The owners of several Residential Care homes in the bay area called rainbow bright are accused of carrying out some dark deeds. In San Francisco today, the state Attorney Generals Office showed off 14 illegal firearms seized during a year long investigation. Four members of the same family faced charges of Human Trafficking swells wage theft and tax fraud. The defendants operated two child care facilities and four Adult Care Homes in south San Francisco, daly city and pacifica. Authorities say they exploited filipino immigrants who came to them for work. They were forced to work 24 hours a day, slept in garages on the floor, locked out in the rain when owners werent home. One defendant is charged with three counts of rape against a female employee whom he was trafficking. Authorities say the defendants also threatened to turn the employees over to immigration officials if they spoke up about their treatment. Henry lee will have a live report on this at 5 00. Meantime, a wildfire in Shasta County continues to grow and a 45mile stretch of interstate 5 remains shut down as a result of the flames. The delta fire started wednesday and there is no containment this afternoon. The fire has now burned more than 24,000 acres north of redding. This fire is burning into dry brush and trees on both sides of the interstate. The u. S. Forest service says the fire is burning toward the northwest and numerous buildings remain threatened. Officials say the fire was humancaused but they arent giving any more details on how it started. More than 1500 firefighters are battling the fire with the goal of preserving lives and property. We know to come home and hopefully have something there. And we want to make sure they have something to come home to. The chp says interstate 5 will remain closed at least through the weekend. The agency says there are a lot of safety concerns including the condition of the pavement and a possibility of burned trees falling on the highway. A trial date was set today for the two men charged in the deadly ghost ship warehouse fire at oakland. But as our Crime Reporter henry lee test us, that trial wont start until next spring at the earliest. Reporter Derick Almena and max marks, whose plea deals on the ghost ship fire were rejected by a judge, will be going to trial on april 2nd at least for now. The defense is considering a motion to have the trial moved out of Alameda County. They are each charged with 36 counts of involuntary manslaughter, one for each victim. Last month, judge james cramer rejected plea deals for both defendants, saying almena hadnt shown enough remorse. The judge also threw out harris plea agreement because it was part of a package deal. Almena gave ktvu the letter he says he was blocked from reading at his wouldbe sentencing hearing. In a new statement to ktvu, he said of his plea deal rejection, it was a setup, a onesided minitrial and a morbid publicity stunt organized by the d. A. My fate was already decided. His Attorney Says he is fighting to get his clients plea deal reinstated and if that fails, he says he is ready to take it to a jury. They want a trial . Theyre going to get a trial. You know, were eager to show our clients innocence. Were eager to show that there is going to be, you know, large reasonable doubt in terms of their culpability. Reporter harris Attorney Says he plans to turn the blame on the landlord who wasnt criminally charged and other entities like pg e and the city of oakland, who they say turned a blind eye to conditions in the warehouse. We want to humiliate and embarrass every public official who didnt do their job. We want to expose all the government malfeasance. Reporter harris Attorney Says he wants this to be the, quote, most painful trial that Alameda County and the city of oakland have ever endured. Opening statements began today in redwood city in the trial of 59yearold Rodney Halbower who authorities believe is the gypsy hill killer. He faces murder and rape charges for the killing of two San Mateo County teens back in 1976. Cameras were not allowed in the courtroom today but the defendant interrupted the proceedings more than 30 times while the prosecution detailed those two brutal rapes and how halbowers dna was linked to the two young victims from millbrae and pacifica over 40 years later. At one point, the jury was excused because of the defendants outbursts. Authorities believe he is linked to six murders in Northern California as well as nevada. The first phase of barts extension into milpitas has hit a snag. Officials announced that a subcontractor has been installing used parts instead of new parts required by the billiondollar contract. Officials with the valley transportation authority, or vta, say they have not seen any problems because the component parts, small parts that go inside a computer are used and not new. But they discovered this back in june and decided to take corrective action no. We are taking measures to take that equipment out, those parts, and replace it and then well retest. Reporter bernice says the problem concerns small Computer Components that have been installed in a tenmile stretch of construction south of the warm springs station. Vta officials learned in june a subcontractor was installing used parts similar to these despite the contract requirement that the parts be new. The components cost about 1. 2 million and are part of the Communications Equipment that controls lighting, public intercom and fire alarms. An email statement, sam liccardo who chairs the board says in part, our top priority is ensuring that we have a safe and secure system which is why were working to replace the improper equipment as soon as possible. Some passengers we spoke to this afternoon agree safety should be the top consideration. I think passengers can take a bit of inconvenience rather than end up outside the tracks with the carriages rolling down some ravine. Reporter Officials Say switching out these parts will cause a delay of up to three months. Right now the earliest they could complete this next phase is the fall of 2019. The latest is the end of the year, december of 2019. I asked if this mixup has hurt the confidence in the contractor thats doing all the work and im told they have complete faith in the contractor that they are going to put in the right equipment and that they take corrective measures against the subcontractor. Back to the airbnb nightmare in San Francisco. The manager of the property says he suspects the renter used it for months as a drug den. Paul chambers has