Without a deal in place, he allegedly tried to run to San Francisco and avoid capture which didnt work either. Surrendering when we are about to arrest you doesnt really make us change the manner in what we are doing. The suspect did not give the victim a choice, we certainly were not going to allow this suspect to dictate how we were going to take him into custody. Chief eddie garcia says without a surrender deal in place, it is headed to San Francisco where he cut his hair in an attempt to avoid capture. The San FranciscoPolice Department made the arrest last night. Investigators say this is the same man seen here seen here in a surveillance video. Tuesday morning he broke onto the campus, prowled the hallways and cornered a teacher as she prepared the classroom following the holiday break. Investigators say he sexually assaulted the victim, robbed her and told her she would shoot her he would shoot her if she left the classroom. They openly provided details to a team of 50 officers investigating the case. I dont think any of us can imagine what the victim went through to be able to cooperate with police and give us a detailed segment of the horror that she must have felt, i cant even put it into words. School staff declined to talk on camera but in a statement, the head of schools says hes grateful for the work of the Police Department adding that this was a senseless, heartbreaking crime and our entire community is grieving. We are relieved that the criminal has been arrested and hopeful that justice has been served. After he ran from the school they moved to a santa clara liquor store and in fact, he has a long criminal history which we will talk more about an charges he faces when we join you again. We are live outside of the main santa clara jail. Jesse gary, ktvu in San Francisco a judge sentenced Garcia Zarate in the death of kate steinle. He was sentenced for three years in jail for being a felon in possession of a firearm. The immigrant the undocumented immigrant was acquitted for the murder and he will not serve any more jail time but will be taken into federal custody to face a new weapons charge. They called the charge retaliatory. Theres going to be a motion made right at the beginning for dismissal predicated on vindictive prosecution prosecution which is disallowed under federal and state law. His Attorney Says us marshals are expected to pick up us Garcia Zarate and taken to federal jail which is in oakland. He is set to be arraigned on federal charges monday or tuesday next week. 3 for former sent a query santa clara guards were sentence for the death of an inmate in the custody and we are joined live with more on that story. The judge began by saying he thought it was inappropriate to grant probation which had been one possibility. Instead he handed down the maximum sentence. Three former jail guards have been sentenced 15 years to life in state prison. It was the harshest that the judge could have imposed. The men were convicted of beating a mentally ill inmate to death inside the client a Santa Clara County jail. Michael tyree was found bruised and bloodied on the floor of his cell in 2015. This is not a happy day for law enforcement. Far from it. Because these three guards, whose job it was to oversee the correctional system, will now be imprisoned within it. However, it is a just day. Sheriff lori smith who oversees the jail agrees. I think it was fair. A man was murdered at the hands of these three, and i think they are held accountable for their actions. They sobbed openly and many had written letters to the judge asking for leniency but a letter from Michael Tyree s sister was the only one read out loud. She spoke about the life sentence she received with the news of his death and how the guards were accountable for that. Two years ago when these guards broke Michael Tyree s body, they also broke the trust of the public. We have to work every day to rebuild and earn the trust that the public gives us. The department has been working hard to make reforms at the jail. Theres a new use of force policy and training and there are additional cameras both at the jail and body worn on the correctional officers. The message is clear, we know what a crime is and what we are not supposed to do, so i dont think this was at all representative of the five men and women who work here. Reporter the guards will likely be held in some sort of protective custody not in the general prison population and will eventually be eligible for parole. Frank . Live in the south bay, thank you. Police standoff in the outer sunset neighborhood came to an end earlier after more than 8 hours. We spoke to the mother of the suspect and are told about the relatively peaceful resolution. Police say they received a 911 phone call late last night around 11 oclock near 29th avenue. The 911 color was saying another man was acting in a threatening manner. Officers showed up and said they had encountered a man whom they have encountered before who then barricaded himself inside of a home. Crisis intervention teams turned out. Officers surrounded the home and opted to wait him out. About 7 30, we did make contact with him and the subject did attempt to assault one of the negotiators, therefore a device was used and he was taken into custody without further incident. We talked with the mans mother and she believes that methamphetamine is at the root of last nights problems and saying her son has been struggling with addiction issues for years. The bay area got rocked by a 4. 4 earthquake yesterday morning. For most it was a shocking wake up call but for a handful of uc berkeley workers, thanks to a new application called quakealert, it gave them advance notice. A useful tool that could save lives in the years to come. And the application is free. It was developed by a Santa Monica Company and one of their developers joins us now with more. Josh . How are you . Doing well, thank you for having me. This is not available to the public yet but apparently at work a quick centered in berkeley, tell us about quakealert. We had a bunch of beta testers up north and down here in los angeles. The mobile application that we built roughly 3 years ago in partnership with usgs, Us Geological survey, and the goal of the application was to create a free way to deliver these Early Warnings out to individuals not just in california but the whole west coast. The quick worked but those close to the epicenter only got two or three seconds of leadtime which may not seem like a lot, but its a pretty big deal, isnt it . Tell us why. It is. To slowly stop the train, we can do that in 10 12 2 but to drop cover and hold on, you can do that within those seconds. Luckily when we have larger earthquakes people are going to be feeling it much farther from the epicenter than they do in a smaller earthquake like this meeting we will be able to get a tremendous amount of warning time for those that are not necessarily just on top of the earthquake. We are really excited about that and the amount of good that we can do. Getting a visual notification so they can drop cover and hold on. The science says we can prevent roughly half the injuries with those types of alerts. That a significant. How far are you from having that application on every phone in california . There are still some challenges that we have to overcome as far as limits to be able to push out those notifications, but this year we will be ramping up tremendously to test that and see how many users we can get on. Im the meteorologist here, this is fascinating. During the quake here in San Francisco i was working at a tv station in the city and on the phone with someone in santa cruz. We had the earthquake, he felt that a couple of seconds later. Is that the technology we are using here . Not phone technology but the idea that quick happens, it takes a while for the waves to move through the earth. Is that what you are doing . Saying we had an earthquake now, hey santa rosa in five seconds you will feel something . Is that the same idea . The same concept. Usgs has a large number of sensors across the west coast and of course up in Northern California and they are listening for earthquakes 24 seven. They detect the p wave and what we are doing is outrunning the earthquake. They detect the wave, calculate when is the damaging wave going to arrive for individual users . Which is when we take over and do the math and say you are asked distance away, you have this amount of time until this level of shaking hits you. Epicenter folks or folks on the fault will not have, obviously, well for people in the outlying areas for that quick moves, it was amazing saying we are having an earthquake and hes like, 60 miles to the south saying yeah we just felt that. Josh, didnt you say you had people in sacramento that had the same application and almost 30 seconds prior notice right . We had a couple of users up north and some people who are testers of the mobile application. We saw some alerts went out to them that notified them of shaking that they would feel and people in the berkeley area as well. Japan and mexico have extensive warning systems. Why is the us so far behind in this game . Its a tricky question to answer. Weve been working on this project, and i say we, the brilliant scientist at berkeley, caltech, universities of washington and oregon, some of us have been working for more than 30 years. Ultimately i think it comes down to funding on both federal and state level, to make sure they have the funding that they need to have the right amount of sensors. Right now in california we are at a good density level but we can always have more. They are pushing to put more and what is key about that is that we can shrink the blinds own for the the blind zone for areas that will be able to get a few seconds more now. The latest job growth has showed enough that the economy is entering new year with solid momentum. 148,000 jobs were added last month which is well below what some economists had forecasted.
