plus, it's going to be a cold weekend across the northeast and the midwest section of the country. >> yep. and now they are dealing with flooding and freezing. it just looks miserable. you look at that and you think, there is absolutely nothing we can say negatively about our weather here. >> that like icy river flowing through the streets there just looks horrible. >> bitter cold. so for more on what our weather looks like -- >> very thankful in the bay area. i mean, when you see the pictures. >> they have been dealing with an extended period of extreme cold temperatures up the eastern seaboard. we can't complain too much. we have been tracking some rain. of course, it was relatively dry here in the bay area. look at this scene out towards san francisco bay. yeah. almost looks like a nice painting to frame, put on your wall. that's what we have this saturday morning. clouds in place. fog in place. but the rainfall, for the most part, is scooting out of town. there is a chance of drizzle or a few sprinkles or a light shower just for this morning. these numbers are adding up. over the past three days, two inches of rain. oakland .87. santa rosa and concord .71. we have a stronger storm developing offshore. it's not here for this weekend, but you will definitely notice it when you come back to work on monday. you can see the clouds, the rain showers over the bay area over the past 24 hours. right now we have some clouds and, as i mentioned, there is enough moisture out there you might encounter a sprinkle or two or drizzle this morning. we will check in on the current numbers. right now we have in santa rosa 39 degrees. san jose 54. livermore in the upper 40s. 49 degrees. as we expand the view out here in the pacific, our old system kind of scooting out to the south. another one developing offshore. i will be watching out for this one as we head into early next week. at least for this morning, we get a chance to dry out out there with fog and scattered high clouds. that's all a part of the forecast for today. so clouds this morning, skies are going to be partly cloudy, forecast highs close to 60 degrees. it is very mild. we are talking about that stronger storm and we will have more on that coming up in just a few minutes. seven stores in san francisco will begin selling recreational marijuana for the first time ever. >> the city of san francisco failed to get the proper permits in place for the new year's day deadline. >> reporter: good morning claudine and alex. sales here kick off at 8:15. already the first customer in line. we are also expecting some elected officials to be here on hand as well. the medical cannabis customers were here yesterday. oakland and san jose launched on january 1st. san francisco, though, lagged behind in this permitting process. right now there are seven locations to buy in the city, but there will be more in the pipeline. >> 31 that have applied at this point in time. so those applicants or submissions are all eligible to receive adult use, we are working to ensure that they are meeting the mandates. >> reporter: among those mandates, san francisco has good neighbor policies. security plans need to be in place. cannabis businesses will have to demonstrate how they are providing opportunities to underrepresented communities. we said before, the first customer in lime. dom, we talked with you. you said you feel like this is an historic day? >> it is an historic day. this is the only time this will ever happen. i see a lot of people before me that advocated this for many, many years and decades. it's finally here. i am here for them. they can't be here, they passed away. i think it's a great cause, you know? >> reporter: all right. thanks. we will see you inside a little bit later on. he said it's an historic day, the first day that they have recreational cannabis sales in san francisco. a final note. keep in mind that san francisco has imposed a 25% tax on cannabis sales on top of the already existing 15% sales tax. now that it's legal, you can tax it. >> yep. i am wondering, christien, if the lines will be shorter because maybe some people who didn't want to wait will have gone to other areas. >> right. they could have made their way to the east bay by this time? >> reporter: that will be interesting to see. it certainly is shorter. i was over in oakland on the first day of sales on january 1st and i could tell you there was more than 100 people or so in line. i think that there will be a line here. people will want to celebrate the fact that cannabis sales are legal in san francisco. i don't think we are going to see that same rush that we saw on the first day on january 1st. >> all right. christien, thank you very much. north bay lawmakers say there are lessons to be learned from october's wine country fires. many residents complained they received little to no warning about the fire and evacuations. lawmakers have drafted a bill that creates a protocol requiring counties to establish local guidelines for implementing a federal alert system that sends emergency texts to cell phones in the area. notifications would go out to the texts, family land lines. family is trying to warn people about a dangerous prank known as swatting. this is when someone makes a hoax 911 call which requires a police s.w.a.t. team to respond. two days after christmas, someone made one of these fake 911 calls and gave police the address of a family in hercules. police from the hercules police department and pinole police departments responded with guns drawn to