in oakland.>> reporter: brooklyn basin broke ground this year. a huge waterfront development. housing and marina and retail. what happened tonight and old peer got ahead of demolition. from sky fox the mess of a collapsed peer which crumbled into the oakland estuary at dusk and said more than 100 feet of shoreline with it.>> it doesn't appear to be an environmental concern. the incident has stabilized.>> reporter: oakland fire responded. then turning attention to the pollution hazard. for metal shipping containers each 53 feet long tumbled into the water.>> they were big containers. they only contained building materials. items such as that. they will take on water in sink and stick into the mud. no concern of them floating into the waterway at this time. this part of the peer was scheduled to be demolished. we are working down that way over the next 12 months.>> reporter: the peer failure is in phase 2 of the five phase construction project. that will bring more than 3000 housing units and 32 acres of parks and trails south of jack london square. it is a 1 1/2 billion dollar project.>> we are working with old peers in the old materials you do have to take it in stride.>> reporter: some will be restored and others are slated to be torn down. they thought the peer and the ground around it was stable enough for their tools.>> we will analyze that and try to set things for the back. we have been storing dirt near the area. they were built to store heavy loads.>> reporter: 500 feet of absorbent containment -- is anchored on the water to trap any debris and contaminants. by 2019 the area will be open space. within san francisco's marina grain.>> over the next 18 months we will continue our work to open up a beautiful new part.>> reporter: the developer has to get the debris and though shipping containers out of the estuary. the fire department says that will be quite a project. they cannot approach it from land. they will have to come in with the bolds and most likely a crying.>> a huge project. a huge development. that they say will it have any impact on the building or delayed their plans?>> reporter: it doesn't sound like it. this is a multi-year project. the first building about 200 housing units is slated to open next year. with a park. there are four more phases after that. this is probably a small blip in a long timeline. a group in oakland the -- is desperately searching for their trailer tonight. it is a kitchen on wheels they say was stolen this morning. hip-hop hunger sister 20 foot trailer is worth $100,000. to use it to cook and serve food to homeless people. members of the group say the trailer was stolen this morning from a locked parking lot at love center ministries international boulevard.>> the people are going to be hurt the most. all of the things we have planned for the up-and-coming holiday season will have to be canceled. there is no way for us to prepare the food.>> the trailer cannot be driven on its own and has to be hooked up to a truck in order to move it. the concert the police when they discovered -- they contacted the police but have not heard anything back. the fate of the mexico next.>> reporter: i spoke with former assistant da here at san francisco. he tells me how quickly the defendant will be deported. it depends on the sentence -- for the one conviction. possession of a firearm by a felon.>> reporter: jose ines garcia zarate in the county jail at the hall of justice waiting for a sentencing date that will likely be said in two weeks. he faces a sentence of 16 months -- two years or three years.>> i'm quite confident he won't go free this time. federal agents will be at the door of the jail when he will be released. and taken into custody.>> reporter: outside the hall people upset with the jury's verdict to acquit him. in the kate steinle case. they clash with a group of people protesting police brutality.>> we don't know why he just got off. >> 12 strangers got together and spent days looking at the evidence and agreed on what it was. we should respect that.>> reporter: former services go assistant da and the head of the da homicide unit. he expects the 54-year-old to be moved from local custody to federal custody in months if not weeks. the u.s. department of justice is now issuing an arrest warrant for him of for violation of his supervised release. on fox and friends a spokeswoman for the agency said the doj is also looking at federal charges. such as felony reentry.>> it is important to reassure everyone we will prosecute this to the fullest extent available. he never should've been on that peer. kate steinle was still be alive.>> it is political posturing now. they can't charge him with murder.>> reporter: former san francisco police chief says he and others in law enforcement are frustrated with the verdict.>> symptomatic of an attitude of accountability. and political correctness interfering with accountability for people doing bad things.>> was it a murder homicide or manslaughter? 12 strangers got together and said no.>> reporter: the probation department will recommend to the judge was sentence he should receive. for being a felon in possession of a gun. it is entirely up to the judge. he anticipates the judge will hand down the maximum sentence of three years since the defendant did kill kate steinle. >> that they seem to think whether or not the jury -- members of the jury will come forward and explain why they came to this decision?