He answers questions, until the entire courtroom can see that he is about to get caught in what he is doing. And he acts like hes crazy. How is the jury interpreting all of this . It is up to each individual juror. It was different effects on different people. Keep in mind, you can be mentally ill. You can have schizophrenia, but, if you know right from wrong, the insanity does not play for the jury. They will be instructed at the end, this trial is in two pieces. They are in what is called the guilt phase of the trial. If he is found guilty, then it goes to the sanity phase of the trial. That is where all of the psychiatrist will testify. What the defense is doing is playing the air cards early. They put him on the stand, hoping the jury will lessen the crime they convict him of. They will convict him of something. Are hoping, look, hes mentally ill, it wasnt deliberate or premeditated. Make it seconddegree murder or manslaughter. That is what they are trying to do. Will it be successful . I think not. When it comes to the sanity question that the jury will have to decide, obviously, John Lee Cowells defense team put him on the stand. Do you think that was a smart move to put him up there . In a case like this, i think it was a smart move. You get to a point, alex, in the trial, you think, what do we have . There is a video. It is a vicious video. The jury will see that and be repulsed. How do we convince the jury that this guy does not know right from wrong and he is a paranoid schizophrenic . Lets put them on the stand and see were the cards fall. The thing that jumped out at me when the da walked by him, he said, get away for me, and he swore at him. I thought, that shows the jury that he has violent propensities. Im sure one or two, or all of them are thinking, you want to find this guy not guilty or lessen his sentence . No way. He might have paranoid schizophrenia, but i am not walking him out. Bottom line is, they would be best to sing so what if he has a paranoid schizophrenic, does not give him the right to murder people. His father and stepmother said that there these were charges they were not aware of. He is not capable of killing somebody. He is a ruffian. He had some issues. The Police Investigators say that marcus is wanted for a homicide, and tracked him to his parents neighborhood. This happened at mission and 23rd street at 4 30 yesterday afternoon. Investigators say they do not believe that alcohol or drugs were involved here. It is unclear exactly what led up to the crash. Witnesses say the driver, identified as Stephen Kernan of San Francisco was speeding as he drove down 23rd street. Authorities say he had a pedestrian in the crosswalk as he turned onto mission. Immediately slammed into a bus as it was letting off passengers. The bus went across the intersection and was struck by the driver. It went out to the sidewalk, and mow down the people as they came off the bus. A third person was treated at the scene. The residence had to go through a lengthy application and security screening process. They all have jobs and the stay will be temporary. The rent they pay will go into a savings account.