that home. a mother, father, two young kids, and her grandparents were home at the time. they had no idea what was going on. police came in. they handcuffed the father and grandfather while searching the home. eventually, they let them go after they didn't find anything. the family says they are still traumatized by what happened and they asked we not show their faces. >> i had guns pointed at my face. we are walking slowly and the police apprehended us and i'm asking, what's going on? >> it does look like it was a prank. it certainly meets the criteria of some of the other swatting incidents out there. >> the family says police did not identify themselves initially, which led to their fear. however, police say they did identify themselves when they arrived at the home. the day after the hercules police case, police in wichita, kansas shot and killed an innocent man at his home after he fell victim to a swatting call. an undocumented u.s. berkeley student is being held at a detention center near the new mexico center. his attorney hopes to get him out by monday. it could take months. >> hi, guys. >> reporter: this is video of luis morrow posted by his girlfriend on social media. she says it was taken a few days before he was detained by border patrol in san diego saturday night. the cal junior was visiting friends. he is now being held at otay mesa detention center. >> there is no reason to detain him. he is not a criminal. >> reporter: an attorney with the east bay community law center represents him. she is fighting to get bail so he can be released pending a hearing before a judge. she hopes bond will be set so he will be back at cal in time to start classes a january 16. it could take weeks or months to secure his release. >> just being very honest. >> reporter: a spokeswoman for i.c.e. said he was taken into custody after border patrol agents determined he violated the terms and conditions of a temporary visa he had been issued for period of six months in 2009. >> he was a child at the time. he didn't really have the resources when he was 18 years old. >> reporter: cal students with rising immigrant scholars through education started the free luis campaign. they have the help of dianne feinstein and kamala harris. lee tweeted i am deeply concerned. >> if an expired visa is your biggest crime, set an example using luis as a bargaining chip. >> it's costing you and me $200 a night to house him there when instead he could be out, he could be at school. >> reporter: she visited him on thursday at the detention center. he feels some fear, but he is gaining confidence now that he has legal representation and that he is grateful for the outpouring of support. at uc berkeley, amber lee, ktvu fox 2 news. three former santa clara county jail guards have been sentenced to 15 years to life in prison for beating a mentally ill inmate to death. matthew farris, raff rel rodriguez, and jereh lubrin were convicted of second-degree murder for killing michael tyree. during this trial witnesses described hearing tyree screaming for help as those three guards beat him to death. he was later found dead inside his cell. tyree was in jail waiting to be sent it a residential mental health treatment facility. >> i think it was fair. a man was murdered at the hands of these three, and i think that they are held accountable for their actions. this case led to changes inside the santa clara county jail. there is now a new use of force policy in place and new training for correctional officers. there are also more cameras up inside the jail and officers also have body-worn cameras as well. we want to tell you about a 20-minute delay on bart right now. check out the tweet. bart says there was a person on the track and the delays are affecting multiple lines. you can see pittsburg, dublin, and sfo. we are working right now to try to find out more about the current delay. all right. attorney general jeff sessions starring states that legalized marijuana. and the price tag is in for the u.s.-mexico border wall. just how much the trump administration wants to build it. woman: so, greg, it's a lot to take in. woman 2: and i know that's hard to hear, but the doctors caught it early. hi, blake! my dad has cancer. woman: and i know how hard that is to hear. but you're in the right place. man: and dr. pascal and her team, they know what to do. they know what to do. the doctors know what to do. so here's the plan. first off, we're going to give you all... (voice fading away) the time now is 7:14. still some lingering clouds in the south bay with the possibility of sprinkles. we will have more on that coming up in a few minutes. >> thanks, mark. 7:14 this morning. president trump is meeting with republicans at camp david. the white house says they are going to discuss priorities for the 2018 year, including the budget, infrastructure, immigration, and we will for reform. one hot topic, whether to extend protections to dreamers. children brought here as undocumented immigrants. senator kamala harris posted this on twitter about dreamers. many dave dreamers -- she says using children who grew up in the country as a bargaining chip to pay for an unrealistic border wall is shameful. >> we are getting details on the trump administration's border wall plan. the "associated press" says the proposal calls for spending $18 billion over ten years. this money would pay for more than 300 miles of new barriers and more than 400 miles of replacement fencing. money would also be used for towers, surveillance, roads, and