police say a robbery suspect shot by a security guard inside a walgreen's store last night has now died. authorities have not yet released his name. they say officers were called to the store on south first street at santa clara street after the guard opened fire at about 8:30 last night. when they arrived, they found the man on the floor with life- threatening injuries. again, he died later at the hospital. police say the security guard is cooperating with the investigation. >> new details on the republican tax plan. house voted today and approved the massive rewrite of the u.s. tax code, but then discovered a procedural snag setting the stage for a revote tomorrow. the republican tax bill is still expected to pass with majorities in the house and senate and then should be sent to the president's desk before christmas. earlier today, there was celebration on one side of the aisle when the house passed the legislation. >> the yays are 227 and the neys are 223. the conference report is a-- nays are 223. the conference report is -- >> there was word that the version parsed by the house contained three things that violated senate rules. they must be approved by both the house and senate. the $1.5 trillion tax bill brings down the corporate tax rate from 35 to 21%. the top tier of individual taxpayers would see a decrease from 39.6% to 37%. the corporate tax breaks are permanent, the individual cuts expire in 2025. republicans argue the cuts to corporate america will spur economic activity and job growth. >> for all those millions of men and women in america who are living paycheck to paycheck struggling to get ahead, help is on the way. >> a vote in the senate could come as soon as tonight. ktvu christina rendon joins us with more. >> the gop tax bill had the support of a dozen california republicans in the house, but democrats, especially those representing the bay area, voted no to the plan. they say it will hurt taxpayers. >> hours before the house vote, house minority leader nancy pelosi was joined by critics of the gop tax bill. >> this is the worst bill to ever come to the floor of the house with stiff competition from some of the things they tried to do. the worst bill in history. >> the fight continued on the floor. >> nearly two million californians stand to lose their state and local deductions if republicans succeed. this is truly a slap in the face to the american people. >> bay area democrats say the bill unfairly harms californians by limiting the deduction for state and local taxes to $10,000 and they say more than 80% of tax breaks will go to the top 1%. >> we are giving the wealthiest in this country the money and taking it from the poorest. >> republicans dispute it will be a windfall for the rich and cheered as the bill passed the house. >> this is a tax break for those who pay taxes. there are other forms of relief for those who pay no taxes at all. >> former chair of the california republican party says the middle class will get 23% of tax cuts and believes it will lead to economic growth. >> what you are going to find is a burst of economic activity next year. tax revenues are actually going to rise because the economy is expanding and it will do so much. revenues will run so high compared to estimates that i think in 2019 you'll get another round of tax reform this time concentrating on the personal side. >> he says it's not that unusual for the house bill to need a second vote. whether that happens tonight or tomorrow, but particularly when it's a significant bill. pelosi tweeted she is not surprised the house will have to vote again saying the bill is badly written. julie, frank? >> thank you. some housing experts say the provision in the tax plan to limit deductions on mortgage interest could lead to a decline in property values in california. it could also lead to less turnovers. people with lower property tax rates decide not to sell their homes and others might choose not to refinance. according to the national association of realtors, home prices in california could potentially fall by an average of more than 10%. another provision in the tax plan would eliminate the deduction for uninsured losses in fires, floods and other natural disasters unless there is a federal disaster declaration. that could be bad news for people living in high risk areas. victims of the wine country wildfires should be able to deduct their uninsured losses for 2017 since a federal disaster was declared. >> joining us now onset is james taylor, professor of politics at the university of san francisco. james, thank you for being here. democrats are calling this a scam that benefits the wealthy. house speaker paul ryan said today that families of every income level will get a tax cut and gave an example a family of four making median income will see a tax cut of $2,000. what will families really see? >> i think it will be short term. every will see a decrease over the next few years, but it all goes up and everyone will start to see the effects. you've done a great job outlining of fiscal impacts of the policy impacts. the politics of this though i think are not in the republicans favor. >> what do you mean by that? >> i think this is finally a piece of legislation they've accomplished. they are celebrating. now they own it and now the democrats have an intangible piece of legislation to run against just like the tea party did against barack obama did. the democrats should form a response to use it as a campaign issue -- >> in fairps, james, this -- fairness, james, this tax plan could work out well. in that case, it would hurt the