police are there.>> reporter: once the video starts again, you see two more shots, and then commands from the officer. police originally say the officer approached to been a struggle, which we saw on camera. the officer gave the command to drop his gun before firing shots. but the short clip does not show the entire as the, and you cannot see a gun during the struggle, and that is what bothers the family. >> brother did not pose any threat to the police officers. we won't justice. the police officer is still working. he went and got a mental evaluation. >> reporter: the bart officer was cleared and has returned to full duty. the shooting was on january 3. matteo returned to full duty january 18. artificial say they understand that any loss of life is tragic, and that is why they are committed to a full independent investigation. oakland police is the lead agency in the investigation. >> what is the police perspective on this in terms of the threat? is it just the fact that there involved at a gunshot wound to the lake. the question -- leg. the question is rather or not he was shot by the bart police officer or someone else shot him. there is still a lot of questions out investigation and the oakland police department are doing an investigation. they say once all of the investigations are done and complete, they will release the entire video. >> still a lot more to be figured out in this case. a judge ruled today that prosecutors have produced enough evidence to have an oakland couple stand trial in the middle killing of an alameda county sheriff's explorer. curtis taylor and laura rogers are accused of luring this woman to an east oakland park where she was stabbed, beaten, and set on fire. ktvu learned that the two women developed a relationship while working at a fast fruit restaurant. -- food restaurant. two men have been arrested after having a pipe bomb delivered at a home. and two men are now under arrest for allegedly detonating a pipe bomb at this on. no one was hurt, but the blast at 1:00 a.m. in the morning windows and was heard and felt for blocks. >> all of my kids went outside to see what happens.>> we heard something very hard. >> reporter: a family inside of the home where the bomb went off yelled at the tv crews to leave saying they were concerned about the young child's safety. >> i think anytime that you have an explosive device like that detonated in front of the residence, there is always the potential for extremely bad things to happen, and we are just thankful that there was not any injuries. >> reporter: an investigation by the suisun city police and the fbi has now led to to arrest. thomas capenhurst was arrested monday afternoon. sky falk was overhead as chp officer stopped him . the other suspect, 20 road robert mcgraw was arrested at this home in fairfield. people at the home declined to comment. police have not revealed a motive in the case, but they are saying this was not a random attack. the suspects were unavailable for interviews at jail, and both are being held on numerous felonies including the use of a destructive device with the intent to commit murder. thomas capenhurst is a convicted felon who was well known to law enforcement. he was arrested by police for allegedly having these guns and ammunition. neighbor say they are feeling much more say. >> we have lived here since 2011, and we never saw something bad like this. and investigators actually -->> reporter: investigators actually found other pipe bombs while investigating a home in fairfield. authorities are working to determine whether or not they will be prosecuted in state court or federal court. a santa cruz teenager accused of killing an 8-year- old girl in 2015 was in court today. aj gonzalez was 15 years old when he was arrested on the suspicion of luring maddy middleton to his mother's apartment, and then raping her and stabbing her to death. his arraignment was continued today after the defense asked for more time to review documents. they also want to appeal the court's ruling of aj gonzalez been tried as an adult. if convicted, he could spend the rest of his life in prison. the two men charged with the deadly ghost ship fire in oakland pleaded not guilty today. derick almena and max harris have been ordered to stand trial on 36 counts of involuntary manslaughter. that is one count for each person that died in the fire of -- in december 2016. defense attorney say their clients are being made scapegoats in the case. they say the blame should be with the landlords and the city of oakland.>> if the ghost ship of the crime, it is the city of oakland that committed the crime. it is the fire department, the building inspection department and a complete failure on the part of local government. >> a trial date was set today for july 16. both men are expected to return to court next month to argue for a reduced bail. they currently remain in custody on seven of $50,000 bail a piece. the push for bill reforming california took a major step forward today. the state attorney general announced that he will not challenge an appeals court ruling that requires judges to consider defendants ability to pay when setting bail. >> reporter: outside of the san francisco hall of justice, across the street from a row of bail bond offices, calls to in bail were loud and clear. >> if you cannot afford bill, that you are four times more likely to take a plea bargain.