injuries. tonight we learned they were heading to a doctors appointment, the mother had a bruised ankle and was shaken up. the video is hard to watch, you see a man with a gray hoodie and plaid pants sneak up behind a woman and a child as the woman walks up the stairs the man runs behind her, yanks her purse. the woman is seen clutching onto her purse and her child's hand. both the woman and the young girl or been dragged down the stairs.>> the girl was crying, mom was screaming multiple times. >> reporter: the robbery occurred right outside this law office. the child looked like she was four or five years old. >> the mom and the child went flying down the stairs.>> reporter: the robbery happened in the office complex in san jose, back on may 6 the pediatricians office on the second floor says the victim and child were coming in for an appointment. cameras capture the violent attack.>> it's horrifying to watch that this guy is preying on women that are really by themselves or in this case with a young child. >> reporter: cameras caught the suspect leaving a black lexus. the video evidence led police to pablo cabrera. they searched his home and found more evidence. linking him to for other robberies. the victims are all asian women with expensive purses.>> he approaches women from behind, an ambush style attack.>> reporter: he was on parole for burglary. patrons from the office complex found the video. they are horrified and glad to hear unrest was made and are thinking of the victims.>> it's all unexpected. she's just minding her own business and he comes out of nowhere.>> reporter: the suspect was booked into santa clara county jail for parole violations and robbery. his next court appearance is tomorrow and julie is being held without bail. and east bay a 14-year-old boy is in the hospital tonight after being hit by a suspected drunk driver. it happened around 3:30 this afternoon on brentwood boulevard, police say the teenager was walking along the shoulder of the roadway when he was hit by a truck officers arrested the 58-year-old driver on suspicion of driving under the influence of alcohol. the boy was flown to children's hospital oakland for treatment. and richmond police are investigating a deadly shooting. officers were called and when he shots fired was called near 17th street. police found a man there with a gunshot wound, he was pronounced dead at the scene. so far no information on a suspect or a motive for the killing. this follows a string of four shootings at three different locations in richmond during a 90 minute span on sunday night. it is unclear if the shootings are related. pushing, shoving and yelling. the major disruption at the vallejo city council meeting tonight, at one point police had to clear the room. the crowd of protesters inside was venting frustrations with the recent police shootings and other questionable encounters. we are live in vallejo where the use of deadly force has become a flashpoint. >> reporter: changes are coming, the police chief is retiring, the department of justice is getting involved but the anger is boiling over. in council chambers and on city hall steps beforehand. >> we are here today standing and demanding that something be done.>> reporter: advocates and attorneys. >> were not just asking them to come and we are begging him to come in. the city is out of control.>> reporter: flanked by families and friends affected by officer involved shootings and use of force. the february fatal shooting of a young rapper is the latest flashpoint. asleep in his car willie mccoy reached for a gun when they woke him. the 16th desk involving officers in eight years. >> this is a racist problem. it is racism in the police department.>> reporter: credits note some of the same officers are involved in multiple incidents. this young man was shot last year riding his bike. >> on his hands and knees cowering away. shot in his back. never a threat. not one time was he an aggressor. it was murder.>> reporter: the mayor said he welcomes reforms and points to talk about involving the department of justice for just a few public comments. then the meeting broke down amid shouting and arguments. councilmembers about at the meeting and police cleared the room. frustrating for those wanting to share their views after the rally.>> the usual way of doing business is over. we are calling on the states top cops. the attorney general to no longer sit on the sidelines.>> reporter: is crowd is on suede, community relations division would rather see them review actual police practices. >> we have a violence problem. people are dying. we don't need community relations. we need an investigation.>> were not going to be able to continue tonight, thank you very much. >> reporter: the overflow of emotion subsided after everyone was ordered out, eventually city council resumed their agenda, of the 30 or so speakers that showed up only a handful remained. activists say the state attorney general is reviewing a request to get involved now in vallejo policing.>> lots of people did not get a chance to speak tonight. will they have another chance to voice their concerns?>> reporter: there will be public comment at any open session of the city council and many of these families and activists have been coming to every council meeting making their voices heard. uc berkeley police have released photos of a man suspected of hiding a camera in a campus bathroom. police issued a campuswide alert for this man, investigators say the videocamera was discovered back on march 15 in a bathroom stall on the fourth floor of the library. police say the images of five people were recorded that day and they believe the camera was used to take photos of another 13 people in that same spot last october. the golden state warriors made it look easy tonight to win game one of the western conference finals. this was the fifth year in the row for the warriors but actually the first time ever that the two brothers have played in the championship round. steph curry plays with portland and you might say that creating a dilemma for their parents. >> reporter: friends told me they enjoyed a change of pace tonight, this game was no nailbiter but they also enjoy the fact that steph curry played against his younger brother, it added to the matchup. there are going to bring that storm rain tomorrow and not just a drizzle. >> this is shaping up to be a decent size storm for the month of may. the rain might begin tomorrow?