staffing. >> the author of the best selling controversial book about president trump is making explosive comments today. michael wolff says one of the interesting affects of the book is that is shows president trump is unfit for the oval office and could end his presidency. the book features reported quotes from current and former trump advisors such as steve bannon who called donald trump jr.'s meeting with a russian lawyer treasonous. >> my credibility is being questioned by a man who has less credibility than perhaps anyone who ever walked on earth at this point. >> they never interviewed the president about the book. he begged to speak with the president and was denied access. >> in a tweet last night, the president slammed wolff. the courts may decide the battle over offshore drilling here in the u.s. the trump administration has proposed opening up as much as 90% of the coast to oil and gas exploration. environmentalists, however, are vowing to fight any such drilling proposal. governor jerry brown is among a group of west coast governors of accusing the president of ignoring the risk to wildlife. representatives say drilling will create jobs and energy independence. >> we have currently 94% of the offshore resources off limits. and this is an opportunity to open up more of those areas to supply growing demand. >> offshore drilling is inherently dirty it's inevitable there will be an oil spill. >> the threat of lawsuits is one reason that major energy companies may still be reluctant to change their long- term drilling plans. they are also weary that a future democratic administration might overturn president trump's decision. all right. 7:17 on the clock. rosemary is off today. mark tamayo has woken up early to join us in studio. happy to have you here. >> thank you. happy to be here. happy to talk about a break with the rainfall. these breaks are so important. the first system kind of the year, in fact, over the past few days generating some rainfall here and some rain in the sierra as well that will eventually turn to snow as snow levels come down a bit later today. you can see our live camera looking towards san francisco. higher clouds and lower clouds. some pockets of fog trying to regroup. here is the radar over the past 18 hours or so. you can see we have some clouds in place. there is a possibility you might encounter some sprinkles or some drizzle. for the most part, we are heading into a break later today and for a good portion of the weekend as you can see. in fact, let me change the radar a bit here. we have some rain and snow showers special towards the southern sierra right now. coming in closer to the bay area, pretty mild in a few spots. a cool start towards santa rosa. san jose 54. san francisco reporting 51 degrees. as we widen out the view in the pacific, we have a lot happening. we have the storm track developing that will take aim towards the bay area about two days from now. monday we are watching this system, an atmospheric setting up. that could be the bay area. here we are. here is the juan islands. this development right here will be approaching the bay area as we head towards monday. for now we get a break. our live camera looking towards the bay. there is the richmond san rafael bridge and higher clouds we are tracking this morning. we are tracking the next storm. this will be a strong storm heading towards monday. rainfall a safe range 1.5 to 3 inches. the coastal hills could have amounts topping 3 inches. border lined wind advisory 45 miles per hour. the sierra will pick up snowfall up above 7,000 feet, eventually dropping back later monday into tuesday. but this will be somewhat of a major storm developing offshore as we head towards monday. here we are today. the clouds, the possibility of a sprinkle. later this afternoon skies becoming partly cloudy. making outdoor plans on sunday? you should be okay. expect a few extra clouds throughout the afternoon hours. then as we head into monday morning, look what happens. you can see the clock moving and this moisture funneling into the bar. this was monday at 6:00. this was monday at 12:00. during this timeframe we could have heavy rain downpours throughout the day. this is the deal we are concerned with a system like this because it can just kind of stall over the bay area, producing intense rainfall for long durations. the models trying to get a better handle on the details of the system. in general, a broad brush description of it, this will produce heavy rain, strong winds, and flooding could be a concern, and of course mudslides in the burn zones as well. san jose 62 ahead. your five-day forecast. we get a break. there we go with the stronger storm coming in on monday. tuesday thankfully the showers will be fading out of the picture later in the day on tuesday. i will say each storm, you know, we have been talking about the possibility of flash flooding in the burn zones, the storms so far have not concerned me at all. but the one coming our way on monday, that does bear some watching. >> after that dry december? tomorrow not looking too bad. even later on today. so in the sierra, yeah, just some clouds and probably partly cloudy skies throughout the weekend. as far as our forecast, we have some low clouds and fog hanging over the bay. a nice start for your weekend, for your saturday morning. of course, we have been tracking the rainfall. it has been adding up. take a look at the numbers over the past three thing monday morning rainfall rates will be picking up. intense rainfall