blocked by a metal fence. >> the vehicle stopped at griffith and fitzgerald street. the suspect exited the vehicle and the shooting occurred. the suspect was transported by ambulance to san francisco general hospital where he was pronounced deceased. >> at least one officer opened fire. police have not said what led up to the deadly shooting by officers. the incident began earlier in the morning when the suspect accosted a woman who works at the california lottery. she was exchanging scratch off lottery tickets at this market. >> a white man belonging to the california state lottery was stolen in this carjacking. >> the woman was shaken but unhurt. the suspect took off in the stolen van and witnesses say it was a company by several other suspects in an suv. >> reporter: police spotted the suv and gave chase. >> one group of officers stopped the gold suv and the subjects in the van were detained. >> reporter: we asked one of the men who was detained if you police have stopped him.>> no. >> reporter: san francisco police and homicide are investigating this deadly officer involved shooting as well as the da's office. the department plans to have a town hall meeting on this incident within the next 10 days. we have continuing coverage on this developing story. we are posting updates on all of our newscasts and on facebook, twitter and www.ktvu.com. right now, we are following breaking news. there has been a pier collapse on the oakland estuary. 200 feet of the pier dropped into the water and we are told four shipping containers fell into the estuary but there is no sign of any hazardous materials leaking into the water. from sky fox, you can see a huge pile of construction debris including dirt and concrete near the edge of the collapsed pier. brooklynn basin is a 64 acre parcel of land where a major construction project is underway . when it is done, it will include shops, open space and 3000 apartments. it is right on the estuary, right next to 880. it is just a few blocks south of jack when the square. our crews just arrived on scene. we will keep you updated. senate republicans appear to be on the verge of passing a massive $1.4 trillion tax bill. the vote is supposed to happen sometime this evening. the timing is not clear. some democratic senators have been posting photos of the nearly 500 page bill with handwritten changes in the margin suggesting the legislation has not been finalized. only one republican, bob corker tennessee, says he is opposed which still gives the gop enough votes to pass. >> with the regulatory changes that have been made and with this tax policy, all we have to get is .4% growth to cover $1.5 trillion.>> republicans say the measure will benefit people across economic spectrum. democrats say it is geared toward big corporations and the wealthy. it is projected to add $1 trillion to the budget deficit over 10 years. major developments in the russia investigation as michael flynn pleaded guilty to lying to the fbi. >> flynn also agree to cooperate with special counsel robert mueller. carolyn shively joins us live from capitol hill.>> reporter: this is all part of a plea deal for michael flynn in exchange for his full cooperation with the russian deal. michael flynn entering district court today in washington, prepared to plead guilty to a felony, lying to banco -- to the fbi. he agrees to cooperate with the russian investigation led by special counsel robert mueller. flynn released a statement reading in part "i recognize that the actions acknowledged in court today were wrong and through my faith in god i am working to set things right." flynn served in the trump administration for just 24 days . he resigned after allegations he misled vice president mike pence about conversations with russia's former ambassador to the u.s. today in court, flynn said he reached out to the ambassador among other officials at the request of a senior member of the trump transition team. that has the white house now distancing itself from flynn. white house lawyer ty cobb said "nothing about the guilty plea or the charge implicates anyone other than mr. flynn. " some lawmakers say not so fast. >> it is part of a broader pattern of people in the administration and people in the campaign. >> reporter: others are waiting for what is next. >> this is the way the process works. no one is above the law.>> reporter: flynn lied because he knew he had violated the logan act. the logan act says private citizens cannot negotiate with foreign government. they had not gotten into power yet. the election was over but it was not january 20. they were not in the white house yet. did anyone else on the transition team tell flynn to make this phone call? fingers are pointing at jared kushner. we don't know if he specifically said make this phone call and talk to russia and give him specific instructions. >> thank you. stocks took a dive it on news of flynn's guilty plea. the dow jones was down three and 50 points at one point but the markets mostly recovered after senate republicans announced that they have the votes to pass the tax bill. at the end of the day, the tao was off 40 -- the dow jones was off 40 points. now we have ktvu critical analyst brian sandoval. flynn has pleaded guilty to lying to that fbi. -- to the fbi. >> we don't know. people in washington dc, when you speak with them who are a little closer to this don't know why. you don't know whether this is flynn taking care of himself and his family, he may have been acting as an agent for turkey. we don't know the extent of it. or, whether this stretches into the white house up to and maybe including the president of the united states.>> what would be a worse case scenario for president donald trump? >> if president donald trump had ordered anything illegal that he asked the general to go and do with the russians, that'll be a problem. not sure that is likely. what you may find out is that people are going to be talked to in the white house like jared kushner and donald trump junior. >> so far, though, nope in teachable -- no impeachable offenses. how is this playing out in russia? >> i think the russians are getting a kick out of it. this is exactly what they intended to do. they wanted to penetrate the democratic party, the republican party. they did it by facebook, twitter, by every means possible. they have accomplished their goal. that is the problem. i hope the rest of the world looks at the united states and says democracy reigns. today, you can bring down a president for illegality if that is where this all goes. >> do you think the senate will test -- will pass the tax bill?