>> some rain showers by tomorrow but throughout the day were going to see showers so a couple commutes are going to be impacted. tomorrow's commute will see some went but the afternoon commute will be the most impacted. the first system wednesday, a second system wednesday with colder air and saturday moring. the pacific is lit up with activity. we have three weather systems wednesday thursday and saturday systems are going to roll through the area. already seeing somewhat scattered showers showing up just offshore, i have had some reports of light scattered showers and if you come in closer you can see the darker area. tomorrow morning scattered showers, pretty much on the morning commute i will put it in motion here. at 7 am you see the green moving and so the morning commute looks like it will have some went on it. somewhere around 10 or 11 a clock it really starts to get going and tomorrow afternoon it's wet on the afternoon commute. the wettest for the commute driving home and there's more behind that. more about a dead whale that washed up today in the ocean waters off pacifica. it was spotted south of linder mart beach. from above it appears to be a gray whale, scientists say they have not been able to examine the well yet. they say the area is too dangerous to access on foot. this is the 10th dead whale found on a bay area beach in the past 10 weeks. marine experts say they are on the annual migration north to alaska, most are malnourished or have been hit by ships. the death toll from a midair collision of two flow planes in alaska has now gone up to six. the bodies of two passengers who were missing were recovered today. a team of federal investigators has arrived at the scene where the two planes collided yesterday. the passengers on the planes were guests from a princess cruise liner. in addition to the six people killed 10 others were hurt, three of those injured were released from hospital today. altogether a total of 16 people were on the planes when they collided yesterday afternoon. the ntsb says it's looking into several factors that might have contributed to the collision. a victory for uber and uber drivers hoping to form a union, today the national relations board said drivers are contractors and not company employees. that distinction is important because under federal law contractors lacked the power to unionize. it is a win for uber mac because they estimated labor cost would rise up to 30% if regulators forced the company to treat drivers as employees. new details in the case of a uber driver accused of trying to kidnap an assault two female passengers in east bay. police say one of the alleged victims jumped from a moving car to escape.>> ride chairs are more common than ever but the uncommon happened thursday on may 2 when a woman ordered a uber. >> the suspect refused to let her out of the vehicle or let her use her phone and locked her inside of his vehicle.>> he told the woman he was going to take her to a room and drop her off afterwards. about half a mile into the drive she took a drastic measure to escape the car.>> when she attempted to get out of the vehicle he refused at which point the suspect actually sped up before the victim was able to jump out of the vehicle.>> she ran to the chevron and the clerk which was the owner brought the woman inside and called 911. they later discovered them and tried something similar to ours later in oakland. in the case in oakland as soon as the passenger got into the car he touched her on the thigh. when she threatened to smashed the window just to get out that's when he let the woman loose.>> he refused to admit to the second incident.>> reporter: but he did admit to the one in berkeley saying he kidnap victim and wanted to pimp her out. when asked for comment they said upon learning of this we removed the drivers access to the app and stand ready to assist police in the investigation. police say incidents like the ones that happened this month are rare but urge writers of the precautions.>> for anybody using right here in the future it is to share their location and share them with friends and acquaintances. >> reporter: is expected to appear in court next week, as for berkeley police they want anyone with information to give them a call. the city of east palo alto is offering overnight parking for 16 rvs and there are restrooms, showers and laundry services as well as helping finding permanent housing. there were 48 applicants for 16 spaces and there is a waiting list. three medical centers in san francisco are rescheduling several hundred appointments and procedures ahead of a one-day strike planned for this thursday. the walkout by union workers as part of a statewide protest at all 10 campuses and five medical centers. the union represents nurse aides, social workers, psychologists, security guards, truck drivers and others. there fighting for better pay, retirement benefits, job security and other issues. labor officials forward backpay. most testimony on the ghost ship warehouse trial, why one tenant got emotional. agencies. backers say facial recognition algorithms can end up wrongly implicating innocent people. the measure also requires city departments to provide a policy plan for any other surveillance technology that would include details on how data is stored and who it is shared with. more emotional testimony today and the ghost ship trial as the jury heard from the tenants that lived at the open warehouse but was not there the night the deadly fire broke out.>> reporter: david lived at the ghost ship with his girlfriend but not at the warehouse at the night of the fire.>> mr. caldera was almost in tears when he had to identify mr. harris inc. he said it was hard to see him in this situation. >> reporter: he continued to weep as he was asked to identify the master tenant. he said i'm sorry, his attorney told him it is okay you don't have to be. >> i think that was an extremely powerful moment that captures how wrong this prosecution is against max harris.