rates that could last for a good portion of the day on monday. so that is the next developing weather headline as you can see here. the weather story is this. so today we have the clouds this morning for your sunday. some clouds increasing through the afternoon hours and a stronger storm by monday. so make the most of this locations in san francisco where pot sales are now legal. good morning to you. >> reporter: good morning. we are here inside the apothecarium giving unique peek. doors open for customers starting at 9 this morning. we will give you a little bit of a sneak peek. we are here with elliott from the apothecarium. let's talk about what we can expected to. are we expecting crowds? this has to be a big day for you guys? >> we are very excited to welcome our first recreational customers. we are expecting big clouds and a festive atmosphere. >> reporter: one of the issues this last week is jeff sessions says he is rolling back the obama era policies of sort of looking the other way when it comes to cannabis in individual states. are you expecting that to impact california and san francisco? >> you know, today we are just focused on this historic day, this happy day. we are not going to be worried about the feds today. and i don't see to making a major impact on us in the future. >> reporter: attorneys general in other states have said that they are going to be fighting it. so perhaps we will see the same thing in california. for today you have some lawmakers, you have politicians coming out here this morning, local san francisco politicians coming out? >> that's right. we will have state senator scott wiener and our san francisco supervisor jeff sheehy here for the ceremony before we open. >> reporter: you said this came together relatively last minute. i said it's like planning a party. this is like planning a wedding. you said this is planning a wedding on a tight timeline? >> that's right. we got our permit from the state at 5 p.m. last night right before the office closed. we've been rushing to get everything ready for our first recreational customers this morning. >> reporter: and last thing for me really is the apothecarium has existed as a medical cannabis dispensary in the past. how does that change when you to go to recreational sales? >> we will still be very focused on our medical patients, but we are looking forward to welcoming recreational customers and walking them through the 400 products that we have for sale, making sure they get something that morning. one final note. because cannabis is now legal in the state of california, it is taxed just like everything else in california. 15% state tax and then here in san francisco a 25% tax as well. change the way they do business. on thursday attorney general jeff sessions announced he would reverse that decision that allowed u.s. states to legalize marijuana. that announcement came four days after the sale of recreational cannabis became legal in california. many pot club owners, as you heard in christien's report, across california and in the bay area openly saying they are defying the trump administration's policies. >> we certainly intend to keep on with our operations. we are a state licensed locally supported, fully compliant cannabis business. >> similar reactions are being seen in other states. marijuana is now legal for recreational use in eight states and the district of columbia. pot is illegal under federal law. it is classified in the same category as heroin. the man acquitted in the murder of kate steinle has been sentenced for being a felon in possess of a firearm. he was sentenced to three years in jail for that gun charge linked to steinle's death in 2015. now, with credit for time served, he will not serve any more jail time. felony gun possession was the only conviction to come out of that six-week-long trial. zarate now faces federal charges for being an undocumented immigration in possession of a firearm. his attorney, however, says that they will be fighting that charge, saying it amounts to double jeopardy. acting san francisco mayor london breed wants the job permanently. >> i am here to get my paperwork to run for mayor of san francisco. >> ktvu was at city hall on friday when she asked for the candidate application. she was named acting mayor after the uncan thed -- unexpected death of ed lee last month. >> i want to make sure that we deliver on a promise to support all of our residents, that we deliver on a promise to address issues around homelessness, mental illness, and what we are seeing in terms of the quality of life on our streets. >> breed joins a growing list of candidates who announced they are running in the special election. now the board of supervisors must decide whether to name a caretaker mayor to serve until june since breed is currently serving as mayor and president of the board of supervisors. breed says she will support whatever decision the board reaches. a 23-year veteran of the richmond police department is planning to appeal his dismissal from the force. he was fired on thanksgiving eve. this was in connection to a misconduct investigation. it focused on a leaked police report that included the show briety of a city councilman on the night he was robbed. he is accused of lying to investigators. the denies those charges and he says the accusations are devastating to him. the investigation is ongoing and officials would not discuss the matter since it is a personnel issue. a panel of independent safety experts is criticizing the state and operators