lied about why they wanted to rent the house for that party. now four people are dead in the search for the gunman is continuing.>> a scene of horror as gunfire erupted in a quiet neighborhood in orinda. >> it got really chaotic. a lot of yelling and shots were fired.>> four people were killed when shots rang out on lou seal way. this was advertised as a airbnb mansion party. although the gunmen escaped, police say there is no ongoing threat. the motive is unknown. >> this is a complex investigation. there was a wide area with lots of people involved and we are trying to wrap our arms around what transpired. >> video taken inside the party shows a crowd of people enjoying themselves.>> everyone was having a good time, not really worried about what was going on. it was halloween. >> that changed around 10:45 when someone opened fire and three victims died at the scene. many others were hurt, others from jumping off the balcony or running to escape. >> people were fleeing into the neighborhood and, we tried to take cover. >> reporter: this instagram post told partygoers to bring your own beer, as well as a dm for the location. sources tell me the person who rented the home falsely claimed they were escaping the smoke from the kincaid fire. the owner of the home wanted no more than 12 people there. instead, sheriff's deputies found more than 100 people spilling into the street in a city not used for such violence.>> quiet and peaceful this is the last place i would expect something like this to happen. >> in a statement, airbnb says they have taken action to ban the booking guest. the city manager tells us this house has been the source of previous complaints for parties, and that the owners had addressed those complaints. the names of the victims have not yet been released. >> okay henry thank you.>> for more on this incident we wanted to bring in our legal analyst michael cardoza. so many people involved here. you have airbnb , the owner of the home and the person who rented the home. let's start first with airbnb and their potential involvement .>> they are the platform for which people rent. and through which homeowners try to rent their property. the families of the deceased will be looking for deep pockets because lawyers aren't going to sue someone that doesn't have enough money to make it worthwhile. they will look at airbnb and how successful they will be will be interesting because they will certainly find out what exactly airbnb does. to make an analogy it's like checking into a hotel. would we say, give me your criminal record? let me do a background check before i write you a room in my hotel? these people who ran through airbnb do so on a regular basis. they are in the hospitality business. one of the questions will be where is his insurance? >> the homeowners? >> that's right. >> let me ask you about the woman who rented the house. you heard in henry's peace, he talked about the information we had and that she misled the owner of the home. about why she wanted to rent the place. she was not supposed to have a party there, what kind of liability does that open her up to. >> all sorts of liability as she rented under false pretenses. she defrauded the homeowner by saying there will not be a party, guns or drugs in the house. people that do these types of parties, where they invite hundreds of people over, they will rent a place and have a mansion party and often times charge people to get in. so is she liable? absolutely. but the big question is does she have deep pockets or does she have nothing? you may want to go after her just in case some day she wins the lottery but otherwise they're looking for deeper pockets. >> what you think comes out of this, we have heard from people in the community concerned about these short-term rentals. >> make it personal, if you had an expensive home or a million- dollar house, and you had somebody renting, and absent landlord. the first thought is what does he or she care about this. from what i understand in this particular house they have had parties before and they have had noise problems and such. so the landlord was on notice and that will be a big part of this lawsuit. why didn't you check into who she was? you knew there were problems there before. to his credit, someone complained to him and he called the police right away because he looked at his surveillance camera and said look at all the people. he called the police, they were on the way when the shooting happened. it will be like napa valley, if you are going to rent your place it has to be either one time a month or it has to be a 30 day rental. or they could change it in any way they want. if you are the homeowner next door, do you want that happening next-door? who is coming over tonight?>> it certainly raises a lot of questions.>> it's going to and the council will change the rules. >> thank you. >> for more information on the hollow ween night shooting, you can find it on our homepage at ktvu.com. a car to car shooting shut down all lanes of the east bay bridge around 6:45 by a chp officer who heard the shots fired and saw a man in a contact silver suv shooting at another vehicle. there were no injuries but the vehicles were damaged. all of the lanes reopened around 8:20 in the morning. the shooter got away. if you have information on the case please call the chp. a man shot and killed by an officer yesterday was holding a replica gun. 2:30 yesterday afternoon near north jackson afternoon. officers were called on reports of a man with a gun. the officers ordered the man to drop the weapon and get on the ground, they say he refused, again walking towards independence high school. they say he appeared to be drawing the gun when he was shot. police released a photo of the replica gun and say the suspect's name will be released after the family is notified. today workers scaled the pg&e transmission tower believed to be involved in the ignition of