>> reporter: he told the jury he used to live in the woods and lived through several wildfires, he said he never thought the ghost ship was a fire hazard and believed living in the city was safer. the defense says some of the das own witnesses have proven more helpful to their clients.>> the prosecution can't get traction on any of their theories.>> reporter: also on the stand was the oakland fire captain, he testified he was concerned by the amount of material in the ghost ship when the firefighters took a look inside two years before the fire. they were there because of a small ice arson fire days earlier. the captain testified you have fire load and material above where you normally find it so you might have different fire behavior from the material. during their visit he told them that nobody lived there according to the captain. he also said he was so concerned he requested documents about the proper use of the warehouse. he says he never got a response from the fire department. the captain got emotional as he described how him and his crew had to recover bodies from the building. testimony resumes wednesday. still ahead, the toughest abortion bill in america. the new legislation now headed honor. we were there for two nights ceremony and talked with a veteran about his close calls and one important milestone.>> reporter: oscar is among the last of the greatest generation still with us here in the bay area and tonight was a sweet tribute to his service, sacrifice and also a very special birthday. at the veterans hall the guest of honor wasn't exactly to this.>> i think people are going too far. i'm not that important. >> reporter: but this veterans life is tremendously important for the dozens of people who came to honor him. leonard who survived 42 months at the prisoner of war never got any metals so on this date fellow brothers in arms gave him a surprise.>> we present you with your prisoner of war metal. the honor came as a celebration of his 100th birthday. leonard was born april 25, 1919, he joined the idaho national guard 116th cavalry regiments just before world war ii began and he went to the philippines and the counterintelligence core.>> i was secret service, we had a lot of things to tell us what we have.>> reporter: his son-in- law has helped draw out the long stories from world war ii. leonard says he escaped the bataan death march by sheer luck, by floating down a river. >> lots of people did not make that trip because there were too many undercurrents. i was just lucky. >> reporter: he survived by clinging to a log for 10 hours.>> were you scared?>> no. scared is a word that does not fit my vocabulary.>> reporter: later leonard was captured and taken to japan.>> there is six different camps, one of the last things he had to do was clean up after nagasaki. >> reporter: he made it home after the war and became a pharmacist falling in love with his wife mary, another pharmacist. this year they will celebrate their 66th anniversary together. all the sweeter because they both cheated that death. they have relocated from their home in paradise to live with their daughter just one year before the massive camp fire destroyed their house and all their possessions inside.>> there is no way they could have been mobile enough to get out.>> reporter: a bullet he kept through all of the camps was destroyed in the fire along with many of the family treasures. but for his children and grandchildren those things are not important.>> i'm happy he is able to get around and have happy memories.>> happy memories for a man that has served and lived for a century. and to veterans came down here so they can be part of this ceremony. they and also the family are trying to work to see if they can get leonard a purple heart for his sacrifices. workers at a bay area restaurant chain will receive back pay after a federal investigation. the labor department says it found the owners in pleasant hill violated minimum wage and overtime laws. the investigation found employees were not paid for all the hours they worked and the overtime hours were paid in cash at straight time rates. there is a legal fight over the reporting of the sordid details about his desk. the freelance photographer at the center of this controversy says his rights have been violated. >> reporter: the public defenders death shocked the city of san francisco. a freelance videographer obtained video to various news outlets including ktvu. ktvu readily pays for used to freelance videographers who pay help make news on their own.>> we got some light shed on what has happened by this report being examined by us.>> reporter: police lost into an estate investigation interviewing him and when he would not review his source rated his home friday cuffing him and taking more than 50 items from his home and office including camera equipment and computers. now he can't work as a journalist missing a deadly bus accident and a homicide.>> there were two major stories that our company would have covered completely in the last few days.>> reporter: now his attorney says he is going to court that he will file a motion before each of the judges who issued a search warrant after setting a new deadline to return his possessions. saying the freelance videographer is covered by california's shield law protecting videographers first amended like rides. there might be a more fundamental problem, whether there was even a crime for police to investigate when offices rated his home.>> somebody might have broken department policy and releasing the report. i am not aware of any law that would create a criminal violation for the release of the police report. >> reporter: police are using a partially sealed warrant and that the search is not only a threat to the rights of him but the public at large. >> the rights are not just the rights of journalists but the rights of the public to know what their government is up to.