since 2008. the dow jones lost 2 1/2% today. the s&p was down 59 points. each of those indexes dropped about 2% as traders are concerned about signs of inflation which may make the federal reserve themselves.>> reporter: the memo asserts that the fbi abused government surveillance powers in the investigation of russian meddling in the election. much of the memo focuses on a dossier compiled by christopher steele. the memo says that surveillance application did not disclose or reference the role of the dnc or the clinton campaign. >> what you see in your, if it is right, the fbi relied on a document paid for by the hillary clinton campaign to distort the essential part of why they filed the warrant.>> reporter: the document also allege bias by steel -- steel saying that donald trump was not wanted to get elected. democrats say this is part of a bigger strategy. >> the president hopes that this misleading memo would help him make the casey goetz fbi and against the department justice and will ultimately undermine robert mueller. >> reporter: it is believed that the house will release the democratic memo which will provide more context for the investigation. that would have to be okay by the president. -- okayed the president. strong reactions that are upset about federal immigration agents auditing 80 businesses from san francisco to sacramento. our report is live in our newsroom tonight with more on the response to the crackdown.>> reporter: this is the notice of inspection that was served to businesses this week and is informed that they will be audited to be sure that they are not employing any undocumented immigrants. some call it a fear tactic. >> reporter: in a country divided, union and religious groups are coming together to lift one another up in song. >> we are here to say to our workers and immigrant community do not be afraid, we stand with you. president donald trump is hopeful that workers will quit their job, and we are here to say do not quit your job. we are going to stand with you. >> reporter: a rally outside of the immigration and custom office in san francisco comes in response to roughly 77 businesses in san francisco, san jose, and sacramento receiving audited by ice. businesses have three days to comply and could face fines if they are not in compliance with the law. the actions this week are a that's make an effort to step up laws to force businesses not to hire illegal workers. >> i am really concerned whether or not california is being targeted. you cannot under the law target a region because of our law on sanctuary cities and have selective enforcement.>> i think it is no coincidence that it is happening in northern california, a big blue region that did not support president donald trump for president. they certainly have the right to audit. >> reporter: a woman sent this notice showing the notice of inspection that was given to her friend, a local business owner. she did not identify the business, but said the agent was professional and came in alone.>> we have proactively been reaching out to our small businesses.>> reporter: this oakland mayor is not aware of any audits in her city, but is definitely concerned about retaliation. >> clearly the government is retaliation against localities that are asserting their values. >> reporter: part of the statement reads that their worksite enforcement strategy is focused on protecting jobs for u.s. citizens and others who are lawfully employed eliminating advantages for companies and strengthening public safety and national security. >> tearing apart families and kids is inhumane. >> reporter: lawmakers are urgent people with concerns to contact the congress members for help. ice says that these investigations are ongoing and any undocumented workers are subject to arrest and deportation. in the north bay, the district attorney's office is running stings to try and catch unlicensed contractors who are praying of victims of the wine country wildfires. our reporter spent the day in the area of santa rosa and shows us how this works and how many scammers have been called.>> reporter: add that did not provide certain required information such as the contractor's license number or they gave licenses that had expired or had been revoked. last saturday under agents that were posing as fire survivors met them at the jobsite. there the bogus contractors offered bids for framing, electrical, and plumbing services.>> we caught a total of 13 people.>> reporter: the prices ranged from $850 to $13,000 for framing. plumbing range from $1500- $4500. >> these are significant bids that are well over the $500 limit where you need to have an that's make a license. >> reporter: those that actually gave the its face very serious charges of illegally contracting in a declared disaster area. >> the penalties are stiffer now because we are under a disaster area and it is a felony.>> reporter: add to that, a $10,000 fine. it is a call to the residence to be vigilant. >> it is really disappointing because overall i have seen the good in people and how people have really put together in the most amazing ways, and i am also a little surprised that there are people that are still trying to take advantage of the situation. >> now that i know that it is happening, i will keep my eyes open. i have a direct line to the contractors put their license number on their ads, on their vehicles, and on the contracts and other documents just to make sure that consumers have the ability to check them out online with the reports an uptick in deadly cases, especially among children. this week there has been 16 pediatric deaths. officials also say they have seen the highest overall hospitalization rates ever recorded. >> hospitalizations of the highest that we have seen, even higher than in 2014. some folks are having difficulty finding antiviral medicine. >> we are seeing record numbers here in california according to the state department of health. at least 30 people died of the flu last week. that brings the total number of death this season in california to 127. in the bay area, there has been at least 22 reported deaths. state officials are saying they also are seeing above expected levels of hospitalization. two brothers in george are sticking together as they try to battle the flu. this video on the mother's facebook page has gone viral. they are gaining strength by comforting one another. one of the boys tested positive to the flu on saturday, and then passed it on to the other one. they are so cute. the boy's doctors say hopefully they will get three of the flu over the next couple of days. in san jose, people at the oak grove school district are receiving news they hope would never come. the school district announced they are closing three schools because of dwindling enrollment. our reporter went to one of the schools today that was expected to shut down.