more from the marina. What a mess. Reporter the owner is out of the country but his friend is handling this situation. He said this place was such a disaster, about three to five hundred needles all scattered throughout the place. He had to get a specialized crew to come clean it up and it took him six hours to do it. Reporter these pictures cannot begin to show or describe the horror that was hidden inside a home in San Franciscos Marina District. A foul odor. You couldnt even stay more than 10 seconds in there without having to gag. Reporter he took this video of his friends trashed house. For the last 3 1 2 months, a man rented this space on airbnb and this is how he left it, trash and fecal matter on the floor, a bathroom that no longer worked, and a major health hazard, used needles. It was hard to discover where the needles were because it was just a tip of the needles that were everywhere and blood stains on the bed. Reporter for the time the man stayed in the home he never used trash cans, instead littered on the floor. Unfortunately, the owner didnt know about it. Reporter neighbors never reported any issues about the renter and there were no signs from the outside that there was a problem. However, that all changed last week when the man left at the end of his contract. After the gentleman checked out, a cleaner was scheduled to clean it. He said immediately they are not going to clean it. Reporter liam says the owner normally pays 100 to clean this 225squarefoot room but with this, it was a lot more. Liam wouldnt say how much the owner paid. He said he had to hire a threemember hazmat crew that usually worked to clean up crime scenes. It took six hours to get it almost back to normal. And theres still a lot needed to be done. The facade has to be removed outside, a new toilet also. But airbnb will probably foot that portion. In a statement from the company, it says, we have a zero tolerance for this type of behavior and have removed this individual from our community. How significant is it for your organization to have someone like Kim Kardashian lending her name and support to your movement for criminal Justice Reform . Its huge whenever influencers decides to use their platform for good. We have been lucky to work with a bunch of influencers. Kim is just one of the brave ones who agreed to put her name on this issue and fight for freedom for people. I will say im very impressed in the way she has engaged with the issue, visiting prisons, working with attorneys, learning individual cases. At this meeting we were actually advocating to change the entire clemency process and she was well versed in what the process had looked liked and the changes we wanted. Talk to us a little bit about why youre involved in this. Its personal to you. Reporter it is personal to me. I had a loved one who went to prison when i was very young and that made me go to college and law school and become a criminal defense attorney. I decided to get into policy work and cofounded with dan jones the cut 50 to do some broader work and really change our nations thinking about criminal Justice Systems and how we are treating people who have made bad decisions and whether or not we are giving them another chance. What do you think needs to change in the way we view criminals in our society . Reporter i think it starts with empathy. It starts with putting yourself in other peoples shoes and starts with understanding that nobody is perfect. We have all done something wrong in our lives. We all have our own regrets. And we all have to own up to those. Everybody has their own issues that they have to take on. And our job is to provide people the opportunity to take accountability, rehab themselves and move forward. Right now, the current criminal Justice System is spending 80 billion a year to lock up 2. 2 Million People. Many of them are there because of drug addiction or Mental Illness or lack of opportunity. So we need to really reimagine our system and think out we can actually fix the underlying reasons why people are criminals instead of just locking them in their cell and throwing away the key. Lets talk about some of the possible pushback to this. When people hear Prison Reform, they are concerned that maybe people will not only get a Second Chance but that could possibly lead to four or five, 10, 11 chances. How do you sort of combat, um, that approach or that thinking to Prison Reform . I think theres some very successful models out there that we can look at. For example, the drugs courts or the veterans courts, you know. Overall, our criminal Justice System as it is now is failing. It is a revolving door. About 74 of the people who are released end up committing a new offense or having a technical violation and ending up back in prison or jail. We need to break that cycle and the way do you that is by actually the way you do that is by actually giving people help and job training and giving them the opportunity to really move forward and get an education and make different choices. I think, you know, we can look to some of these models that are out there like the veterans courts. They have an 86 rate of success because theyre giving people the mentorship and the treatment and skills and education to get back on their feet and to actually succeed. So i know that, you know, this meeting earlier this week was in particular in regards to an inmate in tennessee and it raises the question, how does your organization decide which particular cases youre going to take up, who you are going to advocate for . Ill just clarify that a little bit. So this particular meeting was around the clemency process. Okay. As a whole. Reporter each president has a clemency process. Prior ones have had a process that involved a lot of different people, 12 to 15 different people, overlooking a case before they decided whether or not the president should even take a look at it. So we were talking about ways to streamline the process, ways to increase transparency into clemency, and ways to make it more fair for people like chris young. He is a very example of somebody who deserves clemency and also a good example of why we need sentencing reform in our federal criminal Justice System to change unfair draconian laws like the ones that resulted in him getting a sentence of life and being sentenced essentially to die in prison for a drug offense. So not so much about particular cases with this particular meeting but about broader reform. Yeah. All right. Absolutely. It almost went three hours, really, rambling a conversation