>> reporter: the police department is investigating a potential case of obstruction of justice along with the illegal distribution of confidential material. further sf pd provides all known facts and information in support of the search warrant application. members followed all search warrant protocols during service to ensure the safety of the public. meanwhile the san francisco supervisor is backing off previous statements that it was illegal for him to have the report saying in part that the truth is i am not a legal expert, given the current political climate i understand that freedom of the press is a sensitive issue and why there were concerns about my statement.>> reporter: at this point there's no word on a timeline for them to recur return the clients possessions. alabama lawmakers vote to ban senate approved a measure that would outlaw almost all abortions in the state. the legislation would ban abortions at every stage of pregnancy and would criminalize the procedure for doctors who could be charged with felonies and face up to 99 years in prison. it excludes, rather includes an exception for cases when the mothers life is at serious risk but it does not include an exception for cases of rape or incest. the bill now goes to alabama's republican governor and she has not yet indicated whether she will sign it. donald trump junior has agreed to testify before the senate intelligence committee and a private committee appearance for a limited time. the decision by the oldest son came after he refused twice to appear and after the republican- led committee issued a subpoena for him to testify. senators are concerned that the presidents son might have misled senators during previous testimony about a meeting in trump tower back in 2016 with the russian lawyer promising third on hillary clinton. the alameda county sheriff department is taking a step forward following an in mitigating report, 29 women have filed lawsuits against the sheriffs, one said she was forced to give birth alone in a cell as deputies ignored her cries. the sheriff disputes the mistreatment allegations, he says he runs the best big deal in the nation. the revolution passed the oakland city council safety committee unanimously tonight, the full city council is set to vote next week. on wall street stocks recovered, some of yesterday's big losses the dow was up 207 points or about a third of yesterday's decline. the nasdaq was up 87, the s&p rose 22. actor and comedian tim conway died today at the age of 85. conway has 148 emmys in the 1970s, he was known for his castmate and laugh aloud with harvey korman and others. the store also appeared on may become a coach and 30 rock. he died this morning reportedly from fluid on the brain with family by his side and a care facility in los angeles. today is a grueling climb in stage iii of the cycle race. wet weather is back in the forecast so get those umbrellas ready. we show exactly when you can expect the rain. it's day three of the amgen tour of california and today the writers raised through the south bay with a grueling climb of mount hamilton. we were there when the writers crossed the finish line in morgan hill. >> reporter: the tour of california returned to the bay area tuesday with stage iii starting in stockton and finishing in morgan hill. this kansas native had a tearful moment with his father after the race.>> i was really hurting out there but just never giving up and always keep persevering, that's what i strive for.>> it is special for the both of us.>> reporter: the 14th year of america's largest road cycling race. seven days of state races throughout the golden state involving elite athletes from all over the world. every year the route changes. the biggest challenge for these athletes, a grueling bike up mount hamilton. >> it was one of the toughest i've ever done.>> reporter: some cyclists say is the track down the can be the most difficult.>> going up your going all out but coming downhill grade control, whether you want to draft or take the leap. it's unbelievable watching these world-class athletes.>> reporter: at the end of the stage we let we met this mother who let her boys miss school for this. first they drove to stockton for the start of the stage where they met some of the writers. >> writers were getting ready this morning, there was a big dirt field so they had to carry their bikes over the dirt field so they would not get holes in their tires. >> reporter: they were some of the hundreds of people who attended the stage and festival. amber who normally only sells continues tomorrow starting in laguna. this next weather system will bring some rain, not over the course of the day but over the course of a few days, we can see anywhere from 3/10 of an inch to an inch and a half of rain, unusual weather for this time of year. system number one, tomorrow is knocking at the door now you can see a few showers up around the north bay, reports of a few light sprinkles up there. a mid-latitude system so high snow levels, rain and temperatures running in the mild range and rainfall relations will be light to moderate for this time of year. it does look wet out there now. your morning commute, you will see that in the model this is the forecast overnight low as warm as it has been, that's because all of the clouds. this is the model tapped into the banner showing a chance of showers at 7 am for san francisco, richmond, berkeley and that's your morning commute maybe a little bit heavier on the rain but it's going to be wet. as a get to lunch time you get some breaks, rain is likely right after lunch it gets going just in time for the afternoon commute which i suspect it will have a bit more pop. that's one way to look at it. wednesday at 8 am is the main system and you see it swipe through by 6 pm. let's do that one again. here is tomorrow morning and that is the rain, then we go through the whole day scattered showers and tomorrow afternoons commute looks wet. that's significant rain. as it stands wednesday morning and wednesday evenings commute looks wet. how about thursday morning? look stamp on thursday morning and thursday afternoon looks like it's going to be wet as well. in the mountains winter weather advisories, snow levels generally above 6300 feet, mid to upper 60s, that's how mid- latitude this storm is. the five-day forecast is a wet one. i think it's good for the planet and the fire danger, is good for the air quality and getting the pollen out of the trees. that's the thing to think about. that deal on