>> reporter: this man is highlighting the case of kenneth humphrey. humphrey followed an elderly man into the home and threatened to put a pillow over the man said. he has been in the county jail since may of 2017 on a three and $50,000 bond. last month, an appeals court ruled that he is entitled to a new dell hearing where his ability to pay any threat to public safety is considered. on tuesday, the state attorney general announced he would not challenge the case. >> i am not appealing this ruling because it is unconstitutional to keep someone in jail simply because they cannot afford bail. 4 he also said that his office will not resend future bales things that do not take into account what a person can pay. >> this is significant because the humphrey case said that the bell system is a tax on the poor. >> reporter: part of the statement from the california bell association said -- bail association, said this is a slap in the face of all law- abiding californians. >> bail decisions should be based on a danger to the public. it should not be based on dollars in your pocket. >> reporter: the san francisco district attorney's office does support money belt reform, but they believe the decision should be made on a case-by- case basis by taking into consideration the defendant's rights or whether not they are a flight or public safety risk. a bill that is moving through the legislator would modernize hospital discharge procedures to prevent the release of homeless patients to unsafe and unsanitary conditions. this would work to fight patient dumping ends. this followed -- in. >> before they get discharge, they have to make sure they are fed, they are hydrated, they have proper clothing, and it is not at nighttime, and they need to be safe and have some basic prescriptions to get them started if they need anything for their condition. >> the measure also prohibits hospitals from discharging patients to any other place other than a location identified by the patient unless it is a social service center that has already made accommodations for the a reasonable safety precaution that does not violate the buyer second amendment rights. it applies to all people, even people that alrighty on the gun. state leaders are looking into water saving options including making some restrictions permanent regardless of that yearly rainfall total. our reporter is live with the rules that are being proposed. >> reporter: that lafayette reservoir has plenty of water right now. that is thanks in part to the drought ending rain that we had last year, the changes are on the way for many of us across california. it is a story that the people in california know all too well. clear skies and no rain will come at a price.>> it looks like we are having a miserable winter. it looks like another dry year and another snow drought.>> reporter: the study of such things has been this man's bread and butter. changes are coming to the residence of california in the form of water restrictions, and again very soon. >> we had five years of drought followed by a very wet year last year. >> reporter: the water resource control board met to discuss whether not to ban things like a water hose to wash off driveways and watering your lawn within 48 hours of a rainstorm. the boat was called off because of changes that were made to the list of restrictions and more public input was needed. this statement reads in part that the state water board chairperson convened a workshop in his place to listen to additional public comments on the applications. >> this is pretty minimal to what i think we are going to have to see if the drought years continue.>> reporter: californians in the previous drought years cut water usage by 25%. >> we are going to have to see bigger restrictions on outdoor watering. i think we are going to have to see incentives to see people remove lawns from the guards and put in more drought proof gardens. sometimes it is economic incentives. rebates for efficient washing machines and toilets and dishwashers. sometimes it is just education so that people know we are in a drought and change their behavior.