The reason why the attorney general and the administration said that they were terminating it because it was unlawful is that they did not want to take ownership of the decisions. It looks like that our five conservative justices are likely to back the Trump Administration. You cant be absolutely certain and particularly with chief Justice Roberts you cant be sure which way he will go. If you are going to put down your . 20 bet you should put down that the Trump Administration would come away with the victory. Is there any precedent here . Theres a lot of precedent in it on the sense that theres a question of the power to issue an executive order and the question of whether or not the judiciary has the power to review this or not. It ties into the census case which is the question of how much of a reason does the administration have to give for this change of policy . They really have to go through some sort of a review or is it enough just to say we changed our minds . And that is part of what we will learn from this opinion. You alluded to it that the Supreme Court could side with the Trump Administration and end up striking down daca. If that does happen what happens to the 800,000 dreamers in the country . It matters on what the Supreme Court says. Lets assume the administration is going to win. One way they could win would be a finding that the Obama Administrations program was in fact illegal and then the only course of review would be to go to congress and to get something passed legislatively. The question would be on the power of the president to do this on his own. Do you think congress will step in if they do strike down daca . Maybe. Depending on political pressure. Many say these are sympathetic kids and they have proven themselves over and over again. Sitting at the counsel table this morning was one of the dreamers who has become a lawyer. And that is exhibit a of how terrific some of these kids are. It really depends if they say daca is unconstitutional in which case the only course will be to go to congress. If and said they say the administration is allowed to rescind the Obama Administration program, if and when there is a new president , the president could say we are going to go back to Obama Administration rules with an executive order. If the Supreme Court finds that daca is unconstitutional, we have 700 to 800,000 people, i cant imagine what this is like for them wondering what their future will be. Would they have to leave the country . In all probability what would happen is that they have all been registered. The young people have registered in the program and in the interim, Lower Court Judges have allowed them to renew for two years. In all probability nothing will happen. If the Supreme Court finds it unconstitutional how could they renew as they do every two years . If they say it is unconstitutional, it is not likely they would go that far because the court doesnt have to go that far. If it is completely unconstitutional and you are right. Everything would be rescinded. The administration was talking about winding it down, not immediately resending it. The way you would wind it down is to say no more registrations, no more renewals and that would mean the people would have as long as two years to continue to work etc. Even if they lost their daca status the chances that we will see a big roundup of these people is infinitesimal. There are far bigger problems out there than these kids. Yes it is scary, we dont know what will happen, but it is not as if an hour after the Supreme Court issues a ruling i. C. E will roam the streets. Nothing happens quickly when we have these cases. How long do you think it will take before we can expect the court to hand down a decision . We note the decision will come by the end of june. In all probability it will be 4 6 months from now. Think about the political season. We will have some of the primaries and people will be paying attention to the next election and this will be just one more thing for people to focus on to decide who should be the next president. Should mr. Trump get four more years or should there be a new person in office . And this will be just one more thing to worry about when people are deciding to vote. In the first cleanup Phase Property owners must allow hazmat crews to remove all Hazardous Materials such as paint, pesticides, fuel, batteries and other items must be recycled or retire to a dumpsite for toxics. Homeowners should not do the removal. There will be about 40 people that will go parcel by parcel collecting anything that is of obvious danger. Once the lot is cleaned comes the far more difficult phase 2 when Property Owners may hire a cleanup contractor to remove ashes and debris from the lot.