>> reporter: for families, the news is heartbreaking. this year at glider elementary will be the last. this school along with two others will be closed due to the dwindling enrollment. >> we are just devastated.>> reporter: the school district made the announcement this week saying they had little choice but to close the schools. they say as the number of students shrink, so does the district state funding.>> we have gotten to the report with us losing over 1000 kids over the last 10 years and increasing cost, we needed to take some action to help our district. >> reporter: experts say the school district is not alone. the high cost of housing in silicon valley is taking a toll on most school districts. he says that young family simply -- families simply cannot afford to live here. >> the school district is one of the school district that is admitting to what is going on to the degree that is going on. >> reporter: over the next three years, oak grove will be facing eight $12.5 million budget shortfall including the three schools. they will save $2 million a year in operating costs. >> although it is a difficult decision, it is a decision that was made in the best interest of all the students.>> reporter: officials say they will work hard with care and compassion. they are not expecting any teacher layoffs, but still everybody is a little worried. >> i understand the position of the district trying to save money, but i don't think they put a lot of thought into this. >> i am really sad that my school is closing because i don't want to miss all of my friends.>> -- this talk about our weather now as we bring in our chief meteorologist bill martin. it feels like it should be april . >> it is so warm. >> and near 80 degrees. we did not get 80 degrees, but we got up to 78 degrees. there was some offshore winds out by diablo and parts of the north bay. if this was not deep into winter, it would be a high fire day. we did have more records today, and we are going to see more records. it is the second day in a row that we had records. it is 75 degrees in mountain view. also, it is 76 degrees in san jose. it is much warmer though down towards santa maria. so this is very unusual weather, and it is not helping the lack of rain this year, but i will say it and say it over and over, we always have to be prepared to not have rain. we can easily slip back into the pattern that we see now as we are seeing that is what's happening. california is a drought state, so always be recycling or reusing. it is 73 degrees near napa. these were the highs and other cities and they were not records. so here is the forecast for the month of february. we will be in the upper 70s and mid 70s for the next couple of weeks. as we head into tomorrow, there will be no difference. temperatures tomorrow will be quite similar to what we had to date. you see a little bit of a onshore flow and you see that little notch right there? that is a north and northeast wind. as it blows offshore, it sinks, and as it sinks, it warms. this is the pattern that gets you a high fire danger and record heat. that is why log is not forming and we are not seeing a lot of frost in the morning either. it is 67 degrees in fairfield. so it was a warm day out there. when you look out there you can actually see this reflection this time of the year as it hits the tower. the forecast for the line outside of the russian river brewing company in downtown santa rosa went around the block. people camped out since yesterday afternoon to get their hands on this beer that is brewed once a year. >> we were here last year and we were really excited to come in and try this.>> reporter: this is especially hoppy beer first rose to stardom back in 2010 getting high marks from beer officials. the big buzz has led to long lines every year, and now beer lovers from around the world make this annual pilgrimage. >> today is my birthday and this is my birthday resident to myself. i wanted to come and drink his beer which i have not had before.>> this is our sixth year, and we all meet and come up here no matter where we are at for a girls weekend in santa rosa. >> reporter: the first person in line was lindsay wardell and he told me he lost his santa rosa home and in the midst of rebuilding, he decided to take a beer break. >> this fire happened but we are a very strong community here. a lot of it is just about each day taking some time to make it all good. you cannot miss this beer though. this is a special treat. >> reporter: says the northbay fire tourism in this area has taken a real hit and the owners our hope in the annual release of their renowned beer will help give a boost to the local economy. >> two years ago, pliny the younger had an economic impact of million dollars for the two week period. we are hoping that the same thing will happen this year and it will not just help us, but all of the local hotels and neighboring restaurants. >> reporter: even the it happened the day during the sentencing of u.s. gymnastic doctor larry nassar . a father of three of the victims ask a very blunt question. >> i would ask you as far as his sentencing to grant me five minutes in a locked room with this demon. would you do that? yes or no. >> know. >> would you give me one minute. >> you know that i cannot do that. >> it gives you the chills just watching that. our reporter has more on what happened next including what the judge said that there was no way she was going to punish that father for rushing at larry nassar . >> reporter: a charlotte ms. good judge said she will not punish the father of the three victims as he tried to attack the disgraced sports doctor larry nassar . >> i want to as part of the sentencing to grant me five minutes in a locked room with this demon. would you do that? yes or no. >> no sir i can't. >> would you give me one minute.