witnesses.>> reporter: the early report tell us that the bart police officer discharge his weapon while responding to an argument across the street. at 4:41 pm a call came in for shots fired. police are talking to witnesses and pouring over surveillance video as they try to determine how it unfolded. the chaos played out at 4:41 pm wednesday night stubs from the bart station. a police officer in full uniform responded to gunfire and discharged his weapon. two men were left injured. one dead and another in serious condition. it is not clear who fired the fatal shot..>> this area directly over my shoulder. at seventh and chester there was an officer involved shooting.>> reporter: the bart officer was at the location where a witness said two men were exchanging words.>> it was an argument between two guys. it turned into a shooting.>> reporter: where did it start? >> right here by the barbershop.>> reporter: the argument quickly escalated.>> one of them shot my friend in the lake and the police shot and killed him. the guy that shot my friend in the leg. i guess they heard the dispute. they came running across the street shooting.>> we have recovered a firearm from the scene. there are a lot of questions from the community. we want to answer those questions. as we go through the investigation we are able to provide more information we will share that.>> reporter: because it's a place on city streets oakland police are handling the criminal investigation. bart police are conducting their own investigation and the alameda county district court. district attorney has been notified. the name of the victim and the other injured man has not been released. police just wrapped up the investigation moments ago. they spent the evening looking at surveillance video. in talking to witnesses as they tried to figure out how it unfolded and who is responsible. 4:40 pm the afternoon commute is just getting underway. that one woman seemed pretty calm. gunfire on the streets next to a busy bart station -- were people concerned?>> reporter: we talked to lakisha about that. the witness said seeing someone shot is nothing new to her. what was interesting however was that this bart station was still functional and people were coming and going as if nothing happened.>> reporter: after a dry december the rain has made its return. and alameda light rain caused people to take out umbrellas to stay dry. drivers could be seen using their wipers and headlights. >> and fremont the rain was coming down harder. not many people were out and about. the first in a series of incoming storms expected to hit the bay area over the next week.>> a live look at our toll camera you can see the rain coming down in the rain filling up the camera.>> live team coverage. deborah is some showers heading into thursday. the action ramped up late this afternoon and the evening. the rainfall totals the past 24 hours then lowman approaching one half inch of rainfall. oakland .38. san month later neighborhoods were still exposed just as the fire left him. tarps went down fast to stem erosion and pollution.. now properties are in various states of recovery. some cleared and some already for sale or sold. just over $200,000. the plans for this home are lost. the architect is mapping the foundation to re-create the footprint.>> 24 feet. that is what i needed to see.>> i wanted to get it measured. i thought tomorrow it might be raining too much to do it.>> reporter:>> we found this homeowner getting flowers planted before it rains. her lot will be cleared in the morning. she to get a jump because the foundation was not completely destroyed. they were able to get a permit. there are 17 permits granted so far. another dozen pending. the properties are in various states of trump junior and his son- in-law jared kushner calling their trump tower meeting with the russians during the campaign treasonous and unpatriotic. it it is a legend it was set up so the campaign could get dirt on hillary clinton. bannon said that the lease trump junior or kushner should've called the fbi immediately after that meeting took place. in response the president issued a statement that said in part steve bannon has nothing to do with me or my presidency. and he was fired he not only lost his job he lost his mind. later white house spokeswoman sarah sanders describe the president's reaction to bannon's comments as furious and disgusted.>> i would think going after the president son in an absolutely outrageous way is probably not the best way to curry favor with anybody.>> reporter: the book contains explosive details including allegations as a candidate trump did not want to be president and never thought he could when. it alleges trump was stunned when he one. he looked like he had seen a ghost and melania was crying and not tears of joy. the first lady's office responded with a statement of its own saying the book is clearly going to be sold in the bargain fiction section. mrs. trump supported her husband's decision to run for president. and in fact encouraged him to do so. she was confident he would when and was very happy when he did. the president lasted bannon for the loss of a senate seat in alabama to the democrats. and said he was only in it for himself. the president said bannon did not want to make america great again but was simply seeking to burn it all down. >> reporter: one other explosive