>> reporter: those are changes that he hopes will be made sooner rather than later. the council delayed that vote to accommodate emergency uses for agriculture. a new date has not been set for the water restriction vote. the daytime high temperatures to date was on the cool side. we were in the mid and low 50s. oakland was just 51 degrees. so it was a cool day today. it started off cool and we had a record in oakland this morning at 34 degrees. everyone else tied records. all of this cold air in the midsection and out west and the southern part of the jet, below it, you see all of the record warmth. atlanta is going to see temperatures in the 80s over the next 24 hours or 36 hours. we are tracking another weather system, but it is cold. cold systems do not produce rain or snow. they do a little bit, but not the kind that we need. what we are seeing here is a few showers that will move in. a few snow flurries will move in tonight and tomorrow morning. but, it should not amount to much. we are seeing some snow flurries up by diablo. the current temperatures show as it is 43 degrees in napa. there is more cloud cover tonight and a little bit more of a breeze. no freeze warnings for us tonight and no frost advisories unless you are in the fairfield area. when i come back, we will this morning. plus giants legend orlanda cepeda was rushed to the hospital, and mark will have an update on his condition. an early morning fire destroyed the home and east bay, and we will hear from and 80 locations after closing more than 100 restaurants last year. ihop was shut down 30 or 40 restaurants on top of the 25 it closed last year. both restaurants are trying to update their menu. an early morning fire destroyed a home in walnut creek and created some frightening moments for the family that lived there. the fire broke out just before 4:00 a.m. this morning. >> reporter: the homeowner says that her fianci woke up with a terrible feeling that something was wrong. that is when she said that he noticed the fire in the back room and they are grateful they all made it out alive. >> he looked out the window and noticed the glow. he thought it was the first ambulances across the street. but then he realized it was coming from the back of the house. so we went to the kitchen and saw that the back room was on fire. smoke was coming out. he immediately started yelling fire and to get everybody out. and this is video from the fire chief, and the call came in at 3:50 am this morning. this is what firefighters found when they arrived. four adults and one child live in the house, and all were able to escape.>> his father is recovering from a stroke, and we had them come stay with us because he lived in an upstairs apartment, and he could not get upstairs. they have been with us three weeks, and part of the reason that we wanted them here is that if a fire broke out, they would be safer with us.>> reporter: firefighters had the fire knocked down in 30 minutes, and spent more time extinguishing the fire in the attic. homeowners believe old electrical wiring may be to blame. >> if it wasn't for him waking up and the fast response of the fire department, we could have all been called. and the cause of the fire is still under investigation, but the fire crews say they know the fire was started in the back. the homeowner says the red cross has been helpful in giving them temporary shelter. coming up next, a, denominator in a series of recent gas leaks around the area and the potential punishment for violators. >> reporter: the latest developments are coming up next in the russian investigation. the family of an oakland man who was shot to death by bart police last month is now demanding that the officer be criminally charged with murder. they say that body camera footage shows that the man was unarmed when he was killed during the and near the west oakland bart station. but the officer was said to have to open fire when he refused to drop his gun. the state attorney general said they will not appeal a ruling on the state's unfair cash bail system. the court's decision is an important recognition of the need to reform the current bell system. the case involved a thief of stealing seven dollars and a bottle of cologne from an elderly person. the subject has been in jail while awaiting trial because he cannot afford the three and $50,000 bail set by a judge. bill -- the russia investigation heated backup today when a lawyer linked to a former aide from president donald trump scan paid pleaded guilty and admitted that he lied to the fbi.>> the white house continues there is no evidence to prove russian interference impacted the presidential election. >> reporter: the charge does not involve election meddling or relate to the trump campaign 2016 operation. he said it stems from rob about his investigation into the president's former campaign chairman paul metaphor. reporters mobbed u.s. district court in washington as alex van der zwaan was there. he pleaded guilty to lying to federal agents about his ties to trump former campaign aide richard gates. gates was indicted along with paul metaphor. manafort headed up president trump's campaign in 2016. the white house already has distanced themselves from these latest developments. >> this has to do with an attorney that is representing someone who has already been indicted. it had nothing to do with actions related to this president. >> reporter: sarah sanders continued to insist that russian influence did not influence the election. >> the president did not say that the russian did not metal, but what he is saying is that it did not have an impact and it was not with help from the trump campaign.