>> reporter: good evening to you. not too long ago, the house passed a proceby 221-179 with an even 400 members voting on a new government spending bill. so now they are debating that new bill. that all comes after yesterday. it seemed as though we might be heading toward a continuing resolution that could fund the government through february 8th until president trump said, no, no, i won't sign it unless it has money for the law. >> i am asking congress to defend the border of our nationri. on this. >> reporter: democrats have offered $1.6 milli not knowing going to go. >> reporter: house republicans will try to add a $5 billion border security amendment along with billions in disaster relief to the senate's bill. but that bill would likely struggle to pass in the senate. presumed future house speaker nancy pelosi trying to bring a clean bill to the house floor anyway. >> it would be totally irresponsible. that's why i consider it a privilege to rise to say, let's keep government open. >> reporter: members of the greenhouse kok is warning president trump going back on his house promise to get the money now, will hurt reelection chances in 2020. as some republicans tell the white house, the border wall money is nonnegotiable. >> we were waiting on the president to make sure that he was willing to go to the mat. it looks like he is and we will have his back 100%. this is a hill we should be willing to die on. >> reporter: republican congressman jim jordan just told foxnews, quote, we are going to pass a good one tonight, hinting they are going to pass a government spending bill. but it's important to remember this. if conservatives in the house can pass this government spending bill, it still has to go through the senate where they only have a 51-49 republican majority. we are also learning that tomorrow, senator bob corker, whether this is done or not, is getting in his car and driving back to tennessee, so he will not be there to vote, making it 50-49. it could be difficult to get a bill that gets through the house tonight through the senate tomorrow. back to you. >> ray bogan in washington for us, thank you. the president's refusal to sign a spending measure sent stocks plummeting today. the dow jones lost 464 points, falling to a 14 month low. the nasdaq was down 108 points and the s&p 500 was down 39 points, and the market now on track for its worst year since the crash 2008. today, we learned about another shakeup within the trump adminijim mattis will ret end of february. for more on the potential for a government shutdown and mattis leaving, we want to bring in ktvu political analyst, brian sobel. thank you for being here. the announcement about mattis comes one day after president trump announced he is going to withdraw all u.s. troops from syria, something that defense secretary mattis was opposed to. how much do you think played in his decision? >> well, probably a great deal. generals who have commanded troops on the battlefield don't like to see territory that they know they may have to go in and fight over again. and i think the worry about syria, alex, is that we may have to end up back in syria at some point and all the gains that we made. that will be reduced by taking the troops out. >> let's get back to the stalemate here, over a potential government shutdown. are you is refusing to sign the stopgap spending measure? >> more surprised at the flip- flopping that went on. at one point, it looked like a bill would be passed without funding for the wall. then it turned around and overnight, he received a lot of criticism by his base. and said, no, it's got to be a bill. >> it is true. we went from, i believe a week or so ago, the president saying, i'm willing to be responsible for a government shutdown, if it's not the funding i want, put it on me. and then we started to hear word coming out of the white house that he be willing to compromise and then we see another turnaround. >> and, the compromise was met with opposition by republicans, many of whom ran on the wall, in terms of their elections. and, think the carpet was pulled out from under them by the president, vacillating at the last hours. >> even though we heard the president sit there and say, i wie blame for the government shutting down, do you still think, though, that there is going to be some spin that goes on to try to pin this on democrats? >> yes. no doubt about it. it's washington. and he's not going to accept all of the blame for this shutdown. he's going to say democrats were recalcitrant in negotiations and they tried to put him in a very tough spot. bottom line is that the american people, alex, are getting really, really tired of these last-minute negotiations to avoid government shutdowns. it just gets old. >> how do you think this all plays out here? do we have up until midnight tomorrow night until some of these agencies start shutting down? do you think the deal gets done? >> i think a deal gets done. i don't know what it's going to be but something that continues funding the government. they be not the entire government, but part of the government will occur. the "x" factor involves a bill passed that involves funding for the wall. that's the key question today. >> the other key question is, as lawmakers regroup here, in the house, still controlled