democrats. >> down the line. by the time we can feel the full effects, i think the impact in people's purses even though it kicks in january 1, 2018, i don't think we'll feel the effects for the next few years. i think it may buy the president and republicans time in the midterm, but the long term policies are bad and then paul ryan doubled down and said he's coming after entitlements, social security and social safety net and those things combined in a normal political cycle in american politics would be the third rail we used to call it. in the trump era of american politics, everything is in transition. >> just explain quickly before we go, what happens in the next several hours? we see there was a snag. it goes -- >> yeah, they'll have to reconcile it through reconciliation process. they'll flip it out and have to reconcile it with the senate bill and that comes -- that goes through a reconciliation process and goes to donald trump's desk. donald trump has to stein -- sign it. if anything goes wrong, it might be the pressure to people reacting to what this think is a negative bill because it's very unpopular. >> this bill also eliminates the health care mandate and that could be -- >> yeah, 13 million americans. many people are the very people that were supportive of donald trump. $75,000 household will be devastated in the long run. this is a political issue i think for the democrats to actually now campaign on. we'll see if it can hurt the republicans or donald trump in the long run. schools. about a third of campus libraries are closed. 2 investigates looks into the problem depriving students of the basic school resource. i would say loft -- >> i would say most schools do not have a functioning, open library as you saw here. majority of schools do not. live look at the evening commute. the university overpass is at the top of the screen. heavy as it always is at this hour access to text, your just come is not going to change for schools. >> 1/3 of the school libraries closed. are you ok with that? >> no,. >> kovalev schools have the -- california schools have the worst librarian to students in the country, but oakland has it worst. >> they say the money isn't there even for this most basic educational resource. canned -- candice winn took a look. >> they got money from measure g approved by taxpayers to help maintain school ply bryan anderson. with an -- libraries. with an alarming closure of librarians and layoff of the head librarian, we want to find out what happened and who is responsible. >> i was really confused about what this is. >> oakland students say it doesn't make sense. >> i'm confused. >> they have a library, but they can't check out books. they are not allowed to. books about the holocaust and slavery stay in bins, shelves are in disarray, pages are torn. >> the lie bryan harsin is one of the most -- libraries is one of the most essential parts of school because we go to check out books every day. there's no librarian there and we can't check out books. >> for many children, like edgar, lie bryan harsin are a safe place -- libraries are a safe place, the only place where words come alive. >> i started reading them and after that i fell in love with books. >> and without libraries -- >> i just stayed in my house playing games so then i never experienced books. >> california has the worst librarian to student ratio in the country. oakland public schools have it worse. at the high school level 80% of school libraries are closed. across the board, at least 30% of oakland unified school libraries are closed. >> i think that the number is way higher. i would say most schools do not have a functioning open library as you saw here. i would say the majority of schools do not. >> she's the principal at the academy. >> students are not going to read unless they have access to text. >> parents and volunteers keep some of the libraries afloat. others are not at the level even the district is proud of. >> this number here, 1/3 of the school lie libraries closed, -- libraries closed, are you ok with that? >> no. i don't think anybody in leadership or at sites would say they're satisfied with that number. >> a stack of contrast to the bay area other two largest school districts. at san jose unified, none of its school libraries are closed. in san francisco, also none. >> when 80% of your kids are not reading on grade level, and you don't have access to text, the outcome is not going to change for kids. kids have to read to get better at reading. >> it's the district ace priority to reopen -- district's priority to reopen. at a recent school board meeting, board members approved a $9 million budget cut and in doing so led off the head librarian. according to several librarians, that is the first time that position has been eliminated in decades. >> if we don't have her, i don't know what's going to happen. >> am i happy about it? not at all. the current state that we are in is as a result of just very difficult funding decisions. >> do you see that contradiction though saying that the goal is to reopen libraries, but the cuts are to the head of the library? >> i absolutely do, yeah. that's the challenge i face as a leader in this situation that i am sometimes forced into decisions that are very contradictory of what i intend and what i believe we should do. >> students are addressing the issue themselves. >> we are part of a club called student improvement. >> knowing they deserve better. >> in terms of how oakland unified got to this point, the districts says among other things for nearly a decade, they were giving individual