the kincaid fire. we spotted several pg&e trucks and workers performing unknown maintenance or repairs on that tower which is near kincaid and burned mountain road. one day after the fire broke out the utility filed a report saying they discovered a broken wire on a high-voltage tower. a pg&e spokeswoman would only say that cal fire is investigating and the utility is cooperating. today the governor said northern california deserves a utility company in the same caliber as the firefighters. he said the cpuc is launching an investigation into the power shut off protocols. he named an energy czar to work on reviewing these processes. >> we cannot afford what we have experienced over the course of the last week. we had people out in some circumstances for one full week without power. with no access in some cases to running water or the ability to bathe their children. we had sewer system issues, the amount of food that rotted and was destroyed. >> the governor said over the next few weeks energy officials will also present a framework for the cpuc about what a 21st- century utility grid would look like once pg&e comes out of bankruptcy. state legislators are reimbursing cities by the cost incurred by recent power shut off. larger municipalities will receive half $1 million while smaller ones will get last.>> jesse is outside city hall, will any of that money make it to customers impacted?>> reporter: good afternoon, the short answer is no, not with this funding. but the mayor says this is money that will go towards reimbursing the city of san jose for costs associated with the shutdowns. as well as using it as seed money to help the city become more resilient in case of future power outages. >> this will help us invest in infrastructure. >> reporter: the mayor says the $500,000 in state money will go to help san jose in its quest to add micro grid and communications equipment. the money comes from a pool of $75 million at the state level distributed to affected cities. half 1 million to larger cities and less to smaller ones. >> that's $.50 per average citizen, the real problem is the state is wealthy enough to come up with a little change. >> dating back to late last month the utility has had three power shut off due to fears strong wind could topple aging powerlines. officials are investigating if damaged lines are a partial cause for the kincaid fire. an we have equipment that goes around our mountains. we could very well have the same kind of situation here.>> reporter: senator bell says a proposed 10 year fix is too long leaving residents vulnerable to the uncertainty of power shut off. some residents arguing the cities reimbursement isn't trickling down to them. >> is like a temporary band-aid. there is fixing to do. >> reporter: officials say the puc will determine if customers can be made whole. for now, the half-million dollars is a way to address and ongoing crisis while laying a foundation for a taxpayer owned utility.>> this is about investments we make being more resilient for the future. this money will be very welcome. >> reporter: senator bell says a state task force will take up the question of fire safety and pg&e reimbursements to customers starting on november 18 and next week, here at city hall, more information and cost the massive intentional blackouts designed to prevent fires from breaking out. lawmakers are sounding off on all of this. it is the topic for the issue is. joining us now is alex michelson who spoke with the mayor of los angeles who had thoughts on both of these issues. >> heather so many people are impacted by this. i know your new medical reporter greg lee had the power off at his house. i don't know if you had power outages at your house but so many viewers had to deal with this. the mayor of los angeles is really keeping track of what's happening in northern california. sort of contrasting what is happening in southern california as this entire state tries to figure out how to avoid having this happen over and over again. here is what mayor eric garcetti had to say. >> the state has no power these decisions are made by the executives of these independent utilities. i can listen to their suggestions but the governor and legislature are powerless to do anything. so we have to look at some changes to state law and we have to look at throwing the liability onto these private utilities. we are all upset with them but that comes back in your rate. you may see a doubling in the rate just to deal with liability.>> what the mayor is talking about is here in southern california, the dwp is publicly owned so there aren't some of those issues. i asked governor newsom about that, should pg&e be publicly owned? should we change the whole structure. he didn't really get into answering the specifics of that question, just saying there needs to be more regulation. that is going to be an interesting defining question for california politics. in the coming months. as we know fire season is not over. >> obviously very frustrating times. we did hear from the governor who said he wants to speed up the bankruptcy process for pg&e so there can be restructuring and a focus on how to deal with things like this in the future.>> and of course he also announced this week there is going to be some rebates for some of the folks who were impacted by this. that was something that pg&e has fought back on but now are acknowledging they need to move forward. that will be the great challenge for governor newsom. some folks remember when gray davis was governor, there was a situation with enron, many people ended up with no power and that led to governor schwarzenegger. the governor is well aware how important it is to handle this situation and we have seen him so active in southern and northern california meeting with folks and trying to keep a handle on a situation that many people think is largely out of control and certainly frustrating.