>> reporter: last thursday, 13 russian individuals and three russian companies were charged with meddling in the 2016 campaign. as for alex van der zwaan, he worked for a prominent wall street law firm during the time that was in question, although he was fired from that firm last year. that law firm said they are fully cooperating with the investigation. federal democratic lawmakers in sacramento are urging governor brown to spend more money on programs that will fight sexual abuse and domestic programs in california. a recent study shows that those crimes cost the state nearly $140 billion in 2012. a democrat from the south place at the current budget surplus would easily allow the governor to set aside $50 million to fight this problem.>> there has not been an increase in the state budget for domestic violence at the 1980s, and it is time for an increase giving that we have additional surplus revenues. >> study show that the enormous cost of sexual abuse and domestic violence includes medical and psychological care, legal services, and even property damage. another earthquake rattled the danville area a short time ago. an earthquake hit around 6:15 pm tonight in the same place that other earthquakes hit this morning. three earthquakes hit within minutes of each other within three hours of one another. there has been two dozen small earthquakes in the same area since last friday. most of them were too small for people to notice, the quick this morning jolted some people out of bed.>> it just felt like being nudged the weight. -- awake.>> it will me up. i went back to sleep -- it woke me up. but, i went back to sleep. >> the seismic activity appears be along the calaveras fault. there has been several gas lines around the bay area in recent weeks with at least three of them being in san francisco. they are caused by construction crews and some of them led to evacuation. our reporter has more on the penalties for not calling pg&e before the digging begins. >> reporter: this is a view when a construction crew dug into a gas line and forced the entire street to evacuate. every day, pg&e averages almost 5 excavation diggings that -- dig ends that break gas lines. nationally, this strikes utilities every three minutes. most of these are caused by contractors or residents who did not know or did not call the 811 service before digging. once they are called, 811 will send markers out for all of the utilities to mark with color- coded paint which kind of the lines run were. pg&e investigators, and all of them have law enforcement background, and they quickly respond to dig ins. >> my job is to come out and look at all of the factors that are involved in the dig ins. >> reporter: they take measurements and reconstruct the scene and events and submit them to the companies claim division that will collect from the responsible parties. this way that ratepayers will not have to pay for the damage. the average cost for a contractor or residents who digs into a line, that is about $7500. >> it depends on the type of service that is damaged, and the amount of work that goes into getting it repaired. >> reporter: with all of the massive construction going on in san francisco, you think that would be a perfect recipe for big dig ins. but it is really repairs of old infrastructure that causes the problems. >> sewer work or water work were contractors are doing work on behalf of the city, and they are obviously putting in new infrastructure, and sometimes there excavation techniques may cause them to dig into our facilities.>> reporter: occasionally, pg&e says they may miss mark a pie. but if there is ever a doubt, then simply use a less destructive means of finding the pipe, like hand daughter saw it last night and absolutely loved it. my wife said the thing that really stuck out to her was the women in the movie were all powerful women, and that struck a chord with her. >> the weather is creating a lot of buzz because of the cold weather. when are we going to heat back up again?>> it is february and it is finally feeling like february and i think it is freaking us out because we had nine days in a row of record warm temperatures in the early part of february. so now temperatures are more adjusted to what you would expect in february. we had one record in oakland this morning at 34 degrees. these are the forecasted low temperatures for tomorrow morning. they will not be as cold as this morning. there is not a freeze or frost advisory. there is a hard freeze warning out toward davis. but it is going to be cold tonight, don't get me wrong, but it is not going to be as cold as last night. here is how it goes in san francisco tomorrow morning, you can see a few scattered showers out there, and this cold system just hangs on. it will be a light dusting of snow on some of the bay area peaks at best. maybe a scattered shower late in the day and the high in san francisco will be just 55 degrees. the golden gate bridge outside is dry, and it is cold. this is a dry weather system. it has the don -- dynamics that are there for rain and snow, but the fuel of tropical moisture is not. here is the view from tomorrow morning, and down the coast, you may see a sprinkle. this will pull some more cool air in behind it. here is thursday morning, and