Contra costas firefighters are battling fires in the marsh creek area. A shelter in place was ordered for morgan road territory road. There is no word yet on what it may have sparked these two fires. Surrounding Fire Agencies have all been called in to help put out these fires. Ktvus Elissa Harrington is live, where fire crews have mobilized. Good morning, eliss a. Good morning. You can see the fire burning on that ridge behind me. But we know, so far, 500 acres have burned. I got an alert saying shelter in place on marsh creek road between Morgan Territory and deer creek valley. Theres a lot of smoke. A lot of firefighters on scene. And what we know is that fires are burning on the north side of marsh creek road. So far, no homes have burned. But the fire is close to several structures, including the marsh creek juvenile detention facility. Thats about half a mile from where we are. I can tell you, were surrounded by open space. And a lot of ranchers. In fact, weve passed a lot of rancher the with trailers out, getting ready if they need to. People should avoid the area. There say road block up at marsh creek and pine lanes. The road between clayton and brentwood is completely shut down to traffic. We dont know what sparked these fires, or exactly how many fires broke out overnight. Theres not a lot of wind right now. So firefighters definitely hoping to get this under control. The fire also burning by the clayton palms community, which is a Mobile Home Park. So again, several structures threatened. And if we can put the camera around, i want to show you one of the ranchers down there. Im seeing chickens walking around. Theres home, people out, keeping a close eye on this fire. Making sure it doesnt come too close to their home. Reporting live in east Contra Costa County, Elissa Harrington, fox 2. Gunman at the garlic festival in gilroy died of a selfinflicted gunshot. The 19yearold was hit multiple times by officers bullets. And they say he may have been already lying on the ground. Police initially said the officers bullets killed the gunman. The new information doesnt change what happened. In my mind, it changes nothing. You know, the officers still got there fast. They engaged fast. They threw fire. And they eliminated threat. Whether he fired that final shot or not is, in my mind changes nothing. The information comes as people in gilroy said they are working to move forward as a united community. The people of gilroy say their spirit isnt broken and the city will rebound. A center is set up at rutger elementary school. So far, the center has helped more than 350 people. Some walked in, while others called the center. Everything from shock to disbelief to outright traum taization. The phrase gilroy strong can be seen throughout the city. Local stores are selling t shirts with this message. One store owner made these shirts after she made a donation to the relief fund. But she still wanted to do more for her community. And arrested this man, related to the garlic festival shooting. Jose pinon reportly wrote, quote, he wanted to kill 500, not 3. In reference to the festival shooting. He also faces charge of violating a restraining order. Organizers say they stepped up security for this weekends festival of the arts. Fremont police had already planned for a number of officers both in uniform and plain clothes. There are also large street barricades and a surveillance tower. But this year, because of the garlic festival shooting in gilroy, security is going to be even tighter. Organizers will have uniformed s. W. A. T. Officers in the crowd. Two of the fremont festivals, longtime vendors were hurt in gilroy and remain in the hospital. Clearly, they will not be at our festival this year. So we are having a sign in the position that they normally have. And i know theres a go fund me page to help with their escalating medical costs. So were going to be promoting that as well. Organizers say they will be paying tribute to all of the victims of the shootings; today and sunday in downtown fremont. A raffle organized by the Police Officers union is canceled. The drawing caused controversy because the winning prize was a semi automatic rifle. A fullpage ad for the rifle appears in van guard, the san jose Police Officers organization. Organizers say the ad should have been pulled following sundays shooting in gilroy. Ill take full responsibility that i didnt take it down after gilroy. Our focus was just on gilroy. But i absolutely think it was a mistake not to take it down sooner. I apologize for that. But you know what . We did the right thing to do. Thats a good decision. I hope that they keep their word in this raffle. A gun raffle is off the table forever. The san jose Police Officers association promised the annual raffling of a gun will no longer take place. New this morning. Rohnert park police are searching for a man accused of sexually assaulting a 16yearold girl. Police say that assault happened 10 