state militia. If we have to go to a higher level, then yes, they might want to ask for federal assistance. It is for the governors to ask, and in coordination with the governors is the president to be of assistant and not just to decide that i am going to send in troops. That would be very ill advised. David levine, we appreciate you laying out the constitutionality of all this. Thank you for coming on today. You bet. The california Supreme Court heard an appeal for a new trial for Scott Peterson. Of course, peterson was convicted and found guilty more than 15 years ago of killing his wife, lacey peterson, and their unborn son. His attorneys were going to focus on the trial judge and not to move the trial a second time. Peterson is 47 years old and remains on death row in san quentin. Coming up next, we will tell you about a new initiative. How the program policed hopes to bridge the gap between police and the communities they serve. A bit warmer across the entire bay area. The real heat moves in tomorrow. We will take a closer look at your forecast ties and bigger changes that will move in by the weekend. Z3wvpz z1s6z y3wvpy y1s6y the killing of george floyd in minneapolis has prompted calls for police reform. The Nonprofit Group police to peace is believed to change the publics perception of Police Officers. For more on this we are joined by jim bierman retired president of the Police Foundation and former chief of the Redlands Police department in southern california. When you with the chief in redlands, implemented the police to peace and it trains officers to see themselves as peace officers as opposed to Police Officers. What is the distinction . That is correct. Police to peace was not around when i was the police chief. One of my successors did that. This is how i ended up getting to know Lisa Brodrick the founder of police to piece. In california and in many states, peace officers is the actual title for Police Officers. The penal code that outlines Police Officers authority in california calls them peace officers. This notion that cops should really be about affecting piece in the community and all that entails is fundamental to the roots of policing. My view is that that is one of the things we need to get back to in this country. We need to rediscover our roots in policing and a deep sustainable cultural change level, people we refer to as Law Enforcement or cops are police, peace officers. If we can anchor that to the culture of policing, it promises to hold great change in policing from who we recruit, who we promote, reward systems and accountability. All right. Does this program, is there training involved to address the Racial Disparities that we often see in policing in terms of who gets stop, who gets arrested, and who has force used on them . There is a lot of training in this program. There is a lot of symbolism involved too. In redlands, the police car say peace officers on them. Another in South Carolina change their patches to say peace officer. One of the first things that goes handinhand with training has to do with this public messaging and how we all, cops and citizens, received the police. Are they peace officers . Are they about peace . Are they just about the enforcement of law . It is framed around just that. There are Consulting Services in terms of Data Analysis and surveys. Finding out how people feel about the Police Department. Police officers may feel that they are in fact Police Officers. The community could have a very different take on that. The images youre showing now for instance, do not evoke a sense that these are probably, peace officers. Theres a viral video thats out right now of fayetteville, North Carolina Police Department similar to the beginning of this. Before the protesters can move up to the line of officers, all of those officers take a knee which appears to take the protesters by surprise. They appear to be almost speechless. They move over to the officers and everyone shakes hands. They are there to keep the peace and to protect demonstrators and their First Amendment rights and to make sure they are saying when they are expressing their frustration and anger, even if their anger is directed at those officers. We have certainly seen many of those images across the country of officers taking a knee alongside protesters. We appreciate you coming on.