then thursday afternoon. what do you do with that? it is so not like us. we typically see the systems that come in at the mid- latitude. they have a lot of moisture, and we get rain. this thing is producing nothing. there will be some rain and even snow flurries, but it will not add up. it will be 7:00 a.m. tomorrow morning in san jose and 30 degrees. san jose looks like they are out of the chance for a shower. if that thing goes down the coast, then he could spend something up. these on the forecast high temperatures tomorrow. it will be 55 degrees in antioch. this is the five-day everybody is hoping for a recovery there. meanwhile, in one of his favorite places to hang out, scottsdale, arizona, the giants were at it with full squat -- squad workouts. you won't be able to see the ball, but the sound of that bat hitting the ball tells you that it landed will be on the left field fence. he probably brushed them back on the next pitch. meanwhile, the oakland a's are also in action, and they are in mesa, arizona. they are totally opposite of the giants. the oakland a's are in a perpetual youth movement. their starting rotation, for instance, is led by kendall graveman who figured out in this case. a judge ruled today that prosecutors have produced enough evidence to have an oakland couple stand trial in the middle killing of an alameda county sheriff's explorer. curtis taylor and laura rogers are accused of luring this woman to an east oakland park where she was stabbed, beaten, and set on fire. ktvu learned that the two women developed a relationship while working at a fast fruit restaurant. -- food restaurant. two men have been arrested after having a pipe bomb delivered at a home. and two men are now under arrest for allegedly detonating a pipe bomb at this on. no one was hurt, but the blast at 1:00 a.m. in the morning windows and was heard and felt for blocks. >> all of my kids went outside to see what happens.>> we heard something very hard. >> reporter: a family inside of the home where the bomb went off yelled at the tv crews to leave saying they were concerned about the young child's safety. >> i think anytime that you have an explosive device like that detonated in front of the residence, there is always the potential for extremely bad things to happen, and we are just thankful that there was not any injuries. >> reporter: an investigation by the suisun city police and the fbi has now led to to arrest. thomas capenhurst was arrested monday afternoon. sky falk was overhead as chp officer stopped him . the other suspect, 20 road robert mcgraw was arrested at this home in fairfield. people at the home declined to comment. police have not revealed a motive in the case, but they are saying this was not a random attack. the suspects were unavailable for interviews at jail, and both are being held on numerous felonies including the use of a destructive device with the intent to commit murder. thomas capenhurst is a convicted felon who was well known to law enforcement. he was arrested by police for allegedly having these guns and ammunition. neighbor say they are feeling much more say. >> we have lived here working to determine whether or not they will be prosecuted in state court or federal court. a santa cruz teenager accused of killing an 8-year- old girl in 2015 was in court today. aj gonzalez was 15 years old when he was arrested on the suspicion of luring maddy middleton to his mother's apartment, and then raping her and stabbing her to death. his arraignment was continued today after the defense asked for more time to review documents. they also want to appeal the court's ruling of aj gonzalez been tried as an adult. if convicted, he could spend the rest of his life in prison. the two men charged with the deadly ghost ship fire in oakland pleaded not guilty today. derick almena and max harris have been ordered to stand trial on 36 counts of involuntary manslaughter. that is one count for each person that died in the fire of -- in december 2016. defense attorney say their clients are being made scapegoats in the case. they say the blame should be with the landlords and the city of oakland.>> if the ghost ship of the crime, it is the city of oakland that committed the crime. it is the fire department, the building inspection department and a complete failure on the part of local government. >> a trial date was set today for july 16. both men are expected to return to court next month to argue for a reduced bail. they currently remain in custody on seven of $50,000 bail a piece. the push for bill reforming california took a major step forward today. the state attorney general announced that he will not challenge an appeals court ruling that requires judges to consider defendants ability to pay when setting bail. >> reporter: outside of the san francisco hall of justice, across the street from a row of bail bond offices, calls to in bail were loud and clear. >> if you cannot afford bill, that you are four times more likely to take a plea bargain.