>> before i thought not. now i think they have the votes so the answer is yes. new information in the case of hosea and as the sierra acquitted of the most serious charges in the death of kate steinle in san francisco. the department of justice has issued an arrest warrant for him. they say he is in violation of supervised release due to his conviction yesterday for being a felon in possession of a firearm. garcia is set to return to court december 14 two said they sentencing day. once he is eligible to be released, the san francisco sheriff's office says it will notify u.s. marshals. many people were surprised when the jury in san francisco yesterday afternoon found garcia zarate not guilty of murder and guilty of involuntary manslaughter. president donald trump wrote on twitter that the kate steinle killer came back and back over the weekly francisco is not a safe place. more reaction now from ktvu's tara moriarty . >> reporter: outside the hall of justice, two small groups of protesters clashed. one side believes the case against jose inez garcia zarate never should have been prosecuted as murder. the other says a not guilty verdict means no justice for kate steinle. >> the prosecutors did not do their job. they failed to put on a good case. maybe this will make the country up and make them think about what they are doing. this is becoming too liberal. >> reporter: tony rivera's says he and others in law enforcement were disappointed and frustrated by the verdict. >> it is symptomatic of an attitude of accountability and political correctness interfering with accountability for people doing bad things. >> san francisco public defender jeff ketanji says the prosecutor overcharged his client and the jury knew it. >> it was sort of a throw the book mentality. what was unusual in this case was that they argued in the opening statement for a second degree and then came back later and said we are going to charge this is a first degree. >> legal analysts have attacked the district attorney saying the office's lack of a murder conviction has made him a laughingstock of the united states. >> our conviction rate is one of the highest in the state and it has been for the last six years. i am talking about trial convictions, not settlements. if we go to trial, we win almost 90% of the time. >> reporter: we ask gastown if his office could have a do over if they would do anything differently, they said no. one question that has arisen is over the judge's decision to not allowed to remember is to physically hold the gun and pull the trigger. this entire case really hinged upon whether the gun preparations are underway for a community memorial at the warehouse in the fertile district. we have live coverage now from ktvu's christina run down . emotions are still very raw. >> reporter: visiting this site is still very emotional for so many people. today we saw a handful of people stopped by, take pictures, pay their respects including one woman who visited this memorial behind us privately and we later learned that her brother had died in the fire. she was touched to see that one of the candles next to her brother's name was the only one burning. it is not just family members and friends that are grieving but community members too. >> there is not a day that i don't think about what happened at ghost ship. >> reporter: the motion, pain and sadness is still raw for father jason mendoza. the chaplain with the oakland fire department spent the week of the tragedy comforting family members, friends and first responders. >> a lot of us who were involved in the first response aspect of it continue to think about what transpired that night and continue to be deeply affected by what happened in those days. >> reporter: he plans to return to the site saturday night around the exact time the fire broke out to quietly reflect. in a sign of respect, the city of oakland is preparing to honor the 36 victims. >> we are trying to be respectable and make sure the environment is a positive one. >> reporter: a crew is raking leaves one day before family and friends will gather at the memorial site, a place where people continue to pay their respects. >> i have never seen so many people lose their life in one place. >> reporter: while inspectors are being more assertive, more work needs to be done. >> the demand is so great right now from the warehouses to the apartments to the residential for inspections that we are behind, we need to be more aggressive. >> we care. we won't forget. we don't want this to happen again. >> one year later, the city has hired a new fire chief. they have also added more inspectors to their staff and they have identify nearly 2 dozen properties suspected of being unpermitted residences that they are working with to bring back up to code. tomorrow's anniversary memorial will honor those 36 victims. it starts at 36 victims. it starts at 10:30 am and goes all the way until 9 pm. tune in this weekend for a 2 pm on ktvu plus. police in fremont are asking for the public's help in tracking down a carjacking suspect. surveillance pictures show the man they are looking for. he is accused of stealing a work truck from a landscaper wednesday afternoon. police say the man approached the landscaper as he was getting ready to mow a lawn and asked for a drink of water. the landscaper gave the man a bottle of water. when the landscaper turned his back, the man jumped into the truck. the two men struggle briefly for the suspect drove off in the truck. police are looking for the truck , a 1991 toyota tacoma. the suspect is described by police as being 28 years old. he was last seen wearing a checkered shirt and brown pants. on the driscoll students are suffering from a stomach bug outbreak. units will district officials say a number of the fifth grade students from altavista elementary school in los gatos were out sick yesterday. at the school today, officials were seen sanitizing classroom supplies. the district is working now with the santa clara health department to stop about from spreading. students should stay home for 48 hours after they stop having symptoms. we are checking on