detail from the book is his statement the russia investigation was center on money laundering and investigators would crack don junior like an a on national tv. a short time ago we learned the president's lawyers have since acs and deceased letter laming he has violated a nondisclosure agreement by talking to the author of this book. president trump formally disbanded his controversial voter fraud commission. the panel faced a barrage of lawsuits over privacy concerns. the commission sought personal data on voters across the inappropriate behavior. several female staffers come forward accusing los angeles and its her tony mendoza of sexual misconduct. one of them filed a complaint saying she and two others were fired committee of the assembly and senate to address sexual misconduct issues. top immigration officials said california that are hold on tight in the wake of new rules that make it a sanctuary state. surveillance video shows him wandering the grounds for two hours before the attack.>> it is the best piece of evidence we have. we are trying to identify this person. we are asking the public to call us with any tips they have. anybody they suspect looks like this person or walks like this person.>> reporter: the woman he sexually assaulted was a teacher came to prepare her classroom. school officials released a statement saying we are saddened and upset by the incident and are leaning in to provide support and privacy to our employee and each other. administrators are cooperating with authorities. they regularly review all safety protocols. until the perpetrator is caught parents say the presence is a comfort.>> we feel reassured. we feel they are doing everything they can. >> i have the greatest degree of confidence the school will make sure it the campus is a cure for the faculty and students.>> reporter: police say the video doesn't get a good shot of the suspects phase. hat.>> reporter: this man might have been wearing a santa hat christmas morning but he definitely wasn't in a christmas spirit. san francisco police release this video. it shows him in the upper part of the screen firing shots into a black car on the 100 block of eddy street in the tenderloin before 8 am.>> we see a suspect firing into a vehicle. circumstances surrounding that could be a variety of things. that is something we hope the public can come forward with information.>> reporter: police have not received any reports of injuries connected to the shooting. that doesn't mean there were not any.>> sometimes we don't know what the victim circumstances were. are they afraid to come forward? we don't really know.>> reporter: this man it lives across the street.>> i heard arguing before witnesses.>> reporter: the early report tell us that the bart police officer discharge his weapon while responding to an argument across the street. at 4:41 pm a call came in for shots fired. police are talking to witnesses and pouring over surveillance video as they try to determine how it unfolded. the chaos played out at 4:41 pm wednesday night stubs from the bart station. a police officer in full uniform responded to gunfire and discharged his weapon. two men were left injured. one dead and another in serious condition. it is not clear who fired the fatal shot..>> this area directly over my shoulder. at seventh and chester there was an officer involved shooting.>> reporter: the bart officer was at the location where a witness said two men were exchanging words.>> it was an argument between two guys. it turned into a shooting.>> reporter: where did it start? >> right here by the barbershop.>> reporter: the argument quickly escalated.>> one of them shot my friend in the lake and the police shot and killed him. the guy that shot my friend in the leg. i guess they heard the dispute. they came running across the street shooting.>> we have recovered a firearm from the scene. there are a lot of questions from the community. we want to answer those questions. as we go through the investigation we are able to provide more information we will share that.>> reporter: because it's a place on city streets oakland police are handling the criminal investigation. bart police are conducting their own investigation and the alameda county district court. district attorney has been notified. the name of the victim and the other injured man has not been released. police just wrapped up the investigation moments ago. they spent the evening looking at surveillance video. in talking to witnesses as they tried to figure out how it unfolded and who is responsible. 4:40 pm the afternoon commute is just getting underway. that one woman seemed pretty calm. gunfire on the streets next to a busy bart station -- were people concerned?>> reporter: we talked to lakisha about that. the witness said seeing someone shot is nothing new to her. what was interesting however was that this bart station was still functional and people were coming and going as if nothing happened.>> reporter: after a dry december the rain has made its return. and alameda light rain caused people to take out umbrellas to stay dry. drivers could be seen using their wipers and headlights. >> and fremont the rain was coming down harder. not many people were out and about. the first in a series of incoming storms expected to hit the bay area over the next week.>> a live look at our toll camera you can see the rain coming down in the rain filling up the camera.