>> reporter: this man is highlighting the case of kenneth humphrey. humphrey followed an elderly man into the home and threatened to put a pillow over the man said. he has been in the county jail since may of 2017 on a three and $50,000 bond. last month, an appeals court ruled that he is entitled to a new dell hearing where his ability to pay any threat to public safety is considered. on tuesday, the state attorney general announced he would not challenge the case. >> i am not appealing this ruling because it is unconstitutional to keep someone in jail simply because they cannot afford bail. 4 he also said that his office will not resend future bales things that do not take into account what a person can pay. >> this is significant because the humphrey case said that the bell system is a tax on the poor. >> reporter: part of the statement from the california bell association said -- bail association, said this is a slap in the face of all law- abiding californians. >> bail decisions should be based on a danger to the public. it should not be based on dollars in your pocket. >> reporter: the san francisco district attorney's office does support money belt reform, but they believe the decision should be made on a case-by- case basis by taking into consideration the defendant's rights or whether not they are a flight or public safety risk. a bill that is moving through the legislator would modernize hospital discharge procedures to prevent the release of homeless patients to unsafe and unsanitary conditions. this would work to fight patient dumping ends. this followed -- in. >> before they get discharge, they have to make sure they are fed, they are hydrated, they have proper clothing, and it is not at nighttime, and they need to be safe and have some basic prescriptions to get them started if they need anything for their condition. >> the measure also prohibits hospitals from discharging patients to any other place other than a location identified by the patient unless it is a social service center that has already made accommodations for the a reasonable safety precaution that does not violate the buyer second amendment rights. it applies to all people, even people that alrighty on the gun. state leaders are looking into water saving options including making some restrictions permanent regardless of that yearly rainfall total. our reporter is live with the rules that are being proposed. >> reporter: that lafayette reservoir has plenty of water right now. that is thanks in part to the drought ending rain that we had last year, the changes are on the way for many of us across california. it is a story that the people in california know all too well. clear skies and no rain will come at a price.>> it looks like we are having a miserable winter. it looks like another dry year and another snow drought.>> reporter: the study of such things has been this man's bread and butter. changes are coming to the residence of california in the form of water restrictions, and again very soon. >> we had five years of drought followed by a very wet year last year. >> reporter: the water resource control board met to discuss whether not to ban things like a water hose to wash off driveways and watering your lawn within 48 hours of a rainstorm. the boat was called off because of changes that were made to the list of restrictions and more public input was needed. this statement reads in part that the state water board chairperson convened a workshop in his place to listen to additional public comments on the applications. >> this is pretty minimal to what i think we are going to have to see if the drought years continue.>> reporter: californians in the previous drought years cut water usage by 25%. >> we are going to have to see bigger restrictions on outdoor watering. i think we are going to have to see incentives to see people remove lawns from the guards and put in more drought proof gardens. sometimes it is economic incentives. rebates for efficient washing machines and toilets and dishwashers. sometimes it is just education so that people know we are in a drought and change their behavior.>> reporter: those are changes that he hopes will be made sooner rather than later. the council delayed that vote to accommodate emergency uses for agriculture. a new date has not been set for the water restriction vote. the daytime high temperatures to date was on the cool side. we were in the mid and low 50s. oakland was just 51 degrees. so it was a cool day today. it started off cool and we had a record in oakland this morning at 34 degrees. everyone else tied records. all of this cold air in the midsection and out west and the southern part of the jet, below it, you see all of the record warmth. atlanta is going to see temperatures in the 80s over the next 24 hours or 36 hours. we are tracking another weather system, but it is cold. cold systems do not produce rain or snow. they do a little bit, but not the kind that we need. what we are seeing here is a few showers that will move in. a few snow flurries will move in tonight and tomorrow morning. but, it should not amount to much. we are seeing some snow flurries up by diablo. the current temperatures show as it is 43 degrees in napa. there is