of the oroville dam. the safety group released a report examining last year's spillway crisis. >> reporter: it ignored structural problems and warnings, calling it a long- term systemic failure. after the 3,000 foot spillway failed in early february, things got a lot worse when operators switched to the emergency spillover. immediately that uncontrolled water started eroding the dam's face, causing a potential failure of the dam. the authors of the report held a teleconference saying dwr is hardly along among the agencies that inspect dams nationwide. >> look at its organization to improve many of those recommendations applied to other dam owners also. >> reporter: now, that's scary because of the enormity of the responsibilities listed on its own website. dwr protects, conserves, develops, and manages much of california's water supply, including the state water project, which provides water for 25 million residents, farms, and businesses. if the department of water resources failed in the operation, inspection, and regulation of its own dam described as a long-term systemic failure, how can we trust the inspection and regulation this very same agency exercises over its own vast other facilities as well as 1249 other dams within the state? this is the non-answer answer to that direct question i raised. >> i think, you know, that there -- the industry, we have noticed specifically it's systemic to dwr, the regulators, and the industry, and the vast majority of things that we are finding, things like oroville don't happen very often. >> reporter: he went on to say that the dwr seems to be doing the best it can and the public should trust it's being taken seriously. >> there is always the possibility that something escapes any program, even a good one. >> reporter: that, of course, is no comfort to millions living near state regulated dams or millions more depending on the water they provide, and you're paying for it. tom vicar, ktvu fox 2 news. >> the director of the department of water resources responded to the blistering criticism. they said we will carefully assess this report, share it with the entire dam safety community, and incorporating the lessons learned going forward. san jose police have arrested a man accused of sexually assaulting and robbing a middle school teacher inside her classroom. police say 23-year-old andrew racamonte broke into the campus early on tuesday morning before classes started. he is accused of cornering a teacher as she was getting her classroom ready after the holiday break. he sexually assaulted her inside the room and then stole her cell phone and wallet all while threatening to shoot her. >> i don't think any of us could imagine what that victim went through, and just to be able to cooperate with the police and give us a detailed segment of the horror that she must have felt is just, i don't know, i can't put it into words. >> hours after the attack, police say he committed another crime. he has an extensive criminal history and has a prior conviction that includes assault and sex with a minor. he is scheduled to be arraigned in court next week. 7:42. police and s.w.a.t. racing to an east bay home after reports of gunshots. why investigators now believe the event that negative 20. and commercial flights are starting to recover after hundreds of cancellations and delays yesterday. you are looking at the flightaware misery map, which shows many flights facing delays and cancellation -- and cancellations today. so if you are flying over the next few days, make sure to check with your airline so you can be aware of cancellations or delays. and the brutal cold has reached all the way to usually warm florida. off the coast of florida, manatees are having to crowd together in the water just to stay warm. the giant sea mammals are huddling in the water off of sarasota. they are clearly not used to these cold temperatures. there were freeze warnings last night in florida as far south as daytona beach. and hundreds of cold and stunned turtles are being found along the coast of florida and texas. the turtles are getting so cold, they float to the surface and become immobilized. it happens when they are exposed to water lower than 50 degrees. some may need to have special care and antibiotics. there are teams from the national parks service and fish and game who are rescuing turtles. they have so far rescued over 1,000 turtles. clearly, not used to the cold temperatures in the water. poor turtles. 7:47. you know, the rain is good to see. also good to see a break. that picture of san francisco. >> it's beautiful. >> yeah, right? >> it takes my breath away. >> yeah, just looking down at the clouds. it looks like a fairy tale land. yeah. so the storm clouds moving out. we are looking down above some patchy fog. so if you are in that fog bank, you about the very cold temperatures. we have been talking about this it seems like for the past two to three weeks. the cold temperatures, it is 9 below in minneapolis, st. paul. zero towards buffalo. atlanta 27 degrees. you can see all of the storm reports over the past day or so. so that storm system is moving out to the north. look at all these reports of snow and the freezing temperatures. so widespread, of course, it's a major deal towards the northeast especially. for us here in the bay area, we have been tracking the clouds. some scattered rain showers out there, as well. but those clouds starting to move out of town throughout the day today. we will check in on some current numbers. the cool spot