employees in fremont. >> reporter: elon musk told employees in a companywide email that the road ahead for tesla is very difficult. they need to sell more of this particular type of car the model three. a car carrier full of him right here. he said that tesla needs to sell more of these cars and sell them at a lower price point. right now they cost $44,000. the price needs to come down to 35,000 so more people can afford it. in order to lower the price they are cutting 7% of the workforce. part of that memo said, we have made great progress but our products are still too expensive for most people. we are up against massive entrenched competitors. tesla must work harder than other manufacturers to survive. we spoke to employees and they were concerned to hear about the job cuts but means it will cost people who purchased them more by the end of the year. he says that is part of the reason why they have to focus on making the model three is more affordable and accessible to american consumers. ktvu fox2 news. let's talk more about this layoff announcement. i am joined by tim higgins with the wall street journal. where these cuts anticipated? >> maybe not anticipated but not necessarily a surprise. if you look at the number of employees that tesla has, 45,000. that is a lot of people for a company the size of tesla. they are not one of the world's largest automakers and they don't have to scale a number of sales like general motors, volkswagen, or toyota. it is probably not surprising that they need to make some cuts. this is the second time they've had to make cuts on the headcount. >> in the email from elon musk he was focusing on we've got to get the price of the model three down. how important is it for tesla to bring down the price of that vehicle? >> it is part of the evolution. they've been selling cars for $100,000. they are able to pull out some profit. if you're making a smaller car, a car that is supposed to be money on the volume and sending , selling a lot of them, you've got some problems. we saw in the third quarter the average selling price on the model three was $59,000 according to analyst estimates which is well above that $35,000 price target. he has said and order to get it down to that point, you've got to take out a lot of cost and increase the volume. so make a lot of them and try to get up to scale and lower the price so a lot of people will buy them. >> do you think that elon musk can accomplish that? >> we will see. analysts who had taken the car apart and have tried to calculate what the prices are, they say it is a profitable car at the higher price point good as it gets lower and lower towards $35,000 there is a big question if it can be profitable. they have the battery factory which makes them unique in the whole automotive industry. they are trying to figure out a way to cut the cost of electric cars by making the batteries cheaper. >> and then also, i am guessing that ramping up production, the factory in china will come into big play here. >> another part of this equation , he needs to have money to build that factory. it is expected he will borrow locally in china for that. those car sales will be for the china market. it is a distraction and it will take a lot of effort on their part. the cars being made in fremont are going globally. they will go into asia and europe starting this quarter. that will be some price pressure as they sell those cheaper versions of the model three later this year. >> no doubt about it, that email shows there are many challenges ahead for tesla. thank you so >> of course there are credibility issues. on the other hand we have to keep in mind that he was lying on the behest of his client. and so that is something that we need to keep in mind. the other thing is, there are documents verifying what coleman said. we don't fully have colons word . i think the key here is going to be to wait and see what kind of carrabba dating, corroborating evidence the wrist. >> so the politics of all of this and we have to wait and see how that shakes out. let's talk about the legality of this. we know it is generally accepted that a sitting president cannot be indicted. what is trump's potential legal exposure here? >> it is not entirely clear from a technical legal standpoint that a sitting president cannot be indicted. that is because we are running into a lot of issues with this presidency that we don't have precedents for. essentially the definition is very wide. arguably, some of our jurors might remember what happened during the clinton impeachment and the basis for that was flimsy and the offense itself was more of a personal nature and didn't involve something seriously affecting a presidential campaign. this was squarely fall into the category of high crimes and misdemeanors and would be an impeachable offense. >> we appreciate you weighing in. thank you. new information on the go ship fire case. a judge granted a request by the prosecution for a gag order. >> that was the reaction from the defense attorney. he left the oakland courtroom after that meeting. from today until our jurors are selected, the attorneys involved and witnesses are now banned from talking to the media. they face 36 counts of involuntary manslaughter and have both done and depth interviews with ktvu . prosecutors requested this gag order saying they wanted to protect the integrity of the trial. we will sit down and talk with the lawyer from the aclu as well as the and from stephon clark. the man who was shot and killed by police. to learn more about their request for previously sealed police documents. see the outpouring of support at oakland international airport where people are helping the federal employees get by when they miss paychecks because of the government shutdown. unpaid federal workers at oakland airport got a helping hand from the alameda county food bank which delivered 100 bags of food today. demand has been high as the shutdown reaches the 28. we report on the effort to provide for those in need through no fault of their own. >> reporter: with thousands and thousands of federal workers for load out or working without pay such as tsa workers, a food bank, the oakland airport and just plain folks are chipping in to help out. the alameda county food bank sinister delivery tfederal workers. it is an early hit on the food bank's annual budget. >> we are an emergency