more cloud cover tonight and a little bit more of a breeze. no freeze warnings for us tonight and no frost advisories unless you are in the fairfield area. when i come back, we will this morning. plus giants legend orlanda cepeda was rushed to the hospital, and mark will have an update on his condition. an early morning fire destroyed the home and east bay, and we will hear from and 80 locations after closing more than 100 restaurants last year. ihop was shut down 30 or 40 restaurants on top of the 25 it closed last year. both restaurants are trying to update their menu. an early morning fire destroyed a home in walnut creek and created some frightening moments for the family that lived there. the fire broke out just before 4:00 a.m. this morning. >> reporter: the homeowner says that her fianci woke up with a terrible feeling that something was wrong. that is when she said that he noticed the fire in the back room and they are grateful they all made it out alive. >> he looked out the window and noticed the glow. he thought it was the first ambulances across the street. but then he realized it was coming from the back of the house. so we went to the kitchen and saw that the back room was on fire. smoke was coming out. he immediately started yelling fire and to get everybody out. and this is video from the fire chief, and the call came in at 3:50 am this morning. this is what firefighters found when they arrived. four adults and one child live in the house, and all were able to escape.>> his father is recovering from a stroke, and we had them come stay with us because he lived in an upstairs apartment, and he could not get upstairs. they have been with us three weeks, and part of the reason that we wanted them here is that if a fire broke out, they would be safer with us.>> reporter: firefighters had the fire knocked down in 30 minutes, and spent more time extinguishing the fire in the attic. homeowners believe old electrical wiring may be to blame. >> if it wasn't for him waking up and the fast response of the fire department, we could have all been called. and the cause of the fire is still under investigation, but the fire crews say they know the fire was started in the back. the homeowner says the red cross has been helpful in giving them temporary shelter. coming up next, a, denominator in a series of recent gas leaks around the area and the potential punishment for violators. >> reporter: the latest developments are coming up next in the russian investigation. the family of an oakland man who was shot to death by bart police last month is now demanding that the officer be criminally charged with murder. they say that body camera footage shows that the man was unarmed when he was killed during the and near the west oakland bart station. but the officer was said to have to open fire when he refused to drop his gun. the state attorney general said they will not appeal a ruling on the state's unfair cash bail system. the court's decision is an important recognition of the need to reform the current bell system. the case involved a thief of stealing seven dollars and a bottle of cologne from an elderly person. the subject has been in jail while awaiting trial because he cannot afford the three and $50,000 bail set by a judge. bill -- the russia investigation heated backup today when a lawyer linked to a former aide from president donald trump scan paid pleaded guilty and admitted that he lied to the fbi.>> the white house continues there is no evidence to prove russian interference impacted the presidential election. >> reporter: the charge does not involve election meddling or relate to the trump campaign 2016 operation. he said it stems from rob about his investigation into the president's former campaign chairman paul metaphor. reporters mobbed u.s. district court in washington as alex van der zwaan was there. he pleaded guilty to lying to federal agents about his ties to trump former campaign aide richard gates. gates was indicted along with paul metaphor. manafort headed up president trump's campaign in 2016. the white house already has distanced themselves from these latest developments. >> this has to do with an attorney that is representing someone who has already been indicted. it had nothing to do with actions related to this president. >> reporter: sarah sanders continued to insist that russian influence did not influence the election. >> the president did not say that the russian did not metal, but what he is saying is that it did not have an impact and it was not with help from the trump campaign.>> reporter: last thursday, 13 russian individuals and three russian companies were charged with meddling in the 2016 campaign. as for alex van der zwaan, he worked for a prominent wall street law firm during the time that was in question, although he was fired from that firm last year. that law firm said they are fully cooperating with the investigation. federal democratic lawmakers in sacramento are urging governor brown to spend more money on programs that will fight sexual abuse and domestic programs in california. a recent study shows that those crimes cost the state nearly $140 billion in 2012. a democrat from the south place at the current budget surplus would easily allow the governor to set aside $50 million to fight this problem.