schools money for libraries without tbiedlines for how to spend -- guidelines for how to spend it. they've changed that and now schools have to apply for the funding and give more information how you are going to spend it and go towards the direction of opening these libraries. >> if the libraries are closed, is the door just locked but all the books are still in there? >> it depends school to school. in a lot of places, the doors are open and there's books and you can't check them out. you can't check them out because there is no librarian. it is different definition of a functioning library, but a lot are not at the standards the schools want them to be at. >> that's a shame they're there and the kids can't have access to them. candice, thank you. ktvu.com we posted more on the story including an interactive map of the schools that have libraries and the once that don't. checking newer weather across country -- your weather across the country. strong storms moving through there and rain showing up in the portland area and showers soon to be in our area. let's take a look at the airports. i'll load them all up. pretty much everybody is green except for dallas. dallas has 30 to 60 minute delays. pretty much air travel today, next 12 hours, 24 hours, not too bad. this system moving onshore gives us a shot at showers as we head into late tonight. it's after midnight most likely and between midnight and 3:00 or 4:00 in the morning. that's it. it will move through pretty quickly. there might be a few sprinkles on the very early morning commute. some reports now of showers and sprinkles north of cloverdale. i've had reports all in this area up around important arena, few light sprinkles showing up there. it's a light event in terms of a winter storm. if this was october or november, this is kind of interesting. this is deep december and this isn't really much of anything. we could see a ten ot of an inch -- tenth of an inch to quarter inch of rain. with one of the dryest decembers we've even son record in san francisco for instance -- ever seen on record in san francisco for instance. it looks it's getting ready to rain and it is. as we go into the next 12 hours, showers back in the forecast. morning commute is fine. might be a little wet on the roadways. tomorrow afternoon, sunny, but not that warm. mostly in the temperatures in the upper 50s. >> the sierra snow that seemed to never stop falling last winter is more of a disappearing act this winter. the national weather service says the snow pack in the northern part of the sierra is only 29% of average for this time of year. no need to panic just yet. meteorologists say even last year at this time the snow pack was only 75% of normal. for skiers, there's also man- made snow so resorts like sugar bowl are open with a base of 10 inches. >> there's still enough to have a good time, so i recommend coming out. >> the first part of december can mean a lot of warm storms. typically, it's after the winter solstice when colder storms come and the snow pack starts to accumulate. the winter solstice is this thursday. investigators are looking into a string of suspicious fires in the east bay. >> they do know who is doing elderly woman. when firefighters arrived, the roof was engulfed in flames and soon after they say the roof collapsed. after the fire was out, firefighters found the victim's body, but her name still has not been released. fire investigators say the fire started in the back of the house, but there is still no word on a cause. investigators in antioch are looking into a string of suspicious fires all over the city. some residents expect homeless people may be to blame. >> this wall was the family wall of pictures. >> paula walked through the charred debris. flowers, vases, christmas arrangements all gone after a fire tore through her flower shop early monday morning. that's where the fires were? >> yep, there's all the pictures. it breaks my heart. >> someone started the fire in this dumpster which was originally up against the shop. she and her family have run the shop since the '40s. >> we thought it was the homeless because we have a big homeless problem in the area. now they are saying it could be an arsonist. >> she isn't the only one picking up the pieces. >> the homeless set our building on fire twice. >> down the street, this cremation company was forced to move because of fires in june and again in october. >> it's very frustrating. i've been told by members of the police department and fire department they know who is doing it, but it doesn't seem like much is being done. >> fire investigators say there is a lot being done. two homeless people have been arrested for fires along the railroad tracks. >> there's several fires in that area that we have made some arrests for. trying to tie all the fires together is kind of our next step is to see which fire is related to which suspect and then which ones are sort of one offs. >> he said investigators have reason to focus on the transient population. >> this dumpster by this church caught on fire. >> i think this time of year especially it's getting cold. i don't know if it was arson, but my suspicion is that we have homeless folks who are trying to keep warm. they are finding places of shelter and maybe lighting a candle. maybe portable heaters. i don't know. >> the cold weather setting in, francisco police officer who committed suicide during a traffic stop in richmond was under investigation in las vegas for lewd acts with a minor under the age of 14. officer antonio cacatian shot himself after pulled over at hilltop mall in