don't have the votes, do they? at this point, to put a spending bill on the president's desk that includes the $5 billion that he wants? >> if you listen to republican leadership, they claim to have the votes at this hour. i don't know that they do. it could be a bluff. and then it has to go over to the senate side, where you probably don't have the votes. i don't know where this all ends up but it's got to be a compromise bill that allows even a schumer to save some face. >> i guess as you step back from this whole situation and the president pushing for the border wall, he's pushed for it ever since he was a candidate and his first 2 years in office, republicans have had control of both congresses both houses of congress. whit's not all democrats thinki one way, all republicans thinking another way. you are able to chip away at support on both sides of the aisle, depending on what the issue is. in this case, the wall, not all republicans believe in the wall. the conservative republicans do. not very many democrats believe in it, if any, would vote for it. >> do you think the goalpost is going to start shifting a little bit? it's got to be a wall, it's got to be this and it's got to be this big. are we going to change the definition of the wall? >> quite possibly. you are already starting to hear some of that. the definition changing there. because, ultimately in washington, there has to be a compromise.language. we went from the president referring to funding for a wall, do now he refers to funding for border security. >> part of the wall coul be human assets on the bothe new phrase that we hear here. >> you think we will be able to avoid the partial government shutdown over the holidays? >> i don't think the lawmakers want to go into the holiday with people without their jobs. we will see where it goes. >> appreciate that. take care. fremont police have announced they arrested these two people in a complex order for hire shooting. the victim was an east bay chef and one of the accused is his girlfriend. ktvu's rob roth is live in dublin with more on this. >> the two accused are in the santa rita jail and waived their court appearances today. authorities are calling this a highly complex case of murder for hire. fremont investigators say 50- year-old maria moore hired marvel salvant to murder her boyfriend so she could cash in on his life conference policies, the two are charged with special circumstances. the killing happened in this fremont home after midnight on october 8th. police say marvel salvant broken and shot to death dominic sarkar as he slept. sarkar is a well-known indian strap who worked for years at an indian restaurant in mountain view. court records claim that prior to the shooting, moore had his children's though she had her name removed from the policy and added her son. at one point, the policy was modified under suspicious circumstances to at moore as the primary beneficiary and remove mr. marvel salvant's daughters as the primary beneficiary's. witnesses say moore wired sarkar money with promises of more money. according to the morning of the murder, he sent text messages stating, i'm set to do everything tonight. outside of court, marvel salvant's mother says that she doesn't believe her son is involved. >> this is not my son. >> reporter: on the day he was killed,to visit his three daughters. >> all right, rob roth, thank you so much. >> the case against the man accused of killing 18-year-old nia wilson at an oakland station took a dramatic turn today. john lee cowell prosecutors say he is unfit to stand trial. a grand jury has indicted him on charges up murder and attempted murder. nia wilson's mother says she doesn't believe the defendant is mentally ill. >> he has been exhibiting extreme delusion and extreme paranoia. i'm obviously an attorney, i'm not a doctor. all we are asking at this point is for the court to appoint two neutral court selected doctors who would evaluate him to make a determination about whether he's legally competent or not to stand trial. >> he knows how to behave himself. ain't nothing wrong with him. >> cowell will return to court next week at which point the judge could suspend the criminal proceedings altogether. >> the santa clara county health department says a confirmed case of legionnaires' disease has been reported in the county. the countydid not release any other details on the patient. their condition, where they live or where they contracted the disease. the health department said in a statement, quote, as is standard in these cases, a public health investigation is in progress at this time. there is no indication of any elevated risk to the general public. ten dollars just to enter san francisco. are charged with robbing a bank. he has already been accused and is on leave from the force for allegedly sending racist text messages to other officers. >> now we are learning about a third case. crime reporter henry lee is live at the police department with more allegations the officer is now facing. henry? >> reporter: a mug shot of san now at the center of three investigations. he's at the center of custody, charged with making off with more than $9000 from this east west bank in san francisco's sunset district where he grew up. >> it is sad to see somebody in that position. >> reporter: authorities say doherty didn't bother to cover his face when he walked into the bank at 23rd and irving a week after thanksgiving. according to the fbi, doherty handed teller a note demanding $50 bills and $100 bills telling her, quote, calm down, just do it. two san francisco police sergeants say they recognized doherty from surveillance because he was wearing the same shoes in surveillance video from an earlier investigation. and that case was in san mateo county where doherty has been charged with stealing money from a 76-year-old's account, including through atm withdrawals. >> i did not use atms. i did not know how to. and, we eventually determined that the defendant withdrew about $14,000 via 30 atm withdraws. >> reporter: san francisco police searched his burlingame home and found cocaine and oxycodone as well as anti- anxiety medications for which he had no prescription. he was charged with elder theft and drug possession and is now suspended without pay. >> we are held to the same standards as everybody else. if not a higher standard. the case will go through the wheels of justice like any other case. >> reporter:is still facing disciplinary charges by the department for allegedly being among several officers who sent rasul's racist text messages. in a statement, the san francisco police union said they were disgusted by the allegations and this man should be found guilty through due process and face the appropriate consequences. now, one more note. investigators tell me that the officer also bought cat food with the burlingame victim's card and the victim does not have any cats but the officer does. i tried to get the story but he declined an interview request from jail. live at police headquarters, henry lee, ktvu fox 2 news. more than a dozen arrests and three quarters of $1 million worth of stolen goods. law enforcement in san francisco today gave details on this joint retail theft investigation. a press conference was held this afternoon at san francisco police headquarters were investigators say they served seven search warrants in san francisco and one in daly city that led toarrest of more than a dozen people and uncovered more than $750,000 in stolen merchandise. this was all the result of an eight month long multi agency investigation dubbed "operation wrecking ball." >> these people are ambush style stealing large quantities of property from the retail partners all over the bay area, but specifically here in san francisco. and then they are fencing this all over the united states. they are using conduits like ebay. >> $300,000 in stolen property has been recovered so far, along with $16,000 in cash and 46 cell phones. investigators say they located property stolen from san francisco in states as far away as washington and texas. the public will soon be asked to weigh in on plans that could send the golden gate bridge tolls to almost ten dollars over the next 5 years. bridge officials today voted to begin a month long public discussion to explore annual toll hike options. the first eight dollars to $9.80 by the year 2023. the bridge district says it's facing a $75 million budget shortfall and the district plans to hold open houses starting next month, followed by a public hearing. boy, this day started off really gray, socked in by a thick pile of fog. and it never quite yesterday in san francisco and everybody there in the 2 to 7 degree mark for the difference. i felt it today. it was a little chilly and damp out there. taking a look at storm tracker, you see per graces clouds all through the day. they are part of a bigger system staying to the north of us and bring rain to the pacific northwest. however, it is skirting the edge of our area which is why we will see showers out of it tonight. there will be light rain, a lot of the combined to the north temperatures will be mild as we go throughout the night. 45 in santa rosa, 49 in oakland, and livermore coming in at about 43 degrees for your overnight low. expecting fog tomorrow as well. this is how much we are looking at now. it's not a lot. a quarter inch or less. as you start to track to the south of our area, the bay area is going to get less. if you are in san josemay see a few sprinkles. we are starting to see drizzle in the north bay at this hour. let's show you how this works out. going coming up here, continuing criticism of san francisco mayor london breed after she wrote a letter to governor brown, asking for leniency for her brother who is in prison. san jose police could lead the way for other agencies in their handling of gun crimes in their city. what they're doing that's resulting in harsher punishment for offenders. that's next. san jose police are taking a new approach for how they seek justice for gun crimes. as the state works to reform criminal justice system to reduce incarcerations,is sending some better occasions so she cases to court for more sentences. the strategy is being criticized by advocates for criminal justice reform, while some members of the communities they serve are applauding the effort. joining us now to discuss this new strategy is san jose police chief eddie garcia. thanks for joining us. >> my pleasure. thanks for having me. >> i know you're focusing on tv specific types of gun crimes. talk to us about what that is. >> the