>> reporter: randall margraves lunged at the doctor at the third and final sentencing. deputies and bailiffs quickly stop the attack. two of his daughters testified that day that the sisters were sexually abused by larry nassar at an elite gymnasium. the emotional father later returned to the courtroom and apologized to the judge. the judge says she understands his outburst and will not punish his acts -- him for his actions at the did this, but if he promises not to lash out again. a sentence is expected next week and larry nassar faces a minimum of 25 years in jail on top of the previous sentencing of 65 years. the attack happened after stunning revelation says that the officials were told about the sex abuse claims in 2015, nearly one year before the scandal broke, but did nothing to stop it. a 19-year-old man has been arrested on suspension of watching a 5-year-old boy on a bart train. raymond benson is now facing charges that include battery and child cruelty. he was arrested at the berkeley station at around 9:30 am wednesday morning. police say the child accidentally bumped into him, and then benson punched the child. a woman who was reported missing back in november has been hiding in lakeside on the set of the reality show the bachelor. rebecca martinez is on the season of the bachelor, and it was pointed out by people on facebook. it turns out that martinez's mother reported to police that she had last seen her daughter on november 12. today on twitter, rebecca martinez said mom, i did not get cell service on the bachelor? a northbay chp officer who patrolled the streets are not just partners, they are father and son. our reporter doing paperwork at the office when his father got into a pursuit on highway 101. the sun dropped what he was doing and drove ahead of the chase and flattened the tires would spike strips. >> a lot of this family as the young officer is -- younger son of one of these offers -- officers is instant in becoming a police officer. police are trying to determine how a 12-year-old girl got a loaded handgun that accidentally went off at her backpack yesterday. the 12-year-old has an attorney and is currently not talking with investigators. for students and an adult was hurt with that small caliber gun fired a single round inside of the girls backpack when the girl reportedly dropped the bag. a 15-year-old boy was struck in the head, but he is expected to survive. the other injuries were minor. a woman died when she fell down the escalator at the montgomery bart station last night. the woman was from oakland and there does not appear to be any evidence of foul play. we continue to follow breaking news were utility and fire crews are on the scene of a reported gas leak. we are also learning that some water lines ruptured when a huge tree came down on cherry street. that section of the road is now closed to traffic. the fire department and electric company are both on the scene investigating. they are nowhere to be found. it is 45 degrees for a forecast low in napa. those inland valley numbers, well i would expect 32 degrees or 31 degrees on a pattern like this. with high pressure, you would be looking at 28 degrees up in the north bay. so here is tomorrow morning and that is san francisco. that is everybody's guy. it will be 74 degrees for a daytime high temperature for san francisco in february on super bowl weekend. that is pretty impressive. some 80s will want to pop in in areas. it is kind of interesting because we all have pattern recognition or seasons and patterns that repeat himself. so we get used to a certain thing here in february. when we field temperatures -- feel temperatures like this, it throws you off. you can forget what month it is andy environment does that to with the animals and the plants. it is definitely a curveball to say the least. as we go into the weekend, the hardest part will be watching the super bowl in 75 degrees. >> that's true, but it is 8 degrees at the super bowl. >> it is going to be hard to watch the super bowl at 75 degrees outside. that is something that i am not used to. >> i want to go outside and get some vitamin d. heavy rain in paris has caused high floodwaters in the area. but a couple of teenagers are making the most of it. i want to show you a video of wakeboard enthusiasts practicing as they are wake boarding through the street. hundreds of residents have been evacuated and water levels are expected to remain high for several days. the united nations paid respect this week for the millions of people that were killed in the [ null ] holocaust in world war ii. the general assembly honor the 6 million juice that died. they also heard from one of those that survived. this was the youngest person to be saved from the death camp. she is now 81 years old. >> i wonder why god saved me? perhaps he wanted me to do something big. i am just an ordinary woman, but now when i am here, talking from the united nations, this is a big something that god wanted me to do. >> other speakers also warned that the same kind of hatred and division continues in many parts of the world today. back here in the bay area, a man dying from lou gehrig's disease wanted to leave something behind for his teenage daughter. >> he decided to make a record album of songs that he wrote even though the disease has robbed him of his voice. our reporter met with him and his daughter and has the story of achievement in the face of personal tragedy.[ music ]>> reporter: here in a bet inside of a southbay nursing home, bernie home -- bernie dalton is having a disease that is shutting down his body. his mind is sharp as ever and he knows what he is facing. he is facing lou gehrig's disease. doctors diagnosed it in 2016. the worst part of it is having to watch the love ones.>> he always has a upbeat look for anything that comes along.>> reporter: for als he was a surfer who cleaned swimming pools. once the diagnosis came, dalton decided he want to leave something behind for nicole and perhaps teacher grandkids. he decided he want to make a record album of the songs that he would write. he enlisted his former vocal coach to helping. she got some musicians and raise money for recording studio time and dalton provided the lyrics. >> his words express his view on the world. his advice for living and his ideas and his values are very down-to-earth. and during a recording session, he would give thumbs up if he liked what he heard. the song -- the alvin is called connections and comes out february 9. here is an example.