>> alex michelson, always appreciate it. elizabeth warren unveils details of her medicare for post poll. most democrats in the administration with respondents disapproving of how democrats have handled the process. >> this will now move to a public impeachment investigation. >> reporter: another pole from the new york times shows that while voters in six battleground states support the impeachment, a majority oppose removal from office. the white house says it is ready if an impeachment happens. >> starting from the beginning with all of the closed-door meetings and selective leaks, this has been set up to make, to impeach the president.>> the republicans have been included. >> the resolution laying the framework passing in the house 232-196 on thursday without a single republican vote. two democrats from districts the president took voting with their gop colleagues. >> witnesses are set to testify next week but it is unclear who will actually appear. also uncertain is when the public sessions will begin, what we do know is that open hearings are on the way in the wake of thursday's vote. in washington, lauren blanchard, fox news. former texas congressman beto o'rourke has dropped out of the race for the white house. formally announcing the end of his campaign in a twitter post this afternoon. he became a national political figure following his narrow loss to ted cruz, in deeply conservative texas in 2018. he has been lagging in the polls and his fundraising in the crowded race. he has failed to qualify for the november 20 democratic debate.>> elizabeth warren has released her plan to pay for medicare for all, proposing $20 trillion in federal spending over the next decade. this plan would provide health care to every american without raising taxes on the middle class. for more on this plan we are joined by larry leavitt, executive vice president for health policy at the kaiser foundation. we appreciate you coming on. as you look at this plan, warren says she can accomplish medicare for all by simply, raising taxes on the wealthy, corporations and by cutting spending. does the math add up? >> i do think the math adds up in her plan. the real question is the politics. this is a bold plan. a big tax increase to replace what people are paying now in premiums and deductibles. most low income and middle class people would end up paying less for healthcare but the wealthy would end up paying a whole lot more. part of the way she pays for this plan is by reducing what doctors and drug companies get paid and that is certain to be controversial. >> let's go to that point, essentially under her plan doctors and hospitals would get paid the current medicare rate. so how much money do they stand to lose?>> right, doctors would get paid the current medicare rate and hospitals would make 10% more than the current medicare rate. the challenges under private insurance doctors and hospitals often get paid as much as twice what medicare pays. so we are talking about a substantial reduction in what doctors get paid. >> for folks who may not understand this concept, the single-payer healthcare, how does it work? i'm someone with health coverage through my employer right now, how would this work under a medicare for all plan? would i have to pay anything for a doctor visit?>> yeah, it would change the way people get their insurance. so people who buy their own private insurance or coverage through an employer, they would instead get insurance through medicare the way seniors get it today. there would still be private doctors and hospitals but everyone would get insurance through a public plan run by the federal government. people would pay nothing when they use healthcare. no deductibles, co-pays, no coinsurance. so healthcare when you receive care would be free. >> you touched on it earlier but let's talk briefly as we wrap up about the politics of this. we know that elizabeth warren was hounded for some time by some of her competitors in the race to release these details about her medicare for all plan. do you think she is going to be able to silence the critics? >> i think this does silence the critics who said she didn't have a plan. this is the most detailed specific, plan for medicare for all that i think any candidate has ever released. but she creates some new potential for political vulnerability. a big tax increase and the reduction in payments to doctors and hospitals, most people would end up better off, but you can bet the critics will pounce on these vulnerabilities. >> we appreciate you coming on, larry leavitt, vice president of health policy with the kaiser foundation. thank you. let's turn our attention to some breaking news happening in lakeville in sonoma county. these are live pictures from sky fox where a cal fire vehicle has been involved in a deadly two-car crash. the highway is closed now as you can see in the pictures between state route 37 and 116. we are told the crash involved a cal fire chevy tahoe and a jeep. an occupant of the jeep was killed. we are working to learn if there were any other injuries and to find out more about how this crash happened as soon as any in information becomes available. we will have more coverage coming up on ktvu news at 5:00. hundreds of students were back at school for the first time in weeks in chicago. teachers in the country's third- largest school district have been on strike. they voted wednesday night to accept the tentative new contract with the city. working out an agreement to make up five of the 11 school days lost during the strike. lori lightfoot visited schools this morning to welcome students back to class. the teachers union president calling the deal a win for teachers. >> we accomplished every single thing, no, but we did move the needle on educational justice in the city. we are proud of that. >> the new deal includes a 15% raise for all teachers over the next five years, the formation of a committee to enforce limits on