first two are dealing with armed robberies which are taken seriously in our district attorney's office and our state takes them seriously as well. there might be some cases that might be better tried federally. the ones that we are concentrating on quite frankly are felons in possession of handguns, and individuals that are either dealing arch quantities of narcotics or deal those crimes are deemed nonviolent, per prop for early release. i don't think that's satisfactory. our officers deserve better. they are putting their lives on the line every day and more important the our community that lives in those impacted areas deserve better. >> you could kind of shed some light on a specific case without mentioning a particular offender, where this might come into play and where this is helpful for lost enforcement. >> well, in this particular case that i will tell you, i actually have to stop myself from laughing, without the nervous laugh, with this case. there is an individual that was dealing drugs, that ran from officers in the car. they found a loaded handgun. the officers did a great job. the district attorney's office did an admirable job. our court system did a great job in the individual was sentenced for a period of time, only to be released early per prop 57 and the reason was although the individual had a loaded handgun at the time of his arrest, he did not use it. it was a mitigating factor. you know, i've been through this entire city and been through my neighborhoods, and i have not met a neighborhood in san jose, regardless of race, language spoken, or economic status that wants violence on the streets. and that once an armed drug dealer back on the streets and released out early. you know, we can't have the state undermining the efforts that local counties are having in sentencing and the efforts to keep our communities safe. >> chief garcia, you bring up race and one of the arguments is the disproportion of incarceration for people of color, something being brought to the forefront more and more. a lot of people speaking out about this and why some advocates are pushing for criminal justice reform. but this new strategy seems discretionary, on a case-by- case basis, you discussed the four areas that you are seeking, anyway. how can you kind of calm the concerns of people in the community whmuaneously trying to build trust in the community and saying we are not going to be seeking a person based on their race, or religion, or what have you. >> that's an excellent r crimin isn't perfect. however, the pendulum has swung way too far from our actual victims in our neighborhoods that are impacted by this crime. this practice, in this practice that we are doing right now, is based on crime. it's not based on race. it's based on individuals who are armed that are doing harm to this community. you know, it's basically things that are being referred to the ausa with help from the fbi. if you are a prior felon in possession of a firearm, you will be referred. it doesn't matter to us who the individual is. if you are dealing large quantities of narcotics while you are armed, you will be referred. it has nothing to do with race. it has to do with crime and the individuals that are impacting our communities. and most often, in our most vulnerable communities. >> chief garcia, thank you so much for joining us to talk about this and to calm some of those concerns in the community look forward to speaking with you more on this as this strategy continues to play out in san jose. thank you so much. >> my pleasure. thank you for having me. the backlash continues against san francisco mayor london breed as the group crime victims united issued a statement, condemning breed's letter asking governor brown to commute her brothers sentence for murder, robbery, and carjacking. now in 2011, the murder charge was amended to involuntary manslaughter. reid's brother, napoleon brown, has served 18 years out of a 44 year sentence. that is one of the topics we are discussing this week on the verdict. as always, we are joined by legal analyst, cardoza. thank you for being here. we appreciate it. let's start off with the broad question here. is it appropriate do you think for mayor breed to be seeking leniency for her brother? >> as the mayor? no. as his sister, of course. but, she used anscended her com sense and i ask, where were her advisors the tell her don't be doing this as the mayor. you could have done it before you became mayor but you wait until you are mayor, and then ask the governor to commute your brother's sentence? >> and obviously, she made it clear in the letter, she is the mayor of san francisco, obviously the governor would know that but, as you pointed out, she used a letterhead from the mayor's office. so the other question i ask is, were there any ethical lines that were crossed? did she violate any ethics laws? >> no. she did not violate it but let tl you about the facts of the case. i think that's most important. what her brother does is walk into a johnny rocket's with a gun. he robs a place, not only the place but robs some of the patrons. can you imagine, as they are in johnny rocket's, the fear that they felt? am i going to live through this? am i going to make it? he then leaves with his girlfriend in a car. as they are leaving, he