richmond on a warrant stop. las vegas police say someone came forward last month alleging inappropriate contact from three years ago. a walgreen's security guard is said to be cooperating with police in san jose following a deadly shooting of a robbery suspect. officers were called to the store on south first street and santa clara street about 8:30 last night. when they arrived, they found a man on the floor with life- threatening injuries who later died at a hospital and has not yet been named. soon after the passing from the house came word from the senate that the plan contained three minor provisions that violated senate rules. they were removed and the senate could vote on the revised bill sometime tonight and there will be a revote in the house for tomorrow. the bill is expected to pass both houses and then reach the president's desk by christmas. you are watching ktvu fox 2 news at 6:30. crews in washington state have been work to go remove the dangling, mangled train cars. monday's derailment killed three people and injured more than 100 others. >> now ntsb investigators are looking into the train's speed at the time of the crash h they say it was going 50 miles per hour above the posted speed limit. fox news dan springer is in washington state tonight with the latest on all this. dan? >> hi, frank. ntsb investigators expected to be on the ground here in dupont, washington, for a week to 10 days. they retrieved the two black boxes from the train that crashed yesterday morning and determined quickly that train was going way too fast. crews removing the amtrak train which derailed monday morning here in washington state, the train falling off an overpass sending cars on to the highway below. a total of 13 coming off the tracks in the deadly crash. >> this is very careful, delicate operation. we've got weather in the area today, wind and rain. that can complicate these big moves with these cranes we're doing. >> the tragedy happened on the trains inaugural journey on a new by pass route. 85 passengers and crew on board at the time. federal officials say the eventdata recorder in the rear locomotive shows it was traveling at 80 miles per hour, 50 miles per hour over the speed limit at that location. >> once we get it removed from the scene, ntsb who is taken over as the primary for the investigation of this will be able to conduct an investigation to document everything that occurred in those cars. >> we still don't know exactly what caused the train to derail or why it was traveling so fast. we do know that positive train control technology which can automatically slow a speeding train was not in use on this part of the tracks. >> once we have more detailed determination on that, we can take steps to prevent things like this from happening in the future. >> back here on the scene, crews have been working around the clock to try to reopen all the southbound lanes of i-5 that have been closed down since yesterday morning. of the 14 cars that were on the tracks, 12 cars and two engines, 13 left the tracks and many of them went down an embankment over the tressel down on to the highway. crews have been working to remove all those cars and put them on flatbed trucks and get them out here. we still have a few to go, so this stretch of highway will be closed down for at least another couple of days. frank? >> it's hard to imagine, dan, the train was traveling more than 50 miles per hour above the speed limit there at that particular junction. do we know anything more about the three people that were killed? >> we do. we found out the names of two of them. one is still unknown, but the two that we now know their names, one was a county worker who worked in transportation. both of them belonged to a rider association. they were advocates for train travel. it's ironic and sad they wanted to be on this inaugural trip and live for moments like that and were killed on the inaugural journey. >> dan springer in washington state tonight. thank you. new at 6:30, an east bay congressman is calling for a congressional hearing into close calls at airports including the incident at sfo back in july. that's when an air canada pilot lined up wrong and almost landed on a busy taxiway instead of the runway. such incidents from atlanta to san francisco are being investigated now by federal authorities. congressman wants hearings. he's also working on an aviation bill that would determine the best way to save cockpit recordings following a near miss. right now the recordings are not saved so they can be made available to investigators. san franciscoens are going -- san franciscoians are going to be voting to vote on a replacement to fill out lee's term in office. more are expected to pull paperwork. paul chambers talked with three men today, all of whom are hoping to become san francisco's next mayor. >> with the unexpected death of ed lee, the mayoral race for the city of san francisco is heating up more than a year earlier than some expected. >> i'm not a career politician. i've never held office in my life. i'm only 24. >> i've been in politics for about a year and a half. i ran for district i supervisor. i got a good response at that point which was last year. >> i have a lost passion, -- lot of passion, energy and now expertise and experience in 20 years of public service that i want to put toward the betterment of san francisco. >> of that bench, mark little has the most expertise a former supervisor, assemblyman and state senator. he and other three men who put the paperwork in to run for mayor in the special election have many issues they want to