class sizes, also the hiring of a nurse and social worker five days a week in every school. >> the warriors announced this afternoon that stephen curry is expected to miss at least three months because of an injury suffered earlier this week. he underwent surgery to repair his broken left hand in los angeles this morning. the warriors say they will be reevaluating his injury in early february to determine if he is ready to play. that means he will miss at least 45 games with the possibility he could be sidelined longer than that. the two time mvp broke his hand during the warriors loss to the phoenix california firefighters are attacking wildfires. high wind fueling the maria fire which ignited thursday evening. that blaze has prompted a mandatory evacuation and burned through some 8000 acres. >> we have a heavy presence in there, not only on the ground. but also aircraft. >> firefighters have been able to contain the kincaid fire which has burned more than 77,000 acres.>> the firefighters did a tremendous job with difficult wind conditions. we put a lot of resources in place and they did a great job. >> hundreds of thousands of residents were forced to evacuate due to that fire with many now returning home.>> i never left feeling i wasn't coming back. an >> reporter: utility companies have made the controversial decision to do blackouts in order to prevent new fires from sparking. >> i come before you tonight is a grateful person. grateful to be at the tail end of a string of dangerous october wind events. and the tail end of the power shut off done for safety. >> reporter: even though progress has been made california remains under a red flag warning as fire conditions remain in effect. christina coleman, fox news. back here at home, thankfully the wind has calmed down in the bay area. many fire crews up north getting a handle on that kincaid fire. for the rest of the bay area, rosemary, a clear cool day.>> the clear skies and light wind allowing the temperatures to fall off into the overnight hours. that is what will happen tonight going into saturday morning. a ridge of high pressure is locked over the west and that is pushing the storm track well to the north. take a look at that. we will remain high and dry for the next several days, we would love to see some rain. for the next week or so it looks like we are going to be dry. here is a look at the future caste model, over the next several days you will notice how the storm track is pushing way up and over even the pacific northwest. washington and oregon dry for the next several days. getting out the door tomorrow morning hopefully you don't need to be anywhere. it will be another cold one with a big chill around the entire bay area but it's really our north valley areas feeling it. we are looking at another frost advisory until 9 am. take care of your pets and plants, for some your water pipes. the temperatures tomorrow morning, below freezing in santa rosa, around the bay area, 45 in oakland and upper 40s for san francisco. into the afternoon we will warm temperatures up by a few degrees compared to where we were today. 77 is the high. santa rosa getting to 81 degrees so warm for you. as we get into the east bay, 74 for alameda, 77 in brentwood. for the south bay, afternoon highs in the upper 70s. a nice day by the water in santa cruz at 78. along the peninsula, 76 and low 70s expected for san francisco. upper 60s and low 70s down through half moon bay. under mostly sunny skies. it will be nice out there, nice and mild once we get past the morning chill. here is a look at what's going on in tahoe, upper 50s reported in truck he as well as areas of south lake tahoe. the temperatures will plummet once again starting out in the mid and upper 20s not only for tomorrow but sunday morning as well. low 60s expected on saturday over tahoe with mid 60s on sunday. getting into our forecast, temperatures will come up by a few degrees on saturday, cooling back a touch on sunday and as we get into the weekend only subtle changes coming our way with dry weather in the extended forecast. and yes we get an extra hour of sleep this weekend as we push back the clock one hour saturday into sunday.>> thank you so much. one nurse who was evacuated from sonoma county during the kincaid fire managed to keep track of her patients. >> she shows us how she spent her time caring for others.>> reporter: this is the first time she has been able to visit her homebound patients in a week. she is visiting a patient in santa rosa. >> are you in any pain?>> reporter: with the kincaid fire, she faced a mandatory evacuation order. she left but the very next day came back.>> i was forced to come back home. >> reporter: he is a quadriplegic suffering from a bedsore.>> the longer i was off the mattress the worse it would get.>> reporter: he had to get back to it, the nearest hospital with one was shut down. >> i had to get back into my air mattress or the wound was going to get worse. >> i'm happy you came back.>> reporter: with him in a mandatory evacuation zone, page couldn't get to him. though she called him every day. >> she would call me and i would call her. she would call me three times a day making sure everything was okay. an she would advise them over the phone, driving to her other patients who she couldn't reach.>> i was knocking on doors to see if they were okay.>> reporter: in sonoma county there are over 160 patients like kent who are impacted. some of their nurses had to evacuate.>> they didn't have their scrubs or equipment but they wanted to get out there. that's my job, it's what we do. all of us who could, were working. >> reporter: for her patients, her care in the midst of a catastrophe meant so much more. >> it's not just a job to them, to me, they really care about us. an -- >> incredible. nurses are amazing. >> the son of hollow ween might be over but why not have more fun over the weekend. >> there is a whole lot