00 tuesday night. The girl said she was on a path along hopeland creek Near Country Club drive when a man grabbed her and sexually assaulted her. The suspect is described as a man in his 20s with a heavy accent and a tattoo on his left hand. If you have any information, youre asked to call police. And a standoff in palo alto is still under way this morning, after nearly 24 hours. Police say it started yesterday morning. They say the woman is safe this morning. And negotiators are still trying to get the man to surrender. The standoff at a home. Police say the man may be armed with a gun. But they say there is no danger to the community. San rafael police are stepping up patrols after a spike in home burglaries. Police say there have been 14 burglaries in the past four weeks. Eight of them happened in the tera linda neighborhood. And almost always between 9 00 a. M. And noon. Police believe the burglars are watching and waiting for people to leave their homes before breaking in. Theyre pretty quick about it. And they grab a pillow case. They filled the pillow case up with what are they looking for . Whether its electronics or jewelry. Yeah. And theyre gone. Found a dog on the bed. And the computer was gone. And the jewelry was gone. And they had ransacked the house. They watched. And i dont know how. But i think they know when people go to work. Police are also reminding people to be aware of their surroundings and report anything unusual. Now an update on two local teenagers being held on suspicion of killing a Police Officer. The families of 18yearold gabriel natali yors and 19yearold are asking a court to release the teens. But their attorneys dont know when the tribunal will hear the appeal. Authorities say the teens stole the dealers bag and demanded their money and a gram of coke. The dealer tipped off police and went o. Authorities say an elder stabbed an officer to deat elders father is returning to the bay after visiting him twice in custody. Elders father released this statement saying, quote, it was good to see finn again. The family remains broken over the loss of life. They are hoping for Surveillance Video to show what actually happened. A cliff collapsed onto a beach in Southern California. This all happened in the city of encinitas, which is about 30 miles north of san diego. That beach is a popular spot for both tourists and locals and it was crowded at the time of the collapse. Lifeguard asks deputies rushed to help people who were trapped under mounds of rock and soil. The beach has been closed off. Authorities say all of the victims were adults. A mother and her son are recovering this morning after firefighters in San Francisco had to wes rescue the pair. Firefighters say the call came in around noon friday, after a passerby noticed the two and their dog stranded 20 feet down a cliff. It took about two hours to pull the 8yearold boy, the woman and dog to safety. Firefighters say the woman and son were shaken up but not hurt. One firefighter suffered minor injuries during the rescue. The state of california is making a big investment in emergency preparedness. The state set aside 1 billion. Im going to chat now with battalion chief jim hunter, with contra costa fires. What can you tell me about these fibers . How many of them started overnight . The fire came in about 3 15 a. M. And we found about eight different fires burning. And so right now, its at about 500plus acres. Dont have the containment exactly yet. Some fires are still not contained. Were seeing a lot of homes and ranches around this area. Are people in danger . I would say not now. They were at the beginning. Because the fire was burning, and we didnt have enough resources here. Weve called in several resources now. So were getting it contained as we speak. Are a lot of homes still threatened . Up on some of the flights, im not sure. The ones in the area were stant standing at right here were not. We have this area of the fire contained. What can you tell us about this terrain . The terrain is very steep. Its some of it is only walkable. We have bulldozers also out there, putting the fire out. And some we cannot drive on. It makes the access egress difficult for us. We were told eight fires overnight. Five burned here on marsh creek. And three on Morgan Territory. Are these suspicious . Yeah. At this point, without having without having lightning strikes, yes, we have our arson investigators on scene, as well as working with cal fire. And were taking it real serious. And we dont know the exact cause of the fire yet. Do you think there is anything else people should know this morning . We had no homes burned at this point. Theres no reason for anyone to leave. And an update involving an east bay Medical Transport company that bills the state for uninsured, unregistered and unsafe vans. Four years later, the owner appeared in court to face felony charges. Nathan rabba and his son and wife all pleaded not guilty to