pushes her out of a car, i believe it was on the golden gate bridge, pushes her out, a car hits her and kills her. they go to trial. the mayor comes in as an alibi witness and under oath says, oh, no, he was on the couch at the home. people can take from that what they want. she was also asked, does he go by the name of sb, i believe? she goes, no, he doesn't go by that name. the d.a. had to bring people into go, yes he does victim's dying declaration was sb killed me. now he goes off in prison, he picks up a heroin beef and get two more years. the case is reversed. he's convicted of murder and robberies with a weapon. the case is reversed for inadequacy of counsel. so then the d.a. negotiates and they negotiate it down to a manslaughter and the robbery, and using the weapon for the 40 some odd years. >> obviously, you know you the argument from mayor breed. she's saying at this point that her brother is remorseful, and deserves a second chance and she has even said that, you know, if he is released early, they will be able to get him a job and help him get back on his feet. how do you think the governor is going to respond to this? >> if he's smart, he's not going to allow this at all. here you have a guy that you say is rehabilitated. and while he's in prison, they find him in possession of heroin? i think he had a drug problem before that drove him to these crimes. notwithstanding that, how could you make the argument that he's reformed? let him back out on the street? that the people decide. is this the type of person we want in san francisco especially? i walked down the street the other day in san francisco. you are watching people shooting up right on the street. he should stay in jail for the rest of his life. he's dangerous. how can you say he's rehabilitated? let alone what the parents of the victim are thinking. my lord, their daughter was killed by this guy. pushing her out of a car? >> we should point out that the letter was not written from the mayor's office but her on the letter, we should clarify. let me move on. that issue is something a lot of people are discussing. i want to ask you briefly if we can about this case in fremont. a murder for hire, a complex scheme, where a woman hired another man to kill her partner, an executive chef at a restaurant there to essentially cash in on his $800,000 life insurance policy. sounds like investigators have quite a bit of evidence, text messages, videos. a lot of these financial transactions. it sort of seems cut and dry. you know, it would seem. but these cases can get complicated, can't they? >> they can get awfully complicated. just because you are the beneficiary of the insurance. certainly, some circumstantial evidence that you might be involved with this because you are going to make an awful lot of money. but, circumstantial evidence can point two different ways. it can point to innocence, too. you have to have something to back that up. when was the policy issued? was it an old policy, 10, 20 years old? or was it just taken out six months ago? that would not bold in this case. yes, it can get complicated. a lot of people think circumstantial evidence is the worst kind as opposed to direct. direct evidence is where, i see you punching someone. circumstantial is, i don't see it but i hear of it. thump. i turn around, you've got blood on your hands, the other man has blood coming down his face. that's circumstantial evidence. that's the strongest type of evidence because eyewitness evidence can really be faulty and it has been proven time and time again. could be a complicated case but i've got a feeling it won't be that complicated and they might be facing the death penalty because it was a murder for hire, and for profit. that they are getting. >> reporter: on wednesday evening, two drones were spotted over london's gatwick airport, forcing all flights to be grounded. police say there is no reason to suspect the drones are terror related but they believe the operators know what they're doing. >> each time we believe we get close to the operator, the dipp that seems it's an deliberate act. >> reporter: gatwick is the second busiest airport in great britain. tens of thousands are stranded on one of the busiest travel days of the year. more than 100,000 people were expected to fly through gatwick on thursday alone. those delayed passengers are now crammed into the airport's two main terminals. many are complaining about the lack of contact with airport staff. >> we were stranded inside the plane without any information. >> we've had hotel offers taken back. i would say the information coming out from gatwick has been little and that's been generous. >> reporter: officials say they're focused on bringing the drones down so the airport can reopen. while they understand passengers are uncomfortable, they say safety comes first. >> i'd like to apologize to all of the passengers disrupted by this going to get worse before it gets better because we do have a little rain heading our way tonight. that's what's going on. we started off with fog. we had to low clouds in here that has kept temperatures down and unfortunately made it chilly today, drizzly now. and as we go through the next few hours, we are going to see a little bit of light rain. a lot of it will be confined to the