>> there has not been an increase in the state budget for domestic violence at the 1980s, and it is time for an increase giving that we have additional surplus revenues. >> study show that the enormous cost of sexual abuse and domestic violence includes medical and psychological care, legal services, and even property damage. another earthquake rattled the danville area a short time ago. an earthquake hit around 6:15 pm tonight in the same place that other earthquakes hit this morning. three earthquakes hit within minutes of each other within three hours of one another. there has been two dozen small earthquakes in the same area since last friday. most of them were too small for people to notice, the quick this morning jolted some people out of bed.>> it just felt like being nudged the weight. -- awake.>> it will me up. i went back to sleep -- it woke me up. but, i went back to sleep. >> the seismic activity appears be along the calaveras fault. there has been several gas lines around the bay area in recent weeks with at least three of them being in san francisco. they are caused by construction crews and some of them led to evacuation. our reporter has more on the penalties for not calling pg&e before the digging begins. >> reporter: this is a view when a construction crew dug into a gas line and forced the entire street to evacuate. every day, pg&e averages almost 5 excavation diggings that -- dig ends that break gas lines. nationally, this strikes utilities every three minutes. most of these are caused by contractors or residents who did not know or did not call the 811 service before digging. once they are called, 811 will send markers out for all of the utilities to mark with color- coded paint which kind of the lines run were. pg&e investigators, and all of them have law enforcement background, and they quickly respond to dig ins. >> my job is to come out and look at all of the factors that are involved in the dig ins. >> reporter: they take measurements and reconstruct the scene and events and submit them to the companies claim division that will collect from the responsible parties. this way that ratepayers will not have to pay for the damage. the average cost for a contractor or residents who digs into a line, that is about $7500. >> it depends on the type of service that is damaged, and the amount of work that goes into getting it repaired. >> reporter: with all of the massive construction going on in san francisco, you think that would be a perfect recipe for big dig ins. but it is really repairs of old infrastructure that causes the problems. >> sewer work or water work were contractors are doing work on behalf of the city, and they are obviously putting in new infrastructure, and sometimes there excavation techniques may cause them to dig into our facilities.>> reporter: occasionally, pg&e says they may miss mark a pie. but if there is ever a doubt, then simply use a less destructive means of finding the pipe, like hand because we had nine days in a row of record warm temperatures in the early part of february. so now temperatures are more adjusted to what you would expect in february. we had one record in oakland this morning at 34 degrees. these are the forecasted low temperatures for tomorrow morning. they will not be as cold as this morning. there is not a freeze or frost advisory. there is a hard freeze warning out toward davis. but it is going to be cold tonight, don't get me wrong, but it is not going to be as cold as last night. here is how it goes in san francisco tomorrow morning, you can see a few scattered showers out there, and this cold system just hangs on. it will be a light dusting of snow on some of the bay area peaks at best. maybe a scattered shower late in the day and the high in san francisco will be just 55 degrees. the golden gate bridge outside is dry, and it is cold. this is a dry weather system. it has the don -- dynamics that are there for rain and snow, but the fuel of tropical moisture is not. here is the view from tomorrow morning, and down the coast, you may see a sprinkle. this will pull some more cool air in behind it. here is thursday morning, and then thursday afternoon. what do you do with that? it is so not like us. we typically see the systems that come in at the mid- latitude. they have a lot of moisture, and we get rain. this thing is producing nothing. there will be some rain and even snow flurries, but it will not add up. it will be 7:00 a.m. tomorrow morning in san jose and 30 degrees. san jose looks like they are out of the chance for a shower. if that thing goes down the coast, then he could spend something up. these on the forecast high temperatures tomorrow. it will be 55 degrees in antioch. this is the five-day forecast, and it is dry. it is a cold and dry weather system. >> hopefully will get some rain at some point. >> early march looks really wet. it it will -- it will be warmer and weather. but when you