fraud, grand theft and money laundering. They also waived their rights to preliminary hearing. Prosecutors say they billed insurance for dead or incarcerated patients, padded mileage on reimbursed routes and lied. The trial is scheduled for late september. Judges ruled that search warrants carried against a journalist were improper and should be sealed. They issued warrants for his home and office. Police are trying to learn how carmody obtained details surrounding the death of public defender adachi last weekend. Court papers say he did not say he was a journalist with a policeissued press pas. Under California Law, journalists are protected from having to reveal sources. Arrest warrant. Wednesday, three bay point homes were vandalized and spray painted with racial symbols and slurs. A rock was thrown through two of the homes. Cars were also spraypainted. 63yearold alvin brown was arrested early this morning. He has ties to one of the victims and staged the incident to look like a hate crime. Viewers are understandably angry. I drove around. And everybody has their mouth open. And they think, what did she do to deserve this . I have done nothing to him. So theres no reason for him to try to harm my family. Especially with three children in this house. Brown is held at the martinez detention facility. Held on three counts of vandalism. Shooting death of a 24yearold father of three. Police arent releasing the suspects name, until the Alameda CountyDistrict Attorneys Office decides whether to file charges against him. He and another man were shot while sitting in a car near arthur street on july 22nd. Both victims were taken to a hospital. But died a short time later. The other man survived. The jury in the ghost ship trial was set to resume negotiations. They received the case wednesday afternoon. And spending a full day deliberating. The nine women and three men on the jury are deciding whether derek almena and max harris are guilty of 36 counts of manslaughter. Now, the fbi says a gun stolen last month from an agents car in oakland has been recovered. The thief took a colt m4 automatic rifle. Ammunition clip, loaded with 45 caliber bullets. Along with ammunition and a jacket, with official fbi markings. This happened on july 10th at a Shopping Center the fishhas not revealed where the gun was found. Or if the ammunition or jacket were also recovered. A longtime advocate in the south bay says be able to do even more after a generous gift. It is now refurbishing an old 32footlong rv. I just got an update from calfire and they told me they battled 12 fires overnight, the largest when burning here along marsh creek road. You can see several homes and write up on the home side, flames. Several firefighters are trying to battle this, this is about 250 acres, more than 500 acres total have burned. Firefighters have had to call in water tenders because it is a very rural area and they will bring in air support later on. One of the first fires was called in around 3 15 this morning, they were called in along marsh creek road and along Morgan Territory. Firefighters tell me they responded to 12 total. At this point there is not a lot of wind but it is supposed to heat up. They have also called in about five strike teams. I can tell you there is a lot of smoke, we also saw firefighters stationed in front of different structures ready to protect those structures if needed. We also saw different ranchers out with their trailers getting ready to leave. I spoke with the battalion chief this morning and i asked him what he thinks about this number of fires burning all around the same time. I do not know what started the fires. We have investigators looking at it, they will come up with something. Certainly with this many fires it is suspicious. Reporter at this point they are not sure if there is arson they are looking at that. There is a shelter in place along marsh creek road between Morgan Territory and deer valley. Firefighters did have to evacuate a Mobile Home Park earlier, those the people have been allowed to return home. This is burning half a mile away from the juvenile detention facility. We have seen a lot of homes, branches, animals, certainly people concerned about what may happen. Again they are expected to bring in air support later on this morning. Ktvu fox tv news. This morning we are learning that the gunman at the garlic festival died from a self inflicted gunshot. That is according to the Coroners Office. Police say the 19yearold was hit multiple times by officers bullets and may have been lying on the ground when he shot himself in the head with his own rifle. The chief of police says the information does not change how he feels about what happened. In my mind it changes nothing. The officers engaged him fast, they withdrew his fire and they eliminated him. Weather they fired the final shot or not, in my mind it changes nothing. This comes as people in gilroy say they are working to move forward as a