santa rosa at 39 degrees. san francisco 51. san jose 534. livermore in the upper 40s. as we expand the view out here in the pacific, look what's happening. so here is a system that kind of slowly is moving across california the past couple of days. here is hawaii. look at this moisture stream setting up. this will be the next storm heading towards monday. the latest forecast models trending wet we are this guy. so as a result we could be talking about rainfall easily 1.5 to 3 inches towards monday. here is the live camera. beautiful looking towards the richmond san rafael bridge and sunshine breaking through the high clouds. we are getting a break this weekend. as we showed you, we have some more developments offshore. today we have the clouds this morning becoming partly cloudy and then we will thicken up the clouds probably after 1 or 2:00 on sunday. those clouds in advance of this system here and the main dynamics, the strength of the system still organizing. we will be watching out for this heading towards monday. both commutes, the morning and afternoon/evening commute, will be impacted by the system. here is the forecast model later today. not too bad with partly cloudy skies. tomorrow we thicken up the clouds in the afternoon hours. still dry though. look what happens. this is monday morning 7:00. the commute will be a rough one, and then throughout the day that moisture continues to stream into the bay area. later in the afternoon rainfall. so this is monday 8 p.m. these numbers will change quite a bit. it's hard to pinpoint how much rainfall exactly we will get for each location. the wettest locations could be approaching or think it's going to be coming too much at one point. that will be the case on monday. heavy rain, some wind, and then on tuesday some lingering showers primarily for the morning hours. so if you have hawaii and in this flow you can see a lot of moisture and energy is developing that will be pulling in toward the bay area. not today or tomorrow but it will be monday. first thing monday morning pick outside right now we are tracking clouds to start the weekend. that's what we have in the forecast for this morning. partly cloudy this afternoon. around 63 degrees. i mild pattern. temperatures have been on the warm side with this weather pattern setting up. the next developing headline will be as we head into monday with the possibility of a flash flood watch. increasing rainfall rates. we will talk about the system more as we head into next week and possibly beyond. seven retail stores in san francisco will begin selling recreational marijuana for the first time ever pick >> legal recreational pot sales first were allowed in california back on monday, new year's day, but san francisco failed to get all the proper permits in place in time for the new year. this morning leigh martinez -- christien kafton is live at one of the seven locations in san francisco where legal pot sales are getting underway this morning. >> reporter: we are here inside the apothecary. one of the locations that will have recreational sales. the doors open at 9 am. if you look around you can see this is a big shop. there's a lot to see. they are expecting a big crowd today. medical cannabis customers were here yesterday getting their orders in hoping to beat the rush. recreational pot sales and other cities including oakland and san francisco launched january 1 but san francisco lagged behind in his permitting process. right now there are seven locations in the city but more in the pipeline. this store said he received late notice and are gearing up today for big crowds. >> we got our permit from the state at 5 pm last night right before the office closed. we have been rushing to get everything ready for our first recreational customers this morning. >> reporter: san francisco has a host of regulations. among those mandates, san francisco has good neighbor policies in place. security plans must also be in place and equity plans were cannabis businesses will have to demonstrate how they are providing opportunities to underrepresented communities. we are expecting a press event to start here at 8:15 am. we are also expecting san francisco politicians to be on the scene as well. we are hoping to hear more from them for our next report. and undocumented uc berkeley student is being held at a detention center near the border. 20-year-old luis mora was visiting his girlfriend in san diego for the holidays. they were returning from a party when they took a wrong turn and ended up at a border checkpoint. the guards took them into custody when they determined he is in the usa illegally because his visa has expired. his attorney hopes bill will soon be set so he can be released by the time classes start later this month. >> there is no reason to be detaining him. he's not a criminal. he's not a flight risk. is costing you and me $200 a night to house him there but instead he could be out and be at school and being productive. >> a spokeswoman for immigration and customs enforcement issued a response saying he was taken into custody after border patrol agents determined he violet the terms and conditions of a temporary visa and. he had been issued for a temporary amount of time of six months. >> classmates have launched a campaign enlisting local mike -- lawmakers on his behalf. emeryville police are investigating and armed robbery that happened at a subway restaurant. investigator say someone pulled a gun and demanded money at the subway shop on crissey avenue. the robber left