>> live team coverage. deborah is in the fire zone with concerns prompted by the rain.>> a look at conditions right now and how much more rain we are expecting.>> reporter: things will start to decrease in activity the next few hours. some showers heading into thursday. the action ramped up late this afternoon and the evening. the rainfall totals the past 24 hours then lowman approaching one half inch of rainfall. oakland .38. san trump junior and his son- in-law jared kushner calling their trump tower meeting with the russians during the campaign treasonous and unpatriotic. it it is a legend it was set up so the campaign could get dirt on hillary clinton. bannon said that the lease trump junior or kushner should've called the fbi immediately after that meeting took place. in response the president issued a statement that said in part steve bannon has nothing to do with me or my presidency. and he was fired he not only lost his job he lost his mind. later white house spokeswoman sarah sanders describe the president's reaction to bannon's comments as furious and disgusted.>> i would think going after the president son in an absolutely outrageous way is probably not the best way to curry favor with anybody.>> reporter: the book contains explosive details including allegations as a candidate trump did not want to be president and never thought he could when. it alleges trump was stunned when he one. he looked like he had seen a ghost and melania was crying and not tears of joy. the first lady's office responded with a statement of its own saying the book is clearly going to be sold in the bargain fiction section. mrs. trump supported her husband's decision to run for president. and in fact encouraged him to do so. she was confident he would when and was very happy when he did. the president lasted bannon for the loss of a senate seat in alabama to the democrats. and said he was only in it for himself. the president said bannon did not want to make america great again but was simply seeking to burn it all down. >> reporter: one other explosive detail from the book is his statement the russia investigation was center on money laundering and investigators would crack don junior like an a on national tv. a short time ago we learned the president's lawyers have since acs and deceased letter laming he has violated a nondisclosure agreement by talking to the author of this book. president trump formally disbanded his controversial voter fraud commission. the panel faced a barrage of lawsuits over privacy concerns. the commission sought personal data on voters across the country. trump informed the commission last year after alleging he lost the popular vote to hillary clinton because of millions of illegally cast ballots. he did not acknowledge the panel's inability to find evidence of fraud. vista trump said his decision came in response to a growing number of legal hurdles. state senator has agreed to take a leave of absence during an investigation into inappropriate behavior. several female staffers come forward accusing los angeles and its her tony mendoza of sexual misconduct. one of them filed a complaint saying she and two others were fired reporting behavior. his leave is with pay. the senate has hired lawyers to look into the claims.>> i think he needs to leave. it would be best if he did it on his own. if that is not going to happen we will have to take action.>> everyone needs to be in a safe environment. >> two democratic lawmakers have already step down over claims of inappropriate behavior. state lawmakers have formed a joint committee of the assembly and senate to address sexual misconduct issues. top immigration officials said california that are hold on tight in the wake of new rules that make it a sanctuary state. acting eyes director is making no attempt to hide his anger at california's new laws. and that governor jerry brown for not supporting the work of federal immigration authorities. as a result he said surveillance video shows him wandering the grounds for two hours before the attack.>> it is the best piece of evidence we have. we are trying to identify this person. we are asking the public to call us with any tips they have. anybody they suspect looks like this person or walks like this person.>> reporter: the woman he sexually assaulted was a teacher came to prepare her classroom. school officials released a statement saying we are saddened and upset by the incident and are leaning in to provide support and privacy to our employee and each other. administrators are cooperating with authorities. they regularly review all safety protocols. until the perpetrator is caught parents say the presence is a comfort.>> we feel reassured. we feel they are doing everything they can. >> i have the greatest degree of confidence the school will make sure it the campus is a cure for the faculty and students.>> reporter: police say the video doesn't get a good shot of the suspects phase. of the screen firing shots into a black car on the 100 block of eddy street in the tenderloin before 8 am.>> we see a suspect firing into a vehicle. circumstances surrounding that could be a variety of things. that is something we hope the public can come forward with information.>> reporter: police have not received any reports of injuries connected to the shooting. that doesn't mean there were