united community. The people of gilroy are still grieving say the spirit is not broken and the city will rebound. A Family Assistance Center was set up. So far they have helped more than 350 people. Some walked in and others called. Everything from shock to disbelief to outright trauma, we have seen it all this week. The phrase gilroy strong can be seen throughout the city. Stores are selling shirts with this message. One store owner printed these shirts after she made a donation but she wanted to do more. In Gilroy Police arrested this man for allegedly making threats related to the garlic festival shooting. The 40yearold posted on facebook that he wanted to kill quote 500, not three. Apparently in reference to the number of People Killed at the shooting. He also faces charges of violating a restraining order. Organizers say they have stepped up the security for this weekend festival of the arts. Fremont police have line for a number of offices both in uniform and in plain clothes as well as surveillance towers. This year because of the garlic festival shooting security is tighter. Police will have uniform swat officers on the ground. Two of the fremont festivals longtime vendors were in gilroy and they are still in the hospital. Organizers say they will pay tribute to all of the victims of the shooting. The festival runs today and sunday in downtown fremont. A raffle organized by a San Jose Police union has been canceled. The families are asking an Italian Court to release them. Their attorneys do not know whether a tribunal will hear the appeal. Authorities say the teenagers stole a dealers bag and demanded money and a gram of coke. The dealer tipped off police but when officers arrived they say elders stabbed an officer to death. We are continuing to follow the breaking news in eastern Contra Costa County, authorities tell us 12 vegetation fires broke out overnight near the areas of marsh creek road and Morgan Territory road. They have combined to burn 500 acres. The largest fire has destroyed about 250 acres. A Mobile Home Park has been evacuated as a precaution. Other People Living near the area are being told to shelter in place. So far there are no reports of injuries or structures burned. Arson investigators are coming in trying to figure out what set off the fires. The battalion chief says the fires are suspicious because there was no lightning overnight and the sheer number of fires is a reason for concern. A suspect was arrested in the east oakland shooting death of a 24yearold father of three. Police are not releasing the suspect name until the District Attorneys Office decides whether to file charges against him. Jalen tate and another man were shot was sitting in a car on july 22. Both victims were taken to a local hospital but tate died a short time later. Three San Francisco judges ruled that search warrants used to carry out a police raid against the freelance journalists were improper and should be unsealed. Those warrants were issued for the phone home and office. Police are trying to detail the circumstances surrounding the death of the public defender last february. Court documents show that investigators did not tell a judge that he was a journalist with a Police Issued press pass. Under California Law journalists are protected from having to reveal sources to police. A man faces felony charges in a vandalism case in the east bay. Take a look at the maps and we can show you what weve been hearing about. The terrain and the access, which is the typical case, it is a challenge for them to make that. There is the location and this is called the marsh complex and it will be the biggest challenge later on and that will be the heat. Right now temperatures have been warming up. So for the 9 am hour we have 60s and 70s. The humidity, the relative humidity is up to about 50 or 60 up to 80 . I 3 00 pm those numbers will come down quite a bit and the temperatures will go back up into the 90s and mid 90s later on. You may notice smoke and haze in the sky especially later on today. And a sickly all day long with fire activity. As we look at the fog, it is hugging the coastline and we will check in on some of the current numbers. Livermore at 67 and oakland 62. San francisco, 56. Heres the forecast for today. Partly cloudy skies and areas of fog and then we will bring in more sunshine this afternoon as the clouds cleared near the coastline. Air support just arrived and weve seen them make a few drops on the hillside behind me we you can see flames are burning. There are few firefighters up there right now and there is the air support right now. Lets go ahead and watch this. As you can see they are making some Good Progress on this fire. The battalion chief with cal fire said this is the largest of 12 fires that sparked overnight. This is one of about 12 fires on Morgan Territory road and this is about 250 acres and about 10 contained we are actively suppressing the fire as we speak. Reporter