tack. >> first and foremost, those living on our streets unhoused and all the many reasons that have led them to lose their home. >> i'm going to house as many people by the end of my term because that's a huge priority for me homelessness issues and housing. >> it's appalling to be spending more money on homeless than on the children and the future and quality education. >> these aren't the only ones who filed paper. amy farrah weiss and breanna varner are running for office. we were unable to contact them. angelina alioto has thrown her hat into the race, but didn't respond to our request for interview. besides those who officially announced they are running, there is suspicion that kim, herrera and acting mayor brie could also file paperwork. they have until january 9 to do so. that special election will be on june 5. whoever wins that will be the city's mayor until january of 2020. as for brie, she says right now she would like to focus on her task at hand of running the city as the acting mayor. from there, she may throw her hat in, but it's still too soon so say. in san francisco, i'm paul chambers. ktvu fox 2 news. coming up, a bus full of cruise ship passengers crashes in mexico killing a dozen people. up next, details from authorities. changes coming to the bay area's biggest city. a famous building in downtown san francisco -- san jose, excuse me, is sold. >> this is not for us to really make this -- this is for us to really make this jewel shine. at least 12 people are ced following a bus accident in mexico. the bus was filled with passengers from a royal caribbean cruise ship headed towards mayan ruins when it flipped over. 12 people died in the crash including one child. their nationality has not been released and at least 18 people were injured including seven americans and two people from sweden. royal caribbean released a statement saying the passengers from two of its ships. the cause of that crash is still under investigation. stocks dip slightly on wall street today. the dow lost 37. the nasdaq was down 30 and the s&p was down eight. traders appeared to take profits an record closes for all three indexes yesterday amid expectations that the republican tax proposal would pass. santa went on strike today. a number of wal-mart workers dressed up as santa to demand holiday pay. wal-mart eliminated extra pay on holidays last year replacing it with a policy where workers accrue paid time off based on the hours they've worked. the strike was really more of a protest. similar protests were set for wal-mart locations in 11 states across the country. now to the south bay where san jose's most iconic downtown office tower has been sold for nearly $34 million with plans to restore it. two investors reportedly bought the bank of italy building along with an adjacent parking lot and a building that contains a nightclub. the tower was built 90 years ago and was the one-time site of a bank of italy branch. the bank was founded by gianini and was a forerunner of bank of america. >> it's a long awaited opportunity for an acoppic building -- iconic building in the heart of our downtown due to get a face lift. it has not been well-preserved over the decades and this is an opportunity for us to make this jewel shine. >> san jose mayor says he's thrilled to see the building purchased because it's one of the city's last remaining historic assets and he says the historic jewel of the downtown. loves the customers. they seem to will have her back. >> her incredible sense of style and grace and she was always so welcoming with the biggest smile on her face every time. >> lum began her career in 1960 at trader vic's in san francisco and stayed on when the restaurant moved to the east bay. she's a people person. >> no, i've never been shy. >> lum has seated her share of celebrities perhaps to the tune of a 10th of an inch, maybe quarter of an inch in the north bay area. there's the current radar. you can see it's spinning there. you can see a little activity north of here. this system you don't see it dumping up here. you don't see it unloading up here. you know your system is not really that strong, so the strongest dynamics are further north and a that's where that heavy rain should be falling and it's not. it's just rain. by the time it gets here, it will be light rain to the tune of maybe a 10th of an inch, maybe quarter of an inch. these are current temperatures outside. it will be mild because of the cloud cover. oakland tonight cloudy. it will be wet too. after midnight tonight, roads are wet. roads will be slippery. tomorrow morning's commute, the early morning commute, you might have rain from the sky. that's 4:00, 5:00, 6:00 a.m. commute. after that, roads will be wet for the commute and you can see partly sunny in the afternoon as it clears out really quickly in san francisco. by late day in san francisco, it's not warm. it's just upper 50s. here comes the system about midnight, kind of slides through and just -- i'm going to back that up a bit. this is kind of cool. sorry about that. here it goes. we go this area up here, look at the dynamics up in the watershed around lake tahoe. that's pretty significant. that's a good sign. strongest dynamics are going to be not north. you have lake orville and lake shasta will get some rain. based on this model rendition, lake tahoe may get snow maybe to the tune of four, five, six inches. let's hope for that and rapid clearing. by wednesday, 5:00 a.m. sun is out. mostly sunny. does not get warm. temperatures just in the upper 50s and then right through wednesday into thursday. nice weather.