with a fairly friendly interviewer who wanted to indulge elon musk on his favorite topics such as Artificial Intelligence and the potential threat to the future, space travel, electric cars, um, autopilot, all the things he likes to talk about. It was really towards the end where he kind of got into trouble. Yeah. I do want to read something, though. This was posted just a little bit ago on the companys blog in which elon says, we are about to have the most amazing quarter in our history building and delivering more than twice as many cars as we did last quarter. And in this blog post, he talks about the fact that some officials have been promoted today but tim, this comes as some other high level executives hit the door. Yeah. Todays memo was essentially trying to say, hey, i have some leadership around me trying to ease some of those concerns. Theres been a lot of talk about how he needs someone in there to alleviate the pressure on him, a number two. One of those promotions, a president of automotive to handle the Manufacturing Day to day. Elon took that over this spring when there was a lot of trouble at the fremont factory. So potentially there is now another executive in there who can help kind of take away some of the pressure on him. But well still have to see about that. Do you think, tim that will be enough to please investors . Its hard to say. One of the biggest things that investors are looking for is can tesla continue to make 5,000 model 3s a week this quarter . If they are able to do that, they should be able to generate some cash and elon says they can turn a profit. Thats going to be the big test and how much leeway they give you on it. Ten retired players filed this suit back in 2014 and the case was dismissed but now the Appeals Court has allowed them to revive the lawsuit after those players argued that the nfl violated their collective bargaining rights. Its like after the game is over, the Appellate Court three judges in the federal court court said no, go back to the trial court and start again. We need to point out here that this ruling from the ninth circuit simply means that these players get another shot at having their claims heard in court. But the ruling does not address the merits of their case. They called the game off and said now play the game. They have to go back and they have to litigate the issues. And theres nothing that says they are going to win this. Take me back a little bit and help me understand why it was that their case was originally dismissed. These were a group of retired nfl players who say they suffered permanent damage or addiction to drugs because the team gave them painkillers but the judge in San Francisco dismissed their claims outright. What was the rationale . What judge alsop said was you have a bargaining agreement, a Labor Agreement, with the nfl. You did not exhaust all the avenues, all the things you could have done, within that Labor Agreement. So im going to dismiss this case and send you off to the Labor Agreement negotiation. What the players did was say, no, we want to be in court. We want to get to a jury. It went up on appeal to a threejudge panel and they said, judge alsop, youre wrong, send it back. It doesnt have to go through those labor steps. Its going to be litigated in your court. Whats going to change when it goes back to judge alsops court . Well, nothing other than its back in his court and they will begin to litigate the issues in the class where the players say, look, there were times when you would you, the nfl works give us bags of drugs and say, take it, we took them thinking it would help us, and it mask the pain and because of that, now we have long lasting physical injuries to us and i think in some part, some may have gotten addicted to that. I have to tell you, i think they have a tough row to hoe. I have known nfl players. I played football in college and seen players come off the field with concussions, with all sorts of injuries, and theyre dying to get back in the game. And they lie to the trainers. They lie to the doctors. So i think if you talk to a lot of nfl players and you tell them, which i assume in the future they will do the nfl will say, these could have a long lasting effect, these drugs, the players would say, fine. Give them to me. Im making so much money, im not going to give up my position to somebody else and they would be willing to take that chance and i think thats the big problem with their lawsuit. In oakland, Debora Villalon, ktvu fox 2 news. The family of Stephon Clark announced today its planning on suing the city of sacramento for 15 million. The wrongful death claim stems from a controversial shooting that gained National Attention in march of this year. The 22yearold clark was not carrying a gun when Sacramento Police fired on him at least 20 times as he stood this is grandmothers yard. The damages sought by the family include loss of financial support, funeral expenses, attorney fees, and punitive damages. Google is pushing a physical security key. As brett larson tells us its an attempt to help you keep your Information Safe and private. Reporter a move by google could make passwords a thing of the past. A key that could connect to your computer or smartphone. Google has been making the push for Security Keys for their Cloud Services since july. Thats when the company said that for the past year, they have been using the physical security with their 85,000 employees and have had zero Security Problems as a result. The key is part of whats called two factor authentication. First, you enter a password. Then insert the key. Right now, the usb device runs about 50 bucks. But its really two devices. One a usb key that can be inserted into your computer, the other device uses bluetooth to do the same thing wirelessly. Its a backup but could also be used on your mobile device. If you use any of googles online services, like email or cloud storage, you could use the key to better lock down your data. When enabled, a onetime code is sent to your mobile device and used when you log in with your password. Its another step to help keep your digital life safe. Demolition on the old span of the bay bridge is expected to finally wrap up this weekend. Tomorrow caltrans will implode two marine foundations as the final phase of the demolition process. As with previous implosions, caltrans will conduct Environmental Monitoring before, during and after each blast and the chp will have rolling traffic closures lasting up to 30 minutes on the approach to the bridge.