heres what we know. Roughly 500 acres total have learned. They are calling these suspicious and they will have arson investigators take a look at what happened. We know that they started along marsh creek road and along Morgan Territory. The first one was at about 3 15 am and they are working with some steep terrain and have bulldozers out here. They did have to bring in water and strike teams. Marsh creek road is closed between clayton and brentwood. There is a shelter in place between Morgan Territory and deer valley. People are being asked to shelter in place. Earlier residents of the clayton palms Mobile Home Park had to evacuate. I spoke with woman who rushed to escape with her dog and she said her husband ran down the street at about 3 am this morning waking up neighbors and screaming that there was a fire. Very frightening. I would say at about 3 am looking out my window i saw this hill on fire and took a photograph and, as you can see, it my sister lives two streets over and her house looked like it was going to go up. Reporter that women took this picture to show how close flames got her home. We saw the hillside behind that area and people have since been allowed to return home and firefighters have not issued any additional evacuations but there is that shelter in place. Theres still a lot of homes here. We have seen ranches and people with trailers getting ready to go in case this fire does end up getting too close. There are several agencies out here. And cal fire is the major one but i saw contra costa fire. And the cause of these fires is still and know. We will check in with you in about 30 minutes. The Santa Clara CountyCoroners Office said the shooter at the garlic festival died from a selfinflicted gunshot wound. He was hit multiple times by officers bullets. Authorities say he may have already been on the ground when he shot himself in the head with his own rifle. Police initially said the officers bullets killed the gunman. The police chief said this new information does not change about how he feels what happened. In my mind it changes nothing. The officers got there fast, engaged, and they eliminated the threat. Whether he fired that final shot or not, in my mind, changes nothing. This comes as people are working to move forward. The people in gilroy are still grieving but they say their spirit is not broken and they are promising the city will rebound. A center set up has helped more than 350 people. Some walked in and others called for help. Everything from shock to disbelief to outright trauma. We have seen it all. The phrase gilroy strong can be seen throughout the city. Gilroy police have arrested a man for allegedly making threats related to the garlic festival shooting. This man reportedly posted on facebook that he wanted to kill 500 not three people. And that was in reference to the number of People Killed. He is facing charges of violating a restraining order. Organizers have stepped up security for the festival of the arts in fremont. Fremont police have planned for a number of officers in uniform and in plain clothes. This year because of the garlic festival shooting in gilroy, security is tighter and police will have officers in the crowd. Sundays shooting hit close to home. Two of the fremont festival vendors were injured in worry ands are still in the hospital. We are having them assigned in the position that they normally have. Organizers will be paying tribute to all of the victims and the festival runs today and sunday in downtown fremont. A raffle organized by the Police Officers union has been canceled because the caused controversy. The winning prize was a semi automatic rifle. There have been 14 in the past four weeks and eight happened in the terra linda neighborhood and almost always between 9 am and noon. A mother and her son are recovering after firefighters in San Francisco had to rescue them. The call came in around noon on friday after someone noticed them and their dog stranded 20 feet down a cliff. It took rescue teams about two hours to pull them to safety. Firefighters said the mother and son were shaken up, but thankfully not hurt. One firefighters suffered minor injuries during this rescue. A woman reported missing after the campfire has been found and she is very much alive. She was spotted by a deputy Authorities Say she said she is safe but never came forward because of unresolved legal issues. The only person still unaccounted for is a woman. At this point there have been no structures lost but many threatened. We have seen buildings and ranches that are all threatened, but nothing lost. And no one injured that we know of. Firefighters are hoping to get a handle on this. But at last we heard it was 10 contained. Before you go got maybe we can ask a quick question. A suspect was arrested in the shooting death of a 24 yearold father of three. Police are not releasing the name until the District Attorneys Office decide whether to file charges.