response organization. there are thousands of workers in alameda county alone that are not getting paid. >> reporter: tsa's oakland airport director just like all of his staff of 450 is working without pay. with no significant uptick in sick calls. >> i could not be more pleased or impressed with our community, the port of oakland, the outrage has been phenomenal. they have stepped up in their own way, free lunches, recognition findings, even passengers. >> reporter: this is the staff >> a spokeswoman says the airport has placed collection bins in public areas for anyone wishing to help out. >> the effort we wanted to foster an environment of appreciation for the federal workers who come to oakland international every day despite the shut down. >> reporter: if you taking a trip out, pick up some food, nonperishable food and put it in the buckets before you enter the security lines. that way you will be doing a lot of good for folks who really need your help right now. >> reporter: next week southwest and others will host a barbecue for the workers. ktvu fox2 news . we have continuing coverage in the story we brought you yesterday. the aclu is seeking records that have previously been sealed. joining me now is kathleen of the aclu and the uncle of oscar grant who was killed 10 years ago. both of those cases are included in this request. thank you for being here today. kathleen, why make this request ? why is it important to make this request? >> we believe it is important so that families have answers. for the first time in decades there is an opportunity under sb 1421 to give families whose loved ones have been killed by police the answers about the quality of the investigation the police did into the murders and killings of their loved ones. that sort of transparency is why we believe this law has been passed and why we want to get these records, so they have answers. >> what are you looking to gain from these documents? >> definitely some closure to the hearing, the criminal trial , he murdered my nephew. it brings a form of healing. this information provides a way for us to see what we have been saying all these years whether true or not. it actually helps and is getting some closure most importantly to this very issue. >> you believe these records will provide information you have not been aware of up until this point? >> information that we were privy to in the court but the jury wasn't, was the history of the officer and his work at the police department. this information will bring to light what we argued for in the court. had 1421 been in existence back in 2010 when we were in trial, it would have helped the jury make a better decision. >> what about for you? why is it important to get these records? >> for me it is important not just as a citizen but as a member of a unique community. like uncle bobby says, it's important for these families that have feelings but one specific case i think we can look at this year that shows why it is a necessity to have this is the golden state killer. we have a police officer that was and killing for over 40 years and had the ability to go between different police departments in the state of california. if we had access to these types of records, that community of families could've been saved grief as well. i think it is of the utmost importance. we elect our officials and we know about them. when our loved ones lives are taken by police they are often times criminalized. the fact that these officers have been able to hide behind the blue wall we will say has been unfair to the community that they are supposed to be protecting and serving. >> kathleen, what are you hoping to gain? let's take the oscar grant case. why bring up that case now? why do you feel like it's important to do that? >> this request has been made on behalf of 12 families of the many hundreds of families whose loved ones were killed by police. we are bringing this on behalf of oscar grant's family, stefon? family because we think it is important for transparency. transparency is the first step to accountability. for far too long most communities of color have borne the brunt of police violence and police brutality. this is an important step that these type of disciplinary records are now a matter of public record. that will increase transparency. we have made the request for records related to the investigation but also disciplinary records that are disclose a ball for all of the officers involved. >> do you think that releasing the records will mend relations and improve things as well? >> absolutely. it will increase transparency because people will be able to evaluate the quality of the investigation. i think we all as members of california have a right to know the quality of the investigation the government is doing and to its officers who kill members of our communities. that information is key to transparency and is critical for people to know and have faith in law enforcement. and i will give you another example. one of the first records disclosed pursuant to this new law was in burlingame. those records related to an officer who had an allegation of attempted sexual assault. because of the records that are now public records that disclose, the da in san mateo is not considering reopening a criminal investigation into that officer records revealed an allegation that this was a pattern of misconduct. not just one person accusing, but multiple accusers. because those records are now public record, the district attorney is considering reopening that case. there is transparency and real accountability. >> we will see how it moves forward. thank you so much for being here today. is going to be quite a weekend to get up to the sierra. we will go live to won resort for conditions up there in the high country coming up right after the break. here at home, mostly cloudy conditions. there is a pretty view into san francisco. showers this evening but dry on saturday before more wet weather arrives. details coming up. those cannon blasts were up in kirkwood this morning. skiers and snowboarders were packing the slopes today. once the lives opened it was a perfect day to hit the slopes up in tahoe. for more on the conditions up there and this upcoming holiday weekend, we want to check in with kevin cooper. some spots up there have six feet of snow. is a possible to have too much of a good thing?