>> reporter: he would love to talk to the jury. yesterday when we try to talk to them they left without talking to the press. i have not heard anything from the jurors. san francisco mayor did not respond to questions about the verdict or city policy today. his office provided a short statement. san francisco is and will remain a sanctuary city. the backlash on social media in reaction to the verdict has been swift and harsh. leaders and many residents doubt it will have a lasting impact. boycott san francisco has been trending on twitter since the verdict was announced yesterday. a former state senator and current candidate for mayor says he doesn't think the outrage will translate into any real loss for the city.>> they have their agenda. they will stick to it. san francisco and we are not alone. we are a sanctuary state. there are hundreds of sanctuary cities across this country. for a good reason. they keep our communities safer.>> as the debate rages on social media many people are pointing out to boycott san francisco would mean you might have to give up google facebook apple youtube netflix and even twitter. all of those companies are here in the bay area. police shot and killed a man after he allegedly carjacked a van driven by an employee of the state lottery. the vehicle theft happened at 23rd and arkansas. for alleged accomplices in a second vehicle were arrested later. at angles and gillman in the bayview. the suspect in the lottery van was killed by police a few blocks away. henry lee has more.>> reporter: a blown out window of a san francisco police car at the scene of a deadly officer involved shooting in the bayview district. pieces of glass on the ground as investigators scoured the area for evidence. the shooting happened at the corner of fitzgerald and griffith. at the public housing complex. the suspect was blocked by a fence.>> the vehicle stopped. the suspect exited the vehicle. an officer involved shooting occurred. the suspect was transported by evidence to the general hospital where he was pronounced deceased.>> reporter: one officer opened fire during the confrontation. police have not said what led to the shooting by officers. the incident began earlier when the suspect accosted a woman who works for the california lottery. she was exchanging scratch off tickets at this market.>> a white van belonging to the california state lottery was stolen. but mac the woman was unheard. the suspect took off in the stolen van it wouldn't said it was accompanied by other suspects in a suv. please spotted the suv and gave chase. they stop it near angles and gillman and obtained for man. -- for men. >> those subjects in the van were detained and are part of the ongoing investigation.>> reporter: we asked one of them if he knew why police has stopped him. the officer involved shooting 42-year-old o'neill. he spoke with a man outside the hall of justice who said he has known him since he was a little boy. he wasn't armed. he had no business being shot. he was a good kid.>> the man us with more.>> reporter: after 1 am in washington dc. they are still at it. we are expecting the votes anytime now. at the beginning of the week six republican senators were on the fence. last minute dealmaking has convinced all republicans except for one hold out to support the bill.>> reporter: under intense pressure to pass a tax cut bill before the end of the year senate republicans made a flurry of changes. keeping the alternative minimum tax to provide more revenue to offset the projected deficit. allowing property tax deductions up to $10,000 which matches the house bill. keeping the medical expense deduction for the next two years. one hold out bob corker said he would not support a bill that would add an estimated $1 trillion to the national debt.>> and probably a dinosaur. but mac democrats were united and opposing the bill.>> reporter: republicans are already preparing to move to the next step with reconciliation talks between the senate and house.>> we were supposed to come in next week. we will come back in on monday. we believe the senate will get this done.>> reporter: both the house and senate bill versions cut the corporate tax rate to 20%. bringing the u.s. in line with many countries.>> the u.s. is behind many corporate tax rates. have come into the low 20s. the uk is below 20%.>> reporter: the senate bill keeps corporate tax cuts permanent. it allows individual tax cuts to expire. that could hurt middle and low income families down the road.>> those expirations go through estimates by the joint committee on taxation suggests families with income under $75,000 will be worse off. they will likely lose social programs or other benefits. her face higher taxes in the future.>> reporter: a deeper deficit won't have an immediate impact but there will need to be a day of reckoning.>> we are inching up to the highest amount of debt relative to the size of the economy we have had.>> reporter: democrats launch in opposition to one provision that would allow drilling in the arctic national wildlife refuge. we will monitor the situation. they are still debating this. we will bring information and we get it.>> what does that have to do with the deputies say a woman called 911 on wednesday saying she could hear someone trying to get into her home. when they arrived they saw two of the suspects running away from the house and arrested them later. one was located and arrested. when they found him they also found the guns and evidence of other thefts. san jose police arrested a suspect in the stabbing death of a 21-year- old man. they arrested fabian rodriguez in gilroy in connection with the killing of lucas gutierrez october 18. another suspect evan farkas was arrested nine days after the stabbing. they are both facing murder charges. they have not disclosed a motive. and fremont police were asking for the public's help tracking down a carjacking suspect. surveillance pictures show the man they are looking for accused of