the restaurant and drove off in a small red car. police are going over surveillance video from the shop trying to identify the person behind this robbery. north bay lawmakers say there are lessons to be learned from octobers wine country fires. residents complained they got little to no warning about the fire and evacuations. lawmakers have now drafted a bill that creates a statewide notification protocol. it requires county to establish local guidelines for implementing a federal alert system. the notifications would go out through the text and calls to land lines. sirens and media outlets as well. three former santa clara county jail guards have been sentenced to 15 years to life in prison for beating a mentally ill inmate to death.matthew farris, rafael rodriguez and jereh lubrin were convicted of second-degree murder for killing michael tyree in 2015. yesterday the judge gave them all a maximum sentence. during the trial witnesses described hearing tyree scream for help as those guards beat him to death. he was found dead in his cell. tyree was in jail waiting to be sent to a residential mental health treatment facility. >> i think it was fair. a man was murdered at the hands of these three and i think that they are held accountable for their actions. >> this case led to changes inside the santa clara county jail. there is a new use of force policy in place and new training for correctional officers. there are also more cameras up inside the jail and officers also have body worn cameras. a family in hercules is warning people about a dangerous prank known as, swatting. it's when someone makes a hoax 911 call that requires a police swat team to respond. two days after christmas, someone made a fake calling the police the address of a family in hercules. police from hercules responded with their guns drawn. a mother, father in two young children and the grandparents were home and they had no idea what was going on. police handcuffed the father and grandfather while they searched the home but let them go when they did not find anything. the family says they are still traumatized -- traumatized and as we not show their face. >> i had guns pointed at my face. my son had guns pointed at his face. we are walking slowly and the police apprehended us. i'm asking, what's going on? >> it does look like it was a prank at this point. and meets the criteria of some of the other swatting incidents that have been out there. >> the family said police did not identify themselves initially which led to more fear. police say they did identify themselves. the day after that hercules case, police in wichita, kansas, shot and killed an innocent man at his home he was also the victim of a swatting call. u.s. attorney general jeff sessions is targeting states that have legalized recreational marijuana. we big changes. president trump is meeting with republicans at camp david this morning. the white house says they will discuss priorities for the 2018 year including the budget, infrastructure, immigration and welfare reform. one hot topic will be whether to extend protections to so- called dreamers, children who were brought here as undocumented immigrants. this was posted on twitter -- many daca recipients were young children when they were brought he. some before they could walk or talk. it's up to congress to now pass the dream act now and ensure they can live in the only country they have known. she goes on to say using children who grew up in this country as a bargaining chip to pay for an unrealistic boarder wall is shameful. >> we're getting new details on the trump administration's boarder wall plan. the associated press says the proposal calls for spending $18 billion over the next 10 years. all that money would pay for more than 300 miles of new barriers and 400 miles of replacement fencing but would also be used to pay for towers, surveillance, roads and staffing. the author of the best- selling controversial book about president trump is making new and explosive comments today. michael wolff, author of the book fire and fury, appeared on bbc radio and he said one of the interesting effects of the book is that it shows president trump is unfit for the oval office and could eventually and his presidency. the book features reported quotes from the current and former trip advisor such as steve bannon, who allegedly called donald trump junior's meeting with a russian lawyer treasonous. the author went on television on friday and rejected white house claims that his book is full of lies. >> rec credibility is being questioned by a man who has less credibility than perhaps anyone who has ever walked on earth at this point. >> you never interviewed the president about the book. he berated -- he begged to speak to the president and was denied access. >> in a tweet last night the president slammed the author and said his book boring and untruthful. the courts may ultimately decide the battle over offshore drilling in the u.s. the trump administration has proposed opening up as much as 90% of the coast to oil and gas exploration. environmentalists are vowing to fight in a drilling proposals. governor brown is among a group of west coast governors accusing the president of ignoring climate change and the risk to wildlife. energy corporations and representatives say drilling will create jobs and energy independence. >> we have currently 94% of our offshore resources off-limits and this is an opportunity to open up more of those areas to supply growing demand. >> offshore drilling is inherently dirty. it's inevitable there will be a and oil spill. >> the threat of lawsuits is one reason major energy companies may still be reluctant to change their long- term drilling plans. they are also worried a future democratic ordinary system that passes through. it will actually send a lot of moisture our way for a long period of time as we head into monday. they could cause problems, especially for the fire burn zones. it will be the first challenge as we track that system. here is our live camera looking toward san jose. partly cloudy skies. a little bit of haze but what has been nice with the system moving through, it's been cleaning up the atmosphere. air-quality is improving. on the satellite and radar you see the rainfall over the past 18 hours in the rain and snow mixed toward the sierra. as we come in closer we have partly cloudy skies and pockets of form have -- falconer form. santa rosa and not but reporting visibility down to a quarter mile. san francisco, 52. san jose, 53. looking toward the sierra, some coverage with a little bit of rain and snow. current numbers in the 30s and 40s. 37 in truckee. south lake tahoe, 40. here is a look at the snow report. these mostly have been in higher elevations across the sierra, mainly above 7000 feet. still, that will be the theme as we head toward next week as well, the monday system is another warm one. you can see the snapshot in the pacific. the development is right here. rainfall expectations are easily an inch and a half to three inches. the cost of health may pick up more. the wind will be an issue as well and we talked about the sierra with the rain and the snow. snow levels on monday will be above 7000 feet. looking at the forecast models we take this into monday. there's not much happening until sunday night. look what happens monday morning and tuesday morning as well. these numbers are really adding up. this will be intense rainfall that could lead to the possibility of an urban and small stream flood advisory and possibly a flash flood watch as we head toward the burn zones of the north bay. you can see a lot happening in the pacific. at least get a break this weekend and the rainfall amounts over the past two days have not been extreme. today we have clouds. tomorrow we thicken the clouds through the afternoon and the strongest from developing about here will be pointing toward the bay area. as we take this into the afternoon. partly cloudy skies. on sunday, we increase cloud cover throughout the day and look what happens monday morning. here is the monday morning commute at 7:00. throughout the day, periods of heavy rain throughout the day. monday night, still tracking rainfall. some rainfall is still possible into tuesday morning, especially for the tuesday morning commute. highs today in the upper 50s and 60s. half moon bay, 59. san mateo, 60. your five day forecast. we get a break this weekend but there we go with the rain into monday and could linger into tuesday. fully we get a break later in the day on tuesday and into wednesday and we will need it based on what the forecast models are suggesting. they have been trending wetter and stronger with the system. this will be the first test of the fire burn zones as the system comes on board. i was reading what the national weather service was saying. they are looking at rainfall rates -- if they can pick up about 2/10 of an inch in 15 minutes, that could lead to serious problems. we will be watching those thresholds. >> and does general -- does january and general look what? >> that does. monday will be a challenge. after that we have a do days to dry out and then we're watching out beyond that. it may be too much. i know we need the rain. but we want it spread out. there were two big lottery drawings that happened this week and. coming up we will have more on last night mega millions draw and that made someone an instant millionaire along the peninsula. and we will also talk about tonight's powerball drawing as well. more uber and lyft drivers on the road could be a good thing for traffic. details of a new study that finds ridesharing could be reducing congestion in san francisco. today, if you ever wanted to work in the public sector, today is your chance. san francisco is hosting the first of three city job fairs. agencies hiring include the recreation and parks department, the fire department and the sheriff's department as well as sfo and the u.s. postal service. jobs range from recreation leaders to mail carriers and automotive technicians. today's event runs from 10 am until 1 pm at the joseph lee recreational center on mindel street and there two more job fairs later this month. a new study finds ridesharing companies are actually helping to reduce traffic on the roadways. the research group rmi finds that ridesharing companies move passengers 20% more efficiently through the streets of san francisco compared to personal cars. researchers believe that's because many cars are carrying multiple passengers meaning fewer cars on the roads. that's even after cackling the cars driving without passengers. the impact of ridesharing companies like uber and lyft on traffic has been a hot topic, especially here in the bay area. tech experts say more people will be going wireless in 2018. that includes everything from how you watch tv to the electronics in streaming. verizon is also testing 5g wireless internet and promises blazing fast one gigabit speeds, faster than even most wired connections. and if you were cutting your cable courtier not alone.
